fighting to move the case out of washington d.c. to perhaps west virginia because in dc he says he can't get a fair trial. >> brian: griff jenkins outside of the dc courthouse. >> griff: good morning, that's right, in a matter of hours we expect the former president president here, third indictment in four months, ainsley you mentioned four charges, you can see we put that screen up, three of the charges are on conspiracy, one for obstruction, trump's attorneys said this is a free speech case and former attorney general bill bar says special counsel jack smith has a high bar but agrees it has merit. >> i think it's a legitimate case. i think unlike the document case it's going to have issues of proof. it's a more complicated case. they are not attacking his first amendment right. he can security preparations getting more strict with u.s. marshals but fencing all around the place and as far as protesters, so far this morning i have only seen one, a man in a black and white jail suit holding up a big orange sign that says lock him up, we'll see what happens. brian, ainsley and steve, back to you. >> steve: he wasn't talking about you, right? >> griff: as far as i know he is not talking about me being locked up. it had a picture of the former president on it, steve. >> brian: no doubt about it. let's bring in mark levin, mark, liberty and levin. you think totally unnecessary, we have not spoken, i have not heard you speak out again about this indictment. what stands out to you? >> well give me a few minutes you are going to hear me unravel some of this crap. let me read something to you. 18 united states code section 2384, that's the seditious conspiracy issue. they said it was a slam dunk, is he dish conspiracy in all the media, two or more persons in any state or territory, jurisdiction of the united states conspired to over throw, put down or destroy by force the government of the united states, or to levy war against them, oppose by force the authority thereof or by force to prevent, hinder or delay the execution any law of the united states or by force to seize, take or possess any property of the united states, contrary to the authority thereof they shall fined under this title or prison of 20 years or both. mr. prosecutor, i notice this isn't in your bill of particulars, why is that? why is it that the media is not saying? he wasn't charged with a slam dunk charge, why? because he didn't commit that act. remember this one? 18 u.s. code section 2383. rebellion or insurrection, isn't january 6th insurrection day? whoever incites, sets on foot, assists or engage in any rebellion or insurrection, laws thereof, or gives aid or comfort there to shall be fined in prison of ten years or both, in capable of holding an office of the united states. he is not charged with insurrection, what is why do we have this document, let's go through it. let me educate you, bill bar, you are making a fool of yourself on cnn and everywhere else now. you should take your personal anonymous out of this and stand up for the country and the rule of law because they are destroying our electoral system as i will explain in a second. let's look at four charges. do you know what they had to do? go back to a statute first passed in 1871. it was called the ku klux klan act. post civil war, why was this passed? it was passed because ulysses s grant was chasing down the klan in the south to destroy it. and when the democrats took over the house of representatives, they cut off his funding so the klan survived, reconstruction was destroyed. because the democrat party is evil. let me go on. mrt 18.2, 18 usc section 1512 a. also 1512, what is this? statutes that were passed in 2002. do you know what they are called? the enron statutes. to fill a gap that was -- that they felt needed to be applied because they didn't have what was necessary to charge certain executives with obstructing justice. this has nothing to do with what took place on january 6th or before january 6th or after january 6th. this matter that they have used against protesters on january 6th is extremely controversial and the supreme court hadn't decided it yet but cases are going to the supreme court on these counts. how dare this prosecutor use these statutes against a former president of the united states. then we have count 1, 18 usc 371, cheating the government, interfering with legitimate government authority, this was aimed at financial fraud, federal contractors, others who are ripping off the federal government. this indictment, mre reason they didn't bring insurrection and is he dish conspiracy because there was no insurrection and seditious conspiracy. i want to say something to mike pence, fought like hell, he didn't want to tevin front of this grand jury, he didn't want to give his notes to this grand jury, now we know why scribbling them down in the meeting. he had to give them up. then he gives them up now he comes out, he is like all of a sudden he is a drama queen, i said no. because his notes are in there, he flipped completely. and i stopped a constitutional crisis. you did? regardless of your opinion of what he did. you want to read about presidential elections and constitutional consequence as soon as read about the election of 1800 which was incredibly controversial. read about the election involving adams and jackson. incredibly controversial, almost caused a civil war. read about the election in 1860, abraham lincoln got 30% of the vote, leading to the civil war. read about the election of 1876 where there were dual electors sent by multiple southern states where the candidate who received the most electoral college votes and the biggest popular vote, the election was taken from him. read about these elections. the election of 2000, so here is my question to the three of you. what are the rules now? what now are the rules for running challenging and disputing elections and who decides? when can a candidate rely on legal advice this we have lawyers who are indicted for giving legal advice, the government disagrees with. is a president not free to discuss decisions about the elections with his vice president, vice president is free to do whatever he want, as this vice president did. is a president freely to dispute election results without being indicted. he knew he lost, he said he didn't lose, so what, either way it doesn't matter, the electoral process is not purely political. in our constitution it's purely political. do you know who ultimately decides elections? congress. the electors go to congress, congress decides who is in, who is out, two slate congress decides. congress gets to gather all the evidence at once, it's done it for 247 years. up to this indictment. now all of a sudden a department that didn't exist, u.s. attorneys who didn't exist, special counsel who didn't exist, even judges who didn't exist they are going to look back with 20/20 hindsight and decide what a president says appropriate, what the hell is going on here? i will tell you what is going on here. this guy, jack smith destroyed our electoral system. nobody knows the rules of the game. nobody knows when challenges can be made or cannot be made. now they are going to figure out what you're thinking and what you believe and so forth and bill barr goes on that crack network cnn and he talks about well, you have a right to speak, there is the freedom of speech but you don't have a right to say things in a conspiracy, conspiracy to what? >> brian: he will be on with martha today. mark a couple things. >> congratulations, he is everywhere. >> brian: what joe biden said last year and tell me if you think this applies, listen. >> we just have to demonstrate he will not take power by if he does run. making sure he under legitimate efforts of our constitution does not become the next president again. >> brian: do you think this applies? >> message sent, message received. but i think the mob boss who runs the department of justice is well aware what his job is, how do we know that? every single indictment has been approved by the attorney general of the united states, every single one of them. this special counsel was picked because he was close to eric holder, close to jim comey, andrew wiseman, this isn't an independent operation, i explained it on my show sunday. they took the worse actors under the obama, biden, holder administration, they set them apart, called them special counsel. they have up to 60 fbi agents, 60 fbi agents and prosecutors, we brought in his old chums from the public integrity section, he was sent to the hag, he was so bad he was sent over seas. this march has been reversed by three separate injuries, he was reversed by an 8-0 supreme court, as i explained on sunday, he takes statute that is don't apply, takes statutes and rewrites them. he knows he is in washington d.c., grand jury in washington d.c., he has the worse radical left wing obama judge in america, somehow gets the case. she is in charge of the case. he is going to indict trump for drinking too much orange juice and everybody would say great, he is not above the law. let me tell you something else. this case in florida, this documents case, you also have former federal prosecutors, that's a serious case. that is an unserious case. there are motions to be filed here, he brought that case in washington d.c. in the wrong venue purposely. he wanted to indict trump in washington with democrat grand jurors and then he says by the way we are moving the case to florida. under federal department of justice guidelines for prosecutors, you are not allowed to do that. that's motion number 1. the president of the united states had his attorney/client privilege stolen from him by another obama judge who worked for pat lahe for ten years. that's motion number 2. motion number 3, one of the top prosecutors in this office is accused of extorts defense counsel for a codefendant of president trump by waving a federal judgeship in front of him if he could get his client to turn states' evidence, that's motion number 3. a general warrant, more motions that trumps lawyers can file, i assume they will file, when you have people come on these air waves oh, that's a slam dunk document then step back, america. you charged a president with 37 counts involving documents in the middle of an election where he is the likely republican nominee and in there you never mention the presidential records act, it's called a presidential records act, not the hillary clinton records act for a reason. that is the controlling law in the prosecutor doesn't even use it, this guy is sleezeee, he is destroying our republic, destroying our electoral system, i am telling you three right now, nobody knows what the rules of the games are right now when it comes to election. mike pence you are is a disgrace what you are doing right now, of course you objected what you were told and you did what you thought is right, that's the way the system is supposed to work. it, worked.s the system worked, the biden administration is saying who can we indict, they have the january 6th committee, people on the january 6th committee who should be apologizing to america, they said, sedition. they said insurrection, there is no sedition, there is no insurrection, how could they be, the president of the united states said hey, nancy, you want 10,000 armed national guardsmen to protect capital hill, no, we don't, it would be a bad look, we don't want to do that, how can you run an insurrection when you are running 10,000 armed troops to circle the capitol and protect it. of course they leave out that phrase, peacefully protest. they didn't find, and i told you guys this months ago, not a syllable of evidence that donald trump was involved in over throwing the government insurrection or anything else. as a matter of fact he left office when he was supposed to leave office, that's what he did. they went after him before he was elected, they after him when he was elected, in four years of his presidency, they are going after him now, this is a disgrace to the whole country. >> steve: the next indictment will be, you know, revealed and whatnot coming up 8 hours from right now. mark, thank you very much, it's always great to get your point of view. >> it's the right point of view. god bless you. >> ainsley: god bless you. >> brian: look for your book coming out in december. >> steve: life, liberty and levin sunday nights at 8:00 eastern time right here on the fox news channel. 8:18 here in the east and still ahead, new york city offering students college credit to help migrants fill out asylum requests. we are going to explain that coming up next. we moved out of the city so our little sophie could appreciate nature. but then he got us t-mobile home internet. i was just trying to improve our signal, so some of the trees had to go. i might've taken it a step too far. (chainsaw revs) (tree crashes) (chainsaw continues) (daughter screams) let's pretend for a second that you didn't let down your entire family. what would that reality look like? well i guess i would've gotten us xfinity... and we'd have a better view. do you need mulch? what, we have a ton of mulch. >> steve: it is a beautiful thursday here in new york city, right now 70 degrees. we are going for a daytime high of 81. and there in new york city, there are at least about 95,000 migrants have arrived in new york and new york state over the last year. and so many of them have pending legal cases before the didn't of homeland security and things like that. in may, there were 127,000 pending cases where paperwork needed to be filled out and filed. because there is such a backlog, the mayor has enlisted a whole lunch of really bright college kids at nyu, columbia and the city university of new york to help the migrants fill out their asylum paperwork. >> also hunter college, queens college and new york university nyu. the mayor is getting college students involved and he said if you come and you help the illegals in new york fill out their paperwork for asylum applications, then you will get college credit. >> brian: so in the city yesterday we had madison out there, she was doing great reporting on the roosevelt hotel i think you are seeing some of that now. now they are forcing reports away, they told a new york post reporter they couldn't talk to my migrants and other outlets, bad publicity it is for the democratic mayor, president, how awful this looks, we've seen impoverished nation or the number one city in the number one nation in the world? is this is what happens. welcome to our nation, here is a cardboard box, lay out as long as you want, hope it doesn't rain, best of luck to you. the other problem is, too, when asked if there is a problem in new york, you broke the border, mr. president, help out the cities, they were told here is a consultant to help you out. now the money is starting to come in and kirsten sinema on why the money is coming to new york. >> steve: she says it's all about politics, the reason money is going to new york the leader of the u.s. sent ate, chuck schumer, language put in the law said it should be going for decompression at the border. that's very clear, it should be at the border. we are a long way from the border here in new york, the fact that is a yomen's amount of money going to new york city, they are not -- she is talking about arizona. >> brian: where is senator kelly, going hundreds of millions of dollars, they have found 5000 more sites in new york city to put these illegals to sit there and not work and just i guess just rot away because we have nowhere to put them and we don't have paperwork to process them, to put them on the job but basically do you want to put an illegal immigrant on a job that an american could fill, you can't work, you have to prove another american can't fill that job, unless you are an illegal immigrant we can fill that paperwork for you. >> steve: spending their time out at the roosevelt hotel filling out paperwork. >> ainsley: they are trying to find places to put these immigrants, we don't have anymore room here, they are sending them upstate and come back down because they weren't filling out the paperwork correctly in new york to transfer up there. they are looking at 3000 different sites and she is not saying whether or not central park is one of those. a lot of moms and dads are concerned about this because there are so many playgrounds in the park and our kids play in the central park. >> brian: i play pickle ball in central park. >> ainsley: to ride bikes, walk the doings. >> >> brian: if you want to take an active part, randalls island, they are active 20 hours of the day. >> ainsley: soccer, football. >> brian: they are putting them on the turf fields, are you kidding me? you take a city with little real estate with very few places to play and taking kids who are productive, the pup tents are people from other nations, they are more important than you. it is insane. >> ainsley: how did you get pickle ball courts, they are hard to book. >> steve: they are handily. carley with news out of washington. >> carley: the pentagon will not withdraw american troop from niger, the pentagon saying there are no changes to the u.s. military force poster in niger during the department of state lead ordered departure. u.s. embassy personnel are being told to leave and evacuating citizens on tuesday. dennis qaid is faith overcome his addiction to cocaine. >> i was pretty much a mess. but i had one of those white light experiences when i got home. i saw myself either being dead or in jail. you know, my faith was -- was the thing that really got me through that. >> carley: well, wade has been open about his addiction battle more than two years, faith based record, all about his spiritual journey called fallen, good for him, guys. >> brian: great balls of fire, it was in the movie budget. they were telling people back then it wasn't addictive. >> ainsley: are you serious? institutional investors do not control a large market share in housing, a new report suggests they could own 40% of single-family homes by 2030. is that bad or good. here to break down the numbers, is the cohost of the big money show, brian, great to see you. let's separate and talk about the meaning of this. so, these corporations are buying up the homes, is that a bad thing. >> they are buying up the foreclosed homes, a lot of homes on the market these were cheap, these corporations came with cash, we are going to fix them up and rent them. that's where they got in. it's slowed down a little bit but still very big in the south, southwest where everyone is going during the pandemic to get away from places like new york, it's a huge deal. if this trend were to continue, you would see massive concentration of corporations owning sickle family rentals, that's a major change from where we've been as a country be terms of homeownership and rental rates. >> brian: they could decide corporations together how to raise prices as opposed to market pressures decide. >> they could. one of the big problems we have, it's hard to compete with them, single family buyers are high, bidenomics inflation high, interest rates high environment it advantages the corporate buyer, you fix that, you fix this. >> brian: people are looking at big numbers, what about this number, homeownership down 63%. >> the difference between renting a home and owning it and caring for it and building and investing, that's the kind of investing culture you want, homeownership, right now we are going the other direction. rental is dependency, i don't think anybody believes we need more dependency in america right now, we need more investment in ownership. >> brian: 700,000 single-family homes rental now owned by institutional investors, that's intimidating. you are not as worried about it, 700,000 single-family home rentals owned by these companies. 7.6 million potential institutional ownership of single-family homes. do you think they should be regulated. pulled back from doing that. mr. and mrs. johnson competing with corporate america. >> the way we'll get here, that much concentration if we don't get the economy back on track with inflation and interest rates, the market can solve this but right now we have so much policy mismanagement in dc that it's putting individual home buyers at a disadvantage. >> brian: are not focusing on interest rates, rentals on the market, we'll see how that looks. let's talk beer now and talk about corporate boycotts that's what happened. >> brian: by the way, you see bud light and coors benefits, molson benefiting, the biggest surprise for me. molson coors experiences record sales increases. >> and -- >> brian: i it, last year we spent 36,000,000, this year up to $41.5 billion. this is important because in florida and elsewhere they are going back to school now, in new york in september. >> look, don't buy everything on the list, wait and see what you need and if your teachers are asking you for stuff you don't think your kids need, pushback a little bit. this is getting out of hand. you don't need all
