location. >> katie mars yooulo is live from valencia and cesar chavez with more. katie? >> reporter: dan, ama, police still have cesar chavez here shut down in front of the hospital and the hospital is at least still partially on lockdown but i've been able to speak with people who have since been released from the building. they described for me what they heard, gunshots, loud bangs. some say it sounded like explosions. but here's what we now know happened from the police department. this all started in san bruno, where police say the gunman robbed a big 5 sporting goods store and stole a rifle and some ammunition. and then at about 4:30 he somehow got into the hospital construction site with both the handgun he used in the robbery and the rifle. now, a construction worker has told abc 7 news that he saw the man, he looked suspicious because he clearly wasn't a construction worker and he also thought he saw a gun so, he called 911. the police chief says when officers arrived the man appeared to be firing shots. >> upon arriving they exited their vehicles, looked up and atop the construction elevator was the suspect, and it appears to be white coveralls holding a rifle. the rifle was directed at the hospital. officers directed their firearms at the suspect, who then lowered the rifle, pointing it down below. three officers fired, neutralizing the suspect. the suspect is deceased. police did search for other possible suspects but now believe the dead man acted alone. he's described as being in his late 20s, and we know no one else was hurt. police say the man appears to have driven from san bruno to the hospital and it looks like they have identified his vehicle, a white pickup truck here at the scene. live in san francisco, katie marzullo, abc 7 news. >> witnesses described a frantic scene as police rushed toward the suspected gunman above a busy street during rush hour. we spoke with a woman who was riding in a lyft car at the time and a st. luke's doctor who was told to stay inside her office. >> we were one of the only cars actually on that side. i saw probably seven or eight cops running next to st. luke's with their guns out. saw a man standing on the top -- i guess it was an elevator shaft from what i'm hearing. and he had a huge rifle. >> so there's not much for us to do except sort of stay here and wait. i was talking to one of the security guards, and as far as i know they're sort of just wrapping things up. >> one of the witnesses added that police urged people to move away from the hospital as they ran with their guns enthusiastic, and i'm not sure that anybody -- it would be possible for anybody to have represented the east bay better than she did. >> but today a new power player emerged to help move the team to southern california. abc 7 news reporter laura anthony has more. >> congratulations. >> reporter: oakland mayor libby schaap has made her case to an nfl committee in new york, a group of six that will decide if the raiders stay in oakland or move to carson in southern california. after the one-hour meeting schaap said by e-mail, "i felt it was a positive discussion and that we were well received by the raiders leadership and the other nfl owners. they were engaged and asked great questions. >> very frustrating. >> reporter: chris dobbins is with save oakland sports, a group wondering just how committed raiders owner mark davis really is to keeping the team in oakland. especially now that the raiders and san diego chargers have hired disney ceo bob iger to lead their efforts to move to carson. disney is the parent company of abc 7. >> trying to get this project in carson. he's hired carmen policy, one of the best executives in the nfl, and he comes out with the disney money behind this project. >> reporter: abc 7 news spoke with carmen policy by telephone. >> it's truly a game changer as far as the nfl is concerned. they have bob iger involved with our entry into the l.a. market. if in fact the league approves us as the team to go to l.a. >> it might be difficult, though, for davis to convince the nfl the raider fan base is dwindling in oakland. a key component in the league's relocation process. >> touchdown. >> the team now has more than 40,000 season ticket holders and the next three games are sold out. >> and that was laura anthony reporting. iger will be paid just a dollar a year as chairman of carson holdings but he'll have the option to acquire a minority stake if the stadium bid is successful. a former inmate in the santa clara county jail who says he witnessed michael tyree's beating death is talking for the first time about his own beating at the hands of correctal deputies, he says. we broke the story in september while inmate ruben garcia was being treated at valley medical center and he's now out of jail and gave his first on camera interview to abc 6 report yeh melanie woodrow. >> reporter: these are pictures after surgery on his broken jaw. he says correctional authorities lee and dario beat him inside santa clara jail. >> i've never been beaten like that before. >> reporter: he says he has a rod and titanium plates in his jaw now along with nerve damage and numbness all from the beating. >> felt like a lifetime but in reality it was 10 or 15 minutes. >> reporter: garcia says after the beating he pleaded for help. >> i told them please, i need medical attention. my eye's split open. please. you've got to help me. and he just looked at me and kept walking. >> reporter: the next day garcia says deputy lee apologized. >> and i remember telling him look what you did to me, look at my face, man. and he goes, it is what it is. welcome to my dorm. >> reporter: that dorm, 6-b in the main jail. the same place three other correctional deputies are accused in the beating death of inmate michael tyree. >> they call them the wrecking crew, meaning that they're going to beat you, go beyond the scope of duty to hurt you. >> reporter: originally garcia's broken jaw was documented as an inmate scuffle, but he says that happened the day after correctional deputies beat him. it wasn't until after tyree's august death that detectives interviewed garcia about his july beating. in a statement sheriff lori smith says an investigation was initiated into mr. garcia's allegations and that investigation is active and yan going. >> these people abuse their power and beat this man for no good reason. >> reporter: attorney robert powell will file a claim thursday. it names the county and both correctional deputies. in san jose melanie woodrow, abc 7 news. san jose today reached a ten-year high in the number of shootings involving police. an officer fired at this man, shannon nathan wong. he wasn't hit but did end up getting arrested. he's accused of carrying an assault rifle and trying to break into his neighbor's home. last night police responded to reports of the attempted break-in at the monte vista town home community. when officers arrived they say wong was dressed in military gear and carrying an ar-15 assault rifle. >> the police officer's screaming and giving him instruction on what to do. get down, get out. you know, get down, they're going to arrest him. >> police say these gnsz are among the cache of weapons they discovered inside wong's home. it was the city's 11th officer-involved shooting this year. police say a driver smashed into nine cars in richmond this morning while trying to get away from police. abc 7 news reporter wayne freeman takes you through what happened. >> reporter: it was a neighborhood-numbing ten-vehicle crash. an entire city block in richmond. a landscape of mangled metal and what looked like miles of police tape. >> to hit that amount of cars and somehow ending up where he did, the car probably flew. >> reporter: this is the aftermath. cell phone video shot by rudy sorto showing the suspect being loaded into an ambulance. rudy was the first to arrive at the scene and speak with him. >> as soon as i mentioned to him that the cops were behind, to relax, he kind of got frantic and just started, you know, wanting to get out, trying to get out. but of course it was going nowhere because his legs were pinned to the car. >> reporter: richmond police told us this incident began with a traffic stop initiated by san pablo police, who say that after the suspect pulled over he took off. this afternoon san pablo police say they never gave chase due to the dangers of a pursuit at high speed in a neighborhood. but it appears the suspect never realized that. he clipped a bmw in the street, slightly injuring one woman, then lost control and hit eight parked cars while traveling at an estimated 50 miles an hour. >> it was nothing, no sirens, anything. just quiet and a crash. >> reporter: which fits the profile of a suspect thinking he was being chased. >> it's traveling at a high rate of speed on a residential street like this. officers tend to cancel the chases. because you have to weigh what the benefit is. >> reporter: in this case that benefit might be somewhat dubious. from richmond, wayne freedman, abc 7 news. people in los altos are cleaning up tonight after this truck slammed into a home on marvin avenue. here's a look at the back end of the flatbed truck and here's a close-up look at the truck front. the santa clara fire department tells abc 7 news the driver was taken to the hospital. no one in the home was hurt. a jetblue flight from boston to san francisco was diverted twice to reno for mechanical problems in less than 24 hours. it was diverted once yesterday. and when pilots tried to fly to san francisco again this morning they were forced to return to the reno airport once again. another plane was flown in, and the passengers finally did make it to sfo safely. it wasn't immediately known how many passengers were affected or whether the plane had repairs between tuesday and wednesday. jetblue officials did not immediately return a call for a comment. we still have much more ahead for you on this wednesday night. coming up, remembering a pioneer. a woman who changed the space of san (voand exceptional customerity pre-ownservice,les... head to your neighborhood enterprise car sales and let the people who buy more vehicles than anyone... flip your thinking about buying your next one. now to the passing of a woman who established san francisco's north beach as the red light district of the 1960s. carol doda was a topless dancer. she was famously acquitted on indecency charges in 1965. her topless act put the condor club on the map and her death is generating a lot of reaction. abc 7 news reporter carolyn tyler has more. >> reporter: carol doeda put herself and san francisco's condor club on the map in 1964 when she stripped and began dancing topless, coming on stage atop a baby grand piano. doda's sensational act was even more popular after she became a pioneer of silicone breast injections, growing from a size 34b to a 34dd. she told abc 7 news her bosses had encouraged her. >> they said, you know, there's this doctor out on the avenue that does this, you know, breast enlargement. >> reporter: to friends like ron manoli, doda was much more than her famous body parts. in recent years she sang once a week at his place, gino & carlo in north beach. >> she was the perfect san franciscan as far as there was nobody that she didn't like. i mean, she cared about everybody. >> reporter: doda also opened a specialty lingerie shop on upscale union street once her dancing days were over. but according to a friend on the block, she often wasn't minding the store. >> she put a note and said please come to cafe union and i'm here. people walked over. oh, carol, could you please -- carol would walk over, open her door, do business, come back here and sit down. >> reporter: friends say doda's legacy should be her kindness and humor. carol doda died monday of kidney failure. she was 78 years old. in san francisco carolyn tyler, abc 7 news. well, we've heard so much about the el nino winter that may be coming but apparently all the rain and snow we've seen these last few days in northern california is not related to el nino. the systems coming in now are from the gulf of alaska, not the pacific. national weather service meteorologists say this is typical weather for this time of year. our weather patterns for the last three years have not been typical. despite the recent moisture, weather experts say the drought is far from over. excitement is building tonight in the sierra as many resorts are preparing to opening in the next few days. north star tweeted this photo of their mountain preps this afternoon. north star will open saturday. and this is an image from the national weather service of the snow coverage today versus the same time last season. dramatic difference, isn't it? definitely a good way to start the ski and snowboarding season up in tahoe. that is a real contrast. >> that is. it certainly is. meteorologist sandhya patel is here with the latest on our forecast. hi, sandhya. >> we need to keep getting those storms out of the gulf of alaska like we did the last two times to get that snow in the sierra and that third one for this month is coming. so let's get ready for some more snow, up to a foot possible at the crest on sunday and we're looking at four to eight inches at pass levels. snow levels will start out 6,000207,000 feet if you are doing? [ applause ] >> reporter: on stage last night fierce opposition. >> come on, folks. we all know you can't pick them up and ship them across -- back across the border. it's a silly argument. it's not an adult argument. >> i don't have to hear from this man. believe me. i don't have to hear from him. >> mr. trump -- >> reporter: jeb bush, eager for a strong debate performance, joining the attack on trump. >> and it would send a signal that we're not the kind of country that i know america is. they're doing high fives in the clinton campaign right now when they hear this. >> reporter: but this morning trump going even further. >> are you going to have a massive deportation force? >> we're going to have a deportation force. and you're going to do it humanely -- >> reporter: but last night's biggest fight was between senators rand paul and marco rubio over the size of the military and america's role in the world. >> i know that rand is a committed isolationist. i'm not. i believe the world is a stronger and a better place when the united states is the strongest military power in the world. >> marco. marco. how is it conservative -- how is it conservative to add a trillion-dollar expenditure for the federal government that you're not paying for? >> we can't even have an economy if we're not safe. there are radical jihadists in the mideast beheading people and crucifying christians. yes, i believe world is a safer -- no, no, i don't believe. i know that the world is a safer and better place when america is the strongest military power in the world. visitor come to abc today. he graduated from cal state east bay heyward and is now a top official in afghanistan's government. asadula zamir is the youngest member of president ashraf ghani's government. he's on a fact-finding mission to uc davis california and other states learning about the best agricultural practices to share with his company. he's the minister of agriculture, irrigation, and livestock and is on a trip sponsored by the u.s. agency for international development. >> without investing in agriculture we'll not be able to have long-term stability. agriculture is the backbone of our economy. >> we had a group of uc berkeley students visiting today. and the minister zamir enthusiastically answered their questions about afghanistan and agriculture. >> wonderful to have him here. coming up next on abc 7 news at 9:00, birth control pill mix-up. >> the women coming together to file a customers returned to chipotle restaurants in the pacific northwest today. 11 chipotle stores had closed after an e. coli outbreak sickened about 45 people in oregon and washington. health officials haven't found the source of the outbreak despite testing but now the portland oregonian says there was another outbreak in seattle in july nat public never knew about. health officials said by the time the pathogen was traced to chipotle the incubation point for the disease was over and there was no point in alerting the public. they're considering a new policy to alert people about any outbreaks in the past. now to a major lawsuit over a birth control mix-up. a group of women is filing suit over their pills and an alleged mistake in packaging that they say led to more than 100 surprise pregnancies. abc news reporter mara schiavocampo tells us how this happened and why they think the company should help pay to raise the kids. >> reporter: tonight 113 women suing a major pharmaceutical company for mispackaged birth control pills they say resulted in unwanted pregnancies. the women, from 28 states, seeking millions in damages. some asking for the total costs of raising a child until adulthood, including education. according to the lawsuit, birth control pills made by quarites, a subsidiary of endo pharmaceuticals, were packaged in the wrong order, rotated 180 degrees, reversing the weekly tablet orientation. as a result, the plaintiffs claim they were taking placebo sugar pills intended for the week of menstruation at the wrong time of the month, leaving them without adequate contraception. that packaging error prompted an fda recall in 2011 but not before these women say they unintentionally became pregnant. in a statement the pharmaceutical company told us that the recall was based on "an extremely small number of defective packs" and gay troop leaders and now the organization faces another controversy, its ban on girls. the local girls have formed a troop, and they say they will now fight to be one of the boys. abc 7 news reporter leanne melendez has the story. >> reporter: connecting lines and tying knots is a boy scouts requirement. these girls are masters at it after joining a boy scouts program called learning for life. they basically were allowed to do the same things as the boys in troop 134 in santa rosa. >> we had been participating with the cub scouts and the o older girls with a boy scout troop for about a year and a parent complained. >> just because i was a girl you couldn't participate. because like girls can do the exact same things boys can. >> reporter: now these girls and their parents are expected to protest on friday by handing in their applications to the local boy scouts council. >> our request at this point is it's time for the boy scouts of america to go coed, to stop discriminating against girls and to allow girls full access to the program. >> reporter: the local council office here in santa rosa was closed today because of veterans day. but a council member told me off camera there's nothing they can do because this is a national policy. we received this statement from the boy scouts of america.
