package and this is the house looks to vote on a bipartisan infrastructure plan with deadlines to prevent a government shutdown and raise the debt ceiling. >> john: the biden administration concedes the fate of the president's agenda is "precarious." the president looking for a middle ground over his massive tax and spend plans. in moments ago, senator joe manchin saying he wants a $1.5 trillion package, a lot less than what the president wants. >> they voted pretty consistent. i don't vote any of them if they are much more progressive or much more liberal. but i'm not asking them to change, i am willing to come from zero. >> anita: fox team coverage, bret baier will join us in just a few moments and chad pergram has a latest on capitol hill. >> john: will but we begin this afternoon with white house correspondent peter doocy. how do things look there? >> so far they look quiet and you know how these things go. you don't hear a lot from the president if he doesn't have some good news to share with the people or with members of his party. and as of right now it's a sign of things not looking so good. no public events on the president schedule. but a few moments ago we got some rare insight from joe manchin about the president's negotiating style or a lack of negotiating style because joe manchin has really been getting worked by biden for the last couple of days and by biden's top staffers. he revealed to reporters on the hill that the president never asked him to betray his values. and that's consistent with what we heard for the last few days, the president was not whipping boats. he was not trying to usable power of the office to get people in line for this infrastructure package and that climate and social human infrastructure package that they were trying to get through at the same time. he was just hearing people out. but there are some new questions about why exactly the white house continued to push for this human infrastructure package attached to the physical infrastructure, and a total of three and a half trillion. since the end of july, he knew he would not go above one and a half trillion dollars. and he was shaking hands with members of both parties. they have enough votes, and they have enough to do this. and that's possible at least today. >> john: we will see how it goes. >> anita: prospects for the bipartisan infrastructure deal, as you hear from peter as more progressive democrats, and for congressional correspondent chad pergram is live on capitol hill. >> when he was asked if he was sure that it passed jenny hoyer replied "nope" but house speaker nancy posey was more confident and assured liberals that they would eventually score a generational bill. >> so we will not have a reconciliation, but we will have a reconciliation bill. that is for sure. >> even if the bill shrinks to say to trillion that may not be enough for the left. 3.5 trillion is "fiscal insanity." >> i cannot accept our economy or basically our society moving towards an entitlement mentality. but you're entitled, i'm more of a rewarding because i can help those who really need help if those who help themselves can do so. >> critics call the bill a welfare state with free health care and free college. manchin says he's going to spend 3.5 trillion but says if liberals want more they should have left more progressive's. now manchin told the president that he wanted to spend less and biden said he wants to spend more. why is it manchin's upvotes so important? the democrats meet all 50 members to stick together otherwise it can't process on it. left-wing protesters heckled manchin at the capitol and called him a traitor. >> anita: we will see how they bridge that divide. in q and keep us posted. chad pergram on the hill. >> john: bret baier it is coming up but first let's go to capitol hill. >> if you go to buy a house, you don't put down an offer and then before an offer has ever been put them on the table suddenly say i'm willing to go down a hundred thousand. has anyone done that? i don't think so, that's not how we negotiate. we said consistently, 4 percent don't like it, and we understand we all have to come to the table so tell us what you want and we will figure out whether or not we can get there. >> thank you, congressman. >> john: just picking her up at the end, of course negotiations on that reconciliation bill continue. for more on this, let's bring in bret baier, the anchor of "special report." in terms of the bill, senator joe manchin of west virginia laid down his line. was by what he said. >> i believe in my heart, believe that we have right now and what we can afford to do, without changing our whole society. >> john: so he said he came from 0-1.5 and bernie sanders is saying i came from six to three and a half. there's a lot of daylight there. >> there is. this is in trouble. it's clear on the reconciliation bill. we don't know that manchin is at a firm, that's his final offer at 1.5 trillion and they are negotiating still. but let's rewind. when you hear the progressive caucus chair say that they are in the process of negotiating and they are not going to say how far down they will go, that means they are coming down and we are no longer at 3.5 trillion for the reconciliation bill. and another thing just for perspective here, you've got, let's say it's 1.5 trillion for reconciliation, you have 1.2 trillion for the infrastructure bill that you are supposed to vote on today and then you have 1.9 trillion for the covid relief that will pass for reconciliation in march. i remember the good old days when tarp was $800 billion and everybody said, holy cow. this is the most amazing number we've ever seen we are now in between 6,000,000,000,004,000,000,000,00 0 and that's where this debate is. >> john: it stunning. the part we missed before she was on camera and microphone, she said we will not be able to vote for the bipartisan reconciliation bill until the reconciliation bill has been passed. which means progressives are in place. that means a bipartisan infrastructure bill may go down. a short time ago, joe manchin warning that if that bill goes down it could spell trouble for the reconciliation bill negotiations. >> what happened to negotiations today if bipartisan infrastructure does not pass the house or does not come up? >> it makes it more challenging. i'm rational and on board with talking to people but bottom line it makes it hard. >> john: it's looking like both of these things are going to go down. then what happens to biden's agenda? >> it's in trouble legislatively. but will be interesting is if republicans who said they would want to vote for the infrastructure bill actually do with the progressive start vote against it. in other words, will those republicans say we need to pass this bill despite the democratic opposition, or will they say this is a loss for joe biden and we should leave it like that? >> john: mccarthy as mccarthyism with big boats against the sink because it doesn't want to link to the reconciliation. >> there are modern republicans who think is a big deal for the country. we always won one election away from the next big thing legislatively. if you push all of this 22022 it becomes exponentially more difficult because you have people up for reelection and suddenly that factors into everything. >> john: speaking of elections there's a bellwether coming up december the 2nd of this year. they had a debate the other night in which he said this about schools and parents. listen here. >> i don't think parents should be telling schools what they should teach. >> john: i don't think parents should be telling schools what they should teach. i'm sure all of his staff aides went -- one that came out of his mouth. >> the second it did i thought this is a big moment. when you saw glenn youngkin through a republican and his team put that to an ad right away that night. that's a big area especially for suburban families. mom and a northern virginia, that impacts things. in this race is within the margin of error. it's want to watch because of glenn youngkin, he's a republican winning in virginia, but could spend don't like to send to democrats around the country. speak on his discussion was wrapped around critical race theory for conservative families and voters and independent voters on families. that's a big issue. >> it's also about what's in the books inside the schools and parents standing up saying, i don't really want this graphic materials in these books and different school board meetings across virginia and that's what they were talking about. it's a big, big deal. >> john: that's a huge it groups to be sure. schools were supposed to be local and their parent-teacher organizations that are supposed to have input into what the curriculum is. so for the former governor now is aspiring to be governor for the second term think parents should me telling schools what to teach, that's against the whole philosophy of local control. >> anita: don't tell that the parents of northern virginia because i had a mouthful for the school boards as we saw over the past summer and you are exactly right. parents do want to have input into their children's education so i'm sure he wishes he could take that one back. the one i'm sure everyone in the mcauliffe cagn wishes he could take that back. >> anita: it appears that the 30,000 migrants arriving in del rio, texas, over the past month may have been just the tip of the iceberg. panama's foreign minister telling axios that up to 60,000 more migrants, many of them haitian, are set to make their way up north. the leaders slamming the biden administration over a lack of attention to the crisis saying u.s. officials were warned of the surge of migrants who gathered under the bridge in del rio and at that they engaged every authority figure they could think of to warn them. so that's really interesting. they had the morning but the migrants still came and there were about 15,000 of them under that bridge in del rio at one point. >> john: and other panamanian foreign minister warned there are 60 thousands of them making their way through what's called the darien gap in panama and don't know how many of the 60,000 might make it but the white house has been warned that there is another surge on the way. so we will see what they do without. brandon judd ahead of the national border patrol council will be joining us to talk about that and the investigation of the mounted unit that has brought so much controversy in the investigation, and that investigation be partially carried out another president biden has said whoever is responsible will pay? >> they actually can find him. my theory is, he has fled the state. he's a survivalist, he is hit the appalachian trail. i talk to people and can basically go off the grid on the appalachian trail. by now he possibly is in north carolina i would think and write there he could pick up plenty of food and then go off the grid. i was told to come up because a good friend of mine's son walked the trail this past summer and you could buy anything from the store, no internet. the likelihood of him or anyone on the trail to have a phone is nil because no internet for the phone. >> anita: what about the likeliness of using a credit card, how long can he last without being tracked in some way? unless he has lots of cash. >> i think he has a lot of cash on him. i think you're smart enough to know to ditch everything he has. i think the last reported that he left as well and he left his phone, when somebody does that, some of the books he has read about being out the grade, i think he is smart enough to know, when he's going to disappear, he's going to disappear. so the police and the fbi need to start looking at different leads that they get. i understand some leads in north carolina, there may be some leads in georgia. i start looking those leads because someone may have spotted him when he got off the trail. >> anita: speaking of leads, what do you think about the famous bounty hunters like dog chapman getting in on this? he says he's closing in on laundrie. >> we are covering with canines and we have a bunch of volunteers out here, most of them have former law enforcement or former navy seals and marines. >> anita: maybes on to something and maybe he's not. but does it help or hurt efforts by law enforcement or dog chapman and others to jump in on this? >> it never hurts. him -- what he's doing is uncovering leads. this guy is three weeks at a bus so he may be finding spots where brian was there. so he possibly has an idea of where he was there but he's long gone outside of florida. he is not sitting in florida knowing there is a manhunt for him. if the guy stayed in florida, they got him. i don't think in this case brian will stay in florida, i think is going to flee. it's only five hours from their house to georgia, at the beginning of the appalachian trail where he could get in and disappear. >> anita: he could disappear anywhere. the latest reports show that laundrie's parents bought him in his cell phone and he left it behind the day he disappeared, and the fbi has that device now and they are taking a look at it. what could they glean from that phone? >> two thing is that why he left behind. he bought the phone, the parents have it and every place they go the phone is pinging so that giving them false leads. the second is, him knowing that anything on that phone, they will get access to the phone. everyone that has called and everyone that has called him. that could very well be at divers and on the parents part two throwing them off. everything on this case, he's out ahead of the police and ahead of the fbi. smarter than we realize because i think he's very calculated and what he does and i think in this instance that's one of the cases where he's got the phone to throw to the police officer. because if it's in the parents car and they drive away, the phone is pinging in different locations. >> anita: and like is that if he has a lot of cash he could last for a while. pat diaz, thank you for your insight on this case. everyone is certainly very interested in it. and we will follow-up with you again. >> john: you know if he is up there in north carolina along the appellation trail, near murphy comic north carolina, there was already history laid out by eric rudolph that you can survive for years. eric rudolph eluded capture from 1998 through 2003 he says just living off the land in that area near where the appalachian trail goes through. the capitol hill hearing today is focusing on school safety of children return to class and vaccine mandate start to kick in. how the move could leave some students without a teacher. >> anita: and adding it all up. president biden says his plan will spend, could cost anything but republicans and members of his own party are challenging not claim. we love a closer look at the math coming up. >> jill biden doesn't have a base comic base. he was there because it became sort of an instrument to the far left and now dominates the democratic party. think wearing less makeup means no need for a wipe? >> i need to come at the top republican on the house armed services committee mike rogers said blame should not be on the military for the way the afghan war ended. >> we just have to admit this was the state department and white house that causes catastrophe, not the defense department. it will go down in history is one of the greatest failures in american leadership. >> anita: congressman mike hanson from louisiana read from the transcript of president biden's interview claiming top brass did not recommend keeping 2500 troops in afghanistan. >> either the president lied to the american people or he legitimately cannot remember the counsel of his top military advisors. >> i will look at the appropriate level of our forces which should have been 2500. >> if we left 2500 people there for a long and extended period of time eventually would have to reinforce those people because the taliban was committed to attacking. >> what did the president no, that he forgot what was told to him or was he not being truthful? >> that is an inappropriate question. >> chairman armed services committee defended the president. >> no one said we should keep 2500 there. what the president actually said was there was no option on the table to keep 2500 troops in afghanistan in a stable environment. >> i think it's a real possibility in the not-too-distant future. six, 12, 18, 24, 36 months in that time frame for reconstitution. >> left unanswered was whether the suicide bomber who killed 13 american troops of the kabul airport was a former prisoner at bagram air base. by the taliban. >> anita: jennifer griffin live at the pentagon. thank you so much. >> john: and we have more coming up on this just a head to alaska senator dan sullivan who is questioning the military leaders about accountability. we will be joining him in just a few minutes. president biden and the democrats pushing the claim that biden's sprawling spending plan will cost $0 as congress gears up to potentially build on the infrastructure bill. our next guest says the true price of the bidens a build back better agenda could add a whole lot of money to our debt. market goldline is a senior director of policy at the committee for responsible federal budget and he joins us now. mark, your organization first raised alarm bells about this back in july saying democrats claimed it would cost three and a half trillion dollars and be $0 added to the debt. you are saying the total cost of this, we will put it up on the screen, could be 5-5 and a half trillion dollars and could add four or more trillion dollars to the debt. what are democrats, mark, not telling us? >> the truth is we don't know because we don't have a final package but what we do know is they've made about three and a half trillion dollars in promises. or they are going to play some games and cuts off of hurley which is what they said they wanted to do. in other words have a policy on the go for two years instead of ten and it costs just as much, but you're just hiding the other eight years. >> john: it's of these are arbitrary sunsets being hidden in the bill. and that's not the first time that this budget give gimmick which would obscure the true cost of legislation was rightly criticized in 2017 and it would be unwise and irresponsible to use arbitrary expirations and sunsets to obscure the true cost of the legislation. you know, maia mcginnis who is the president of see if rb went so far as to say if you look at the true cost of this bill you shouldn't be able to do it through the reconciliation process because it would add to the debt outside of the 10-year window. >> that's right. in fact often times the reason these expirations are used is special rules that don't allow you to add to the long-term debt. we wouldn't have to worry about the silly games. >> so you are also seeing an organization that contrary to the democrats claimed, this bill cannot be fully funded by taxing the wealthy. talk to us about that? >> what this could be fully funded if they were willing to raise taxes enough. but what we've seen from the house is about $3 trillion with tax increases and some of those are not going to make it through the senate if they are not politically viable. but even if all 3 trillion makes it through it's not going to cover the three and a half or $3 million claimed cost and its not going to cover the five and half trillion or so true cost of development. >> so the way that the democrats are trying to sell this to the american voters is to say, look. it's a lot of money, three and a half trillion dollars. it's a a tremendous amount of money but it's not going to cost anything that will be zero cost to the taxpayer. listen to what they said. >> the dollar amount of the president said a zero. >> it is zero price tag on the debt. we are going to pay for everything we spend. >> john: in a "wall street journal" op-ed at gerard baker rode this. joe biden's economic fantasy world. he seems to think that if you pay for something it doesn't cost anything. why hold onto your wallet. this is a novel way of estimating the cost of something, that i watering the expensive dinner last week didn't really cost you anything because you paid for it. the biden bill is paid for by the largest tax crease, increase in history and you are entitled to argue that if the cost worth paying but you can't argue that it costs nothing. so this idea that it cost nothing. what does literacy frb say about that? >> there's the tax break and theirs and that cost which was the ultimate obligation to the debt. both of those concepts are important for different reasons and in the fiscal hocker group we care more about net cost but it's not wrong to say here is three and a half or four or four and a half, some of which will be paid for it. i take the president at his word and his commitment that they are going to get this net cost down to zero but so far the legislation isn't reflecting that. so far there is some significant borrowing in this bill. >> john: is with this thing were to pass at three naturally dollars in addition to the 2,000,000,000,001.9 trillion income of the $400 billion is in the bipartisan infrastructure bill, what's the long-term impact on this? because that would soar to 130% of gdp. >> we've run some of these numbers. under the current trajectory that that is expected to raise to a new level by the end of the decade. about 107%. if you enact all of these bills and all the potential extensions and we do all the gains they we think they well, we are talking about debt levels that could be as high as 130 or even 140% of the gdp by the end of the decade which would be astronomical. >> john: and it would never ever be paid back and would be a burden on our children and our children's children. my goldline, thanks for laying it out for us. we really appreciate it. >> anita: john, a massive new surge of haitian migrants already better than many cities and growing larger by the day making their way to our southern border. the biden administration seems paralyzed. the president of a national border patrol council brandon judd joins us. >> john: about first brand-new reactions to the hearings on afghanistan. america's top generals contradicting their commander in chief. will there be any more fallout from that? >> the hearings yesterday, i think the two main takeaways from that is this foreign policy fiasco and you are listing one of the reasons on the weapons but this entire fiasco is president biden's. he owns this. and you saw yesterday in the hearing where the general said that they did say let's leave a residual force. that was their advice to the president and not only that but they predicted the catastrophe that we would see. so, joe biden owns this but here's something else that came out of this which is to me very disturbing. the president is clearly not leveling with the american people and you just mentioned on one of the big ones. he mentioned just a month ago that none of us of military advisors told him to keep forces in afghanistan. we know that that is completely not true. he mentioned that al qaeda was gone from afghanistan and that's not true. he told the american people he would keep the military and afghanistan until every american citizen who wanted to get out, got out. and that was not true. and here's the big one. he's been saying that this was "an extraordinary success. general milley, the chairman of the joint chiefs yesterday in the hearing or two days ago in the senate hearing said that it was not an extraordinary success, it was a strategic failure. so these are not minor misstatements that the president has been telling the american people, these are fundamental falsehoods and they are lies in the most critical aspects of this fiasco. one thing i was pressing them on was who is responsible and who is going to be held accountable and right now i think it should be joe biden. but there's been nobody. >> anita: mark milley so the taliban is still a terrorist organization, they still have ties with al qaeda and al qaeda and isis could reconstitute as early as next spring. that's very scary. which of the u.s. be doing to prepare for that? >> john: the military leaders in this hearing two days ago in the senate were very clear about the threat that you just mentioned. at that al qaeda and others, isis and the heck connie network will be reconstituting. we went after afghanistan and 9/11 to make sure it would never become a safe haven for terrorism again. the way in which this chaotic withdrawal happened, it ensures that it is. now, it's once again the world's haven for terrorists. what we continue to do in the senate is continue to press for oversight. as a matter of fact we had a hearing in the armed services committee just this morning on this very topic. both the witnesses, the democrat and republican witnesses in front of the armed services laid out how this was a catastrophe. and we introduced it earlier this week, the afghanistan counterterrorism oversight legislation, which will be focused in the way in which we can, accountability has to come in the executive branch. >> anita: there were also a lot of questions about a new book coming out and general milley reacting or reaching out to china about how stomach whether president trump was planning an attack. let's listen to this exchange. >> these are two great powers and i'm doing my best to transmit the president intent, president trump's intent to make sure that the people are protected. >> i understand your intent but i think that's worthy of your resignation. i think that's against our country and you would get our number one adversary that information. >> since when do we warn other unfriendly nations about our military plan, is that appropriate? >> i press general milley in this senate hearing on this very topic. it is a couple issues here. the senior military leaders regularly have contacts with other military leaders including some of our adversaries or russians, the chinese, i think having those lines of communication, that's important. but what i had mentioned to general milley was, do you think that if the chinese military leaders somehow said, they would give us a heads up before they invaded taiwan, do you think someone in china would do that? obviously the answer to that is no. xi jinping wouldn't allow that. i mentioned xi jinping would probably shoot it general that did something like that. so what's happening now isn't general milley saying one thing in the book is saying another thing, it's an important issue to continue to get the details on. all of this came out in the hearing out again we will keep pressing for the details on these and i do think we need to stay focused on afghanistan. that foreign policy fiasco that the president solely owns will have ramifications not just for terrorism but as i mentioned in the hearing today i think other countries will test us. i think russia, country and iran will test us because they are testing our credibility and would better be ready and we better be strong. >> anita: and senator dan sullivan, thank you so much for your insight. >> john: is a breaking news to tell you about, it looks like there will not be a government shutdown at midnight tonight because the senate has got the vote to pass that stopgap spending bill that would fund the government through the 3rd of december. a bigger fight though is still in the works over raising the debt ceiling and of course the bipartisan infrastructure bill which is up for a vote today and then there's that three and a half trillion dollar reconciliation bill. they've got something done today but there's a lot still to go. >> a lot. amid plummeting poll numbers and facing crises after crises, president biden is getting a mix of cheers and it tears at last nights congressional ball game. how much trouble is his agenda facing? >> i don't know any of them that believe they are much more progressive and much more liberal. and all we need to do, elect more liberals. i'm not asking them. >> we also heard from the chair of the house progressive caucus today who said she's not willing to budge on what they believe was a deal to first past the reconciliation package and then to get to bipartisan hard infrastructure bill. >> now that joe manchin has laid down his marker, 1.5 trillion, will progressives note counter with another number? >> those negotiations are going on as i understand it at the white house. the speaker has committed to us that nothing will be agreed to because she knows that we have to sign off on it. >> the senate today avoided a major issue, avoiding a government shutdown by approving the continuing resolution to get the government funded through december 3rd. but that does not solve a looming debt crisis. they did not include a measure to raise the debt ceiling and avoid the government completely running out of money and that was what treasury secretary janet yellen was here on the hill morning house members today that that is something that could push the economy to the brink. right now the u.s. has a lot of bills to pay as this debt limit looms. the u.s. is facing an estimated 20 billion in social security payments on october 20th along with around 6 billion in individual tax refunds and another 49 billion in payments through october 29th. so the bills are coming due, but it is still unclear whether or not republicans in congress are going to get on board and help democrats raise the debt ceiling to avoid a debt crisis. >> we will be keeping an ri on that. good job hilary getting in there and pressing and senator manchin. $1.5 trillion, 2 trillion less than the democrats want. we will see where that goes. hillary vaughn on capitol hill. >> john: for more on this, let's bring in texas senator john cornyn. here's what he said earlier in the day as to why that's his number. what i made clear to the president and democratic leaders is that spending trillions more on new and expanded government programs only can't even pay for the essential social programs like social security and medicare is the definition of fiscal insanity. it really is a shot across the bow at progressives in the democratic party. >> and john, joe manchin has been consistent and i agree with him. and that's the reason why we are doing every thing we can to stop this reckless text spending spree called reconciliation. the democrats hide this bipartisan infrastructure bill that's passed in the senate to pass into the reconciliation bill which is not going to happen, i believe. so now they are threatening to take down the infrastructure bill that does have broad bipartisan support. >> john: let's back up a second. you say you agree with that joe manchin has principles. let me see if i can ask you -- do you agree with him on the 1.5 trillion? >> i do. i do not agree with him on that figure but first of all we can't continue to add to our debt. we did that during the covid-19 crisis and we did so on a bipartisan basis because it was necessary. but now democrats want to continue to borrow more money and spend recklessly and raise taxes on things that are not emergency spending. they ought to spend a little more time working with us and trying to build consensus rather than to do things by themselves. >> john: also is there no way no how that you would support a reconciliation bill if it wasn't maybe less than what senator manchin is proposing? >> i don't know of any figure that i would support. the reason they are using reconciliation of courses because they refused to do things on a bipartisan basis. my suggestion to them his truck but trying to ram things through on a bipartisan basis and let's talk and see if there's some common ground. >> john: it's went out about this afternoon is on the bipartisan reconciliation bill, $1.2 trillion in infrastructure spending and it should be an easy win for the president. this was negotiated between republicans and democrats but it looks like it's in jeopardy now because progressives are saying like bernie sanders, he said this. no infrastructure bill should pass without a three and a half trillion dollar reconciliation bill. that's the agreement that was made and that's the agreement that must be kept. house minority leader kevin mccarthy on the republican side as whipping votes against the bill because he doesn't like the fact that it's being linked to the three and a half trillion dollar bill. that almost sounds like a bullet through the heart of this thing. >> i do think it's a train wreck in them making and it's entirely predictable because our democratic friends believe i guessed that they have some sort of mandate on the last election for turning america into a european welfare state, but they did not. i think they just misread that message from the voters in 2020 and they are overreaching the consequences of that failure. >> john: is esso business groups including the chamber of commerce are looking at, we need this infrastructure bill, and american infrastructure is crumbling. we went through four years waiting for infrastructure week which never appeared. what's wrong with at least getting this part of it passed, the $1.2 trillion? >> i don't have any opinion on the infrastructure bill, but everybody believes that roads and bridges and ports of entry are important infrastructure for our economy for public safety and the environment. but it has to be done the right way which is to responsibly pay for it. but this is the democrats that are linking this reckless spending and tax bill to a bipartisan infrastructure bill which is going to do, both of it looks like. >> john: and we will see. at least you get the stopgap spending measure through the senate. senator john korner on the state of texas, thank you. one of the dangers here is that if we can't even get through a bill that had bipartisan support it raises the issue of, can congress do anything other than pass the stopgap spending measures? john: of violent crime is again on the rise here in the nation capital but yet i crime fighting plan that seem to be working is getting scaled-back. could it say it's all in the name of political >> john, it's interesting when you look over the past three years. we know gun violence continues to pummel big cities across the country, even small cities and municipalities across the country. but there was a program announced in d.c. about two and a half years ago, february 2019, that but local and federal partners to the department of justice that said we will give people stiffer penalties and then u.s. attorney jesse luoma with d.c. mayor muriel bowser looking to curb violence that would move a gun violence cases to local d.c. superior court to federal court. but now the current u.s. attorney channing phillips has the program under review, concerned about his future. carl racing wants to reportedly keep the cases in local courts jurisdiction's arguing in some cases it disproportionately affects african-americans. >> i find that unacceptable as an excuse. the black community is already disproportionately affected with crime and i think law-abiding citizens in the black community clearly would like to do anything to eradicate guns from the street. >> john: according to court documents and nearly 130 felony gun cases went to u.s. district court from local d.c. court between february 2020 this past february. the number 87 cases, but this year from figure eight through september just about 20 cases filed between those months. you can see those numbers dropping right there but they went up in superior court and we are told that d.c. police chief robert conti is in favor of this project. but privately john so people that work at the u.s. attorney's office, they say they are frustrated, they believe their hands are tied and they want this tool in their tool belt. they are told that muriel bowser despite waffling back and forth, threw some critics she says she is in favor of the program. >> john: somethings clearly clearly don't make sense. david, thank you. >> anita: is democrats bicker over the $3.5 trillion spending package critics warn that the package could have even greater cost that can be measured in dollars. republicans argue that expanding the government handouts would take away the incentive to work. eventually grinding the american economy and its culture to a halt. maine senator susan: me that case on the senate floor. >> we will not build a more prosperous, just and equitable society characterized by opportunity, dignity and meaning just by issuing government checks. the time-tested way to achieve those goals for american families is by supporting and rewarding work. >> anita: david osman's host at fox business and he joins us here on the set. david, it's great to see one person. how about susan collins, he talks about the dignity of work and there are so many studies out there on basic income and other programs that hand money to people. and that does so with the disincentive. >> and we've already seen what happens when we have some of the of work despite the fact that we have 11 million unfilled jobs. it's gone from eight, 109 come up to 11 million, even without the extra payment on unemployment checks from the feds. we still have a lot of benefits that are keeping people from working and we are losing our competitive edge. i think anyone who's going to a restaurant recently or other service industries may notice there's been a slippage. people are not as sharp, not as quick to serve as a used to be. you ask people in the manufacturing floor whether the workers they are getting at the same incentive to work as he they use to but not so. they often say joe manchin, and democrats, proposing an historic expansion of social programs while ignoring the fact that we are not in a recession and that millions of jobs remain open will only feed a dysfunction that could weaken our economic recovery. i think manchin and susan collins are exactly right. the problem with him is they are already bargaining, a trillion at a half wouldn't be so bad. in the meantime what's happening is the fed is buying up all of the debt that the treasury is issuing. the fed is buying 60-70% of all of the bonds that the treasury department issues to pay for things that we don't have money for. and out of course causes inflation because the way the fed pays for it is to get them to print money and that causes inflation. so just with the spending we've done so far, the trillions over the past year and a half were having inflation spending. you add just 1.5 trillion, i can't believe i said just before 1.5 trillion but that is what manchin is saying he could go for. that will do even more to create this process by which we have inflation. no money printing process. >> anita: and you can really feel it, the prices for everything are going up. i went to a restaurant in new york recently that i loved in the menu was like this big. they can't make normal things on the menu because they don't have enough workers. >> and that workers now have to check for vaccines. so the government mandates are providing all these disincentives for good, solid work. and that's a big problem. particularly because the chinese are not flashers, they are taking advantage of our weakness and training our workers even more. >> anita: i want to put up a quote for minority leader kevin mccarthy. putting themselves in competition with small business, and as the last year has proved, small businesses operating on tight margins are no match for the government printing press or mandate machines. so exactly what you are saying. >> john: and let's remember democrats have a long history of being opposed to cradle to grave welfare. fdr said it was a drug that could transform our working economy. at jfk was against it, but clinton was the one who signed onto the welfare reform which required the work requirement that newt gingrich was offering. they worked together with republicans in congress so there was a history of democrats recognizing the danger as manchin has of providing too many disincentives for work. and i'm worried that we are losing our edge. >> anita: really quick david, five seconds. some of the things that republicans are upset about in the $3.5 trillion human infrastructure bill, free college and for universal pre-k but there are other things, very quickly. >> there is a free college for illegal immigrants. we remembered on stage, they raised their hands and said are you for it health care? it will now they are including college for illegal immigrants as well. there's just no end as to what they are trying to do in order to buy their way into the next election and, we thought that manchin was going to be the one to stop it but it may now turn all the attention to kristin cinema, the democrat from arizona. she may be the senator who holds a line and >> they have no plan just like the last haitian crisis that we just faced. we knew those individuals were already working their way up to a southwest border and we knew that they were going to cross and we knew exactly where they were going to do it. yet, we had nothing in place to deal with it just like we don't have anything to deal with this new group that's coming up. we see large numbers of people across the board border every single day. the difference between the del rio situation is it allows the public to see pictures of what was going on. it painted a picture of the crisis that is at the border right now but when all those groups are dispersed throughout the entire is hopeless to border you just don't get that same picture for the american public. but now that we know what's going on, you would expect that the white house would have done something about it but they have nothing in place to deal with what we are currently facing. >> john: we are seeing pictures from our fox drone which the government tried to ground for a little while which brought impacts to our viewers in ways we haven't seen. alejandro mayorkas and the white house says, time and time again, the border is closed. don't come, your journey will be successful yet. 12,000 of haitians out of the bridge and del rio got released into the united states. what kind of message does that send to the 60,000 making their way through panama? >> john: if they are working their way out right now. they are clearly sending the message that you are going to be rewarded if you violate our law. and that's the magnet that is drawing out people here. it's not just from haiti. all you have to do is look at del rio and the moment we cleared all those people out from underneath the bridge, we apprehended people from senegal, gambia and gola, is pakistan. we are talking from around the world right now and we are dealing with 151 different countries, like haiti that's dealing with everything that they are facing right now and that's why you see so many people coming. his criminal cartels are able to go into countries throughout the world and are able to advertise their services and we are getting destroyed in the southwest border as we speak. >> that situation in del rio is what happened with the mounted patrol units, apparently an impartial investigation is underway but when the president of the united states says something like this you wonder how impartial investigation can be. listen. >> president biden: of course i take responsibility, i'm president. but it was horrible to see people treated like they data, courses running over people being strapped, it's outrageous. i promise you those people will pay. >> john: i saw the other day branding made some comments about that and when the president of the united states seems to put his thumb on the scale of what happened there, can you have an impartial investigation? >> very few things for my blood more than that clip right there. the president of the united states for political purposes through agents under the bus who did exactly what they were told to do. they were operating on his orders and his orders alone and yet he goes after them. no, there cannot be a fair and impartial investigation. the president of the united states has already said they will pay four of the most powerful people in this country who have already condemned what those agents did. there's no way they can be a proper impartial investigation, that's completely and totally a farce. >> john: we know the mounted units are and figure out comic and valuable when you are going over rough and rocky, particularly mountainous terrain. if they get kept in the stable as a result of this how will that affect the ability of the border patrol to patrol some of those really remote areas? and we have to go, i'm sorry. jen psaki is taking some questions on the reconciliation bill. >> they are not going to outline private negotiations are private discussions and we will let the senator speak for that as senator manchin did today. of the president sees this as an ongoing discussion or ongoing negotiation. here's what we know. we know that timelines help make progress and we cannot play out over the last couple days. we know that compromise is inevitable and we cannot play out over the last couple of days. now we are clearly in the thick of it. i would also note that during senator manchin's and honestly i'm not on his spokesperson, he can certainly speak for himself, but during his q&a that he did on the hill today that there was a document from a couple of months ago. and i will let him and at leader schumer speak to that. it was repeatedly pushed and asked, would you go higher than 1.5? i believe it to all of you to determine if you answer that question but this is an ongoing discussion and an ongoing negotiation. as i said yesterday that will require all sides giving a little and we are in the midst of that right now. >> so on that note, house speaker said stay here all weekend and work the deal. and commercial lawmakers? >> we are taking it hour by hour here, and making a determination about what's most needed. that relates to what will happen this afternoon, we are open. it's available and he's been making calls this morning. he's open to having visitors and open to going places but we will make those decisions hour by hour. so we are a little bit away but i will tell you this is the president's top priority, getting released to the american people. we are lowering the costs for american people, we are rebuilding our roads, rails and bridges and we are still at work. >> one of the presidents central promises wants to restore the american ability. what is the white house was message to the americans right now? the debt ceiling is unclear, legislation nothing past, and those americans don't feel that they can be confident. how is the white house responding? >> first i would say the president and speaker of the house and the leader have gone across the finish line more than any democratic group of leaders in history. it's a messy, the sausage making on capitol hill, policymaking is messy. they have representatives advocating for the points of view and that's democracy in action. what i can tell them is that we are on the path to keep the government open and you just so that passed the senate. it was going over to the house. that's not just keeping the government open, that's getting relief to make sure we take care of refugees, people who fought by our side in afghanistan and that's to make sure we get relief to the gulf coast, additional relief to the gulf coast and all important priorities. we would also tell them that the president is going to use every lever at his disposal to fight to get this legislation passed. these two pieces of legislation which will make historic investments and he is doing it because he wants to have an impact on their lives. but these types of packages, not a lot of precedent for them but he's going to work at it and get it done and that's what he would tell them. >> due to president strategic values unveiling on the house floor? >> we are on a path to win and i don't want to consider any other options. we are in it to win it and the president is also in it to win it. lots of time left in the day and he will continue to engage, stay closely engaged with her about the path forward. >> referred to this moment as a collection point. >> this moment as in this moment, 2:40 p.m. this afternoon or as in today? >> he doesn't have -- his topline number. >> i think the president has used this as the last several days and even longer than that, he's made some progress. seen some members come down and some members come up and you've seen active negotiations. he's actually been hard at work at them himself and what we clearly see as an agreement about the need to get this done or whether it's the infrastructure bill or the reconciliation practice -- a package which has key priority. i think the speaker referred to it earlier today about the cause of her time in public life and that's a bit of a paraphrase. i will leave you to her words. so he sees this moment, he knew that as we got closer to soften posed some timelines, these timelines can make progress. more members would be out there advocating for what was important to them, that's happening. we would hopefully see more willingness to compromise on that happening, too. we are hard at work and he's been through this before so he's not too thrown off his game. >> do you guys see a possibility of some kind of framework agreement to unlock the structure vote today? >> that's what we are working towards. >> we talk about self-imposed timelines, self-imposed real timelines for the debt ceiling. what progressives don't seem to make any sense of urgency, and it doesn't seem to feel any urgency about reconciliation. the only democrat i can think of that really has a sense of urgency is terry mccollum. it do you feel comfort of the present want this done in a certain amount of time or does he also feel that this could play out over weeks and months and still come to the conclusion that he wants? >> as i settled a bit earlier, we know and the president knows from his time in public office that timelines can help make progress. that's often how legislating happens on the hill. as the speaker -- we would disagree with that. we've had members out there advocating for their viewpoints and being very vocal about what they want to see, some coming up and some come down and that's a progress. >> does he feel that he needs to be done by a certain time, like by the end of the year? >> obviously we are trying to get it done now. we are working on it as of right now today and that's what our focus is on this moment. >> i will go back to you. >> to follow up on what was asking, what of the president want, is he asking members of congress to do on this infrastructure? is he calling progressives and republicans and asking them to vote for it or does he definitely want this boat tonight or is this all murphy trying to do things together and hope something comes of it? >> there's nothing murky about what's going on here. we understand what progressive members want to. they've been out there vocally talking to you all of you about what they want. it's clear we also need their votes in order to pass an infrastructure bill. they want to have a clear path forward on the reconciliation package and the president wants both piece of legislation to pass, that's what he wants bottom line. he wants the speaker and the leader to get that done so what he's been spending his time on over the last couple of days is having conversations with senator manchin, senator sinema and others who have been vocal about the fact that they are not quite there yet and his effort is to try to get them there. that's what they are looking for in order to support an infrastructure bill, many of the components which they support. >> if it's between the boat tonight which fails and sort of puts everybody on the record, or pulling the boat tonight and continuing deliberations by potentially upsetting moderate -- over it. >> we are working towards winning a boat tonight. we have several hours left in the day. >> and last one. republicans sort of made clear that we are not going to back any efforts, so it seems and the regulatory process, and it seems like the votes are on the table, but you are kind of pursuing this political point as a potential risk of -- >> i think it's a bit of a shorthand of what's happening but, first since you gave me the opportunity, it's not just senator mcconnell. republicans are paying, complain politics and an economic catastrophe, and playing a d.c. game. there are huge impacts here and you touched on the fact, you get the public a little test of that. 6 million jobs lost, 16 trillion in savings wiped out, those are real impacts. republicans in congress of treating this like a game. let me give you some examples. senator rick scott, and this is a real quote i will note. this is going to be a ball, i will have so much fun. that's about the debt limit. senator kevin cramer, it sort of fun to watch. and senator koerber said it republicans will use every tool at their disposal to slow democrats from doing it on their own. that's what leader schumer is working to move forward on. and honestly as you know, republicans have blocked that effort. so of course we are going to continue to press, we won't let up on that on republicans to do with responsible, to protect the full faith and credit of the united states as has been done many times in the past. it also been working to do it on their own and keep working with leader schumer to get that done. i'm not going to get into additional mechanisms here. so we will continue to press them on it. >> one of the things that senator manchin said today were concerns that he had around 3.5 number are how it would impact inflation in the economy and i'm curious, what the white house thinks of that concern and what you've done to convey that. >> we conveyed what he said privately and what you conveyed publicly which is what these packages will do is address inflation and cost over the long-term. that's one of the core reasons that people should be supporting that and if you are concerned about inflation that's exactly the reason you should support those packages. >> with the president signed a reconciliation bill that would include -- prices? >> the president feel strongly about that, and he wants to make prescription drugs more affordable to the american public. >> and jake sullivan's conversations in saudi arabia, what is this message, paying a dollar more for gasoline? >> i know someone asked about this the other day and obviously the focus of his trip was on yemen and working with the saudis on yemen and tim lunger king joined us in those meetings. he was -- obviously the price of oil is of concern and we've been in touch with opec and i haven't had a chance to get a read out beyond that. i could try to do that after the briefing. >> putting the top line have they talked about what they want and do not want? does the white house have a clear understanding of what it is that each one of them wants? >> without a lot of private conversations with both the senators about what their priorities are, as they've said publicly. what their priorities are and what that looks like in a final package, the still an ongoing discussion. >> are they asking for the same thing, are the two of them on board? >> i will let them speak about their priorities and how that lines up with each other. was a president worried at all about eroding trust in that the republicans who signed onto the bipartisan deal after he reassured them that it would not be conditional on reconciliation? >> let's remember what's actually going on on the hill. republicans in the house led by kevin mccarthy are opting to vote against roads and railways and bridges. so i think if you are asking about trust or whether people are delivering for the american people you should directed at kevin mccarthy. >> i think the progression has been made so clear, without a vote on reconciliation, why doesn't the president asked them to treat them separately? to focus, and he also has made clear he wants to get them both across the finish line. but we are talking about now is the legislative process and how you get the majority of votes to get both of them done and that's what they are working to negotiate and unify the carcass around. >> at the national school board association affects a letter to the president, asking for help from federal loans or federal agencies because of the violence and of the threat that they are seeing across the country. as a president receive that request and are you considering offering that help? >> first we take the public officials very seriously and these threats to school board members is horrible, they are doing their jobs. obviously they are going to be different law enforcement authorities and where this happening so we would certainly refer this to them about any specific threats and things they face with local and state law enforcement agencies and more can be done from across the administration but a lot of this will be local law enforcement and how they can help ensure these schoolboard members feel feel protected. >> has a president at all lost control of his party, from any perspective you are looking at this from, you have some people say that it appears that progressives are running the show and banding together and other people are saying it looks like joe manchin is making plain president. >> that's how democracy works, how it works is the american people elect their elected official, the president of the united states puts forward a bold and ambitious proposal and everyone negotiates. and they have different points of view which is how democracy should work. we are in the midst of it right now and we are not trying to paint over how messy it looks from the outside, we know that. but what the good thing is is there is an agreement among most democrats if not everything to one of them that we need to get something done, that we need to do more to rebuild our roads and railways and bridges and we need to cut costs where they make in people, we need to address the climate crisis. there they are in agreement on that. we are at the end stage of this process and the american people should know that that's what the president is working on. >> if the bipartisan bill failed, it would appear that these two bills cometh reconciliation and the infrastructure are linked. the president made a statement that republicans should be able to vote for the bipartisan bill, and if he stood in front of the bill with a group of republicans who negotiated that infrastructure bill, is there a message that he has for those republican senators who voted to pass that bill on its merit of this bill is somehow not linked with the reconciliation because of its happening in the house? >> it's because it doesn't have enough votes. i think republicans in the sun i understand that and know how this process works. but that's what we are working towards now and that's what the president has been making phone calls about. that's what we have the schedule cleared for this afternoon and i'm not going to make a prediction of how the outcome will look several hours from now. >> the vice president, why isn't she on the hill working to broker this deal? >> of the vice president had the chc over last week and she's been making calls herself. like the president, if it's constructive for him to go to the hill or her to go to the hill, they can do that. all hands on deck, and you get through these intricate details and that's where the focus is in this moment. >> since we haven't seen the president much publicly, you talk about leaving room in the schedule, and you paint more of a picture of what's happening? >> john: it will jump out of the white house briefing after jen psaki is questioned. she says when i try to paint over how messy this looks right now we are working toward victory and that the president, i need that's quite a schedule for the afternoon to work both as much as he can. we heard he is talking to people but not trying to whip the votes and the question is, is this going to go to a vote or will they pull it and hold it for another day? >> it so interesting john because the white house is taking it hour by hour, but it seems like more minute-by-minute because they are so far apart, the democrats and republicans, according to joe manchin. at least $2 trillion apart and nobody would know better than you what they are thinking inside of the white house. it seems like a lot of compromising has to be done before they can get to the vote. >> john: if you have so far apart not just democrats and republicans but democrats and democrats because bernie sanders has said he wants a $6 trillion bill and members of the squad have suggested it should be closer to seven. president now has it down to 3.5 and joe manchin is saying not a penny over $1.5 trillion so there is a lot of daylight between the sides. joining us now to break this down further is our white house correspondent peter doocy. if you are a betting man, and you had a dollar to put on this, would you say this bipartisan bill passes or fails? >> i think i could probably drive to atlantic city and back after placing some beds and would probably still wouldn't know. so i don't want to say what my own opinion is but a lot of what jen psaki is saying on behalf of the president, in the first administration reaction that we have gotten all day, since we found out that chuck schumer and -- knew that joe manchin was essentially not going to come along with the three and half trillion dollars, but as part of this climate and human infrastructure package, jen psaki says it's like this 2:00 hour today, a lot more hours left in the day. yes, there are a lot more hours left in the day, nine hours almost. but this is a huge multitrillion dollar negotiation that they are trying to do. it has taken months until this point and no one has said anything on behalf of the white house that makes it seem like they are close. and we are not hearing a lot of confidence about this happening today from officials. this is a white house where they like to plan things out in advance. they always have a message plan and a strategy and that you can't really have a plan or a strategy when things are out of your control. and that's what we are seeing right now the podium. >> anita: peter, i've got a question. when it comes to the negotiating going on and on the human infrastructure bill, what might the progressives be willing to give up? we are hearing about things like college, free college for illegal immigrants. might they be willing to come from eyes on some of those things? >> it's interesting because white house has been insisting for months. yes, the three and a half trillion dollar plan actually costs $0 and if that was true then none of this would matter because it's all about money today then it is about the actual things that are going in it. the claimant priorities, the child care. and it's not clear because when the progressives are asked about this they say they are not moving. they haven't been told anything different and they haven't been given a counter proposal. they thought they were going in today i trillion dollar package to give a thumbs-up or thumbs down on and that part is deftly not happening today. now this infrastructure package, the hard infrastructure that had bipartisan support that nancy pelosi and chuck schumer said, if you want that, we have to do what we want, too. it might just all be going down today. again the officials here have had a very, very hard september. with everything at afghanistan on the border, they are looking for something to count as a win and they might have to start looking elsewhere. >> john: you make a very salient point here, we got 25 seconds left, they've been negotiating this thing for months. how did they get some sort of agreement and the next nine hours?
