the parents of a 10 year old boy are suing the city o the parents of a 10 year old boy are suing the city of dublin, california after that boy went flying off a water slide. you might remember this video. it shows the boy going over the side barrier and skidding across the wet pavement. he suffered numerous scrapes in the incident. his parents are now suing for $2.5 million in damages, including for emotional distress. water slides are still closed pending further safety testing. there were some frightening moments in the meantime aboard an american airline flight as it came into miami. >> a bird flew directly into the plane's nose, but this is no ordinary bird strike. andy perez of our miami station has the story. >> reporter: gathering in groups, watching in shock. even the ground crews tell us, they've never seen anything like this. a bird's head going right through the front of a plane. no blood, no big mess, just quite a bit of damage done to the aircraft. american airlines says the flight was landing at m.i.a from mexico city. and during landing the plane somehow hit that bird causing all this damage. the plane landed safely. it got to the gate. american airlines releasing a statement what that reads in part, the aircraft was taken out of service and our maintenance team is currently inspecting it. so we showed this video to several experts and they were pretty surprised by this one. however, bird strikes are actually way more common than you would think. the faa released a study just last year, more than 160,000 bird strikes alone reported in the u.s. from 1990 to 2015. 62% of them occurred during the day, and a majority of bird strikes occurred during landing. >> kind of scary, but what can you do? >> reporter: for plane enthusiasts, the thought can be somewhat alarming. >> i have got pictures of birds next on to planes flying as you're taking off. you don't see it until you get it home on the computer, and then it's like, ooh. >> reporter: authorities are now trying to figure out how this bird became wedged like that. >> that is a big bird. our thanks to andrew perez of our miami station. when we come back, lost and found. you'll never believe what was returned to diana ross. >> "the skinny's" next. >> "the skinny's" next. i can breathe again! i can breathe again! vicks sinex... breathe on. ♪ skinny ♪ skinny so skinny ♪ time for "the skinny," and we have to start with some breaking skinny news. >> where is the banner? >> breaking. stories we're following on "world news now." a manhunt is heating up in tampa for a serial killer after a fourth victim was gunned down on his way on to serve food to the homeless. what the mayor of tampa is now saying, straight ahead. alabama senate candidate roy moore accusing his fellow republicans and democrats working together to keep him out of washington. and moore says the media only wants to talk about the sexual assault allegations against him. there are winter storm warnings and watches for the pacific northwest as the second powerful system this week moves in. it's bringing more wind, heavy rain and even snow and then it heads east. and president trump is expected to spend thanksgiving with family at his mar-a-lago estate in florida. no official word from the white house yet, but the faa has issued flight restrictions for the palm beach area on the days surrounding the holiday. those are some of our top stories. it's wednesday, november 15th. from abc news, this is "world news now." we begin this half hour with an apparent serial killer on the loose in tampa, florida. >> the fbi went door to door across the seminole heights neighborhood where residents packed into a community meeting last night demanding answers from investigators. >> after three random shootings last month, 60-year-old ronald felton was gunned down from behind. he was on his way to feed the homeless at a local church. the city's mayor had strong words. >> this has got to stop. we need to catch this killer before we have so notify one more family that one of their loved ones is dead. >> police have been investigating this string of murders since last month. witnesses say in this case police missed the suspect by just five seconds. and breaking this morning, authorities in california say a mass shooting there could have been much worse. a gunman killed four people in a rural community 100 miles from sacramento. apparently firing randomly, but when he attempted to go into an elementary school, he was unable to. the school was already on lockdown. and the families connected to another mass shooting, this one in connecticut, are trying to sue the maker of the assault rifle that was used in that incident. abc's maggie rulli reports from hartford. >> we, the plaintiff families of the victims of the sandy hook school massacre, have infinite patience to see justice done. >> reporter: parents who lost their children during the sandy hook elementary school massacre have brought their fight to the supreme court of connecticut, appealing a lower court's decision to throw out their lawsuit. >> we have not lost one ounce of confidence in the justness of our case. >> reporter: nine families who lost loved ones and one teacher who was wounded are taking on remington arms. the company who made the gun that was used to kill 26 people that day, including 20 children. >> early morning of december 14th, 2012, there was a young man in newtown and he was preparing for a mission. >> reporter: lawyers for the families argue that remington arms purposely market their ar-15 bushmaster rifle to men like the killer, posting ads and product placements in violent video games. >> think of the marketing as the best evidence of what remington knew about their weapon, about what remington knew where the weapon was ending up and about what remington knew who they were reaching out to. >> reporter: but the defense counters that their ads are protected by the constitution. >> advertisements are commercial speech. they involve first amendment protection. >> reporter: and note a law stops them from being liable when vines is committed with their products. for the families, they say this case goes beyond federal law and it's simply about what's right. if this supreme court decides to let the case go forward it could set a major precedent for other victim hes in similar gun cases moving forward. maggie rulli, abc news, hartford, connecticut. president trump returned from asia from a trip he says was a tremendous success. the white house says he accomplished his goals of improving relationships and laying the groundwork for fair trade materials. he'll have more to say about the trip when he makes what he's billing a major statement, saying it could happen as early as today. and some lawmakers are questioning the president's authority to launch a nuclear strike amid growing tensions with north korea. republican senator bob corker held the first hearing on the issue in more than 40 years. corker recently warned that the president could put the u.s. on a path to world war ii i and other senators are also voicing concern. >> we are concerned that the president of the united states is so unstable, is so volatile as a decision-making process that is so quixotic, that he might order a nuclear weapons strike that is wildly out of step with u.s. national security interests. >> our allies who rely on u.s. defense assurances are watching. and if we create doubt in their minds about the capability or willingness of the united states to live up to those commitments in any way -- and i'm not claiming that's what anyone's doing -- i think it could have repercussions that are significant. >> corker insists that the hearing was not in any way a rebuke. the retired air force general testified that the armed forces could refuse the president's order to fire a weapon if the command is deemed illegal. attorney general jeff sessions is facing scrutiny after hours of tough questions about russia from house lawmakers. he defended his earlier testimony, insisting that he never misled congress and is pushing back against allegations that the president is now pressuring him to go after hillary clinton. more now from abc's pierre thomas. >> reporter: the attorney general for the third time on capitol hill answering questions about russia. >> truth to help you god. >> reporter: and after already amending his answers from before, he was defiant, saying he has not lied about russia. >> i will not accept and reject accusations that i have ever lied. that is a lie! >> reporter: this last month, sessions testified he never knew of any communications queen between the russian operatives and the trump campaign. >> i'm not aware of those activities, and i wasn't, and am not. i don't believe they occurred. >> reporter: since then, we learned sessions was sitting right there, just one seat away from former trump adviser, george papadopoulos, when papadopoulos said he had connections who could arrange a meeting between trump and vladimir putin, donald trump sitting there, too. the attorney general saying he had forgotten about that conversation and only remembered it after news reports of the meeting. >> i do now recall that the march 2016 meeting at the trump hotel that mr. papadopoulos attended, but i have no clear recollection of the details of what he said at that meeting. >> reporter: but even though sessions said he did not remember details of the meeting, he says he does remember what he told papadopoulos. >> there are reports that you shut george down, unquote, when he proposed that meeting is this correct, yes or no. >> yes. i pushed back. with putin. >> reporter: his answer to how he could forget a meeting like this? >> it was a brilliant campaign i think, in many ways, but it was a form of chaos every day, from day one. >> reporter: sessions was pressed about his own communications with the russians during the campaign. in a senate confirmation hearing he said there were none only later to acknowledge meeting with the russian ambassador. >> you did have communications with the russians last year, is that right? just yes or no? >> i had a meeting with the russian ambassador, yes. >> that's exactly the opposite answer you gave under oath to the u.s. senate. so, again, either you're lying to the u.s. senate or you're lying to the u.s. house of representatives. >> well -- >> reporter: the attorney general not just facing heat from congress but the white house, as well. the a.g. under pressure from president trump who has been pushing for the justice department to investigate his political opponents. >> honestly, they should be looking at the democrats. and a lot of people are disappointed in the justice department, including me. >> reporter: we're now learning ten days after the president's comments, sessions said they would look into a special counsel to investigate the clinton foundation. but the attorney general insists he's not a pawn of the president. >> the department of justice can never be used to retaliate politically against opponents and that would be wrong. >> reporter: sessions said there would have to be a factual basis to appoint a special counsel, in other words, evidence he a crime has been committed. but sessions recused himself from the investigation into the 2016 campaign, so it's unclear how this will turn out. the u.s. embassy in zimbabwe is urging american citizens to shelter in place as military troops converge on the capital there. explosions were heard as the army took over a state-run television to reassure the country that this is not a military takeover. we're told that the 93-year-old president, robert mugabe, is safe and sound. here in the u.s., alaska airlines is canceling a flight between los angeles and havana, cuba. the cancellation follows recent changes in travel policies to cuba. planes used on that route will be moved to other routes with higher demand. the final alaska airlines flight from l.a. to havana will be january 22nd. and federal investigators are blaming a weak safety culture at amtrak for a deadly crash last year in pennsylvania. two amtrak employees were killed and 39 passengers injured when a train slammed into a backhoe and derailed. an ntsb investigation accuses employees of frequently taking shortcuts and puttinging on-time performance over safety. and trendy fashion retailer forever21 is notifying customers their credit card information may have been compromised. they're focussing on transaction between this past march and is last month. forever2 1 is trying to clarify which of its stores is may have been affected. and several companies are recalling nearly 14,000 hover boards. the government says battery packs may time since thwarting an alleged kidnapping plot aimed at 1year old amber driving home from her waitressing job when she noticed something was offer. >> i became scared, like my life was in danger. there were three barrels blocking my driveway. and, you know, i automatically thought, like, this is something that would happen on a scary movie, you know, like when you get out and then you get taken or something bad happens. >> reporter: as amber swerved around the barrels, her father terry sprang into action. >> i noticed the flood lights on the front of the house came on. the dogs wouldn't quilt barking. so i got up again. when i walked out to the back door and looked to my right, that's when i saw the two individuals, about 15, 20 feet from me the at the next door, which is the garage door next to me trying to break in. that's when i yelled at them and fired three shots. >> reporter: according to investigators, the suspects were allegedly planning on kidnapping amber by forcing her out of her car, taking her to the house and subduing her father who they believed to be wealthy and then robbing the home. >> i work seven days a week. i work hard. i own a funeral home and clothing store here in town. and the community's been very good to me over the years. had these individuals made it in our house, i said today would have probably been our funerals. >> reporter: after the 51-year-old called 911, police tracked down this white jeep. inside, they say they found a trove of potential kidnapping materials, latex gloves, masks, dark clothing and a roll of tape. the suspects, four teenagers who go to the same high school as terry's daughter are now being charged as adults with attempted kidnapping and attempted home invasion. the brocknys now working on moving forward and reclaiming their sense of security. >> i'm just thankful that i'm still here today and alive and that me and my dad are safe and that their plan didn't succeed. coming up, a list of the about to stand trial for assault with a deadly weapon. abc's matt gutman has more. >> reporter: the gunman had already killed four people by the time he started firing into the rancho tehama elementary school right during morning dropoff. >> all of a sudden, one of the teachers came running out around the building, telling us to run inside, there's a shooter coming. >> reporter: witness coy ferrera says he took cover inside his child's kindergarten classroom as gunfire poured into the school for 25 minutes, wounding one child and terrifying the rest. >> when they saw their friends shot up on the ground, they all started balling because they knew their friend was shot. >> reporter: the shooter fired in multiple locations for 45 minutes, terrorizing residents in this rural area, about 100 miles from sacramento, all residents ordered to shelter in place. >> it was very clear early onset that we had a subject that was randomly picking targets. >> reporter: police say the shooter stole a pickup truck and went on that shooting spree throughout the community, pumping this truck full of bullets, wounding a mother and her child. neighbor brian flynn says the shooting began when the suspect killed his roommate. the suspect was known to shoot guns late at night and had threatened flint in the past. >> we made it aware that this guy has been crazy and he's been threatening us. >> reporter: by the time it was all over, seven different crime scenes, five people killed, including the shooter and at least ten more wounded. >> the suspected shooter is deceased by law enforcement bullets. >> reporter: apparently, he'd had multiple recent run-ins with the law, including a domestic violence incident and a look-running dispute with a neighbor. they think he was out on bond. he had no license to carry a gun, yet had three weapons with him, including that long gun and two handguns. the four people killed were all adults, but ten people still hospitalized. matt gutman, california. quite a scene overnight in the red bluff. thank you, matt. to politics now and alabama senate candidate roy moore speaking very little about the sexual assault allegations against him during an appearance at a church. this taking place hours ago, and moore said the controversy swirling around him is part of a spiritual battle going on in american politics. >> obviously, i've made a few people mad. i'm the only one that can unite democrats and republicans. they've done everything they could, and now they're together to try to keep me from going to washington. >> in an attempt to ramp up the pressure on moore, the republican national committee has ended a joint fund raising agreement with him. and now senate majority leader mitch mcconnell is the latest floating the idea of a write-in candidate. mcconnell specifically says that attorney general jeff sessions might be the only person who could win that way. the election next month is meant to fill the seat vacated by sessions when he joined the trump admin vacation. jeff sessions is blaming the chaos of the trump campaign for his hazy memory about russian contacts. sessions faced more than five hours of testimony on capitol hill. he insists he never lied to congress and he denied that he's doing the president's political bidding. abc's janai norman has the details. >> reporter: the nation's top law enforcement official facing tough questions, forced to defend himself. facing questions about whether he lied last month when he testified before senators that he wasn't aware of trump campaign contacts with russians. >> the campaign had contact with the russians through mr. papadopoulos and on others and is two of you seem to be unaware at the time. >> reporter: a guilty plea from george papadopoulos revealed at this 2016 meeting sessions was aware of papadopoulos offering to arrange a meeting between donald trump and vladimir putin. >> i will not accept and reject accusations that i have ever lied. that is a lie! i believe that i wanted to make clear to him that he was not authorized to represent the campaign with the russian government. >> reporter: and questions swirling around new revelations sessions authorized federal prosecutors to examine allegations that donations to the clinton foundation influenced the obama administration to allow a russian agency to buy the nuclear one company and decide whether there's any merit to appoint a special counsel. a move that has some wondering whether the independent justice department is caving to pressure from the president. >> is it common for the leader of the country to order the criminal justice system to retaliate against his political opponent? >> the department of justice can never be used to retaliate politically against opponents, and that would be wrong. >> reporter: and it wasn't just democrats with tough questions. one republican congressman wanted to know why no special counsel has been appointed to investigate the actions of hillary clinton and former fbi director james comey. the attorney general saying there would need to be a factual basis and proper standards met for that to happen. on capitol hill, janai norman, abc news. president trump is back at the white house expected to make a major announcement as soon as today. he declared his tour of asia a tremendous success in his words. he said he made a lot of progress shaping trade deals. the president said he spoke with the chinese leader on behalf of three ucla basketball players accused of shoplifting in china. those players are scheduled to make a public statement with school officials later this morning. the school has been deciding whether to take disciplinary action. the pentagon confirms that an active duty service member has undergone gender reassignment surgery. the procedure was performed yesterday in an undisclosed private hospital. the patient had already started a sex reassignment treatment. the surgery was paid for by the military's health coverage because a doctor declared it to be medically necessary. and supporters of same-sex marriage were celebrating in australia this morning after a public survey found major support for legalization. 62% of respondents expressed support for marriage equality. the poll puts legalizing gay marriage on the australian parliament's agenda. lawmakers could after 40 something years of fighting this battle, i'm now facing allegations. and that's all the press want to talk about. >> also last night, senate majority leader mitch mcconnell opened the door to a write-in campaign to challenge moore. he named attorney general jeff sessions as a possible write-in candidate. on capitol hill, the house is taking a step to fight harassment in congress. house speaker paul ryan says all members and their staffs will be required to undergo antiharassment training. ryan's announcement came just hours after two female house members of spoke about harassment. >> in fact there are two members of congress, republican and democrat, right now, who serve, who have been subject to review or have not been subject to review but have engaged in set. >> other instances of alleged misconduct were also revealed, but lawmakers' identities weren't. last week the senate approved mandatory harassment training for members and their staff. senate republicans are once again taking aim at obamacare and taking democrats by surprise. the move could save billions of dollars but leave millions without health insurance. abc's mary bruce has more. >> reporter: an explosive addition to tax reform that re-ignites the health care debate. as part of their tax bill, senate republicans are now aiming to repeal the obamacare mandate that all americans have insurance. >> now is a good time to repeal bad policy. >> i've always said if we can get it in there without imperilling the bill, it's a good thing. >> reporter: the move solves a math problem for senate republicans. it could save more than $300 billion over the next decade, but it's also projected to leave 13 million more americans uninsured by 2027. republicans have tried to get rid of the mandate before and failed. john mccain delivering that dramatic thumbs down to the last attempt to repeal obamacare without a replacement. are you concerned this is going to make passing tax reform even more difficult? you've tried this in the past. it hasn't worked. >> i'm mildly concerned, but i don't think the concerns are great enough to cause them to vote against tax reform. >> reporter: but president trump wants to give this another go, tweeting how about ending the unfair and highly unpopular individual mandate in obamacare and reducing taxes even further. and a reminder of the math here. senate republicans can only afford to lose two votes and still have this bill pass. but already some republicans are voicing some concerns about this move. senator susan collins, for instance, says she has serious questions about how this might impact premiums. so the big question now, will republicans' desire to pass tax reform outweigh these concerns. california has been hit by an earthquake swarm. it started with a 4.8 quake in monterey county, that's been followed by aftershocks. so far, no reports of any injuries or damage. all the shaking took place along the san andreas fault. that's the major fault line that scientists say is overdue for a devastating quake. but they say there's no indication a bigger quake is on the way. today the space station will begin unloading the latest supplies from earth. >> the unmanned spacecraft arrived yesterday right on schedule after a two-day trip. scientific experiments are on board, along with some holiday gifts and a thanksgiving meal, but more importantly, pizza and ice cream. >> yes! >> now we're talkin'. >> is it in a tube, though?
