>> there is some heavy traffic out there, steve, to be sure. good morning, everyone. we are going to it as we take a look at the commute. it is backed up at the bay bridge toll plaza for a 20 to 25-minute delay. and if you are driving to the san mateo bridge, there is a problem there, too. tell you about that in just a moment. let's take a look at the commute here if you are driving on 880. not bad heading north. a little bit of slow traffic in san leandro. if you are trying to get to the san mateo bridge westbound 92, i am going to put the maps up here, there is a crash there and traffic is back up on 880 heading south and westbound on 92. dumbarton bridge not that bad. actually, pretty decent alternative to the san mateo bridge. 7:02. back to the desk. >> thank you, sal. >> new this morning, a violent car crash in antioch is under investigation. it happened after a city council meeting wrapped up last night. >> ktvu fox 2's allie rasmus is there right now. you say the mayor tried to help victims? >> yeah, we will explain in just a second. i want to tell you where it happened. 8th street just north of the highway 4 off-ramp. you can see right now there is quite a bit of traffic on this road. a lot of people use the street to get on highway 4. also a lot of construction work in this area. there has been for years with the highway 4 improvement going on. according to a chp log, a black honda struck a construction zone vehicle under the highway 4 overpass last night. firefighter had to extricate the driver out of the mangled vehicle shortly after the crash. firefighters say two people were also in the construction vehicle, but this morning we talked to one of their co- workers who says he found out this morning that both of his colleagues have been in that construction vehicle, they are okay this morning. he says frightening episode what happened last night, that it's just part of the job. >> i have got cars going by at 70 miles per hour from me to you. and so -- and i'm setting cones out. so you've got distracted dryers, people texting, people on their cellphones. they blow through our closures. it's scary. >> reporter: now, we should mention we don't know why that black honda crashed into that construction vehicle. the cars -- the crash is still under investigation. antioch's mayor wade harper saw the aftermath of the wreck on his way back from the city council meeting. he stopped and pulled over to help after he saw one of the city council members, lori ogorchock, had been involved in the crash. she was not seriously injured. we don't have any updates on the condition of the driver who was extricated from the honda last night. we are hoping to hear from police or fire sometime later this morning. back to you guys. >> allie rasmus, in antioch. thank you. >> time is 7:05. more police patrols around a palo alto elementary school after reports of a man exposing himself to a young girl. look at this police sketch of the suspect. on monday, a 7-year-old girlof elementary school saw the man on the other side of the fence who unbuttoned his pants and exposed himself. look that sketch. if you have any information call palo alto police. >> legislation that would get rid of the statute of limitation for sex crimes is moving through the state senate. before a senate committee gave initial approving of the bill, supporters told committee members said justice for rape victims should not have a 10- year deadline. among those testifies alleged victims of bill cosby. one reason l.a. prosecutors decided not to prosecute him was because the 10-year window had closed on most of the cases. >> i know firsthand the amount of courage and bravery it takes for victims to step forward and speak their truth. even amidst hateful scorn. >> there is an expectation to the ten-year rule. if new dna evidence is discovered, even so supporters say too many rapists are going free because of that statute of limitations. it would apply to crimes committed after january 1st of this year. palo alto approved a pay raise for the firefighters, but firefighters say it is still not enough for them it actually live in the city they protect. new contract gives firefighters a 2.5% raise each year until 2018. that means the average firefighter pay goes from $88,000 a year to $94,000 a year. the average home price in palo alto is $2.5 million. one man says he has a very long commute, 100 miles away. not a single palo alto firefighter lives in the city. many living in the sierra foothills or central valley. >> not even close. not even close to even coming any near palo alto. >> i think a lot of us wish we could live in the city or relatively close. i don't know what the answer is. it's not a realty any more in palo alto. >> the firefighters union says the high cost of living has been driving away good firefighters. the city hopes the new contract will help retain workers and possibly recruit new ones. >> despite efforts to conserve and save water, the city of brentwood is about to raise water rates. the city will raise water rates by 6% over the next two years. the average customer, you will pay about $6 more on your monthly water bill. the city says that increase is needed to help replenish the water fund. now, if nothing is done, the city says the water fund would have been $8.8 million in the red by june of 2018. well, tonight is the night the warriors are going to go for a record 73 regular season wins. they will do it at home in oakland. >> ktvu's alex savidge live at oracle right now. fans are excited. i am assuming players are as well, alex? >> reporter: yeah, they certainly are excited about this. the final regular season game of the warriors have a chance to make history tonight here on this floor. boy, it's going to be a fun one at oracle tonight. if the warriors win, oh, there you go. if the warriors win it would give them 37 victories -- thank you, dave. 73 victories on the season and that would set the record in the nba. it would be something incredible. but they have to beat the memphis grizzlies tonight at oracle. the scene yesterday, the warriors held a plaque practice -- practice. there were members from all over the world on hand for that practice. and the warriors, all eyes are on the warriors right now. they were focused on what's going on. they are tied right now with the chicago bulls. the '95-96 chicago bulls with 72 wins. but they are going for 73 tonight. it would really, be something special. the players don't want focus on that too much. steph curry says if they could set this record, it would mean a lot. >> it's a big deal for sure. our last regular season game. last game before the playoffs. obviously, nobody wants to lose their last game going into the playoffs if you can avoid it, and obviously 73. >> reporter: now, fans who want to be here inside oracle arena tonight, well, they are going to have to pay up. there are tickets available we understand at warriors.com, and also on the resale market as well. some of the cheapest seats you find are just over $300 each. those are upper level seats. the more expensive seats by the court run you ten grand. that's what we're showing online this morning. people still buying tickets for this game. you can imagine they will be doing so right up until tip- off, which happens tonight at 7:30. all the warriors have to do is beat the grizzlies. the grizzlies, they are going to come to play. no doubt about it. it will be a fun game. last one of the regular season. >> they are a tough team. alex, i dare you to dunk live on tv right now. ran out of gas and electricity march 31. she got disoriented while trying to find a cell phone signal. she and her dog survived on pond water and plants for nine days. rescuers spotted her dog and then that help sign. she was taken to the hospital to be treated. she is expected to be okay. the antioch school district is warning parents after a student says she was robbed at gunpoint as she walked to school yesterday. the principal of deer valley sent out a phone message. she was right across the street from school when a man with a gun approached her and robbed her. that robber is described as an african-american man, five feet nine. he was in his early 20s and wearing all black clothing at the time. antioch police are investigating and the school is reminding students and everyone to walk in groups whenever possible. happening today san francisco police will hold a town hall meeting at about noon on last week's deadly police shooting of a homeless man. police say the man had a knife and confronted a homeless outreach team. when police responded at first, they fired beanbag rounds, but they say when he charged at them, they shot and killed the man. there are conflicting witness accounts as to whether the man was aggressive to police or not. the public meeting will be held at the union local hall on 18th street. >> a judge rejected a defense motion to throw out a murder charge. kate steinle was sightseeing last summer near the ferry building when she was shot in the back and later died. lawyers for the suspect, juan lopez-sanchez, wanted to get the charges dropped. the judge was troubled by the delay, but refused to throw out the case. lopez-sanchez due in court may 12. >> time is 7:16. sal, can you take care of the folks this morning? >> i can, dave and gasia. it is getting busier, but there is a problem i want to start with, is kind of not expected, and that would be in northern marin county southbound 101 near highway 37. there is an injury crash here and traffic is slowing down in novato. there is a break, but there is more slow traffic near marinwood over to central san rafael. the lane is blocked there. across the bay, traffic on 80 westbound is slow in pockets from hercules all the way down into the berkeley area. when you get to the bay bridge there is also some slow traffic waiting for you there. we will go to the live picture of the bay bridge toll plaza and you can see the traffic is backed up to the maze. aboua 20, maybe 25-minute delay. not too bad in the santa clara valley. this is a live look at 280 northbound certainly sounds like a final decision. good morning. yeah, for folks that were hoping that paul ryan would emerge as some kind of a pick out of this -- out of a contested convention, if we have a contested convention, it's not going to happen. you listen to what paul ryan said yesterday, he did not leave himself much wiggle room. paul ryan couldn't have been more emphatic. >> let me be clear. i do not want nor will i accept the nomination for our party. >> reporter: ryan dismissing talk that has been percolating for weeks that if donald trump fails to win the 1237 delegates needed to win the republican primary ahead of the convention, ryan could emerge as a consensus pick. he went a step further. >> . >> if no candidate has a majority on the first ballot. i believe you should only choose from a person who is actually participated in the primary. >> reporter: and that in theory would limit the potential field to what we saw on the crowded early debate stages. and he has some weight to throw around on that point because he will chair the convention. still, all of that thought may need into donald trump's argument that the party rules are rigged. >> the rnc, the republican national committee, they should be ashamed of themselves for allowing this kind of crap to happen. >> reporter: and an ap poll shows almost 60% of gop voters think whoever walks into the convention with the most delegates should be the nominee whether they have an outright majority or not. as ted cruz is happy to point out, those are not the rules. trump, he suggests, is just whining. >> as we know in the state of california, wine is something best served with cheese. >> reporter: now, all of this talk about a brokered republican convention, or a contested convention, carries with it the assumption that come candidate doesn't reach the threshold of 1237 delegates locking down the nomination before the convention. donald trump is the most likely candidate to do that right now. it's going to be a stretch. it's possible though. a lot may hinge on what happens in the new york primary next week. back to you guys. >> thank you. >> a new report out this morning says the fbi paid professional hackers for hardware to help crack an iphone used by one of the santa barbara shooters. the "washington post" reports hackers told the fbi about a software flaw in the iphone 5c that had not been known about before. the paper says the hackers used that information to create a tool that let the fbi break into the phone without triggering a security feature. the fbi director says the tool works only on the iphone 5c. officials have not said if there was any useful information on that phone. >> nearly 400,000 student loan borrowers will be eligible to have their loans forgiven. they will get a letner the mail with a form to fill out for the loan forgiveness. half of the borrowers are already in default. the department of education says it could write up more than $7.5 billion in student debt. all right. time is 7:25. do you eat low-fat dairy products? there is a new study shows you may not have to. a study by tufts university says adults who eat dairy products high in fat, they actually report fewer cases of diabetes. now, earlier studies from tufts scientists show people who switch from whole fat to low- fat foods tend to compensate by eating foods with more sugar and carbohydrates. the doctors say higher fat cheeses, yogurts and milk can be part of a healthy diet, but they say make sure the fats you eat come from healthy sources like olive oil and today. >> we received word of a big earthquake in in myanmar. >> the usgs reports it was a 6.9 magnitude earthquake that happened about half an hour ago. it's a primitive map. it gives you a good idea of the location we are talking about. myanmar is southwest of thailand. it was felt some 300 miles away in bangladesh. we don't have any reports of damage or injuries. as we continue to follow this story, when you have a magnitude of this size in such an area, your mind might go to the risk of tsunami. let's bring in meteorologist steve paulson. >> that was inland. not in the sea, i believe, bay of bengal. when they had their tsunami, it was in the gulf of thailand. this is on the other side. it was not in the ocean in the bay, but over land, based on what i am seeing there. >> but it's early. >> yeah. twitter says there is nothing yet on tsunamis. they are saying 6.9, 7.1. somewhere in there. we have a little break or two in some of these clouds finally. how about that? a couple of there was a crash partially blocking lanes and it's backing traffic up as you drive through novato. but there is also slow traffic after the accident as you head into marin wood. we have slow traffic across the bay on 80 westbound after highway 4. it slows, it's very slow all the way into the berkeley area. a lot of that commute is not good. by the way, the richmond bridge commute is thick as you drive over to the toll plaza there. let's go to the bay bridge toll plaza where you will see the traffic is backed up to its usual spot. the macarthur maze. 25-minute to 30-minute delay there. also the san mateo bridge, we had an earlier crash on 92. it's been cleared. traffic is on the heavy side on the way over to the peninsula. 7:32. back to the desk. >> sal, thank you. >> now the search for a missing man from stockton is leading authorities here to the bay area. a silver alert for 68-year-old tommy lee carpenter was issued yesterday. advisories are posted on bay area freeway signs now. mr. carpenter drove from his home yesterday in a red nissan versa. they say his credit card was used at a gas station in sow last night. authorities now will check the surveillance video hoping to find him. they are concerned because mr. carpenter is suffering from the early stages. dementia. >> the san mateo county sheriff's department, they want your help. they want to find an elderly at- risk man. here is his photo. 73-year-old peter boot of poretolo valley was seen monday 6:15 in the morning. the sheriff's office says he left his home without his wallet, cell phone, and important medication information that keeps him from being disoriented. he is described as 6'3", about 185 pounds with grey hair and blue eyes. look at the photo. if you have any information, call the sheriff's department. turning to a developing story now. the missing two-year-old san francisco girl, she is still missing days now after her mother's body was found in a park. candlelight vigil is to be held tonight for 32-year-old nicole fitts at the best buy store on harrison street. that's where she worked. she was found murdered last friday. ktvu talked with a woman who calls herself a street pastor who met nicole fitts and her daughter at a homeless shelter. >> i been having people praying all day, all night that that bay bridge would show up, baby ariana would show up. >> my gut tells me that they did something to that girl's bay bridge. and when nicole found out, she went ballistic, as any mother would do. >> fitts, friends, and co- workers are suspicious of pastor briggs who baby sat ariana. they insist they would never do anything to harm the girl. >> the search goes on in the north bay for the owner of a dog believed to be have been thrown out of a moving car. this is a photo of the dog who suffered several broken bones, including a broken leg. veterinarians, they are taking care of her right now, but officials want the public to know. this is the dog. if you have any information about her owner, or what happened to her, call the authorities. happening now some 39,000 verizon workers are on strike. we will show you video of striking verizon workers taken earlier this morning. this is mostly east coast technicians and customer service workers. they have been working without a contract since august. they want a contract that includes less out sourcing, better healthcare, better working conditions and more money. >> enough is enough. this company is very profitable and refusing to work with and bargain with their dedicated employees. it's intolerable. corporate greed has gotten out of control with this one. >> all right. time is 7:36. big changes planned in the next few years for menlo park-based facebook. the company's ceo says the next decade will be about creating a global community. >> brian flores with what is planned for day two of the facebook developers conference. hi, brian. >> reporter: good morning to you guys. you know, social media, and that includes febook, just continues to evolve. i remember when facebook was strictly just for college students and now it's gone worldwide. but coming up on day two now of the facebook developers conference conference, they talked about what's next for the company in the next ten years and for the developers, what's in it for them. we go to video during day one of the developers facebook conference, mark zuckerberg says he wants to see facebook in some more of a global community giving people a voice. he told the crowd during his keynote address he hopes that we have the courage to bring people together and not push people apart. from a technological standpoint, they are moving to more streaming video coming in the near future. users can use short video now for their profiles instead of a picture. zuckerberg expects to use what are called chatbot, which is an intelligent software program that allows businesses to interact with customers like having a messaged conversation with your friends on facebook. >> artificial intelligence will power all kinds of different services with better than human level perception and we'll see the emergence of the next major computing platform in virtual and augmented reality. >> reporter: now, again shot bot is planned to be launched in facebook's messenger service. about 30 companies so far have signed up, including bank of america and burger king. facebook officials say it's a balancing act because they don't want people to be turned off by the amount of ads on the social media site. but as we take it back out here live, set-up continues for day two of the developers conference here at fort mason in san francisco. on today's schedule they are going to be talking about the technology behind -- i don't know if you have seen this before -- that 360 video streaming service. i think we did a story about stanford athletes using this type of technology. it's amazing to see it on the social media site. also appeared to criticize presidential candidate donald trump during that speech yesterday. zuckerberg said, quote, i hear fearful voices calling for building walls. instead of building walls, we can help people build bridges. donald trump, the republican presidential frontrunner, has made building a wall along the border with mexico a big part of his campaign. zuckerberg performance president obama's executive actions on immigration, but later said his statements were not directed at any particular person. >> 7:39. san bruno will hold a news conference about a deadly hit- and-run that occurred monday morning. investigators expected to give us new information about the case. now, police so far have said that a 27-year-old man was walking across lanes of traffic when a car hit and killed him. he suffered from severe autism and had been missing from a group home. the contra costa sheriff's office is looking for a man. brian hill is described as being 43 years old, 280 pounds. he has close cropped hair and a goatee and tattoos of musical symbols on his neck. investigators say he forced his way into a silver prius in the tara hills area on friday. they say he veered close to three police officers and a police dog. this morning he is wanted for three counts of attempted murder on a peace officer and stealing a car. anyone with information is asked to call police. community leaders are planning a vigil outside the mission police station in san francisco tonight in protest over the deadly police shooting of a young immigrant from guatemala. the group says it wants the d.a. to release his investigation into the shooting that happened in february of last year. 20-year-old perez lopez was shot and killed by plain- clothed officers last february. initially police said he lunged at officers with a knife, but autopsy results show he was shot in the back. >> san jose state has hired a chief diversity officer. kathleen wong waugh will lead the office beginning into july. she grew up in the east bay, received her bachelor's degree at cal state east bay, most recently worked at the university of oklahoma where she led that school's first required freshman diversity training. it comes after three former san jose statements who were white were sentenced for misdemeanor battery on their african- american roommate in 2013. they were accused of taunting him with racial slurs and putting a bike lock around his neck. they were sentenced to 30 days in jail to be served on the weekends, plus probation and community service. a blue-ribbon panel investigating problems at the santa clara county jail is recommending the sheriff be removed from the jail system. they made 30 recommendation to the county. four are creating an inspector general's office that has access 24 hours a day to the jail and have the power to investigate the complaints. overhaul the grievance system, more transparency in the process used to discipline officers, and reform administration of the inmates' welfare fund. the commission says having someone new to supervise would be the biggest change. >> continued supervision of the jails by the sheriff is not in the best interest of the inmates. the correctional officers or the community either. >> sheriff lori smith says she has been behind some of the recent changes at the jail, and she would like to remain a supervisor of the jail system while more reforms take place. >> san francisco's port commission now has the results of an extensive study confirming serious seismic problems along the waterfront. the report says a big earthquake, a magnitude 7 or above on the san andreas fault, will probably cause the seawall to move. that seawall runs between fisherman's wharf and at&t park. it's part of the foundation for many of the buildings along the embarcadero, including the historic ferry building. >> it shows the seawall would move bay ward, and that would cause a lot of damage to historic resources, to the embarcadero, and we need to fix that. >> now, it's going to cost about $3 billion to fix that seawall and rebuild it. san francisco port officials will be looking for funding. time that's right. the textalyzer works like a breathalyzer in that it can be used on the spot to tell you what a driver has been doing. the breathalyzer tells if the driver has been drinking too much. this textalyzer tells you if the driver had been just texting behind the wheel. that is sometimes difficult to figure out. a 19-year-old man was killed five years ago. they say the driver who caused that crash was texting and driving, but it took months to figure that out. >> we subpoenaed the phone records on our own, through our own civil lawsuit. took us six months to get the records. we found texting through the drive leading up to the crash. >> reporter: now, since his death they have been working with new york state lawmakers on a new bill that would allow officers to use this textalyzer. if you have ever heard of it before, it's still being developed by an israeli company. it scans your phone to determine if you were texting at the time of an accident or before. as you might imagine, there are concerns about privacy. supporters say it only detects texts being made. it does not read them and cannot get any other information from your phone. >> i think that there is of that needs to be done and that can be done both to address the problem and to respect the privacy rights of drivers. >> reporter: now, this proposed legislation says that if a driver refuses to allow police to scan their phone. they could lose their license. brooklyn state assemblyman felix ortiz is co-sponsoring this bill. i imagine there is going to be some fighting going on because people interchange, 680 backed up from 242 to alamo and 24 is slow through lafayette still. 8:03. back to the desk. new this morning, antioch police are investigating a violent crash. one that happened on a street near highway 4 last night. >> it was really bad. one car was badly mangled. ktvu fox 2's alley allie rasmus, you're in the area now. >> reporter: according to police, the driver is a 35-year- old manhe had to be extricated from that honda suv he was driving when he hit a construction cone truck. it happened in the area where we are. this is a street right behind us. there is highway 4 off-ramp and this happened around 10:20 last night. this is what was left of that mangled honda suv after the wreck. police say the driver of that suv was speeding and they are looking into whether drugs or alcohol were involved. the suv hit a construction cone truck. two people inside that truck also went to the hospital, but this morning one of their co- workers told us he found out they are both doing okay. >> i actually spend a lot of time riding in the back of that cone truck, and i saw just watching the news, getting ready to get in the cone truck this morning, and i saw it on the news and i freaked. you know, i am thinking about my buddies. and, yeah, it's scary. >> reporter: the driver of the suv, however, is still in the hospital this morning. antioch's mayor wade harper was driving home from a city council meeting last night when he saw the aftermath of this crash. he is a former police officer and he stepped in to help and comfort the injured driver. >> i was able to tell the guy, do you hear the police and fire? they are on the way. the guys are coming for you. hang in there, you know. we got you. you know, just trying to encourage him to, you know, be alert and to make sure he's breathing and alive. >> reporter: now, the mayor says he saw one of his council members at the crash scene. he pulled over to help her. her vehicle was also apparently struck by the speeding suv, although it's not clear how. she wasn't seriously injured. the mayor says when he stopped and went to talk to her, she was already on the phone calling police about this crash. back you alto police. >> legislation that would get rid of the institute of limitations for sex crimes is moving through the state senate. before they gave approval to the build, supporters told committee members the justice for rape victims should not have a ten year deadline. they were alleged victims of bill cosby. one reason prosecutors decided not to prosecute crosby is because the ten year window city approved a pay raise for them, but say it's still not enough money for them to live in the city they protect. a new contract gives firefighters a 2.5% pay raise every year until 2018. that means fell flat. for the 8 time in six years, t in the legislature. if it passed, it would have imposed a 2-cent per ounce fee on sugary drinks. the money would be used to pay for obesity, diabetes and oral health programs. critics say soda tax, a warning label won't change behavior. >> you may not need low-fat dairy products. a study by tufts university says adults who eat dairy products with high amounts of fats had fewer case of diabetes. earlier studies show people who switch from whole fat to low- fat foods, well, they tend to compensate by eating foods with more carbohydrates or sugars. 68-year-old tommy lee carpenter was issued yesterday. there are advisories posted on bay area freeway signs. yesterday mr. carpenter drove from his home in a red nissan versa to find a dentist. he has not been seen since. the san joaquin county sheriff's department told ktvu his credit card was used at a rotten robbie gas station in san jose last night. authorities are going to check surveillance video hoping to track him down. they are worried because he has early stage dementia. >> the san mateo county sheriff's department is also asking for help in finding an elderly at-risk man. here he is. 73-year-old peter boot of portola valley. last seen monday about 6:15 in the morning. he was leaving his home in his silver 2006 toyota tacoma. he left home without his wallet, cell phone, and zuckerberg definitely talked about that. he talked about the changes for the company and there is a lot of changes as well for the developers attending this conference here in san francisco. as we go to video now, during day one of the facebook developers conference in san francisco mark zuckerberg says he wants to see the facebook turn into a global community giving people a voice. he told the crowd during the keynote address that he hopes we have the courage to bring people together. technology wise, facebook has poised itselfnov into more streaming video. in the near future users can use short video for their profiles instead of a picture. zuckerberg expects to use shot -- chatbot, which is an intelligent software program. it's like a conversation. >> artificial intelligence will power all kinds of different services with better than human level perception, and we'll see the emergence of the next major computing platform in virtual and augmented reality. >> reporter: facebook's messenger service in the near future, about 30 companies have signed up so far. company officials talking about facebook say it's kind of a balancing act because they don't want people to be turned off by the amount of ads on the social media site. as we take it back out live at fort mason in san francisco, many of the developers making their way here. many of the workers working the event are here as well. one of the main highlights of today's activities are talking about 360-degree video streaming or video service. we did a report about oculus technology that stanford university voices calling for building walls, instead of building walls we can help people build bridges. donald trump, of course, the republican presidential frontrunner has building a wall along the u.s. - mexico border a key part of his presidential campaign. zuckerberg supports president obama's actions on immigration. he said his statements were not directed at a particular person. >> san bruno police will hold a news conference about monday's deadly hit-and-run case. we expect to hear new information about the case. so far police say a 27-year-old man was walking across lanes of traffic when a car hit and killed him. he suffered from severe autism and had been missing from a group home. also the contra costa county sheriff's office searching for a suspect in what was thought to be a carjacking, but that is now changed. brian hill described as a 43- year-old man about 6'3", 280 pounds, he has close cropped hair and a goatee and has tattoos of musical symbols on his neck. investigators now say hill forced his way into the silver prius of someone he knew in the tara hills area of west county on friday. he stepped on the gas and veered near three police officers and a police dog. he is wanted now for three counts of attempted murder on a peace officer and stealing a car. if you have any information call the police. >> community leaders are planning a vigil outside the mission police station in san francisco tonight in protest over the deadly police shooting of a young immigrant from guatemala. the group wants the d.a. to release the investigation to the shooing that happened in 2015. the 20-year-old was shot and killed by plain-clothed officers last february. initially police said he lunged at officers with a knife, but autopsy reports showed he was shot in the back. >> now to the south bay. san jose state has hired a chief diversity officer. she will lead the school's office of diversity, equity and inclusion starting in july she grew up in the east bay. got her bachelor's degree at cal state. she worked at the university of oklahoma where she led this scullery's first required freshman diversity training. it comes after three former san jose state students who are white were sentenced for misdemeanor patry on hair african-american roomte in 2013. they were accused of taunting him with racial slurs and putting a bike lock around his neck. they were sentenced to 30 days in jail to be served on the weekend plus probation and community service. >> 8:39. a blue-ribbon panel investigating problems at the santa clara county jails are recommending the sheriff be removed from the jail system. the head of the commission made 30 recommendations to the county, including four that they say should happen immediately. they are create an inspector general's office that would have access 24 hours a day to the jails and have the power to investigate complaints, overhaul the grievance system used by the inmates, create more transparency and fairness in the process used to discipline officers, and reform administration of the inmates' welfare fund. that commission says having somebody new to supervise, that would be the biggest change. >> continued supervision of the jails by the sheriff is not in the best interest of the inmates. the correctional officers, or the community. >> the sheriff, lori smith, says she has made some of the recent changes at the jail and she wants to remain as supervisor of the jail system while more reforms take place. san francisco's port commission now has the results of a study concerning serious seismic problems on the waterfront. the report says a major earthquake of magnitude 7 or more on the san andreas fault will likely cause the seawallnov. that seawall which runs between fisherman's wharf and at&t park is a foundation for many buildings on the embarcadero, including the historic ferry building. >> in a major event, the seawall would move bay ward, and that would cause a lot of damage to historic resources, to the embarcadero, and we need to fix that. >> it will cost some $3 billion to rebuild that seawall. port officials will now get to work on getting funding. >> back in the studio now. is this an invasion of privacy? >> reporter: that's the debate. and new york is trying to figure out if this is is going to go forward. this textalyzer works like a breathalyzer. it can be used on the spot to see what a driver has been doing. textalyzer tell you if the driver has been texting behind the wheel. it is sometimes difficult to figure that out in the case of an accident. ben and debbie lieberman's 19- year-old son was killed five years ago and they say the driver who caused that crash was tegsing and driving, but it took months to figure it out. >> we subpoenaed the phone records on own through our own civil lawsuit. took us six months to get the record. we found texting through the drive leading up to the crash. >> reporter: they have been working with new york state lawmakers on this new bill that allow officers to use this textalyzer. if you have never heard of it it's still being developed. it scans your phone and that determines if you were texting at the time of the accident or before the accident. as you might imagine, there are some concerns about privacy. supporters say it only detects that texting are being made. it does not read them and cannot get any other information from your phone. >> i think that there is of that needs to be done and that can be done both to address the problem and to respect the privacy rights of drivers. >> so this proposed legislation also says that if a driver refuses to allow police to scan their phone, they could actually lose their license. brooklyn state samably man felix ortiz is north carolina's governor issued an executive order extending employment protection to lbgt people who are state employees. those workers lost protections as part of a new state law the governor signed three weeks ago. the executive order signed yesterday by republican pat mccrory let's stand provisions in the law that ban transgender people from using bathrooms that correspond to their gender identity. several businesses halted their plans to establish or expand operations in north carolina because of that new law and a federal lawsuit is pending aimed at overturning it. well, organizers announced the theme of this year's san francisco pride parade is racial and economic justice. the parade is set for sunday, june 26. the celebrity grand marshals will be the stars of the fuse tv show transcend ent. it's a show about young talented trans women. members of the black lives matter organization have also been selected as grand marshals. several individuals are also being city because of an earlier accident. southbound 280 slows from the mall to 380. so this area is kind of crowded. caltrain had a problem with a stuck train in san carlos. train number 217 will make all
