monday. john roberts, great to be back after a few days not being able to talk. >> gillian: and glad to be back with you on the new set, it's awesome. this is "america reports," the desperate search for survivors is continuing across maui. >> john: recovery teams with cadaver dogs going building to building with the 1,000 that remain unaccounted for. >> gillian: survivors reporting warning sirens never went off and crews say hydrants had no water pressure. >> no idea what was going on, no siren, nothing. my son was like oh, mom, is this it? what do you tell your kids? >> right now the government is letting us down, so it's really important that all the people of maui stick together, come together and support one another at this crazy time. >> some of my friends are saying you know who is missing, so and so, so and so, so and so, and that's when it clicks in my head a bit. >> we will build back together, find out what we could have done to prevent such loss of life. >> john: max gordon live on the scene, are officials saying anything about why the fire spread so quickly? we know the wind was high, but other factors? >> no official word on why the fires started but a class action lawsuit pins the blame on hawaiian electric, the local fire company. alleges that they did not deelectrify lines and ignored weather warnings warnings about high winds and red flag fire danger warnings. they declined to comment on pending litigation but said it's focused on providing electricity to the west side of maui. the governor ordering an investigation into what caused the fire. saying 80 mile per hour winds caused what he called a fire hurricane. >> that meant that fire travels one mile every minute, resulting in this tragedy. with those kinds of winds and 1,000° temperatures, the pictures are easy to understand. >> the town is devastated by fires, unsafe and still recovering bodies. an entire family of four was identified as victims. an overnight curfew from 10:00 a.m. to 6:00 p.m. with access during the day limited to residents and people with hotel reservations. more than 2700 buildings were destroyed. the vast majority being houses, with so many people without homes the need is immense. the county estimates around 4500 people need shelter and many waiting for word of loved ones still missing. >> it's been so hard, very hard. never -- i think in my life would i have imagined that we would have something like this. >> lahaina itself, i cannot describe -- the feelings i get. >> meanwhile, the death toll is expected to rise. hundreds are still missing. people here on the island are urged to give dna swabs to help identify loved ones who might still be victims. back to you. >> john: let's hope a lot of those people simply got out. max gordon, thank you. >> gillian: to help hawaiians impacted by the wildfires, redcross.org/fox, and text 90999 and make a $10 donation. >> john: every little bit helps. hunter biden could be facing the threat of a trial after the collapse of a plea negotiation last month and new charges may be on the horizon after attorney general merrick garland granted special counsel status to david weiss. hunter's legal team is saying a trial is not inevitable. byron york, chief political correspondent, and fox news contributor. first of all a general sense, appointment of david weiss or elevation of david weiss to special prosecutor, some people are saying this means the investigation could go in a lot of different directions. some say it gives the doj an excuse to say we are in the middle of an ongoing investigation. we cannot comment when congress wants information. >> both of those things can be true. certainly the doj is going to say to republicans in congress sorry, we can't talk about it, it's an ongoing investigation, we just can't discuss it. on the other hand, a special counsel weiss could go off in different directions and could look at the links to joe biden, hunter biden's business links to joe biden, that are the most important thing here. now, we all know that david weiss was always claiming he had this authority and so why did he all of a sudden last week ask for it. but put that aside, going forward if he were to pursue it he has the ability to do so. >> gillian: over the weekend, hunter biden's newer attorney said there are no criminal charges, what going to change going forward as a result of this is the scrutiny of the accusations against hunter biden. that's a good thing, right, for everybody who is not hunter biden? >> you would think so. actually, they are making an interesting argument, which is remember this plea deal where it all fell apart in court, they were in court and they had this plea arrangement for not paying your taxes, and then this thing called the diversion agreement. and kind of tricky thing, they had hidden in the diversion agreement an agreement not to prosecute hunter biden on virtually anything going forward relating to that period of time. now his lawyers are saying we know the agreement was not affected by the judge, does not have to be approved by the judge, justice department signed it, it's still in effect. we still have a deal. so, it's going to be interesting to see the back and forth between hunter biden defense team and the justice department over that. >> john: the doj has asked the judge noreika to vacate the plea agreement but hunter biden's defendant said defendant through counsel accepted the prosecutor's invitation to discuss in settlement negotiations they understood would resolve the government's five-year investigation as is customary in negotiated resolutions, prosecutors not the defendant or his counsel proposed and largely dictated the form and content of the plea and diversion agreement. so, hunter biden's attorneys are saying don't look at us. the doj handed us this thing, raises the question, how did it ever get drawn up in the first place? >> unintentionally funny washington post editorial out today saying it might be that some of the republicans who complained about special treatment from the justice department had a point. there's no way you can understand that the justice department would forego any future prosecutions of hunter biden on anything they might discover during the years where they already know and believe that he committed tax crimes. but they did. so that was in this agreement, and there again you quoted the defense team, a deal is a deal, you signed it, you can't prosecute us. >> gillian: we know from living through special prosecutor robert mueller's investigation to former president trump that at least sometimes as a result of living through a special investigation the public comes by way of a lot more information that would be made public as opposed to this remaining the criminal proceeding it was before, certainly with the plea deal. do you anticipate that happening here, do you think congress will be more informed and by extension, the american people? >> i think we are all going to be more informed. if it continued as before and david weiss was the u.s. attorney he could have closed the investigation and not said anything. but the special counsel has a report requirement. he has to write a report and give it to the attorney general. and the attorney general would be under intense public pressure, which he would cave to to make it public. >> john: jonathan turley is voicing concern he named a special prosecutor from outside the doj, not just elevated the u.s. attorney and asked if it was expanding. jonathan will be joining us the next hour. >> he knows everything. >> john: and you do, too, why we have you on. >> gillian: gas prices eight-month high, creeping closer to $4 a gallon. energy experts are saying the recent rise is primarily due to the jump in crude and the latest production cut by opec+. >> john: my 12-year-old twins love to pump gas, a great way for me to ignore what's going on at the pump. >> gillian: and be in denial. >> john: i give them a credit card and go for it. >> gillian: what about on the boat? monday. john roberts, great to be back after a few days not being able to talk. >> gillian: and glad to be back with you on the new set, it's awesome. this is "america reports," the desperate search for survivors is continuing across maui. >> john: recovery teams with cadaver dogs going building to building with the 1,000 that remain unaccounted for. >> gillian: survivors reporting warning sirens never went off and crews say hydrants had no water pressure. >> no idea what was going on, no siren, nothing. my son was like oh, mom, is this it? what do you tell your kids? >> right now the government is letting us down, so it's really important that all the people of maui stick together, come together and support one another at this crazy time. >> some of my friends are saying you know who is missing, so and so, so and so, so and so, and that's when it clicks in my head a bit. >> we will build back together, find out what we could have done to prevent such loss of life. >> john: max gordon live on the scene, are officials saying anything about why the fire spread so quickly? we know the wind was high, but other factors? >> no official word on why the fires started but a class action lawsuit pins the blame on hawaiian electric, the local fire company. alleges that they did not deelectrify lines and ignored weather warnings warnings about high winds and red flag fire danger warnings. they declined to comment on pending litigation but said it's focused on providing electricity to the west side of maui. the governor ordering an investigation into what caused the fire. saying 80 mile per hour winds caused what he called a fire hurricane. >> that meant that fire travels one mile every minute, resulting in this tragedy. with those kinds of winds and 1,000° temperatures, the pictures are easy to understand. >> the town is devastated by fires, unsafe and still recovering bodies. an entire family of four was identified as victims. an overnight curfew from 10:00 a.m. to 6:00 p.m. with access during the day limited to residents and people with hotel reservations. more than 2700 buildings were destroyed. the vast majority being houses, with so many people without homes the need is immense. the county estimates around 4500 people need shelter and many waiting for word of loved ones still missing. >> it's been so hard, very hard. never -- i think in my life would i have imagined that we would have something like this. >> lahaina itself, i cannot describe -- the feelings i get. >> meanwhile, the death toll is expected to rise. hundreds are still missing. people here on the island are urged to give dna swabs to help identify loved ones who might still be victims. back to you. >> john: let's hope a lot of those people simply got out. max gordon, thank you. >> gillian: to help hawaiians impacted by the wildfires, redcross.org/fox, and text 90999 and make a $10 donation. >> john: every little bit helps. hunter biden could be facing the threat of a trial after the collapse of a plea negotiation last month and new charges may be on the horizon after attorney general merrick garland granted special counsel status to david weiss. hunter's legal team is saying a trial is not inevitable. byron york, chief political correspondent, and fox news contributor. first of all a general sense, appointment of david weiss or elevation of david weiss to special prosecutor, some people are saying this means the investigation could go in a lot of different directions. some say it gives the doj an excuse to say we are in the middle of an ongoing investigation. we cannot comment when congress wants information. >> both of those things can be true. certainly the doj is going to say to republicans in congress sorry, we can't talk about it, it's an ongoing investigation, we just can't discuss it. on the other hand, a special counsel weiss could go off in different directions and could look at the links to joe biden, hunter biden's business links to joe biden, that are the most important thing here. now, we all know that david weiss was always claiming he had this authority and so why did he all of a sudden last week ask for it. but put that aside, going forward if he were to pursue it he has the ability to do so. >> gillian: over the weekend, hunter biden's newer attorney said there are no criminal charges, what going to change going forward as a result of this is the scrutiny of the accusations against hunter biden. that's a good thing, right, for everybody who is not hunter biden? >> you would think so. actually, they are making an interesting argument, which is remember this plea deal where it all fell apart in court, they were in court and they had this plea arrangement for not paying your taxes, and then this thing called the diversion agreement. and kind of tricky thing, they had hidden in the diversion agreement an agreement not to prosecute hunter biden on virtually anything going forward relating to that period of time. now his lawyers are saying we know the agreement was not affected by the judge, does not have to be approved by the judge, justice department signed it, it's still in effect. we still have a deal. so, it's going to be interesting to see the back and forth between hunter biden defense team and the justice department over that. >> john: the doj has asked the judge noreika to vacate the plea agreement but hunter biden's defendant said defendant through counsel accepted the prosecutor's invitation to discuss in settlement negotiations they understood would resolve the government's five-year investigation as is customary in negotiated resolutions, prosecutors not the defendant or his counsel proposed and largely dictated the form and content of the plea and diversion agreement. so, hunter biden's attorneys are saying don't look at us. the doj handed us this thing, raises the question, how did it ever get drawn up in the first place? >> unintentionally funny washington post editorial out today saying it might be that some of the republicans who complained about special treatment from the justice department had a point. there's no way you can understand that the justice department would forego any future prosecutions of hunter biden on anything they might discover during the years where they already know and believe that he committed tax crimes. but they did. so that was in this agreement, and there again you quoted the defense team, a deal is a deal, you signed it, you can't prosecute us. >> gillian: we know from living through special prosecutor robert mueller's investigation to former president trump that at least sometimes as a result of living through a special investigation the public comes by way of a lot more information that would be made public as opposed to this remaining the criminal proceeding it was before, certainly with the plea deal. do you anticipate that happening here, do you think congress will be more informed and by extension, the american people? >> i think we are all going to be more informed. if it continued as before and david weiss was the u.s. attorney he could have closed the investigation and not said anything. but the special counsel has a report requirement. he has to write a report and give it to the attorney general. and the attorney general would be under intense public pressure, which he would cave to to make it public. >> john: jonathan turley is voicing concern he named a special prosecutor from outside the doj, not just elevated the u.s. attorney and asked if it was expanding. jonathan will be joining us the next hour. >> he knows everything. >> john: and you do, too, why we have you on. >> gillian: gas prices eight-month high, creeping closer to $4 a gallon. energy experts are saying the recent rise is primarily due to the jump in crude and the latest production cut by opec+. >> john: my 12-year-old twins love to pump gas, a great way for me to ignore what's going on at the pump. >> gillian: and be in denial. >> john: i give them a credit card and go for it. >> gillian: what about on the boat? >> john: we have been out twice this year, maybe burned two gallons of gas all year. so many other things to do. tens of thousands of dollars in merchandise gone in the blink of an eye as flash mob robbers hit stores in los angeles. how the city's democratic mayor is responding. >> gillian: and crime also impacting downtown san francisco streets and federal employees who work there are being told to stay home and work from home for their safety. leo terrell is fired up about that. he's on deck next. psoriasis really messes with you. try. hope. fail. no one should suffer like that. i started cosentyx®. five years clear. real people with psoriasis look and feel better with cosentyx. don't use if you're allergic to cosentyx. before starting get checked for tuberculosis. an increased risk of infection, some serious and a lowered ability to fight them may occur. tell your doctor about an infection or symptoms or if you had a vaccine or plan to. tell your doctor if your crohn's disease symptoms develop or worsen. serious allergic reaction may occur. best move i've ever made. ask your dermatologist about cosentyx®. veteran homeowners to combat today's rising prices. lower your monthly payments with the three c's: pay down your credit cards, pay off your car loan, consolidate your debt with a va home loan from from newday. after switching to the farmer's dog we noticed so many improvements in remi's health. his allergies were going away and he just had amazing energy. it looks like nutritious food, and it is. i'm investing in my dog's health and happiness. get started at longlivedogs.com the first time you made a sale online with godaddy was also the first time you heard of a town named dinosaur, colorado. we just got an order from dinosaur, colorado. start an easy to build, powerful website for free with a partner that always puts you first. start for free at godaddy.com i'm sholeh, and i lost 75 pounds with golo. i went from a size 20 to a size 6. before golo, nothing seemed to work. i was exercising for over an hour every day. it was really discouraging. but golo's so easy, the weight just falls off. >> my count, three times in the last three weeks. so it's becoming frighteningly routine for l.a. area stores and shoppers to find themselves caught up in these kind of flash mob robberies. the latest incident happened just after 4:00 p.m. saturday, browed daylight at a high end store, at a high end mall. about 30 miles northwest of downtown l.a. up to 50 people were involved in the robbery, clearly organized and planned. the mob, most dressed in black, burst into the nordstroms store at the topanga mall, and bags, shoes, clothes, the main targets. they took off with goods worth up to $100,000 and escaped in cars whose license plates had been removed. the l.a. mayor bass said those who committed these acts and acts like it in neighboring areas must be held accountable. the los angeles police department will continue to work to not only find those responsible for this incident, but to prevent these attacks on retailers from happening in the future. and these kinds of robberies, as i mentioned, have happened at other malls recently, and a store at the americana store in glendale hit august 8, $300,000 worth of merchandise taken and july 31st thieves burst into a jewelry store in irving, $900,000 worth of goods. lapd acknowledged the communities are feeling up safe and officers will do all they can to find those responsible for saturday's nordstrom mayhem. but john, as yet, no arrests as far as we are aware have been made. >> john: we'll see if karen bass makes good on her vow. jonathan, thank you. gillian. >> gillian: violent crime and street drugs have workers in san francisco worried about safety. it's so bad that officials are saying at the nancy pelosi building it's safer to stay home and work from there. leo terrell, a fox news contributor. leo, they are calling it now the san francisco doom loop. take a look at this, outtake from a government memo by the san francisco chronicle, this is from the officials there in light of the conditions at the federal building, we recommend employees maximize the use of telework for the foreseeable future, work from home. this recommendation should be extended to all region 9 employees, including those not currently utilizing telework flexibility. i guess it's a solution if you are one of the government employees who works in that specific building. i don't know about the rest of the city. >> no, no, gillian. respectfully, its it's a surrender. the federal government could protect the building and the outlying area. let's be honest. george soros' money is more important than public safety. san francisco city is in total chaos because of crime, because the george soros' money and the progressive left, sandra, gillian, want to dismantle the criminal justice system. they think it's racist. you cannot tell me that law enforcement cannot stop this crime. the crimes are going on around the government building and in san francisco. but they allow it to happen they believe the criminal justice system is racist. that's not true, and again, it's george soros' money. >> gillian: you are saying prevention would be a lot better for the entire city in this case than trying to have employees stay out of crime-ridden areas all together, right? >> well, gillian, we have a significant update to a cartel-related story we brought to the viewers last week. right into the photos, this was last tuesday we reported exclusively on the photos of three cartel gunmen who had rifles and body armor as they were seen crossing into fronton, texas. two of those gunmen have been arrested after they were crossed illegally in the same area with guns again. right into the brand-new photos, courtesy of law enforcement sources who tell us that these two men are mexican nationals and confirmed members of cartel del noreste, they had magazines, several magazines, 556 ammo on them, and military grade green-tipped ammo. and they found guns ditched in the water, one was ak-47, the other m-4, both rifles were loaded and texas dps says it's a huge reason why it is so important for the feds and the state of texas to work together to catch guys like this. released a statement says in part, there is no greater public safety and national security threat than the mexican drug cartels who have exploited security vulnerabilities due to an unsecured international border. this joint effort highlights the importance of collaborating with local, county, state, and federal agencies for one common goal, keeping our state and country safe. and back out here live, the first images from last week, three gunmen in the photos. the third individual was with them but he jumped into the water and swam back to mexico and was able to escape and while all this was going on, texas dps says just up river from that location, the mexican military was engaged in a gun battle with suspected cartel gunmen. so that part of the border is very, very active when it comes to cartel activity. these two guys at least now in custody. pack to you. >> gillian: quite a tale. thank you, john. >> john: joe germanotta, restaurant owner upper east side and father of lady gaga. it's been said many times every state is now a border state because the illegal migrants are being bussed hither and yon across the country, whether it's the federal government or the border governors and hitting home in your neighborhood. down the street from where you live, what was the stratford arms hotel, formerly single room occupancy motel and served as a resident hall for the american music and dramatic academy is now a migrant shelter. what's happening down the street from you?
