ukraine. where by both u.s. and ukrainian assessments, russia is coming up on arm slaughts in the eastern region. russia has 65 troop units in those regions. it's staging attack helicopters at ukraine cracy border and bringing more soldiers -- ukraine's border and bringing more soldiers and artillery as it quote posturing for offensive operations. and local leaders say thousands of civilians have been able to flee the area in recent weeks, a welcome sight, as ukraine continues to measure the civilian toll of the war. russia has also been accused of committing atrocities nationwide. the mayor of mariupol now estimates 5,000 civilians have been killed since the starts of the invasion. and new reports of deaths, russia could be on the brink of capturing that city. and the u.s. has yet to make that assessment. russia's defense ministry is vowing to ramp up missile strikes on kyiv after withdrawing its forces following a string of battlefield losses. all of this, comes as president biden authorizes an additional $800 million in aid for ukraine, bringing the united states total to $3.2 billion. that seemingly roiled moscow warning the shipments are adding fuel to the conflict and could bring a quote unpredictable consequences. joining me now is historian and russian propaganda translator ian garner and also with us retired u.s. army colonel jack jacobs who is an msnbc military analyst. and colonel, the white house has responded to the formal complaint by russia, writing this shows the effectiveness of our weapons delivery and security assistance to ukraine because russia is getting upset. our assistance is making a difference. and that white house official added, if the administration takes russia's note seriously but not necessarily as threatening. do we risk, provoking vladimir putin by continuing to aid ukrainian military? >> it doesn't take much to provoke putin in any case, don't forget he started a war, invaded in '14 and '08 and so on and bellicose for the last years he has been in business, so nothing that we do or say is going to provoke him anymore than he has already provoked himself in attacking civilians and bombarding cities and so on. he is single-minded in the achievement of his tactical and strategic objectives and that includes securing donbas, and securing the ukrainian southern coast on the black sea. so that russia can control the black sea. and nothing we do or say is going to change him from doing that except arming the ukrainians and making sure that they resist russian advances. >> colonel, one follow-up question about the weapons that were' providing. one of the things i was wondering earlier, is to your point, it doesn't take a lot to provoke vladimir putin. but are there concerns from the west and from the american side that some of those shipments, and the process of shipping those weapons will be disrupted and that that attack could escalate this conflict further? >> well, we're concerned all the time about interrupting the flow of material to the ukrainian, we've been concerned about that since the beginning of the war, when we were concerned that the russians would chop the country in half and prevent shipments from east to west but the ukrainians take control of those weapons, outside of ukrainian territory, and then move them to where they need them in the east. and that's when they're the most vulnerable. there was some concern that russia may attack our stockpiles of those weapons, before the handoff in nato territory. that's not likely to happen but they surely will try to interdict the throw -- the flow of those weapons from east to west into ukraine. >> and we were alerted to the devastation last week that was uncovered in bucha and the reporting out of mariupol. help us understand the devastation russia is leaving behind as they concentrate their efforts now in the eastern part of ukraine. >> so i mean the pictures you're seeing on screen already do some of the, some of the devastation is being brought on cities in ukraine, this is a tactic that russia has used in syria a few years ago, in chechnya, two decades ago when putin came to power, it seems to be a limit to the readiness to use destruction against infrastructure, and buildings, but also, against civilians and citizens, and russia's propaganda networks are telling russians that it's in fact ukraine that's carrying out these atrocities, and not russia, and using that to justify yet more violence and yet more aggression against ukrainians. >> so ian, how does that begin to work? is that a persuasive argument for the every day russian, that ukraine is blowing up their country like this? >> i mean to an extent, yeah, you've got to bear in mind the russians are living in a very closed information sphere. information from outside is accessible but only if you are a canny social media user who is able to skirt the new bans that the government has introduced on things like instagram, and facebook. but if you watch the state media, then for the last ten years, you've been told that the world is aligned against you, nato and america is leading a conspiracy, that ukraine is led by nazis, and they really do emphasize these are neo nazis, these are genuine nazi, kind of leftovers from the 1940s, almost. and when you're in that world, and it's the only thing you see, then you can start to believe it, even if you're a rational and a right-minded person. >> it is an important point and it's helpful to understand that, because i think as americans, i mean we have our own issues with propaganda, ian, here, but i think as americans, we're seeing these images and how can anybody in russia believe that ukraine is blowing up buildings in their own country. so it's important to understand that. colonel finland, and sweden, they are both weighing nato memberships, one finish cabinet member adding it is very likely that this may happen. russia's warning of big consequences if that should happen. what do you think about this? are they worried about a republican candidate false claims getting exposed in front of millions of american viewers and voters? and speaking of protecting our democracy, congressman jamie raskin says the public will be surprised by some of the new information uncovered by the house committee investigating the january 6th insurrection. >> that's what citizens in the world's greatest multi-racial, multi-religious, multi-cultural, constitutional democracy need to know, what are the weaknesses that these reactionary alt-right neo fascist forces conspired to take advantage of, because they did. and they will be, i think, both agonizing and riveting for the country to see, how close we came to losing it all. and certainly as close to fascism as i ever want to come in my life. >> joining us now, lynn kirchner, former federal prosecutor and adviser to the democratic national committee. glen, i'll start with you on the january 6th verse. the committee interviewed stephen miller former white house adviser for eight hours yesterday and repeatedly pressed him on trump's use of the word "we" in the rally before the insurrection. >> help us understand the significance of that line of questioning. lay it all out. >> so the significance in part, stephen miller apparently participated in drafting the speech that the president gave at the pre-insurrection pep rally, a speech that was designed to gin up and enrage his supporters, his foot soldiers and then he directed them at the capitol and said now go. go fight like hell, or you won't have any country anymore, stop the steal, because your vote has been stolen from you. so i think the devil's in the details and maybe the devil helped prepare the speech and they wanted to talk to stephen mill ber it, because it seems to me that there is pretty strong evidence, culpability for insighting the insurrection based on the words donald trump spoke and they want to find out how many of those words were fed to him by stephen miller and we had a development yesterday, where one of the insurrectionists, a guy named dustin thompson was convicted on all counts by a dc jury, after he laid out the argument to the jury that, listen, i was just following presidential orders, i did what donald trump told me to do, i believed that. the problem for him, it it's not a defense. right? but it is incriminating evidence against donald trump and perhaps based on yesterday's testimony before the january 6th committee, it may be incriminating evidence against stephen miller as well. >> that's an interesting point, glen. thank you for that analysis. and curt, we mentioned the presidential the debates and the fact that it is not a law, it is a norm, an historic norm, but they also give us candidates, these presidential debates we like to, have folks like trump and other, big huge platforms, with millions of viewers, for lying and gaslighting american voters. is it good or bad if presidential debates as we know them end? >> well, i think it's bad. i think any time that you can have the two people who are vying to have the most powerful position in the world be asked objective questions, be challenged on their answers, and have a worldwide audience of millions of people, watching them to help evaluate how they're going to vote in the election, i think that's an important part of our election process and part of our democratic norms an watching the republicans withdraw from that is just another chunk in the armor of our democracy. they don't want to go outside of the fox news bubble. they don't want to be challenged with facts and truth. they know that their entire party now is built on lies and treason, and the last thing they want to do is be challenged on that because will is no answer for that, when confronted with the facts, they will fold like a house of card, and so they know now, that there's nothing they can do, but just stick to that right wing media script, the propaganda machines and really what they're trying to do, zerlina, is build two different country, one country that has democratic norms and another country that abides by completely different set of rules, and what's to stop them at some point from saying you know what, we only want votes counted by the election clerks that we like, by the election clerks that the republican party certify, and that's where they're trying to take this whole thing. >> that is not democracy. glen, one of the things that has become very clear today, as we sit here, and that was not true last week, there's a grand jury, looking into the january 6th insurrection, ella alexander has told reporters that he received a subpoena from a grand jury, and you mentioned the fact that there are these other cases that have been going through the court system with the sort of ground level folks who stormed the capitol physically, ella alexander represents the group of folks who were planning, help us understand the significance and how much of a shift that is, in terms of the seriousness and perhaps the walls closing in, if you will, on some of the trump folks who thought they might have gotten away with this up to this point? >> yeah, the recent reporting is pretty important, zerlina, because we've learned that there is a grand jury sitting, investigating not only the foot soldiers of the insurrection, the people who actually breached the capitol at donald trump's direction, but we've seen reporting that the criminal probe by the department of justice has expanded into the fake electors, and the trump lackeys who were offering the fake elector narrative who were trying to push for the overturn of the election. so it becomes really important to know that there have apparently been grand jury subpoenas that have been issued, and the grand jury has been quietly doing its work, without us knowing anything about it. the "washington post" report actually reported for the past two months, there were former officials in donald trump's orbit who had been receiving grand jury subpoenas. and we knew nothing about those. so that's encouraging, because it tells us that not only has the d.o.j. been doing the work behind the scenes, with the grand jury, which is a criminal investigation, but it's been doing it without the kind of leaks we would expect to see. so we're being kept in the dark. but that doesn't mean that the department of justice is not doing its work. and of course, we know stephen miller was the point person for donald trump, on the fake electors. he was running around bragging about how they were going to send alternate electors. let's call them what they are, fraudulent electors. and that makes stephen miller one of the spokes in what is a hub and spoke conspiracy. we've seen a clearer picture emerging of the nature of this criminal conspiracy every day. so i believe d.o.j. really is digging in. >> well, we will wait and see what they discover. and also, we're looking forward to those hearings from the january 6th committee. glen kirchner, and curt, thanks as always for being here. please stay safe. coming up, have things gotten better or worse for black americans over the past year? >> i think our social and economic traditions are frozen in a sort of suspended animation, zerlina. meaning the comparative position of blacks versus whites, when it comes to jobs, and housing, and life expectancy, and health care, remains a wide gap, a gap that hasn't changed for multiple decades. now, you always have to qualify it, because of the black people serving as a bit of a caboose on the american train. meaning when the train speeds, the condition and position of black people may improve, for example, a high school graduation rate for black people is higher today than it was 30 years ago, but it's also higher for white americans. the gap hasn't narrowed as much. for things like joblessness, and home ownership, and some things have widened, home ownership being one of them. so all in all, in this report, we mean to say to people that this work to close these racial gaps is still necessary, and that america has to reckon with the fact that these gaps have not materially changed. we also in this report focus on democracy and voting rights. so the report paints a picture based on fact, not based on opinion, and we just report what the numbers say, and that's what this report says. >> one of the things that the report highlights, is that this really isn't a matter of individual decision making, or individual choices, it instead focuses on just how hard it is for people of color to overcome systemic racism. speak to that point. i mean what are some of the key issues that require systemic change? >> well, home ownership is one. why are the denial rates systematically lower, the mortgage denial rates higher, than for white americans, even if you look at similar incomes. why, when you look at an african american and white person, who may graduate from the very same college, in the very same year, with the very same grade point average, do you find 20 years later a wealth gap, and in many instances, an income gap. this is the frustration of progress, the frustration of trying to get ahead. there are always going to be people we can point to who shatter glass ceilings, overcome the great difficulties but we're talking about here, what we're talking about here is broader issues and that is the overall community. so this is a call to action, to continue to do the work that is necessary in the face of a backlash against voting rights and democracy in this country. and the report emphasizes that as the most paramount issue not only facing the nation, but facing black americans. there is absolutely an assault, a campaign, an effort from the far right, and bad actors to undermine and destroy democracy. >> and one of the other things that i think is important to note, i mean the attacks on democracy, culminated i think at the insurrection, on january 6th, but also, you know, january 6th followed a summer of racial justice protests. and i don't think those two things are as separate as we think they are. i think that the backlash you're speaking of, in that multi-racial progress, is some of what we saw at the insurrection. your report found black people are more than twice as likely to experience these encounters and i want to play you some sound, with patrick lyoya, who was killed in grand raps michigan and talk to the attorney ben crump and talk to you on the other side. >> america, rooted around the world, are making sure that we condemn russian soldiers who are shooting civilians in the back of their head, in the ukraine, and where we want them to also condemn police officers shooting unarmed black civilians in the back of the head here in america. >> well, that's incredibly blunt, but i think that as we talk about, and talk about at the top of the show protecting democracy in ukraine, we have to talk about protecting democracy here in the united states. and that includes democracy with black people a part of that. i mean do you think the administration recognizes the connection here, because, you know, black people deserve freedom and liberty and democracy, just like the folks over in ukraine. >> you know, zerlina, if you go back and look at it, i'd invite you and the listeners and viewers to do this, look at my speech at clark university on tuesday, when we released the state of black america report, i said as much as the same thing as ben crump said. it is inconsistent to on one hand condemn putin and russia, for their invasion and aggression in ukraine, and on the other hand, be silent or turn your back or hide behind the filibuster when it comes to protecting democracy here at home. and we have to call out the inconsistency. and i encourage the administration and the president to strengthen the narrative that the fight against russia and ukraine is not an isolated battle. it's part of a broader, if you will, effort, by right wing bad actors, here in the united states, and vladimir putin, to destroy what we know as democracy. representative democracy, with universal suffrage. >> marc morial thanks for being here today. please stay safe. coming up, this week is black maternal health week and despite continuing to develop new technologies black mothers are not safe in america. and i'll explain why next. a. and i'll explain why next. can tell you how a young homeowner is turning into their parents. -not those two. -yep, they're gone. -forever? apartments-dot-com. the most popular place to find a place. states, and vladimir putin, to new technologies black mothers states, and vladimir putin, to new technologies black mothers we talk on this show about racial health disparities and one of the most glaring and heart breaking examples is maternal mortality. the u.s. already has the highest rate of any developed nation of people dying from complications of pregnancy and childbirth. but it is worse for people, especially black americans, whose maternal mortality rate is three times higher than that of white americans. three times. and it is actually getting worse, not better from 2018 through 2020, the first year of the pandemic, maternal mortality rose for all group, but for black people, it shot up by 25 whole percent. the biden administration has named maternal health a top priority, and this week, which is black maternal health week, vice president kamala harris, who convened a cabinet meeting on this specific issue where she said this. >> this is an issue that is not just about health care, it is about treating a woman as a whole human being. understanding that if we are to expect and actually influence positive outcomes on this issue, we must see her then as a whole human being. which is why we have gathered the leaders that are here today so that we can address issues such as the issue of housing. we can address issues such as transportation. such as nutrition. which all have an impact on not only the experience that she will have, and therefore, her family will have, but also, generational impact. >> joining us, journalist and activist and host of the podcast, also the author of the how racism in health care kill women and also with us dr. erica marsh, professor of obstetrics and gynecology at the university of michigan medical school. i want to start with a question related to black maternal health which is the right to reproductive freedom and this week oklahoma, texas, well, prior to this week, but kentucky and oklahoma this week, passed bans, near total bans on abortion care. we're all waiting, with baited breath, and anxiety, for the supreme court to rule on the mississippi case, and i mean black people and other people of color are the most hurt by these kinds of restrictive abortion bans, and at the same time, black women are most likely to die from having a baby. what does this say about the value given to black women's lives, when access is caught up in this way that affects not only those who want to seek out abortion but also women who want to have people, who want to have a healthy baby? >> well, it points out that we don't really have control over our bodies and as we're seeing state by state, increased restrictions on abortion, it is just really a larger assault on women's reproductive health and rights and women's overall health, because as we know, abortion is health care. and you pointed out that black women in america are three times more likely to die giving birth in america than their white counterparts and zerlina, we cannot ever get used to that statistic. that statistic is 243%, more likely to die, giving birth in america, than their white counterparts. and pre-pandemic, you know, there were some really racist explanations for this. that, you know, black women are less educated, or their welfare, but now we know studies show that a college educated black woman is still five times more likely to die giving birth than their white counterparts. so we know, i mean the pandemic is really just exposed how its racism and not race, that is driving these disparities. >> it's such an important point, i think about serena williams when you say that, right, serena williams, almost died giving birth to her child, and it was because of the inbleed, she was as much in pain and distress as she said, and that is a common experience. doctor, why are black people primed more likely to die? why is this data point and why does this kind of appear to be getting worse instead of better? >> i think that's a critically important and complex question. but fundamentally, to the point that was just made, you know, the point that our vice president harris made in terms of the contributors of the social determinants and the structural determinants of health certainly contribute but also the fact that we are experiencing a significant, we continue to experience a significant amount of racism in the united states, and that racism absolutely contributes in a very negative way to our health status, and and i think pregnancy is a magnifier of racism, and the same way that covid-19 is a magnifier of racism. >> and what are some of the specific issues related to pregnancy that black women deal with disproportionately. i'm thinking about fibroids or i think it's preeclampsia. >> help us understand some of these. >> absolutely. i think preeclampsia is a condition that involves high blood pressure and changes in blood flow to the uterus and to the pregnancy is a significant contributor. blood clots are a significant contributor that develop, that all women are at an increased risk for, during pregnancy, but i think the challenge is when you report the symptoms, are you asked about the symptoms, when you do report symptoms, are you taken seriously, are you believed? are you followed up? how are you treated? and who in the health system, who is the health system really created for? and that's where racism comes into play. it's not about a biological difference, inasmuch as it is does my caretaker provide, listen to me, do they value my life as much as other patients, do they value my voice as much as other patients. as you mentioned zerlina, uterine fibroids is another area where there is significant disparity in pregnancy and outside of pregnancy and a huge percentage of a woman's life where she may not be pregnant but the fibroids can persist, they are benign tumors that grow in the wall of the uterus and the leading cause of hysterectomy in the united states, and more than endometrial cancer and uterine cancer and we know black women are significantly higher risk of developing fibe roids and they have disproportionate experiences to determine how they're treated for their fibe roids and if they're treated for their fibroids. so one group of women may be told just have a hysterectomy for that, another group of women may be told, you know, have a, you can have other options, and that's where the racism plays in. >> thank you both so much for being here and please stay safe. coming up, what do jared kushner and i have in common? >> honest l i almost hate to say it, but i liked her as a professor. at the time, i had no idea she was this racest and i'm not even sure she had begun this downfall into kkk territory that she's clearly been on over the last several years but i found her to be a very good civil procedure professor and i actually really loved civil procedure, as a result of having her as a professor. now, i have to qualify that by saying that when you go to law school, grading is blind. so she wouldn't have known that i was a black student or a white student or an asian student. i was just a number, i was just a test in front of her that she gave a grade to and ended up giving me an "a" but as of late, these comments from her, i almost find it hard to get really upset about them because they're so comically racist, and so comically untrue that i almost feel sorry for her. like i wonder what has happened to her in the 20 years since i sat in her classroom that has led her down this truly gross and comical path of, you know, kkk vintage racism. >> so i love that you honed in on that point because i think that often when we look at examples of racism like this one, that is an easy one. that's a lay-up for anyone, no matter what color you are, what background you have. could you identify this as a racism. where does it get more tricky, though? she's a professor with ten tour and she has obviously an influence and an impact on students throughout the years, talk about the spectrum of racism and how dangerous that could be and the impact that could have on young people of color who are in her classroom. >> well, i mean, you went to law school, so you know this. being a black woman in law school is like being a fish out of water, particularly if you're an intelligent black woman and a successful black woman. i've had people underestimate me from the get-go, right? ukraine. where by both u.s. and ukrainian assessments, russia is coming up on arm slaughts in the eastern region. russia has 65 troop units in those regions. it's staging attack helicopters at ukraine cracy border and bringing more soldiers -- ukraine's border and bringing more soldiers and artillery as it quote posturing for offensive operations. and local leaders say thousands of civilians have been able to flee the area in recent weeks, a welcome sight, as ukraine continues to measure the civilian toll of the war. russia has also been accused of committing atrocities nationwide. the mayor of mariupol now estimates 5,000 civilians have been killed since the starts of the invasion. and new reports of deaths, russia could be on the brink of capturing that city. and the u.s. has yet to make that assessment. russia's defense ministry is vowing to ramp up missile strikes on kyiv after withdrawing its forces following a string of battlefield losses. all of this, comes as president biden authorizes an additional $800 million in aid for ukraine, bringing the united states total to $3.2 billion. that seemingly roiled moscow warning the shipments are adding fuel to the conflict and could bring a quote unpredictable consequences. joining me now is historian and russian propaganda translator ian garner and also with us retired u.s. army colonel jack jacobs who is an msnbc military analyst. and colonel, the white house has responded to the formal complaint by russia, writing this shows the effectiveness of our weapons delivery and security assistance to ukraine because russia is getting upset. our assistance is making a difference. and that white house official added, if the administration takes russia's note seriously but not necessarily as threatening. do we risk, provoking vladimir putin by continuing to aid ukrainian military? >> it doesn't take much to provoke putin in any case, don't forget he started a war, invaded in '14 and '08 and so on and bellicose for the last years he has been in business, so nothing that we do or say is going to provoke him anymore than he has already provoked himself in attacking civilians and bombarding cities and so on. he is single-minded in the achievement of his tactical and strategic objectives and that includes securing donbas, and securing the ukrainian southern coast on the black sea. so that russia can control the black sea. and nothing we do or say is going to change him from doing that except arming the ukrainians and making sure that they resist russian advances. >> colonel, one follow-up question about the weapons that were' providing. one of the things i was wondering earlier, is to your point, it doesn't take a lot to provoke vladimir putin. but are there concerns from the west and from the american side that some of those shipments, and the process of shipping those weapons will be disrupted and that that attack could escalate this conflict further? >> well, we're concerned all the time about interrupting the flow of material to the ukrainian, we've been concerned about that since the beginning of the war, when we were concerned that the russians would chop the country in half and prevent shipments from east to west but the ukrainians take control of those weapons, outside of ukrainian territory, and then move them to where they need them in the east. and that's when they're the most vulnerable. there was some concern that russia may attack our stockpiles of those weapons, before the handoff in nato territory. that's not likely to happen but they surely will try to interdict the throw -- the flow of those weapons from east to west into ukraine. >> and we were alerted to the devastation last week that was uncovered in bucha and the reporting out of mariupol. help us understand the devastation russia is leaving behind as they concentrate their efforts now in the eastern part of ukraine. >> so i mean the pictures you're seeing on screen already do some of the, some of the devastation is being brought on cities in ukraine, this is a tactic that russia has used in syria a few years ago, in chechnya, two decades ago when putin came to power, it seems to be a limit to the readiness to use destruction against infrastructure, and buildings, but also, against civilians and citizens, and russia's propaganda networks are telling russians that it's in fact ukraine that's carrying out these atrocities, and not russia, and using that to justify yet more violence and yet more aggression against ukrainians. >> so ian, how does that begin to work? is that a persuasive argument for the every day russian, that ukraine is blowing up their country like this? >> i mean to an extent, yeah, you've got to bear in mind the russians are living in a very closed information sphere. information from outside is accessible but only if you are a canny social media user who is able to skirt the new bans that the government has introduced on things like instagram, and facebook. but if you watch the state media, then for the last ten years, you've been told that the world is aligned against you, nato and america is leading a conspiracy, that ukraine is led by nazis, and they really do emphasize these are neo nazis, these are genuine nazi, kind of leftovers from the 1940s, almost. and when you're in that world, and it's the only thing you see, then you can start to believe it, even if you're a rational and a right-minded person. >> it is an important point and it's helpful to understand that, because i think as americans, i mean we have our own issues with propaganda, ian, here, but i think as americans, we're seeing these images and how can anybody in russia believe that ukraine is blowing up buildings in their own country. so it's important to understand that. colonel finland, and sweden, they are both weighing nato memberships, one finish cabinet member adding it is very likely that this may happen. russia's warning of big consequences if that should happen. what do you think about this? are they worried about a republican candidate false claims getting exposed in front of millions of american viewers and voters? and speaking of protecting our democracy, congressman jamie raskin says the public will be surprised by some of the new information uncovered by the house committee investigating the january 6th insurrection. >> that's what citizens in the world's greatest multi-racial, multi-religious, multi-cultural, constitutional democracy need to know, what are the weaknesses that these reactionary alt-right neo fascist forces conspired to take advantage of, because they did. and they will be, i think, both agonizing and riveting for the country to see, how close we came to losing it all. and certainly as close to fascism as i ever want to come in my life. >> joining us now, lynn kirchner, former federal prosecutor and adviser to the democratic national committee. glen, i'll start with you on the january 6th verse. the committee interviewed stephen miller former white house adviser for eight hours yesterday and repeatedly pressed him on trump's use of the word "we" in the rally before the insurrection. >> help us understand the significance of that line of questioning. lay it all out. >> so the significance in part, stephen miller apparently participated in drafting the speech that the president gave at the pre-insurrection pep rally, a speech that was designed to gin up and enrage his supporters, his foot soldiers and then he directed them at the capitol and said now go. go fight like hell, or you won't have any country anymore, stop the steal, because your vote has been stolen from you. so i think the devil's in the details and maybe the devil helped prepare the speech and they wanted to talk to stephen mill ber it, because it seems to me that there is pretty strong evidence, culpability for insighting the insurrection based on the words donald trump spoke and they want to find out how many of those words were fed to him by stephen miller and we had a development yesterday, where one of the insurrectionists, a guy named dustin thompson was convicted on all counts by a dc jury, after he laid out the argument to the jury that, listen, i was just following presidential orders, i did what donald trump told me to do, i believed that. the problem for him, it it's not a defense. right? but it is incriminating evidence against donald trump and perhaps based on yesterday's testimony before the january 6th committee, it may be incriminating evidence against stephen miller as well. >> that's an interesting point, glen. thank you for that analysis. and curt, we mentioned the presidential the debates and the fact that it is not a law, it is a norm, an historic norm, but they also give us candidates, these presidential debates we like to, have folks like trump and other, big huge platforms, with millions of viewers, for lying and gaslighting american voters. is it good or bad if presidential debates as we know them end? >> well, i think it's bad. i think any time that you can have the two people who are vying to have the most powerful position in the world be asked objective questions, be challenged on their answers, and have a worldwide audience of millions of people, watching them to help evaluate how they're going to vote in the election, i think that's an important part of our election process and part of our democratic norms an watching the republicans withdraw from that is just another chunk in the armor of our democracy. they don't want to go outside of the fox news bubble. they don't want to be challenged with facts and truth. they know that their entire party now is built on lies and treason, and the last thing they want to do is be challenged on that because will is no answer for that, when confronted with the facts, they will fold like a house of card, and so they know now, that there's nothing they can do, but just stick to that right wing media script, the propaganda machines and really what they're trying to do, zerlina, is build two different country, one country that has democratic norms and another country that abides by completely different set of rules, and what's to stop them at some point from saying you know what, we only want votes counted by the election clerks that we like, by the election clerks that the republican party certify, and that's where they're trying to take this whole thing. >> that is not democracy. glen, one of the things that has become very clear today, as we sit here, and that was not true last week, there's a grand jury, looking into the january 6th insurrection, ella alexander has told reporters that he received a subpoena from a grand jury, and you mentioned the fact that there are these other cases that have been going through the court system with the sort of ground level folks who stormed the capitol physically, ella alexander represents the group of folks who were planning, help us understand the significance and how much of a shift that is, in terms of the seriousness and perhaps the walls closing in, if you will, on some of the trump folks who thought they might have gotten away with this up to this point? >> yeah, the recent reporting is pretty important, zerlina, because we've learned that there is a grand jury sitting, investigating not only the foot soldiers of the insurrection, the people who actually breached the capitol at donald trump's direction, but we've seen reporting that the criminal probe by the department of justice has expanded into the fake electors, and the trump lackeys who were offering the fake elector narrative who were trying to push for the overturn of the election. so it becomes really important to know that there have apparently been grand jury subpoenas that have been issued, and the grand jury has been quietly doing its work, without us knowing anything about it. the "washington post" report actually reported for the past two months, there were former officials in donald trump's orbit who had been receiving grand jury subpoenas. and we knew nothing about those. so that's encouraging, because it tells us that not only has the d.o.j. been doing the work behind the scenes, with the grand jury, which is a criminal investigation, but it's been doing it without the kind of leaks we would expect to see. so we're being kept in the dark. but that doesn't mean that the department of justice is not doing its work. and of course, we know stephen miller was the point person for donald trump, on the fake electors. he was running around bragging about how they were going to send alternate electors. let's call them what they are, fraudulent electors. and that makes stephen miller one of the spokes in what is a hub and spoke conspiracy. we've seen a clearer picture emerging of the nature of this criminal conspiracy every day. so i believe d.o.j. really is digging in. >> well, we will wait and see what they discover. and also, we're looking forward to those hearings from the january 6th committee. glen kirchner, and curt, thanks as always for being here. please stay safe. coming up, have things gotten better or worse for black americans over the past year? >> i think our social and economic traditions are frozen in a sort of suspended animation, zerlina. meaning the comparative position of blacks versus whites, when it comes to jobs, and housing, and life expectancy, and health care, remains a wide gap, a gap that hasn't changed for multiple decades. now, you always have to qualify it, because of the black people serving as a bit of a caboose on the american train. meaning when the train speeds, the condition and position of black people may improve, for example, a high school graduation rate for black people is higher today than it was 30 years ago, but it's also higher for white americans. the gap hasn't narrowed as much. for things like joblessness, and home ownership, and some things have widened, home ownership being one of them. so all in all, in this report, we mean to say to people that this work to close these racial gaps is still necessary, and that america has to reckon with the fact that these gaps have not materially changed. we also in this report focus on democracy and voting rights. so the report paints a picture based on fact, not based on opinion, and we just report what the numbers say, and that's what this report says. >> one of the things that the report highlights, is that this really isn't a matter of individual decision making, or individual choices, it instead focuses on just how hard it is for people of color to overcome systemic racism. speak to that point. i mean what are some of the key issues that require systemic change? >> well, home ownership is one. why are the denial rates systematically lower, the mortgage denial rates higher, than for white americans, even if you look at similar incomes. why, when you look at an african american and white person, who may graduate from the very same college, in the very same year, with the very same grade point average, do you find 20 years later a wealth gap, and in many instances, an income gap. this is the frustration of progress, the frustration of trying to get ahead. there are always going to be people we can point to who shatter glass ceilings, overcome the great difficulties but we're talking about here, what we're talking about here is broader issues and that is the overall community. so this is a call to action, to continue to do the work that is necessary in the face of a backlash against voting rights and democracy in this country. and the report emphasizes that as the most paramount issue not only facing the nation, but facing black americans. there is absolutely an assault, a campaign, an effort from the far right, and bad actors to undermine and destroy democracy. >> and one of the other things that i think is important to note, i mean the attacks on democracy, culminated i think at the insurrection, on january 6th, but also, you know, january 6th followed a summer of racial justice protests. and i don't think those two things are as separate as we think they are. i think that the backlash you're speaking of, in that multi-racial progress, is some of what we saw at the insurrection. your report found black people are more than twice as likely to experience these encounters and i want to play you some sound, with patrick lyoya, who was killed in grand raps michigan and talk to the attorney ben crump and talk to you on the other side. >> america, rooted around the world, are making sure that we condemn russian soldiers who are shooting civilians in the back of their head, in the ukraine, and where we want them to also condemn police officers shooting unarmed black civilians in the back of the head here in america. >> well, that's incredibly blunt, but i think that as we talk about, and talk about at the top of the show protecting democracy in ukraine, we have to talk about protecting democracy here in the united states. and that includes democracy with black people a part of that. i mean do you think the administration recognizes the connection here, because, you know, black people deserve freedom and liberty and democracy, just like the folks over in ukraine. >> you know, zerlina, if you go back and look at it, i'd invite you and the listeners and viewers to do this, look at my speech at clark university on tuesday, when we released the state of black america report, i said as much as the same thing as ben crump said. it is inconsistent to on one hand condemn putin and russia, for their invasion and aggression in ukraine, and on the other hand, be silent or turn your back or hide behind the filibuster when it comes to protecting democracy here at home. and we have to call out the inconsistency. and i encourage the administration and the president to strengthen the narrative that the fight against russia and ukraine is not an isolated battle. it's part of a broader, if you will, effort, by right wing bad actors, here in the united states, and vladimir putin, to destroy what we know as democracy. representative democracy, with universal suffrage. >> marc morial thanks for being here today. please stay safe. coming up, this week is black maternal health week and despite continuing to develop new technologies black mothers are not safe in america. and i'll explain why next. a. and i'll explain why next. can tell you how a young homeowner is turning into their parents. -not those two. -yep, they're gone. -forever? apartments-dot-com. the most popular place to find a place. states, and vladimir putin, to new technologies black mothers states, and vladimir putin, to new technologies black mothers we talk on this show about racial health disparities and one of the most glaring and heart breaking examples is maternal mortality. the u.s. already has the highest rate of any developed nation of people dying from complications of pregnancy and childbirth. but it is worse for people, especially black americans, whose maternal mortality rate is three times higher than that of white americans. three times. and it is actually getting worse, not better from 2018 through 2020, the first year of the pandemic, maternal mortality rose for all group, but for black people, it shot up by 25 whole percent. the biden administration has named maternal health a top priority, and this week, which is black maternal health week, vice president kamala harris, who convened a cabinet meeting on this specific issue where she said this. >> this is an issue that is not just about health care, it is about treating a woman as a whole human being. understanding that if we are to expect and actually influence positive outcomes on this issue, we must see her then as a whole human being. which is why we have gathered the leaders that are here today so that we can address issues such as the issue of housing. we can address issues such as transportation. such as nutrition. which all have an impact on not only the experience that she will have, and therefore, her family will have, but also, generational impact. >> joining us, journalist and activist and host of the podcast, also the author of the how racism in health care kill women and also with us dr. erica marsh, professor of obstetrics and gynecology at the university of michigan medical school. i want to start with a question related to black maternal health which is the right to reproductive freedom and this week oklahoma, texas, well, prior to this week, but kentucky and oklahoma this week, passed bans, near total bans on abortion care. we're all waiting, with baited breath, and anxiety, for the supreme court to rule on the mississippi case, and i mean black people and other people of color are the most hurt by these kinds of restrictive abortion bans, and at the same time, black women are most likely to die from having a baby. what does this say about the value given to black women's lives, when access is caught up in this way that affects not only those who want to seek out abortion but also women who want to have people, who want to have a healthy baby? >> well, it points out that we don't really have control over our bodies and as we're seeing state by state, increased restrictions on abortion, it is just really a larger assault on women's reproductive health and rights and women's overall health, because as we know, abortion is health care. and you pointed out that black women in america are three times more likely to die giving birth in america than their white counterparts and zerlina, we cannot ever get used to that statistic. that statistic is 243%, more likely to die, giving birth in america, than their white counterparts. and pre-pandemic, you know, there were some really racist explanations for this. that, you know, black women are less educated, or their welfare, but now we know studies show that a college educated black woman is still five times more likely to die giving birth than their white counterparts. so we know, i mean the pandemic is really just exposed how its racism and not race, that is driving these disparities. >> it's such an important point, i think about serena williams when you say that, right, serena williams, almost died giving birth to her child, and it was because of the inbleed, she was as much in pain and distress as she said, and that is a common experience. doctor, why are black people primed more likely to die? why is this data point and why does this kind of appear to be getting worse instead of better? >> i think that's a critically important and complex question. but fundamentally, to the point that was just made, you know, the point that our vice president harris made in terms of the contributors of the social determinants and the structural determinants of health certainly contribute but also the fact that we are experiencing a significant, we continue to experience a significant amount of racism in the united states, and that racism absolutely contributes in a very negative way to our health status, and and i think pregnancy is a magnifier of racism, and the same way that covid-19 is a magnifier of racism. >> and what are some of the specific issues related to pregnancy that black women deal with disproportionately. i'm thinking about fibroids or i think it's preeclampsia. >> help us understand some of these. >> absolutely. i think preeclampsia is a condition that involves high blood pressure and changes in blood flow to the uterus and to the pregnancy is a significant contributor. blood clots are a significant contributor that develop, that all women are at an increased risk for, during pregnancy, but i think the challenge is when you report the symptoms, are you asked about the symptoms, when you do report symptoms, are you taken seriously, are you believed? are you followed up? how are you treated? and who in the health system, who is the health system really created for? and that's where racism comes into play. it's not about a biological difference, inasmuch as it is does my caretaker provide, listen to me, do they value my life as much as other patients, do they value my voice as much as other patients. as you mentioned zerlina, uterine fibroids is another area where there is significant disparity in pregnancy and outside of pregnancy and a huge percentage of a woman's life where she may not be pregnant but the fibroids can persist, they are benign tumors that grow in the wall of the uterus and the leading cause of hysterectomy in the united states, and more than endometrial cancer and uterine cancer and we know black women are significantly higher risk of developing fibe roids and they have disproportionate experiences to determine how they're treated for their fibe roids and if they're treated for their fibroids. so one group of women may be told just have a hysterectomy for that, another group of women may be told, you know, have a, you can have other options, and that's where the racism plays in. >> thank you both so much for being here and please stay safe. coming up, what do jared kushner and i have in common? >> honest l i almost hate to say it, but i liked her as a professor. at the time, i had no idea she was this racest and i'm not even sure she had begun this downfall into kkk territory that she's clearly been on over the last several years but i found her to be a very good civil procedure professor and i actually really loved civil procedure, as a result of having her as a professor. now, i have to qualify that by saying that when you go to law school, grading is blind. so she wouldn't have known that i was a black student or a white student or an asian student. i was just a number, i was just a test in front of her that she gave a grade to and ended up giving me an "a" but as of late, these comments from her, i almost find it hard to get really upset about them because they're so comically racist, and so comically untrue that i almost feel sorry for her. like i wonder what has happened to her in the 20 years since i sat in her classroom that has led her down this truly gross and comical path of, you know, kkk vintage racism. >> so i love that you honed in on that point because i think that often when we look at examples of racism like this one, that is an easy one. that's a lay-up for anyone, no matter what color you are, what background you have. could you identify this as a racism. where does it get more tricky, though? she's a professor with ten tour and she has obviously an influence and an impact on students throughout the years, talk about the spectrum of racism and how dangerous that could be and the impact that could have on young people of color who are in her classroom. >> well, i mean, you went to law school, so you know this. being a black woman in law school is like being a fish out of water, particularly if you're an intelligent black woman and a successful black woman. i've had people underestimate me from the get-go, right?
