Taxed face masks class action update: Dollar General and Aldi seek dismissal of case

PITTSBURGH – Counsel for Dollar General and Aldi argue that allegations brought against them and other retailers which said they unlawfully charged sales taxes on the purchases of face masks during the COVID-19 pandemic are unsupported, and should be dismissed.
Joshua James of Freeport (and on behalf of all others similarly situated) filed suit in the Allegheny County Court of Common Pleas on Nov. 12.
(The case was later removed to the U.S. District Court for the Western District of Pennsylvania on Feb. 11.)
The lawsuit took aim at many different retailers, including Marshall’s, Forever 21, Sally Beauty Supply, Dry Goods, Amazon, Zazzle, Etsy, Brave New Look, Outdoor Research, Aldi, Dollar General and eBay. ....

Man says he suffered lost eye and blindness after being hit with 'Hold-Zit' strap device

PITTSBURGH – A Western Pennsylvania man says he has suffered the loss of his right eye, permanent blindness and other injuries, after his eye and face were struck by a “Hold-Zit” strap device.
Robert Bogle of Loyalhanna filed suit in the U.S. District Court for the Western District of Pennsylvania on March 8 versus JDS Technologies, Inc. of Oneida, Tenn. and Radiator Specialty Company, Inc. of Indian Trail, N.C.
“JDS and RSC, acting together and in concert, sold the ‘Hold-Zit’ strap to the general public and placed it into the stream of commerce. The defendants expressly warranted and guaranteed the ‘HoldZit’ strip for life. Bogle came into possession of one of defendants’ ‘Hold-Zit’ straps, which he used,” the suit states. ....

Mistaken identity stabbing update: City of Pittsburgh denies it wrongfully arrested plaintiff

PITTSBURGH – The City of Pittsburgh denies allegations that it wrongfully arrested a local woman for a stabbing incident that occurred in the city, due to a case of mistaken identity.
Desiree Pinkston of New Kensington first filed suit in the U.S. District Court for the Western District of Pennsylvania on Sept. 23 versus the City of Pittsburgh, Officer Morgan J. Logan and John Doe officers, all of Pittsburgh.
“On Thursday, Sept. 19, 2019 City of Pittsburgh police officers, including defendant Morgan J. Logan caused a criminal complaint to be issued against Pinkston, based on an affidavit of probable cause prepared by Logan as the charging officer, concerning a stabbing incident that occurred in the East Hills section of the City of Pittsburgh,” the suit stated. ....

Walmart fall update: Case settled for couple's injuries suffered in entryway of West Mifflin store

PITTSBURGH – A Pittsburgh couple’s personal injury lawsuit brought against Walmart for injuries suffered by the wife-plaintiff when she fell on an unspecified liquid in the vestibule of the retailer’s West Mifflin store has been settled.
Theresa Allard and Charles Allard of Pittsburgh first filed suit in the Allegheny County Court of Common Pleas on Sept. 14 versus Walmart, Inc., of Bentonville, Ark.
The Allards said Theresa was shopping in the Walmart store in West Mifflin on Jan. 30, 2019, when she fell on spilled water, liquid or a discarded substance on the concrete floor of defendant’s premises – which, additionally, the plaintiffs said was the result of the defendant’s negligence in failing to make the premises safe for shoppers, failing to remove the liquid and failing to warn shoppers of the dangerous condition. ....
