>> i'm happy to get a rundown for you from department of homeland security. >> john: remember michael mccall will weigh in on this. >> dana: first to bill, on the ground reporting in del rio, texas, for us. bill, we just heard a lot from the administration. not sure if they are the answers most were looking for. >> yes, we did hear a lot and i think we've got to put an asterisk next to psaki's comments. she says they are titling 42ing a lot of of the families coming across that hasn't been the policy for the past six months and agents on the ground here in del rio are telling me they are involved in the transport and processing of these migrants. they are letting go of pretty much all family groups and units. what's the difference between the two? i'm told a family group is a couple where the woman claims to be pregnant. a family unit is a cup what has a young child with them and as you heard peter questioning her, all pregnant win, all women who claim to be pregnant are being released although they are not giving pregnancy testing unless they give their permission. the population of the camp is decreasing significantly. it's now at 3,800 down to 15,000 on saturday. >> all morning long they have been clearing out the structures they have built. about 1,400 migrants have been deported back to haiti. then there are about 4,000 still left and they say they are putting 3,200 in either removal proceedings or in other border patrol facilities so that leaves about 5,000 unaccounted for. some likely went back to mexico. as you see this heavy equipment tearing down this camp as more people are processed out. some of the people likely went back to mexico when they heard there was a chance they were going to be deported. we're still waiting to hear where they went. when you hear removal proceedings it sounds like they are going to get removed. a way of saying they will likely be removed -- what psaki is not telling you, we'll track them with biometric information and fingerprints but what they forget is back in february when biden came in they changed isis policies. they changed isis policies and directive to only go after national security threats and aggravated felons for the most part so when you have hundreds of thousands of people being released with court dates ice doesn't have the manpower or resources or the back of the administration to go back after those people who potentially skip a court date. we've been talking about del rio this whole time. there is a heck of a lot of area along the southern border that's not being talked about. look at this situation out of el paso, texas. human smuggling a massive problem. this is near the port of entry in el paso. they stopped a tractor-trailer and found 131 people being smuggled inside. not just a heat risk but also a covid risk. security issues along the border. take a listen to this exchange yesterday as congress pressed the dh secretary on his job performance as secretary. >> the question is, is the border more secure now under your leadership? >> congressman, it is no less secure than it was previously. >> and those comments right there will likely raise some eyebrows. you have two straight months of more than 200,000 migrants coming across our southern border. well over a million people this year so far potentially on track for two million. remember, the secretary won't even call this a crisis. he calls it a challenge they are addressing. but last month fox news obtained a audio of him in private where he said this is losing, it's unsustainable and we can't continue. >> moments ago, when psaki was asked, the border is closed. but all indications is it's not. >> thank you. >> john: let's bring in michael mccall with more on this. let's just run over the numbers. you heard bill talk about it. let's put him up on the screen, congressman, so people at him can see. 1,401 of the haitian migrants have been returned to haiti. over 3,000 turned over to custody for either title 42 expulsion or removal proceedings. 3,881 remain at the del rio bridge. there is a total of 15,000 at the bridge so clearly we don't know how many have been released into the country with notices to appear. congressman what are you hearing on that front? >> we asked the secretary that question yesterday. he couldn't answer it. he doesn't know the answer, the numbers himself. if they have a claim for political asylum under our laws, they can go through that process, but we were told they were all going to be deported. that they had six planes leaving per day. remember, most of these haitians are from brazil. they got word from the biden administration we have an open border policy. come in. this is symptomatic of a bigger problem and it's the fact that president biden rescinded the migrant protection protocols that president trump put into place and these asylum cooperation agreements remain in mexico, policies that were working. i asked the secretary yesterday now that the supreme court of the united states has ruled that you have to reinstate those policies, will you follow those orders of the highest court of the land, and he told me yes, but we'll see. >> there doesn't seem to be any plan immediately to reimplement release in mexico. we'll see what happens on that front. in the meantime democrats are focused on some of the images we saw from earlier this week of border patrol agents and how they were dealing with the migrants coming across the border. maxine waters weighing in. listen here. >> haitian laws are -- black lives. the biden administration must immediately halt all deportation of haitian migrants. >> i'm not happy with the cowboys using their whips. i'm unhappy with the administration. >> they are pushing this idea that they were using split reins to whip migrants coming across the border. as a result of that the mounted units have been pulled back to the desk. what's your position on that? >> i've been down to the border so many times as a federal prosecutor. the idea of the border patrol is mounted on horses, it's very common. i don't understand what the protest is all about. and they do have reins on the horses. they are so overwhelmed, john, and so under resourced right now, and now with 14,000 haitians coming over the border, which, by the way, the secretary was warned as early as june that this was going to happen and they did nothing to respond to it. i defend our border patrol at, and they are so demoralized and this latest accusation, idea that they can't be on horseback to get control of our border is really insanity. >> your colleague from texas, a democrat, is at least giving a measure of support to the border patrol mounted unit saying, my only question is what are border patrol agents supposed to do? if there was any conduct not done according to standards it will be looked at. we have to be careful that we don't just automatically blame the border patrol. they are trying to do their job as best they can and if there is an issue we'll investigate. you agree on one point, that this white house needs to put in place some sort of deterrence to migration in order to control this problem. >> a hundred percent. there has been no deterrence. i think, you started to see the migration occur pretty much after the last election. when biden got elected, and then when he rescinded on day one, when he got inaugurated the remain in mexico policy, when you talk to border properly, and i've talked to them many times down there they say a direct cause and effect between the rescission of that policy and this migrant surge that we're seeing today that's getting worse and worse. not to mention all the fentanyls coming into the country. again, now that the supreme court of the united states has mandated that this administration put that policy back into place, we're going to see a real battle here between the supreme court and this administration and congress. >> likely we'll see a lot more migrants because a lot of people have their eye on what's going on at the border right now, thinking about making a decision to come here. texas congressman michael mccall good, to talk to you. >> sandra: the search for petito is entering its fifth day as they focus on a 25,000 acre swamp preserve just outside of northport, florida. cadaver dogs search land for signs of brian laundrie. neighbors telling fox news the family appeared to go camping just days after brian returned home without gabby. they are live from venice, florida, where the search for laundrie is under way. day five. >> good afternoon. it is another hot and humid day here at the carlton reserve. day four ended last night with "nothing found." now we're well into day phi. still no brian laundrie. still not his pack back and no physical evidence that he was even here but the searching continues. again, it's day five. every day involving about 60 searchers including divers, sonar which can see objects under water and cadaver dogs looking through 40 square miles of the reserve. they are also using atv's and high water vehicles known as swamp buggies as the terrain is rough and deep under water with plenty of alligators and snakes. laundrie's parents say their son went for a hike here last tuesday, nine days ago, and there is no sign of him since. laundrie is a person of interest in the death of his fiancee, gabby petito. her body was found on sunday in wyoming. her stepfather built a cross out of rocks to mark the spot. could someone be camping and surviving in these very rough conditions? obviously there is so much about this unprecedented but the twists and turns it continues to take are shocking at times. >> without a doubt. the news media, social media, has made this case come to light and has solved finding the body of gabby. that's very important in this type of case, you know. it's unprecedented the amount of social media coverage it's gotten and i truly believe the continued coverage, one of those leads that comes in we'll find him. >> sandra: it's remarkable, it's what helped to find gabby. what in the search are the authorities doing? how do you find someone really not having any specific location or whereabouts of this missing person? >> in a case of this magnitude you'll get a ton of leads. the good news is the f.b.i. has the manpower to go after each league and check if they are valid or invalid. you've got to get information out of the computer, hand-held devices, that's the second thing, proactive by the police going throughout and seeing who he last talked to where he has was. there is a lot of work for them to do in addition to handling the leads that come in, which will be a lot. so that's why it's good the f.b.i. is handling this case. they have the manpower to go out and investigate each lead. >> we have the phone number at the bottom of the screen. any chance that you think you saw brian laundrie. call that line and you let the authorities know. john walsh, from america's most wanted says eventually it will be the people that find this guy. listen. >> we did get multiple tips yesterday. our hotline blew up because it's the people who will find this guy. i tell people, you can text me, you can call me, i don't trace, i don't tap the phones. i know people don't want to call cops because they think they will get dragged it into. i don't care if you're legal, illegal, wherever you are, just text or call me and that's how i've caught all of these people because the public is my supporters. >> sandra: that's remarkable, now there are even more neighbors on that street in northport, florida, who are coming home, coming in front of the camera to say what they saw over the past several days. most notably what they say on the day that brian laundrie returned home. neighbors claim that he and parents packed up their attached camper for a weekend camping trip on the day that gabby petito was reported missing. that's obviously remarkable as well. >> without a doubt, john walsh is right on point. his comment, the leads that come in, one of those leads will find him. as to the camper appearance, we've got to think now, are they assisting him in trying to write his own book and disappear. that's a possibility, that they are there to possibly throw authorities off base and let them get away. but we'll never know because i'm sure they are going to invoke their rights but without a doubt john walsh is strongly on point. the public will be the one with the lead to call in. >> sandra: real quick because i only have a few seconds. why is laundrie just a person of interest. why has he not become a suspect? still just not enough evidence? >> they have to tie him into this case, but in reality, in the police world, he's a suspect. in the public world, he's patterson of interest. they have got to tie him to the scene. they have got to tie him to the crime. that's why he's still a person of interest, but in reality, once they are able to locate him, he's a suspect at that point. >> sandra: we appreciate you lending us your expertise on this as the search for brian laundrie continues. thank you. >> john: controversy over images at the texas border with agents on horseback trying to deter haitian migrants but some border at say things are not as they appear. their words coming up next. >> and john, will the taliban end up with a seat at the table at the u.n.? get outta here. everybody's a skeptic. paper money. it's the future! get outta here. i'm leaving with my gold. it's not crazy. help me, mother. it's an omelet. just crack an egg. >> john: the department of homeland security promising an investigation into the treatment of haitian migrants on the texas border will be completed within days. officials say they are looking into footage that border patrol at on horseback dispersed migrants. we'll talk to former u.n. ambassador nikki haley about the situation in moments. here's more. >> the field agents had lost control of the border and so agents were called in. the white house has already concluded the image, were, in thinker words, horrific, brutal, and inappropriate. a retired chief says twirling the reins is a proper technique to keep people away from grabbing the horse's harness and to keep them from getting knocked down and trampled. other sources in horse patrols in two different states tell me the rider was using the reins as a signal to move the horse forward but twirling is not taught at the academy because if a migrant can hold the reins they control the horse which is worse. the dhs will determine if the agent's actions were consistent with department values. >> assure control of the horse, long reins are used. >> i know a lot of border patrol agents. i see them at church. the kids go to school. they are good folks. but, you know, they will investigate this. they were not using whips. they weren't using last sows. we don't know what the contents was. >> the border patrol has been using horses for 117 years, mostly in tracking and in mountains where atv's do not work. the del rio confrontation was unacceptable and racist. supporters say -- >> i'm sick and title with psaki and members of congress who want to say this is a racial thing. >> the uses of horses in del rio, for the time being, is suspended. >> we'll see what the results of the investigation bring. thanks. sandra? >> sandra: for more on this let's bring in nikki former ambassador to the u.n. great to have you in the studio here in new york. it's just brutal. some of the reaction we're seeing from this white house on what's happening at the border, as we don't to see those life images, people pouring over the border, the inhumane conditions. your response to how the white house is handling this? >> the hypocrisy of joe biden going to the united nations and speaking on human rights and looking at those people underneath the bridge living like that, not third world country, fourth world country, is inexcusable, and instead they are going to talk about the horses and they are going to talk about everything else. what about the root problem? biden has yet to be there. kamala has yet to be there. blinken has yet to be there but they love to talk about it and around the edges. the truth is we have a real crisis on our hands and they are tone deaf when they talk about it and they refuse to acknowledge it's their problem. >> this is an exchange with our own peter doocy and psaki, where it appears that psaki, relating the president, they appear to maintain the message that the border is closed. >> the issue is not about pregnant women. the issue is, is it open or closed? >> i think you know the answer to that question and i just conveyed clearly that we're implementing border restrictions including title 42 and including making it clear that people coming through for regular migration this is not the time to come. >> you let me know what you take away from that? >> the border is not closed, if you're picking up haitians and letting them fly to other parts of the country. they are allowing them to come here without any sort of vetting. they can't say the boardcer closed. the one thing i've been fascinated with the biden administration, they honestly believe if they say it people will believe it to be true but you can't continue to lie to the american public and that shows in the approval ratings. >> sandra: as "the new york post" covered this morning, the border lie. biden saying he's deporting migrants but he's secretly letting them in. i want to now move to the u.n. the afghanistan collapse, taliban takeover. you said this, on foxnews.com. joe biden was bold enough to go to the u.n. to lecture the world on human rights yet he can't find the courage to call on america to recognize the taliban. america looks weak and pathetic. what do you believe will happen with the treatment of the taliban as it pertains to the united nations? will they let them in? >> first, it's amazing to me that he showed up in his one speech on the world stage was literally nothing. i was doing a u.n. event earlier today and it was totally van nellla. we were looking for the united states to give us direction on where they are going to go and we got nothing. you look at what he said. do not sit there and acknowledge that the taliban should never get credibility at the u.n. because if they get credibility, they get money. they are forcing girls into marriages, they have taken them out of school, they have taken women out of governments, they are killing innocent afghans on the streets. and we still have americans over there. the idea that biden didn't acknowledge any of that, and the dangers of this terrorist group is unthinkable. but the second side of it is, he couldn't even call china by its name. like it was a very weak, pathetic show. for the first time i was truly embarrassed at how the world saw america. >> sandra: as far as the rise of isis k, f.b.i. director christopher wray had this. your final thought on this? >> we're, of course, concerned that there will be an opportunity for a safe may haven to be recreated there which is certainly something we've seen in the past, and allowing former terrorist organizations to operate more freely in the region. >> sandra: on the rise of isis k we're certainly concerned. where does your level of concern lie? >> it's too late. they should have been concerned before now. now what you've got, through with everything taliban flying its flag above afghanistan you've given the right for every terrorist group to recruit, literally go out and hurt innocent people and this is all on biden's back and we have to start leading. we can't -- i'm not going to just complain about everything biden has done. i'm begging him to lead. begging him to start getting terrorism under control. begging him to have some sort of voice on afghanistan. begging him to have a voice that has actions on human rights. all of these things, americans in afghanistan, we've lost our moral core and we have to get it back. >> real quickly, political implications 2022 with biden sinking in the approval ratings? weren't they curious as to where gabby might have been since they set out together and he came back by himself? that's very suspicious. i don't think, if the family knew at that point, that a crime had been committed or possibly committed and they were trying to do their level best to get their son out of dodge not only will he be in trouble if he ever surfaces but so will they. >> we're seeing the mustang that the police took away and did an examination of, as well as the pickup truck-camper. the latest piece of information comes to us via instagram. this is on august 27. apparently, gabby and brian were spotted at the mary piglet's restaurant in jackson hole, wyoming, where brian was involved in some sort of argument with the staff prompting gabby to get upset. here's what angelo posted on instagram. she was there at the restaurant and witnessed the whole thing. >> she was on the sidewalk crying and he walks out but then right away turns around and walks back in. he's kind of like violently, like talking to the hostess. >> four hours later on that day, that travel blogger spotted their camper van in grand teton national park. gabby never heard from again until her body was found. your thoughts? >> we're surely getting the picture that line laundrie was a jerk. i mean, it's safe to assume that at this point. and again, fact that he's now missing in action, i tell you my theory, john, there is no way he left to go commit suicide because if he wanted to kill himself for whatever did or didn't happen in the tetons, he could do that in the backyard. he doesn't need to send people on a wild goose chase that man is running, and -- is he running because he has a kurdishness of guilt or for some other reason? what we really need to know next is what was the cause of gabby's death. we know the manner is homicide but it doesn't kwaumt equate to murder. homicide is simply the killing of a human being by another human being. there are different levels, different crimes that could have been committed. we won't know those until we have a better idea of how she actually died. >> there is a coroner in wyoming who has not released that information. there is one other piece of the puzzle. that is, during that october 12 traffic stop which you see in the lower right-hand side of the screen, melissa, who is a park ranger, spoke at length with gabby petito during which time she urged gabby to reevaluate her relationship, because melissa thought it was toxic, urged gabby to choose another path and make a change in her life. i'm wondering, there in jackson hole, another fight. gabby upset again. did she take melissa hall's advice, and if she did, did it go really badly? >> yes. that's a possibility. i mean, i shudder to think this young woman was by herself wandering around someplace in the mountains, and something special happen to her. we know that's the case but did it happen to her at the hands of brian laundrie? count they are actually keeping. >> i have question about the numbers you gave and the math. there are 15,000 migrants under the del rio bridge on saturday. if you add up the ones that you say were expelled or lease, it's less than 5,000, 5,000 are still left. where is everybody else? >> i'm happy to get you a more fruitful rundown if helpful from the department of homeland security. >> as we wait for that the numbers we have don't add up. our colleagues on the ground is reporting pretty much everybody is releasing into the usa as long as they say they are a family or a couple where the woman is pregnant. no pregnancy test required and no covid test either. >> we understand basically, most of these people that are going into removal proceedings are being put on either buses from del rio to el paso and laredo or being flown to tucson with no covid testing, unless they show symptoms. how is that helping anybody to control the spread? >> again, we have a protocol in place as it relates to testing and quarantining and also vaccines are provided for a range of migrants by our partner organizations in the region. >> president biden doesn't have any public events on his schedule today as another potential crisis starts to bubble up. federal agencies are expected to start coming up with contingency plans today in case there is a government shutdown next week, john. >> john: did we get the answers the american people want, especially when it pertains to the number of migrants there, where they are going? >> no, it's not been fruit. . in jen's psaki's words, we haven't received any of those final numbers. there have been some numbers that came out from dhs but as peter mentioned they don't add up to what we saw from border control on the ground. there have been thousands of haitian migrants who have been released into the u.s. where they are going, what facility they are going to and how that process is working really is still a big question. the focus has been for a lot of coverage, you know, the picture of the horseback rider. the border patrol agent and the long reins and there has been a lot of focus on capitol hill about that and the white house saying today they will no longer be able to use horseback riding, horses in the pursuit of migrants coming across that boardner that area. that does not help the border patrol agents who are just trying to do a job that they are really behind the eight-ball on as far as resources. >> there was that one photo as well of the mounted border patrol agent grabbing the haitian migrant. that marched had tried to take control of his horse so he was grabbing him to try to get him off in. terms of the numbers, let's put them up so the people at home can follow along. 1,401 haitian migrants have been returned to haiti. over 2,000 were transferred to custody either for title 42 expulsion or for removal proceedings. in removal proceedings people are often released into the united states pending a notice to appear and 3,881 remain at that del rio bridge. 15,000 were said to have come across the board and been under that bridge so where are the rest? >> they told me, there would be no math but as i can see on the board it's not 15,000. you still have obviously some 5,000 according to bill and others under the bridge, so yes, you have a situation where, as we've seen before, math doesn't add up here. >> what's really interesting is this administration is using title 42 which is a trump era health rule dealing with co-individuals, to expel these migrants and they are putting push back from the left about doing that, about how to do that we see this split on the democratic party up on capitol hill about the budget and about the way forward on these pieces of legislation. you're also having a split on immigration and how to deal with it and the reality versus what's wanted are two different things. >> that's a great point. and now you've got the "washington post" in an opinion piece taking on this administration over its border policy saying democrat immigration policies are a gift to republicans. biden's inabilities or unwillingness to puts america first when it comes to immigration is the single biggest political problem he faces, and bret, you've seen it, it's showing up in the pulse. biden's overall approval rating sinking to 43% and even his approval rating among independents in september seeking to 37%. that's down from 61% in january. >> it's a death slide and there are many democrats, especially terry in virginia who is looking at those numbers. come november, how the president is doing will affect those races. this is not a great stretch for this president. and for democrats overall. they are going to try to pull a rabbit out of the how the legislative up on the hill. >> when you look at how his numbers are crateering among independents. independents are where races are won and lost. for him to lose that much support among independents is an indication that things aren't going well for this administration and while 2022 isn't a long way off, things like that tend to have legs. >> you can see the ads already. you can see the immigration issue. you can see crime in big cities. you can see concern about inflation and the economy long term and you can see credibility around the world with the afghan situation. you add all of those up and it's a powerful pitch for puns. again, we have a long time to go, but this stretch has been particularly bad for biden. >> real quickly, if we pick you will nikki haley, she joined us last hour but she was not just calling out the administration as a whole oh but kamala harris. she was put in to tackle this crisis. >> biden has yet to be there, kamala has yet to be there. blinken has yet to be there but they love to talk about it. we have a real crisis on our hands and they are absolutely tone deaf and they refuse to acknowledge its their problem. >> she says the administration is tone death and they are not recognize ohhing the probable ohlem. >> when you factor in what she's equaled in on, horse, at, and the pictures, is where she's been animated and yesterday the vice president put out a readout of call, not with a foreign leader but with the department of homeland security, and it was an interesting readout. she was telling him how unfortunate she went missing to be closer to the search efforts. on wednesday he came to the spot where mayweather weather was found and created a tribute, making a cross out of river stones and laying flowers, a crime scene that's a long walk from the main path of the campground. >> this is spread creek and beyond that tree line right over there is where the dispersed campgrounds that's where people pull up and park to camp for the night and it's where petito's white ford car was spotted. you can see what a trek it was to the area where her body was found. >> the area tucked away behind a grove of trees hidden away from any casual hiker enjoying the scenery of the creek. a possible contributing factor of why petito was not discovered for so long. >> it's hard to imagine such a horrific crime happening in such a beautiful tranquil place and there are still many more questions that need to be answered for investigators and her family. >> fox news. >> sandra: laura has been covering so many different an tolls this story out there in wyoming and now the search in florida, it's just an unbelievable history and how many investigators, homicide detectives, et cetera, have called this unprecedented how many twists this story takes. >> let's bring in a private investigator. he knows a thing or two, because he was one of the lead investigators on the private side in the natalee holloway case. good to see you again. everything taken together, what we know so far, where is this all adding up for you? >> well, first of all, he's missing. brian is missing. thank you for having me on the show. they are focusing right now on trying to find him and trying to find the pieces of the puzzle that lead brian to be responsible for her death. and until they find him, they are going to keep him as patterson of interest. and once they find a piece of evidence that links him to the death of gabby, then they will probably change him from a person of interest, he won't be a person of interest anymore, he'll be a suspect in this case. >> sandra: we have a life image of the parent's home. obviously rain coming down there in this moment and the camper is still in the driveway. the attached camper. the daily mail is reporting exclusively right now, tj, that the best friend of gabby petito is saying brian laundrie is "well equipped" she believes, to survive months in that 25,000 acre florida nature reserve. she said he's gone off the grid before. he's survived before by himself and he certainly can do it again as this manhunt enters its fifth day. >> so i believe that probably he had something planned. there is something more to this picture that's going on, and her death, and this fight that they had when they were stopped by the police. there is something more that was going on. she was extremely upset and i don't think it was just a domestic argument. there was something going on that she knew or something that's come up because this was an extreme amount -- if you looked at her face and her eyes, how swollen they were this had been going on for a while, which evidence they have now she was in a restaurant that they were asked to leave and they were fighting. there was something in this event that transpired prior to her death. >> we know that that incident was at the mary piglet's restaurant in jackson hole. that happened on the morning of august 27. later that day, is when that travel blogger spotted, as laura was telling us, the camper at the grand teton national park. we now know she was very upset on the 12th and very upset again according to eyewitnesss the morning of the 27th. where is that leading you. >> >> again, there is something that was going on with them, that they were discussing or something that was wrong between their relationship. so this was not just a random fight that just came up on the day that they were stopped by law enforcement. this had been going on. there is something that's transpired and now i'm concerned that the parents, or some family member may be hiding him. the search that's being launched right now with the team in florida may not be the source of where he is. he may be somewhere else. somebody else may have removed him and took him somewhere else, and so we're just going to have to remain -- so things need to be watched, not only him but family members and other pieces of evidence that may lead. they took a lot of evidence out of the house and something in that evidence that they took out of the house may lead to change them from a person of interest to a suspect if they can launch him to be the one, in fact, that caused the death of gabby. >> real quick, you've got to think the parents have some of the answers here. >> the parents, i mean, obviously, know, they may know where he is. so i think they need to lead them to a family member or family of where he may be. there may be evidence that they have and what's going on with them, where he is right now. >> they did go on that camping trip just before he disappeared. >> we don't know if he came back either. good to see you, thanks so much. >> and prayers for gabby's family. >> absolutely. tj was mentioning the evidence there. from a layman's position you would think if they had a definitive piece of evidence they would be going after him with an arrest warrant which they aren't at this point. they are still >> there is certainly not an open border. we're continuing to employ our immigration proceedings and process and restrictions at the border. >> so again, jen psaki repeating the administration claim they believe there is not an open border. i'm not sure what else you would call 15,000 people walking across unposed right here into the united states. it was never stopped by the federal government. it was stopped by troopers who had to be sent to the area. so her idea of a closed border is unclear but you're also talking about they are releasing thousands of these migrants into the community with a future court date. they say they are tracking them but keep in mind back in february they told ice we only want you to focus on aggravated felons and national security threats and ice does not have the manpower or resources to track hundreds of thousands of people if they don't show up for their court date in the future. back to you. >> sandra: on the disaster down south. thank you. >> john: fox news confirming 3w0shder patrol agents sent emails as early as june asking for extra resources to deal with the number of crossings in the del rio sector. let's bring in a rep from the texas department of public safety. great to have you with us. we'll talk more about the emails in a second but first let me get your reaction to what the white house press secretary said earlier today where she said we do not have an open border. >> first of all, peter, i think the situation at the border is the result of a broken system. >> i didn't mean to play that. give me your thoughts on what she said earlier about there is not an open border. >> thanks for having me. there has been an open border from the start of this whole crisis and that's why they have deployed hundreds and hundreds of personnel, tabs tabs department of public safety personnel to the southern border to help our federal partners to secure the board. i was in del rio saturday afternoon. thousands and thousands of migrants were crossing into the u.s. from mexico freely with no resistance until our troopers got there and they put a stop to it and contained the area. it was a very effective strategy from our personnel to put a some to that current surge in that particular area. >> we saw how they did it, backing the patrol cars up against the river creating a wall of steel. in june they sent letters to the sent for heads, or marls, rather, to sector heads saying we're expecting something will happen and it will require a lot more manpower. reading from their email they said we suggest sending agents to the field in del rio with tablets to start the intake process instead of letting the groups sit there while space is cleared in the station. this way we can at least get part of the process finished before they get to the station instead of wasting that time. so they were trying to be proactive here, and with the idea that something like this was going to happen. what was dps hearing? >> we did the same thing. we knew there was a surge of migrants coming across. we've never seen the numbers like we've seen this year and we work closely with our partners. we gather intelligence. we have information coming in and they had a proactive strategic plan to take care of the surge but it was ignored. of course now, we're having to deploy state resources to the southern border to take care of a federal government issue in which they are failing to secure the board. we'll step up and assist to secure this crisis. >> i want to play what jen psaki, press secretary said, in response to peter yesterday. in terms of who is responsible for all of this. she said it wasn't the white house's fault. >> first, the situation at the boardcer the result of a broken system. >> she says the situation at the border is the result of a broken system. the question is who broke it because if we put up on the screen here total border encounters for federal year 20, it was 450,088. 2021, year to date, 1,541,651. that's the population of dallas, texas. lieutenant? >> they can't believe how stupid it was carried out by people who are supposed to be much more competent than the crazies that ran the trump administration. the border crisis and then you have stuff involving economics. big issues, small issues, a package of spending that is not really needed right now. the best stimulus man in the world was the vaccine that works pretty well. people going back to work. the economy is in pretty good shape. and on top of it all throw that much -- there are a lot of taxes in here aimed at not just really rich people but if you make more than $400,000 per year, you live in long island with a family of five, you're not exactly warren buffet, those people are going to get crushed under this plan. so will investors so there is this whole thing like, we thought we were getting mr. competent. what they are getting is joe biden -- >> biden campaigned on open borders. >> it's one thing to campaign on a different immigration plan. halfway to championship. another thing to say come in and we'll take care of you. >> sandra: when it pertains to the u.s. chamber of commerce, this is remarkable. >> john: why do you think it's remarkable?
