plan social media company. i am going to talk to one writer who got his hands on a test version, and reports it's about the mess that you'd expect. that is coming up. we want to begin, though, with that breaking news out of wilmington, delaware, where president biden has just wrapped up his meeting with west virginia senator joe manchin and senate majority leader chuck schumer. at the heart of it all, reaching an agreement over the president's expansive and social environmental bill. manchin has spent months rebuffing the president's demands for the $3.5 trillion package, no longer that number, as we well know. nbc's mike memoli and "washington post" white house reporter tyler page are joining us on this. mike memoli, you got some major news for us which is the meeting has now wrapped up. i broke it on your behalf so give us an update. what happened inside? >> well, yasmin, even the detail of knowing this meeting has ended was more difficult because of the unusual setting for it, right? we are used to these meetings. we have seen, over the last really several months, the president going up to capitol hill on one occasion. but more often, senators coming to the white house for these in-person meetings and when that happens, we usually can see them coming and going. we have a sense for how long they are sitting down and talking with one another but this is an unusual step. the president welcoming senator manchin, as well as senator schumer to his home in wilmington. we know the president likes to get away from washington when he can. well, today, washington literally came to him at a really key point. we have heard from the president and other officials throughout the week significant optimism. they feel like they are on a path toward getting to the finish line but one of those key stumbling blocks has been the final price tag. senator manchin has really been clear that he thinks the most he is willing to budge beyond is about 1.75 trillion. the white house has been talking a little bit of a higher number. so that would be, obviously, one of the key points under discussion today. and we heard from another key progressive senator today, senator warren, was on nbc earlier. she was asked what she would be doing if she were in this meeting between these three. and here's what she had to say. let's listen. >> i would say let's come together and get this deal done. failure is not an option here. we made promises to the american people and we need to deliver on those promises. >> and so, obviously, senator warren managing those expectations herself. we know progressives have come down from the price tag that they wanted. but they seem to be comfortable with where they are moving forward but that all depends on the time deal. it was interesting, yasmin, senator warren also talked this morning about her conversations with the other key senator in all this, senator kyrsten sinema. they are closing in on their own sort of agreement on a billionaire's tax and why is that important? because we have heard senator sinema does not support where we all thought this was heading which was undoing some of those trump tax cuts on the wealthiest income earners, as well as raising the corporate tax as well. so that's of potential side path here towards being able to pay for whatever the final number is that senator manchin and the president can agree to. >> tyler, talk to me. how -- how far do you think, at this point, the president is willing to go to satisfy manchin's demands? i mean, is it as far as 1.75 trillion which is, it seems, the top line for senator manchin at this point. >> yeah, i think that's probably the bulk of the discussion today between senator manchin, senator schumer, and the president. you know, as the president has repeatedly said, he needs these 50 votes and if he can't get an agreement with senator manchin, then this bill does not move forward and so, i think it is an ongoing negotiation. the president has kind of said there is no red lines or he is not going to be public about what his red lines are in the package but he feels confident as we saw this week in his "cnn town hall," he was very transparent about where these negotiations stand and how much, you know, progress they've made but work that remains. i think one of the noteworthy things about this meeting today in wilmington, delaware, is this is the first time the president has brought people outside of washington. this is a tactic we have seen other presidents use, whether that's camp david or other presidential retreats i think it's noteworthy he is finally bringing people to his home to really try to close this deal. obviously, he is heading overseas later this week and it's an imperative from his perspective they get a deal done or at least a framework before he headings overseas. >> can we talk about that for a moment? kind of the informal way in which they had this meeting in the president's own personal home, versus having this meeting at the white house. what does that really do to negotiations? what is the strategy here, i should say, on behalf of the president? >> will, what's so interesting about it, yasmin, is it is taking a page from the manchin playbook. we have seen so often senator manchin as a key broker in noerkszs in washington. sometimes between democrats and republicans, and sometimes as is more often the case now, simply among democrats. and what manchin has talked so often about is how he likes to break the ice and bring lawmakers to the house boat. that he has just outside washington. it's a more relaxed, more informal setting where they can maybe come to an agreement and in a different way. it's easier there than in the sort of confines of the marble and ornate halls of the capitol or grandeur of the white house. so i think part of what the president may be trying to do is take a more comfortable, relaxed setting but i think something tyler raised is also an issue here, which is there is only so many days left in the calendar for the president to get to that framework or a final vote before he heads off to yufrp. we are all counting the days till we head to rome with the president later this week. so he wants to feel more comfortable about where this is heading and that's why you got to give up a sunday sometimes to try oh get thoo point. >> i do it every week. by the way, what happens in the house boat we hear stays in the house boat. tyler, we heard from elizabeth warren. and -- and memly just mentioned it as well in his first response kind of talking about how progressives need to acquiesce a little bit, right? their coming off that number. they are not as hard line as they once were at the beginning of these negotiations and the president's really going to have to give and he is giving when it comes to getting this thing off the finish line. we are hearing free community college now is subsequently going to be dropped. clean electricity performance program. that's likely gone. so we understand the motivation as to why. right? the question, tyler, here is whether or not this is actually going to come back to bite the president on behalf of the progressives in the future. >> yeah. i think it is striking to see how much has dropped from this home. mike and i both spent the better part of two years on the campaign trail listening to democrats run for president. and so much of what was in this bill was core democratic priority. obviously, there are only 50 democratic senators and they need to reach an agreement with all of them. joe manchin was not somebody running for president who put out a expansive policy platform. but this was something that was core to the democratic base. you know, repealing the trump tax cuts. expanding medicare. free community college. we heard it from across the democratic spectrum. from more moderate capped dates like joe biden to elizabeth warren and bernie sanders. the rhetoric we hear on the campaign trail as democratic priorities, when push comes to shove, they often don't make it over the finish line because of the complicated negotiations going on here in washington and on capitol hill. and so, i think that is an important point to recognize just how important and fundamental these were to the democratic platform that are ultimately not going to make it into final passage. >> mike memoli, tyler page, thank guys both. we are going to be watching for developments coming out of this meeting over the next 24 hours. coming up. by the way, congresswoman yvette clark of new york and judy chu of california are going to join me live with the latest on the reconciliation negotiations, reaction to this manchin meeting, of course, and their must-haves in the legislation. that is right here at 4:00 eastern. so, we are continuing to track new developments in of course that fatal shooting of cinematographer halyna hutchins by actor alec baldwin on a movie set. nbc news is now reporting that dave halls, the assistant director who handed the loaded gun to baldwin, had a history of unsafe practices. that is according to a prop maker who worked with haul. joining me now, nbc news producer, david douglas. daifbtd, thanks for joining us on this. appreciate it. some fascinating and troubling stuff to say the least in some of your reporting. tell us more about what you learned and what else this prop maker told you about david hall's history? >> of course, yasmin, thank you for having me. her name is maggie. she is a prop maker and licensed pyrotechnician here in hollywood. she worked with halls on two productions a few years ago, and she described an environment they were a viert of safety concerns to you and i, people not in hollywood, we might not think a lot of. but a blocked fire lane, for instance. a blocked exit from a set. there were issues around open flames. shooting that continued in spite of a medical incident on set. a desire to rush. that was some of what she described including an accidental around there not being proper announcements of guns being used on set. something that is very common here in hollywood. it's supposed to be very clear that a weapon is being used on set. whether or not it is real or fake and blumhouse television, the production company in question here, did respond to nbc news and they tell us all the firearms used on the episode we talked about with maggie were dummy props. meaning, they would not fire. but what we are told by people in the industry is it is all very clear, it is always announced a gun is on set. so everyone is aware. and whether or not it could be live or obviously is completely non-fireable just a dummy prop. so everyone is comfortable and told us on numerous occasions, she and other members of the crew would ask for announcements to be made, ask for safety mightings and they frequently would not happen. >> so, we know that halls did not respond to your request for a comment on this. but given the history here and what we know now about his conduct on the set of "rust," what is the liability picture here? and who could be liable and how? >> well, i want to be clear, as well, about this. blumhouse says they did not receive any safety complaints through their internal online reporting system. they did go back and check for us. but gold did tell us she reported it to a punish in person. just to be clear, they checked and said they don't have any issues around safety on those episodes pt as far as what this could mean for rust, obviously none of us were on the set. very few people were on the set that day and those are really going to be the only people who know along with investigators as they work to piece this together. but when it comes to this particular case -- and you are looking now at aerials of that movie set in santa fe, new mexico on your screen there. what we understand is from an affidavit for a search warrant that does say that dave halls was the person who picked up the firearm from a table designed to hold the firearms. called cold gun, meaning it had been rendered safe. it was not going to cause harm to anyone. and handed it to actor and producer alec baldwin. and so, in terms of who is ultimately responsible, there could be a chain of people involved in some sort of accident like this. any liability is probably not likely to come down to one person. obviously, there could be wide civil liability, lawsuits for folks, right? in terms of criminal negligence, we have been told by a variety of different attorneys it's probably unlikely. but we will have to see as the investigation unfolds. >> and the chain of liability actually is exactly what happened in the tragic shooting of brandon lee, as well, which we have been consistently referring to since the shooting occurred on the set of "rust." thanks so much, we appreciate your reporting on this. ail right. so we are also following breaking news out of texas where two children are dead and eight others injured after a collision at a drag racing event. the two children were just 6 and 8 years old. police saying the driver lost control, veering off the track before hitting this spectators' and parked vehicles. the competition happened at an airport in carville about an hour's drive northwest of san antonio. nbc's jay gray reports. >> reporter: has, yasmin. look, at this point, it all seems like an unfortunate and tragic accident. a driver during a drag race losing control of his vehicle, careening into the crowd. there were parked cars, and then of course, a lot of spectators lined up along a runway at an airport. it was the kerrville kirk county airport. the race was put on by an independent sponsor and basically, what you had was these cars running down a runway at the airport and racing there. and again, he apparently lost control. 6-year-old boy died on the scene. an 8-year-old was transpotor ported to a nearby hospital and he passed away as well. four others taken by air ambulance to area hospitals, including the driver. none of their injuries are considered life threatening. you had two preem treated at the track and released. and then, you had two others small children a 4-year-old boy, a 3-month-old girl who were taken in for evaluation. looks like, they are going to be okay. a little bit more into what this race, what this event was about. it was billed on the convention bureau website as a race that means it's held on an area that is not an official race track and that nothing is done to that site before the racers get out and drive. so normally, if you had a drag race, they put down a liquid compound that really helps the tires adhere to the asphalt, to the race track this. when you don't have that, it leads to some spin outs, loss of control, unfortunately, yasmin, it just looks like that's what enned in this case. kerrville police still investigating in fact, they say it is an active and ongoing investigation and will be for some time. >> all right. still ahead, everybody by the way, thank you jay gray for that. still ahead. truth, lies, social media. former-president trump reclaiming a new soishl platform while one of his most ardent supporters breaks away from his big lie strategy. the potential impacts on the upcoming midterms after the break. he upcoming midterms after the break. when you're driving a lincoln, stress seems to evaporate into thin air. which leaves us to wonder, where does it go? "the post" revealing a command center set up by some of president trump's most loyal supporters, led by rudy giuliani at the willard hotel in the days leading up to january 6th. paper says they were working day and night with the goal of overturning the results of the 2020 election. their activities, including finding and publicizing alleged cases of fraud, and urging members of state legislatures to challenge joe biden's victory. the january 6th committee cited steve bannon's reported presence at the war room and its efrtss to try to compel testimony from the trump adviser. also, former-president trump announcing with fanfare this week, the dawn of a new social media company. but like everything with the former president, there is more to the announcement than meets the eye. there are catches, what of had ifs, and lingering questions. writes this week, quote, so far, the platform called truth social -- of course -- has been as true to form as one could have imagined. a ramshackle derivative project that expresses trump's desperate thirst for power and profit. and he is joining me now. thanks for joining us on this. you got your hands on the test version. how did it go? what'd you sigh? and how did you get your hands on that? >> well, it was sort of a clatic, chaotic trumpian rollout. the site had such striking vulnerabilities that unreleased test versions of the site were quickly found and circulated on social media and variety of pranksters, journalists and curious people were able to flood the site and test it out before the official, beta version was supposed to be rolled out november. official version's supposed to open in early-next year. and it was an experience. i would describe as sort of a cheap, scammy knock-off of twitter with some strikingly hypocritical claims about speech. you know, the site, to be fair, you know, there is still some time before it's officially rolled out. maybe, the design will improve but right now it looks rather drab. immediately, they were accused of violating licensing rules. sort of another case of where trump seems to be sort of ripping off other people potentially or not abiding by basic, you know, regulatory sort of norms. and what's really striking, recently, is that we have noticed this is supposed to be a bastian of free speech but the terms and conditions of the site reveal apparently you are not meant to disparage the site or its leadership, presumably that might extend to trump himself. and one's left questioning if this is supposed to be a place where it's supposed to be a non-cancellable sort of cultural space, then why are users not allowed to say what they want to say about the president. >> >> so you are not supposed to criticize the former president on truth as it's being called? i guess, is that what it's being called? truth? >> it's called truth social. and every time you publish a post, it's -- you hit a button that says truth, exclamation point. yes. >> and so, it -- so, that's supposed to mean that what i am publishing is truth? >> yeah, i mean, it -- it poses very interesting philosophical questions. that -- that the implication seems to be that every time someone publishes there, it's a truth. but of course, there are certain truths that apparently are not acceptable. for instance, if you say something that, yes, makes the president look, you know, bad or embarrassed in some sense. and -- and there is this sort of broader thing which you can understand truth social is an extension of trump's general ambition to lay waste of the idea that we have a shared reality. if everyone is right-wing site is publishing truths constantly, you sort of are saying that truth isn't a matter of the substance of what you are saying, it's not governed by reality or reason or objectivity. rather, it's who is saying it and where they are saying it and for trump, it means him and anyone in his political tribe. >> while i have you, because i do want to pivot on this. we will talk about truth social, i'm sure, in 2022 when this thing launches but so far, sounds like kind of a mess. let's talk about what you wrote when it came to marjorie taylor greene. there is something it seems she is disagreeing with the former president on and that is voting. we know at the point, the former president at this point is urging republicans not to vote. of course, trying to continue to push this election lie. um, however, marjorie taylor greene is coming out against that. >> yeah. so, she basically -- she had this finding. she did an informal internal survey of her constituents, republicans in georgia and that found something that she found alarming. so, roughly 10% of republican voters were expressing a lack of confidence in the security of georgia's elections. specifically, 4% of them are saying they didn't think the elections are secure and wouldn't vote in future elections. and then, 6% were saying they were unsure whether their votes will be counted so what you have is a very significant chunk of the republican electorate, you know, in georgia that is saying they're not sure whether or not they trust the voting process at all. and i think what greene was expressing concern about is a possibility that trump's threats to lead a republican election boycott if he is not satisfied by the republican party's attention to his 2020 disinformation schemes and involving fraud that happened, then could potentially end up just destroying republican turnout and threatening the potential success of republican candidates in 2022 and 2024. >> all right. thank you for your reporting on this. we'll check back in with you when it comes to truth exclamation point as this thing launches. but keep us posted. thank you. still ahead, everybody. bomb cyclone. the massive-winter weather system that could impact more than 100 million americans. coming up tonight on "the medhi hasan show". voting rights blocked again in the senate this week but why do we only talk about senators joe manchin request kyrsten sinema when it comes to these issues? >> well, it's -- it's early, yasmin, as you can see, the winds are kicking up. we get the little bit ofs of rain where i am here in santa clara. the storm is moving from the north to the south so we are going to see conditions continue to worse. parts of northern california, expected to get ten inches of rain. already, we are seeing some widespread power outages as the winds kick upment. as many as 66,000 people just in the bay area, alone. and that is expected -- that is expect today continue. expected to continue. the big concern is the areas that are -- that -- that suffered wildfires, not only this year but last year. these so-called burn scars. very much, vulnerable to debris flows and mud slides. the california office of emergency preparedness has had crews pre-positioned in four california counties in advance of this. now, some mandatory evacuations are under way, as well. with the threat of flash flooding, really, across northern california and into nevada. so that's a big concern. i am in santa clara, as we said, which is in silicon valley. about 4 miles way from levi stadium. that's where the san francisco 49ers play tonight in sunday night foot to take on the indianapolis colts. at game time, they are expecting the temperature to be around 64 degree, winds at 17 miles ap hour but gubtds up to 40 miles an hour. you have to be a hardcore fan to be in that open-air stadium this evening. yasmin. >> scott cohn for us, keep us updated as things are developing there. appreciate it. we want to get to news on the vaccine front now. this morning, dr. fauci telling abc news children may be able to get vaxed much sooner than once thought. if all goes well, and we get the regulatory approval, and the recommendation for the cdc, it's entirely possible, if not very likely, that vaccines will be available for children from 5 to 11 within the first week or two of november. >> huge, huge news there. meantime, new york city union workers now have five days left to get vaccinated or risk losing their jobs. nbc's rehema ellis reports. >> i feel secure in my decision. >> i don't know the long-term effects. >> i opted to take the unpaid live. >> reporter: karen rose is a patient care technician at a new york hospital. rob, a married father of three boys, spent 17 years at a new york city high school as a phys ed teacher. raquel martinez is a pediatric occupational therapist. they all reached the same conclusion about vaccine mandates. >> why did you decide to put your livelihood on the line? >> i felt like i didn't have much of a choice in the matter. that i was being forced to do something. to put something into my body. >> i felt that what they were doing -- what they have done is they've basically held for ransom your -- your health insurance, your benefits, your livelihood, your career, in some cases. >> reporter: a decision pulling at raquel's heart. >> my last task at my job was, um, laminating hearts for my students. and i was able to place them in boxes -- i am getting very emotional because i miss them. >> the consequences go beyond emotion. financially, can you see yourself continuing? >> we have discussed the possibilities of having to sell our house. having to find a new place to live. >> reporter: does anything keep you awake at night? >> yeah. you know, fear of the future. not knowing, you know, what's going to happen next. am i going to be able to get a job? are we going to be able to keep our home? >> losing a significant portion of your income, just like that. where you weren't able to prepare. it -- it's shocking. >> reporter: but for them, concerns about the vaccine, more frightening than losing their jobs. are you afraid that being vaccinated will hurt you? >> there's too many unknowns for me to be comfortable with it. >> i think we need to allow for adequate science and studies to be done. >> reporter: rob believes because he already had covid, he's protected. research shows the vaccines are overwhelmingly effective and safe. and antibody levels do wane over time, after infection. what do you say when people say it's just selfish not to think of the larger community, and just to think of yourself? >> well, it's selfish to think that an individual or a government is going to take away my right to choose what's best for me. wouldn't that be selfish? >> i don't think anybody should impose their beliefs on me for what i choose not to do. >> reporter: what would you need to hear to change your mind? you got it. ♪ liberty, liberty - liberty, liberty ♪ uh, i'll settle for something i can dance to. ♪ liberty, liberty, liberty, liberty ♪ ♪ ♪ only pay for what you need. ♪ liberty, liberty, liberty, liberty ♪ want to remind folks tonight, 10:00 eastern, msnbc airing the documentary "civil war." you don't want to miss that. and right now, we want to put the civil war in the spotlight with a podcast that shines light on one of the worst chapters in american history. to see what you learned about the war, what you didn't, and why. the award-winning "uncivil" tells many fascinating and unknown stories of the war, including one of an incredible raid in south carolina. it was an act of bravery carried out mainly by slaves that saved hundreds of others like them. take a listen. >> the boats headed back down the river. at the last bend, enraged confederates appeared with canons but montgomery's troops fired first and slipped past with just enough time to chug out of range. on board were more than 700 newly-freed people. just to put that in context, if you look at tubman's work on the underground railroad, most conservative estimates say she helped free roughly 75 people over the course of ten years. but in the cumby raid, more than 700 in a single trip. the success of the raid was front-page news in 1863, north and south. heading up a river, daringly making a strike behind enemy lines. a month later, robert e. lee tried the exact same tactic at gettysburg, a daring dash behind enemy lines and we all know how that worked out. major movies have been made about lee's greatest disaster but there's never been a movie about the success of the cumby raid. in fact, i ohm heard of it because it was the name of a feminist collective in the 1960s who took their name from harriet tubman's leadership in the raid. it's not in any standard history textbooks. >> i am joined now by peabody award winning host, thanks for joining us on this. we appreciate it. an incredibly amazing podcast, i got to say, and the coverage that you have is just -- it's -- it's awesome and it's breathtaking, i should say, because so much of what we learn, we've never even heard of. what do you make of that? the clip that i just played, right, you talk about the raid and how it's not learned in history books. it's not well known. why do you think that is? >> absolutely. i mean, i -- i -- first of all, thank you so much for having us on and thank you for checking out the podcast. i'm really excited about what you all have coming up with this documentary. um, the history i grew up of the civil war sort of didn't really imagine black people as agents, as part of the process of emancipation, right? you almost got the idea in some of the accounts that we were just sitting around on plantations waiting for the union army to come. so that's one of the key thing that we wanted to highlight in "uncivil" was to really highlight the role people had played, all kinds of folks. certainly, the union army played an important role. but here, harriet tubman not only participated in that raid but she planned it and led it and that was -- and the ways in which she was key to the strategy was something that we learned during the process of making "uncivil." and we have lessons like that throughout the podcast that people really have -- we have gotten great feedback on. >> what was some of the most surprising things that you learned as you kind of uncovered these truths that were unknown? >> i think, you know, there is a lot of different areas that -- about -- about the civil war and how that folds into the larger teaching of american history that people misunderstand. so one thing that was surprising was to learn how definitive the confederacy was about why they succeeded and essentially, this makes clear what the civil war was all about. in all these successionist documents, they were explicitly clear saying we are doing this because of slavery. so just seeing that and then seeing the tremendous pr campaign the sons and daughters of confederacy put forward, i thought a lot of these monuments that are plastered across the country to the confederacy. i thought they went up at that time. but what we learned during that -- during making uncivil, based on the work of historians, i should say, who were doing that work was that this was really like a pr project to rewrite history and those monuments went up decades after the civil war, not during it. >> in having this conversation about the civil war, and, of course, leading up to the debut of this -- of this documentary here on msnbc, "civil war," and the learnings and teachings of it and why so many things were left out. you can't help but also have the same conversation, obviously, as to what's happening in classrooms now across this country and schools across this country. this argument over critical-race theory and the teachings of that. and how, in a way, history has been whitewashed, right? many teachers saying that. many administrators saying that. and then, you got parents and teachers saying that they're against it. they are against the teachings of critical-race theory. i want you to take a little bit of a listen to -- um -- this argument over it, and then we will talk on the other side. >> we will defeat the radical left, the socialist marxists and the critical race theorists. >> right now, it's very trendy. i know that. it's very unpopular for me to be against it. >> just because i do not want critical-race theory taught to my children in school does not mean that i am a racist. >> how about you fire them? >> sir. >> by limiting the number of population in the count, they specifically limited the number of representatives that would be available in the slave-holding states and they did it for the purpose of ending slavery. well before abraham lincoln, well before civil war, do we talk about that? [daughter] slurping don't pay for water. pay for clean. it's got to be tide. growing up in a little red house, on the edge of a forest in norway, there were three things my family encouraged: kindness, honesty and hard work. over time, i've come to add a fourth: be curious. be curious about the world around us, and then go. go with an open heart, and you will find inspiration anew. viking. exploring the world in comfort. a lot happening in texas, folks. policymakers in texas have not been shy about targeting lgbtq plus people who live in their state. the latest assault on transrights coming in the form of a bill banning kids from playing sports. a bill passed by the state legislature that the governor, greg abbott, says he is going to sign into law. but the obsession with kids who do not conform to traditional gender norms does not stop there. seven kids, at least six boys and one nonbinary kids in a houston school district have been separated from their peers, some for over a month, suspended, just because they have hair past the bottom of their ears, a violation of school policy for males, if you can believe it. but now parents are fighting back with the help of the aclu, saying that the policy institutes the child's institutional rights and title 9:00. joining me now is the mother of one of those students, a nonbinary child, who the school district insists on recognizing as male, thus leading to their suspension. thank you for joining us on this. i know it's a tough topic to share and to talk about it, but we appreciate you being open-minded to talk to us today. how is trystan doing? >> trystan is doing okay. i, um -- trystan is definitely learning firsthand how being different means being discriminated against. but for the most part, trystan is strong and brave in their identity and hanging in there. >> what has their experience being like since they were suspended? how did it go down? >> reporter: so the second day of school, i was notified by the assistant principal that trystan's hair was out of dress code. i asked the principal not to talk to trystan, because trystan has an incredible moral compass, and if anybody said that they were doing something wrong, it would be pretty detrimental to trystan. i talked to trystan when they got home from school and when i explained to them the situation, i was met with absolute trauma and heartbreak. and it wasn't because they were being told they had to do something they didn't want to, it was because trystan is able to present female inconspicuously with long hair. trystan's long hair is deeply seeded in their gender identity. and once i saw that response and i saw the trauma that was in their eyes, i realized, we weren't going to be cutting trystan's hair. and that we needed to go and do what we needed to do. i let the principal know. i explained to her that trystan was nonbinary and would not be able to conform to a boy/girls dress code because trystan does not identify as a boy or a girl. trystan identifies as nonbinary. from that point, they continued to misgender my child and put trystan in iss for nine days. it was at that point that i retained a lawyer and reached out to the aclu and from day one, i've been fighting. and so have many other parents across the district, have been fighting this antiquated, sexist, and archaic dress code. >> let me ask you, what did the principal say you when you said trystan identified as nonbinary, despite the fact that the school was insisting to identify trystan as a male? >> she didn't know what it was. and i understand that. so i tried to explain it. and i tried to reach out to her with compassion and love and try to turn it on to her. i said, what if you had a child that was nonbinary. what would be the decision that you would make? and she said, i would cut his hair and hung up on me. and i just realized that the school is not inclusive. the school is not educated in lgbtq community and we were just going to have to educate and hopefully find a good outlet for this. >> what is this like for you as a mom, danielle? >> it's tough. >> yeah. yeah. >> it's tough. when trystan was sitting in iss, we would drive to school and i would blare the music, "this is me," so trystan can celebrate who they are and never for one second doubt the ability of their greatness. and i would drop them off at school and i would cry. you know, like a school district has turned their back against our children and against my sweet kid. and it's heartbreaking to see the devastation in all of these children's eyes that are being discriminated against. and it's just -- it's been a very difficult time. >> how do you make sure that trystan stays true to theirself, that tristan remains constant to who they are. because that's what you want as a mom at the end of the day, for them to be happy. >> i know that when tristan came to me about navigate and exploring their identity, their gender, i was taken aback a little bit, mainly because i needed to educate myself further on it. and once i read books -- then we read books together, and their eyes just lit up. and they looked at me and said, mama, that's me. i'm like, i know, kid. i was like, this is you. and so, let's just navigate it and explore it and let's just be the book you you can be. and, you know, we do boy things, we do girl things. tristan loves to paint their nails, steals my nail polish all the time, and we do a little bit of everything. and i make sure that i'm using they/them pronouns, and i didn't realize that it's a life-or-death situation by using correct pronouns. and when a school refuses to use that, it's life-or-death. statistics say that for trans and nonbinary children, by using the correct pronouns, there's a 50% increase or decrease in suicide rate. so my sweet kid, they will know that i respect and adore everything that they are, despite everything that a school district has showed them, they are safe with me. >> danielle, mom-to-mom, i feel for you. i wish you the best of luck. i'm thankful that you shared your story with us today. i appreciate it. and our best to tristan, as well. we'll be right back, everybody. well we'll be right back, everybody 'tt enough of your love babe♪ ♪oh no, babe girl, if i could only make you see♪ ♪and make you understand♪ get a dozen double crunch shrimp for $1 with any steak entrée. only at applebee's. now that's eatin' good in the neighborhood.
