as a mother, you hear these day care horror stories and pray it doesn t happen to your children. the fact of the matter is the employee who was supposed to be watching these children wasn t doing her job at the time. reporter: deputies say 23- year-old casey burke failed to properly care for the children. the arrest report says the kids were napping while burke should have been watching. instead, she talked to colleagues and ate lunch. at one point, she heard crying neglect which is a felony. we went to the day care looking for answers. but they didn t want to talk. i m not going to talk about it. reporter: 8 on your side went digging into records and found since december, the day care was cited twice for improperly supervising children. the department of children and families is steping in saying in a statement what happened to this child is absolutely unacceptable. we are conducting a child care attorney. burke no longer works at this facility. we are told the ....

candace mccowan joins us live. candace, there is actually a term for this. right? reporter: yeah josh, jen, good evening. it is called forgotten baby syndrome. you know how you are driving home from work and you automatically make a left turn. that is how these deadly mistakes can happen. dr. hammond calls it a tragedy. she says leaving a child in a hot car is any parent s wors just on auto pilot. we may get home and say i forgot to go to the store and those sorts of things. that is what is happening with parents that are leaving their children in cars. reporter: it is called forgotten baby syndrome. it is used as an argument in court for why parents shouldn t be convicted. it is the defense troy whittaker could use. lawson in the car for eight hours where he died. whittaker questions surrounds the fact he wouldn t take a blood test. he sometimes smokes marijuana. though he denied smoking it the day lawson died. is there any long term damage that can lead to forge ....

letting my dog out earlier, paramedics were parked in front of my house right here. and, i wanted them to know i didn t make a call. they told me to go back inside and lie down. they wouldn t tell me anything. reporter: as a deputy and a sergeant went inside the home, they found a man having what appeared to be a mental break down. they tried to came him down according to the sheriff to no avail. both members of the hernando county sheriff s office have gone through crisis intervention training but in this case, the team had to use lethal force and shoot the man who later died. you know, they had this training and obviously, in this case, it wasn t success. as hard as you try, you can t be successful every time when you are dealing with humans in crisis. reporter: and as a routine in situations like this, both the deputy and the sergeant are on paid administrative leave. fdle has traveled to hernando investigating tonight and the hernando county sheriff s office. ....
