afghanistan to tell you about. general john allen, the is now strongly condemning some photos that will be appearing in "the los angeles times" at 8:00 a.m. eastern time and those photos depict u.s. troops posing with the bodies of suicide bombers in afghanistan. the incident which took place back in 2010 "represents a serious error in judgment by several soldiers who acted out of ignorance and unfamiliarity with u.s. army values." nick, we haven't seen the photos yet. what exactly are they supposed to show us? >> apologizing for the contents of these pictures ahead of their publication by "los angeles times" expected later on today. they issued a statement in which they condemn the images which apparently show the bodies of dead afghan insurgents who died in suicide attacks. i mean apparently taken, according to issa a in 2010 but only now being leaked to the press. let me read to soyou some of th statement. "the action of the photographs do not represent the policies and these behavior is inconsistent with the values." but to be honest, after the past four months, nato are becoming used to and practice the art of damage limitation. in january we had the instance in which united states marines apparently corpses of dead afghans and then the mistake of burning korans by nato soldiers and then the massacre of 17 afghan civilians in kandahar. deeply troubling narrative for the nato campaign as it inches towards its end, it's unclear what it will be when the pictures are published. this adds to a growing toll of bad news towards the end of this deca decade-long war here. >> thanks for that update. we'll try to get those photos for you as soon as we possibly can and have more conversations about them this morning. naftau bendavid. amy kremer. do you prefer chairman or chairwoman? what? >> that's one of the questions that always comes up with these things. should we care? he didn't have an official position with the romney campaign or anything like that. >> he's kind of known for saying things that are over the top. >> that's the thing he's most known for right now. on the other hand, he's a celebrity and he endorsed mitt romney. romney campaign glad to have him on hand. they were happy to benefit from that. and now it's back firing somewhat. >> on the heels of hillary rosen's comment, connected to movements or administrations and how much did her comments respect those they're speaking about. >> doesn't even matter. >> i think ted nugent just builds upon the narrative. should we care what ted nugent has to say? >> i think, really, this kind of conversation coming from either side is not helpful. we've seen it from debbie wasserman schultz about the tea party and, you know, it's not just helpful from either side and, you know, i've heard last night i think somebody said this is the nastiest presidential campaign ever and these people who have a platform as celebrity, i think they need to tone it down. they don't speak for the campaign or the party, but, still, it's not helpful. >> i don't know that people will tone it down in the days of twitter. it will just elevate and get that whole conversation spread to more people. ted nugent, i should mention, had an opportunity, if he wanted to, he could have apologized yesterday because he was on dana loesch radio show. there has been a lot of doubling down of these comments. people say something, instead of saying, i was wrong. my goodness, i apologize. i meant it, i said it, i really meant it. i mean it more today than ever before. he told the crowd as he was stumping for mitt romney at the nra convention in st. louis, this originally on saturday. take a listen. >> barack obama becomes the president in november, again, i will either be dead or in jail by this time next year. >> okay, wasn't really sure what he exactly meant by that, but then when he was talking to dana lo l l loecsh he said this? >> i stand by my speech. it is 100% positive. it's about we the people taking back our american dream from the corrupt monsteres in the federal government under the administration and the communist czars he has appointed. the national journal, others reporting that the secret service is now involved and intends to follow up with nugent about exactly what he meant. democrats launching a social media and one video campaign demanding that mitt romney disavowed nugent who. romney campaign actually didn't directly respond to nugent. they issued a statement through the romney spokesperson saying "devisive language is offensive no matter what side of the political aisle it comes from. mitt romney believes everyone needs to be civil." that's not going out on a limb. let's get right to senator james, nice to see you, sir. thanks for talking with us. >> nice to be with you, soledad. >> thank you, appreciate that. we were just talking and walking through what rocker ted nugent, who's pretty much known for his outrageous comments had to say. i'm interested in your take on it now that the secret service is involved. >> i hadn't really heard the exact comments until i heard it three times on your program and earlier this morning. what he's saying, i can't figure out what people are talking about. he's talking about him that tim himself would either be dead or in jail. how does that relate to the president? i have a real hard time putting that together. if you want to see how you can be abused, read my book "the greatest hopes" and see what bobby kennedy, you know, he had me for treason and, so, if you want to see some real threats, you can see them. i don't know what they're talking about. >> do you think, hold on one second there, senator. do you think that ted nugent when he said those comments, which i think were very vague, he did go on to talk about some, the administration in general. not certain individuals. it's certainly violent language at the very least. go ahead, senator, i'm sorry. >> yes, he did. again, he was talking about himself. to me, when i first heard that, i thought this guy is so offended by what the administration is doing. if we're going to have to have four more years of barack obama, he will either be dead or in jail. >> well, senator,ed admittedly e comment was hard to understand what he was getting at but one interpretation said he was going to somehow attack the president and that's the reason he would wind up in jail or dead. the secret service is taking it serious enough to go after it. i'm puzzled by your puzzlement to why the reaction has been as strong as it has. >> i think that anyone could put an interpretation on like that. i just didn't hear that because that's not what he said and it is confusing because it's hard to say, why would he be dead and now we're talking about ted, not the president. and i didn't quite understand it. well, i tell you, if they scrutinize people that close, they have done that to me, so i can understand. why is it? let me ask you guys this, we have a -- >> are you interviewing me on our own show. come on, senator, we love that. >> i know you're interested in what's going on. we have a president who constantly says that we only have 2% of the reserves and he says this totally outrageous, not true at all, but he says is it so many times, he believes it. if we open up for some these lands for drilling. you know how long it would take, soledad? >> i don't know. >> it would take perhaps 70 days. i talked last night to herald hamm who is one of the biggest, he's from oklahoma and working up in north dakota right now. i said if they were to open up some of these public lands or other places because 90% already stopped we can't drill on and that's back to supply and demand. how long would it take you to reach the pumps to fill our gas tank? he said, well, 60 days to bring the first barrel up and then take an additional, listen to this, ten days to go through the refining process and reach the pumps. you're talking about something like two or three months and i agree gary becker is nobel prize economist and he said, what's wrong with these people? there's not a person watching us right now who didn't in the elementary school hear about supply and demand. we have, if we would just open up and do what every other country does, enough gas, oil and coal to take care of this country without any independence on the middle east for the next 90 years. >> senator, i have the president saying that. i want to play that first and then ask you a question on the other side, if i can. let's play that, guys. >> the problem is we use more than 20% of the world's oil and we only have 2% of the world's proven oil reserves. even if we drilled every square inch of this country right now, we'd still have to rely disproportionately on other countries for their oil. >> i would say roughly that i talked to 25 analysts over the x number of years about gas prices as they go up and back down and invariably they talk about those prices are not really linked to whoever is sitting in the oval office. they really say, listen, whatever the external factors are, in this particular case, instability in iran is really much more correlated to those high gas prices. is that not correct? >> no, i think, first of all, he trying to use this manipulation and an extension of his attack on oil companies and all of that, but, again, you're just making that case. you just repeated that he has said over and over and over again and people assume that someone is going to tell the truth. >> i didn't repeat it. i replayed what he said. i played a chunk of what he said and you mentioned it the first time and i'm telling you what analysts told me that they correlate high gas prices to externals in this particular season it is really about what's happening in iran. is that wrong? >> no, i think it is wrong. i think that we have to look at what our domestic capabilities are. but he talks about 2%. that's what they call proven reserves. in order to prove a reserve, you have to prove a term. recoverable reserve as to what is there and what is our potential. greater than any country in the world and all we have to do. again, we're the only country that doesn't exploit our own resources. i think, you know, you have to look at this supply and demand because it's a major thing. again, i'm not an economist. but that's why i quote other people who are saying how is it that we can just ignore all of this potential that we have out there. obviously, in addition to being able to be self-supporting, we'd have all the jobs and everything that goes with it and maybe it's because i'm from an oil state and i look at this and just shake my head and wonder, by the way, i just got back from the middle east and areas like that and they asked the same question. why is it you guys don't develop your own resources? just wanted to check and make sure that we were on schedule. the first technology of its kind... mom and dad, i have great news. is now providing answers families need. siemens. answers. calls to resign despite an apology from the public policy arm over comments he made in the trayvon martin case. last week on his radio show richard land had this to say about reverend al sharpton and reverend jesse jackson. >> not that the facts matter to people like al sharpton, even if it turns out zimmerman did not act out of fear, did act out of fear for his safety and not racial animosity. don't expect anyone stoking the racial fires to start issuing macopes. they're race hustlers who made their careers and made their fortunes exploiting racism in the united states. >> so, that was richard land talking. the comments didn't sit well with some southern baptists. after all the, southern baptist convention spent many years frying to distant itself. so, on monday land apologized and he wrote this. i'm writing to express my deep regret for any hurt or misnoodzing about my comments from the trayvon martin case. it grieves me to hear that any comments of mine have to any degree set back the cause of racial reconciliation to southern baptist or american life. some of the members say it's not enough, they are demanding his resignation. this as the religious group is expected to vote in its first african-american president in a couple months. nice to see you, thanks for talking with us. we just had a technological glitch and we have lost him. so, we will see if we can get his connection up again, but we're going to ask him about these comments about richard land. interesting, i think when you look at the polling on the whole trayvon martin case. outside of the case, sort of no question that george zimmerman killed trayvon martin, no one is arguing that part of the case. was it justified? anything anyone can be convicted of at the end of the day. african-americans overwhelmingly see injustice done in not arresting him and white people for the most part, overwhelmingly see that injustice is done and arresting him in some way and the numbers are almost exactly flipped. and i think that this goes to the heart of what richard land is talking about. what he calls a rush to judgment and racial ambulance chasing. >> i don't know if that's put exacly right. i think the poll would reflect it, if my twitter feed is any reflection of how people feel the assumption of knowing the unknowable. we still don't know exactly what happened in this case and that doubt, some people really don't like hearing that doubt in this case. >> the biggest question is about racial profiling. black people say racial profiling exists and they will cite personal experiences they have and they'll say, racial profiling exists, so, no surprise that this could have happened with george zimmerman and trayvon martin and there should be an arrest because to not have an arrest is an indication that the police aren't doing their job. i think white people and this is broad strokes on this, nonscientific polling on my part, who don't have an experience personally with racial profiling say, let's wait for a judgment. let's see how it turns out. >> i don't think that when we're talking about white people versus, you know, african-americans. i think everybody wants justice done in this case, justice served. and i believe in the justice system. i think most people do believe in the justice system, but what we've seen played out here is it's being tried in the media and just perpetuated by these comments that are being made from people all across the country and it's not helpful. let the authorities, whether they be the state authorities in florida or the federal authority, let them do their job and let justice be served in this case. that's what we need to do. >> i think a lot of people would say that's fifsophically great. if there wasn't protests and marches, the case would not have gone back to being reconsidered. if you remember what happened, the local folks started marching and eventually it was reverend sharpton and reverend jackson who flew in and became part of those marches. maybe it would have just disappeared. >> also, i think that black people in this country have had a lot of experiences with authorities not doing their job. you know, they've seen over decades that people who were supposed to step in and particularly in the south and pursue these cases whether it's police, prosecutors, judges haven't done what most of us would consider to be justice and that's why they don't have the same trust that people with a different experience may have had. i think one of the things that richard land's comments highlight, white conservatives in the south do have a fairly complex history with race. i think for him to say that in that contest provoked a certain action. >> i think it just really shows that conversations about race are really mired in conflict and people's personal reactions and are informed by your sort of personal experience and then get ugly very, very fast. i think we have brian wright up, i hope you're there. there you are. always nice to toss to you and see you in person. richard land has apologized but still calls for him to step down. do you think those calls are merited? >> i really don't. all throughout richard land's ministry he has been working for racial reconciliation and racial reconciliation is very important to southern baptist christians and i know that he has apologized for comments that were in appropriate, that have inflamed the issue and i just ask others to be forgiving, as he has asked forgiveness for his actions here and let us all work together when it comes to racial reconciliation because our lord and savior jesus christ certainly wants mankind to love one another. >> president obama said, talked about the trayvon martin case. i believe it was one set of comment wheres he really talked about trayvon mart aen could be his son and said, he sort of said he felt very sorry for the family. richard land said this about the president's comments and i want to play them for you. >> he knows that this is in the case, people say, why would he do this? mr. obama is in deep trouble for re-election and the only chance he has is getting 95% of the black vote and getting the black vote to be as high as it was last time. >> what do you make of those comments? >> well, i think richard land has come out and expressed an apology for comments that were inappropriate in that setting and i think all of us have made mistakes when it comes to comments about racial issues through the years and i'm just sorry that for a man like richard land, who has really worked so hard to lead so many southern baptist christians to have a greater sensitivity and understanding and call for justice in areas of racial reconciliation has made some comments that have, obviously, been offensive to others and inappropriate in this situation. but he has asked forgiveness and i think when someone acknowledges that they said some things that are inappropriate and asked forgiveness, i think it is our calling to forgive and accept that apology. >> have you had conversations with the incoming president who would be the first african-american president of the southern baptist convention, reverend luter of new orleans, i believe where he's from. what kind of conversations do you have about moving the organization forward and taking this controversy, if you will, and at least sort of getting something positive out of it, if that's doable. >> fred is a very fine pastor and he pastures the strongest southern baptist church in new orleans and probably will be elected as the next president of the southern baptist religion and these comments were disappointing for him and yet he has also expressed an acceptance of richard land's apology and urging us to move forward and any steps that we can take when it comes to racial reconciliation. he is a mighty fine man. >> thank you for joining us. nice to see you, sir, we appreciate your time this morning. sorry about our technical difficulties off the top. great to have you as part of this conversation. >> glad to be with you. >> thank you. we'll come back in just a moment and continue this conversation about breaking news. u.s. troops apparently posing in photos with dead bodies. the pictures taken back in 2010. apparently those bodies of suicide bombers in afghanistan, the "l.a. times" apparently will be releasing those photos at 8:00 a.m. eastern time and we'll, obviously, keep following this story for you. that is not my song. who is that? go the election battle year over texas and how it will come to a head tomorrow when a republican bill to cut small business taxes will come up for a vote. on tuesday majority leader eric cantor taking up the bill suggesting that it will not only create jobs but also help women at the same time. take a look. >> as a study out would show when this bill fully implemented would create 100,000 plus new jobs and, in fact, the beneficiaries of this policy are small businesses and, frankly, a third of those small businesses are women-owned businesses. >> sounds good, right? democrats say this thing is nothing more than a tax cut for the most wealthy. president obama is already vowing to veto the bill, if it reaches his desk and it becomes clear the republicans and democrats are divided over taxes, lots of oamericans seem to agree that the current system isn't working. a new cnn/orc poll that shows the current system benefits the rich isn't fair to the rest. steve israel of new york is the chairman of the democratic campaign committee joins us this morning. obviously, fairness in taxes is a big topic in this political year and no surprise that it's coming up in a political year. why do you think what eric cantor is proposing is not a good thing. if you believe him, he's saying 100,000 jobs would help women, sounds like it would help the middle class, as well. >> well, over one half of this so-called small business tax cut goes to people earning over $1 million a year. this is a typical bait and switch. you put a label on something saying it's for small businesses and you give away the store to millionaires. because of our debt, we have to dismantle medicare and then you pass a $46 billion tax cut for millionaires that's not paid for. i'm all for investments in the middle class, giving incentives to small businesses and this doesn't make investments and incentives and small businesses and moms and pops in the middle class. this is another unfunded, unpaid for tax give away, giving away the store to people who are earning over $1 million a year. >> hey, i just wanted to ask you, how are you feeling currently about your chances of retaking the house? there's a lot of people who would say that right now democrats would take about ten seats, which is far short of the 25 they need and redistricting if anything help. how do you feel about your odds at the moment? >> well, i'm a big fan of the new york mets. i understand patients and you have to wait to the last game of the season and we're not there yet. i said since day one this is an uphill battle, but the house will be in range. i can tell you today, the house is in range. we'll see what happens in november. the more house republicans say that we've got to end medicare because we can't afford it, but keep getting tax cuts to millionaire as, the more they devest from the middle class and kick the middle class in the stomach with budgets like the ones that they're passing, the better our chances. but that also gives us an a obligation to offer solutions. our solution is fundamentally you invest in the middle class. we want people to pay the lowest taxes possible. the problem now is that the rich are paying less and the middle class is paying more. that's why we need to have a tax code that is fair and that invests in middle class families. >> amy. >> yes, congressman, this is amy kramer with tea party express. republicans don't want to end medicare. they want to reform medicare. it was just last may that the board of trustees issued a report saying if it was not reformed, it would be bankrupt by 2024, i believe. it falls on both republicans and the democrats to take the necessary steps to reform this program so that our seniors can count on it in their future years. that's what they banked on their whole lives they worked hard and they deserve that. it falls on both parties. the party politics of going back and forth and blaming each other is not acceptable. you need to stand up and do what's right for the american people. >> i will throw a question on to the end of amy's point. in an election year, is that going to be possible? a benefit for everybody running to a camera and positions that are opposite of what the other person is stating. is that even viable? >> why can't we do something like give the head of health and human services just like the secretary of veteran affairs does. that will help to stabilize prices. there are a lot of things we can agree on. i agree with you, we need to reform medicare and ensure its solvency. they start solving the budget crisis by taking seniors off medicare. from turning it from a benefit program into a coupon program where you may have it, you may not and the congressional budget office says under any scenario it will cost, why are we at the same time saying we are going to balance our budget, not by making taxes low and fair, but by asking seniors to pay more first. >> congressman steve israel is a democrat from new york joining us this morning. nice to see you, sir. thanks for the time. appreciate it. still ahead, did you hear the story. 6-year-old kid cuffed after throwing a fit in school. we'll talk about what happened there. did they go overboard? [ male announcer ] the citi simplicity card. no late fees. no penalty rate. no worries. that's brooks and dunn off of amy's playlist. our get real this morning is kind of crazy. we turn to the state of california, a state as we have reported many times, huge financial problems, however, still managed to spend more than $205,000, yes, $205,000 on that plant right there to relocate a single shrub that was standing in the way of a billion dollar highway project in san francisco. here's the reason why. apparently the plant was located in the roadway improvement project and, so, this plant, whichs is actually known, it is one of the few rare one growing in the wild right in the middle of the median, which meant they had to dig up and replant it. the cost of all that work, i guess, removal, $100,000, that sounds high to me and i've been ripped off by many contractors. transfer $25,000 total came out to $205,000. however, the kicker in this, of course, you can buy these plants. they're not from the wild, but you can buy them in a nursery for roughly $15.98. >> but, soledad, i'm a big gardner and i love gardening more than anything and, actually, to get my hands in the dirt and remove me from all this political stuff. but societies and garden clubs that are willing to go and do this stuff at no charge. i know we have them in georgia, they're all over the state. i'm sure they're in california, too. why did they not tap into some of these people to do this. >> the removing of the plant itself, which seems this rationale behind it. the last one growing in the wild, through the concrete and not thinking of creative ways to do it. i would dig up that plant for $40,000. >> are you telling me that we shouldn't have paid government? >> by the way -- >> for $16 at the local nursery. i'm having a hard time at this story. >> do you know how long it takes to grow a gallon plant to that huge of a plant. it takes a long time. >> the plant is not valuable. we do think other people could jump in -- >> it is valuable now. >> s.o.b., which happens to be my initials. >> just checking. still ahead on "starting point." a show that starts off with shalom, my brothers. growing up with her famous dad who is black and her mom is jewish. in honor of our guests, here is creed singing "rain." modern buildings and all the quality that makes the space inhabitable is this onslot of machinery that pumps air and light into the building. so, what we're interested in is what you could call engineering without engines that essentially we use contemporary technology and our capacity to calculate the performance of a building to put the at trtribute into the actual design of the building. >> about 12. >> all from your life? >> yes. >> what's the range? >> i play my jewish grandmother. i play my dad. i play kids from my school. i play the woman at my dad's funeral who was ridiculous. all those things. >> who is that woman at your dad's funeral that was ridiculous? >> whoever they paid to do this eulogy that one else wrote that was hideous really. that's going in the show. >> it's a long play with not a break in between. you play these different characters out of your own life. does it feel like a relief at the end of the show or do you feel kpafted about reliving some of these retough moments in your life? >> i thought i wrote a drama. i realized i wrote a comedy. it's kind of fun for me. i have a great time playing these different people and going into them and exploring who they are and coming out of it. it's exciting. >> whenthy think of an actor playing multiple character, i think of eddie murphy. >> i believe the audience should come on the journey and it's the actor's responsibility to take you there. i have no props. >> you could play two different characters? >> i would. >> could you? show us the two ends of the spectrum. >> my jewish grandmother on the night obama became president called me up on the phone and said rain flower, i want you to know, i'm so happy for your people. she's just one of those. i asked her once did you have any black friends? we had a black maid once. we were friendly. i paid her well. and then there's my paternal grandmother, now, soledad, you is about as they come. you got a boob job because it look good. that's who these people are. >> you said you're a survivor. what's the hardest thing to survive? ( announcer ) fly without putting your life on pause. be yourself nonstop. american airlines. good morning. our "starting point" this morning is breaking news. photos of out. it shows u.s. soldiers posing with a mangled remains of suicide bombers in afghanistan. the military this morning had a preemptive strike trying to do damage control this morning. we'll take you live to the pentagon. ted nugent, anti-obama rant. listen to what he said. >> barack obama becomes the president in november again. i will either be dead or in jail by this time next year. >> what exactly did that mean? that is getting the secret service's attention. the question today is did he go too far? health care for the world's third richest person. warren buffett tells shareholders he's battling prostate cancer. and "time's" most influential person of the year. it's wednesday, april 18th. "starting point" begins right now. welcome, everybody. this could be another huge problem for u.s. forces in afghanistan. "the l.a. times" is releasing some new pictures which appear to show soldiers posing with remains of suicide bombers. the military responding even before those pictures were made public. nick paton walsh is live for us in afghanistan and barbara starr is live at the pentagon this morning. you know when you get preemptive notice out of the pentagon, this is going to be a problem that clearly these photos are dramatic and very problematic. >> absolutely, soledad. that's exactly what started happening a couple hours ago. we started getting e-mails with statements from general allen, the top nato commander, ryan crocker, the u.s. ambassador to afghanistan, all saying that they were condemning this action being reported by "the l.a. times" showing soldiers posing with bodies of dead insurgents back in 2010 in eastern afghanistan. now, "the l.a. times" said they got these from a soldier who wanted to draw attention to what he said was the potential breakdown of discipline in afghanistan by u.s. troops. we've seen these incidents before. they do happen. this one, of course, now wiould come at a sensitive time and we see statements responding to something that's alleged to have happened two years ago. we also got a statement from leon panetta, the top spokesman, who told us secretary panetta strong strongly rejects the conduct depicted in these two-year old photographs. these images by no means represent the values of professionalism of the vast majority of u.s. troops serving in afghanistan today. anyone found responsible for this inhuman conduct will be held accountable in accordance with our military justice system. the army has begun an investigation into all of this trying to validate the circumstances of what happened and whether discipline is warranted and whether these soldiers are even still serving in the army. soledad? >> thanks, barbara starr. let's get to nick paton walsh. is the preemptive move out of the pentagon because pictures are bad or is the preemptive move because the tenor and relationship between the united states and nato forces and afghanistan is so tenuous and challenging at this moment? which do you think, nick? >> reporter: well, you could argue after the last four months that nato here have become better at crisis management and wanted to break this story themselves, get their apology out first so first people would hear about it would be them condemning these images and what they show. general john allen has had to apologize for three other incidents so far this year. u.s. marines urinating on afghan corpses and mistaken burning of korans in february and massacre by u.s. staff sergeant in kandahar only last month. increasing bad news here that mounts up daily. these particular images very gruesome. 2 of 18 were leaked by a soldier here showing disembodied legs of a suicide bomber and the hand placed on the shoulder of a u.s. soldier, that hand belonging to the hand of a dead insurgent. it remains to be seen exactly how the afghan population are going to react when these images begin to get more wide circulation. >> nick paton walsh updating us. thank you. we appreciate it. we'll check back in as we get access to these photos. i want to introduce everyone to our panel. i nearly fell off my stool. >> careful. >> thank you for caring, will. will cain is a columnist for blaze.com back with us. amy cremor is a chairman of the tea party express. and a political reporter for "the wall street journal" joining me on the panel this morning. we're talking this morning with senator bill nelson who will join us in just a moment. he had a meeting with the commodity futures trading commission chairman because gas prices in part is an election issue that people feel very strongly about is really percolating to the top of the conversation. how much of this is political will cain and how much is a general attempt to deal with issue. >> 100% political. i would say that both sides are making hay out of an issue that has little truth to it you spoke about this in our last hour. we talked to the senator from oklahoma. i agree with the point of view you put forward that politician have control over short-term gas prices so when president obama says i'm going to crackdown on speculators, he's making a political issue out of one that's not political and when republicans say check out gas price, look at your side of the highway, hold it against president obama is also an unfair criticism. >> i agree with will. i think when you are talking about gas prices specifically, we need to look at the bigger picture of being energy independent and tapping into our natural resources of natural gas, coal, shell, here in this country. that's the bigger issue. the department of energy was created to get us off foreign oil back in the '70s and look where we are now. we need to look at being more energy independent and tapping into our natural resources. >> often people don't have that bigger conversation because the gas prices are something that people physically react to at the gas pumps. let's bring in -- excuse me. i'm losing my voice too. i want to bring in the democratic senator bill nelson from florida joining us now. nice to see you, sir. forgive me. i'm struggling being able to speak this morning. you heard what will cain said who said this is 100% a political issue at the end of the day and on both sides of the aisle people are trying to make hay out of this political issue. you had a meeting with commodity futures trading commissioner. what did he have to say? >> let me comment on will's comment. of course everything in an election year can be labeled political. three years ago it wasn't political when oil went from 60 bucks a barrel all of the way up to 147. there's widespread agreement that speculators running the price of bidding on futures contracts for oil, most of whom do not use the oil like an airline and therefore they have reason to buy it to hedge, that when you have that excessive bidding and you're flipping like that flipping and running up the prices of condos in the real estate bubble, that's part of the price. it's been reported by wall street firm in "the wall street journal," 63 cents of every gallon that we pump in our gas tank is due to speculation. so you can say because it's being brought up, it's political because we're in an election year. i've been bringing this up as well as a number of our colleagues for the last several years. >> senator, so you know, obviously you are allowed to invest in oil. how do you make a distinction between investment that's legitimate and legal and speculation or manipulation of the market that's improper? >> you don't allow any one speculator to have a huge share of the market. it's called position limits. so you put a regulation that any one speculator cannot hold a particular percentage of the total market. now, what the administration proposed yesterday was for congress to enact margin limits and that is the amount that you pay down. approximately it's 6% now that you pay on an oil contract that is going to provide oil in the future. between the two you would have a lessening effect on the ones that want to get into these futures contracts and just keep running the price up. >> let me just lay out for people the gas prices this morning on average. $3.90 per gallon. and what the president has sent to congress yesterday in this plan to reign in market speculators as the senator is talking about would be higher penalties, more enforcement, and more data collection. at the end of the day, sir, does this also sort of grow government? that sounds like a plan that brings a lot of people around it that would have to enforce it and watch penalties, et cetera, et cetera. isn't that a downside of what the president is proposing and isn't it sort of the opposite of what he claim all along that ultimately what's happening in iran that is really correlated to these higher prices. >> you asked a couple of questions there. certainly is iran threatening to mine the strait a fear actor that causes prices to rise? i think it does. the world market, iran now being boycotted, less oil out on the world market, that is true also. at the same time, you've got less domestic consumption and more domestic production so that affects the world oil price. why are we seeing suddenly the run-up. there are other factors at play and this was the case several years ago as well. now, with regard to your question about regulation, remember this regulation of energy's future contracts was eliminated in the dead of night in december of 2000 and you saw the enron scandal that came from that and you've seen markets that have excessive speculation. i'm saying let's do some common sense. let's do some bipartisanship on which we can agree. i think administration is moving there. you ask about my meeting yesterday with the chairman. i don't think he's moving fast enough. i think he has the emergency powers under the wall street reform bill and i think they need to move faster. they are moving in that direction but not fast enough for me. >> democratic senator bill nelson, appreciate it. got to get to christine with other headlines this morning. good morning. >> good morning. the controversy over ted nugent's remarks over president obama heating up this morning. late yesterday the rocker said he was standing by his explosive comments made over the weekend. this is what he originally told a crowd while stomping for mitt romney at the nra convention in st. louis this past saturday. >> barack obama becomes the president in november again, i will either be dead or in jail by this time next year. >> last night conservative talk show host show nugent followed up with this. >> i spoke at the nra and i will stand by my speech. it was 100% positive. it's about we the people taking back our american dream from the corrupt monsters in the federal government under this administration and the communist czars he's appointed. >> nugent's rant on the secret service's attention according to several news outlets including the national journal it is investigating. a man gets naked at the portland international airport last night. he says he was protesting the tsa screening process accusing agents of harassing him. 50-year-old john brennan was arrested and charged with disorderly conduct and indecent exposure. futures down about 27 points on dow after a really big rally yesterday. everyone is waiting for news from europe. concerns mounting that spain may need a bailout now. investors here waiting this morning on more corporate earnings news which have been unexpectedly good so far. what price happiness? "the l.a. times" releasing photos which appear to show soldiers posing with the remains of suicide bombers in afghanistan. i have to warn you, the pictures are very graphic. parts of the photos we have censored and blurred. we want to get to barbara starr who is at the pentagon for us this morning as she has more details for us. tell me more context around these photos. >> you know, sadly we have seen these before from the war zone. always categorized as inappropriate behavior by the troops when it is proven to be the case. "the l.a. times" published these photos in an article but even before the paper came out this morning, top officials were issuing statements condemning it in advance of publication clearly trying to get out ahead of the next sensitive crisis in the war zone. this is apparently an incident that took place in 2010 in eastern afghanistan. let's put up one of those approxima pictures you were just talking about. we have blurred some gruesome details. you will see u.s. troop in the middle, afghan dead insurgent and what is by all accounts afghan forces also in the same photo. now defense secretary leon panetta through his spokesperson george little issuing a statement saying "secretary panetta strongly rejects the conduct depicted in these 2-year-old photographs. these images by no means represent the values or professionalism of the vast majority of u.s. troops serving in afghanistan today. an investigation that could lead to disciplinary measures is under way. anyone found responsible for this inhuman conduct will be held accountable in accordance with our military justice system." the army does have an investigation under way but they are not even certain -- they don't believe at this point the soldiers potentially involved in this are still serving in afghanistan of course so they will have to be located. >> can i ask you a question for one second? i want to throw that picture back up. it's hard for us to see and partly because we blurred some of it out. it appears to me that it shows soldiers who are holding the legs, maybe off a mangled body. describe who else is in that photo? it's hard for me to tell because we blurred out faces of the soldiers. are you saying there are afghan soldiers in there as well as u.s. soldiers. >> look on both sides particularly the man standing to the right in a darker jacket and perhaps a lighter blue/gray uniform. these are not u.s. military uniforms. this would be potentially the more traditional dress you might see by local afghan security officials. so the question is if people think violence will break out because of this, it is fair to say there are afghans in the photo as well. now, why did these photos come to light might be the most immediate question. they were given by a u.s. soldier who wanted to draw attention to the breakdown of discipline in some u.s. military units. that is his view of course. and that's what's being investigated. >> yeah. >> henry? i found your music. do you want your music now? okay. let's try your music, okay. then you tell me if it's too loud or not. >> he's given an ipod containing his favorite music. immediately he lights up. his face assumes expression. his eyes open wide. he starts to sing and to move his arms and he's being animated by the music. >> more than 5 million viewers have seen this video. it's part of a documentary called alive inside and it really brings to life the power of music and impact on patients with dementia. joining me this morning, the director and social worker in the film. nice to have you both with us. we appreciate it. talk a little bit about henry, who is that gentleman there. we see him very unresponsive. his own daughter sort of, like, do you know who this is? he can't really quite answer. and then you see this change. was it as simple as that? they gave him an ipod and he sort of woke up? >> with alzheimer's disease, people may not be able to recognize their own loved ones, maybe not able to speak. if they hear music from their youth, that part of the brain is not affected so much by alzheimer's. they do come alive so to speak. this he can speak and sing to the music to almost perfect rhythm. it's quite amazing. >> were you surprised at that clip which is off the work you've been doing in nursing homes that you would like to bring to a wider audience went viral. millions have seen it. >> completely surprised. i put this -- i gave this clip to dan because we're trying to tell people about the work that dan is doing. there's this enormous population that doesn't have their own music. the music that they love. and we put it on his website. 300 people saw it for six months. and then some kid wrote "this is us in 70 years." people just watch it and saw a human being come alive and when any of us come alive, it touches us deeply and makes us really happy. >> i want to show people a little bit of video as we're talking of henry who is very unresponsive. he doesn't pick his head up. i thought maybe he couldn't pick his head up having spent a few years working with elderly people in nursing homes, that he physically couldn't do it. let's roll videotape of henry kind of unresponsive almost out of it. >> this is how he spends most of his time. >> sitting in a wheelchair. not really active. and then i want to show a little bit of sort of -- they come over and they engage him with the headphones. let's roll that as well. >> i'm crazy about music. you played beautiful music. beautiful sound. >> did you play music when -- did you like music when you were young? >> yes. i went to big dances and things. >> what was your favorite music when you were young? >> i guess callaway was my number one band guy i like. >> how typical is what henry is talking about here and what you see with nursing home residents? >> right now we are using this approach in 50 nursing home in 15 states in u.s. and canada. half of the people have dementia and they are using it successfully. they all have stories. when they talk to me they say, dan, i have more stories to tell you of unexpected coming alive and improvements in people's behavior and their mood as a result of the movie and then they can tell me. it's just that kind of turning on the faucet. we make a connection there. if you look there was a student from tulane university went into a local nursing home. we have 15 residents with dementia. i'll help you find their playlist and work with their families and everyone looked like there was no cognition. every one of them came alive and started talking and interacting. the benefit is not only music but social interaction. >> is this the influence of music in general or particular personal attachment to one kind of music? [ female announcer ] live the regular life. phillips'. >> get the inspector. >> this crime is familiar to me. >> edgar allen poe. >> what may i attribute the honor of your call? >> actor john kuszak is known for many character rolls and is now taking on a suspenseful one in a film called "the raven." he plays edgar allen poe trying to track down a serial killer using his own stories to plot murders. >> the night before last, the daughter's body was lodged in a chimney and the mother's head was nearly severed with a straight razor. does any of this sound familiar to you, mr. poe? >> you're talking about my story. a work of fiction. >> i'm afraid i am not. >> in the movie it's not a work of fiction. it comes to life. i sat down with john kuszak and talked about it. listen. you play edgar allan poe who is in real life and screen life a bit of a mess. a drinker. womanizer. financial train wreck. what did you like about that character that made you read that and say i want to do that? >> well, i think he sort of the godfather of goth, right? i mean, he was such a literary giant and i will say i don't think he was a womanizer as much as -- >> passionate with women. >> i think he was a one woman guy. i think he preferred the company of women. i don't think he liked men at all. he thought he was sort of at war with the world with all of the other intellectuals and writers. he was a hot mess. no doubt about it. >> he also in this film is a sleuth which is obviously fictionalized version or he's helping those who are really trying to track down this serial killer. it's very dark and scary film. he never was -- in history he was never helping the police solve a murder. the story line of "raven" is fictional. >> the story line is fictionalized. it's basically as if poe got involved in one of his own stories or was kind of engrossed or enrolled in one of his own stories. one of the things poe also wrote about, one of his themes was that sort of twilight between waking and dreaming and fantasy and reality and sanity and insanity so the fact that he would get immeshed in his own story feels poe like. >> a different character for you when you think about all of the characters that you played. often you play sort of this happy go lucky good guy. this is a real turn. is it just because you want to mix things up and that's sort of as an actor what you want to do. >> whatever opportunities you get. if someone said you can play edgar allan poe. you think, he's one of the great kind of lunatics and geniuses and such a complicated mixture of things. i just sort of jumped at the chance. >> when you play a character who is dark and creepy and comes sort of with a whole host of problems, is that something that sort of affects you personally as an actor. 5:00, we're out. wrap. we move on. >> depends on the project. you know, with poe i think you just sort of immerse yourself in his stories and in his divide there and he had such a tragic life. he lost his mother to tuberculosis and then he lost his stepmother and then lost his wife. i think he was really a haunted man. i think you just have to immerse yourself in that. it was just -- i just sort of stayed in it for the entire shoot so i felt a little bit like a vampire when i was done. then i went home for christmas and scared my family. what happened to you? >> when you look back at your career, do you think -- you were a child actor, right? most of the stories i have done on child actors -- >> guilty as charged. >> bad endings. >> i wasn't a child. i was -- >> teenage actor. >> 16, 17. the night is young. i could be dead by tonight president. >> by 40 something you have figured out the direction you're going to head. what do you think allowed you to have longevity that your colleagues hasn't had. is it interesting roles? >> i think a lot of it is luck and probably having really good parents probably who really didn't take a lot of that seriously and didn't sort of judge me and didn't think that fame really had any value and that character is more important than that. i don't know. i always had a mistrust for it. i was grateful for all of the opportunities but i mistrusted the glitzy part of the business so maybe that has helped. >> john kuszak. end point is up next with our panel. stay with us. this bowl of strawberries is loaded with vitamin c. and now, b vitamins to boot. coffee doesn't have fiber. unless you want it to. splenda® essentials™ are the first and only line of sweeteners with a small boost of fiber, or antioxidants, or b vitamins in every packet. mmm. same great taste with an added "way to go, me" feeling. splenda® essentials™. get more out of what you put in.
