carcinas bridge to the macarthur maze. traffic looks good into san francisco. at the bay bridge toll plaza traffic is going to be busy at the toll. it's about 15 to 20 minute delay. no problems getting into san francisco. the morning commute looks good. we did have an earlier accident that's been cleared. traffic is going to be slow. we are looking at slow traffic on highway 4. still pretty slow coming in through all of pittsburg and into bay point. now at 7:02, let's go back to the desk. the unsolved killing of a college professor is prompting san jose police to release new surveillance video, and the police hope the public can help identify a person investigators want to question. ktvu's janine de la vega you're at san jose police headquarters. tell us what's on that video. >> reporter: well, the video shows a person of interest, and police need the public's help in identifying him. take a look at this surveillance video which shows a man that is walking down a street. he's wearing some dark clothing there. detectives think he knows something about the murder of 37-year-old david moglen. they hope someone recognizes him and calls the department. in july, police say moglen was shot to death near sherman and willow street while chasing a man who just robbed minimum. police canvassed the neighborhood, and they haven't been able to identify suspects and they are hoping to bring closure to his wife and two small children. moglen worked as an economics professor at foothill college in los altos and faculty and staff described him as intelligent and well liked. we reached out to police to see if we could talk about the challenges in this case, we hope to hear back in the next hour. back to you. >> janine de la vega in san jose, thank you. meantime, the san jose city council is considering a tougher gun law for the city. the proposed law would toughen requirements for buying guns, reporting when they're stolen and would require gun stores to record all ammunition sales in an electronic log. critics say the proposal is impractical. it's hard to enforce, and it won't stop violent crime. if this is approved by the city council, the law would put san jose among oakland, san francisco, and sunnyvale as cities that have adopted local gun control laws. there could be more fallout from the growing sexual misconduct scandal that's flagging several bay area law enforcement agencies, and ktvu's brian flores live in oakland with what we expect to hear today. brian. >> reporter: good morning, pam. yeah, the alameda county district attorney is expected to announce whether more officers will be charged in this ever growing sex misconduct scandal that we know has affected several bay area law enforcement agencies. nancy a molly expected to hold -- o'malley expected to hold a news conference at noon in oakland to discuss her decisions in this case. if the da finds evidence leading to criminal charges, the names of the officers involved could be released. on wednesday, as you recall, oakland mayor, libby schaaf, announced plans to fire four officers, and send one to counseling in training. a 19 year old celeste guap said she had sex with dozens of officers while she was underage. and yesterday, the livermore police department announced that an officer resigned because of his involvement with the woman at the center of the scandal n. a statement police chief michael harris said quote here this incident does not accurately reflect the professionalism of the men and women of the livermore police department who protect our community every day. livermore police say they became aware of the officer's involvement back in june. he was placed on administrative leave, but then he quit a week ago based on an internal review. of course this has affected several bay area law enforcement agencies as well, but again, the announcement coming later this afternoon by the da noontime here at the courthouse in oakland. pam, back to you. >> as you said, affecting a lot of communities and a lot of police departments. >> reporter: yes. >> thank you, brian. 7:06 is the time right now. happening today, the house of representatives set to vote on a controversial bill that would allow the families of september 11 victims to sue saudi arabia in the u.s. courts. now the senate passed legislation in may. the house is expected to approve it as well. president obama has said he would veto the bill. there has been suspicion saudi arabia was supportive of the september 11th attacks. 15 of the 19 hijackers were from saudi arabia. critics say it would damage an important relationship with saudi arabia, and could open the door for the u.s. to face similar lawsuits in other countries. time is 7:07. today voters in north carolina can start submitting mail-in ballots in the presidential race. if that has hillary clinton and donald trump out on the campaign trail trying to win support. a new swing state poll shows florida, north carolina, ohio, and pennsylvania all within that margin of error. >> for trump to win, he's going to have to win all the states that mitt romney won, and on top to have that, pennsylvania, florida, and ohio. so unless those states work out for him, he's not going to win. >> and then there's libertarian candidate gary johnson. he wants to be included in the upcoming presidential debate. but in an interview this week, he was not able to answer a question about the city of aleppo in syria, which has been at the heart of the civil war there. it's not clear what kind of political damage this will have on his campaign. facebook cofounder, dustin moskovitz says he is donating $20 million to help hillary clinton. in a blog postwith the title compelled to act, he says this is the first time he and his wife have endorsed a candidate or contributed to a campaign in a presidential election. he says he's supporting hillary clinton because if donald trump wins quote the country will fall back wards and but is expected to recover after being shot while responding to a domestic disturbance call. it happened about 6:00 last night in the community of dell high south of turlock along highway 99. a man came outside the home with a rifle and opened fire on two deputies who responded to the call. one was shot. the other deputy fired back, shooting and killing gunman. >> it's very difficult. you know, these guys are coming out here every day doing these things, and again, putting their lives on the line by a very positive thoughts the deputy is going to pull through this all right, and we're taking care of it as we can. >> the gunman was identified as 38-year-old jose torrez. the deputy who was shot was not identified but the sheriff says he has more than fifteen years of law enforcement experience. we now have a timetable on when all san francisco police officers will be wearing body cameras. they should all them -- have them by the end of the year. the department is rolling the cameras out station biestings. engelside and -- station by station. engelside and bay view were the first to get them. japan town and the marina already cameras in the next week or two followed by the mission station near the end of the month. new this morning, the spanish government is launching an investigation into a deadly train derailment just hours ago. the train was traveling to portugal when it jumped the tracks in northwest spain. at least four people were killed, about 50 others injured. now, the train apparently hit part of a bridge and signaling tower. there were 63 passengers, two crew members on board. no word yet on how fast the train was going, but the damage indicates it was traveling at a high rate of speed. well, 15 days after that devastating earthquake in italy, firefighters made an incredible discovery. they pulled a small cat out of the rubble alive. incredible. now, the cat has a fractured jaw but otherwise appears to be okay. you see them treating it. the cat even tried to scratch the hand of the fright who was trying to -- firefighter who was trying to pull it out. the 6.1 quake took the lives of 300 people. the italian rescue agency says it has helped rescue more than 900 animals. >> wow. 7:14 is the time right now. let's check back in with sal who is covering traffic. pretty light on this friday, sal? >> it's not light, but it's not as busy as it was yesterday. so it's a little lighter, but this morning we still have slow traffic out there. good morning, pam, and dave. let's go out and look at 80 westbound, the bay bridge. you will see traffic is backed up for a 20 minute delay before you make it onto the span. it's not a bad commute at all as you drive into san francisco. we had an earlier stalled motorcycle. it slowed the metering lights down. that's why it is a little bit slower than it is. the motorcycle is gone from the bridge. this is a look at interstate 880 north and southbound. this traffic has not become filled in just yet. northbound as you pass the coliseum. and driving a little further south from hayward to fremont. slow traffic. yesterday was much worse. today this gets better at dakota road heading south. 7:15, let's bring steve in here. >> thank you, sal. >> you're welcome, steve. let's get to it, a big fog bank out there, and temperatures cooled off yesterday, and today we'll see a little bit warmer inland temps. probably not much change coast and bay, but it does look like some of those inland temps will come up a few degrees after a 15, almost 20-degree drop for many yesterday. the fog has made it all the way up to cloverdale, not here, but right about here. not here, but right about here. take that graphic. there you go. brian says the beautiful foggy, 56-degree morning in cloverdale and we're not temperatures will warm up away from the coast. santa rosa took the plunge yesterday. after 90s on wednesday. 73 yesterday, bump you up to 80 today. have to get a north wind for that to happen. i think it will kick in later. concord up 5. yesterday's 76. los gatos 81 to 84 degrees. a little bit warmer here. the big news continues to be next week. a low is going to move in coming in over land. it's going to drop in around eastern oregon, idaho, then come back toward the sierra. where it ends up, it may not even come close to this projection. i have seen one that puts it over mendocino county. there it is over sacramento. generally this time of year, when they do that, they end up over the sierra. windy and cooler for us monday, tuesday. if it does come back to the west, maybe some shower activity could be in the forecast on tuesday. fog and low clouds here will give way. sunshine, i think that fog burns off a center here. the delta breeze has been cut in half. yesterday was much purchase stronger. 50s -- much purchase stronger -- much much stronger. we'll keep an eye on the system coming down. late sunday into monday for sure, on tuesday. could be interesting here. usually when they come over land they don't have a lot of cloud cover to work with. 60s to 90s. after tomorrow, i would think that would be it for the 90s for a bit for sure because some of these inland temps, which are in the 80s, 90s now may be hard for us to get over 70 next tuesday. it will feel fall like early next week. weekend looks good. saturday will be warmer, and cooler as fog starts to have smart trains run quietly through two north bay cities. novato, and san rafael yell have both sent applications to the federal railroad administration to set up quiet zones near some smart train crossings. novato has completed the required 60 day public comment period. san rafael yell -- san rafael has asked for a quiet zone operation, for train operators not to blow the horn at some vehicle or pedestrian crossings. that is unless there's a hazard on the tracks or the train is leaving a station. the sonoma marin area rail transit is due to start service later this year. an emergency fund for the bay bridge is running low on cash. now, the san francisco chronicle says when the fund was created in 2005, it had about $900 million but a variety of problems like corroded rods and other unexpected repairs we have reported have used up a lot of that money. the chronicle says the fund has about 68 million dollars left and that may lead to toll payers paying more for extra repair work. however, the metropolitan transportation commission says there are no plans to raise the bay bridge tolls at this point. time is 7:23. new this morning, nissan now recalling some of its most popular vehicles because of a fire threat. nissan is recalling 120,000 cars and suvs in the u.s. because brake fluid can leak and possibly start a fire. the recall covers 2015 to 2017murano suvs and 2016 to 2017 maxima large cars. they have intelligent cruise control. some 2015 and 2016 murano hybrids are also affected. several vehicle fires have already been reported. nissan will notify car owners within two months. well, ford is expanding a huge recall over faulty door latches. concern is that the doors can pop open while the car is moving. ford says it knows of one accident and three injuries linked to that problem. now, here the latest recall includes the 2012 to 2015 ford focus, the 2013 to 2015cmax and escape, the 2015 mustang. the lincoln mkc, and the 2014 to 2016 ford transit connect advance. if you have any of those -- vans, if you have any of those cars, take them to a ford dealership and they will be fixed. air bnb is trying to cut down on discrimination. the home sharing seattle asked a former aclu director to review its platform and develop ideas to fight discrimination. under the new policy called open doors, air bnb will help find accommodations for anyone's booking was denied or canceled because of discrimination. hosts must agree to a stronger more detailed nondiscrimination policy starting next month. pam, time is 7:25. women targeted at a popular news. >> yes, we do. we want to go straight out to alameda county fairgrounds. that's where a protest is underway for today's urban shield exercise. >> alex savidge you're out there. what's happening out there right now? >> reporter: well, hey, good morning to you guys. we're right at the front entrance to the alameda county fairgrounds and this all just happened in the last 15 minutes or so. we saw protesters pull up here, and they got out, and chained themselves together and they chained themselves to the front entrance to the fairgrounds where the urban shield police training event is set to get underway later today. law enforcement agencies from across the country come here to do various training and these are members of the stop urban shield coalition. i want to bring in one of the organizers, mohammed chek to talk about the plan here. you have protesters at this entrance, and other protesters at other entrances. >> it is part of our campaign to end urban shield have mobilized people from across the state. we have locked down the entrances to the alameda fairgrounds where the weapons expo is being held. what it is is that there's vendors from across the country and world that come to showcase their surveillance technology, their militarized weaponry in order to have police departments purchase them. and that is obviously what the stop urban shield coalition takes issue with is the overall, what you perceive as the militarization of police in this country. >> reporter: is it your sense that you're going to be able to stop the vendors from getting inside the event by doing what you have done this morning. >> we are doing all that we can to disrupt the event from happening. >> reporter: okay. so you have how many demonstrators, 15 here, and do you know how many folks will be taking part all told? >> in terms of people that are locking down, we have about 50 totally. we're expecting a thousand people to show up to rally and march. >> reporter: when do you expect the bulk of the people to get here? >> 8:00 a.m. >> reporter: the stop urban shield coalition, the breaking news at the fairgrounds in pleasanton. we had protesters show up a short time ago. they chained themselves to this entrance and all of the other entrances to the fairgrounds where, again, the urban shield law enforcement training exercise and the vendor fair is expected to get underway later on today. police at this point simply standing by pam and dave. we'll see how this unfolds and let you know. >> before you go, ask him, because obviously the other side of this is the officers saying that they need to train for unfortunately the world that we live in where there are some pretty scary attacks, and their side is they need to train for this. so what is their response to that? >> reporter: well, you know, we can talk to mohammed here, and you obviously know that law enforcement agencies said this is vital training for them to train for emergencies, terrorist attacks, that sort of thing. do you believe that the training component at the very least of this is important? >> not at all. so what urban shield does is brings together law enforcement agencies from across the country in order to train to share tactics, to share technologies, to share weaponries on how to better repress control and harm our communities. they say this is for disaster preparedness, emergency response, but if they actually cared about those kinds of things, they wouldn't be based on extremely militarized situations. it wouldn't be as if they were going into a war zone. it would be investing in community based response that doesn't rely on this kind of weaponry and tactics. >> reporter: and again, you have a number of protesters here at this particular entrance to the fairgrounds. they have all chained themselves together and chained themselves to the front gates. they have done the same thing at the other various entrances here, and again, we have police cars, i'll flip around here and show you, you have some police cars here parked across the street. officers standing by, but at this point, police are not taking any action. obviously they're going to probably develop a strategy as to how to proceed here. so we will stand by of course and let you know how this all unfolds. >> all right. it's going to be very interesting. thank you, alex, we'll biways, here's the man, sal castaneda. >> thank you. good morning, steve. we are looking at a commute that's going to be busy if you are driving on interstate 80 westbound coming in. 39 minute drive. it takes you from the carquinez bridge to the macarthur maze and a lot of traffic is in richmond. it's a little bit of an improvement, but definitely on a friday, i would not call this friday light. moving out to the bay bridge toll plaza, you will see the traffic is backed up approaching san francisco. we had a couple of earlier issues in getting on the bridge. so this has been cleared. this is a look at highway 4 westbound. you will see slow traffic here, and also on 680 from about 242 down to 24 and westbound 24 is slow through lafayette. so gone are the days where fridays we had completely light traffic. 7:35. let's go back to the desk. well, shoppers at an upscale shopping center in san jose are being warned about an armed robbery there wednesday night. it happened at 9:00 p.m. in a santana row parking lot near hatten street. two women were at their car when a white car came up. two men jumped out. one masked his face and carried a gun. he demanded the purse of one of the women. he grabbed it and briefly dragged the woman. the robber snatched the purse and took off in his car. a person who lives nearby heard her scream. >> i have lived in la for ten years, and san francisco for seven, and you normally don't hear that type of yelling around here. occasionally i see bikes out here. nothing leek this. >> the company -- like this. >> the company that manages rental homes sent notes to residents this week warning them about recent crime in the area. there is a vague description of the suspects. they're only saying they're described as two asian or latino men, and they were driving a small white four door sedan. a san jose man has filed a civil lawsuit against valley faire mall and two security guards after he says one guard pulled a gun on him. you're looking at cell phone video provided by the attorney for nicholas buchanan. it shows a mall guard pointing a gun until another guard arrives. the second guard threatens to break the window. now, the lawsuit claims the guard who drew the gun was not licensed to carry a firearm at the time. a mall official says they won't comment on pending litigation. an anti-violence group will host a candlelight vigil in san pablo. 18-year-old aleish amc coy was shot and killed monday night. she was seven months pregnant. her baby did not survive. police say ms. mccoy was shot during a fight involving friends and the father of her unborn child. 21-year-old lewis morales jr. was arrested and luciano o duerte turned himself into police. they will hold a vigil on 23rd 23rd street in san pablo. former 49er bruce miller is set to be arraigned in court this afternoon on 7 felonies. prosecutors now say miller used a cane in an attack on a 70- year-old man and his son at a san francisco hotel earlier this week. police say miller tried to enter the man's hotel room. the man's son told miller he had the wrong room. that's when police say miller attacked the older man. miller was later seen on surveillance video there at another hotel bleeding and disoriented. the 70-year-old man was sent to the hospital. the 49ers released miller hours after that incident. the san jose man who's accused in a string of random shootings targeting drivers on blossom hill road is due back in court today. 30-year-old michael james lee lewis was in court facing charges of attempted murder. police say a search of his home turned up a gun that matched shell casings from four of the ten shooting scenes. people who live in the area say they are relieved an arrest has been made. >> i'm here maybe seven, eight times a week and my daughter has a dance school right over there. we were very concerned and feeling more relieved now that hopefully they've got the right person. >> no one was hurt in the shootings. police have said nothing about a possible motive. lewis is the father of two, a former youth football coach, being held on $100,000 bail. we are following a developing story out of north dakota this morning. today, a federal judge is scheduled to deliver a key ruling on an oil pipeline that has drawn thousands of protesters to a construction site in north dakota in recent weeks. more than 200 tribes have joined the protest by the standing rock sioux in their fight against the dakota access project. they have been arriving on horse back, and canoes and the tribe has asked a judge to stop construction on the pipeline that would carry oil from north dakota to illinois. the tree says the project could damage tribal lands. the white house released a statement from president obama condemning north korea for its latest nuclear weapons test calling it a grave threat to international peace and stability. north korea says it successfully conducted its fifth nuclear test last night to determine the power of its nuclear warheads. the impact of that blast was so strong it registered as a 5.3 magnitude earthquake. this morning, secretary of state john kerry talked about the test while meeting with russia's foreign minister in geneva. >> i think it's fair to say that china, russia, the united states, everybody, we're trying still to monitor to find out precisely what took place, and at the appropriate moment today, i'm confident president obama will address this. >> now, south korea is calling that nuclear test an act of fanatic recklessness. the un security council plans to hold an emergency meeting about the test later today. right now at 7:40. a new clue to solve whoever vandalized an antioch family's home. it's a case that's been investigated as a hate crime. coming in 20 again. : welcome back to mornings on 2. a little more than an hour ago, the new york stock exchange opened with a moment of silence before the bell to remember the victims of the september 11th september 11th attacks. then they rang the bell and that is a nonprofit group campaigning to turn september 11 september 11th into a national day of service and remembrance. they led that moment of silence and traders on the floor paused to pay tribute to the 3000 people killed on 9/11. sunday marks the 15th 15th anniversary of the attacks. there are events planned throughout the nation to honor the victims. here's a live look at the big board. the dow jones as you can see, down 190 points. full percentage point there. same for the nasdaq and the s&p 500 actually down more than a percentage point. almost 26 points there. the faa has issued a warning about the new samsung galaxy note 7 phone after reports of the phone exploding. the faa now strongly advising passengers not to turn on these phones or charge them while on planes. aviation officials also say the phone should not be placed in checked bags. the phone is being recalled for having batteries that are at risk of catching fire and exploding. more than 35 incidents have been reported including a florida man who says his jeep caught fire. here's a picture of that. that's when he left his phone charging inside the car. san francisco based wells fargo has been hit with a $185 million fine. the consumer financial protection bureau says 5300 wells fargo workers opened 2 million fake accounts using names of the banks customers. more than 5000 employees have been fired for reportedly creating the accounts in order to meet sales quotas. >> when you're talking this number of people that were engaging in these practices that crossed the line, then what that means is that there was broad knowledge that this was happening and broad acceptance of these practices. >> yesterday wells fargo ceo sent a letter to all employees saying the bank has refunded $2.6 million in fees to customers and says the bank is implementing better training and more monitoring. time is 7:46. the 49ers plan to donate a million dollars to bay area charities. the ceo jed york issued a statement yesterday saying quote the 49ers foundation will contribute $1 million to the cause of improving racial and economic inequality, and fostering communication with bay area law enforcement agencies. all of this comes after quarterback colin kaepernick helped begin a nationwide conversation about racism and police brutality when he refused to stand during the national anthem. he pledged to donate $1 million to groups combating racial injustice. one of his former college teammates has joined in on the protest, inside line backer, brandon marshall did so before last night's game against the carolina panthers. marshall said he supports kaepernick and understood where he was coming from. well, the broncos beat the panthers, 21-20, kicking off the season. denver failed 17-7 going into the 4-quarter. gave the broncos the lead. carolina then got within one and had a chance to win, but that field goal went wide left with four seconds left and the game was over. well, our question of the day is about football, the nfl, as we have been saying back, and the excitement, expectations are high for both bay areas teams. but the home of the oakland raiders. northbound traffic is going to be slow as you drive past that area. the south bay commute again is not as bad as it was yesterday, but certainly there is slow traffic gatos up 3. here's the news for next week. monday, tuesday, there's going to be a low dropping in. it will have a very fall like feel. where does that low end up. i have seen projections take it not that far south but pretty close, up to the sierra. i have seen one that puts it right over about mendocino county. when they come in over land, they don't have to lot to work with moisture wise. we call them moisture starved. inside sliders from oregon and washington. it will be windy. it will be cooler, ramping up the fog bank and chew it up. if it drifts back towards us, there's michigan coming in again, back towards us, then we could incorporate some showers in the forecast. the sierra for sure. that will be on tuesday. so stay tuned. today tomorrow, though, does look a little warmer inland, even though we'll have to deal with the fog and low clouds. delta breeze has come down. they are running 2 to 4 degrees cooler than yesterday at this time. livermore, concord, fairfield, santa rosa, sfo minus 3. fog and low clouds will peel back. nothing yet. a series of systems. i like the pattern if it holds here. these lows keep dropping in. we will need one over water to make a the hospital today. >> what are you going to tell all your friends. >> dude, i got bit by a rattlesnake. >> that's what you want to tell everybody. >> yeah. >> that's brendan singh. he's in good spirits, at least when we visited him in the hospital. he was playing in a friend's backyard when a baby rattlesnake bit him on the ankle. his mother credits the quick actions of his friends and friends parents for brendan's recovery. >> i think that was key that the children that he was playing with were very aware, ran in, yelled for help, mom came out, called 911, everything was just done in perfect sequence. >> it was interesting, baby rattlesnakes can actually be more dangerous because they can't control their venom. brendon says he's only in a little pain. once he's released from the hospital, he'll be on crutches for a while, but he should make a full recovery. well, guess what, you can now rent a bit of san francisco history for about $14,000 a month. it's known as the full tech will make the burritos, load them onto a drone that will then fly to the kiosks and lower the food down to the students with a tether and a wench. it is all a drone test and is run by ford light you may have been looking for. it's not terrible, but it is slow here at the toll plaza. it's backed up for about a 15 to 20 minute delay. we are seeing some of the slow traffic also in the east bay this morning as you can see here on interstate 880 northbound. it is slow. that's northbound 880 on the right side of the screen. it is backed up from about san leandro to downtown oakland. the south bay, silicon valley commute has had a couple of problems, issues on 85. in general, i would say it is just a little bit better than it has been the last few days. but you will see slowdowns as you drive into the west valley. now at 8:03. let's go back to the desk. >> thank you, sal. the developing story that we are following that's happening right now. hundreds of s.w.a.t team members from across the country are gathering in pleasanton. so our protesters, though for the 10th annual urban shield training exercise. the protesters have now chained themselves together at the entrances to the alameda county fairgrounds. that's where ktvu's alex savidge is this morning to talk about why the protesters want to disrupt this event. alex. >> reporter: yeah, pam, good morning to you. protesters are voicing their opposition to this urban shield law enforcement training exercise because they believe that it furthers the militarization of police, and you can see you have a couple hundred protesters who are gathered here near the front gate of the alameda county fairgrounds in pleasanton this morning, all taking part in the demonstration. they just arrived in the last hour. and if we swing around this way, you can obviously see what you have at the front gate. you have 15 protesters who have chained themselves together and chained themselves to the front gates here in an effort to try to stop this event, which, again, they oppose. they say this is the militarization of police in this country, and they want this event shut down. now, law enforcement members come here from across the country to train, and they say this is important training for emergencies and natural disasters and they say this is critical training. i want to bring you one of the protesters, alicia taking part here today. first of all, why are you doing this, alicia. >> we're here to demand a stop to urban shield, to that conference, and what's at the core of that is a demand that police stop terrorizing and harassing our communities, that they stop militarizing community police forces, and that they stop enacting military tactics and call it public health and public safety. >> reporter: how long will you remain cheaped to the front gates. >> -- chained to the front gates. >> we're willing to be here as long as we need to be. >> reporter: i appreciate that. so this is the situation. again, you have protesters chained to the front gates here at the fairgrounds where the urban shield event is getting underway this morning. we talked with police who are standing by across the street. they are not planning on taking any action. they are here to facilitate the first amendment rights of protesters here for this demonstration going on here outside of the fairgrounds, back to you for now. >> and it's getting loud out there. >> exactly. >> reporter: it is. >> thank you very much. there could be more fall out from the growing sexual misconduct scandal plaguing several bay area law enforcement agencies. brian flores has more on what is expected later today. >> good morning, the alameda district attorney's office is scheduled to make that announcement later this afternoon. right behind me at the courthouse here in oakland. as we go to video, she's going to make that announcement at noontime, making the decision on whether to file charges in this case. if the da does find evidence leading to criminal charges, the names of the officers involved could be released. on wednesday, as you recall, oakland mayor, libby schaaf announced plans to fire four officers, suspend several hours and councilling and training. a woman at the center of it all, a 19-year-old who goes by the name of celeste guap said she had sex with officers at the time while she was underage. the officers helped her avoid arrest for prostitution. yesterday we are learning the livermore police department announced an officer reseened because of his involvement with the woman at the center of the scandal. in a statement police chief michael harris says this incident does not accurately reflect the professionalism of the men and women of the livermore police department who protect our community every day. livermore police say they became aware of the officers involvement in june. that officer was placed on administrative leave. he quit a week ago after the internal investigation. this scandal has rocked southeasterly bay -- several bay area police agencies. celeste guap continues to be at a rehabilitation facility in florida. we'll know more information at the press conference at noon later today. . >> brian, thank you. the city of oakland will hold a community meeting to get public input on a selecting a new police chief. that meeting will be held at mclyman's high school at noon in the school cafeteria. young people are particularly encouraged to come and share their concerns and talk about what they want to see in the next police chief. there will also be several other community meetings where people can give their opinions later this month. today voters in north carolina can start militarying mail in ballots -- submitting mail in ballots. that has hillary clinton and donald trump out on the campaign trail trying to win support. a new swing state poll shows florida, north carolina, ohio and pennsylvania all within the margin of error. >> for trump to win, he's going to have to win all the states mitt romney win and he's going to have to win pennsylvania, florida and ohio, so unless those states work out for him, he's not going to examining new video of a person who fired at the home of an african-american family. you can see them lighting and throwing three molotov cocktails at the home on mccormick court early wednesday morning. the family heard the commotion. they came out of the house, doused the fire. that's when they also discovered the house had been spray painted with swastikas and a racial slur. yesterday, the mayor of antioch gave the community message from the homeowner. >> one bad seed does not destroy her faith in antioch or the members of this community. she wanted to thank the community for reaching out to her, and she wanted to let everyone know that she's going to be okay. >> police are treating this as a hate crime. so far they do not have a suspect. the mayor, surrounded by the city council and other leaders said antioch residents should not have to live in fear. the house of represent actives is set to vote on a controversial bill that would allow the families of september 11th victims to sue saudi saudi arabia in u.s. courts. the senate passed the legislation in may. the house expected to approve it as well. president obama has said he would veto the bill. there has been suspicion that saudi arabia was involved in the attacks. critics of the bill say it would damage an important relationship with the country. this morning in northwest spain a train derailment killed at least four people and injured about 50 others. that train was traveling from spain to portugal when it jumped the tracks. the first car was demolished after hitting part of a bridge in a signaling tower. there were 63 passengers, two crew members on board. no word yet on the speed of the train. the damage to the cars indicate they were going at a high rate of speed. one of the worst train crashes in spanish history happened in the same region back in 2013 when 80 people were killed. a florida man has a frightening tale to tell. steve moon was in the water in fort myers on wednesday. he was trying to attract fish with bait he recently bought. he got stuck near a sand bar, and a group of sharks started to move in. ten sharks to be exact all looking hungry and aggressive he said. they came within a foot of him. >> i saw them out of the corner of my eye come toward my leg, and i was able to see the back of him, and i'm like, yeah, that's a 7-foot shark. >> moon says he spent the next 90 minutes fending off the sharks be a fishing rod and at last he was able to reach a fire rescue service with the emergency button on his iphone. the coast guard came by and rescued him about 10 minutes later. he loves to fish, and says he will be back next week. this time he's not going alone. >> but he'll go back. just like surfers. time is 8:14. let's check in with sal for friday morning traffic. it's not bad in some areas. but it's slow in others, and this morning's commute has been a touch lighter than usual as we look at the commute here on 880 north and southbound. it has been slow northbound. southbound is not too bad but you will slow in hayward as did usually the case. at the bay bridge, hasn't been light but we haven't had any major problems. we had a couple slowdowns on the metering lights and that's usually what makes things slower at the toll plaza. the toll plaza traffic gets stacked up. 880, we talked about it a little bit slow in fremont, getting into san jose looks good. the silicone valley communities are beginning to get better. no slow down downtown san jose. we have seen some improvement here, and if you have the time to wait, you might do yourself a favor by smart trains run quietly through two north bay cities, novato and san rafael have both sent applications to the federal railroad administration to establish quote quiet zones near some smart train crossings. novato has concluded a required 60 day public comment period, and has asked to write a required letter of support for the application. the plan is for train operators not to blow the horn at vehicle and pedestrian crossings. that is unless there's a hazard or the train is leaving the assassination. the rail transit is set to start service later this year: the city of san francisco plans to install some speed bumps in golden gate park after the death of a cyclist. 41-year-old heather miller was struck and killed by a car in june along jfk drive. in the wake of the tragedy, mayor ed lee asked the city to fast track safety improvements. all the way to the great highway. >> people are going about 7 and 9 miles per hour over the speed limit on jfk drive. we're putting forward proven methods and efforts to reduce the speeds. >> now, cyclists we spoke with say they are glad to see the city taking an aggressive stance on safety, a public hearing on the issue is set for next friday. a major sponsorship agreement is set to be announced today that will allow the bay area bike share program to complete the expansion of its fleet to 7000 bikes across the bay area. expansion of the 3-year-old program was approved last year. righten, there are 700 bikes in the program. with this -- right now, there are 700 bikes in the program. the program can expand to oakland, berkeley, and emeryville at no cost to taxpayers. a news conference is scheduled for 10:00 this morning. a popular bay area restaurant chain is now facing a lawsuit. the san francisco chronicle reports that burma superstar is being sued by former kitchen workers who say they are not become paid fair wages. they are concerned about overtime, sick leave, and their breaks. burma superstar has restaurants in san francisco, oakland and alameda. the restaurant a chain has not commented on the lawsuit. a million dollar donation the organization says will go to improving racial and economic inequality. police when you look at this. it doesn't look right to me. now it's moving just a little bit better. it's very slow, especially for a friday, northbound on 880. you would think we would get a little bit of a break, getting up to downtown oakland. by the way, if you're thinking of 585 oz an alternate -- 580 as an alternate, that's also slow. the bay bridge toll plaza, you can see the traffic is going to be backed up for about a 15 minute delay. today, 580 coming out of san leandro is not bad. once you get to oakland it slows down as you drive past the oakland zoo exit and continue to the lake shore area. 8:31. let's go back to the desk: thank you, sal. it's been six weeks since a popular college professor was killed in the south bay, but police now think they may have an important clue to help solve this case. ktvu's janine de la vega reports from san jose police headquarters with video of a person investigators are looking to talk to. >> reporter: it's been a challenging case for police and in this have you video, it does show a man's face. it is blurry, but detectives are hoping that somebody recognizes him. check out the surveillance video showing a man in dark clothing, casually strolling by on a street. police want to know who he is and talk to him about what happened in late july on willow and sherman street. police say 37-year-old david moglen was gunned down by a suspect who had robbed him on the street. moglen chased him and that's when the suspect fired. detectives had interviewed witnesses, but so far, that has not led them to a suspect. moglen taught economics at foothill college in los altos. he was a beloved professor, popular with students and faculty. he left behind a wife and two small children. police are hoping to give them some sort of closure. for now, they are hoping the public steps up to help them on this case. reporting from san jose, janine de la vega ktvu fox 2 news. the san jose city council is now considering a tougher gun law for the city. the proposed law would toughen requirements for buying guns, reporting when they're stolen, and would require gun stores to record all ammunition sales in an electronic log. critics say the proposal is impractical, hard to enforce, and won't stop violent crime. if approved by the city council, the law would put san jose among oakland, san francisco, as cities that have local gun control laws. a federal judge is scheduled to deliver a key ruling on an oil pipeline that has drawn thousands of protesters to a construction site in north dakota. 200 native american tribes have joined the protest in the fight against the dakota access pipeline project. they have been arriving on horse back as well as canoes. the tribe says it wants a judge to stop construction on the pipeline that would carry oil from north dakota to illinois. now, the tribe says the project could damage tribal lands and river water. supporters of the pipeline say it would reduce the amount of oil that travels by train. just a short while ago, the white house released a statement from president obama condemning north korea for its latest nuke weapons test calling it a grave threat to international peace and stability. north korea says it successfully conducted its fifth nuclear test last night to determine the power of its nuclear warheads. the impact of the blast was so strong it registered as a 5.3 magnitude earthquake. now, this morning, secretary of state john kerry commented on the tests while meeting with russia's foreign minister in geneva. >> i think it's fair to say that china, russia, the united states, everybody, we're trying still to monitor to find out precisely what took place, and at the appropriate moment today, i'm confident president obama will address this. >> south korea is calling the nuclear test an act of fanatic recklessness. the un security council plans to hold an emergency meeting about it later today: former 49er bruce miller is set to make his first court appearance today. he's facing seven felony charges. prosecutors say miller used a cane in an attack on a 70-year- old man and his son at a san francisco hotel earlier this week. police say miller tried to enter the man's hotel room. the man's son told miller he had the wrong room. that's when police say miller attacked the older man. miller was later seen on surveillance video at another hotel bleeding and disoriented. the 70-year-old man was sent to the hospital. the 49ers released miller hours after the incident. the 49ers have pledged to donate $1 million to bay area charities. ceo issued a statement saying quote 49ers association will deliver $1 million to the cause of improving racial and economic inequality, and fostering communication are bay area law enforcement agencies, after quarterback colin kaepernick helped start a conversation about racism, and police brutality when he did not stand during the national anthem. one of colin kaepernick's former college teammates has joined in the national anthem protest. denver broncos inside line backer brandon marshall did so before last night's game against carolina panthers. last month after kaepernick's protest made national headlines, marshall said he supports kaepernick and understands where he's coming from. the broncos head coach says he's supportive of the decision not to stand. the broncos beat the panthers 21-20. denver had trailed 17-7 going into the 4th quarter, but vallejo native, c.j. anderson scored two touchdowns to give the lead. and 4 seconds remaining, field goal attempt went wide left, ending some, especially on the coast where it's going to be a cool day. inland temps will bump up a few. . welcome back to mornings on 2. it's 8:41. police are investigating an armed robbery at a popular shopping center in san jose. it happened wednesday night at 9:00 at santana row in a parking lot right near olen avenue and hatten street. two women were at their car when a white sedan came up. two men jumped out. one masked his face and carried a gun. he demanded the purse of one of the women. he grabbed it, briefly dragged her. the robber eventually snatched the purse away, and took off in the car. a person who lives nearby heard her scream. >> i thought somebody was getting stabbed. i mean, that was the first thing that popped in my mind. that was literally being attacked. >> now, the company that manages rental homes at santana row sent out notes to people living there this week warning them about recently crime in the -- recent crime in the area. there is just a vague description of the suspects. they are described as two asian or latino men driving a small white four door sedan. a san jose man has filed a civil lawsuit against valley fair mall and two security guards after he says one of the guards pulled a gun on him for hitting a traffic cone last december. you are looking at cell phone video. this was provided by the attorney for nicholas buchanan. it shows a mall guard pointing his gun at a car until another guard arrived. the second guard threatens to break the window unless buchanan unlocks his door. the lawsuit claims the guard who drew the gun is not licensed to carry a firearm at the time. a mall officials says they won't comment on pending litigation. the san jose man targeting drivers on blossom hill road is due back in court. 30-year-old michael james lee louis is in court the first time to face charges of attempted murder. police say a search of lewis' home turned up a gun that matched shell casings of four of the ten shooting scenes. people who live in the area say they are relieved that an airs has been made. >> i am -- arrest has been made. >> i am here 7, 8 times a week, and my daughter has her daughter in dance school right over there, and we were very concerned and feeling a lot more relieved that hopefully they have the right person. >> no one was hurt in the shootings and police have said nothing about a possible motive. lewis is a father of two and former youth football coach being held on $100,000 bail. this is an incredible story. more than 100 people in the french alps are safe this morning but that is after being rescued from cable cars that stopped working 12,000 feet in the air. the broken cable cars left them dangling overnight at a high altitude over the mountain range. some people were rescued yesterday, but the rescue efforts had to be suspended overnight because of rough flight conditions. the remaining 45 people were brought down to safety early this morning. 15 days after that devastating earthquake in italy. firefighters made a big discovery. they pulled a small cat out of the rubble alive. the cat has a fractured jaw but appears to be fine. he tried to scratch the hand of the firefighter who was trying to pull him out. the 6.1 magnitude quake claimed the lives of 300 people, and left hundreds of others without a home. the rescue agency has helped rescue more than 900 animals. check out our freeway still a little bit slow as you drive from the san pablo area really into el cerrito. we're going to show it to you. 35 minutes, though. the last few days it's been more like an hour. we are getting a break. this looks more like what we had in summer 35 minutes when we had those busy days, but it's just a little bit better than normal. when you get to the bay bridge, you will still see waiting to getting into san francisco. those friday lights are gone. it is lighter than usual today as you drive through the area. there have been no major problems. things are still kind of slow in the middle of the bay. 880 southbound slows from about highway 92, all the way down to stevenson, and still some slow traffic in the silicone valley. but just as we suspected, waiting has helped. the traffic on 85 has become better and so has the traffic on 101 and 280 getting into the west valley. 8:45. let's go to steve. >> was there not a lot more red there not too long ago. >> you're while because there's a lot of low clouds and fog. as you know, we had a really warm day on wednesday. coast cleared out. sunshine 80-degree temps. san francisco with 82. yesterday dropped right back to 66 and today looks to be about the same. inland temps come up a little bit. might be jumping the gun a tiny bit. los gatos up 3. concord up 5. santa rosa in the north wind kicks in you'll get low 80s. still a lot of fog out there. big news is early next week. a low dropping in around tuesday. where it ends up, probably it will favor areas to the east or the north. i doubt it goes this far south but there are a couple projections that take it a little bit back toward the west. end result for us is going to be a windy and cooler pattern, most likely. it will chew up the fog. that's for sure. there will be thunder shower activity up in the sierra. we'll keep an eye on that. won't be until tuesday. you'll notice a huge change as temperatures take a tremendous plunge as we get to early next week. today, though, 60s, 70s, 80s, the delta breeze is down. 50s, 60s on the temps, starting to warm up a little bit. that low cloud deck is in place. it's going to be slow to retreat, but 60s, 70s around the bay. 80s, these are about where they should be this time of year. a couple of 90s: certainly up in ukiah, clear lake, low 90s. 80s in between, and 70s around the bay or upper 60s. a little bit warmer, santa clara which cooled off to 84. san jose slightly below average. should be closer to 82, 83. 67 in the city. 76 san mateo. 81 woodside. menlo park, a soft 80. warmer inland on saturday. clouds start to roll in, thicken up, cool down on sunday, and a huge change monday and tuesday, even though it's still technically summer. it will not feel like it next tuesday. >> you said maybe even some rain. >> in the sierra, yes, it would be iffy here. if it difficult -- drifts far enough west, mendocino, napa, somewhere in there. 8:47. nasa has launched an $800 million mission to select a sample from an asteroid orbiting in our solar system. it should reach the asteroid in about two years traveling about 4 billion miles. it will orbit and map the asteroid before collecting a 2- ounce sample. they hope the material will answer questions about the make up of the early solar system. that sample is set to arrive back on earth not until 2023. more trouble for samsung and its galaxy note smart phones. how one man said his device destroyed his vehicle and the fa parks warning for samsung users on planes. hours ago. the new york stock exchange opened this morning, though, with a moment of silence before the bell, a tribute to the victims of the september 11th september 11th terror attacks. that's a nonprofit organization ringing the bell campaigning to turn 9/11 into a day of service and remembrance. they held that moment of silence, then applauded for the opening of the exchange. sunday marks the 15th 15th anniversary of the attacks. ceremonies are planned throughout the country. i want to just let you know about the numbers, though, as we're looking at traders on the field. down day today. all three indexes down more than 1%. 200 points for the dow. 70 points for the nasdaq. a lot of concern over that missile test we have been talking about from north korea and fears about an interest rate hike and what that would do for the economy, so stocks are down today. the faa has issued a warning about the new samsung galaxy note 7 phone after reports of the phone exploding. the faa is now strongly advising passengers not to even turn on the phone. certainly not charge them while on the plane. aviation officials also say the phone should not be placed in checked bags. samsung says the batteries are at risk of catching fire and exploding. a florida man says his samsung exploded while plugged into his car charger. he went inside his house, left his car running while his phone was charging. when he came back outside the jeep was engulfed in flames. he said he only had the phone for four days before it blow up. >> that's the thought in my head, something as simple as a phone is going to burn down my car or my house or hurt a family member. >> samsung is now recalling the phone saying that the note 7 will be replaced. san francisco based wells fargo has been hit with a huge fine after being accused of opening accounts without customers permission. wells fargo has been told to pay a total of $185 million to three agencies, the consumer financial protection bureau said 5300 wells fargo workers opened 2 million fake accounts using names of the banks customers. wells fargo says more than 5000 employees have been fired for allegedly creating these accounts in order to meet sales quotas. >> when you're talking this number of people that were engaging in these practices, that crossed the line, then what that means is that there was broad knowledge that this was happening and broad acceptance of these practices. >> yesterday, wells fargo ceo sent a letter to all employees saying the bank has refunded $2.6 million in fees to customers and says the bank is implementing better training and more monitoring: nissan is recalling some of its most popular vehicles because of a fire threat. nissan is recalling 120,000 cars and suvs in the u.s. because brake fluid can leak and possibly spark a fire. the recall covers 2015 to 2007 murano suvs, 2015 to 2016 maxima large cars equipped with intelligent crews control and some murano hybrids are affected. several vehicle fires have been reported. nissan will notify car owners within two months. ford is expanding a huge rule over faulty door latches. the concern is that the doors can actually pop open while the cars are moving. ford says it does know of one accident and three injuries linked to that problem. now, the latest recall there includes a 2012 to 2015 ford focus, the 2013 to 2015c-max and escaped and the 2015 mustang, and the lincoln mkc, and the 2014 to 2015 ford connect transit advance. if you have any of these cars take them to a ford dealership to be fixed. air bnb is trying to cut down on discrimination for short-term rentals. they asked an aclu director to review its platform. under the new policy called open doors. air bnb will help find accommodations for anyone who thinks a booking was denied or canceled because of discrimination. hosts must agree to a stronger, more detailed nondiscrimination policy starting next month. he was bitten by a rattlesnake but he's in very million, but a variety of problems like corroded rods and other unexpected repairs have used up a lot of that money. the chronicle says the fund has about $68 million left, and that may lead to toll payers paying for any extra repair work. however, the metropolitan transportation commission says there are no plans to raise the bay bridge tolls at this time. an 8-year-old boy from concord who was mom came out. called 911, everything was just done in perfect sequence. >> baby rattlesnakes can be more dangerous because they can't control their venom. once he's released, he will be on crutches.
