that prompted zucker to fire chris cuomo and the state investigation of his brother, andrew cuomo, allison gollust worked earlier for the then-governor. zucker found cuomo if improperrerly aided his embattled brother. he didn't try to get zucker fired, but his lawyers took some steps as a warning shot in the negotiations to have cnn pay off cuomo's contract. as this source put it, chris dropped the knife that was used by zucker's enemies. the cuomo camp want to contend that zucker dumped his biggest star for a conflict of interest, but with jeff gone, that argument evaporates as a way of cuomo collecting his remaining $18 million. by the way, msnbc, which loves to attack fox, has not aired a single word on zucker's ouster. nothing to see here. jeff who? that is pretending a friend ask one-time boss w an absolute dereliction of duty. the larger issue is how zucker transformed cnn from there a reporter-driven network to a left-leaning outlet that crusaded against donald trump. now the ratings are crashing and zucker is gone. we'll have more on this ahead with john roberts. i'm howard kurtz, and this is "mediabuzz." ♪ ♪ howard: ahead, glenn green wald on pundits still pounding away against joe rogan and spotify. what whoopi goldberg said about a the holocaust was deeply offensive. >> let's be truthful about it because the holocaust isn't about a race. >> no. >> no. it's not about -- >> well, it is -- [inaudible] >> but it's not about race. it's nobt race -- not about race. >> what is it about? >> it's about man's inhumanity to man. howard: not about race. well, except for the historical fact that the nazis murdered 6 million jews because they considered them an inferior race. after fierce criticism, whoopi apologized with stephen colbert and on her own show. >> i did a lot of harm, i guess, to myself. and people, you know, decided i was all these other things. i'm actually not, and i'm incredibly torn up. words matter, and mine are no exception. i regret my comments. howard: abc news suspended her for two weeks for, quote, wrong and hurtful comments, but many pundits criticized the punishment. >> she made a terrible mistake. we all a make terrible mistakes. she apologized for it immediately and took correction action. now -- corrective action. i want the know who is so frail over at abc? >> i just believe in second chances, and i'm pretty confident she's never going to make that same mistake again. yeah, i know, nobody at "the view" would do this for a conservative ever. hell would freeze over. howard: joining us now in utah, jason chaffetz, former republican congressman and fox news contributor. and in new york, liz claman, host of "the claman count countdown" at three eastern on fox business. liz, let's deal with the substance first. she kept repeating that the holocaust wasn't about race, and people -- not just jewish peopl. >> yeah, of course. i mean, but i do believe, howie, that whoopi goldberg's biggest crime was simply showing an extraordinarily major lack of knowledge, basic knowledge if about the roots of the holocaust. clearly, being jewish is a religion. i am jewish. however, it was hitler and the nazis who were adamant, impressing that the jews were erased and, in essence, based their entire final solution as they called it which entailed putting millions of men, women and churn in -- children and ovens and gassing them to death. they based that on nazis being a master race where they had to eliminate jews. the nazis saw jews as a race and, therefore, that is what the holocaust was about. however, whoopi goldberg -- and i'm with joe scarborough and sean hannity on this -- she apologized. she said, i stand corrected. it was a learning moment that she turned into something the next day on her show where they talked about it and, hopefully, educated more people. howard: well, let me -- >> i look at this -- howard: let me come back to this, i want to get to jason, and we'll move on to the question. whoopi admitted that she sees racism as a matter of black and white, and again, you can get into her argument about jewish people and religion isn't a race, but the nazis clearly saw it very differently. >> her comments were ignorant, they were hurtful, they -- i mean, think of of every negative word you can think of, and she repeated them several times when she went on with stephen colbert, i think she made the situation worse. it wasn't until she actually got in front of teleprompter and read something that, you know, she tried to clear it up. i think america though is tired of this cancel culture. i don't think she should be canceled just because she said something that was hurtful and disgusting and everything else. i think sean hannity and the others are absolutely right. but it is the due policety, it is the -- duplicity, it's the hypocrisy that this never happens to conservatives. when roseanne barr and others say something or do something, guess what? they are canceled, they are gone. but with whoopi, i think we need to stand true and say, you know what? the principle's the same. you don't cancel somebody and ruin their career. she's going to have to live with this, but i don't think you take her off the air, and i think the punishment was, i mean, let's talk about that because i don't think that was right either. howard: well, liz, you know, whoopi fully apologized, as you pointed out. and to her credit -- and i don't think she should be canceled. but, you know, abc took a stand, said is, okay, two week suspension. reflect on your comments. and abc's getting criticized for that. why? >> well, because, number one, a two week suspension for somebody saying something that showed ignorance versus outright, you know, horrific sort of mean attitude about something is -- i'm not sure that really does anything for whoopi. whoopi goldberg is not anti-semitic, okay? she's just not understanding --, and that's really sad because a lot of americans do not understand the nature and the roots of the holocaust. abc, you don't know what considerations were being had or what kind of calls that they had. i understand that they felt they had to do something, but we not allowed -- are we not allowed to learn from our mistakes and learn about something that we didn't know beforehand? this is really pushing it, in my opinion. howard: jason, of course whoopi goldberg is not anti-semitic. she chose the name goldberg saying she identifies with the jewish people, but if she had done nothing, wouldn't abc say the network's condoning this kind of language that is completely, flatly wrong? >> yeah. i viewed it as abc sent her on a two week vacation, and maybe she's learning something from it. if i hope she is. but you're right, karen johnson, aka whoopi goldberg, i don't know. i mean, there are a lot of people, if you're looking to whoopi goldberg for your political news and information and perspective, i don't know that that's necessarily where you get it, but i guess some people do that. look, i hope everybody learn ares about this. i like what my colleague, former colleague trey gowdy said. if you're out there talking and trying to compare something to the holocaust, to slavery or for a man trying to, you know, say something about what it's like to be pregnant, then you're probably going off the rails and making more trouble for yourself. howard: never ends well. but i would say that "the view" is an in -- influential show. i've interviewed her, she's likable, and i think that's one of the reasons people are being very generous with her. let me switch to donald trump, january 6th and his comments which got a lot of attention in the media about how he would consider pardons for the january 6th defendants. that was criticized as inappropriate by a guy who had been his closest ally in the senate, lindsey graham, and here's the former president hitting back on newsmax. >> yes, i would absolutely give them a pardon. lindsey graham's wrong. he's a nice guy, but he's a rino. with the exception of one young, fine woman, nobody died on january 6th. howard: liz, why has this question of pardons if trump is in the white house again in 2025, struck such a nerve in the press? >> well, you know, the republicans are known as the party of law and order. if somebody breaks the law, then they should be punished. so an outright pardon would certainly diminish or vaporize any kind of responsibility for what happened and all the video evidence that's out there for january 6th. and, howie, if lindsey graham is a rino, then ronald reagan is too. i mean, republicans are the party -- at least they have stood upon -- for law and order, and they believe that if you attack a cop, you attack multiple cops, that you should pay for that crime. howard: jason, i ask you as a former republican house member, the rnc, as you know, meeting out in utah where you are, passed this resolution against two pretty prominent dissidents now, liz cheney and adam kinzinger, for serving on the january 6th committee using the language they engaged in the persecution of odder their citizens engaged -- ordinary citizens engaged in political discourse. the president has depicted this as being intolerant by the rnc. fair or unfair? >> i think it's a bit unfair. i think republicans are very concerned that nancy pelosi set the precedent of being able to unilaterally choose who's on that committee. i think it undermined any credibility that it had. i think it's an absolute farce. the minority if should be able to pick -- in this case, kevin mccarthy -- should be able to pick and select who is actually serving on the committee. for them to hand pick the two people that have obviously already made up their minds about the conclusion of this and is already have made decisions about this is a joke. and i don't think that those two people, adam kinzinger and liz cheney, of which i both know and i've been very friendly with in the past, but i've got to tell you, i think they should have stood tall and said, no, that's not the way america works. the minority gets a voice, and they get to select who gets to be on this committee too. and if you're going to go along with this cha railed, then you should not be in the republican party. howard: so you're perfectly comfortable with the rnc saying they shouldn't be part of the gop. >> absolutely. i think they should be dismissed from the -- i just think they are not caucusing with the republican party. and republicans get to choose who serves on that committee, not nancy pelosi and nancy pelosi alone. howard: all right. just briefly, liz, this phrase whether they're engaged in legitimate political discourse referring to what happened on january 6th, hundreds and hundreds of people have been charged, that is getting huge attention from the media. >> yes. but, howie, it should get huge attention from republicans whether they are far right or centrist when a national political party like republicans define all the attacks that we saw with hockey sticks and tasers and all kinds of weapons including, you know, the american flag pole being used as a spear. when they define that as legitimate political discourse, i can pretty much if guarantee you they've got bigger problems than liz cheney and adam kinzinger. they are going to be watching ae midterm elections than we were january 6th. that was pointed out by the daily caller, a conservative site, who made that connection. but, howie, i would only say every democrat rival is going to be using that video and then that legitimate political discourse in those ads is going to be a problem -- howard: that's why we have campaigns. ahead, john roberts on the ouster of cnn's jeff zucker, but when we words. >> i heard this week that president trump said i had the right to overturn the election. president trump is wrong. howard: jason cough fetes, mike pence explicitly pushing back against trump's strongest words to date saying the vice president had the power to, quote, overturn the election. the media's reaction was, wow, that's great. trump -- pence finally spoke up after years of being loyal ask good for him. your thoughts. >> the role of the united states congress, the role of of the senate president, which is the vice president, is to simply count the votes that are presented to the congress when certified by the states based on the popular vote within those states. looking forward, for instance, kamala harris at this next election, she'd be the president of the senate, she doesn't have discretion to just pick a unilateral decision as to whether or not what the states sent were valid. what they get to decide is, is the count right. that's all they do. they simply are vote counters. howard: but, liz, this obviously was a decision by the former vice president to speak those words knowing how popular donald trump remains with the party. and some pundits are saying, well, is it just pence defending his actions on january 6th, or is he laying the groundwork for a possible white house run in 2024. >> could be a little bit of both, howie. take note of where he said this, the federalist society, a strict constitutionalist and very, very conservative republican people as part of the federalist society. i'm with jason. i think that people on both sides of the aisle if they're looking at the electoral count act of 1887 will say the vice president does not have unilateral power to deem who won an election or to overturn the election based on outlying situations. but donald trump was a little clever when he did argue that because there are constitutional scholars who believe that that act of 887 is flawed -- 1887 -- they talk about reform, but none of the reforms would change what jason outlined, and that is that the vice president simply is there to count the votes. howard: well, i totally agree that he didn't have the power. that's what mike pence concluded and what most lawyers and scholars say. on the other hand, it was a hard thing to do, and you're right, picking that very conservative organization to publicly break with president trump at least on this question. now, meanwhile, a new york times report says president trump pushed for or seriously considered having the federal government seize voting machines in key states as players were pushing wild conspiracy theories. three departments -- justice, homeland security and defense -- refused to go along. in fact, rudy giuliani assisted a draft executive order for the military to seize machines would be illegal and talked trump out of it. >> he was so bad and so over every red line that giuliani and barr were on the other side of it. >> it's extremely frightening, a president of the united states was considering trying to seize election machines to keep himself in power. it's an unhinged attempt really to burn down democracy. howard: fox hasn't covered this new york times story. jason, my question to you, shouldn't media conservatives -- even if they like and support donald trump -- be concerned about a newspaper story that depicts in great detail these efforts, which the president was either apprised or in some cases pushing, to go out and have the federal government seize voting machines after an election? >> the bottom line is that they didn't. and this is the problem, is that for five years really now they have published story after story after story about donald trump that has not turned out to be true. so it would be one thing if he actually did it, but he didn't actually do it. so for the president to have counsel with all these different organizations, if that's indeed true and i don't know that a it is, that's just part of the discourse of a president probing and figuring out what can we do, what should we not do and then ultimately making the right decision. this never happened, so i think it's a terribly inappropriate story to give it the kind of coverage and attention for something that actually didn't end up happening. howard: well, there's no disputing, obviously, in the end it did not happen, liz, and cnn and msnbc have gone nuclear over the story, but do you think it is newsworthy and important to have an account about these three different departments, the debates about whether to seize voting machine, some of the fringe characters that were pushing these wild conspiracy theories, is that important journalism in your view or not? >> what's the evidence? if okay, if there is evidence that is revealed about this draft executive order and there are phone calls that have been taped about deciding and discussing this kind of thing, it's a legitimate news story. however, you know, you have to be really careful here. there are all kinds of stories floating around, but there's already audiotape in the cath lis berger -- rath raffensperger case in georgia of president trump saying i need you to find 11,780 votes and afterrens berger was pushing back and saying we've already done audits. you're looking at a pile-on effect here that perhaps could be used in one of these legal cases against the president. howard: well, i would agree that a lot of people are sick of being bombarded with the january 6th stories, some of them of much less performance. at the same time, i think this is in a different category. great discussion, glenn -- excuse me, looking at the prompter here, liz, jason chaffetz, have a great sunday. and ahead, why those protests aren't dying down, but up next, a racially-charged covers the white house for fox news. kevin, does it seem a bit strange that this whole media debate about the fairness of biden saying he'd only consider a black woman for the supreme court when we don't even have a nominee? >> it's tough of to understand because at the end of the day, he may have the best intentions to have someone of a particular sliver of the american population -- 7%, if you want to know the real number. but the truth is, we don't know who this person is going to be, what her qualifications are going to be like if, indeed, it is an african-american bottom but i think the debate really underscores the change, i think, in the way the press covers the story. for us it's like catnip. history, we want to be there to write the first rough draft of history, but we don't have all the facts yet. howard: you turn on the tv and ronald reagan promised the first woman to the high court in sandra day cononner -- o'conner and conservatives saying, well, he's gym -- discriminating. it's two different conversations. >> it's the difference in where we are as a nation. if this were 5-10 years ago, it would have been, oh, i'll celebrate it. we're looking for more equality and opportunity, not necessarily equity and outcome. howard: yeah. it's obviously perfectly fair to look at somebody's qualifications and judicial philosophy and easier to do that when biden actually tells us who it is. as you know, the president up in new york this week with mayor eric adams, and they talked about crime. the president has not been able to pass legislation either on police reform or guns. but is it fair for some in the media to blame the national crime wave on bide when it's mayors and local police and prosecutors, many of them democrats in the case of the mayors, who are really on the front lines? >> it's really about what the defendant a.s will do -- d.a.s. that's really where this is. it's not necessarily the mayor or even the cops on the beat but, again, going back to an old playbook. the president wants to talk about ghost guns and getting guns off the street, but the real point for the american people right now, howie, is what can we do to stop people being shoved in front of oncoming trains and being mugged in the streets and these roving bands of shoplifters. that's the messaging that i think the white house should have gotten out there, and the coverage, i think, reflected frustration in not talking about that. howard: but is there -- look, you cover the white house. we are always focused on what the president is doing. and when it comes to something like covid or the economy, rightly so. i just think that biden, who actually was criticized on the 1994 crime bill for being too hard. , i don't think any president can single handedly stop something that is fought at the state and local level. >> and that's the real challenge because they know this, you and i know that but, exactly, it's all about what you can convince the american people. and in this particular circumstance, i think they had a very difficult hill to climb. i'm not so sure it gets better before it gets tougher for them. howard: yeah. biden we don't know. but this has been rumored for a long, long time, and for it to somehow stop below the c suite, to me, is very unusual. howard: that's a salient offense vegas -- observation. some of the top stars met in washington with jason clark, and he's hat a strained relationship with jeff duke orer. they defunded him saying the punishment doesn't fit the crime, so is it cause for termination if you hide a consensual relationship from your bosses? some are also saying why didn't allison gollust also lose her job? >> i guess it's because zucker was in the position of power. she was a direct report to him, so it was incumbent upon him to report it. you know, you get into an area here where are certain things forgiven, or do you have to hold the line on them. i would assume, and i don't know for sure, but i would assume the reason why the relationship was not disclosed was because you couldn't have a relationship with somebody who's a direct report. that just wouldn't fly. although at cbs les moonves a had a longtime affair with julie chen, the two of them eventually got married -- howard: lots of exceptions. some cnn inside are saying this is chris cuomo's revenge for being fired and, we should mention, allison gollust previously worked for andrew cuomo. he's being called a bad guy by at least one anchor, his lawyers did arrange some legal maneuvering and raised the question about, well, if zucker's going to fire cuomo for his conflict of interest, what about his own conflict of interest? so a lot of finger pointing going on, but clearly, this came out of cnn's own cuomo probe. >> i may not know everything about this, but it seems that the conflict of interests are different. if chris cuomo is helping his brother who was the governor of the state, a politician, try to weave his way through allegations of sexual impropriety and sexual harassment -- howard: which ultimately led to his resignation -- >> one thing if he had a nondisclosed sexual relationship with somebody whom you worked may with a different thing. i could see that there would be upset at cnn by people who liked jeff zucker, who were very loyal to him who see him shown the door because of this and might think that the treatment was harsh. howard: and there's no question he was shown door. the -- >> the problem is going to be, howie, once the relationship became officially disclosed, again, it's been an open secret for a long, long time, then something's got to happen. who goes, dicker or gollust? the two of them couldn't continue to work in the same parameters, but it's not like you have somebody who is on a show over here who has a relationship with another person on the show and that person could be transferred to another show regardless of where she was moved, she would always be a direct report to him. howard: yeah. she was an executive vice president. i was reading katie couric's book, and i just stopped when i got to the page when she talked about how jeff zucker pushed very hard to hire allison gollust. quote, she and her kids moved into the apartment right above jeff and his wife. that was back in 2012. >> yeah. you know, it -- again, there is a lot of rumors swirling around that this had been going on for a long, long time. the fact that they were living in the same apartment building -- [laughter] one floor above or below the other kind of is an indication that they wanted to be close to each other. howard: new york media is a very small world. cnn has always marketed itself as the straight news many network when you and i were there. and then zucker, who many people credit or blame with making donald trump a national figure because he created the apprentice when he ran nbc, drastically changed the network. was it a mistake? >> cnn had a problem, and that was the people would use it as a utility. when there was breaking news, cnn's ratings would go through the roof, then when it was over, they would go back down again. cnn spent millions of dollars on studies and audience surveys trying to find out how do we maintain that audience that we get when we have breaking news. and stop it from going away. well, the thing that they found to do it was donald trump. howard: donald trump. >> once he was elected, cnn's ratings went up, and jeff zucker got them to stay there and go even higher by deciding that cnn was going to be the foil to donald trump. and i remember thinking at the time -- because i know the way that the place works, i know the dna of the place -- they had better be careful how hard they try to kill donald trump because the only reason their ratings are as high as they are is because of donald trump. and now that trump is a year out of office, we've seen ratings have crashed back through the floor. howard: becoming identified as a left-leaning anti-trump network. very happy to see jeff go, called him a sleaze bag. but now they're launching a streaming service, the takeover by discovery hasn't happened, and suddenly zucker is gone. tough spot for cnn right now. >> but again, cnn has managed to pull off some ratings, although they've all but disappeared now, for the very fact that they were the foil to donald trump. if they move in a straight news direction, probably be right back where they were when i worked there. you get the peaks and valleys of breaking news and then no breaking news. howard: john roberts, thanks very much. >> i don't think it'll be any one of those three people, and i would bet it's going to be a woman. howard: you have it on tape. >> we'll see. thanks, howie. howard: after the break, joe rogan under fire from the pundits again after apologizing for his past use of the n-word. glenn greenwald weighs in next. ♪ ♪ ex. we still have 12 hours to australia. mucinex lasts 12 hours, so i'm good. now move! kim, no! mucinex lasts 3x longer for 12 hours. we just moved. so there's millions of - dahlias in bloom. over nine acres. when we started, we grew a quarter of an acre. now i'm taking on new projects on the regular. we always dreamed of having this property, so - i want to make my yard look as beautiful as butters, here. butters. how are you doing over there? >> i think it's the same reason why they're so obsessed with fox news, sort of the one place that has always existed in the large media ecosystem that deviates from what the rest of the media is typically saying, like why can't you just have one place where people are questioning your orthodoxieses. and it's because the ability to control information is an incredibly powerful instrument that everyone who tries to obtain it wants to safe guard. and so what you see with rogan is he's built an enormous audience, bigger than essentially everybody on television, an audience that's young and ideologically diverse, and he does veer from the if pieties that they're attempting to implant. and they're looking to censorship as one of the ways to maintain this stranglehold on our discourse. howard: joe rogan clearly isn't part of the club, you know? he gets these ratings by talking for three hours a day to a wide variety of people. does that draw resentment from many in the mainstream media who can only dream of putting up such numbers? >> i mean, obvious it does. there's a sense that certain kinds of people deserve to have platforms and other kinds don't, and i think there's a big class and cultural component to this entire resentment. he's the kind of guy who likes wrestling, mma fighting and hunting. he just doesn't look like the sort of east coast journalististic professional we're used to seeing in tv studio. i think that's part of it. and the other part of it is, you know, this idea that they do all the right things, they went to the right schools, they're doing journalism right, why is this interloper allowed to have such a large audience. i felt that myself, howie, you know, over the years being kind of with always one foot in independent media, why does he get this huge national security report, and i've done everything right. there's a huge component of kind of resentment on the part of this insular class in liberal enclaves that nobody else is entitled to have influence. howard: right. now yesterday roh began apologized again with an instagram video after clips circulated of singer india arie of him repeatedly in the past using the n-word. here's what rogan had to say. >> i'm making this video to talk about most regretful and shameful thing that i've ever had to talk about publicly. it's all smooshed together, and it looks horrible even to me. howard: now, rogan says these were out of context, they were often discussions about whether comedians could use the n-word as part of their act. looks awful, but he himself admits that. >> yeah. i mean, you could find videos of lots of people over the years using the n-word in different contexts. joe biden did when he was in the senate, howard stern has used it more times than you could possibly count, the young turks, the popular show, there was a clip of them using it. i think one of the myths is one of the things people complain about with corporate media and the reason they no longer trust them is because they think when they get things wrong -- which, of course, we're all going to da willingness to apologize and admit error. one of the things joe proban does -- joe rogan does so often, he goes right away in a very flinching way, he says i screwed up, he apologizes to his audience. it seems that he's being pressured to, but no one can pressure joe rogan to do anything. he has this gigantic contract. he would have no trouble going anywhere else and getting a similar contract given the size of his audience. he has this humility which is a big part of why so many people trust him that i think a lot of people in journalism could actually learn from. howard: yeah. he's called himself an f-ing moron on occasion, he's not shy about doing that. now, the ceo of spotify, to his credit, says we have to have a diverse set of voices now that it has all these podcasts, but he's also said there are many things that joe rogan says that i find offensive. so you have neil young, crosby stills and nash, joni if mitchell basisically saying they want rogan kicked off spotify. why hasn't there been more pushback from at least some in the press that, you know, this amounts to crushing others' views as opposed to trying to push him into being more responsible? >> if you look at the media coverage, it's one of the biggest stories in the world today, and yet certain media outlets have not even covered it. howard: the study of studies says lockdowns defined as one compulsory restriction have had little to no public health effects but huge social and economic costs reducing deaths by only 0.2. that rose to 10.6% reduction when bars and other nonessential outlets were closed. the study, which hasn't been peer-reviewed, is taking some flak. steve hanky is a cato institute fellow and one-time adviser to president biden saying among other things the focus on death rate ignores other lockdown benefits such as reduced hospitalizations. still, shouldn't our major newspapers and networks be joining a national conversation even if they want to criticize the study? that prompted zucker to fire chris cuomo and the state investigation of his brother, andrew cuomo, allison gollust worked earlier for the then-governor. zucker found cuomo if improperrerly aided his embattled brother. he didn't try to get zucker fired, but his lawyers took some steps as a warning shot in the negotiations to have cnn pay off cuomo's contract. as this source put it, chris dropped the knife that was used by zucker's enemies. the cuomo camp want to contend that zucker dumped his biggest star for a conflict of interest, but with jeff gone, that argument evaporates as a way of cuomo collecting his remaining $18 million. by the way, msnbc, which loves to attack fox, has not aired a single word on zucker's ouster. nothing to see here. jeff who? that is pretending a friend ask one-time boss w an absolute dereliction of duty. the larger issue is how zucker transformed cnn from there a reporter-driven network to a left-leaning outlet that crusaded against donald trump. now away against joe rogan and spotify. what whoopi goldberg said about a the holocaust was deeply offensive. >> let's be truthful about it because the holocaust isn't about a race. >> no. >> no. it's not mistakes. she apologized for it immediately and took correction action. now -- corrective action. i want the know who is so frail over at abc? >> i just believe in second chances, and i'm pretty confident she's never going to make that same mistake again. yeah, i know, nobody at "the view" would do this for a conservative ever. hell would freeze over. howard: joining us now in utah, jason chaffetz, former republican congressman and fox news contributor. and in new york, liz claman, host of "the claman count countdown" at three eastern on fox business. liz, let's deal with the substance first. she kept repeating that the holocaust wasn't about race, and people -- not just jewish peopl. >> yeah, of course. i mean, but i do believe, howie, that whoopi goldberg's biggest crime was simply showing an extraordinarily major lack of knowledge, basic knowledge if about the roots of the holocaust. clearly, being jewish is a religion. i am jewish. however, it was hitler and the nazis who were adamant, impressing that the jews were erased and, in essence, based their entire final solution as they called it which entailed putting millions of men, women and churn in -- children and ovens and gassing them to death. they based that on nazis being a master race where they had to eliminate jews. the nazis saw jews as a race and, therefore, that is what the holocaust was about. however, whoopi goldberg -- and i'm with joe scarborough and sean hannity on this -- she apologized. she said, i stand corrected. it was a learning moment that she turned into something the next day on her show where they talked about it and, hopefully, educated more people. howard: well, let me -- >> i look at this -- howard: let me come back to this, i want to get to jason, and we'll move on to the question. whoopi admitted that she sees racism as a matter of black and white, and again, you can get into her argument about jewish people and religion isn't a race, but the nazis clearly saw it very differently. >> her comments were ignorant, they were hurtful, they -- i mean, think of of every negative word you can think of, and she repeated them several times when she went on with stephen colbert, i think she made the situation worse. it wasn't until she actually got in front of teleprompter and read something that, you know, she tried to clear it up. i think america though is tired of this cancel culture. i don't think she should be canceled just because she said something that was hurtful and disgusting and everything else. i think sean hannity and the others are absolutely right. but it is the due policety, it is the -- duplicity, it's the hypocrisy that this never happens to conservatives. when roseanne barr and others say something or do something, guess what? they are canceled, they are gone. but with whoopi, i think we need to stand true and say, you know what? the principle's the same. you don't cancel somebody and ruin their career. she's going to have to live with this, but i don't think you take her off the air, and i think the punishment was, i mean, let's talk about that because i don't think that was right either. howard: well, liz, you know, whoopi fully apologized, as you pointed out. and to her credit -- and i don't think she should be canceled. but, you know, abc took a stand, said is, okay, two week suspension. reflect on your comments. and abc's getting criticized for that. why? >> well, because, number one, a two week suspension for somebody saying something that showed ignorance versus outright, you know, horrific sort of mean attitude about something is -- i'm not sure that really does anything for whoopi. whoopi goldberg is not anti-semitic, okay? she's just not understanding --, and that's really sad because a lot of americans do not understand the nature and the roots of the holocaust. abc, you don't know what considerations were being had or what kind of calls that they had. i understand that they felt they had to do something, but we not allowed -- are we not allowed to learn from our mistakes and learn about something that we didn't know beforehand? this is really pushing it, in my opinion. howard: jason, of course whoopi goldberg is not anti-semitic. she chose the name goldberg saying she identifies with the jewish people, but if she had done nothing, wouldn't abc say the network's condoning this kind of language that is completely, flatly wrong? >> yeah. i viewed it as abc sent her on a two week vacation, and maybe she's learning something from it. if i hope she is. but you're right, karen johnson, aka whoopi goldberg, i don't know. i mean, there are a lot of people, if you're looking to whoopi goldberg for your political news and information and perspective, i don't know that that's necessarily where you get it, but i guess some people do that. look, i hope everybody learn ares about this. i like what my colleague, former colleague trey gowdy said. if you're out there talking and trying to compare something to the holocaust, to slavery or for a man trying to, you know, say something about what it's like to be pregnant, then you're probably going off the rails and making more trouble for yourself. howard: never ends well. but i would say that "the view" is an in -- influential show. i've interviewed her, she's likable, and i think that's one of the reasons people are being very generous with her. let me switch to donald trump, january 6th and his comments which got a lot of attention in the media about how he would consider pardons for the january 6th defendants. that was criticized as inappropriate by a guy who had been his closest ally in the senate, lindsey graham, and here's the former president hitting back on newsmax. >> yes, i would absolutely give them a pardon. lindsey graham's wrong. he's a nice guy, but he's a rino. with the exception of one young, fine woman, nobody died on january 6th. howard: liz, why has this question of pardons if trump is in the white house again in 2025, struck such a nerve in the press? >> well, you know, the republicans are known as the party of law and order. if somebody breaks the law, then they should be punished. so an outright pardon would certainly diminish or vaporize any kind of responsibility for what happened and all the video evidence that's out there for january 6th. and, howie, if lindsey graham is a rino, then ronald reagan is too. i mean, republicans are the party -- at least they have stood upon -- for law and order, and they believe that if you attack a cop, you attack multiple cops, that you should pay for that crime. howard: jason, i ask you as a former republican house member, the rnc, as you know, meeting out in utah where you are, passed this resolution against two pretty prominent dissidents now, liz cheney and adam kinzinger, for serving on the january 6th committee using the language they engaged in the persecution of odder their citizens engaged -- ordinary citizens engaged in political discourse. the president has depicted this as being intolerant by the rnc. fair or unfair? >> i think it's a bit unfair. i think republicans are very concerned that nancy pelosi set the precedent of being able to unilaterally choose who's on that committee. i think it undermined any credibility that it had. i think it's an absolute farce. the minority if should be able to pick -- in this case, kevin mccarthy -- should be able to pick and select who is actually serving on the committee. for them to hand pick the two people that have obviously already made up their minds about the conclusion of this and is already have made decisions about this is a joke. and i don't think that those two people, adam kinzinger and liz cheney, of which i both know and i've been very friendly with in the past, but i've got to tell you, i think they should have stood tall and said, no, that's not the way america works. the minority gets a voice, and they get to select who gets to be on this committee too. and if you're going to go along with this cha railed, then you should not be in the republican party. howard: so you're perfectly comfortable with the rnc saying they shouldn't be part of the gop. >> absolutely. i think they should be dismissed from the -- i just think they are not caucusing with the republican party. and republicans get to choose who serves on that committee, not nancy pelosi and nancy pelosi alone. howard: all right. just briefly, liz, this phrase whether they're engaged in legitimate political discourse referring to what happened on january 6th, hundreds and hundreds of people have been charged, that is getting huge attention from the media. >> yes. but, howie, it should get huge attention from republicans whether they are far right or centrist when a national political party like republicans define all the attacks that we saw with hockey sticks and tasers and all kinds of weapons including, you know, the american flag pole being used as a spear. when they define that as legitimate political discourse, i can pretty much if guarantee you they've got bigger problems than liz cheney and adam kinzinger. they are going to be watching ae midterm elections than we were january 6th. that was pointed out by the daily caller, a conservative site, who made that connection. but, howie, i would only say every democrat rival is going to be using that video and then that legitimate political discourse in those ads is going to be a problem -- howard: that's why we have campaigns. ahead, john roberts on the ouster of cnn's jeff zucker, but when we words. >> i heard this week that president trump said i had the right to overturn the election. president trump is wrong. howard: jason cough fetes, mike pence explicitly pushing back against trump's strongest words to date saying the vice president had the power to, quote, overturn the election. the media's reaction was, wow, that's great. trump -- pence finally spoke up after years of being loyal ask good for him. your thoughts. >> the role of the united states congress, the role of of the senate president, which is the vice president, is to simply count the votes that are presented to the congress when certified by the states based on the popular vote within those states. looking forward, for instance, kamala harris at this next election, she'd be the president of the senate, she doesn't have discretion to just pick a unilateral decision as to whether or not what the states sent were valid. what they get to decide is, is the count right. that's all they do. they simply are vote counters. howard: but, liz, this obviously was a decision by the former vice president to speak those words knowing how popular donald trump remains with the party. and some pundits are saying, well, is it just pence defending his actions on january 6th, or is he laying the groundwork for a possible white house run in 2024. >> could be a little bit of both, howie. take note of where he said this, the federalist society, a strict constitutionalist and very, very conservative republican people as part of the federalist society. i'm with jason. i think that people on both sides of the aisle if they're looking at the electoral count act of 1887 will say the vice president does not have unilateral power to deem who won an election or to overturn the election based on outlying situations. but donald trump was a little clever when he did argue that because there are constitutional scholars who believe that that act of 887 is flawed -- 1887 -- they talk about reform, but none of the reforms would change what jason outlined, and that is that the vice president simply is there to count the votes. howard: well, i totally agree that he didn't have the power. that's what mike pence concluded and what most lawyers and scholars say. on the other hand, it was a hard thing to do, and you're right, picking that very conservative organization to publicly break with president trump at least on this question. now, meanwhile, a new york times report says president trump pushed for or seriously considered having the federal government seize voting machines in key states as players were pushing wild conspiracy theories. three departments -- justice, homeland security and defense -- refused to go along. in fact, rudy giuliani assisted a draft executive order for the military to seize machines would be illegal and talked trump out of it. >> he was so bad and so over every red line that giuliani and barr were on the other side of it. >> it's extremely frightening, a president of the united states was considering trying to seize election machines to keep himself in power. it's an unhinged attempt really to burn down democracy. howard: fox hasn't covered this new york times story. jason, my question to you, shouldn't media conservatives -- even if they like and support donald trump -- be concerned about a newspaper story that depicts in great detail these efforts, which the president was either apprised or in some cases pushing, to go out and have the federal government seize voting machines after an election? >> the bottom line is that they didn't. and this is the problem, is that for five years really now they have published story after story after story about donald trump that has not turned out to be true. so it would be one thing if he actually did it, but he didn't actually do it. so for the president to have counsel with all these different organizations, if that's indeed true and i don't know that a it is, that's just part of the discourse of a president probing and figuring out what can we do, what should we not do and then ultimately making the right decision. this never happened, so i think it's a terribly inappropriate story to give it the kind of coverage and attention for something that actually didn't end up happening. howard: well, there's no disputing, obviously, in the end it did not happen, liz, and cnn and msnbc have gone nuclear over the story, but do you think it is newsworthy and important to have an account about these three different departments, the debates about whether to seize voting machine, some of the fringe characters that were pushing these wild conspiracy theories, is that important journalism in your view or not? >> what's the evidence? if okay, if there is evidence that is revealed about this draft executive order and there are phone calls that have been taped about deciding and discussing this kind of thing, it's a legitimate news story. however, you know, you have to be really careful here. there are all kinds of stories floating around, but there's already audiotape in the cath lis berger -- rath raffensperger case in georgia of president trump saying i need you to find 11,780 votes and afterrens berger was pushing back and saying we've already done audits. you're looking at a pile-on effect here that perhaps could be used in one of these legal cases against the president. howard: well, i would agree that a lot of people are sick of being bombarded with the january 6th stories, some of them of much less performance. at the same time, i think this is in a different category. great discussion, glenn -- excuse me, looking at the prompter here, liz, jason chaffetz, have a great sunday. and ahead, why those protests aren't dying down, but up next, a racially-charged covers the white house for fox news. kevin, does it seem a bit strange that this whole media debate about the fairness of biden saying he'd only consider a black woman for the supreme court when we don't even have a nominee? >> it's tough of to understand because at the end of the day, he may have the best intentions to have someone of a particular sliver of the american population -- 7%, if you want to know the real number. but the truth is, we don't know who this person is going to be, what her qualifications are going to be like if, indeed, it is an african-american bottom but i think the debate really underscores the change, i think, in the way the press covers the story. for us it's like catnip. history, we want to be there to write the first rough draft of history, but we don't have all the facts yet. howard: you turn on the tv and ronald reagan promised the first woman to the high court in sandra day cononner -- o'conner and conservatives saying, well, he's gym -- discriminating. it's two different conversations. >> it's the difference in where we are as a nation. if this were 5-10 years ago, it would have been, oh, i'll celebrate it. we're looking for more equality and opportunity, not necessarily equity and outcome. howard: yeah. it's obviously perfectly fair to look at somebody's qualifications and judicial philosophy and easier to do that when biden actually tells us who it is. as you know, the president up in new york this week with mayor eric adams, and they talked about crime. the president has not been able to pass legislation either on police reform or guns. but is it fair for some in the media to blame the national crime wave on bide when it's mayors and local police and prosecutors, many of them democrats in the case of the mayors, who are really on the front lines? >> it's really about what the defendant a.s will do -- d.a.s. that's really where this is. it's not necessarily the mayor or even the cops on the beat but, again, going back to an old playbook. the president wants to talk about ghost guns and getting guns off the street, but the real point for the american people right now, howie, is what can we do to stop people being shoved in front of oncoming trains and being mugged in the streets and these roving bands of shoplifters. that's the messaging that i think the white house should have gotten out there, and the coverage, i think, reflected frustration in not talking about that. howard: but is there -- look, you cover the white house. we are always focused on what the president is doing. and when it comes to something like covid or the economy, rightly so. i just think that biden, who actually was criticized on the 1994 crime bill for being too hard. , i don't think any president can single handedly stop something that is fought at the state and local level. >> and that's the real challenge because they know this, you and i know that but, exactly, it's all about what you can convince the american people. and in this particular circumstance, i think they had a very difficult hill to climb. i'm not so sure it gets better before it gets tougher for them. howard: yeah. biden we don't know. but this has been rumored for a long, long time, and for it to somehow stop below the c suite, to me, is very unusual. howard: that's a salient offense vegas -- observation. some of the top stars met in washington with jason clark, and he's hat a strained relationship with jeff duke orer. they defunded him saying the punishment doesn't fit the crime, so is it cause for termination if you hide a consensual relationship from your bosses? some are also saying why didn't allison gollust also lose her job? >> i guess it's because zucker was in the position of power. she was a direct report to him, so it was incumbent upon him to report it. you know, you get into an area here where are certain things forgiven, or do you have to hold the line on them. i would assume, and i don't know for sure, but i would assume the reason why the relationship was not disclosed was because you couldn't have a relationship with somebody who's a direct report. that just wouldn't fly. although at cbs les moonves a had a longtime affair with julie chen, the two of them eventually got married -- howard: lots of exceptions. some cnn inside are saying this is chris cuomo's revenge for being fired and, we should mention, allison gollust previously worked for andrew cuomo. he's being called a bad guy by at least one anchor, his lawyers did arrange some legal maneuvering and raised the question about, well, if zucker's going to fire cuomo for his conflict of interest, what about his own conflict of interest? so a lot of finger pointing going on, but clearly, this came out of cnn's own cuomo probe. >> i may not know everything about this, but it seems that the conflict of interests are different. if chris cuomo is helping his brother who was the governor of the state, a politician, try to weave his way through allegations of sexual impropriety and sexual harassment -- howard: which ultimately led to his resignation -- >> one thing if he had a nondisclosed sexual relationship with somebody whom you worked may with a different thing. i could see that there would be upset at cnn by people who liked jeff zucker, who were very loyal to him who see him shown the door because of this and might think that the treatment was harsh. howard: and there's no question he was shown door. the -- >> the problem is going to be, howie, once the relationship became officially disclosed, again, it's been an open secret for a long, long time, then something's got to happen. who goes, dicker or gollust? the two of them couldn't continue to work in the same parameters, but it's not like you have somebody who is on a show over here who has a relationship with another person on the show and that person could be transferred to another show regardless of where she was moved, she would always be a direct report to him. howard: yeah. she was an executive vice president. i was reading katie couric's book, and i just stopped when i got to the page when she talked about how jeff zucker pushed very hard to hire allison gollust. quote, she and her kids moved into the apartment right above jeff and his wife. that was back in 2012. >> yeah. you know, it -- again, there is a lot of rumors swirling around that this had been going on for a long, long time. the fact that they were living in the same apartment building -- [laughter] one floor above or below the other kind of is an indication that they wanted to be close to each other. howard: new york media is a very small world. cnn has always marketed itself as the straight news many network when you and i were there. and then zucker, who many people credit or blame with making donald trump a national figure because he created the apprentice when he ran nbc, drastically changed the network. was it a mistake? >> i think it's the same reason why they're so obsessed with fox news, sort of the one place that has always existed in the large media ecosystem that deviates from what the rest of the media is typically saying, like why can't you just have one place where people are questioning your orthodoxieses. and it's because the ability to control information is an incredibly powerful instrument that everyone who tries to obtain it wants to safe guard. and so what you see with rogan is he's built an enormous audience, bigger than essentially everybody on television, an audience that's young and ideologically diverse, and he does veer from the if pieties that they're attempting to implant. and they're looking to censorship as one of the ways to maintain this stranglehold on our discourse. howard: joe rogan clearly isn't part of the club, you know? he gets these ratings by talking for three hours a day to a wide variety of people. does that draw resentment from many in the mainstream media who can only dream of putting up such numbers? >> i mean, obvious it does. there's a sense that certain kinds of people deserve to have platforms and other kinds don't, and i think there's a big class and cultural component to this entire resentment. he's the kind of guy who likes wrestling, mma fighting and hunting. he just doesn't look like the sort of east coast journalististic professional we're used to seeing in tv studio. i think that's part of it. and the other part of it is, you know, this idea that they do all the right things, they went to the right schools, they're doing journalism right, why is this interloper allowed to have such a large audience. i felt that myself, howie, you know, over the years being kind of with always one foot in independent media, why does he get this huge national security report, and i've done everything right. there's a huge component of kind of resentment on the part of this insular class in liberal enclaves that nobody else is entitled to have influence. howard: right. now yesterday roh began apologized again with an instagram video after clips circulated of singer india arie of him repeatedly in the past using the n-word. here's what rogan had to say. >> i'm making this video to talk about most regretful and shameful thing that i've ever had to talk about publicly. it's all smooshed together, and it looks horrible even to me. howard: now, rogan says these were out of context, they were often discussions about whether comedians could use the n-word as part of their act. looks awful, but he himself admits that. >> yeah. i mean, you could find videos of lots of people over the years using the n-word in different contexts. joe biden did when he was in the senate, howard stern has used it more times than you could possibly count, the young turks, the popular show, there was a clip of them using it. i think one of the myths is one of the things people complain about with corporate media and the reason they no longer trust them is because they think when they get things wrong -- which, of course, we're all going to da willingness to apologize and admit error. one of the things joe proban does -- joe rogan does so often, he goes right away in a very flinching way, he says i screwed up, he apologizes to his audience. it seems that he's being pressured to, but no one can pressure joe rogan to do anything. he has this gigantic contract. he would have no trouble going anywhere else and getting a similar contract given the size of his audience. he has this humility which is a big part of why so many people trust him that i think a lot of people in journalism could actually learn from. howard: yeah. he's called himself an f-ing moron on occasion, he's not shy about doing that. now, the ceo of spotify, to his credit, says we have to have a diverse set of voices now that it has all these podcasts, but he's also said there are many things that joe rogan says that i find offensive. so you have neil young, crosby stills and nash, joni if mitchell basisically saying they want rogan kicked off spotify. why hasn't there been more pushback from at least some in the press that, you know, this amounts to crushing others' views as opposed to trying to push him into being more responsible? >> if you look at the media coverage, it's one of the biggest stories in the world today, and yet certain media outlets have not even covered it. howard: the study of studies says lockdowns defined as one compulsory restriction have had little to no public health effects but huge social and economic costs reducing deaths by only 0.2. that rose to 10.6% reduction when bars and other nonessential outlets were closed. the study, which hasn't been peer-reviewed, is taking some flak. steve hanky is a cato institute fellow and one-time adviser to president biden saying among other things the focus on death rate ignores other lockdown benefits such as reduced hospitalizations. still, shouldn't our major newspapers and networks be joining a national conversation even if they want to criticize the study?
