it's saturday august 12th, you're watching velshi. i'm charles coleman junior filling in for my friend ali velshi. we begin this hour with the latest developments in the fast-moving case of the united states versus donald j trump. there are major developments in the government election interference case against the former president. federal judge tanya chutkan granted the special counsel team request for protective order just yesterday. the protective order seek salute what trump can and cannot disclose about the case, and the trove of evidence that prosecutors are set to turn over to the defense during discovery. now the government requested a protective order that covered all of the discovery materials. but the judge's ruling did not go that far. it does stop trump from publicly sharing quote, material that the government doesn't, designates has sensitive. and quote. this would include things like personal information of possible witnesses, recordings, and transcripts of testimony. the defense argued that a protective order would infringe on trump's first amendment rights. but chutkan noted quote, mr. trump, like every american, has the first amendment right to free speech, but that right is not absolute. later in the hearing, she added quote, if that means that he can't say exactly what he wants to say about people who may be witnesses in this case, that's how it's going to have to be. and quote. seems straightforward to me. it was the first time both sides met in the courtroom with chutkan, the federal judge assigned to oversee this case. the next time they meet will be in a few weeks, august 28th, to discuss the actual trial date. the special counsel's team has propose starting that trial on january 2nd 2024, which is a sign of how fast they want to move the case along. now even though the defense has yet to respond, if we can clean anything from the other federal criminal case that donald trump is facing, they are likely to push for a much later date, so they can delay this as much as possible. for more on this, i'm now joined by nbc news senior national political politics reporter, jonathan allen. jonathan, so great to talk to you today. listen, donald trump has been framing this protective order as such an infringement on his free speech rights, not being able to save what he's able to constitutionally under the law. how has he been talking about this on the campaign trail? is it actually resignation with voters? >> good morning charles. i was in new hampshire earlier this week. donald trump up and wyndham talking to a high school gym full of supporters. talking about his first amendment rights being infringed, potentially being infringed. he's anticipating what we just saw. a couple things about that, number one, his team did not object to the idea of a protective order. they knew that would've been futile. they simply asked for a different one. the fact that even his defense team believes that his free speech should be unfettered in this case was, you know, sort of rendered moot by the fact that they filed their own protective order. people who listen to him believed that his, they believe his first amendment rights, his big supporters, they believe the first amendment rights are being infringed. more importantly, i'm not even sure they care about the sort of technical nature of it. they're behind him one way or the other. i think what the judge said, the first amendment right is not absolute seems pretty clear. you're not allowed to surefire, shout fire in a crowded theater. i think the supreme court justice once said that. you're not allowed to intimidate witnesses. donald trump has a history of trying to pressure people with his public commentary, and ends up being charge right now at least in the documents case, you know, with regard to the possibility of the obstructed investigation that he put undue pressure on people to try and destroy evidence. so it's not like the judge pulled this out of thin air. >> fascinating to me that even as his attorneys in court try to argue for a different version of the protective order, the public narrative from donald trump is that he's against it entirely. and this is infringing upon his first amendment rights. i want to turn for a moment to georgia. we know that donald trump has been criminally indicted three times, twice on the federal level. and a fourth indictment seems like it's coming in georgia very soon. whatever that means. the term has been flown around, along with a minute, which is my favorite. has this had any effect on the republican primary field at all? is it penetrating? is it breaking through? >> there's a certain number of republicans who are uncomfortable with donald trump, period. there's a certain number who are uncomfortable with the idea of him being nominated out at a time where he's under indictment, or could even be convicted. and then there's a large group of republicans why there love trump no matter what, or are concerned that republicans could lose the presidency so much that they vote for him anyway. -- i was talking about all stripes. i think what we know from the polling, what i know anecdotally from talking to voters is these indictments have created a rally around the flag effect for donald trump. his numbers have gone up. you've seen ron desantis, the florida governor, of course stumbling under his own weight. but also sort of dropping into more distances. so trump is in good shape. >> nbc's john allen. thank you so much. >> thank you charles. >> joining me now is former federal prosecutor, my friend and colleague, msnbc legal analyst, paul butler. he is a professor at georgetown school of law. and the author of the book chokehold, policing blackmon. also with us is danny so fall, is another one of my treasured colleagues. he's a criminal defense attorney, cofounder of snowfall is -- also an msnbc legal analyst. super excited to talk to two of my favorite lawyers. let's get right into it. paul. the defense invoked this first amendment argument as part of its strategy yesterday. but that is not with this case is actually about. tell our viewers how the protective order actually is going to help ensure a fair trial going forward? >> so you're right charles. this case isn't about what donald trump said, it's about what he did. the judge is a former federal, actually state prosecutor. a state public defender. she was very fair to donald trump, like she is to every defendant. but she made it clear that she is not going to put up with this typical stuff. so she went along with this protective order, and at the defense request from donald trump. that if he restricted to sensitive materials. but then she imposed are really raw definition of what's included in that category of sensitive materials. so charles, most of the 11 million pages of evidence that the trump team is going to get, trump will only be able to look at under adult supervision. >> danny, to paul's point, it's clear for anyone who's paying attention that judge chutkan is doing as good a job as possible in terms of balancing the interest of both parties, and not making it apparent one way or another that she is trying to point to either side. this is a fairly routine order, in terms of it being a protective order. the three of us have seen this over, and over again. what we haven't seen before is the unprecedented nature of this case. and how it came up during yesterday's hearing. how do you think trump's presidential campaign could complicate how judge chutkan has to go about crafting rulings in this case going forward? >> the bottom line is this. they simply cannot forecast all the different ways that donald trump might use the information that's given to him through discovery, and put it, out either on social media, or in rallies, or even on the debate stage. that was always the challenge. it was uncontroversial that there was going to be a protective order. it wasn't controversial, just as you pointed out charles, the reality was, even his own defense team acknowledge that there would be a protective order. and they submitted a protective order that included things like, no, we agreed, he doesn't get actual copies. we show him things. but the parties, the government, and the defense couldn't agree on the contents of the protective order. that too by the way is both common, and non controversial. when that happens, the judge source it out. that's exactly what she did. and guess what, -- split the difference, because she can't give the government everything she wanted. they wanted a lot more to be classified as sensitive stuff. the judge essentially said, will you don't get everything that sensitive. i define sensitive. and of course, the defense didn't get everything it wanted either. but the problem still exists that nobody, not the judge, not the defense team, not the government knows the infinite number of ways that donald trump may use this information. and of course, the first amendment is not a non issue. it does have to be balanced against the idea that political speech is arguably more cherished than all other speech. so everyone acknowledges, including the judge, the trump needs to be able to go out there and talk about his case. the problem is, nobody knows exactly how he's going to do it. but trust me, the government will be watching like a hawk. if they think he's violating, or if they think he's threatening a witness, they think, he will be the first to go before the judge and bring it to our attention. >> danny, paul and i are both former prosecutors, i want to ask you as a criminal defense attorney sitting with us, if you are donald trump's defense attorney, how concerned are you that while you are in court, trying to deal with the contours of a protective order, your client is on the outside talking about his first amendment rights, what he wants to say, and apparently trying to make it appear that if he wants to vocalize things, where he's going after his opponents, political enemies, or things -- witnesses in the case, that he's gonna continue to do it. how concerned are you about that? >> if you'd asked me that question in 2016, i would've told you, criminal defense attorney's clients never help themselves when they go out and speak publicly about their case. strangely for some reason, i can't fathom a lot of criminal defendants feeling like if they themselves are on a podium somewhere, get on social media, will be able to help their case. that's virtually never true. they should never speak openly about their case. if you have asked me that in 2016, i might've said something like a criminal defense attorney has to put his or her foot, down and see if a clients going out there to talk, then they need to withdrawal. but it's 2023. trump has had probably 1000 lawyer since then. every one of them knows that donald trump is going to say and do what he wants, no matter what you advise him. so now, being donald trump's attorney is out of the norm, in that york sent, essentially acknowledging that you're gonna do your best. but you probably don't even bother this point to have the top with the client. the top being, don't get on social media, don't make phone calls from the prism, they're all recorded, i don't know why, you to both know, that the defendants never get. that they keep making phone calls from the prison, for all recorded, and used against them. but this is, you know, if there's a new paradox. if your trump's attorney, don't even bother having to talk with him about not speaking. he's going to speak. and you do, i think his lawyers did a good job here. they recognize that, they did it their duty. they tried to -- knowing that doing so now might head off problems later. now, paul, to danny's point trump has not only threatened that he is going to continue to speak, he is actually done it. he continues to attack people connected to this case. he has called jack smith deranged. he said mike pence, impossible witness in this trial, is delusional. it was already warned about this during an arraignment. are we bordering on something along the lines of witness intimidation? time of the haina which has been turned ruined by the wildfires. -- what is the latest that you can tell us on the search and rescue efforts -- >> this rogue law goes into lahaina disrobe lockwood set up overnight this low that people back in. the robotic was lifted yesterday. this vote stop and a few hours, when that happens the people will go back into the town. for many cases, see the ruins of their homes and their neighborhoods. as you mentioned, tens of thousands of people displaced living in their cars. some living in their cars right next to me. for hours looking to get back into me. others trying to get off of this island. they will return to find not a whole lot. that is the unfortunate thing. search and rescue crews have been working day and night. there is an unofficial list of missing. it is growing. it may be beyond 1000 people they have not been in communication with their families or agencies to know where they are. it does not mean they are among the dead. it does not mean that they are lost. . but it is now more likely as people are moving on. there are more reports about the fact that they have not been able to search the interior of the buildings you are seeing on screen. the devastation you're seeing on screen. because of that, that is the reason why the death toll is expected to sow precipitately rise. exponentially. rise we do not know where we could end up over the next 24, 40, a 72 hours. it is a process that is now including more cadaver dogs and recovery efforts than it first did. that is where we are with this. meanwhile, you see some trucks rolling up behind me as a start to open up this roadblock, there will be an investigation with the state attorney general looking into how this was handled for the emergency management standpoint. the state has admitted that they did not sound the alarm. the sophisticated sirens set up all over the state and all over this island did not sound in time to let people know that this was happening. there were alerts that went out by text, tv, and radio. the power was down well before that happened, leaving residents to wonder why that system did not kick in. that will be part of the a federal society judge. already, with just a week on the job, bannon has stopped the offices diversity programs, the programs which were intended to provide intervention for certain nonviolent offenders. this is not the first time the desantis has yielded his executive power over local government to suspend a democratically appointed official. last year prosecutor andrew warren was suspended in a similar fashion because warren pledged not to prosecute people who were seeking abortion care this is the latest in a long list in similar actions that desantis is taking to issue more and more control over the state of florida this laundry list includes going to war with disney whitewashing history lessons, eliminating diversity programs and public schools. signing a slate of extreme anti lgbtq bills. quietly signing a very restrictive abortion bill into law to enemy now is the honorable monique worrell the florida attorney suspended by governor ron desantis earlier this week thank you so much for being here now that these diversion programs have been canceled, they were central to your policy platform as a when -- you are campaigning, when you are running for office. what does that do for the people who are in these programs? these programs are suddenly ended in these folks have nowhere to go? >> thank you for having me. yes, this is going to harm our community. the policies that we implemented surrounding diversion are based in research. i spent 16 years as a professor at the university of florida college of law. there i was the director of the criminal justice center. there was a lot of research that goes into the fact that diverting nonviolent people out of the criminal legal system build stronger, safer, communities. what we did with my first two and a half years in offices we expanded diversion programs so we could make it easier for people who just needed a little redirection to be able to get that without having their entire lives ruined by a criminal legal system that is unfair given. one, that once you have been in it, and there is a mugshot circling a view, it makes it difficult for you if not impossible for you define education, employment, and to see the light. our diversion program with central to public safety in our community. >> monique, as a former prosecutor i can tell you that so much about our conversations about crime and punishment are not data driven. the fact that you are talking about research being the impetus for why you divide these things are the candidate is so critically important. i do want to say that i feel like so much of the conversation is not only about desantis's action with respect to you but also the disenfranchisement of an entire block of black and brown voters. let's really run this down here. you won your election, overwhelmingly, with about 66% of the vote. of the jurisdiction that you were in charge of, about 60% of those voters are either black, latino, or people of color. when desantis makes this decision to suspend you because your politics don't align, in the, effectively, invalidating the votes of those who chose you to represent them as their prosecutor? >> it is another one of desantis's many forms of voter suppression in the state of florida. in addition to gerrymandering court districts and the voting districts as well as and forcing regulations against the individuals who are formerly incarcerated who recently gained their rights to vote under amendment for. desantis then enacted election police went out arresting people. this was in an effort to scare people out of voting if they were unsure what their status was even though the supervisor of elections had confirmed their ability to vote. this is just the multitude of ways he's using to suppress the voters of blue counties in the state voted that did not support him in the elections. yes, those counties include a lot of black and brown voters. >> now, money, gallon ask you question it a lot of people maybe would not. we know that desantis doesn't have the greatest record when it comes to race. you are the only black woman who was a local prosecutor in florida. you were removed by desantis. you were replaced by a conservative judge who also happens to be a black man who ran against you and who you defeated. do you believe, that some level, that desantis is summing his nose and playing in terms of who we treasure a place you so that he doesn't have to have the argument of a racist being applied to him with respect to this move? a 2015 traffic stop. the a.i. facial recognition search wrongfully identified woodruff as a defender she spent eight hours in jail detain for something she did not do you. after being released on a 100,000 dollar personal bond woodruff went straight to the hospital at the time she was dehydrated with a low heart rate and forced in the early contractions from all the stress of this ordeal. now, she has filed a lawsuit against the detective responsible for negligence in processing that a.i. facial recognition tool. this incident highlights a pattern of racial bias in our justice system and an antique naje. if you years ago a series of studies show just how unjust a.i. recognition is. the 2019 federal study found that asian blind people were up to 100 times more likely to be misidentified by facial recognition tools than white people. middle aged white man and were identified correctly with the highest rates of accuracy. no surprise there. black and indigenous women were identified with the lowest degrees of accuracy by a long shot. also not a surprise. these implications are serious. our justice system is already known to be heavily biased against both black and brown people. with artificial intelligence becoming more and more common in different aspects of modern life, from policing, to medicine, to hiring processes. these prejudices that existed society being programed into algorithms that will be relied on more and more every day, this is all cause for concern. joining me now is ben collins, senior reporter for nbc news. and doctor joy weenie. founder of the algorithmic justice lead. say that three times fast. author of the upcoming book, unmasking a.i.. my mission to protect what is human in a world of machines. coming out this fall. she closely studied the link between racial and gender bias in a.i.. joy, i want to start with you. there is a recent article and bloomberg business that dives into how and why a.i. bias is actually worse in more skewed than what exists in human bias already in society. that study is based on your work and your time at m.i.t.. can you just talk about why a.i. bias is actually worse than the bias we are to have as humans? >> absolutely. thank you so much for having me and highlighting the work of the algorithmic justice lead. we are looking at a.i. systems. we continue to see amplify racial bias, amplify racial binds, and also the gender bias we are seeing with black women indigenous women and as you spoke to before part of the reason and i amplifies this biases it perpetuates the bias that has already been seen so if it is more likely that a woman has been a misidentified or not as well represented in a particular data set, then the a.i. is going to make that even worse. what we are seeing is a combination of algorithmic bias. the a.i. systems work differently on different faces. also, confirmation bias. here we have a feedback loop where somebody is seeing a black person being labeled a suspect. it is than being given an indication that confirms that bias as well. >> this story of porsche woodruff in detroit, that experience a wrongful arrest. it exemplifies some of the real dangers that and poses. this has implications in policing, the justice system, health care, our medical system, and more. can you talk about what can happen with these types of tools when they are unreliable and racially biased? >> i think a good quote here it's from julius caesar, the fault is not in the start but in ourselves. we program these programs with our own biases. that is what is at issue here. we have developed a new technology that exemplifies and extrapolate that buys into technology to make it seem like objective facts. not quite chatgpt spinning out answers at a wrong but feel very ray. it is happening on this level with average recognition. they will get back numbers and say it might be 78% who it is. that is a be, sometimes, right? in class. but you are misidentifying a person. a b is not good enough. you need to be 100%. what we have seen recently is cops police forces of america and also the military of america leaning into a eye practices for things like the border wall. there's something called -- from the border who started oculus, nothing you put on your face for facebook. he is now in a.i. border security stuff. there is a massive complex around. this it is simply not there yet. it is taking in all the vices, the human biases that feed into these algorithms and are making them even worse. >> there is also the danger that there is a bias that will exist in the criminal justice system towards these types of identifications. and as much as if a jury were to hear, for example, this person was identified by anti-technology, it may cause a georgia say, well, this must be extra reliable, compared to the human eye. when you talk about the potential for things to go wrong there, there are so many different implications. joy, i wanted to turn to you because this conversation, nationally, there has been such a pushback about diversity and inclusion on so many different respects. people often underestimate the ways that those types of discussions have implications here in this space. can you talk to us a little bit about why it is so important to really push back on the conversation about having diverse engineer courses that actually program they i tried avoid this kind of bias continuing to develop? >> i think it is really important that we recognize that even if the systems were flawless, if they functioned perfectly, we would still have an issue. facial recognition is dangerous when it works. it is dangerous wasn't doesn't work. as we saw with the false arrest. when we are thinking about the teams that are creating these systems, we want to have people with a variety of experiences. people who know that black women already have a higher infant mortality rate, ray? this compounds even what it means to put somebody in prison while they're pregnant, which is already bad enough. what we already know about medical treatment of black women, black pregnant people, that is also out on top of this. as we are studying a.i. systems, it is crucial that we also understand the cultural, social, political contacts. you brought up a great example with how jurors could be swayed. there is an app that was introduced that was a facial recognition and biometric technology app which would say this type of evidence cannot be used in court. also prevent federal funds from being used by local agencies to get this type of technology, which has already been shown to be discriminatory and ineffective. >> watching the artificial intelligence hearings in may, one thing i was particularly struck by is that there are a lot of elected officials who have a very limited understanding of these technologies. i'm not gonna say that they don't know what they're talking about, but their ability to understand them and to discuss them is probably not aligned with what they're trying to regulate, and the degree to which they are forming policy. do you see that gap in understanding is being an obstacle to actually having sensible policy that is going to help regulators go forward? >> i think we are having the wrong conversation. as you said, i'm not sure congress gets it. it is a lot to take, and right? it is an immediate conversation. the conversations around eric now is the a.i. apocalypse. how these machines will become sentient in turn honestly whatever, that is not what is going to happen. the real harm is already taking place. it is already taking place in cases like this one with this misidentified person. it is also taking place where jobs are being handed over to computers that are simply not ready, getting rid of 10% of workforces in some cases. in the hope that a.i. can eventually take over. this sort of new technology is working in the same way that other relatively predatory industrialized technology have taken over. they have targeted minority groups. they have targeted workers who don't have much say, or power, in this sort of thing. they cannot stand up and say, hey, are dog and taken away. hey, i got misidentified in this crime. the conversation is about the a.i. apocalypse. not what is actually happening. >> joy, i have about 60 seconds left. you are our export here. as rapidly as a eyes growing, there is not a whole lot of regulation there. we were just talking about that. what is actually needed? give us the top three concerns you would say from a regulatory standpoint that need to be introduced to help get this thing under control? >> one thing that we do have is a blueprint froma.rits that thee released last fall. on that list, one of the things that says is the systems need to be safe and effective. we didn't have that. another piece is we need to have protections against algorithmic explanation, data privacy, and human alternatives and fall backs. we know what to do. we have been studying these systems for quite some time. we know the hype around a apocalypse is not where the focus needs to be. we also have had multiple executive orders coming out of the white house. i believe that they should add an executive order to create a national registry for false arrest links to facial recognition that can build on the national law enforcement accountability database mandated in a more recent executive order on policing. there are steps to take. there is legislation like the facial recognition in biometric technology moratorium at. we have action steps. now we have to take them. >> beyond, fascinating. critically important. nbc's been colin's and doctor joy buolamwini thank you for joining me. that's gonna do it for me for this edition of velshi. thank you so much for watching. i'll be back tomorrow starting at 10 am all the way through noon eastern. stay right where you are. my friend and colleague, alex quinton reports, begins right after a quick break. she is glowing. she is 1 of 1." with new olay hyaluronic body wash 95% of women had visibly-better skin. it's saturday august 12th, you're watching velshi. i'm charles coleman junior filling in for my friend ali velshi. we begin this hour with the latest developments in the fast-moving case of the united states versus donald j trump. there are major developments in the government election interference case against the former president. federal judge tanya chutkan granted the special counsel team request for protective order just yesterday. the protective order seek salute what trump can and cannot disclose about the case, and the trove of evidence that prosecutors are set to turn over to the defense during discovery. now the government requested a protective order that covered all of the discovery materials. but the judge's ruling did not go that far. it does stop trump from publicly sharing quote, material that the government doesn't, designates has sensitive. and quote. this would include things like personal information of possible witnesses, recordings, and transcripts of testimony. the defense argued that a protective order would infringe on trump's first amendment rights. but chutkan noted quote, mr. trump, like every american, has the first amendment right to free speech, but that right is not absolute. later in the hearing, she added quote, if that means that he can't say exactly what he wants to say about people who may be witnesses in this case, that's how it's going to have to be. and quote. seems straightforward to me. it was the first time both sides met in the courtroom with chutkan, the federal judge assigned to oversee this case. the next time they meet will be in a few weeks, august 28th, to discuss the actual trial date. the special counsel's team has propose starting that trial on january 2nd 2024, which is a sign of how fast they want to move the case along. now even though the defense has yet to respond, if we can clean anything from the other federal criminal case that donald trump is facing, they are likely to push for a much later date, so they can delay this as much as possible. for more on this, i'm now joined by nbc news senior national political politics reporter, jonathan allen. jonathan, so great to talk to you today. listen, donald trump has been framing this protective order as such an infringement on his free speech rights, not being able to save what he's able to constitutionally under the law. how has he been talking about this on the campaign trail? is it actually resignation with voters? >> good morning charles. i was in new hampshire earlier this week. donald trump up and wyndham talking to a high school gym full of supporters. talking about his first amendment rights being infringed, potentially being infringed. he's anticipating what we just saw. a couple things about that, number one, his team did not object to the idea of a protective order. they knew that would've been futile. they simply asked for a different one. the fact that even his defense team believes that his free speech should be unfettered in this case was, you know, sort of rendered moot by the fact that they filed their own protective order. people who listen to him believed that his, they believe his first amendment rights, his big supporters, they believe the first amendment rights are being infringed. more importantly, i'm not even sure they care about the sort of technical nature of it. they're behind him one way or the other. i think what the judge said, the first amendment right is not absolute seems pretty clear. you're not allowed to surefire, shout fire in a crowded theater. i think the supreme court justice once said that. you're not allowed to intimidate witnesses. donald trump has a history of trying to pressure people with his public commentary, and ends up being charge right now at least in the documents case, you know, with regard to the possibility of the obstructed investigation that he put undue pressure on people to try and destroy evidence. so it's not like the judge pulled this out of thin air. >> fascinating to me that even as his attorneys in court try to argue for a different version of the protective order, the public narrative from donald trump is that he's against it entirely. and this is infringing upon his first amendment rights. i want to turn for a moment to georgia. we know that donald trump has been criminally indicted three times, twice on the federal level. and a fourth indictment seems like it's coming in georgia very soon. whatever that means. the term has been flown around, along with a minute, which is my favorite. has this had any effect on the republican primary field at all? is it penetrating? is it breaking through? >> there's a certain number of republicans who are uncomfortable with donald trump, period. there's a certain number who are uncomfortable with the idea of him being nominated out at a time where he's under indictment, or could even be convicted. and then there's a large group of republicans why there love trump no matter what, or are concerned that republicans could lose the presidency so much that they vote for him anyway. -- i was talking about all stripes. i think what we know from the polling, what i know anecdotally from talking to voters is these indictments have created a rally around the flag effect for donald trump. his numbers have gone up. you've seen ron desantis, the florida governor, of course stumbling under his own weight. but also sort of dropping into more distances. so trump is in good shape. >> nbc's john allen. thank you so much. >> thank you charles. >> joining me now is former federal prosecutor, my friend and colleague, msnbc legal analyst, paul butler. he is a professor at georgetown school of law. and the author of the book chokehold, policing blackmon. also with us is danny so fall, is another one of my treasured colleagues. he's a criminal defense attorney, cofounder of snowfall is -- also an msnbc legal analyst. super excited to talk to two of my favorite lawyers. let's get right into it. paul. the defense invoked this first amendment argument as part of its strategy yesterday. but that is not with this case is actually about. tell our viewers how the protective order actually is going to help ensure a fair trial going forward? >> so you're right charles. this case isn't about what donald trump said, it's about what he did. the judge is a former federal, actually state prosecutor. a state public defender. she was very fair to donald trump, like she is to every defendant. but she made it clear that she is not going to put up with this typical stuff. so she went along with this protective order, and at the defense request from donald trump. that if he restricted to sensitive materials. but then she imposed are really raw definition of what's included in that category of sensitive materials. so charles, most of the 11 million pages of evidence that the trump team is going to get, trump will only be able to look at under adult supervision. >> danny, to paul's point, it's clear for anyone who's paying attention that judge chutkan is doing as good a job as possible in terms of balancing the interest of both parties, and not making it apparent one way or another that she is trying to point to either side. this is a fairly routine order, in terms of it being a protective order. the three of us have seen this over, and over again. what we haven't seen before is the unprecedented nature of this case. and how it came up during yesterday's hearing. how do you think trump's presidential campaign could complicate how judge chutkan has to go about crafting rulings in this case going forward? >> the bottom line is this. they simply cannot forecast all the different ways that donald trump might use the information that's given to him through discovery, and put it, out either on social media, or in rallies, or even on the debate stage. that was always the challenge. it was uncontroversial that there was going to be a protective order. it wasn't controversial, just as you pointed out charles, the reality was, even his own defense team acknowledge that there would be a protective order. and they submitted a protective order that included things like, no, we agreed, he doesn't get actual copies. we show him things. but the parties, the government, and the defense couldn't agree on the contents of the protective order. that too by the way is both common, and non controversial. when that happens, the judge source it out. that's exactly what she did. and guess what, -- split the difference, because she can't give the government everything she wanted. they wanted a lot more to be classified as sensitive stuff. the judge essentially said, will you don't get everything that sensitive. i define sensitive. and of course, the defense didn't get everything it wanted either. but the problem still exists that nobody, not the judge, not the defense team, not the government knows the infinite number of ways that donald trump may use this information. and of course, the first amendment is not a non issue. it does have to be balanced against the idea that political speech is arguably more cherished than all other speech. so everyone acknowledges, including the judge, the trump needs to be able to go out there and talk about his case. the problem is, nobody knows exactly how he's going to do it. but trust me, the government will be watching like a hawk. if they think he's violating, or if they think he's threatening a witness, they think, he will be the first to go before the judge and bring it to our attention. >> danny, paul and i are both former prosecutors, i want to ask you as a criminal defense attorney sitting with us, if you are donald trump's defense attorney, how concerned are you that while you are in court, trying to deal with the contours of a protective order, your client is on the outside talking about his first amendment rights, what he wants to say, and apparently trying to make it appear that if he wants to vocalize things, where he's going after his opponents, political enemies, or things -- witnesses in the case, that he's gonna continue to do it. how concerned are you about that? >> if you'd asked me that question in 2016, i would've told you, criminal defense attorney's clients never help themselves when they go out and speak publicly about their case. strangely for some reason, i can't fathom a lot of criminal defendants feeling like if they themselves are on a podium somewhere, get on social media, will be able to help their case. that's virtually never true. they should never speak openly about their case. if you have asked me that in 2016, i might've said something like a criminal defense attorney has to put his or her foot, down and see if a clients going out there to talk, then they need to withdrawal. but it's 2023. trump has had probably 1000 lawyer since then. every one of them knows that donald trump is going to say and do what he wants, no matter what you advise him. so now, being donald trump's attorney is out of the norm, in that york sent, essentially acknowledging that you're gonna do your best. but you probably don't even bother this point to have the top with the client. the top being, don't get on social media, don't make phone calls from the prism, they're all recorded, i don't know why, you to both know, that the defendants never get. that they keep making phone calls from the prison, for all recorded, and used against them. but this is, you know, if there's a new paradox. if your trump's attorney, don't even bother having to talk with him about not speaking. he's going to speak. and you do, i think his lawyers did a good job here. they recognize that, they did it their duty. they tried to -- knowing that doing so now might head off problems later. now, paul, to danny's point trump has not only threatened that he is going to continue to speak, he is actually done it. he continues to attack people connected to this case. he has called jack smith deranged. he said mike pence, impossible witness in this trial, is delusional. it was already warned about this during an arraignment. are we bordering on something along the lines of witness intimidation? time of the haina which has been turned ruined by the wildfires. -- what is the latest that you can tell us on the search and rescue efforts -- >> this rogue law goes into lahaina disrobe lockwood set up overnight this low that people back in. the robotic was lifted yesterday. this vote stop and a few hours, when that happens the people will go back into the town. for many cases, see the ruins of their homes and their neighborhoods. as you mentioned, tens of thousands of people displaced living in their cars. some living in their cars right next to me. for hours looking to get back into me. others trying to get off of this island. they will return to find not a whole lot. that is the unfortunate thing. search and rescue crews have been working day and night. there is an unofficial list of missing. it is growing. it may be beyond 1000 people they have not been in communication with their families or agencies to know where they are. it does not mean they are among the dead. it does not mean that they are lost. . but it is now more likely as people are moving on. there are more reports about the fact that they have not been able to search the interior of the buildings you are seeing on screen. the devastation you're seeing on screen. because of that, that is the reason why the death toll is expected to sow precipitately rise. exponentially. rise we do not know where we could end up over the next 24, 40, a 72 hours. it is a process that is now including more cadaver dogs and recovery efforts than it first did. that is where we are with this. meanwhile, you see some trucks rolling up behind me as a start to open up this roadblock, there will be an investigation with the state attorney general looking into how this was handled for the emergency management standpoint. the state has admitted that they did not sound the alarm. the sophisticated sirens set up all over the state and all over this island did not sound in time to let people know that this was happening. there were alerts that went out by text, tv, and radio. the power was down well before that happened, leaving residents to wonder why that system did not kick in. that will be part of the a federal society judge. already, with just a week on the job, bannon has stopped the offices diversity programs, the programs which were intended to provide intervention for certain nonviolent offenders. this is not the first time the desantis has yielded his executive power over local government to suspend a democratically appointed official. last year prosecutor andrew warren was suspended in a similar fashion because warren pledged not to prosecute people who were seeking abortion care this is the latest in a long list in similar actions that desantis is taking to issue more and more control over the state of florida this laundry list includes going to war with disney whitewashing history lessons, eliminating diversity programs and public schools. signing a slate of extreme anti lgbtq bills. quietly signing a very restrictive abortion bill into law to enemy now is the honorable monique worrell the florida attorney suspended by governor ron desantis earlier this week thank you so much for being here now that these diversion programs have been canceled, they were central to your policy platform as a when -- you are campaigning, when you are running for office. what does that do for the people who are in these programs? these programs are suddenly ended in these folks have nowhere to go? >> thank you for having me. yes, this is going to harm our community. the policies that we implemented surrounding diversion are based in research. i spent 16 years as a professor at the university of florida college of law. there i was the director of the criminal justice center. there was a lot of research that goes into the fact that diverting nonviolent people out of the criminal legal system build stronger, safer, communities. what we did with my first two and a half years in offices we expanded diversion programs so we could make it easier for people who just needed a little redirection to be able to get that without having their entire lives ruined by a criminal legal system that is unfair given. one, that once you have been in it, and there is a mugshot circling a view, it makes it difficult for you if not impossible for you define education, employment, and to see the light. our diversion program with central to public safety in our community. >> monique, as a former prosecutor i can tell you that so much about our conversations about crime and punishment are not data driven. the fact that you are talking about research being the impetus for why you divide these things are the candidate is so critically important. i do want to say that i feel like so much of the conversation is not only about desantis's action with respect to you but also the disenfranchisement of an entire block of black and brown voters. let's really run this down here. you won your election, overwhelmingly, with about 66% of the vote. of the jurisdiction that you were in charge of, about 60% of those voters are either black, latino, or people of color. when desantis makes this decision to suspend you because your politics don't align, in the, effectively, invalidating the votes of those who chose you to represent them as their prosecutor? >> it is another one of desantis's many forms of voter suppression in the state of florida. in addition to gerrymandering court districts and the voting districts as well as and forcing regulations against the individuals who are formerly incarcerated who recently gained their rights to vote under amendment for. desantis then enacted election police went out arresting people. this was in an effort to scare people out of voting if they were unsure what their status was even though the supervisor of elections had confirmed their ability to vote. this is just the multitude of ways he's using to suppress the voters of blue counties in the state voted that did not support him in the elections. yes, those counties include a lot of black and brown voters. >> now, money, gallon ask you question it a lot of people maybe would not. we know that desantis doesn't have the greatest record when it comes to race. you are the only black woman who was a local prosecutor in florida. you were removed by desantis. you were replaced by a conservative judge who also happens to be a black man who ran against you and who you defeated. do you believe, that some level, that desantis is summing his nose and playing in terms of who we treasure a place you so that he doesn't have to have the argument of a racist being applied to him with respect to this move? a 2015 traffic stop. the a.i. facial recognition search wrongfully identified woodruff as a defender she spent eight hours in jail detain for something she did not do you. after being released on a 100,000 dollar personal bond woodruff went straight to the hospital at the time she was dehydrated with a low heart rate and forced in the early contractions from all the stress of this ordeal. now, she has filed a lawsuit against the detective responsible for negligence in processing that a.i. facial recognition tool. this incident highlights a pattern of racial bias in our justice system and an antique naje. if you years ago a series of studies show just how unjust a.i. recognition is. the 2019 federal study found that asian blind people were up to 100 times more likely to be misidentified by facial recognition tools than white people. middle aged white man and were identified correctly with the highest rates of accuracy. no surprise there. black and indigenous women were identified with the lowest degrees of accuracy by a long shot. also not a surprise. these implications are serious. our justice system is already known to be heavily biased against both black and brown people. with artificial intelligence becoming more and more common in different aspects of modern life, from policing, to medicine, to hiring processes. these prejudices that existed society being programed into algorithms that will be relied on more and more every day, this is all cause for concern. joining me now is ben collins, senior reporter for nbc news. and doctor joy weenie. founder of the algorithmic justice lead. say that three times fast. author of the upcoming book, unmasking a.i.. my mission to protect what is human in a world of machines. coming out this fall. she closely studied the link between racial and gender bias in a.i.. joy, i want to start with you. there is a recent article and bloomberg business that dives into how and why a.i. bias is actually worse in more skewed than what exists in human bias already in society. that study is based on your work and your time at m.i.t.. can you just talk about why a.i. bias is actually worse than the bias we are to have as humans? >> absolutely. thank you so much for having me and highlighting the work of the algorithmic justice lead. we are looking at a.i. systems. we continue to see amplify racial bias, amplify racial binds, and also the gender bias we are seeing with black women indigenous women and as you spoke to before part of the reason and i amplifies this biases it perpetuates the bias that has already been seen so if it is more likely that a woman has been a misidentified or not as well represented in a particular data set, then the a.i. is going to make that even worse. what we are seeing is a combination of algorithmic bias. the a.i. systems work differently on different faces. also, confirmation bias. here we have a feedback loop where somebody is seeing a black person being labeled a suspect. it is than being given an indication that confirms that bias as well. >> this story of porsche woodruff in detroit, that experience a wrongful arrest. it exemplifies some of the real dangers that and poses. this has implications in policing, the justice system, health care, our medical system, and more. can you talk about what can happen with these types of tools when they are unreliable and racially biased? >> i think a good quote here it's from julius caesar, the fault is not in the start but in ourselves. we program these programs with our own biases. that is what is at issue here. we have developed a new technology that exemplifies and extrapolate that buys into technology to make it seem like objective facts. not quite chatgpt spinning out answers at a wrong but feel very ray. it is happening on this level with average recognition. they will get back numbers and say it might be 78% who it is. that is a be, sometimes, right? in class. but you are misidentifying a person. a b is not good enough. you need to be 100%. what we have seen recently is cops police forces of america and also the military of america leaning into a eye practices for things like the border wall. there's something called -- from the border who started oculus, nothing you put on your face for facebook. he is now in a.i. border security stuff. there is a massive complex around. this it is simply not there yet. it is taking in all the vices, the human biases that feed into these algorithms and are making them even worse. >> there is also the danger that there is a bias that will exist in the criminal justice system towards these types of identifications. and as much as if a jury were to hear, for example, this person was identified by anti-technology, it may cause a georgia say, well, this must be extra reliable, compared to the human eye. when you talk about the potential for things to go wrong there, there are so many different implications. joy, i wanted to turn to you because this conversation, nationally, there has been such a pushback about diversity and inclusion on so many different respects. people often underestimate the ways that those types of discussions have implications here in this space. can you talk to us a little bit about why it is so important to really push back on the conversation about having diverse engineer courses that actually program they i tried avoid this kind of bias continuing to develop? >> i think it is really important that we recognize that even if the systems were flawless, if they functioned perfectly, we would still have an issue. facial recognition is dangerous when it works. it is dangerous wasn't doesn't work. as we saw with the false arrest. when we are thinking about the teams that are creating these systems, we want to have people with a variety of experiences. people who know that black women already have a higher infant mortality rate, ray? this compounds even what it means to put somebody in prison while they're pregnant, which is already bad enough. what we already know about medical treatment of black women, black pregnant people, that is also out on top of this. as we are studying a.i. systems, it is crucial that we also understand the cultural, social, political contacts. you brought up a great example with how jurors could be swayed. there is an app that was introduced that was a facial recognition and biometric technology app which would say this type of evidence cannot be used in court. also prevent federal funds from being used by local agencies to get this type of technology, which has already been shown to be discriminatory and ineffective. >> watching the artificial intelligence hearings in may, one thing i was particularly struck by is that there are a lot of elected officials who have a very limited understanding of these technologies. i'm not gonna say that they don't know what they're talking about, but their ability to understand them and to discuss them is probably not aligned with what they're trying to regulate, and the degree to which they are forming policy. do you see that gap in understanding is being an obstacle to actually having sensible policy that is going to help regulators go forward? >> i think we are having the wrong conversation. as you said, i'm not sure congress gets it. it is a lot to take, and right? it is an immediate conversation. the conversations around eric now is the a.i. apocalypse. how these machines will become sentient in turn honestly whatever, that is not what is going to happen. the real harm is already taking place. it is already taking place in cases like this one with this misidentified person. it is also taking place where jobs are being handed over to computers that are simply not ready, getting rid of 10% of workforces in some cases. in the hope that a.i. can eventually take over. this sort of new technology is working in the same way that other relatively predatory industrialized technology have taken over. they have targeted minority groups. they have targeted workers who don't have much say, or power, in this sort of thing. they cannot stand up and say, hey, are dog and taken away. hey, i got misidentified in this crime. the conversation is about the a.i. apocalypse. not what is actually happening. >> joy, i have about 60 seconds left. you are our export here. as rapidly as a eyes growing, there is not a whole lot of regulation there. we were just talking about that. what is actually needed? give us the top three concerns you would say from a regulatory standpoint that need to be introduced to help get this thing under control? >> one thing that we do have is a blueprint froma.rits that thee released last fall. on that list, one of the things that says is the systems need to be safe and effective. we didn't have that. another piece is we need to have protections against algorithmic explanation, data privacy, and human alternatives and fall backs. we know what to do. we have been studying these systems for quite some time. we know the hype around a apocalypse is not where the focus needs to be. we also have had multiple executive orders coming out of the white house. i believe that they should add an executive order to create a national registry for false arrest links to facial recognition that can build on the national law enforcement accountability database mandated in a more recent executive order on policing. there are steps to take. there is legislation like the facial recognition in biometric technology moratorium at. we have action steps. now we have to take them. >> beyond, fascinating. critically important. nbc's been colin's and doctor joy buolamwini thank you for joining me. that's gonna do it for me for this edition of velshi. thank you so much for watching. i'll be back tomorrow starting at 10 am all the way through noon eastern. stay right where you are. my friend and colleague, alex quinton reports, begins right after a quick break. she is glowing. she is 1 of 1." with new olay hyaluronic body wash 95% of women had visibly-better skin.
