the weekend. >> is your microphone working. for some it will warm up today, for others wait until the weekend. inland temps look like they will jump up. warmer over the weekend, certainly sunday for sure, when it looks to be the warmest day of the weekend for everybody. pretty good fog bank out there, i'll say for mid september. got chewed up on tuesday, boom, there it is. much of this is making a pretty good surge here for some. for others it's cloudy on the cool side. not much of a delta breeze. some upper 40s for some. 50s for others. very cool. look at the 40s here, black hawk, danville. lafayette, walnut creek. yet it is clear for many. fog will retreat. high pressure is building in, and the north, northeast breeze, hints developing by tonight into tomorrow. but today, 60s, 70s, coast and bay. 80s to near 90 for some inland. what do you have on a friday. friday light? >> friday medium. you know, we do have slow traffic out there. but it's not quite as robust as the commutes have been for monday through thursday. on this friday, we do see some slow traffic on the bay bridge toll plaza. it's about a 15 minute delay. a little bit more than that. not too much. once you get onto the bridge it looks good on the way into san francisco. we are also looking at a commute here on the san mateo bridge that has been moderately heavy. there's slowing on 92 in hayward getting to that point. and dumbarton bridge is medium. the silicon valley commute, this is a good indicator it's not quite up to the levels we have been. 85, 280 and 17 are all slow getting up to the interchanges. that's about all. 7:02. let's go back to the desk. happening now, a line around the corner, and the apple will have an hour to go until the release of the apple 7. christien kafton is at the apple store in union store, and one of the people there has been in line for a full week. >> absolutely. gasia. we'll introduce you to him in a moment. let's go ahead and show you the line. you can see the line stretching up the street, up and around the corner, lining up to see the new iphone 7. we had a chance to see one for ourselves at the at&t store in san francisco. we were there a couple hours ago, and had a chance to preview the iphone 7. it's v. responsive -- it's very responsive. that phone expected to be very popular. in fact, some models have already sold out, and that is just the news that justin harris has heard as we have been telling you, justin harris has been here for a full week. justin, if you could tell us for just a moment, first off, which phone are you waiting for and what have you heard about that phone. >> i was originally waiting for the iphone 7 plus, jet black model, but yesterday we were informed that there are not going to be any, or any jet black of the iphone 7. >> are you disappointed? >> no, i came out here for the experience, just to meet people and live life, and we had a nice little party last night, ordered some pizza, and got to hang out. >> reporter: got to ask you, what has that week been like? what has it been like being out in the street in front of the apple store for a full week. >> wild. you know, it gave me a completely different perspective on life. the first couple of days, the security, and literally being homeless and interacting with the community, and you know, being able to wake up and see that people cared. one night i went to sleep, woke up and there was food leftover for me. and on the other end of that, one night i woke up and my sleeping bag was gone, and claire and had to replace that. i've been able to experience both sides of the spectrum and as the day got closer, seeing the security step up, and you know, i guess to be more conventional. >> reporter: last question, just briefly, what's your plan since the iphone 7 plus that you were looking for is not available, what is your plan, briefly. >> wow, i don't have one. simply to enjoy the next, you know, hour and walk in, you know, celebrate with the rest of the apple employees, and enthusiasts in line. >> reporter: thank you so much. i appreciate it. we'll see if we can't put in a good word and get one of the iphones. there must be someone around here who has one. if you look around the corner, this is what everyone has been waiting for. the doors open at 8:00. you can see the apple employees putting those finishing touches on the inside of the store. those are the iphone 7's lined up over there, and not just here in san francisco. we had our producer, chelsea who texted me earlier and said she was on her way in, saying there was a line as well. clearly anticipation. >> the way the man described his week in lines, up and downs and community coming together, and generosity, it was moving in a way. >> reporter: it really was, and you know, this young man said there's a sense of community out here that there really has been a sense of community of people kind of pulling together, coming together. he says just this morning watching this kind of e involve, and seeing the line grow -- e evolve, and seeing the line growing and clearly folks have created their own village, their own community. >> as he mentioned, the iphone goes on sale in just one hour. some bay area apple stores opening early to handle the crowds and that includes the store on university avenue in palo alto. we hope you stay the ktvu facebook page and tweet us using the hark tag ktvu. a big fire in san mateo ripped through a condo complex. fire investigators still out there, but several people need a new place to live as a result. and one person is also mourning the death of her dog in that fire. ktvu's janine de la vega in san mateo now with the details of what happened. >> reporter: dave, investigators are here now. they wanted to wait until daylight so that they could get a better look at the building. they're also interviewing some people who live here in this condo complex. now, if you look here, you can see it's still standing, but there is definitely heavy damage on the roof and inside. this was a four alarm fire, which started just before eleven last night near highway 892 in rollston. neighbors smelled smoke. they called 911 and ran out of the building. when firefighters arrived, flames had engulfed one of the units. she was not home at the time but her dog was and did not survive. we spoke to a deputy fire chief about the damage. >> the first and second floor of the fire unit is completely destroyed, and then there is smoke damage to the units to the left and right. >> reporter: what does that mean for these people. >> that means that we have 8 occupants within this building that had to be displaced. they are currently staying with friends, but again fortunately nobody was injured. >> reporter: firefighters say it was a challenging fire because of the roof construction and the flames were trapped in the attic. there were concerns it was going to spread to a wildland area behind the complex, but it did not. investigators will focus on trying to figure out the cause of the fire. they're going to be talking to more people who lived here, including trying to talk to the woman who lost her dog. she was arrested for interfering with the crews during the fire. she tried to go into the building for her dog. she was cited and later released. certainly a sad situation for the people who live here and for that woman. gasia. >> janine de la vega in san mateo. thank you. well, jury selection will start today in the trial of a man involved in a highly publicized scuffle back in july with b.a.r.t. police officers in san francisco. 22-year-old michael smith is charged with battery, and resisting arrest in connection with a fight at b.a.r.t.'s elementary school bank dare row station in -- embarcadero station in july. smith is african-american and his attorney says it played a role in his fight with police. they deny claims he was acting in self-defense. the santa clara county sheriff's office has released the name of an armed man killed earlier this week in an officer involved shooting. the mercury news reports deputy shot and killed 86-year-old eugene craig during a tense encounter in a saratoga home saturday night. craig pointed his gun at deputies after ignoring repeated orders to drop it. this was the first officer involved shooting in saratoga in three years. authorities in the east bay are asking for the public's help as they search for the person responsible for a terrible case of animal cruelty. a dig nicknamed bullet is a 2- year-old german shepherd mix. veterinarians had to amputate one of his legs after being shot over labor day weekend. a good samaritan found the dog on monument boulevard. he had no collar, no microchip. authorities are trying to find the owner and the person who shot him. >> we want to speak to somebody who can offer information about the dog, and how it got to become in this situation. veterinarians say bullet is recovering and will soon be ready to be put up for adoption. anyone with information on this case is asked to contact animal services in contra costa county. the city of san francisco starting to distribute money to build affordable housing. it's part of a measure approved by voters last november. the chronicle reports four projects have received some of the $310 million in housing funds. now, the map you're looking at shows projects are scattered in the mission district, the exsellsier, forest hills and the western edition. these products are converting a former car repair shop, a bakery, and an old funeral home into hundreds of affordable residential units. the dog patch neighborhood association overwhelmingly approved plans for a homeless navigation center in their area. the san francisco port commission also unanimously approved plans for that center citing the need to help the homeless. now, november gas station centers are temporary shelters designed to help people find permanent housing. the center in the dog patch neighborhood is due to open next year. time is 7:11. video you have to see. if you have already seen it, you'll want to see it again. a great white shark leaps off the water, happening at san francisco beach, all caught on camera. at 7:30, reaction from eyewitnesses who saw this in person, and what scientists are saying might have made the another student. sadar kahn, campus police say he raped a 19-year-old woman at a school dorm two weeks ago. investigators say the two of them were acquaintances. meantime, the former dean of the uc berkeley law school filed a discrimination charge against the university. he stepped down after his former assistant accused him sexual harassment. the university found he violated the university's sexual harassment policy and they reduced his salary 10% for one year. although he resigned, he remained a tenured professor. the school's academic center is considering whether to strip him of his tenure. he is from south asia, and accuses the university of treating white faculty members more leniently. 25 years after after rodney king was beaten by los angeles police, his daughter is teaming up with officers to send a message of peace. laura king was just 7 years old when she saw video of her father being beaten on television. the now 32-year-old says she wants to spread a message about building bridges with police, especially to young people. yesterday she stood side by side be los angeles police officers and told a group of young people that her father had no hate in his heart against officers. >> he held no ill feelings towards anybody, so i mean, we definitely couldn't hold any feelings either, if he's able to get over it. not over it but look more so to a solution rather than, you know, dwell on the problem. >> laura king says an entire police department shouldn't be judged by the actions of a few officer. rodney king died in 2012 at the age of 47 in an accidental drowning. our time is 7:16. let's check in with exactly. -- sal. i know you're watching highway 24 and everything else. >> and dave and gasia, we have noticed today is a little bit better than it was the last two days, westbound 24, we're starting there. so what i was trying to say is the first four days of the week were busier. we have slowing here in laugh yet westbound -- lafayette westbound and orinda, and 680 as you drive from pleasant hill to walnut creek. we are looking at of course the bay bridge toll plaza and you will see the traffic here is going to be okay. it's moving along just fine. once you get to the toll plaza, there's about a 15 minute wait, but just looking at those middle lanes, it's moving as it should for this time of the morning. we are looking at slow traffic on the san mateo bridge approach, and we're taking a peek at the south bay commute. the commute here is moderately heavy. 85 is getting a little bit slower to saratoga, and up to sunnyvale. 7:17, let's go to steve. >> sal, thank you, sir. >> you're welcome, steve. we have a rather robust fog bank. some of that is down on the deck. some of it still a low cloud deck. there's a lot of x-ray over the bay. some -- gray over the bay. very cool for some. lots of 40s, 50s, so it does look like a better weekend for the coast as we get more of a northerly breeze. right now, it's more of a west, southwest. if you have the fog, it's cool. i want to show the hawaiian island. there are flash flood watches out for oahu. improving conditions will kick in over the weekend and early next week. there's a lot of rain around there. they have had a ton of rain. remember last september when we were talking about that very strong el nino. how did that work out for us. well, it's below average on the rain. some areas near average, others below. this year we thought we would go diving into a la nina, colder pattern. it's leveled off into more neutral conditions, which are okay. neutral is not bad for us. that's not really a dry pattern. we have had rainy years with neutral conditions, and that's okay. the winter outlook looks to be wetter, colder to the north. dryer to the south. however, what about in california. they're saying higher chances of being dry to the south, equal chancings for us on the board -- chances for us. we're on the border. remember last year, though, above normal rain, below normal rain. how did it turn out, just the opposite. would not stop raining in the pacific northwest. they couldn't buy a drop in southern california and the desert southwest. just food for thought. i think it will be colder and i think we'll have good rain. that's my 2 cents. giants, cardinals, cool tonight, warmer on the weekends, saturday, sunday, looks to be warm. san francisco, 65. 54. 70 is average. 55, so below on both. 101, 50 back in 1898. the record low, plenty of fog and low clouds. there are signs that warmer air is squashing that which will translate. plenty to go around. take your pick. some areas to the east bay are clear, and others are socked in. look for the breeze to kind of tail off here. that along with temperatures. 50s on the temps, upper 40s here. peninsula temps are low, and mid-50s. everyone is close. 27 in truckee. 47 ukiah. fog retreats, gives away. high pressure is nosing in and a northerly breeze is developing. that will scour things out later. pockets of thick fog, near 90, well inland. others locations will have to wait a little bit. 60s to 90s. just depends. still summer, but again, the angle of sun is not as high. the nights are leaders are taking a big step in trying to bring the raiders to their city. a nevada tourism committee unanimously approved a plan to finance a $2 billion domed stadium. committee members recommended raising a hotel tax and chipping in $750 million of public money to support the stadium project. the raiders and the billionaire casino mogul would pay the rest. supporters say a new stadium would bring the raiders and a super bowl to las vegas. >> so the economic impacts and all the other ancillary things, besides the raiders is going to raise room rates and increase visitation. >> the governor will decide whether to call a special session of the legislature to vote on the stadium project. supporters hope it will happen by november so nfl members can consider in april. the libby schaaf is offering hope to raider nation saying there's a long and complicated history between the team and the city. we have learned from the mistakes of the past and we won't repeat them. oakland is neither rolling over nor giving up. time is 7:24. president obama is creating the first national marine monument in the atlantic ocean. it's 150 miles off the coast of cape cod. that designation protects sea life and underwater canyons, it also bans commercial fishing and drilling in that area. just last month, the president expanded a national monument off the coast of hawaii, creating the biggest protected marine preserve in the world. the new beatles documentary, 8 days a week, the touring years is now hitting movie screens around the bay area. paul mccartney and ringo star reunited in london, walked the blue carpet in the movie's world premier. 8 days a week is directed byron howard. he said he saw those early years as an adventure and survival story for the beatles. he used rarely seen or heard material in that movie and says he took the project very seriously. >> for me, it's been a great experience. it first began as just a, you know, a fun cool creative adventure, then i became very intimidated by it, when i realized how important it was to fans. >> the documentary shows the beatles as they toured the globe back in the 1960s. it also has archived footage of the it's been down right cold for some. many people say this is the coldest summer i can remember. inland temps will bump up. giants tonight, cool tonight, and warmer into the weekend as we start to get more of a northerly breeze. does not look like a classic september offshore breeze. there are signs saturday and sunday, even in the city will be warmer. plan accordingly. boy is there a lot of fog out there. there's warm air aloft. what breeze is there, it's very cool. plenty of locations that are cloudy, foggy, and cool. other locations, mainly east bay dealing with more sun. west, southwest, 13, that's not much. 15s on the temps, 40s, to the south, boulder creek, a brisk, 43. santa clara at 56. cupertino also at 53, and gilroy, upper 40s, low 50s, without that breeze might be slow to warm for some. there are signs high pressure will give us a warmer weekend, east bay temps, and inland locations jump up a little bit today. pockets of thick fog, once that burns after, 60s, coast -- burns off, 60s, coast and bay. not friday light but friday medium. >> it's not bad. it's definitely a little better than it was yesterday when it comes to the morning commute. let's go outside and look at what we have. we're of course checking out the bay bridge toll plaza. this looks typical. about a 20 minute delay before you make it onto the bridge, and you'll see slow traffic. we are also looking at other parts of the east bay commute, and we always look at the east bay. the east bay tends to be slower, and we have noticed that southbound 880, there is a slow down now approaching 98 because we have something blocking the two left lanes here. southbound 880 at 98, so sort of a hazard that chp is reporting, and you can see that that's unusual slow. on the left is traffic heading toward hayward, and we're going to keep an eye on that for you. let's talk about contra costa county commute, highway 4 is slow through pittsburg and bay point. 680 slows at 242. at 7:32, let's go back to the desk. we are finds out more of a man accused of robbing and severely beating an 88-year-old woman in san jose. court documents show he lives in the same neighborhood as the elderly victim. ktvu's brian flores back with us now with more on her condition and also last night's emergency safety meeting, brian. >> reporter: many people disturbed by this story. yesterday about a hundred neighbors showed up for an emergency safety meeting to talk about their concerns following the arrest of 19-year- old zachary cuen. investigators say he broke into the home of a woman known as miss flo. robbed her of jewelry, ransacked her home, and stole a car. a neighbor found the car abandoned down the street on monday, and found her bleeding inside the house. family members say she had been living in the house since 1964. according to the court documents, the suspect lives about two blocks away from miss flo who remains in critical condition this morning. neighbors say they are happy about the arrest but they are still worried about crime in their community. >> i'm upset about what's been happening. i'm really upset about the poor woman who was attacked. i'm concerned about our safety in the neighborhood. >> court documents reveal cuen was on probation. back in february, he was arrested for stealing and trying to sell a car, and for hit-and-run. a law enforcement source also tells ktvu in spring of 2015 when he was a juvenile, he was arrested for an attempted house burglary where the victim in that case was also an elderly female. investigators say it's unclear if cuen acted alone or had an police in the latest robbery. his arraignment set for monday being held without bail. as for miss flo authorities say she's in grave condition and there will be a prayer vigil at her house later tonight. >> what a story. thank you. two men face a possible life prison sentence for the killing of an oakland anti- crime activist. yesterday, a jury convicted 25- year-old stephon lee and 24- year-old mario floyd of first- degree murder for the killing of judy solman. prosecutors say the 66-year-old woman had taken cell phone video of the two reputed gang members as they were committing a crime in her maxwell park neighborhood in july of 2013. investigators say she was shot and killed after following the two men in her car. the teenager at the center of a police sex scandal is back in the bay area, going by her real name. jasmine abuslin. she was previously known as celeste guap. she sent the last few weeks in rehabilitation and jail. the 19-year-old claims to have had sex with 30 officers from law enforcement agencies across the bay area, some when she was a minor. yesterday, her attorneys questioned whether the richmond police department may have wanted the teen in florida as part of an attempt to obstruct justice. >> no, she didn't voluntarily go to florida. rather she was told that she needed to go to florida because she had dabbled in drugs, and this would be like a vacation, and she needed to go urgently. >> richmond police and the contra costa d a's office secured the funds to send her to florida, but would not say why she was sent there. abuslin is expected to testify in the prosecution of 7 officers in alameda county caught in the scandal. now to the presidential race, donald trump appearing last night on the tonight show talked about how he handles the up and downs of the poll results. >> do you pay attention to the polls. >> i love the poll, but i don't pay attention if i'm losing or lagging, i never mention it. >> and then there was this. donald trump let jimmy fallon mess up his air a lot. on a more serious note, trump told the washington post he remains unwilling to say that president obama was born in the united states. trump has repeatedly raised questions about where the president was born over the past five years, and hillary clinton was quick to weigh in on that issue. >> he still wouldn't say america. this man wants to be our next president. when will he stop this ugliness, this bigotry. >> now, hillary clinton is back on the campaign trail after being sidelined three days with pneumonia. both trump and clinton have several appearances this morning, and there are reports donald trump will talk about whether or not he now believes president obama is an american citizen. back at home in the bay area, a fish tail you have to believe because it's caught on video. a great white shark leaps out of the water just behind a line of surfers at san francisco's own ocean beach. alex savidge is here with what eyewitnesses have to say about what's shocking to see on tape. >> it's incredible for us to see, and long time surfers say they have never seen anything like it. they were stunned by what they saw in the water this week off the coast of san francisco. that great white shark leaping up into the air. it was not all that far from the shore. this happened wednesday morning. it was near ocean beach in san francisco. about 30 or so surfers were in the water at the time when suddenly, that 7 to 8-foot shark makes its surprise appearance. researchers say it's not uncommon for some sharks to jump out of the water. it's hunting behavior. and this shark, likely was trying to feed on a school or fish or something else in the water. we talked to one surfer who was there at the time this all happened. >> i traveled pretty quick in. not everybody did. people stayed out there. die hard surfers, they weren't sure what they saw. a group of 6 or 7 of us came in. >> there you go. who can blame them. this leaping shark was caught on camera, they had a web camset up to show the surf conditions to folks online. researchers say it doesn't appear this great white was interested in the surfers who were close by, and surfers we talked to say this isn't going to keep them out of water. it makes me nervous. i don't go in the water because it makes me cold. >> we have long time bay area surfers, meteorologist mark tamayo. every surfer has been a story of being bumped or coming close. >> sure. and the researchers that we spoke with say the sharks are always there. they're always a lot of them tend to cruise the surf breaks and they're under water, but this is just, you know, a dramatic verbal of the fact -- visual of the fact that they're ever present. >> sharks doing what sharks do. >> thank you. time is now 7:38. the giants, they gained some ground in the division. they added to their wild card lead, beating the cardinals 6-2 to open up a four game series. got off to a good start in the first inning, two outs, buster posey singling to right, first pitch he saw. he had four hits last night. the first set the table for hunter pence to do that. a homer, a two run homer giving the giants a 2-0 lead. the giants gave the lead back, and went ahead for good in the 4 4th. johnny quado, went the entire game, the distance, got good defensive help. way to go brandon crawford. struck out 7 batters in his 5 5th complete game of the season. >> it was a big one. quedo did a great job for us. fast ball command got better and better, and it was big for him to come out and give us a complete game. >> and bruce bochy gave them a mental break, canceled batting practices, he's doing the same thing tonight for game two of the series. matt moore will pitch for the giants. the chicago cubs became the first team to clinch a playoff spot. they actually lost to milwaukee but as soon as the giants beat the cardinals, the cubs won the national league central title. the cubs are trying to end their infamous championship drought. they last won a world series in 1908. they haven't won a national league pen ant since -- pennant since 1905. the a's swept the world series champions, kansas city royals. highlighted by this 3-run home run by rookie ryan heely. the ball went an estimated 480 feet. one of the longest projected home runs of the season. that was one 13-year-old ohio boy shot and killed by police in columbus are demanding a fair investigation of the shooting. tyreke king was shot wednesday night after police responded to a call of an armed robbery involving three suspects. police chased king and one of the other suspects in the alley. king pulled out a bibi gun and pointed it had at them. officers shot him. investigators say they didn't know it was a bibi gun until after the shooting. >> we found a gun at the scene near the suspect that we were trying to apprehend and this is what that gun looked like. >> there is inherent bias in the police with a meat cleaver. that cell phone video captures the violence and chaotic scene in midtown manhattan yesterday evening. police confronted the suspect who they say was irate after finding his car locked with a parking boot. investigators say the shooting came after the suspect attacked the off duty officer with an 11- inch meat cleaver. officers fired 18 shots, critically wounding the suspect. that off duty officer is in serious condition with a slash to his face: our time is 7:46. new this morning, the arrest warrant for wikileaks founder julien assange will not be dropped. he is wanted in sweden by prosecutors there in a rape investigation. today, a swedish appeals court upheld the arrest warrant, rejecting an arrest by assange to have it lifted. assange has managed to avoid being extradited to sweden by seeking shelter at the embassy of ecuador. he says he won't travel to sweden because he fears further extradition here to the u.s. over wiki leeks of military files on the wars guys, the doors technically are open but they aren't letting the first fans in quite yet. these are the first 24 fans who are lining up to be let in. those doors expected to open here momentarily. this is the moment that fans have been waiting for. you can see a lot of excitement, a lot of fans very very excited about being among the first to get their hands on the new iphone 7. the gentleman you're looking at, we talked with him, justin harris, a little bit earlier. he has been out here a full week, camping at the union square store, hoping to get his hands on an iphone 7 plus. unfortunately he tells me that they do not have those available here. he is trying to plan out exactly what he's going to do. he's not sure if he's going to opt for another model or try some other thing. he says the sense of community out here among the iphone fans and among the apple fans has been enough for him so far. you can see lots of other fans out here. now, we did have a chance to test out that iphone 7 ourselves a little earlier this morning at one of the at&t stores, and guys, i can tell you from firsthand experience, it is very fast, a slick phone. it's a pretty good indication they are just about to start opening the doors and letting the first 24 super fans in. you heard these are the fans who have been here a good long time, fans who have been camping out. fans who have socked in. low clouds and fog and some very cool temps as well. upper 40s, low 50s and fog goes down to the salinas valley. now it's ten. that's pretty light there. northwest, west, southwest, north, north, northwest, that's a sign the pattern is changing here. that will take care of the fog. 50s on the temps. upper 40s, lafayette, concord, they will warm up quick. still, we are holding in the know. let me know on twitter. east shore, we're going to start with the east bay commute. it has been slow, and if you are driving on 80 westbound, 31 minutes, though, let me give you a little comparison. 31 minutes today, it was 56 or 57 a couple of days ago. i think we're much better. i know we're much better, looking at the numbers. there still will be slow traffic for you to deal with. when you get to the bay bridge toll plaza, traffic is backed up. that's been steady and slow all morning long. we have been looking at the peninsula just to take a peak at what 101 looks like. traffic is not bad. we can go to the maps, and show you 101 through san mateo is not bad and then for the silicon valley commute, 101 is slow getting into sunnyvale and cupertino. we have had a couple minor accidents with no major delays. new from overnight, an intense fire fight at a apartment complex forced a group of families out of their homes. janine de la vega has the story. >> reporter: fire investigators have determined that the fire started in a rear bedroom of one of the units. now, the woman who lives there is devastated because of course she lost her home, and she lost her dog. you can see the building is still standing but it is still uninhabitable. the fire started just before 11:00 last night off of highway 92 and rollston. it was burning in one of the units of the three story complex and by the time firefighters arrived, it was completely engulfed in flames. people in the adjoining units escaped. firefighters concentrated on putting out the fire and preventing it from spreading. it was trapped in the attic and quickly grew, enough for firefighters to call for a 4th 4th alarm. >> we have 6 units under one roof, and also on the backside of the building, we have a wild land area. we wanted to make sure that the fire didn't get extended to the wild lands and cause a fire in the hills as well. there is a lot of smoke and water damage to all the units in the building. now, no one was inside the one where the fire started but a dog was, and as i mentioned it did not survive. the woman came home to find the fire dried, and police arrested her for interfering with crews, apparently trying to get back into the building to see her dog. she was cited and released when she caulk down. -- calmed down. firefighters don't know the cause of the fire yet. they plan on talking to the condo owner to try to figure out just what happened here. reporting from san mateo, janine de la vega, ktvu fox 2 news. the santa clara county sheriff's office released the name of an armed man killed earlier this week in an officer involved shooting. deputies shot and killed 86- year-old eugene craig during an encounter at a saratoga home on monday night. the sheriff's office says officerrings were forced to open fire -- officers were forced to open fire after craig pointed his weapon at deputies after repeated warnings to drop it. this was the first officer involved shooting in saratoga in three years. the former dean of berkeley law school, sujit choudhry stepped down in march after his former assistant accused him of sexual harassment. the school found that he violated the university's sexual harassment policy and cut his salary 10% for a year. although he resigned, he remained a tenured professor but the school cease academic senate is now considering whether to strip his tenure. choudhry's federal lawsuit accuses the school of more lenient treatment of white faculty members. a great white shark at san francisco's ocean beach. >> terrible case of animal cruelty. a dog named bullet is a 2-year- old german shepherd mix. he was shot during the labor day weekend. a good samaritan found the injured dog on monument boulevard. he had no collar, no micro chip. authorities are trying to find the owner and the person who shot him. >> we would like to find someone who has information about the dog and how it got to become in this situation. >> veterinarians say bullet is recovering and will be ready to be up for adoption. anyone with information on the case is asked to contact animal services in contra costa county. beyonce is to get red again. >> some commutes are getting redder, people are realizing it's good to go, so i'm going to go now. other commutes have stayed steady. the east shore freeway between the carcinas bridge and macarthur maze. that's been the peak. others days we have had 60 minutes, 50 minutes. this week we have had some much worse commutes, so 32 minutes is not too bad. when you get to the bay bridge, you will see slow traffic as you get there. this is a look at the bay bridge toll plaza. it's beginning to improve. now, steve did mention the south bay commute, and i want to touch on that, because 101, as we look at the maps here, 101 is going to be slow as you drive up to the sunnyvale area. the good thing is 280 is getting better and 85. if you're waiting on the commutes to get 88-year-old woman in san jose. court documents show he lives in the same neighborhood as the victim. >> ktvu's brian flores in our newsroom with more on the woman's condition and the emergency safety meeting that was just held, brian. >> certainly many people are concerned, yesterday, about 100 neighbors showed up for an emergency safety meeting to talk about their concerns of 19- year-old zachary cuen. he broke into the home of a wok known as miss flo, robbed her of the jewelry, ransacked her home and a neighbor saw the car abandoned down the street on monday and found her bleeding inside the house. family members say she had been living in that house since 1964. now, according to court documents, the suspect lives about 2 blocks away from miss flo who remains in critical condition this morning. neighbors say they are happy about the arrest, but they are still worried about crime in their community. >> i'm really upset about what's been happening. i'm really upset about the poor woman who was attacked. i'm concerned about our safety in the neighborhood. >> now, court documents reveal cuen was on probation. back in february, he was arrested for stealing and trying to sell a car, and for hit-and-run. a law enforcement source also tells ktvu back in the spring of 2015, when he was a juvenile, he was arrested for an attempted house burglary where the victim in that case was also an elderly female. investigators say it's unclear if cuen acted alone or had an accomplice in the latest robbery. his arraignment set for monday. being held without bail. as for miss flo, authorityings say she's in grave condition and there will be a prayer vigil saturday night. a teenager now goes by her real name, jasmine abuslin, she was previously known as celeste guap. she spent the last few weeks in rehabilitation and then jail in florida. the 19-year-old claims to have had sex with 30 officers from law enforcement agencies across the bay area, some when she was a minor. just yesterday, her attorneys questioned whether the richmond police department may have wanted the teen in florida as part of an attempt to obstruct justice. >> she didn't voluntarily go to florida. rather she was told that she needed to go to florida, because she had dabbled in drugs, and this would be like a vacation, and she needed to go urgently. >> abuslin is expected to testify in the prosecution of 7 officerrings officer -- officers in alameda county. and officers in contra costa are investigating allegations of officers have sexual contact with her. two men face a life in prison sentence in the killing of an anticrime activist in oakland. a jury convicted 25-year-old stephon lee and 24-year-old mario floyd of first-degree murder in the killing of judy salamon. prosecutors say the 66-year-old woman had taken cell phone video of the two reputed gang members as they were committing a crime in her maxwell park neighborhood in july of 2013. investigators say she was shot and killed after she followed the two men in her vehicle. back now to the unusual shark sighting at san francisco's ocean beach. a great white dramatically leaping out of the water as you can see, caught on camera. >> alex savidge is here with more on what people who saw this in real life have to say. those who saw it on video, keep wanting to see it. it's incredible. >> a number of surfers were there and witnessed it. it all happened wednesday morning off of ocean beach in san francisco. at the time there were about 30 or so surfers in the water when suddenly, you see that 7 to 8- foot shark, it just leaps clear out of the water. researchers are saying that it's not uncommon for sharks to jump like that. it may have been trying to feed on a school of fish in the area or something else in the water. one surfer who was in the water when this happened said he headed back to shore and he was in awe when he saw the piece of video. >> the shark launched out of the water, straight up mouth in the air, and its full white pelley, pectoral fins, i consider myself lucky to have seen that, and to have all ten toes and fingers is awesome. >> that leaping shark was captured on camera by a company called surf line which had a web cam set up to show surfers the surf conditions. sharks are often cruising the surf breaks off the coast of the bay area, but usually staying under the surface. not jumping out of the water. this is certainly an interesting sight, a rare sight for those who were there. it doesn't appear as though this great white was all that interested in the surfers nearby. >> at that moment. >> at that moment in time. >> if the shark missed the school of fish and he's still hungry, so we never know. >> and some surfers stayed out there. >> some of the guys did from what we understand. there was a group of surfers who were in the water. some saw it happen if they were facing that direction. a group of them came back in. i don't blame them at all. that would be me. i held the arrest warrant rejecting the request by assange to have it lifted. assange managed to avoid extradition to sweden for the past four years by seeking shelter at the ecuadoran embassy in london. he fears further extradition to the u.s. over wikileaks on the wars in afghanistan and iraq. the families of a 13-year- old boy are demanding a fair investigation of the shooting. tyree king was shot after police responded to a call of an armed robbery. officers chased tyree king and one of the other suspects in an alley. king pulled out a bibi gun and pointed it at them. that's when the officer shot him. investigators say they did not know it was a bibi gun until after the shooting. >> we found a gun at the scene near the suspect that we were trying to apprehend. and the this is what that gun looked like. >> there is inherent bias in the police investigating themselves, and we have an issue with this being a 13-year- old child and the call nationally already for a transparent investigation into the shooting. >> king's family says he did not have a criminal history. yesterday, his family, classmates and football coach held a candlelight vigil for him. the officer who shot king is a 9 year veteran of the force. columbus police say he has been placed on paid administrative leave as they initiative the shooting: the city it of san francisco is starting -- the city of san francisco is starting to get money. four projects have received $310,000 in housing funds. the projects are scattered in the mission district, excelsior, forest hill and the western edition. they are converting a former car repair shop, bakery, and old funeral home into hundreds of affordable residential units. in san francisco, the dog patch neighborhood association has overwhelmingly approved plans for a homeless navigation center in the area. the san francisco port commission unanimously approved plans for the center citing the need to help the homeless. navigation centers are temporary shelters that are designed to help people find permanent housing. the have the there in the dog patch neighborhood -- the center there in the dog patch neighborhood is set to open next year. how are we looking? >> we're looking better. there has been improvement in many commutes that were just jammed about a half hour ago. you can see some improvement at the bay bridge for sure. this was jammed oakland coliseum, and 580 from san leandro to the lake shore curve. we have been looking at the south bay commute, and we have been looking at some of the ways to get into the silicon valley, and 880 the s&p 500, the dow and the s&p 500 down about a 1/2 percent. the nasdaq off just about a 1/4 percent this morning. fiat chrysler has issued a worldwide recall of almost 2 million cars. the problem is with the air bags and seat belts, linked to at least 3 deaths. the recalled vehicles include the chrysler sea brink, dodge avenger, and dodge and jeep patriot. model years range from 2010 to 2014. fiat chrysler says the problem involves hardware that can fail to activate the air bags and seat belts in some accidents. twitter, already looking ahead to next thursday's nfl game between the new england patriots and the houston texans. last night, twitter aired the nfl game for the first time in its history. the new york jets beating the buffalo bills, 37-31. very close game, and twitter reportedly paid the nfl $10 million to show ten games. that was one of them this season. the live stream was trending on social media throughout the night. some viewers, though, complained about that constant buffering, and they also were apparently comparing the two. they say the twitter video was lagging behind the tv coverage. cup of noodles is changing its recipe after requests for a healthier student in lake county says she has been sitting during the pledge of allegiance for years, long before colin kaepernick's protest. she is native american and says she has no allegiance to the stars and stripes. she has been sitting down during the pledge of allegiance, but one teacher lowered her grade because she viewed her refusal to stand as a lack of class participation. >> i was mad when she lowered my grade. i worked hard for it, and i turned everything in. i did whatever she wanted me to do in her class. >> thomas complained to school administrators about her punishment, and they immediately sided with the teacher, moved her to another class, but the school is not revealing whether or not it punished the teacher. chp is investigating an accident in san jose where someone was run over and killed by his own truck. it happened yesterday morning just after 9:00 near hicks hicks and alameda road. the man was drawing a dirt haller when he merged left to pass a truck. his truck partially went up a hillside and tilted up, and the driver either jumped or fell out and was run over by the truck. the truck then kept going down the road without the driver and fell about a hundred feet down an embankment. investigators are looking into whether a medical emergency or possible mechanical problem caused that crash. some of the world's top race car drivers are in wine country this weekend. practice begins for the go pro grand prix of sonoma's spectator gates open just about an hour ago. there are practice runs throughout the day for the grand prix as well as several other auto races. the go pro grand prix, again, this sunday, and it is the season finale of the indy car circuit. the iphone 7 is now in stores. ktvu's christien kafton is checking out the phone which talking to
