"politico" is reporting the former president, quote, might regret passing on the first debate pointing out that in recent nominating contests, the nationally televised shout fests have prompted significant shifts in polling after. the most recent fox polling still has the former president with a sizeable lead but it shows a dip for florida governor ron desantis in one area and a surge for vivek ramaswamy. >> do you think donald trump should drop out of the race? >> i think so. but obviously that's up to him. you were asking me my opinion. he will lose to joe biden if you look at the current polls. i'm a republican. i think any republican on that stage in milwaukee will do a better job than joe biden. >> harris: the gop in the spotlight this week. team biden is buying big in hopes of overshadowing the debate stage. really? he will have to be seen for that to happen. they just announced a 16-week, $25 million ad buy that covers key voting states, arizona, michigan, nevada, pennsylvania, wisconsin. in "focus" david car lucci former democratic senator and cassie, former executive director for the america rising pact. late to the party but on. the president's team is still relatively small for biden. what do you make of it. >> well, i think now with the debates happening and the president talking about spending $25 million really a record this early in the campaign, it will jocks -- will bring forth the difference. the republican candidates are trying to have their cake and eat it too, they don't want to talk negatively about trump or his policies. i think it is a losing strategy. you have donald trump who is running this rose garden strategy of not debating but that really only works when you are the incumbent and you have proven to beat the person you will be running against in november. so that's a real problem on all sides for the republicans. but the other issue is how are they going to talk -- will they talk to americans or will they talk washington talk? washington talk is all about hunter biden, conspiracy theories. the issue important to americans is the bread and butter kitchen tabletop ickx. i will look to see who talks about that. >> harris: let's give cassie a chance to address that. >> this is the first debate. a chance for most to make a first impression to a national audience. you will have a lot of people tuning in not just republicans but independents or democrats who regret their vote for joe biden. who are in desperate need of another option. things are not going well. every time biden says bidenomics it reminds people that the country is in the wrong direction and our money is not going far enough. so there will be a lot of people tuning into this debate to hear the alternative solutions or what happens when you have a republican in the white house. not long ago we remember things were good. gas was cheap. we could afford our groceries and get a vacation on the calendar. not the case for so many americans. joe biden is the reason why. >> harris: i want to stay with you for a second. des moines register poll out this morning. we were just talking previously. david, you mentioned where some of the candidates fall and i did as well. it is showing that ron desantis is still the clear alternative to trump in iowa. closer than it may seem. we saw vivek ramaswamy moving up particularly in iowa. a place where you would see tim scott move up. what do you make of where the pack stands going into the debate? >> it is another sign of people starting to pay attention. i heard a lot about that in iowa. things were closer than the national headlines might have you believe. but the real reason here that you are starting to see people shift and move to different positions is because people are looking for an alternative to what we have in the white house right now. they haven't necessarily made up their minds. they are getting kids back to school and getting the last-minute summer camps wrapped up and now tuning in. at the forefront of their minds how difficult the economy is to live our lives. i do see some real opportunity not for desantis but everyone on the stage to encroach on trump's numbers. they are about to be tens of millions of eyes on them, many for the first time. >> harris: the "wall street journal" editorial board weighed in on president trump potentially ducking the debate. trump clearly thinks he has the nomination wrapped up. what a message he is sending about the loyalty he thinks gop voters owe him. republican voters often say they like that mr. trump is a fighter but for whom is he fighting? them or himself? your thoughts on that, david. >> yeah, i couldn't agree more. this is a real problem for donald trump. he really made a name for himself in the debates in 2016. now he is falling on complacency. he is afraid he will be challenged. he is stepping down from the debate. i think that's when you see politicians at their weakest point. when they think they are so popular they don't have to go to the rubber chicken dinners or shake everyone's hands or court the voters like they did and where you see a politician peak and they start to come down. i think it's a real miscalculation for donald trump not to show up. of course the rose garden strategy every politician wants to do. it is easy. you have to do the hard work particularly for an incumbent president. >> harris: when you are north of 50%, his argument has been and still continues to be it's his party. last little word from you, cassie, and we'll move. >> no question about his popularity when he showed up to the iowa state fair he was the talk of the town. generally the american people deserve to see all the candidates who qualify for the debate stage and hope it includes donald trump. he is good on a debate stage. why not? >> harris: joe biden needs the rest at this point. if he sets the standard and joe biden has to step up and it does end up being the two of them as the nominees. one will be ready and one won't be ready. good to see you. thank you. tomorrow another installment of families in "focus." i sit down with casey desantis, wife of florida governor ron desantis, for a candid and wide ranging interview. catch it tomorrow at 11:00 a.m. right here on "the faulkner focus." and fox news weather alert now. mudslides, swollen rivers, flooding, power outages. all that we expected following that tropical storm hillary that hit the southern california coast and on inland, pushed its way inland where there were many evacuations. it has been going on since yesterday. the first tropical storm to ever hit la county since 1939. the first in san diego ever. san diego mayor todd gloria. >> we're not used to this level of precipitation generally. certainly not in august. we're not built for this kind of rainfall. that's my main concern. >> harris: the storm is losing some steam and that's such a blessing. as it moves north and over more land as these storms do. we know on the east coast. we get them. hurricane hillary is now considered a post tropical cyclone. it doesn't mean that there still aren't some threatening conditions. death valley, one of the hottest places on the planet got more than a half a year's normal amount of rainfall in 24 hours. the national park there closed because of the dangerous conditions. hillary's remnants continue to soak southern california. the flood risk is spreading into the other parts of the west as well. it's reaching all the way to phoenix, tucson in arizona. fox news meteorologists adam. >> we saw winds up close to 90 miles-per-hour yesterday at higher elevations. with that the rain was just absolutely unheard of. it doesn't rain in southern california in the month of august hardly. we got rainfall totals over ten inches. several inches of rain and why all the flooding continues to be an issue. the system is dragging to the north. now a post tropical system. there is still a lot of moisture now running in portions of eastern oregon and idaho and still rain falling back across portions of northern california. it become a larger disorganized system. that still could bring flooding. flood alerts in place because there was so much rain over the last 24 hours. are you looking at flood alerts stretching from the coast getting you all the way across idaho towards montana. i want to show you this. over in the atlantic. we were talking about the pacific. 1, 2, 3, 4, 5 areas where we could see potential tropical weather in the next week or so. a ton of activity. this one here a low pressure system in the gulf of mexico. it will bring rain to south texas tomorrow. it is active out there right now. >> harris: i'm always looking for a silver lining. you said flooding is bad in some places. the reason the flooding is bad in the west the ground is not saturated. i want to talk about california and the west coast with hurricane season. do they have one? we know when ours starts on the east coast and we name them all the way through the alphabet every year. what's going on on the west coast. >> the first ever tropical storm warning they've ever had in southern california. this is showing you water temperatures. all of these reds is where water is warm and the storms can fire up. they shoot off the sea usually. there was a feature in the atmosphere that forced it in the colder water. see how cold the water is? were they seeing what the rest of the country was seeing for a heartbeat and changed their minds? what was happening? >> this shows why influence pedestrian plunge is such a big deal. there is a reason why the lawyers for the defense threatened the prosecutors with the name joe biden. that shows what the purchasing power of that name is. they bought themselves, if you will, a sweetheart deal because it is a threat. it is a threat to weiss. if you go after this guy, we'll bring in your boss. he is their boss. there is the attorney general in between. let there be no doubt weiss works for the department of justice that works for joe biden. listen, prosecutors have a different ethical burden than regular defense lawyers. they have an obligation to do justice, whatever that means. it means objectively following facts and evidence to wherever it may lead without any kind of bias or prejudice. and that also means that if you have a conflict of interest or even the appearance of a conflict of interest, you might need to think about recusing yourself. this should have been done by a truly outside lawyer. >> harris: i have to tell you the road is so windy and connected tissue is so thick between this special counsel and the biden family. how surprised were you to learn that as the u.s. attorney, the acting u.s. attorney for the state of delaware, the president of the united states' home and his former now deceased son beau, a state's attorney at the time, they were working together. the history with david weiss and this family, isn't that automatically a conflict of interest? >> i think so. look, they are very close. you just mentioned the working relationship, the hand in glove working relationship between weiss and the late beau biden. now you will investigate beau biden's brother and the son of the president, joe biden? this is what influence peddling is, dana, just like in the segment just before what andy mccarthy was heard saying. this is why we need an outside counsel. this is why joe biden's justice department cannot adequately, i think, handle the investigation into hunter biden. listen, if they wanted to go after him they could have done so on the gun charge. it is wrapped in a bow, sealed and delivered for them to get a conviction. here we are approaching the statute of limitations with no indictment. i think the statute of limitations on that runs in october if i'm not mistaken. and any other potential crimes that he may have committed that are subject to the standard five-year statute of limitations, those charges are dropping by the wayside by the day. >> harris: they will sit on their hands and let innocence fall into his lap, i guess. at least non-prosecution. there is a difference between that and innocence. house oversight committee chairman james comer on sunday morning futures talked about the obstacles the house gop are facing in the hunter biden investigation. let's watch. >> we're facing obstruction like has never been demonstrated in the history of congressional investigations. not only are we being obstructed by the biden legal team but by the department of justice, by the f.b.i., by the secret service, by the i.r.s., by the democrats on the house oversight committee. >> harris: isn't that the plan? because if it's not, then it looks like, you know, the d.o.j. just got lucky. they should go to vegas. >> that's why we heard the lawyers in the plea deal that went south when they were in court. they were eager to say yes, there is still an ongoing investigation. they wouldn't go into any details and tell us what kind of investigation. just enough information to tell congress that weiss and nobody else will go before congress to answer any of these questions because it is an ongoing investigation, wink, wink. the bottom line is this. the name joe biden terrifies people at the top levels of the justice department. they don't want to do anything to cross joe biden. >> harris: why? >> this is why the joe biden name has been used in influence peddling on the world stage because at least in those circles it carries weight. if it carries weight overseas it certainly carries a lot of weight in his own justice department. >> harris: wow. i ask why are they so terrified of the man? but you just pointed it out. >> they could lose their jobs. they are afraid their career will be shot. if they go after hunter too hard it will make joe mad and it could be the end of a federal prosecutor's career if they get crossways to the commander-in-chief who is at the top of the food chain and their ultimate boss. >> harris: there has to be a group of attorneys maybe led by you who will tell the people that somebody has their backs if they will just tell the truth. you would think they would want to do it anyway. i understand what's at stake. but still there has to be a way. i have to let you go. thank you for being with me in "focus" today. >> always happy to be with you, harris. >> you heard of people jumping in the water. as many as 100 off from the shoreline. so we sent that and we sent helicopters, three coast guard cutters and 300 people to the scene. we train for search and rescue on the water. a search and rescue due to a fire from a community is something that just we are not trained to do. >> harris: still 800 people are missing and we learned from that interview that i had with the commander of the coast guard last week that many of those people could, in fact, be in the water and never found. we continue to pray for the entire state of hawaii. coast guard commander kristin hahn there talking about the horrors that she and others witness. wildfires devastated maui, 114 people confirmed to have died and all those unaccounted for, hundreds that i just mentioned. finally after nearly two weeks president biden and the first lady are leaving the lake tahoe vacation to visit the devastation we're told soon. residents there growing more frustrated over the federal and local response. the president has faced some criticism over his response to the maui disaster. >> you say no comment that's telling me you really don't care. >> you are in a high position and should know the country is falling apart. >> he don't have nothing to say about people losing their lives and people losing their homes. what kind of president is he? >> harris: we don't know. that's why we asked the voters. the trip also comes as democrats ramp up their push for biden to declare a national climate emergency. white house correspondent peter doocy has more from the north lawn. politics he has time for. >> well, harris, it is interesting. it doesn't sound like president biden is prepared to do what some prominent democrats want him to. you have congressman telling "politico" i refuse to accept that people choosing between burning alive or jumping into the ocean for hours on end is our new normal. it is a crisis. it starts with president biden declaring a national climate emergency to unlock vast federal resources to help our communities prepare for and recover from the deadly climate disasters. but on the other hand you have president biden who thinks his inflation reduction act already does a ton on climate. this much. >> president biden: the most aggressive action ever on climate ever. i've long said -- >> president biden has quiet about the loss of american life in hawaii, particularly as the fires were smoldering and said no comment from the delaware beaches. the presidential historian is kwoefted saying about that, just like there is a 72-hour window in rescue and relief. there is also a window when a president can be the great grief counselor in chief and biden is usually good at this. for some reason, he seemed slow off the mark. president biden hasn't even left lake tahoe area yet. he will have a five-hour flight to hawaii and back. he won't get back to the vacation home early tomorrow. the latest day for him in the united states that i can remember in covering this president. >> harris: he should be working. there is a lot going on. peter doocy, thank you. there is some big concerns about president biden's 2024 campaign and even the liberal media are taking notice. plus that third party threat is real. >> i think we're at a point that we've never been in this country where 2/3 of the people are not interested in voting for the republican or democratic nominee. >> harris: but will the push to give voters options upend the 2024 election particularly for democrats? they want to bring the people from the middle to their side. the independents. they are not with joe biden at this time either. >> harris: the president obviously thinks the american people are stupid. he doesn't think that we understand that if inflation is cooking at 3%, that's 3% more of what we've been paying for the last year. it didn't go to 0. it is not a negative number. we didn't reset to 2019. he actually thinks we don't understand why the prices continue to go up. they are going up at 3% on top of the 9% they went up last year under his watch. i mean -- he is not even willing to give us the benefit of the doubt by being silent. he wants to convince us we're all wrong. we're not convinced. >> that we're idiots and can't read the numbers. the economy said consumer prices up. gas prices up. home prices 11.3%. credit card debt up 33.9%. this is not the vision of america you want to paint because they are in trouble. people are upset and disappointed with the leadership of joe biden, black folks in particular are upset. back in 2020 we saw black folks participate at 91% of support for democrats. now we are at 63%. these are alarming numbers for anyone who wants to run for president. you have a record and people are not liking your record and then when you look into the potential corruption that joe biden may have been a part of it taints your candidacy. that's part of the reason why he has been staying off the campaign trail. not talking much to the media as much as he should because he has a lot of issues and doesn't have answers for them. >> harris: that doesn't describe why the vice president isn't making the case. maybe she understands where the economy is and doesn't want to defend something she can't defend. let's move forward. >> or doesn't want to be connected with it and hopes that joe biden is removed from office or something after so she becomes the actual president. that could be part of it as well. >> harris: the group no labels is pushing for a third party campaign in 2024. one prominent republican says you may be able to bet on it happening. >> if trump and biden are the nominees no labels will get access to the ballot and offer an alternative. if most of the voters don't want a or b we have an obligation to give them c. >> trump has a high floor and low ceiling. if you lower the floor he will win and benefited from third parties in 2016. this would be a dreadful mistake if the goal is to deprive donald trump of the presidency. >> harris: democrat senator joe manchin still has not ruled out his own third party run. they want to put a democrat and republican on the ticket some kind of way and railing at the current state of political extremism. here he is. >> this is not normal. this is so abnormal in the political arena we're in today. if you are a democrat they want you to villainize republicans and vice versa. that is not what the founding fathers intended. >> harris: your reaction to that. >> he is absolutely right. i do think a lot of villainizing democrats attempt to paint republicans as extremists. people who care about the economy, who care about what their kids are learning in school. who care what the next step is for the future and see a u.s. government taking on more debt than they can pay back at this particular time without saddling onto the grandkids and grandkids of the children who have to pay this debt back. he is right about that. when we think about the no labels party, i think david axelrod is spot on. you have to keep in mind donald trump has a large swath of the republican party that will vote for him no matter what. not the same for joe biden. if there is another candidate jumping in the race that is viable, democrats will leave joe biden and go with that candidate if they think this person is viable. not the same with donald trump. >> harris: he has anybody but biden syndrome. thank you. a showdown over parental rights in virginia just as children are headed back to school today. several districts are defying the governor's gender identity policies prefer to substitute their own judgment on the issue. jason rantz next. jason rantz next. mlb chooses t-mobile for business for 5g solutions... ...to not only enhance the fan experience, but to advance how the game is played. now's the time to see what america's largest 5g network can do for your business. the first time you connected your godaddy website and your store was also the first time you realized... well, we can do anything. cheesecake cookies? >> virginia governor glenn youngkin supports the new policies and his office expects every district to follow the rules. so far the governor nor attorney general have yet to say if they will challenge the schools in court. over the weekend governor youngkin did not address the controversy specifically but told a conservative crowd in atlanta says his agenda is under attack by a powerful lobbying group. >> the teachers union were fighting us every single step of the way. they still do. we've got to continue to recognize that the role of the teachers unions in america is not to progress their children and families. it is literally to be a political organization. >> speaking of politics fox news finding in a poll that 48% of voters think too much time in class is being spent on sexual and gender orientation issues as opposed to math, reading. the same concerns we've heard on the campaign trail quite a bit, too. >> especially coming out of the pandemic when so many kids across the country were on devices, too much time on a device hurts is brain is what we were told. we were forced to put them in front of the devices. we were twofold if a man comes into a bathroom screen and now we have to deal with biological men in the locker room. jason rantz. author of the book what's killing america. your response to what is happening to those school district challenging youngkin's policy. >> they do it to their own detriment. this state has led the country in pushing back on the battle between teachers, teachers unions and schools deciding they know what's best for kids and the parents who rightly step up and say no, i will love my kid more than you ever will. i know what's best for them. of course, when you look at it more globally in this country very clearly according to that poll in every other poll taken we're on the right side of this. the parents saying there needs to be a clear separation between the gender identity obsession and schools is pretty clear. i wish they would just learn from that. all they are doing is creating a larger wedge between families and schools. which i don't think does a service to these children. you want everyone to basically be working in concert with one another. unfortunately you have radical left educators who are trying to take total control. >> harris: it's interesting. what do you think the kids are talking about at school in the four districts as the administrators and teachers fight with the governor over gender identity? they are probably talking about that. shouldn't it be all the other things that will make them cot pettive in the workforce. parental rights in new jersey taking a temporary hit after a lawsuit from the state attorney general. a judge just blocked three school districts in new jersey from enforcing a new gender policy while the legal process plays out. and it could take years. until then, those schools cannot tell parents whether their children as young as five years old want to change their gender identity. an attorney for one of those new jersey school boards says this, quote. the school district is severely constrained in its ability to notify parents about important issues involving their minor children which is concerning on many levels. a new jersey mom told fox she is now worried about her child's safety. >> i feel like what happens if my daughter uses the boy's bathroom and something happens to her in there? is the school going to notify me that something happened to my child in the bathroom? i don't know. where does the line get drawn? who is responsible? >> harris: jason. >> two things. number one i hope every single parent across this country is looking at a story like this and taking this away from it. talk to your kids. have better relationships with your kids. you need to make sure that they trust you enough to tell you what is going on in the school but are also aware enough to flag certain issues that are coming up in the school so that these educators and administrators aren't trying to keep things from parents. two, all of these policies are rooted in a lie, a falsehood. an assumption that these kids who maybe are going through some gender identity confusion come from abusive households. they do not. the vast majority of the times they simply feel a little uncomfortable talking with their parents. i felt uncomfortable talking with my parents about sex and gender like everybody else. i think these schools would do better to try to bring them together, the kids with their parents because those are the relationships that ultimately matter. when it comes to any of these topics. i just wish they would understand we already have laws and policies in place for kids who are coming from abusive households. >> harris: yeah, it's true. they aren't going to teach the children our values in each home. they couldn't possibly. >> exactly. >> harris: jason rantz. thank you for weighing in and thank you for watching "the faulkner focus." he will have to be seen for that to happen. they just announced a 16-week, $25 million ad buy that covers key voting states, arizona, michigan, nevada, pennsylvania, wisconsin. in "focus" david car lucci former democratic senator and cassie, former executive director for the america rising pact. late to the party but on. the president's team is still relatively small for biden. what do you make of it. >> well, i think now with the debates happening and the president talking about spending $25 million really a record this early in the campaign, it will jocks -- will bring forth the difference. the republican candidates are trying to have their cake and eat it too, they don't want to talk negatively about trump or his policies. i think it is a losing strategy. you have donald trump who is running this rose garden strategy of not debating but that really only works when you are the incumbent and you have proven to beat the person you will be running against in november. so that's a real problem on all sides for the republicans. but the other issue is how are they going to talk -- will they talk to americans or will they talk washington talk? washington talk is all about hunter biden, conspiracy theories. the issue important to americans is the bread and butter kitchen tabletop ickx. i will look to see who talks about that. >> harris: let's give cassie a chance to address that. >> this is the first debate. a chance for most to make a first impression to a national audience. you will have a lot of people tuning in not just republicans but independents or democrats who regret their vote for joe biden. who are in desperate need of another option. things are not going well. every time biden says bidenomics it reminds people that the country is in the wrong direction and our money is not going far enough. so there will be a lot of people tuning into this debate to hear the alternative solutions or what happens when you have a republican in the white house. not long ago we remember things were good. gas was cheap. we could afford our groceries and get a vacation on the calendar. not the case for so many americans. joe biden is the reason why. >> harris: i want to stay with you for a second. des moines register poll out this morning. we were just talking previously. david, you mentioned where some of the candidates fall and i did as well. it is showing that ron desantis is still the clear alternative to trump in iowa. closer than it may seem. we saw vivek ramaswamy moving up particularly in iowa. a place where you would see tim scott move up. what do you make of where the pack stands going into the debate? >> it is another sign of people starting to pay attention. i heard a lot about that in iowa. things were closer than the national headlines might have you believe. but the real reason here that you are starting to see people shift and move to different positions is because people are looking for an alternative to what we have in the white house right now. they haven't necessarily made up their minds. they are getting kids back to school and getting the last-minute summer camps wrapped up and now tuning in. at the forefront of their minds how difficult the economy is to live our lives. i do see some real opportunity not for desantis but everyone on the stage to encroach on trump's numbers. they are about to be tens of millions of eyes on them, many for the first time. >> harris: the "wall street journal" editorial board weighed in on president trump potentially ducking the debate. trump clearly thinks he has the nomination wrapped up. what a message he is sending about the loyalty he thinks gop voters owe him. republican voters often say they like that mr. trump is a fighter but for whom is he fighting? them or himself? your thoughts on that, david. >> yeah, i couldn't agree more. this is a real problem for donald trump. he really made a name for himself in the debates in 2016. now he is falling on complacency. he is afraid he will be challenged. he is stepping down from the debate. i think that's when you see politicians at their weakest point. when they think they are so popular they don't have to go to the rubber chicken dinners or shake everyone's hands or court the voters like they did and where you see a politician peak and they start to come down. i think it's a real miscalculation for donald trump not to show up. of course the rose garden strategy every politician wants to do. it is easy. you have to do the hard work particularly for an incumbent president. >> harris: when you are north of 50%, his argument has been and still continues to be it's his party. last little word from you, cassie, and we'll move. >> no question about his popularity when he showed up to the iowa state fair he was the talk of the town. generally the american people deserve to see all the candidates who qualify for the debate stage and hope it includes donald trump. he is good on a debate stage. why not? >> harris: joe biden needs the rest at this point. if he sets the standard and joe biden has to step up and it does end up being the two of them as the nominees. one will be ready and one won't be ready. good to see you. thank you. tomorrow another installment of families in "focus." i sit down with casey desantis, wife of florida governor ron desantis, for a candid and wide ranging interview. catch it tomorrow at 11:00 a.m. right here on "the faulkner focus." and fox news weather alert now. mudslides, swollen rivers, flooding, power outages. all that we expected following that tropical storm hillary that hit the southern california coast and on inland, pushed its way inland where there were many evacuations. it has been going on since yesterday. the first tropical storm to ever hit la county since 1939. the first in san diego ever. san diego mayor todd gloria. >> we're not used to this level of precipitation generally. certainly not in august. we're not built for this kind of rainfall. that's my main concern. >> harris: the storm is losing some steam and that's such a blessing. as it moves north and over more land as these storms do. we know on the east coast. we get them. hurricane hillary is now considered a post tropical cyclone. it doesn't mean that there still aren't some threatening conditions. death valley, one of the hottest places on the planet got more than a half a year's normal amount of rainfall in 24 hours. the national park there closed because of the dangerous conditions. hillary's remnants continue to soak southern california. the flood risk is spreading into the other parts of the west as well. it's reaching all the way to phoenix, tucson in arizona. fox news meteorologists adam. >> we saw winds up close to 90 miles-per-hour yesterday at higher elevations. with that the rain was just absolutely unheard of. it doesn't rain in southern california in the month of august hardly. we got rainfall totals over ten inches. several inches of rain and why all the flooding continues to be an issue. the system is dragging to the north. now a post tropical system. there is still a lot of moisture now running in portions of eastern oregon and idaho and still rain falling back across portions of northern california. it become a larger disorganized system. that still could bring flooding. flood alerts in place because there was so much rain over the last 24 hours. are you looking at flood alerts stretching from the coast getting you all the way across idaho towards montana. i want to show you this. over in the atlantic. we were talking about the pacific. 1, 2, 3, 4, 5 areas where we could see potential tropical weather in the next week or so. a ton of activity. this one here a low pressure system in the gulf of mexico. it will bring rain to south texas tomorrow. it is active out there right now. >> harris: i'm always looking for a silver lining. you said flooding is bad in some places. the reason the flooding is bad in the west the ground is not saturated. i want to talk about california and the west coast with hurricane season. do they have one? we know when ours starts on the east coast and we name them all the way through the alphabet every year. what's going on on the west coast. >> the first ever tropical storm warning they've ever had in southern california. this is showing you water temperatures. all of these reds is where water is warm and the storms can fire up. they shoot off the sea usually. there was a feature in the atmosphere that forced it in the colder water. see how cold the water is? were they seeing what the rest of the country was seeing for a heartbeat and changed their minds? what was happening? >> this shows why influence pedestrian plunge is such a big deal. there is a reason why the lawyers for the defense threatened the prosecutors with the name joe biden. that shows what the purchasing power of that name is. they bought themselves, if you will, a sweetheart deal because it is a threat. it is a threat to weiss. if you go after this guy, we'll bring in your boss. he is their boss. there is the attorney general in between. let there be no doubt weiss works for the department of justice that works for joe biden. listen, prosecutors have a different ethical burden than regular defense lawyers. they have an obligation to do justice, whatever that means. it means objectively following facts and evidence to wherever it may lead without any kind of bias or prejudice. and that also means that if you have a conflict of interest or even the appearance of a conflict of interest, you might need to think about recusing yourself. this should have been done by a truly outside lawyer. >> harris: i have to tell you the road is so windy and connected tissue is so thick between this special counsel and the biden family. how surprised were you to learn that as the u.s. attorney, the acting u.s. attorney for the state of delaware, the president of the united states' home and his former now deceased son beau, a state's attorney at the time, they were working together. the history with david weiss and this family, isn't that automatically a conflict of interest? >> i think so. look, they are very close. you just mentioned the working relationship, the hand in glove working relationship between weiss and the late beau biden. now you will investigate beau biden's brother and the son of the president, joe biden? this is what influence peddling is, dana, just like in the segment just before what andy mccarthy was heard saying. this is why we need an outside counsel. this is why joe biden's justice department cannot adequately, i think, handle the investigation into hunter biden. listen, if they wanted to go after him they could have done so on the gun charge. it is wrapped in a bow, sealed and delivered for them to get a conviction. here we are approaching the statute of limitations with no indictment. i think the statute of limitations on that runs in october if i'm not mistaken. and any other potential crimes that he may have committed that are subject to the standard five-year statute of limitations, those charges are dropping by the wayside by the day. >> harris: they will sit on their hands and let innocence fall into his lap, i guess. at least non-prosecution. there is a difference between that and innocence. house oversight committee chairman james comer on sunday morning futures talked about the obstacles the house gop are facing in the hunter biden investigation. let's watch. >> we're facing obstruction like has never been demonstrated in the history of congressional investigations. not only are we being obstructed by the biden legal team but by the department of justice, by the f.b.i., by the secret service, by the i.r.s., by the democrats on the house oversight committee. >> harris: isn't that the plan? because if it's not, then it looks like, you know, the d.o.j. just got lucky. they should go to vegas. >> that's why we heard the lawyers in the plea deal that went south when they were in court. they were eager to say yes, there is still an ongoing investigation. they wouldn't go into any details and tell us what kind of investigation. just enough information to tell congress that weiss and nobody else will go before congress to answer any of these questions because it is an ongoing investigation, wink, wink. the bottom line is this. the name joe biden terrifies people at the top levels of the justice department. they don't want to do anything to cross joe biden. >> harris: why? >> this is why the joe biden name has been used in influence peddling on the world stage because at least in those circles it carries weight. if it carries weight overseas it certainly carries a lot of weight in his own justice department. >> harris: wow. i ask why are they so terrified of the man? but you just pointed it out. >> they could lose their jobs. they are afraid their career will be shot. if they go after hunter too hard it will make joe mad and it could be the end of a federal prosecutor's career if they get crossways to the commander-in-chief who is at the top of the food chain and their ultimate boss. >> harris: there has to be a group of attorneys maybe led by you who will tell the people that somebody has their backs if they will just tell the truth. you would think they would want to do it anyway. i understand what's at stake. but still there has to be a way. i have to let you go. thank you for being with me in "focus" today. >> always happy to be with you, harris. >> you heard of people jumping in the water. as many as 100 off from the shoreline. so we sent that and we sent helicopters, three coast guard cutters and 300 people to the scene. we train for search and rescue on the water. a search and rescue due to a fire from a community is something that just we are not trained to do. >> harris: still 800 people are missing and we learned from that interview that i had with the commander of the coast guard last week that many of those people could, in fact, be in the water and never found. we continue to pray for the entire state of hawaii. coast guard commander kristin hahn there talking about the horrors that she and others witness. wildfires devastated maui, 114 people confirmed to have died and all those unaccounted for, hundreds that i just mentioned. finally after nearly two weeks president biden and the first lady are leaving the lake tahoe vacation to visit the devastation we're told soon. residents there growing more frustrated over the federal and local response. the president has faced some criticism over his response to the maui disaster. >> you say no comment that's telling me you really don't care. >> you are in a high position and should know the country is falling apart. >> he don't have nothing to say about people losing their lives and people losing their homes. what kind of president is he? >> harris: we don't know. that's why we asked the voters. the trip also comes as democrats ramp up their push for biden to declare a national climate emergency. white house correspondent peter doocy has more from the north lawn. politics he has time for. >> well, harris, it is interesting. it doesn't sound like president biden is prepared to do what some prominent democrats want him to. you have congressman telling "politico" i refuse to accept that people choosing between burning alive or jumping into the ocean for hours on end is our new normal. it is a crisis. it starts with president biden declaring a national climate emergency to unlock vast federal resources to help our communities prepare for and recover from the deadly climate disasters. but on the other hand you have president biden who thinks his inflation reduction act already does a ton on climate. this much. >> president biden: the most aggressive action ever on climate ever. i've long said -- >> president biden has quiet about the loss of american life in hawaii, particularly as the fires were smoldering and said no comment from the delaware beaches. the presidential historian is kwoefted saying about that, just like there is a 72-hour window in rescue and relief. there is also a window when a president can be the great grief counselor in chief and biden is usually good at this. for some reason, he seemed slow off the mark. president biden hasn't even left lake tahoe area yet. he will have a five-hour flight to hawaii and back. he won't get back to the vacation home early tomorrow. the latest day for him in the united states that i can remember in covering this president. >> harris: he should be working. there is a lot going on. peter doocy, thank you. there is some big concerns about president biden's 2024 campaign and even the liberal media are taking notice. plus that third party threat is real. >> i think we're at a point that we've never been in this country where 2/3 of the people are not interested in voting for the republican or democratic nominee. >> harris: but will the push to give voters options upend the 2024 election particularly for democrats? is this what this looks like? you have americans becoming more poor than we've seen in the past. we had a strong growing economy under donald trump. now it has been destroyed. we know covid had a lot to do with that. joe biden has been saying in this white house we've come back and roaring back and better than we've ever been. people aren't feeling that. of course, we haven't seen the commander-in-chief push a message for independents. are we going in the wrong direction, 70% of independents say we are. we are talking about primary season now. republicans count, democrats count. they count in a general election. what do republicans and democrats whoever the nominee is try to get? they want to bring the people from the middle to their side. the independents. they are not with joe biden at this time either. >> harris: the president obviously thinks the american people are stupid. he doesn't think that we understand that if inflation is cooking at 3%, that's 3% more of what we've been paying for the last year. it didn't go to 0. it is not a negative number. we didn't reset to 2019. he actually thinks we don't understand why the prices continue to go up. they are going up at 3% on top of the 9% they went up last year under his watch. i mean -- he is not even willing to give us the benefit of the doubt by being silent. he wants to convince us we're all wrong. we're not convinced. >> that we're idiots and can't read the numbers. the economy said consumer prices up. gas prices up. home prices 11.3%. credit card debt up 33.9%. this is not the vision of america you want to paint because they are in trouble. people are upset and disappointed with the leadership of joe biden, black folks in particular are upset. back in 2020 we saw black folks participate at 91% of support for democrats. now we are at 63%. these are alarming numbers for anyone who wants to run for president. you have a record and people are not liking your record and then when you look into the potential corruption that joe biden may have been a part of it taints your candidacy. that's part of the reason why he has been staying off the campaign trail. not talking much to the media as much as he should because he has a lot of issues and doesn't have answers for them. >> harris: that doesn't describe why the vice president isn't making the case. maybe she understands where the economy is and doesn't want to defend something she can't defend. let's move forward. >> or doesn't want to be connected with it and hopes that joe biden is removed from office or something after so she becomes the actual president. that could be part of it as well. >> harris: the group no labels is pushing for a third party campaign in 2024. one prominent republican says you may be able to bet on it happening. >> if trump and biden are the nominees no labels will get access to the ballot and offer an alternative. if most of the voters don't want a or b we have an obligation to give them c. >> trump has a high floor and low ceiling. if you lower the floor he will win and benefited from third parties in 2016. this would be a dreadful mistake if the goal is to deprive donald trump of the presidency. >> harris: democrat senator joe manchin still has not ruled out his own third party run. they want to put a democrat and republican on the ticket some kind of way and railing at the current state of political extremism. here he is. >> this is not normal. this is so abnormal in the political arena we're in today. if you are a democrat they want you to villainize republicans and vice versa. that is not what the founding fathers intended. >> harris: your reaction to that. >> he is absolutely right. i do think a lot of villainizing democrats attempt to paint republicans as extremists. people who care about the economy, who care about what their kids are learning in school. who care what the next step is for the future and see a u.s. government taking on more debt than they can pay back at this particular time without saddling onto the grandkids and grandkids of the children who have to pay this debt back. he is right about that. when we think about the no labels party, i think david axelrod is spot on. you have to keep in mind donald trump has a large swath of the republican party that will vote for him no matter what. not the same for joe biden. if there is another candidate jumping in the race that is viable, democrats will leave joe biden and go with that candidate if they think this person is viable. not the same with donald trump. >> harris: he has anybody but biden syndrome. thank you. a showdown over parental rights in virginia just as children are headed back to school today. several districts are defying the governor's gender identity policies prefer to substitute their own judgment on the issue. jason rantz next. jason rantz next. mlb chooses t-mobile for business for 5g solutions... ...to not only enhance the fan experience, but to advance how the game is played. now's the time to see what america's largest 5g network can do for your business. the first time you connected your godaddy website and your store was also the first time you realized... well, we can do anything. cheesecake cookies? >> virginia governor glenn youngkin supports the new policies and his office expects every district to follow the rules. so far the governor nor attorney general have yet to say if they will challenge the schools in court. over the weekend governor youngkin did not address the controversy specifically but told a conservative crowd in atlanta says his agenda is under attack by a powerful lobbying group. >> the teachers union were fighting us every single step of the way. they still do. we've got to continue to recognize that the role of the teachers unions in america is not to progress their children and families. it is literally to be a political organization. >> speaking of politics fox news finding in a poll that 48% of voters think too much time in class is being spent on sexual and gender orientation issues as opposed to math, reading. the same concerns we've heard on the campaign trail quite a bit, too. >> especially coming out of the pandemic when so many kids across the country were on devices, too much time on a device hurts is brain is what we were told. we were forced to put them in front of the devices. we were twofold if a man comes into a bathroom screen and now we have to deal with biological men in the locker room. jason rantz. author of the book what's killing america. your response to what is happening to those school district challenging youngkin's policy. >> they do it to their own detriment. this state has led the country in pushing back on the battle between teachers, teachers unions and schools deciding they know what's best for kids and the parents who rightly step up and say no, i will love my kid more than you ever will. i know what's best for them. of course, when you look at it more globally in this country very clearly according to that poll in every other poll taken we're on the right side of this. the parents saying there needs to be a clear separation between the gender identity obsession and schools is pretty clear. i wish they would just learn from that. all they are doing is creating a larger wedge between families and schools. which i don't think does a service to these children. you want everyone to basically be working in concert with one another. unfortunately you have radical left educators who are trying to take total control. >> harris: it's interesting. what do you think the kids are talking about at school in the four districts as the administrators and teachers fight with the governor over gender identity? they are probably talking about that. shouldn't it be all the other things that will make them cot pettive in the workforce. parental rights in new jersey taking a temporary hit after a lawsuit from the state attorney general. a judge just blocked three school districts in new jersey from enforcing a new gender policy while the legal process plays out. and it could take years. until then, those schools cannot tell parents whether their children as young as five years old want to change their gender identity. an attorney for one of those new jersey school boards says this, quote. the school district is severely constrained in its ability to notify parents about important issues involving their minor children which is concerning on many levels. a new jersey mom told fox she is now worried about her child's safety. >> i feel like what happens if my daughter uses the boy's bathroom and something happens to her in there? is the school going to notify me that something happened to my child in the bathroom? i don't know. where does the line get drawn? who is responsible? >> harris: jason. >> two things. number one i hope every single parent across this country is looking at a story like this and taking this away from it. talk to your kids. have better relationships with your kids. you need to make sure that they trust you enough to tell you what is going on in the school but are also aware enough to flag certain issues that are coming up in the school so that these educators and administrators aren't trying to keep things from parents. two, all of these policies are rooted in a lie, a falsehood. an assumption that these kids who maybe are going through some gender identity confusion come from abusive households. they do not. the vast majority of the times they simply feel a little uncomfortable talking with their parents. i felt uncomfortable talking with my parents about sex and gender like everybody else. i think these schools would do better to try to bring them together, the kids with their parents because those are the relationships that ultimately matter. when it comes to any of these topics. i just wish they would understand we already have laws and policies in place for kids who are coming from abusive households. >> harris: yeah, it's true. they aren't going to teach the children our values in each home. they couldn't possibly. >> exactly. >> harris: jason rantz. thank you for weighing in and thank you for watching "the faulkner focus."
