nursing home deaths in the state of new york. we will be following that as well. first, it is the day after. reactions have been pouring in from everywhere to donald trump's new status of being the very first president to be impeached and acquitted twice. there are also lingering questions whether the house could have done anything differently. house manager plaskett said calling witnesses would not have changed a thing. watch this. >> these are not honest people. kevin mccarthy has changed his story multiple times about what happened. prepare pence, his own president came after him and tried to assassinate him. and we are still waiting to hear from him. what does that tell but the fortitude of these individuals? at the end of the day, it wasn't more witnesses that we needed, it was more senators with spines. >> all right. let's get into this w. me now, alley vitale, who is on capitol hill. it has been quite a 24rks 48, 72 -- four years shall we say? we could go on. talk me through what we are hearing today, the day after. i am hearing the words censure used repeatedly, the possibility of that for the former president? >> that's a word you are probably going to be hearing in the coming days as republicans and democrats both try to figure out okay now this we are past the official impeachment part this is there anything else coming in terms of holding donald trump accountable outside of that structure? what is going to be interesting, we are seeing it play out today, republicans seeing two different meanings in what donald trump being acquitted for the second time mean. seven republicans voted with democrats seeing this as a sign that the party needs to move away from trump's influence. others, though, doubling down saying this is the direction of the party and that donald trump remains the leader of the republican party which we will see heading into the 2w50 mid terms. we know he is wanting to get out there. democrats on the other hand, you started to get into this, they are trying to see a upside even though they fell short of the cop vix. this is what we are saying this morning about what this trial means going forward. >> i think it was dramatic success in historical terms. you know, it was the largest impeachment conviction vote in u.s. history. it was by far the most bipartisan majority that's ever assembled in the senate to convict a president. we successfully prosecuted him, and convicted him in the court of public opinion and in the court of history. >> yasmin, censure is one word you might be hearing around here. the other word is going to be covid relief. that's a big part of the reason why democrats didn't want this to be a lengthy trial. it is why when there was a call for witnesses surprisingly yesterday democrats were pretty quick to say that maybe the best way of going about it isn't to go down the rabbit hole of witnesses but to instead put jamie herrera's comment on the record and move past it. it's because they didn't want to jeopardize any part of the dieden agenda. the white house stayed really far away from this publicly. repeatedly when they were asked any said they were not part of it, this was an issue for the senate. but joe biden released a statement after the acquittal yesterday in which he said, while the final vote did not lead to a conviction, the substance of the charge is not in dispute. even those opposed to the conviction, like senator minority leader mitch mcconnell, believe donald trump was guilty of a disgraceful dereliction of duty. i think mcconnell's comments yesterday are interesting, too. clearly, he sided with the majority of his caucus. at the same time he issued a challenge. it will be interesting to see if it bears fruit. he said that donald trump is still liable for his actions while he was in office and that he hasn't gotten away with anything yet. i think he is inquiring into law enforcement officials across the state to dig in. >> i can't help but think listening to -- ali vitali, good to talk to you. how are folks reactingreact? want to go to georgia where the former president remains under investigation for election interference. the acquittal has drawn sharp reactions. talk us through, before we get to the case that is currently in atlanta talk us through kind of the reactions that you are hearing from folks on the ground there. >> yeah, here in fulton county, this is a democratic stronghold, yasmin, you can imagine the kinds of reactions from voters we spoke to yesterday. this held the county, this is the reason georgia turned blue. they said they are disappointed in yesterday's outcome but they are not surprised. they do wonder what it means for the future of politics. even though we had the outcome we did yesterday they feel it was very important for the second impeachment to be pushed through by the democrats for the sake of history, sake of setting an example. they also say when it comes to the outcome they wonder if it will embolden other extremists in the future and other violent attacks. it also means that donald trump is still the leader of the republican. >> it is extremely republican and they totally lack objectivity. >> i think a lot of the republican people who voted with trump don't actually agree with it. they are just looking to get elected in to your. >> it was not surprised. disappointed but not surprised. it is clear there are multiple steps of law. depending who you are -- this is not a race thing. who you are, government. this is one set of laws for them and another set of laws for us. not that -- because he will take that as a win no matter that, you know, there were seven that gave a strong message of condemnation. some surprising, and others not so surprising. mitt romney definitely not surprising. susan collins. sometimes. you never know what you will get from her. some of the republican senators from income and those states -- it was surprising. but yeah, it is going to be a win for him, regardly. >> mark dakous also said trump wakes up emboldened. that's the same of the day. and of course they will be looking into the criminal allegations here in gentlemania moving forward. >> that should be on a t-shirt, corey, for sure. i was talking to ali vitali. she mentioned former leader mcconnell's speech and kind of kicking the can over to the states, right, the criminal investigations currently in certain states across the country. new york being one of them. georgia being one as well. the investigation into election interference essentially trying to overturn the election results in that state. talk us through where we stand right now in that investigation against the former president? >> we are now looking at two investigations here in the state of georgia. the latest one being brought by fulton county district attorney fanny willis sending a letter to governor kemp saying any agencies that have any information regarding the january 2nd phone call keep awful those records because we are going to be doing a criminal investigation. we are launching not just a criminal investigation regarding the january 2nd call. but this is going to be expanded out to include a november call between lindsey graham and raffensperger regarding the mail of ballots. it is also going to include the ousting of the u.s. attorney for the northern district of georgia who didn't want to go along with the overturning of the election results here. it is going to be an expansive investigation by the fulton county's district attorney office. but we are hearing nothing will come out of this until march at the very earliest because they are starting from the beginning and leaving no stone unturned. >> corey kaufman for us. today many on capitol hill are struggling with the question of how to move forward, unite the country, tackle the crisis still devastating america. everyone is can go that question no matter what side you are on. but this morning, listen satisfy graham said president trump is planning his political return to glory. >> you know, he's ready to move on and rebuild the republican party. she's excited about 2022. the trump movement is alive and well. people leave that he brought change to washington policy wise thars long overdue. all i can say is that the most potent force in the republican party is president trump. >> wow. all right. i am joined by democratic representative debbie dingell from washington. thank you for joining us. appreciate it. some startling words from lindsey graham. i can't help but think back to the insurrection on january 6th. when lindsey graham stood up i am not sure whether it was during the day offer during the overnight. lindsey graham stood up and said i am done with this guy. >> consistency with lindsey graham is like consistency with donald trump. you are never sure where he is going to be or what he is going to say. i do believe that trump has a lot of supporters in this country. he's going to try to resurface again in four years for president. and i hope a lot of people will in that period of time see what it means to actually have a national covid strategy, that we are actually going to go out and try to defeat covid. we are going to have calmness. we are not going to be upside down anymore. we are going to stop this fear and hatred. i was disappointed by the results but totally unsurprised by what happened yesterday. and somehow, democrats have just got to -- we've got to listen. i mean there are people -- they are starting to use the word working peel. democrats need to remember to get back to their roots. their working people in the midwest and what issues they care about and be working on those as well. >> i want to go with that for a moment, what you just said. so we've got to listen. because -- i guess i want to know what you mean by that? and do you feel as if you weren't listening up until now? >> four years ago, when -- remember i was one of those few that said that donald trump could get elected. it was because we weren't hearing the issues that were really on the minds of a lot of people when they sat around the dining room table. we weren't talking about those basic issues of jobs, of health care, how are you going to educate your kids, having a safe and secure retirement. and you know, that's what people are still looking for. now, the pandemic has turned this world upside down. and people are scared every single day. you do not understand how scarce you are unless you are out in a state like mine in michigan and people have lost jobs, they -- i mean, food, hunger has become -- the people that i used to collect from food banks before are the ones that need the help now. they can't get a vags nation. it is chaos. how did masks become so political? >> hi yasmin, good morning -- good afternoon, rather. i do think that it is worrisome, but not for -- not for the reasons, probably, that i think that most people are worried. it is worrisome just because we have done such a good job in developing a vaccine that's safe and effective in a short amount of time, and it is concerning as dr. anthony fauci referred to that we could essentially be escaping some of that immunity protection later. i am not worried for today because i do think that it is worthwhile saying that as cases come down we see less and less of the possibility for these variants to spread like wildfires. of course that's contingent on us keeping with all those measures that help the cases come down. but i do worry that the presence of these variants signal that we are going to have this low lying level of covid that we will always have to worry about and that we will need to see probably seasonal vaccines to deal with them. >> okay. so you bring that up. and that's a really good point. i want to talk about that in comparison to the flu vaccine. there were a couple of years ago where there was a different variant of the flu emerging and we were seeing more children dieing from the flu. the year after the new vaccine included that new form of the flu. can we do that with these new variants? and if these far right extremist groups field emboldened by the fact that the former president has been acquitted for a second time by the senate? >> it's a great question. to be honest, i have seen similar rhetoric since january 6th although maybe even more right after the insurrection where people were rallying and kind of getting excited about the weekend before the inauguration. law enforcement then stepped in and tamped everything in. they were at capitals at all 50 states. i think for the most extreme in the movemente they took a step back and said let's recalibrate. this morning i was on telegram in in the extreme echo chambers i saw calls for violence on ploys. i didn't see anything towards mike pence, which we saw on january 6th. but it can be kind of random. they are sort the target du jour. one of the things i think is interesting, that's more prevalent is the christian nationalism wound up in the qanon conspiracy theories where on these channels they purport to be against violence. and that's fair enough. but they truly believe that donald trump was ordained by god and something are work out and trust the plan. that kind of language, it continues to this day. that has not really gone away. and i have interviewed quite a few people who were there on january 6th. and that kind of a thinking was a thread that ran through a lot of the conversations i was having, which is interesting. i know you were there. you probably saw some of that as well. in terms of the most extreme, where there are actually calls for violence. we have seen that all along. and it is tough for law enforcement because they don't know who is actually going to act on that. in the past first amendment rights issues have come into play. i saw today calls for violence on nancy pelosi. but it is really tricky. one, it is an anonymous poster or under an alias. and number works you don't know which person is going to act on that. it is tricky, it is tough. i think and militia groups, too, are really -- yeah, go ahead. >> no. i guess -- my next question is kind of twofold in that do you feel as if the government has enough of a handle on these folks, on these people, on these extremists that are kind of in the deep dark web in which you seem to independent could of peruse and see all of these comments on. great for you to do that, by the way. i am happy it is not my job. >> it is not always fun. >> i bet. do they have the capability to accurately monitor those right-wing extremists and bring them to just, seeing how tricky and hard it is, obviously, for someone like you, who has been monitoring these people and identifying who they are? and then secondly, are we sensing that there is a rise, a kind of coming together, a uniting of groups that were not united before? >> yeah, both are good questions. i will answer the first part first. i think that it's been impressive to see all of the arrests, more than 200 arrests. it is actually hard. you can see a photo of somebody's face, but facial recognition software can lead you astray and you can then you can think you have the right person, and then you don't. so there were hundreds of thousands of tips that came into the fbi and they had to wade through those. but those were probably helpful. and i actually do think that they have increasingly, over time, gotten better. but the trump administration also wanted to kind of eescalate the scrutiny on these far right groups. so there were some miscommunications between agencies in terms of like, okay, far right extremism is probably the biggest threat. but should we go after that? [ chuckles ] great to meet ya. people love my nicknames. it's a whole thing. that's wonderful, sir. switch to progressive, and you can save hundreds. you know, like the sign says. welcome back, everybody. a white house deputy press secretary resigned saturday after reports surfaced that he harassed a reporter earlier today. t.j. buck low's decision came just one day after being suspended without pay following reports that he verbally harassed a female reporter from ploito who was working on an article about his romantic relationship with another journalist. he says no, words can express my regret, my embarrassment, and my disgust for my behavior. new york governor andrew cuomo is facing backlash over the handling of covid outbreaks in nursing homes in the state of new york. the criticism stems from a report that alleges his administration undercounted covid deaths in nursing homes by as much as 50%. nbc's kathy park has more on this. >> reporter: growing fallout for new york governor andrew cuomo and his administration over covid numbers in hearsing homes. his top aide telling democratic lawmakers this week on a private call, we froze, concerned that the information was going to be used against us. after receiving a request from the department of justice last year. those comments first reported by the new york post sparked immediately backlash among lawmakers on both sides of the aisle. democratic state senator andrew beginard easy tweeting this is a betrayal of public trust. reid sayingest he's filing a formal claim against the aide. >> she needs to be arrested snooze we informed the houses of this at the time. we were comprehensive and transparent in our responses to to d.o.j. and then had to immediately focus our resources on the second wave and vaccine rollout. we could not fulfill their requests as quickly as a anyone would have liked. the growing scrutiny comes just weeks after new york attorney general leticia james released a report claiming the state undercounted nursing home deaths by as much as 50%. state health officials acknowledge the death toll was more than 15,000, much higher than originally reported. on friday, 14 democratic state senators called to repeal cuomo's emergency powers in the pandemic joining the republican-led effort. governor cuomo defended his administration's actions in late january. >> a third of all deaths in this nation are from nursing homes. new york state, we are only about 28%. only. but we are below the national average in number of deaths in nursing homes. but who cares? 33, 28, died in the hospital, died in a nursing home -- they died. >> often praised for his leadership early on in the pandemic, the governor is now coming under fire and tackling a new crisis. >> all right. that was kathy park reporting. thank you to kathy for that. with students and teachers itching to get back into the classroom safely the cdc unveiled its highly anticipated sweeping new guidance on just how schools can reopen for in-person learning. so far, the update has sparked mixed reaction and confusion among some parents and teachers as well. gary gom bach is outside a school in vingfield virginia for us, near washington, d.c. gary, good to see you this afternoon. talk us through exactly what is different about some of these new cdc guidelines and how parents and educators there in fairfax specifically have been reacting. >> it was a 35-page document released on friday how to get students back into schools safely. it was based on a color-coded tier system. the red zone, they call it would be where there is substantial community spread. it means 10% or more of a positivity rate in that community. what they are saying is for folks in that red zone they would like high schools and middle schools to be completely virtual but they would like the elementary schools to be in person, six feet apart, and wearing masks. now you may ask, wait, am i in a red zone? the answer is you probably our. according to our friends at a company that tracks the schools, 91% of students right now live in a red zone. clearly a lot of questions from parents and educators as to what the next step is. we had the cdc director on meet the press this morning. here's what she had to say the chuck todd. >> our guidance is really dependent on how much disease is in the community. we are more flexible with the six feet if there is limited amount of community spread in the low to moderate ranges. when you get to high ranges of community spread we suggest you need six feet. the science and the data suggests you need six feet with 100% wearing masks to keep your students and our staff safe. >> reporter: these are recommendations from the cdc. guidelines, not something that is enforceable or required. teachers are seeing these numbers down -- coronavirus numbers down across the nation and they are seeing that schools are not being seen scientifically as place where is there is a lot of coronavirus spread. so their big question, why can't everybody go back to schools? (vo) discover the exclusive, new miracle-earmini- a nearly invisible hearing aid from the brand leader in hearing aids. new miracle-earmini. so small and comfortable that no one will see them, but you'll notice the difference. call today to start your 30-day risk-free trial. start the year with better hearing and big savings. call miracle-ear today. welcome back, everybody. in the wake of the impeachment acquittal of donald trump in this week's edition of the spotlight, we are turning to harry will itman, host of the talking feds podcast where in a breaking education of the podcast he broke down the former president's trial, the evidence put forward and the implications on the republican party's future. joining me now. toer u.s. attorney and host of the talking feds podcast. i have not yet listened to your podcast. i knew you were coming on. this morning on my run i took a listen. it's really good. >> on a run is as good a place as answer. >> it is great to listen to a podcast while you are running. because all you can concentrate on is what you are saying. before we get into the nitty-gritty and the podcast you released last night give me first your reaction to the acquittal yesterday and how the case kind of was presenteds. >> sure. i think it was presented impeccably. even better than they say. there were many trial lawyer nuances they did perfectly. i am struck at the range of opinion from overall satisfaction to rage and heart break. immore on the san quinn side. yes, the republicans were in the tank. yes, the arguments they advanced were bogus, and they violated their oaths. nevertheless, i think it's clear that today trump stands convicted on the facts before the country and the world and history of a really appalling even monstrous dereliction of duty. and you know, that's where his defenders have to now begin. and i think that's a pretty positive development, especially when you consider the jurors were in fact in the tank. >> so i want to be clear here. even though you feel as if he was not convicted in the senate, you feel as if the case presented over the last couple of days swayed americans to understand, folks maybe that were on the fence about this to understand the leadup and what actually took place on january 6th with the president insighting the riot. >> the mcconnell speech as well. and contrast it, yasmin, with what happened in the mueller report and impeachment one. we really have a set of facts that are easy to grasp and are stunningly monstrous on his part and you know, imposing danger on his vice president. really being gleeful about the deadly damage at the capitol. nobody can really dispute those. and that being the case, i just think it means going forward trumpism has a real burden. it's not disappeared. but i think they have gordon a long way, more than half the way, to sort of making it harder for him to have the choke hold on the country that he's had for the last few years. >> i am happy that you made that transition for us, this idea of trumpism and what's going to happen to it. you actually talked about it on your podcast. >> yeah. >> the future of the republican party at least for the next couple of months. on this podcast you had congressman hakim jeffries who served as a house manager in trump's first impeachment trial. you had matt miller and -- joining your panel as well. such a good conversation. i want to play a little bit of it for and you have you reagent on the other side. >> okay. >> absent him running again which we won't see for -- you know, we wouldn't see for a couple years, i think, i think there is going to be an interest in the republican party to on the short-term forget that donald trump exists not because he's just a political liability to them but because there is a interest by the republican facing unified democratic control to face all of their weapons against joe biden and attacking the democratic administration. i think in three months, four months, six months i don't know that we are going to be talking about donald trump very much. >> it's an interesting take. was that matt miller that was talking there?
