the biggest names. a mandate for boosters could be on the horizon somewhere near you. the metropolitan opera and colleges near you. more on that in a moment as president biden is set to meet with the nation's top doctors. plus we have our eyes on this minneapolis courtroom. former officer kim potter is charged with kill 20g-year-old daunte wright. in the last hour, the prosecution rested its case. the defense's first witness is up now, and potter is expected to be called to the stand to testify as well. and honoring our heros. today the first black servicemember to receive the medal of honor for service in iraq and afghanistan. the story of his bravery ahead. but we start with the latest on this pandemic. we have rehema ellis. also with us, dr. ashish za. first i want to go to msnbc's miguel almaguer who has more on the concern of the new rise in cases and what that could mean in the days and weeks ahead. >> chris, we're really looking at a convergence of several issues here. omicron is surging at a pretty rapid pace and delta has devastating issues at hospitals. >> reporter: new predictions for omicron are ominous. by the end of christmas week, the cdc now predicts the variants will produce a massive spike in new infections, up to a 55% increases. 1.3 million cases in just seven days. the grimacing prediction, the death toll could shoot up 71%. well over 15,000 lives could be lost in a single week. the health commissioner of the cdc making this plea. >> please do not get together with holiday guestser, or if you do, keep the gathers small. >> reporter: you have mass vaccination sites like at fenway are reopening. more schools are turning to remote learning. apple stores in three cities now shuttered because of a rise in infections. with more employers considering booster mandates, experts say omicron cases could double every two days here in the u.s., even though existing vaccines may offer less protection than they did against earlier strains. they still appear to fend off serious illness. >> if we didn't have these tools, i would be telling you to really, really be worried, but we have tools, so get vaccinated. get boosted. >> with tens of millions still unvaccinated and many past due for boosters, the most dangerous surge is still likely weeks away. this morning a somber reality as our country faces the prospect of another dark winter ahead. and because of the christmas holiday and new year's, experts expect january will most likely be our most dangerous month for new cases. chris, back to you. >> thank you for that, miguel. dr. jha, i want to go over that. we're already seeing obviously an increase in cases right now. in new york city, multiple broadway shows had to cancel performances this week, and that's with fully vaccinated casts. the nfl with nearly a 95% vaccination rate has had some bigout breaks, so when you look at everything happening, how concerned are you, how concerned should we be heading into this holiday season? >> yeah, chris. so thank you for having me back. look. it's a concerning situation obviously. the good news is as dr. fauci said, we have a lot of tools at our disposal. we can do things much more safely. i think largely we don't have to shut society down. we don't have to shut schools down, but we do have to be careful. i think getting boosted is absolutely essential for individuals. i think using more rapid tests when you have gatherings with people. avoiding large gatherings in the short run. thankfully most of those will not lead to serious illness. >> so, rehema, you're there. what's happening there? >> reporter: what's happening is an expression of concern as the doctor was just mentioning. they're manifesting that concern with what they're doing with students on this campus. they're basically told they don't want any more in-group gatherings, and they are shifting finals to online. in addition they're telling students and staff that they have to get that booster shot before they return from the holidays for the spring semester, and nyu is just one of several colleges and universities around the area doing this. fordham university here, cornell, as well as prisonton in new jersey. they're all saying they want to see the students vaccinated with that booster shot before they come back online. we talked to some students here at nyu about all of in. take a listen to what they had to say. >> are you surprised that finals are now online instead of in person? >> i am surprised at how quickly they decided to make the change just because obviously with the new variant it is very concerning. >> it's better to be safe than sorry. we don't want to not be able to come back next semester, like we want the opportunity. >> reporter: for the most part students are taking it in stride. one student said she was very anxious about this and looking forward to going home because it has been a stressful season wondering if the numbers are going to be up. now that they're going up, she'd rather be home. you mentioned the metropolitan opera house. they're requiring booster shots for employees as well as those fans coming to the opera house, and broadway is in conversation with union members to see whether or not they can work out a program for them getting that booster shot as well. chris? >> so, dr. jha, that has people thinking about it. is this now, in your opinion, what responsible companies, businesses need to be doing? >> yes. look, i think what we're doing is we're heading toward a point. we understand to be fully vaccinated. to be fully truly vaccinated you need three shots. that's a change. we're obviously learning things in this pandemic and that is where we're heading scientifically. and, by the way, our university, brown university is mandating a booster. we want to keep people safe on campus and in the classroom. that's going to be an essential part of getting through this pandemic. >> let's talk about what a lot of folks are talking about with their family members, with their friends. should we be having that gathering over the holidays? should i be getting on a plane and traveling? should i take that long-awaited european vacation? so many people are reassessing whether or not to continue with their plans, even those fully vaccinated with boosters in my experience. what do you say to them? >> some things are still quite available to do, getting together with small families, aunts, cousins, uncles, aunts, so long as everybody is vaccinated, boosted, unboosted. it's quite safe. nothing is 100%. if there are high-risk people in the mix, you could add testing and that would substantialically lower the risk. european vacations is a challenge. you could find yourself stuck in a country, isolated or quarantined. not the best time for travel if you could hold on. the omicron makes that much more obscure, more complicated. >> rehema, thank you. dr. jha, stay with us. nearly 6 million, age 5/to 1 11, with a shot. but many fail to remember a time before covid, masks, school, quarantine. nbc's stephanie ruhle sat down with kids at a hoboken library and they talked about what they missed before covid. >> what do you miss most before covid, chloe? >> i miss going out or having to worry about our surroundings. >> what do you miss? >> i miss going on cruises. >> i miss going to the trampoline place. >> i miss like going to my grandma and grandpa's house because i really don't get to see them. >> what do you miss? >> i miss visiting my cousins in india. that's what i miss the most. >> a lot of people before covid used to complain before covid they hated going school. it was hard and boring. since covid they realize they missed school. did you miss school? >> yes. >> did you miss it? >> yes. >> i missed a lot. like when i was in third grade, we had heard they were going to put us on like only a two-week remote, and everyone was really happy because they got to stay home. >> what was remote school like for you? >> very boring. >> what was it like for you? >> superhard to do work at home because there's a lot more things outside, and then there's so much things disstragtsing me i couldn't get all of it done. >> does it frustrate you more people aren't getting vaccine? >> yes, because like a lot of people are dying and it's making the covid rate go up again, and i've heard things that they might like shut down schools and put people on remote again, and i don't want that to happen because during covid it was really hard because i was on remote all year, and when i finally came back to school, like everything was different. >> so now that you are back in school, what happens when someone in your class gets covid? >> most of my classmates have gone on quarantine because like lots of my klatt mates go to dance, soccer. so as soon as one person in the class out of school gets covid, they like quarantine. >> so in school we do like random testing, so they'll pick someone randomly and you'll go get tested, and you'll get your results back. so if you get covid -- if it comes back positive, like the whole class has to go like on remote. >> chloe, are you excited about getting vaccinated? are there things you want to do but can't do yet? >> yes. i don't have it planned out whey want to do, but i am excited because i want to be -- i don't want to get my family sick. i want to be sure of how they are. >> are you scared of getting vaccine? >> no. >> how come? >> because my parents have it and the rest of my family have it and i heard things that's good for you, so, yeah. >> stephanie ruhle is here with me in the studio. dr. jha has stuck around. first of all, i love these kids. it also strikes me how much they know. obviously they've lived it, but it's like they get it better than some of the adults. >> bingo. it's what stood out to me. these kids should be covid vaccine ambassadors. did you hear one single kid talk about don't tread on me and my freedom? no. one kid said i want to go to india to visit my cousins. it was funny. one of them said, when covid first started and we went on remote for two weeks, we were psyched about it, but it's terrible. i've lost so much. they want to go back to the basics, the way they lived their lives. these are important years for them. >> what was the age range? >> between 5 and 12. here you have all of us who don't have much more to do in our lives saying i don't feel like it. it's not important to me. here you have kids who want to flourish. >> you heard that kid say he wanted to go to india and visit his cousins and the one kid wanted to visit his grandma and grandpa. here's my question. if the grandma and grandpa are fully vaccinated are but the chide -- child isn't yet, hasn't gotten all their shots, is it safe? >> first of all, those kids are amazing. at this point, yes, there are ways of having kids visit their grandparents. i have a 9-year-old who just got his shot he's not fully vaccinated. i would be totally comfortable with him visiting my parents. you can get a rapid test. not that cheap but getting cheaper. that kind of stuff makes it all that much more safe. we're not at a point where we should be thinking about closing schools, preventing kids time from spending time with grandparents, all of that is doable because of vaccines and testing. >> has this been a slower rollout than you had hoped with one in five? and when you're dealing with parents, what are they telling you? what's the hesitation? >> it has been slower. parents have been bombarded with misinformation about covid and kids. of course, thankfully, kids are not at the same level of risk as adults, but that's not the point. the point is what is the risk for covid versus other risks we immunize them against? >> reporter: the first witness is a use-of-force expert, rebutting what you heard from some of the prosecution witnesses, this expert saying that the force that was used by the officers was appropriate. it's still in that direct examination right now, so we'll see what the prosecution is able to get out of this expert in that cross-examination. but you mentioned this morning the prosecution rested their case officially. it came after 25 witnesses were presented on their behalf. the last and final witness being the father of 20-year-old daunte wright who gave emotional testimony yesterday afternoon. listen to what we heard from his father. >> daunte lived with us. he pretty much was there every day. and he loved his son. >> and you love your son daunte wright as well. >> a lot. i loved daunte. he was loved. >> do you miss him? >> i miss him a lot, every day. >> reporter: the big question now is when kim pot letter take the stand on her own behalf. we did hear from kim potter in the courtroom earlier today when the judge asked her if that is still her plan, to take the stand and testify. she said, yes, that's her plan. the judge said, do you need more time to reconsider? she signaled, no, she's ready to do it. the question is when she'll be called to the stand. chris? >> so, danny, typically when you see serious charges like this, the defendants only take the stand if their case is in real trouble. but we saw kyle rittenhouse, travis mcmichael. what do you make of this here and how significant will her testimony be? >> the last few months have been an anomaly. defendants typically i do not take the stand because there's too much risk, but if any defendant should take the stand, it's kim potter. number one, she and only she can establish she did not take a justifiable risk. police officers are professional testifiers. they're better than lawyers or prosecutors. they do it all the time. most days officers go in and testify. she's going to be experienced in the courtroom. and only she can give jury insight what was going through her mind. finally they will almost surely empathize with her after seeing that video of her that traumatized herself after the shooting, this tragic awful shooting, and the centerpiece of her defense, undisputed on both sides, is this is a horrific accidentet at the core of this case is whether she consciously created that risk. she can tell the jury she didn't. >> part of my experience -- and i'm curious when you say how important it is for her to take the stand -- when you have an expert witness, somebody who comes out and says, oh, it's very, very difficult, you should not if you're a trained officer mistake a taser for a gun and the defens puts on a witness who says exactly the opposite, i have talked to juries after the fact, if they're good, they'll cancel each other out. >> you're right. the battle of the experts. the jury decides who they like better, who's got a better story. sometimes they'll say they're so diametrically opposed, we're going to overlook it. you're exactly right. jurors get bogged down and will say, we don't need either of them. >> what are you looking for from kim potter's testimony and what would you expect in the cross? >> she will have been prepare and emote and let the jury know this was a hor iffic mistake and how it's impacted her. she will give the jury insight into what was going on in her mind because this entire case is what she consciously created, what risk she consciously created. arguably if the defense can establish she did not conscious die draw her firearm, in her mind she was drawing her taser, arguably that's what the defense needs in order to get an acquittal. they're going to hammer that topic heavily on her in the cross-examination. >> shaquille brewster, danny cevallos -- wait a minute. i looked up indianapolis. 16 degrees, real, 2? [daughter] slurping don't pay for water. pay for clean. it's got to be tide. it's fair to say that for most americans, this has been a tough holiday shopping season, especially when it comes to finding gifts that are actually on the shelves. the pandemic supply chain hiccups are still very much impacting every corner of our country. now while it may not help you or santa in time for december 25th t biden administration is rolling out a new plan to tackle one piece of that shipping puzzle, trucking. according to the white house, 72%, 72% of goods in america are shipped by truck. so the administration is working to recruit the next generation of truckers with a big focus on veterans and women. nbc's josh lederman has more from the white house, and leigh ann caldwell is live on capitol hill. jorks take us through this. >> reporter: it's been percolating for years, but it's gotten particularly bad with the covid-19 pandemic. there are parts of the country where trucks are the only wash to get goods in and out. a few months ago they took the steps to increase the hours of the ports of long island and long beach, it moved the bottleneck to other parts of the process some of they were time get more of these shipping containers unloaded at the ports, but then there came a backup to try to get them on trucks to bring them to the places where they need to go. that's one of the reasons the white house now says it's focusing particularly on this trucker shortage. take a look at what transportation secretary pete buttigieg said why they're taking on this issue right now. >> remember, these truck drivers are the definition of essential workers. you can't do that job from home. we do have a lot of people ready and willing to join the profession. that's why we're trying to clear the red tape in the short term, but it is a leaky bucket. we want to ensure that they want to stay and build careers. that means listening to truckers and what they have to say. >> reporter: part of this is making sure states have enough funding from the federal government to speed up the process of issuing commercial driver's licenses so they can get more truck drivers on the road, but they're putting an emphasis of recruiting new drivers on the force, and they're specifically emphasizing two groups they want to see more in the trucking industry. u.s. veterans and women. >> so, josh, while i have you and they're rolling out the lead pipe replacement plan, it remains unimaginable that 10 million households, care facilitying, schools, get the drinking water that goes through lead pipes. tell us about this plan. >> reporter: to think it's been more than six years since the flint water crisis pushed this to the froer front, they're still dealing with this. that's why the white house says they believe they can meet president biden's commitment ahead of the infrastructure bill of actually getting rid of 100% lead pipes that are still in the 6 million across the country. so this plan is going to involve a mix of new regulations from the epa. they'll mandate that the water utilities take the pipes out of the ground and replace them, and also funding to make sure that's able to happen. but hero the white house is ham strung by the fact they're trying to cobble together some funding from this from the infrastructure law. there's about $15 billion in this, which is a fraction of the $45 billion biden wanted. they're going to take some funds from the covid relief stimulus measure and they're also counting on $15 billion from the build back better bill, which, of course, has not yet passed, and so it's just the latest indication of how difficult it is for bide on the tackle these core promises, these core part of his domestic agenda, given that all of the funding he's relying on has yet to be passed. >> democrats look to be pushing it to next year. i want to play you something president biden said when asked about that. >> there's nothing domestically more important than voting rides. it's the single biggest issue. >> you've got this shift, and in the last hour senator sinema released a statement in opposition regarding filibuster. where are we with both of these things?
