we are dealing with wet roads and ponding likely the cause of some of these accidents that we are tracking. westbound 4 just past mcewan a car crashed into a tree wrapped around that and emergency crews are on the scene. they have one lane blocked along highway 4 as you're approaching mcewan. and that backup is really starting to stretch, cruising speeds around 30 miles per hour until you get past that accident making your way on over towards 80. it's about a 20-minute ride from 680 over to 80. westbound 4 and bailey road, off-ramp blocked due to an accident so expect delays. 580, the usual slowdowns between 205 and 680, 27 minutes. president trump could sign the gop tax plan into law by the end of the day. senate republicans passed the measure early this morning. but as john lawrence explains, due to technical changes in the bill the house has to revote later today. >> reporter: while most americans were asleep, the republican backed tax bill was approved by the senate. >> the tax cuts and jobs act is passed. >> reporter: the vote as expected was along party lines, 51-48. this is the first overhaul of the u.s. tax code in more than 3 decades. vice president mike pence tweeted the bill is a historic win for the american people. democrats made no secret about their disdain for the plan. >> the far right architects of this tax plan are going to be coming for your social security and medicare before you take your christmas tree down. >> reporter: the gop says the bill will boost american paychecks and make the country economically stronger. >> with this measure, not only providing middle class tax relief but an opportunity for businesses to be competitive globally, we have a chance to take america to new heights. >> it's one of the most important things we can do to get the u.s. economy growing faster to help people get more pay. >> reporter: critics blast it saying it will pad the pocketbooks of the 1%. >> it's not tax reform. it is a heist, a heist that steals from millions of middle class families and hands that money over to the wealthy. >> reporter: time will tell how voters will respond to the changes. but the democrats believe it will haunt president trump and the republican party in the 2018 midterm elections. >> this tax bill will be an anchor around the ankles of every republican. if they haven't learned it yet, they are going to learn it next november. >> reporter: i'm john lawrence reporting. >> the bill caps the state and local tax deduction at $10,000. according to the "l.a. times," about a third of california taxpayers take an average state and local deduction of $22,000. the bill caps the mortgage interest deduction at $750,000. that's higher than the original propose limit of $500,000 but down from the current $1 million. that will have a bill impact in the bay area where the median home price is over $900,000. a handful of lawsuits against president trump's decision to end daca face a court hearing today in the bay area. jackie ward explains. >> reporter: this morning, u.s. district judge will consider five lawsuits about daca. groups including seiu local 521 joined santa clara county in the lawsuit. the union represents 10,000 workers in the county many who are daca recipients or have members of their families who are. the union says there may be 23,000 daca-eligible people living in santa clara county. back in september, it seems like progress was being made toward a daca solution. >> we're looking at allowing people to stay here. >> reporter: as far as any potential progress in washington regarding daca, senate majority leader mitch mcconnell said it won't come up this week. he believes congress has plenty of time to talk about starting next year. republican arizona senator jeff flake is tweeting out his prediction saying a bill will be on the senate floor in january. democratic california senator kamala harris tweets: hem back to countries they don't know. today's hearing is happening in just a few hours at 8 a-m at the federal courthouse in san francisco. the walnut creek city council >> reporter: today's hearing will be in a few hours at 8 a.m. at the federal courthouse in san francisco. >> thank you. the walnut creek city council has approved a homeless shelter plan to temporarily relocate over the objections of community members. it would occupy a storefront downtown at botello drive and california boulevard. the trinity center currently feeds the homeless at its walnut creek campus near st. paul's episcopal church. that location needs to be revamped. the trinity center says it would be devastating to be forced to shut down completely during construction. but some neighbors expressed strong objections. >> you lose the advocacy, the job skills training, the place they get a shower, get a shelter, get a meal. >> sick to my stomach if there are a bunch of homeless people congregating over where i go get frozen yogurt and go get a burger. >> construction at the original location is expected to take about a year and a half. with christmas just days away, today could be one of the busiest travel days of the year on freeways. kpix 5's katie nielsen is live in south san francisco to explain. >> reporter: travel experts say that today could be one of the busiest days and that partially due to a stronger economy. they say on average, they estimate 107 million people across the country will be going out of town for christmas, 97 million will be going by car, 6.5 million flying, and 4 million will be taking a train or bus. gas prices are 28 cents higher a gallon than last year. but a stronger economy means more people are willing to hit the roads. >> it will be busy starting thursday. trying to get on the road early, fight the crowds, you know. >> reporter: part of the reason for the early start to the holiday travel season is because christmas is on a monday this year. now, the worst time to travel, late afternoons and into the evening. travel experts say if you want to miss most of the traffic, head out mid-morning, give yourself some extra time to get to your destination, and also be careful, slow than 1,000 structures, and is linked to two deaths. it's currently 55% contained. the humane society's marin county chapter plans to find permanent homes for 45 pets that have been waiting adoption in ventura county. they include dogs, cats, rabbits and guinea pigs. the first dogs are expected to arrive in novato this morning. berkeley council members have decided to continue a city policy allowing police to use pepper spray for crowd control in some situations. the council first allowed restricted use of pepper spray three months ago after clashes between protestors. critics of the policy have raised concerns about the potential health impacts. but police chief andrew greenwood says that pepper spray can sometimes be a valuable tool. >> motion carried. policy goes into effect. >> i'm pleased that council has voted to continue with the policy they came to agree upon on september 12th. it gives us a tool we may need in extraordinary situations to keep our people and community safe. >> officers are allowed to use pepper spray on individual violent protestors. it's not to be sprayed indiscriminately to disperse crowds. a cannabis summit starts today in the east bay. it's being hosted by the alameda county board of supervisors to bring key stakeholders together to address the challenges and opportunities related to the legalization of recreational marijuana. that becomes legal in california on january 1st. the summit starts at 9 a.m. at the board of supervisors chambers in oakland. mark desaulnier wants more information about near misses at airports in the country. >> an incident happened in october but no recording of what happened in the cockpit because it's erased. >> you have the interviews with the pilot and copilot but it would be better to have the we are tracking delays along in a stretch plus we have roadwork -- bridge crews taking longer to finish roadwork. one lane is closed. you can see the crowding as people make their way through that tunnel at treasure island. the ride is slow across that span heading into san francisco. speeds are dipping to 25 miles per hour but once you get on the skyway, things are at the limit. so your travel time in the yellow. it's about 18 minutes from the maze into san francisco. still dealing with these slowdowns due to an accident. this is westbound 4 just past mcewan. a car hit a tree and emergency crews still have that one lane blocked so if you are heading from 680 to interstate 80 connecting to hercules do prepare for a slower ride. extra time on the roads this morning. that's a check of your that precipitation. behind this, you can see this whole -- a few remaining showers further south along the coast. san jose will be having rain. in san jose now your temperature 48 degrees. santa rosa cooler because it's clear up there in the north bay now. 42 degrees, concord 50 degrees. 51 oakland. this low pressure center will create a front moving through. it's slowly making its way through the area. again, it's going to be clear and breezy behind it. looking at our futurecast, here's this layer of green this precipitation and cloud coverage that we are seeing now but it will move through quickly. clear this afternoon and breezy. the same story into the evening hours and thursday. rain here means snow in the sierra so we have a winter weather advisory in effect right now. so take it into account in the higher elevations. snowfall 3 to 5 inches and above 7,000 feet, up to 10 inches. so that could affect your drive up there through the pass. a few morning showers, breezy, cool and clear afternoon. after that it's dry. a few chilly nights to mild days. and then in the long term we have rain chances returning to the forecast specifically on christmas day. your high temperatures temperatures for today. it's going to be chilly up there. your seven-day forecast, we have rain or showers that are moving through right now. actually wednesday afternoon is going to look more like thursday so consider today a little bit in between these two right here. so showers that are moving through now, thursday we'll have beautiful clear skies. same thing on friday moving into saturday. temperatures are going to start to rebound getting a little warmer moving into sunday when clouds return to the forecast. and then on monday, for christmas day, we have a chance of rain, tuesday sunny against its stance on "deferred action for childhood arrivals," also known as daca. >> kpix 5's jackie ward joins us on the lawsuits being heard in federal court today in san francisco. >> reporter: so here's who is fighting back of the the university of california, the state of california, the city of san jose, santa clara county, seiu local 521, and six people. that is how is filing lawsuits against the trump administration and whom a federal judge in san francisco will be hearing from today. they don't agree with the end of the daca program, although the president gave congress until march to come up with a legislative fix. many democrats hoped it wouldn't take that long. some hope the daca deal could pass as part of the year-end government funding bill. gop leaders said that's not happening and they are mulling over details of the proposal. >> we are still looking at the bill, still reading the bill, still working on some other issues. just came from a meeting on daca. it won't be voted now, but january is going to be busy. >> reporter: the bill being considered now suggests legalizing the status of people admitted through the daca program. under the trump administration policy, daca recipients could stay for the remainder of their two-year authorization. today a federal judge will consider the government's request for dismissal of the lawsuits. the hearing will start in federal court in san francisco at 8 a.m. president trump could have a new tax billing to sign by the end of the day. overnight, the senate passed the bill along party lines. the house will vote again on the measure today due to some technical changes made to the bill before the senate vote. independent studies find that most taxpayers will save between $60 to $51,000 next year depending on their income and where they live. in a decade more than half of taxpayers will pay more than before. savings for the very wealthy will continue to rise. the red-hot bay area real estate market could take a hit under the new tax plan. the mortgage interest deduction will be capped at $750,000 which is down from $1 million. and there's a $10,000 limit for state and local tax deductions. >> it's a possibility that california taxpayers will end up owing more tax and the main reasons would be that there is now a cap on the deduction estate income/property taxes of $10,000. our radar. that means there are still some showers in the area. let's zoom in to where we're seeing that precipitation. again not a whole lot of rain just a few scattered showers. most of the front has moved south along the coast but you will see a few scattered showers around san jose, fremont, maybe even to the east of hayward. livermore seeing a few showers, as well. so as jaclyn said be careful on the roads. you won't need the umbrella. it's moving out. cooler in the north bay. warmer in the south bay. 48 in san jose and cooler at the coast . low pressure bringing the front through.
