oakland police chief will be holding a news conference about this later this morning. in the meantime, investigators are out here trying to piece together exactly what happened. live in oakland, lisa chan, kpix 5. thanks for the live update. the rocky fire has now grown to cover an area larger than the city of oakland. it's burning in rugged terrain just east of the community of lower lake about 20 miles north of calistoga. now burned more than 84 square miles in three counties and just 5% contained. the fire has grown in size partly because firefighters let it burn freely in an unpopulated area so that they could focus on saving homes. evacuees are taking what they can. >> terrifying. but you just go and get everything you can. take care of your animals and do what you can to get out of here. >> more than 6300 structures are threatened right now. two dozen homes are -- have already been destroyed and cal fire says it may take more than a week before it has the fire under control. more than 2700 firefighters from around the state are working on it and a viewer sent us the photo yesterday from the wal-mart in clear lake. the fire is actually a couple of miles away. but you probably wouldn't know it from the size of that smoke cloud. >> pretty incredible. and right now firefighters are mopping up. this is in hayward, after a fire broke out near jackson street and silva avenue at a residential building and started around 3:30 this morning. no reports of injuries or how that fire got underway. b.a.r.t. trains back in service between oakland and san francisco after the transbay tube was shut down over the weekend. crews had to replace a section of crossover tracks. transbay service scheduled to be closed again over the labor day weekend to do more work and the agency says the shut downs are inconvenient but the maintenance will benefit passengers in the long run. >> what we're doing is rebuilding a mechanism on the track that is called on interlocking which allows trains to move from bun side of the -- one side of the track to the other and helps us mitigate delays and gives us operational flexibility. >> b.a.r.t. board member joel keller telling kpix 5 sunday morning that there's also talk of eventually of perhaps building a second transbay tube. >> number of officials have stated their support for it. it's going to be a huge undertaking and it's a lot of money and a lot of planning and a lo of timing. so we have to start looking at that as an option. >> but before that can happen, b.a.r.t. needs about $9 billion to just maintain the current system. a bond measure to fund part of that could be on the ballot next year. all right, let's check in with liza and transbay tube now reopened right? >> yes. exactly. and you know over the weekend, they ran that bus shuttle between oakland and san francisco. and earlier in the week, they were warning of up to two hour delays and it went much smoother than they had expected a lot of folks stayed away from the b.a.r.t. system and there was only a 25 minute travel time using the shuttles between the east bay and san francisco. we're going to start off with the bay bridge toll plaza. where westbound traffic is backed up from the foot of the macarthur maze. the metering lights are on this morning. and do keep in mind because of this morning's police action in oakland, martin luther king jr. remains shut down between west macarthur and 40th. this is close to the macarthur b.a.r.t. station and b.a.r.t. is unaffected and trains are rolling through there with no issues at all. to the golden gate bridge, southbound traffic is looking good getting into san francisco. a quick 14 minute travel time between 580 and the golden gate bridge span. it's nice and easy there. 580 heading across the richmond- san rafael bridge. hardly anybody out there. enjoy the light traffic both ways. that's a look at the monday commute. here's roberta. awesome to see. because you've had a couple of fact marine layer has marched inland at least a good 45, 50 miles and currently we're in the upper 50s and 60s. today it's going to pan out to be pretty spotton as far as the numbers are concerned. in the 60s be partial clearing to the skies at the beaches and 70s and 80s are common across the peninsula and then 86- degrees in morgan hill. east of the bay numbers stacking up from the 70s to the low and mid- 80s. good morning brentwood at 85 degrees. 65 and barely any clearing in stinson beach. santa rosa topping off 80 degrees and upstream we go to 85 in cloverdale. i got the full forecast though coming up in 18 minutes after the hour. maria? we didn't get the purple menu i guess we're not that cool. >> no look at frank. he's got pink opinion. >> oh okay. i didn't get it. >> oh whoa. a health advisory has been lifted following a small fire that broke out yesterday at the conoco phillips refinery in rodeo. it sent up a large plume of black smoke. they warned people with smoke sensitives to stay inside. conoco phillips is looking into the cause of the fire and it was out within about two hours if no one was hurt. researchers are trying to figure out what killed the latest whale on the coast in san mateo county. kpix 5's kiet do joins us he's live in pacifica where the carcass is attracting scientists and a lot of looky- loos too i goes right? >> reporter: yeah exactly. you know there's a good on shore breeze blowing right now. the good news for neighbors is that we don't smell the whale just yet. the carcass was spotted sometime yesterday morning right off of esplanade avenue. this is behind the safeway that's in town on pacific manor beach. many curious people out here taking photos and checking out the themselves. the city is making arrangements for it to be removed. until then researchers will study it and collect samples in hopes of determining a cause of death. >> there have been lots of humpbacks and lots of blue whales feeding. very large numbers. hundreds of them at a time. so it's not unusual. >> reporter: and scientists say there are reports of another dead whale that's floating offshore. so more headaches could be coming soon out >> under the new rules, existing power plants would have to cut their carbon emissions by 32% over the next 15 years. each state would be able to develop its own plan for meeting carbon reduction targets and they'd have until 2018 to submit those proposals. and until 2022 to comply. police have caught up with a man they arrested the suspect of committing assault -- they believe committed assault with a deadly weapon. there we go. james beldin allegedly came up behind a woman last friday on willow pass road in concord and cut off a piece of her hair and smelled it in front of her and then ran away. police say earlier that day beldin tried the photograph the underwear of a woman wearing a skirt. beldin is a parolee and a registered sex offender. two women died of suspected drug overdoses after attending a southern california music festival. the teens who were 18 and 19 years old collapsed at the hard summer music festival on saturday. doctors say the combination of drugs, the heat, and dancing can often have fatal consequences. >> the kids feel high. and they dance and do a lot of muscular activity. and the result is that they can get muscle breakdown and they can have systems failure. >> well, autopsies are expected to be performed in the coming week. 11 people injured and five critically after a crash involving a limousine in l. a. county. sheriff's investigators say the limo ran a red light. crashed into two other cars saturday night. this is in santa which rita. those with the most serious injuries were inside the limousine which was carrying nine people at residents near reunion island now to help comb their beaches for any evidence to help unravel the mystery of that malaysian airliner flight 370. yesterday, part of alatedder was recovered on -- a ladder was recovered on french island but authorities determined it didn't belong to the plane itself. last week a piece of a boeing 777's wing was found on the island more than 2 now miles from where crews are searching for the missings jetliner. police in tennessee are looking for 29-year-old tremaine wilbourn, facing a first degree murder charge in the death of an officer in memphis. officer bolton. police say bolton interrupted a drug deal for pot and they say on saturday the suspect stepped out of the passenger's side of the mercedes and got into a physical struggle with the police officer and then opened fire. the suspect had recently served time for a bank robbery. a couple of san francisco neighborhoods are on edge after a series of sexual assaults on women in russian hill and nob hill. kpix 5's joe vasquez shows us concerned neighbors are now posting warning signs in the area. >> reporter: last saturday night, on fill bert and hyde, neighbors heard screams coming from the dark staircase. a woman began knocking on doors and rinking door tellsful she's the -- bells. she's the latest victim on a series of attacks on women between russian and nob hill. a source close to the investigation tells me there have been three or four gropings in recent weeks. the suspect always approaches the victims from behind and grabs them through their clothing and then quickly runs away. they are random the source says. the women do not know their attacker. >> very disturbing and that's why i never open my door without look out the window first. >> i'm worried. this is where my kids play and where my family thrives. >> some concerned neighbors have posted the flyers on light poles and mailboxes around russian hill. also on social media. warning women to be careful about how they interact with strangers. police say they're asking the public to be especially aware as they walk around in these neighborhoods especially at night when so many people are on their cell phones. they are flooding the area with undercover officers hoping to catch the suspect if he strikes again. >> it's awful. but hopefully they can -- we get together as a community and make a difference. hopefully we'll end this. >> reporter: at least one victim fought back. according to the source, she was approaching her door to go back inside when the groper attacked her from behind. but she knows martial arts and swung around and attacked him back and chasted him away. in san francisco, joe vazquez, kpix 5. some college students on bicycles just finished a cross- country ten week trip from new york to the bay area. >> they ended the two wheeled journey yesterday in san francisco. but also to raise money for cancer research and patient services. >> riding for my grandmother. she died and when i was about 5. and i remember her having cancer along the way. >> and the cross-country adventure took 72 days. >> can you imagine how they feel this morning? relieved and -- so satisfied after the macarthur b.a.r.t. station but officials tell us that b.a.r.t. is unaffected and trains are rolling through there with no problem. and just a heads-up if you plan on making the 880 drive later today. we've got the a's playing at the coliseum. at 7:05. expect delays closer to game time. this always delays traffic along the nimitz this morning 880 is rolling well in both directions. so far. and the rest of the commute has been fine. so the san mateo bridge still looking good in both directions heading across the span. no delays for the san mateo bridge toll plaza. and the 101 and 280 commute heading to and through the peninsula, that's moving well at this hour with no major problems to report to you. for all of san mateo county. that's a look at your kcbs traffic. and very suspect is dead and a police officer is in the hospital after a gun battle on martin luther king jr. way. kpix 5's lisa chan is at the scene near the macarthur b.a.r.t. station with the very latest. good morning lisa. >> reporter: good morning. well we learned the shooting happened outside here on the sidewalk. now investigators from internal affairs, the da's office and the homicide unit are out here trying to figure out exactly what happened. now police responded out here to the 3800 block of mlk at 1:32 this morning. they were investigating a sexual assault that led them to a suspect who was armed with a rifle. >> the suspect presented himself with a rifle. shot at the officers. one of the officers was struck by gunfire. both officers returned fire. with multiple officers at the scene. but both officers returned fire. >> reporter: we heard about 30 shots were exchanged. the officer and suspect were beth transported to the -- both transported to the hospital and the suspect was pronounced dead. the officer was in surgery and but we heard he is now out and he is expected to be fine. mlk is now closed between west macarthur and 40th. we were told the oakland police chief is planning to hold a news conference about this officer-involved shooting later this morning. live in oakland, lisa chan, kpix 5. thank you. the wildfire in lake county now covers more than 84 square miles. still just 5% contained. the fire is exploded in size the past day and a half that's partly because firefighters actually let it run towards a rugged unpopulated area so they could focus on saving homes. more than 6300 structures still threatened this morning. at least two dozen have already been lost. and firefighters have been setting backfires to try to stop the main blaze from crossing highway 20. some of them working for several weeks straight as california fires continue to burn out of control. >> sadly i think wean we're done this -- when we're done with this one we'll be on to the next one. >> does it wear you out? >> a it does yep. >> from the wal-mart in clear lake this picture. the fire is actually a couple of miles away but you can see that massive plume of dark smoke rising thousands of feet in the air. and in kings county in central california some people can go home now after firefighters beeped you have the lines around the willow fire. evacuation orders were lifted for a community at 9:00 last night. but they're still in effect for several hers and -- others. the fire has burned about 5600 acres near bass lake it's now 60% contained. 6:32. a check of weather now with roberta and i guess -- temperatures are heading down. that's some good news. >> this morning we have the extensive marine layer. any kind of moisture in the atmosphere temperatures in the low 80s. and 85 in brentwood and you know i'm just turning off the ac today. open up the windows, temperatures 60s at the beaches in steinson and 80 degrees inland in santa rosa and meanwhile up stream we go to 86- degrees in clear lake. west winds 10 to 15 miles per hour and i have the full forecast at 48 minutes after the hour. liza? bay bridge toll plaza millions millions are on robert -- metering lights are on roberta and we have a backup this morning extending to the foot of the macarthur maze as the metering lights are on. sitting in backups just beyond the picture as well. once you're on the bridge though traffic does okay heading into san francisco. and just a reminder because of this morning's police action in oakland, mlk remains shut down between west macarthur and 40th. the macarthurward station is open and unaffected. trains are rolling through there with no delays. it's going to be a slow morning though for north 101 to and through san jose. expect backups now beyond the interchange. that's staying heavy towards the great america parkway. and this morning's accident is in the clearing stages. west 580 at grantline a big rig accident off to the shoulder. traffic has been backed up still very slow from beyond the 205 interchange and just a reminder the transbay tube is open. b.a.r.t. trains are now rolling between the east bay and san francisco. they do report no delays on the b.a.r.t. system. it's also been a nice morning for the ferries, caltrain, and the altamont commuter express with no delays across the board. that's a look at the kcbs traffic. guys? let's talk about b.a.r.t. now. trains up and running again after service was shut down between oakland and the city for maintenance over the weekend. crews replaced a section of crossover tracks and transby service scheduled will be shut down one more time over the labor day weekend for the same work. meanwhile b.a.r.t. saying the aging -- says the aging transit system still needs $9 billion worth of maintenance. it could be on the ballot in next year's elections. a second american is being investigated for hunting and killing a lion in zimbabwe illegally. officials say dr. jan seski of pennsylvania killed the big cat with a bow and arrow back in -- arrow back in april. u.s. dentist automaticker palmer is accused of killing that animal. officials in zimbabwe are trying to bring him back to face charges there. another whale carcass attracting a curious bunch of onlookers along the coast of san mateo county, kpix 5's kiet do is live in pacifica this morning where the dead whale washed up on the beach over the weekend and garnered a lot of attention. good morning. >> reporter: yes, good morning. another big headache out here for neighbors and for the city as the third dead whale has now washed up in the city of pacifica here for the year. they are hoping to get this thing occupy here before it -- out of here before it starts smelling too bad. the car cause cass was found yesterday -- carcass was found yesterday morning. attracting plenty of attention and a lot of people out here coming out to take photos and checking out the scene. the city is making arrangements to have it removed. but until then, researchers will study it and collect samples in hopes of determining a cause of death. this man was camping nearby. >> and i got closer and i saw all the people and i thought okay. well, it looks like a whale. so we start -- the second day of our vacation and every day something different. >> reporter: scientists say there are reports of another dead whale floating offshore. so another carcass could be washing up soon here in the area. we're live in pacifica, kiet do, kpix 5. very sad. but a stinky situation. authorities with the special olympics are on their way to the bay area to pick up an athlete who went missing in l. a. over the weekend. andi gusmari walked into the hayward police department around 2:00 this morning. the 44-year-old was reported missing on saturday after he separated from his group after a bowling competition on the usc campus. it's unclear how he ended up in hayward more than 350 miles away. and new this morning, firefighters are mopping up in hayward after a fire forced dozens of people from their homes. the fire broke out near jackson street and silva avenue at an apartment building over here. it started around 3:30 this morning. no reports of injuries or how that fire started. an american flag raised last night to honor hayward police sergeant scott lunger who was killed in the line of duty last month. hayward police officers helped hoist what's known as the u.s. honor flag a nonprofit organization bring this is flag around the country to honor fallen service members. the founder of the u.s. honor network traveled cross-country to bring the flag to hayward. >> i understand that that flag brings a level of comfort. however you can do it. whatever healing it can bring. it's not a religious thing. it's not a -- ethnic thing. it's just an american flag that brings them some comfort and understanding that when we say that that sacrifice isn't going to be forgotten, this flag emphasizes that. >> the sergeant was killed on july 22nd during a traffic stop in hayward. a thief makes off with thousands of dollars of merchandise from a bay area apartment. how she used a popular tepid spending by continue super heading into the summer. the commerce department reports that consumer spending of just .2% up in the month of june. that was the weakest gain since february. and it came despite a decent rise in incomes. they were up by .4%. that was the third straight month that they rose at that level. now there's some hope that perhaps july will see a bit more of a stronger gain from consumers. as autosales were a little weaker in june but so far we're getting pretty strong word that auto sales are gaining a little bit stronger for the month of july. fiat chrysler and ford both reporting stronger than expected sales. in fact it was a record month for the jeep brand in july. biggest in ten years also ford's f series pickup did very well last month. could be a fine opportunity for social media stocks this week. a big quartet pummeled last week, facebook linkedin yelp and twitter each saw the shares dissofty spite some pretty dong -- dissolve despite some pretty strong earnings. so far the shares are down once again this morning. overall a pretty flat start for the stock market. let's take a look -- maria and frank back to you. >> all right thank you so much dollars worth of items inside. police say the surveillance video back in april showing the suspect 27-year-old j ooh na dominguez out of richmond and apparently booked the home through the website. maze. again, expect those delays leaving oakland heading into san francisco. and we've been talking about that police action in oakland. martin luther king jr. remains shut down between west macarthur and 40th and b.a.r.t. is completely unaffected. trains are rolling through there with no delays. now it's going to be a slow morning from northbound 101 as you head to and through the south bay backed up now from beyond the 280 and 680 interchange and that stays heavy to great america parkway in santa clara. and if you plan on making the commute in the evening commute, the afternoon commute along 20 and the guadalupe parkway. that's expected to be even slower than usual. a big wwe event at the s. a. p. center and it's scheduled at 4:30 this afternoon. and it always -- anytime a big event like that happens at s. a. p. it always delays thereafter heading through the south bay. the san mateo bridge very slow westbound traffic heavy now leaving the toll plaza to about mid span. bart is on time good 50 miles this morning. that's all because we have this upper level trough out over the pacific ocean. as that gets closer to the coastline of california that sea breeze will allow the temperatures to dial back. again a west wind up to 15 and 20 during the afternoon hours so when will we clear today? this is futurecast and look at the lunch hour. just some clouds hanging tight to the sunset district. also right around the san mateo coast. otherwise sunshine for most. temperature-wise, we'll be quite seasonal and see the clouds fill back in in the overnight hours. 87 at the roberta thank you. it is 6:47. a pro life group released several videos allegedly depicting planned parenthood employees discussing the sale of fetal body parts. >> but last friday a judge? san francisco blocked the group from releasing more tape. legal analyst melissa caen joins us now to break down the case. >> good morning, an exciting afternoon here. a big hearing coming up but first, a little background here. the pro life group behind these videos is called the center for medical progress. and they've made headlines by releasing undercover videos that they believe prove that planned parenthood actually sells for profit fetal body parts. the parenthood denies this and don't profit from the sale of the tissue and also receive a small fee that covers the cost of chitting and delivering it to medical -- collecting it and delivering it to medical research labs. now a representative for the center for medical progress says if there are many more videos to come. they claim to have thousands of hours of conversations on tape to release. however, on friday, a federal judge here in san francisco issued a temporary restraining order against the center for medical progress. that order says they cannot release any new types that contain certain confidential in fact. today at 4:00 p.m. there's going to be a hearing and the judge is going to decide whether that temporary restraining order should become a permanent restraining order. >> so what's the legal basis for blocking the videos? >> well, so the -- the case was brought by the national abortion federation. i want to be clear. not by planned parenthood. now the national abortion federation is an association of abortion providers. every year, they have a conference and because a number of threats have been levied against abortion providers there's a lot of security surrounding the conferences. very hard to get into. and according to the abortion federation, these pro-life activists under false pretenses came to two of their conferences and when the activists attended. they like everybody else, signed contracts saying i will not videotape or record at this meeting and i will not disclose any information i learn here to anyone else. so according to the federation, despite these promises, activists did videotape and then they used information that they learned at those conferences to get the private conversations with planned parenthood we nouveau in the videos. the -- now see in the videos. they say they breached their contracts with us and you need to stop them before they do it again. the judge agreed at least temporarily to stop the center for medical progress from releasing any more videos related to the federation. to be clear it's not a ban on every video in the world. just anything federation related. which we don't know. it could be a lot or a little we're not sure. >> what does the center for medical progress say about this? >> today they'll finally get their day in court. today at 4:00 p.m. we will hear their side sort of more explicitly. so far they've already said look, everything we've done here is legal. we are citizen journalists. and this is all protected by the first amendment. >> so with or without the new videos, the release already had a pretty big effect and now congress is getting involved too? >> this is already really huge there. two investigations that have already been called by congress. they want to investigate planned parenthood and a number of republican members of congress have vowed that they will not support any budget that contains funding for planned parenthood next year. they want all the funding cut off. senator ted cruz has already said he's okay with creating another government shutdown in october over the issue of planned parenthood. funding. so -- >> okay. we shall see. >> yes we shall. >> hard to argue against video show. >> that's true. it's very difficult and they've admitted a lot of the city. they've also been spotted recently at some other airports in the region including one that got into the rapidding path of a -- landing path of a train. senator charles schumer says a simple train to the software could help avoid a big potential disaster. >> we should add geodependencing to all the software. no drone mr. it's a $50 or $5,000 one should be able to fly within two miles of
