>> i don't know how anyone can look at this entire exercise and take iters isly. i mean we have seen all along how fraught it has been with problems from lack of transparency, huge security lapses, and just the fact that a lot of what they were trying to carry out was based on just unfounded conspiracy theories. and their report yesterday echoed a lot of these conspiracy theories and talked about anomalies which are easily explained by people who understand how elections run. so, you know, this whole thing has just been a sham. we knew that. and nobody should take it seriously. >> one of the most important clauses of the statement there by people who actually understand how elections are run. there were missteps as you said by cyber ninjas throughout the entire process. and at the hearing for the time release and the report the ceo blamed some of his firm's sloppiness on a lack of cooperation from maricopa county. your response? >> look, maricopa county did everything they could to comply with this. but it was simply unnecessary. and i think it is important to remind folks that this entire exercise was enabled by elected leaders of the state of arizona who are clearly running the state by conspiracy theory. and this kind of partisan activity, this partisan posturing is keeping us from dealing with real issues. arizonans are simply tired of this. they are -- we have real problems and issues that need to be dealt with. and our leaders are failing us on that. that's why i am running for governor, because we have work to do and i want to get the job done. and folks can jane me in that at katiehobbs.org. anyone looking to take further action based on this this report should not be taken seriously as a leader. >> i wonder where you see this going next, which state you see this going next to? >> we already heard about texas. looks like pennsylvania is trying to launch something as well. we have been having conversations around the country with other secretaries of state and election officials who are concerned about the ramifications and trying to stop it. and my advice is, take every legal pathway you have to do that. i think maricopa county at this point probably wishes they had appealed the subpoena. and that would have gone a long way to try to squash this and really stop the sowing of doubt. >> for more, i want to turn to my panel, eugene daniels coauthor of prosecution playbook", lauren gambino of the guardian. and the author of the new book titled "resistance, how women saved democracy from donald trump". i want to read you something that jamal buoy from the "new york times" writes. that all of the pieces are falling into place for trump to seize power from voters. quote, all he needs is a rival slate of electoral votes from contested states. state officials and state legislatures willing to intervene on his behalf. a supportive republican majority in either house of congress. and a sufficiently appliant supreme court majority. if he runs in 2024, is jamal right? are all the pieces in place for him? >> they are. if you look at the eastman memo, the attorney for trump that laid out a six-point plan for overthrowing the government. you don't need the electors. it is very dangerous. what folks need to understand is arizona was a win for trump because this is all about getting across the notion that elections are not final and they are not inviolate. it is just the first round. this is a dangerous concept. we are going to have every election where republicans don't win with these kinds of shenanigans, threats of violence, these threats of intimidation. that's why it is essential that these things be debunked, that not only we have voting reform but that the federal government, the justice department, prosecute trump and others for attempting to overthrow the government. i can't stress that enough. that is the only deterrence. once politicians understand that they can go to jail for participating in these kinds of shenanigans will we have a chance i think to survive this. >> lawmakers called on cyber ninja's ceos to testify on the test results. they requested documents were him. he has not complied. what do they want to learn from him? and why not just subpoena logan? >> i think they are hoping they can hear from him exactly as was said, to debunk the claims, to bring him before a panel, put him under oath and walk flew and understand the process that his company used which as we heard over and over again there is a lot of questions about the way this so-called audit was performed. but i think you know, this is an evident in trying to stem the fallout from this because, as we mentioned, other states are looking to perform audits. we have mid terms coming up in 2022. texas is going to be a state for a lot of competitive races. if you are already laying the groundwork for challenging an election that happened nearly a year ago now that could be consequential for the mid terms. >> eugene, thursday the texas governor said four counties will be targeted. that is despite the fact that trump won texas. listen to what harris county judge lina hidalgo said in response. >> i have our county attorney here looking at legal options. it's not clear to us that there is a statute under which the state can conduct this audit. but we also recognize that the state supreme court will be friendly to whatever claims the state makes. we also are calling on legislators not to fund this. this is the time where they should look at their moral compass, who they are as public servants, the legislators in austin and not fund this audit because they will need to approve the funding for it. finally, we need to federal government to act. i mean, this has gone too far. >> eugene, what kind of federal recourse do these states and counties have at the moment? >> when it comes to the federal aspect of this, the only thing, and the thing they have been begging for and asking for, is reason why those dozens of democrats spent weeks and weeks here in washington, d.c. is some kind of democracy bill, right. hr-1 which was the democracy reform bill. some kinds of bill to protect people. some kind of bill to protect voting and the importance of voting. the texas one is a hard one for me to get, figure out kinds of what's the reason that they want to do that. obviously, you said it is really important for people thou remember that donald trump won texas. it wasn't really that close. it was closer than it usually is, but it wasn't that close. so what they are looking at when they are talking about those four big populous countiesed is idea to say democrats -- this would be republicans. no matter what state we win in democrats in the big counties, the black and brown counties, this is where the foolishness goes on. that's what they are hoping to show in texas and all of these other states. things we know aren't true. thing that arizona showed us, things that the trump-backed arizona audit showed us. i think the thing that's really important for folks to remember is that this monster has grown much bigger than i think this white house, the democrats on capitol hill thought it would. right? because i think the idea -- even after january 6th, the idea that we would still be talking about the election that president trump -- former president trump would still be trying to overturn said election or said states, that that would still be happening to this day. >> right. >> and it still is. i think what is happening in the republican party is something that is hard to get our hands around in trying to figure it out because it is growing and continuing. and it is going to continue until someone stops it and there is no one in the republican party willing to do so other than people like liz cheney and adam kinzinger. >> you either understand it is growing or you understand this was always the plan, making it impossible for president biden to actually govern. you wrote a piece this week for the "washington post" about how trump's election 2016 was a turning point for a lot of women, including yourself. you write about one of your fears of his possible return. quote. i now worry the democrats lack the instinct for the jugular needed to expose the gop's is a dishes conduct, habitual lying and radical obstructionism. the democrats' naive belief that politics alone can win the day when republicans will stop at nothing to secure power. what is it, jennifer, you want to see from dems? >> first i would like the justice department to do its job and investigate for example, trump committed voter fraud or extortion in georgia when he called up brad raffensperger and tried to have him find extra votes. i would like to see democrats polka hole in the filibuster so we can protect against these measures. i would like to see them reform the voters reform act. they need to be going to bar associations and seeking disciplinary action against people like johnman. they are thinking that i don't know they are going wait for the public to become disenchanted with it, they think it is so ridiculous that it is all going to solve itself. i cannot understand this lack of urgency, this lack of desire. and moreover, the language that is used is so mancy pansy that you wouldn't understand. these were not rioters. these were domestic terrorists on january 6th. you have an entire party that is now enabling and defending domestic terrorists. the language has to be match sharper, much more definitive and we need to be doing something to deter this in the future. next, what was the former president doing before and after the deadly riot? >> it can, if president biden invokes it. there is no evidence that president biden will. but a former president cannot invoke executive privilege. it belong to the office, and he's out of office. so, no, he can't. and none of his people can. they can invoke the fifth amendment if they are willing to take the political heat for admitting that they would be incriminating themselves. >> so eugene, part what have jill upped scores there is that some of this will come down to the way this white house responds to it. when it comes to the january 69:investigation, politico reports, where trump's doj intervened to black house inquiries, biden's administration indicated it won't stand in the way. overall, eugene, how is the white house responding to this select committee? >> my colleagues reported not standing in the way. obviously, they are -- they want to know what happened that day, too. right? this is not something that really should be partisan. but these are democrats who want to know what happened on january 6th. and what, more, importantly, who are the people in the offices they are sitting in now, what did those people do? so they are interested in finding those things out. and when it comes to whether or not the president -- the current president is going to say executive privilege for trump -- that's likely not going to happen. they already said. one, they said they weren't, and they had to back pedal a little bit and said they would do -- you know, whether or not they would claim executive privilege on a case-by-case base. i assume it has nothing to do with this particular case and more with whether or not they want do it later and whether they want to be public about that. but they want this stuff to come out. the president himself talked about wanting that information to come out because not only does it -- everything that happens around january 6th, all of these lies about the election, it does not actually call into question, but it calls into question what is happening and who is the president and all that stuff and makes it harder for president biden to govern. but more important lesion it's bad for democracy. >> right. >> people in the white house is less about themselves than whether joe biden is going to be snatched out of the white house and trump is going to move in. but it is about democracy. and they are concerned about the impact on testimony accuracy? jennifer, to that point, january 6th isn't just about donald trump. it's about his enables. we talked about what accountability look like. specifically, can you draw a line for me between the accountability they face and the buffering of our democracy? what message does it send to someone who might intend to follow in the same? >> to follow up on the last point. the justice department indicated to members of the current justice department that they can testify. the administration has already gone on record at least with respect to people like jeffrey rosen that they can testify. we already know they are hot going to be invoking executive privilege. the people who committed the breaking and entering, the people who were out there threatening to hang nancy pelosi and the vice president, those people are being prosecuted. and they should be. they committed crimes. just as in the mafia, we do not stop with the hit men, we go up the ladder of responsibility and hold everyone accountable, we must do that here. and i must say, i'm very troubled, perhaps this is going on very quietly, but i do not see evidence that the people who financed it, the people who supported this, lawmakers who may have given tours to some of these people -- and of course the president of the united states, who may have been plotting this -- i don't see evidence that the justice department is serious about going after them. and i think that is a fatal, fatal mistake. these are serious crimes. sedition, overthrowing our democracy. if the justice department doesn't act on this, what are they there for? and moreover, if donald trump is not prosecuted on this set of facts where you have tapes, you have memos, you have the best possible evidence you could have, what is to prevent him or any other republican going forward from repeating this? so i do think that there is information to be gathered from lower level people. and do you want to work your way up. but i haven't seen evidence that they are really intent on doing that. and i certainly hope that they don't take the attitude, well, this would be too political. the justice department would look like they are playing politics. this is essential. and if they are not willing to do this, i think we need a new attorney general. >> jill, i want to give you a chance to respond to what jennifer just said there about the scope of this. >> the scope -- let me take it from a different perspective. with the subpoenas they have issued and the detailed information they cave in why they subpoenaed these people show they are reaching far and wide in terms of what they are investigating. i think that, you know, the people who are the best known, bannon, and meadows, are not necessarily the most interesting. although, meadows because he was with the president so much of that day is important. but i think patel is going to be very interesting. and i wonder if his boss, who was the acting sec def, chris miller, will be the next one as to what his conversations with the president were. and i think that that will be a very important thing. i had the privilege of interviewing chris miller for i jen politics, one of my podcasts and as hard as i pressed him i didn't get the kind of answers you can get when someone is under oath in front of congress. i hope that he, too, will be subpoenaed. and i think that the subpoenas, you know, just raise the question of who is going to talk, what do they know, and what can they tell about what the president knew in and more importantly, what did they do? you have most importantly these two deadlines running into each other. the real deadline, the actual deadline is the raising of the debt limit. right? that is the one that actually really matters. the government runs out of money to pay its bills at the end of thursday, september 30th. and the other -- and the one that is most important to democrats is this idea by september 27th that they were going to be done with voting and figuring out what we have got the playbook called the bif, the bipartisan bill on infrastructure, but also the reconciliation bill. and the fight that's happening right now, and the negotiations that are happening right now within the democratic party are, one, you have moderates who say they just want to get the infrastructure bill out and done. but that was not the agreement moving into it. right? >> uh-huh. >> president biden and progressives and moderates all agreed they were going to do this two-track and that both of these bills would move in tandem and reach the president's desk kind of on the same day or within a similar time frame and moderates have changed the game a little bit here and are kind of blaming progressives for sticking to what the president has said and wanted. i think that's where the interesting things happen. for this week, the things i am going to be looking for, is a lot of people, moderates and progressives have drawn a lot of red lines in the sand. they have said a lot of strong statements of things they won't do. one thing we know about nancy pelosi, she is really good atteting what she wants done. this is going to be really tough. if anybody is going to do it, it's her. but all these people who put lines in the sand it is going to be tough to get them to come bag together. i think that's going to prove tough for the officer and for president biden as well frying to get these people together. >> lauren, to that point, the progressive chair warned last week she had enough votes kill the bipartisan infrastructure bill if it came to the floor without that other bill. she said this yesterday on our air. >> we are all part of the same team. this is the president's democratic agenda. we are all democrats. let's finish this. get the reconciliation bill done as was done in the senate when those senators voted for the infrastructure bipartisan bill they did so on the condition that this exactly thing that we are talking about right now is what happens. the reconciliation bill happens and then we will be happy to vote for the infrastructure bill. >> lauren, your sense of where this goes from here? >> i hear from the progressive chair she is not backing down. she has the votes and this is how they plan to go forward. it is a really -- monday is going to be kind of do or die and very telling. they had the whole caucus will meet at 5:30. nancy pelosi just announced that in her letter to the caucus. i think that meeting is going to be incredibly fiery. you are going to see where those red lines are, who is willing to come together. and never to remember that, you know, their whole -- this could be it. this could be their only chance. they know they have two majorities at this moment but come 2022, they could easily lose one house or both houses. so i think -- you know, i think that's the real trick here is they all believe they have to get something done. they all think it is consequential to their chances in 2022. it is just where that compromise is going to come from. and there is so little time and there are so many other legislative and financial deadlines that they have got to meet. that's going to be just the trickiest part of these negotiations. you know, nancy pelosi threw down the gauntlet and said we are voting on both next week. that's what we are going to be watching for. >> jennifer, it is really clear what is on the line here for democrats. what does it look like for republicans? >> well, they are the masters of throwing sand in the gears. they not only want us apparently the default. they want the government to shut down. that's another deadline, separate from the debt, which basically means we won't pay our bills. this basically says we don't have enough to keep the government open, the lights on right now. they would like nothing better than complete chaos. the government shuts down, we default. biden can't get his agenda through. this is how they thrive, how they are going to win. one of the things i learned in my book is that no one ever should bet against nancy pelosi. it is like looking through a pin hole right now. we are getting a fraction of what is actually going on. and what she is doing is trying to cajole, trying to meet the needs of one member, meet the needs of the other. she's bringing in the present. she basically is saying to these people, we are all going to sink together or we are all going to swim together. this is too important to mess up. perhaps i have gotten accustomed to her pulling the rabbit out of the hat every time. but as impossible as it seems, i almost think she's going to do it. how she's going to do it and how ugly it is going to get is going to be something else. but this is republicans' dream come true. they can see utter chaos this week. that's what they would like. >> lauren, jennifer, thank you. eugene, i think we have all been following your covid saga on twitter. i am so glad that you are well. and it is so good to see you. thank you so much for making us the show you returned to. next, the case of gabby petito is heart breaking. yet another reminder that there are thousands of cases just like it across the country that we never here of or about. we will talk about that next. and later, haitian refugees, president biden calls what happened horrible and an embarrassment. what caused this humanitarian crisis? who is making money from these conspiracies? and whose fears is it that are being exploited? >> so there's an easy answer to that and it's the purveyors of misinformation making money. these are folks selling essential oils as cures for covid. they're selling all different kinds of treatments beyond the just ivermectin we hear about. they are raking it in, and the people who are falling prey to this are people who are seeing these folks in their social media feeds, on facebook, tiktok, instagram, and other platforms as well. >> dr. hilton, scientists are developing an antiviral pill to treat covid at home. but unvaccinated people are turning down the chance to be in the trial. so what can medical professionals do, then, to build trust in new and existing treatments for covid, doctor? >> i think we have to continue to have this conversation and be louder than our persons that are anti-vax, have we know they're working. if you look at how many people have received an additional dose of vaccines since august 13th, that's 43 days, it's only been 2.53 million people. we are losing in this battle when we used to vaccinate up to 4 million people a day. and so what does that mean as we transition into the winter months where people are going to go indoors and be isolated in these groups where covid is shared back and forth? it's going to count for more cases and, unfortunately, more deaths. >> it's really important to talk about disinformation and misinformation and at the same time, i want to put an asterisk on this conversation, which is to say it is not to say it's responsible for 100% of the people who have not gotten vaccinated. you have the u.s. department of health & human services saying 44% of vaccine holdouts are quote unvaccinated but willing. what does that tell you and what is the best way to reach those people? >> right. what it tells me is that, again, us giving information will help them greatly. be us saying, for instance, of last week 226,000 children were infected with covid-19. in fact, they were 1 out of 4 new cases that we saw. if you fu look at the last four weeks that was 925,000 cases for kids alone. i really do feel if we start to speak about these children, most adults will say i want to do what's best for them, well, what's doing best for them is you being vaccinated because the way they get infected is from me and you. at this point unfortunately 5.5 million children have been diagnosed with covid-19. and we don't know the long-term consequences of what happens when that fragile body, as they're growing up. i encourage the adults, there's only been 2.53 million people that have gotten an additional dose since august 13th. we can do better and we must do better heading into the winter. >> we can do better than that. part of the reason this conversation has come into focus is it's really about apps and the way people are accessing the disinformation on these apps. you report thousands of facebook users are teaching each other how to obtain religious exemptions from the vaccine. how successful have these groups been? >> it depends whether you believe them or not. these are groups i've been observing over the course of the last few weeks and they've groan exponentially. they started at the beginning with a few dozen members and now they're up into the thousands and even the tens of thousands. these folks are swapping tips who are showing each other the forms that their employers have given them to submit a request for a religious exemption for a vaccine mandate. and they're telling each other how to evade -- how to answer various questions and how to evade filters. and, you know, one of the most common questions is have you gotten a vaccine in the past, and the folks in these groups are advising each other not to even answer that question. they say that if you simply don't answer that question, then your employer can't come back and accuse you of having an inconsistent position. these are the kind of tips they're swapping in these groups. >> kira, i got to say your skepticism of how successful they are or aren't really says it all. thank you both so much. still to come, is the gop now the party of frautds?
