A justice on Monday ordered a psychiatric exam to determine the trial fitness of Eric Belucci, the Annadale man whose murder conviction in the 2010 deaths of his parents was overturned late last year. The test will determine whether Bellucci, 40, understands the charges against him and can aid in his defense. State Supreme Court Justice Alexander Jeong ordered the exam during a remote conference which Bellucci attended.

In a remarkable development, a Staten Island justice on Wednesday recused himself from presiding over a retrial of Eric Bellucci, the Annadale man convicted of murdering his parents over 10 years ago. “I cannot abide another round of hearings to determine the defendant’s (mental) fitness,” Justice William E. Garnett said during a remote conference with prosecutors and the defense. “I have spent enough time and energy on this case in which any rational person would agree that the defendant slaughtered his parents on Oct. 13, 2010.”

A New Brighton man has been indicted on murder charges in the fatal shooting four months ago of a 34-year-old victim who was attending a memorial gathering in his community. Tyler Carmon, 26, of the 100 block of Prospect Avenue, pleaded not guilty at his arraignment Thursday in state Supreme Court, St. George. Prosecutors allege Carmon gunned down Cedric (Ced) Black on Sept. 15 while Black was at a memorial site on Jersey Street between Crescent Avenue and Carlyle Street.
