bay, especially if you use highway 85. let's go back to the desk. thank you. new this morning oakland police arrested all three people who were accused of shooting at two under cover officers over night. they search for the third suspect for hours, we've been covering this live. alex savage first one out at the scene 4:00 this morning about this shooting, what can you tell us now? >> well pam good morning to you, we just got an update from a lieutenant hear at the scene, we can confirm they have captured all three people they were searching for in connection to that shooting, someone they believe those three people now in custody fired upon two, at least two officers involved in some kind of under cover operation they were apparently trying to arrest a man with a warrant for his arrest, a warrant for a very violent crime that's when those shots were fired. there was a massive search because they were searching for that third and final person on the run here, let me show you what that search looked like. >> come out with your hands up! >> this all played out near 55th avenue and foothill here in oakland you can see police had a house surrounded, they were ordering the people to give them up, there was a yard to yard search for one man who was on the run on the loose in this neighborhood and he was captured trying to leave the police perimeter. now this situation apparently started when under cover detectives were involved in some kind of an operation searching for a man with a warrant, the chief of police told us this was all related to a homicide investigation from yesterday. and during that operation, shots were fired at two under cover detectives, now the people responsible for that shooting then sped off in a car which they crashed just a short distance away, two people arrested right away by officers but a third man escaped, and i asked the chief of police why those officers may have been targeted. >> this is scary stuff, shows people are not afraid to use guns and we need to really continue to work hard to try to reduce violence here. >> so again this all began with some sort of under cover operation in which officers were trying to track down a man with a warrant for his arrest, the warrant for a violent crime and also we want to point out the chief says this may, this was connected to a homicide investigation as well and while those officers were doing that investigative work, someone open fire on them but again the officers were not hit by the gunfire, all three people that police have been searching for are now in custody, pam. good news because boy a different scene behind you now. all right time is 6:05. the death tole has now topped 5,000. rescue crews are still having trouble getting to remote towns and villages for saturday's 7.8 earthquake killed or injured many people. the death toll could eventually top 10,000. a san francisco man who was touring a nepal national park, take b out by helicopter yesterday just before a new mud slide hit. >> the protest, they are spreading out as they are angry from the lack of aide coming from the government, most of the country without clean water or sanitation. aide groups say the damage is widespread as we've seen on pictures and the after shocks are delaying even more the relief efforts, this quake was the deadliest natural disaster to hit nepal in more than 80 years. schools are back open in baltimore this morning but this after people mostly obeys a curfew following rioting over the case of freddie gray. reporter live in baltimore yesterday morning and pan off to a live shot here we're in front of baltimore's city hall, a short time ago you might be able to see people wearing blue shirts they said they were with a faith-based organization called build. they plan to do exactly that. help the city of baltimore get rebuilt. people here, there is some good in this story where volunteers are coming forward to lend a hand to their community, they are not just people from this community, they are coming from all parts of the state and even out of state as well. now yesterday about 2,000 national guard troops were deployed along with a thousand baltimore police officers at 10:00 wen the curfew went into effect, in a show of civil disobedience, people kind of streamed out on to the streets, the police officers fired smoke canisters and pepper spray bullets that helped disperse the crowd so the feeling here is that the curfew is in fact working, pam? all right. that's good news. what about the two night games were canceled the orioles doing something that's never happened before they are actually going to hold the game but it is closed to the public they'll play the game with no fans. >> yeah it is pretty nuts, never happened before, at 2:00 the orioles take on the chicago white sox. the only people who will be there beside the players will be members of the media and some security detail. no fans at all the commissioner of major league baseball decided it would not be a good idea to have people in the stands in light of what's going on here, then additionally baltimore scheduled to play the tampa bay rays here in baltimore but they have now moved that game to florida even though the game is going to be played out near tampa bay, baltimore is still the home team the first time ever in baseball update. 6:08 here in the bay area protesters marched through oakland for a second straight night to show solidarity for protesters in baltimore. >> we won't take it anymore! >> demonstrators marched through downtown oakland, they went to the bart station ended up with an impromptu rally, smaller than monday night's demonstration in about 100 people marched through the downtown area, both marchs there may be more victims. 47-year-old rob richard chapman surrendered to police, they are crediting an overwhelming community response on social media and on the local news for the quick arrest -- accused of groping a little girl on sunday afternoon. and the possibility of a similar incident earlier this month. this video shows the man who two teenage girls say bothered them as they were shopping in a safe way store. american airlines apologizing for delays on several flights over the last 24 hours, american say some pilots have problems with an app on theipads they use instead of paper maps. some of the flights had to go back to the gate to fix that problem. two years ago american became the first airline to have the pilots rely entirely on ipads for navigation and flight plans, that saves american airlines about 400,000-gallons of fuel every year, because it eliminates the weight of the flight bags that the pilots used to have in the cockpit filled with thousands of pages of flight plans. 6:10, the supreme court is taking up whether same-sex could be legal nationwide, how they reacted to yesterday's oral arguments. a new group says it will block the warrior's trying to block plans from building a new arena in san francisco. and critics say they are worried about access to health care what's that all about, tara? >> parking and traffic are the major concerns from this group, they say that ambulances aren't going to be able to get to the hospital because of the influx of crowds and cars associated with this project. new the chronicle is reporting that a var wealthy group of ucsf donors hired a group of high powered consultants to block the move to this neighborhood. they want to develop 12 acres, include an 18,000 seat arena, 2, 160-foot tall office tower, and larger than union square. the opposition called the mission bay alliance says the arena would undo years of work and planning for the mission bay medical campus. again, one of their biggest concerns is parking, they say the warriors plan to build only 950 parking spaces midwest of which would serve the two office towers, saying they plan to host as many as 200 events at the arena and show no willingness to negotiate the project's term. and fired back saying it has brought support across the city including ucsf. the environmental report is due back next month we'll try to get reaction here from people who live in mission bay. live from san francisco, back to you. time is now 6:15. governor jerry brown calling for $10,000 fines for people and businesses wasting the most water during the drought. the recommendation was part of a proposed legislation to expand enforcement of water restriction. now governor brown met yesterday with a mayors of 14 cities including oakland, san jose, livermore, he is also directing state agencies to speed up environmental reviews of projects, will increase local water supplies. drought conditions are affecting air quality here in the bay area, according to the associations annual state of the air report, the lack of rain has made the air stagnant, allowed particles from exhaust fumes and fireplaces to build up in the air. this particular kind of pollution is worse in santa clara and salano counties, saying the bad air is affecting the elderly, children, and people with asthma. preparing to close two more fire stations and lay off firefighters after voters rejected a tax assessment in the east fire district that would have raised more than $4 million a year for the next five years. two of the fife fire stations will be closed. four firefighters laid off that will leave just 9 on duties, they cut they will from 8-5. brent wood was closed in september, and another one shut down as well. 6:17. let's get everybody moderate heading out to the peninsula. we mentioned a crash westbound 237, looks like they are making progress on it and it is not going to be one of those accidents that will last for a long time. nevertheless slow traffic on westbound 237. 6:31. let's go back to the desk. time is now 6:32. new this morning 3 people have been arrested on suspicion of firing shots at two under cover police officers in oakland, this is a case that involves a homicide, a car crash, and a man hunt, ktvu fox 2 alex savage joining us live from oakland police headquarters with details, alex? >> a close call for oakland police as someone open fire, thankfully the officers were not hit, now we're learning that those officers were involved in some kind of an under cover operation trying to track down and arrest a man with a warrant for his arrest and after a long tense search, eventually police say they were able to capture all the people involved in this shooting. . >> come out with your hands up! . there you see the scene, early this morning officers surrounded a home near 55th avenue and foothill and that's where they arrested two people in connection with that shooting upon police officers, but there was a third man who was initially able to get away from police and that prompted a large swat team call out and they were doing a yard to yard search for quite some time and then eventually that third man was captured there at the scene. this situation all started when officers were doing an under cover operation searching for a man with a warrant for his arrest for a violent crime. the chief of police did tell me this morning that investigation was related to a homicide earlier in the day. at some point shots were fired towards under cover officers, the people responsible for that shooting sped off but they crashed their car a short distance away, that's what led to the two initial arrests and then the long search and a lieutenant told me he was certainly nervous when he heard about shots being fired at officers. >> when it comes out, responsible for the area, to hear my officers getting shot at it is a very tense moment. the first thing i want to do is get on scene of course, but i am really proud of my officers they really responded professionally, really fast, it was the quick response is the reason we were able to get into custody as fast as we did. >> so again police were doing an under cover operation, a man wanted for violent crimes searching for him when shots were fired in the direction of under cover police officers again, no officers hurt out here this morning but there was that massive search in that neighborhood it is all now come to a conclusion and they have arrested three people in connection with that initial shooting, dave. all right alex savage in oakland. the 18-year-old charged with a 9-year-old boy's murder going to appear in court. police say schultz stabbed 9- year-old jordan to death inside his home in discovery bay early sunday morning. in a jailhouse interview he told the newsgroup that he wanted to know what it was like to kill another person. police at stanford university are trying to track down the people who painted disturbing symbols on student housing, last night they rallied against the vandalism, and we're there at stanford with the event and response from the university. pam, the university's president has come out saying that he is deeply troubled that somebody would paint offensivesymbols like a swastika on student housing, they launched an investigation, the way students are handle it, they have banded together last night about 200 students gathered in memorial plaza to talk about what happened. organized by the jewish association and had a somber tone, people talked about how family members were treated during the holocaust, they'd like to know who spray painted a swastika and student housing over the weekend. the swastika was found on the fraternity house and the pent gram discovered on the back wall. >> it sort of puts a bad name on the university makes us feel a little attacked, but i mean, something that is out in the real word, we have to face it and confront it in a manageable way. sanford university president released a statement quote, the university will not tolerate hate crimes this incident will be fully investigated. this has no place at stanford, i asked everyone in the university community to stand together against intolerance and hate. there are two investigations one by the campus and the other by the police, they are looking foranyone who may have information, saying they are surprised about the vandalism hope it is not fellow students here on campus that are responsible. back to you. all right thank you for the update. all right time now 6:37. relief supplies on earthquake ravaged nepal, and quake survivors are angry at the slow arrival of the aide which includes medicine, food, water. while international aide is starting to arrive there, there are several relief groups here in california and the bay area ready to go there. ktvu brian flores in our studio to tell us how they are preparing. >> help is coming from all over the u.s. including a group of california firefighters and search dogs headed to nepal. a trainer tells us that k-9 handlers and labs were trained at their facilities, one was found through a south bay animal rescue group. >> to train by teaching a dog that has a lot of energy and focus to retrieve and find a specific item, which is a human, bark when they find scent. this is a video of them leaving on sunday, they have a difficult task ahead of them especially because of the rainy weather. they can cover 4 to 5 times the amount of people can. meantime a man was one of the four americans who died in the avalanche that was triggered by the quake these are photos of 48-year-old vin tron. he said he was going on a trip of a lifetime. said he loved hiking and always wanted to see the himalayas. on a brighter note we earned a man who went to nepal is safe, spencer was finally able to call his family his father said he screamed with joy when he heard the words, hi dad. he was heading towards katmandu. and uc berkeley is holding a fundraiser that event starts at 7:00, i'm sure we'll be seeing more groups heading to nepal in the days to come. thank you. time 6:39. a man pulled out of the rubble of a collapsed hotel in nepal he is recovering, spent 82 hours buried under debris. the 27-year-old man says he had just finished his lunch, went up to the second floor when the quake hit. said he kept banging on the rubble hoping someone would hear him, finally a french rescue team heard the noise. he said during those 82 hours, he was surrounded by people who had been killed, even had to little bit. a new associated press pole shows americans are split on whether the supreme court believes same-sex marriage should be nationwide. the case involves bans in four states the court's ruling could enup legalizing gay marriage across the country, experts expect justice kennedy, but he expressed that it should be between a man and a woman. >> this has been with us through millenia. >> the supreme court will decide two questions, the constitutionality of bans on same-sex marriage, if states must recognize gay marriages from other states. a decision from the court isn't expected until late june. >> and san francisco, saying they feel optimistic after the hearing a large crowd gathered at city hall, the first country to issue marriage licenses back in february, 2004, then the mayor directed the city clerk to issue marriage licenses to same-sex couples. years of legal wrangling followed, then in 2008, made a bold prediction after a california supreme court ruling in favor of gay marriage. it is inevitable, door is wide open now. it is going to happen whether you like it or not. >> well now california's lieutenant governor was at the supreme court for yesterday's hearing. there is a new very alarming information about the number of students finishing high school in san francisco. the graduation rate of public schools in san francisco dropped below the statewide average for the first time in at least 5 years. it is drop out rate is now one of the highest in california. according to the state department of education, 79.9% of students graduated in san francisco last year. statewide, the graduation rate was almost 81%. the city's drop out rate reached 11.9% while for the state, it was 11.6. middle schoolers around the country, they are getting failing grades on tests known as the nation's report card, results from last year's national assessment of educational progress show only about a quarter of eighth graders actually did well in u.s. history, civics and geography. among the test takers only about a third answered correctly that a belief shared by most people in the u.s. is that the government should be a democracy. 45% were able to correctly looking at the backup here on southbound 101 in san jose, and it is just terrible. you can see it is stacking up, this is normally where there isn't a big backup because southbound 101 for most people is the noncommute direction heading down to tully. the people here are expecting a good ride and some people have actually been turning around on the onramps here and going back the wrong way. you can see that there at the top left of your screen, cars have turned around and going the wrong way, just stuck and i think chp takes a dim attitude when it comes to this kind of thing, but you know, i sympathize with people who are stuck. southbound 101 at tully, northbound traffic is getting by but they are looking at what's going on and this is going to be here for awhile issued an alert for the area. let's go to other traffic in the east bay westbound 580, we had an earlier problem that's clear, traffic is moderately heavy on the pass, getting into dublin and 880 beginning to slow heading south. looking at the bay bridge toll plaza, that's backed up for a 20 to 25 minute delay before you actually make it on to the span. today's weather, 6:48. >> thank you very much, we have some low
