administration is wavinging them in. here is what's happening on a daily basis at key crossing points. federal government releasing bus load after bus load of migrants to private organizations where they are being assisted with travel to cities and states across the country. little fear of deportation when they cross that border, dana. >> dana: we want to take you to one of the flash points along the border. bill melugin is in mission, texas. good morning, bill. >> good morning to you. the day before title 42 ended back in may dhs secretary mayokas held a press conference at the white house where he promised tougher consequences for any migrants caught crossing illegally after title 42 ended. listen. >> i want to be very clear. our borders are not open. people who cross our border unlawfully and without a legal basis to remain will be promptly processed and removed. >> will be promptly processed and removed, he said. that's not the reality of what we're seeing on the ground here in the rio grande valley where we continue to see mass releases of migrants from the federal government. our team shooting this video in just a few hours in mcallen outside of catholic charities of the rio grande valley, we witnessed bus load after bus load of migrants dropped off by the feds. family units mostly. once they get to the charity they get helped with travel paperwork and going across the united states. some will have court dates several years into the future. border patrol agents telling us migrant families when they encounter them don't hope for release, they expect it and they have little to no fear of deportation when they turn themselves into agents in the field. this is just one location like this. there are many of them all across the southern border where these mass releases take place. take a look at this video here in the rio grande valley in mission. our team embedded with texas dps had their eye on a human smuggler guiding a group of illegal immigrants through the brush. he was taken down, a 26-year-old mexican national charged with felony human smuggling as that cat and mouse game plays out every day and night in mission, texas. we bring you to eagle pass, the drone team over more groups of migrants trying to cross illegally despite all the fortifications the state of texas has put up. row after row of razor wire. they find a way to cross illegally as the del rio sector continues to see 70900 illegal crossings per day. back out here live, guys, you guys heard the video, secretary mayokas said himself tougher consequences if you are caught crossing illegally between ports of entry, processed quickly and removed quickly. reality on the ground is often very different than what we hear out of the white house or dhs. the migrants know it. that's why they wave to our cameras and look for border patrol to turn themselves into. most don't believe they will be removed. send it back to you. >> dana: incredible video as well. >> bill: thank you, bill. four minutes past. fox news alert. news breaking now. the lead attorney for hunter biden, christopher clark, asking the judge for permission to get off the case. remember there is a noon deadline where the judge wants an answer as to what biden's team will do next. david spunt following all that tells us what it means now from the department of justice. david, hello. >> this is significant news. the lead attorney chris clark and a close confidant of hunter biden for years. he represented him for years. he is trying to get off this case. he was the lead architect of this plea deal with the department of justice and it fell through in public in the courtroom on july 26th. abby lowell, a washington powerhouse attorney here in the district of columbia, is now representing biden in this case. lowell has also worked with biden before. right side of the screen and clark on the left side with the glasses. hunter's team is well aware of the two tax violations that were supposed to be part of the plea deal but no longer and may go to trial. however, abby, lowell insists a diversion agreement to avoid jail time for a gun charge is already signed by the government and hunter and is valid. in their filing they wrote the defendant intends to abide by the terms of the diversion agreement that was executed by the defendant, his counsel and the united states. the parties have a diversion agreement. we'll see what the judge said. she had big problems with this diversion agreement inside the courtroom in wilmington, delaware. david weiss is the special counsel investigating the case. he just sat in the courtroom a few feet away from hunter biden and was prepared to enter into this plea deal. the case will move toward trial in washington, d.c., california or both. that filing from hunter biden's team came out on sunday and the judge is giving the government until noon today to see how they want to move forward. what do they have to say? we'll see in a few hours. >> bill: thank you, david spent with breaking news from d.o.j. >> dana: bret baier, special report anchor. i was thinking since chris had been his lawyer for so long but the situation has changed for the biden team. bringing on abbe lowell to take on this case would mean probably make sense. if chris had been the one negotiating with the justice department for the plea deal, it probably makes sense for him to not be the person who will try to clean up the mess on the other side. >> right. good morning, bill and dana. i think according to delaware statute, he can't be the lawyer for hunter biden anymore because he is a potential witness in how that plea deal was structured and how it was negotiated. so by lending himself to being a potential witness by delaware statute he can no longer be the lawyer. the crazy part about this whole thing is that plea deal unreverb ravels in court. a judge digs in and says what is this and buried in the language is a broad immunity deal that they had structured. that essentially he would not face anything else. and she went down that road and figured it out and then it all came apart. i think how that plea deal was negotiated and what exactly went into it will now be a part of proceedings going forward. >> bill: let's do lightning round. that's topic one. topic two the border. you saw the video from bill melugin. all the concert wire and crates. seven prominent democrats and one independent have now called out the federal government, the white house, for a federal crisis of inaction. put them on screen. call for number one. here they are. might recognize the names. gentleman from chicago, lopez. robert f. kennedy. our mayor in new york and the governor in massachusetts as well. is the white house listening to their concerns, bret? >> that's a great question, bill. i do think this list is limited and that there are many more democrats who have concerns but they might not be as vocal. many democrats in the border states, mayors and lawmakers in the border states who have real concerns. these are vocal. senator mark kelly has talked about what's going on. now you have these democratic mayors, democratic governor in massachusetts who are saying this is untenable. for all the criticism those republican governors got for moving the migrants from the border to these different states, it has spurred action. you can't take that away. and you can question the way they did it but it definitely has changed the dynamic. whether the white house is listening or not is a great question. >> dana: might be hard to hear over the waves of the ocean. let me ask you about president trump indicted again last night. here is jonathan turley call for number four. this is from the 9:00 a.m. hour which he calls it excessive. >> it's excessive and i think it's also dangerous. it criminalizes challenges to elections. there is no sort of limiting principle in this document. they are charging things like the president saying publicly we need to have a recount. democrats and republicans challenge these elections routinely. >> dana: all right, bret, your assessment after last night's indictment. >> you add it up. it is 91 charges against the former president in large all of these four indictments. that adds up to if he was convicted of everything more than 1,000 years in jail. it is quite something in the scope of it. this particular case is a rico case. what's challenging is they have 100 possibilities, all the jury has to get to is two of them. like picking from a menu. you take the soup and half sandwich or you could take the soup and the chips. but you pick two of them and suddenly it's a rico case. i think what the d.a. is doing here is trying to get the other 18 to turn and a lot of them are in a position where they may just do that. >> bill: she wants to have them all in the courtroom at the same time. that would be a picture. >> that's just impossible. >> bill: cameras in the courtroom are allowed in georgia. we'll see whether or not it happens. >> dana: a reminder the first republican primary debate is one week from tomorrow night right here on fox august 23rdrd. mark your calendars. it is in milwaukee. bret baier and martha maccallum are the moderators and we'll be there covering all the action and reaction and get you set up for the debate. tune in for the brand-new perino on politics podcast launching next week. wherever podcasts are available. there is the picture. 20 to 25 minutes every monday, that's it. all you need for the monday. >> bill: speed 1 1/2? >> i'm impressed with their findings, bill. what they did that no one else has done before is looked specifically at smoke from wildfires, particulate matter 2.5. lung experts across the country have known for a long time it can be associated with problems. why? it is so small. those particles are so small and previous studies out of the british medical journal have shown up to 40% increase in dementia. viewers want to know why am i talking about the brain when it's coming through the lungs? the answer is, it's so small it crosses the blood/brain barrier into the brain. another study out of the university of north carolina shows that it causes neural inflammation in the brain. we know from increasing research that if the brain gets inflamed, it can lead to alzheimer's and dementia. we've been focusing on the abnormal proteins in the brain but inflammation is the key. these particles in your body can lead to inflammation. increasing amount of research showing this. >> bill: let me show our audience. number two, guys, the smoke from the canadian wildfires that drifted for several weeks into the u.s., my primarily in the northeast and they call it pm2.5. a tiny particle, right? so tiny it is invisible. so if you were to advise your patients to wear a mask, it would do no good with an invisible particle, would it? >> the mask wouldn't do much but i want to point out to the viewers and to my patients that i've been treating a lot of asthma lately and sending people to the e.r. when i worked in the e.r. i dealt with asthma and responses like emphysema getting worse from exposure to wildfire smoke. i've always wondered what's the long-term risk. it is tiny and invisible and you can't wear a mask all the time and it probably wouldn't stop it, either. just a way of saying there are long-term risks. this is not proof, bill like we took one large group and didn't expose them and another large group we did expose them. this isn't harmless stuff. this stuff is getting into your body and can affect your brain especially in areas where there is a lot of air pollution in areas a lot of wildfire smoke over many months. that's the key. >> bill: last question for you. 6 million americans have dementia. we're told that number could rise. when you have a patient can you do anything for them? >> there are. there is a lot of special forces units that worked with a lot of our counterparts, their counterparts in the u.s. as well as with our intelligence agencies who have been left behind who are always in hiding and trying to stay out of the grasp of the taliban. >> dana: what about those who you were able to successfully get back, the partners that were afg afghanis. >> most are stuck in processing centers in other countries, in third party countries that have accepted them and are then allowing them to file their paperwork. the last reports i've seen they are talking to get them all processed, all of those that are seeking asylum, the next 10, 15 years to do that. >> dana: which is unacceptable. there was also injuries and deaths of our men and women in uniform there and i want to play for you a little sound from this march 8th hearing that took place. it was very powerful to listen to sergeant tyler vargas andrews. he was very brave to testify. listen here. >> over the communication network there was a potential threat and i.d. attack imminent. this was as serious as it could get. i requested engagement authority while my team leader was ready on the sniper system. leadership did not have the engagement authority. do not engage. >> dana: the administration continues to say there was no chaos or disaster. it is the greatest airlift in american history. young men like him are still living with this every day and they are looking for accountability. don't feel they are getting it. >> no, they're not. and it is unfortunate. if i'm not mistaken, i think the marine that was testifying there had lost two limbs if i'm not mistaken. so he is going to live with this for the rest of his life. the injuries of what could have been done and what could have been done better and this administration is trying to paint this with a broad brush to make it look like they were successful when the planning of it from the very get go was a failure by just choosing to do the escape out of the cap you will airport instead of bagram. a much better facility to do that from. >> dana: what do you think will be the long-run consequences of this exit? is that fair to all women who spent their whole life chasing their goals? where are all the women's rights activists and feminists? it is a great question. what have you heard from people since you decided to speak out on this? >> i did a lot of support. to be fair i'm seven feet, 270 pounds. if i decided to identify myself as a woman and decided to play in wnba, put on a wig and changed my name is anisha it wouldn't be fair to the women who chase their dreams since they were a little kid. that's what i'm saying. what are all the women activists and the feminists who has to stand up for these first? it is very interesting why this should be even a debate, you know? we just need to do whatever we can, all the male athletes should do whatever they can to bring words to this. >> dana: what would happen if you put on a wig and were to try out? to a person they say homelessness, st. louis. small towns in colorado. it is exploding. this number is probably an undercount. >> no doubt it's an under count. a good place to study this is california, which has seen the biggest jump not just number wise but percentage-wise. a great study from the uc san francisco just a couple of months ago. they essentially blamed it on the local governments. inability to build affordable housing. a lot of these towns, regulatory issues, tax issues, all the burdens it takes for just to start a business, same thing, 90% of the folks there lost their homes and why they are homeless. there are drug problems and mental health issues. and here is something that's really interesting. president biden just had this supplemental budget he wanted the $40 billion for? right before 14 democratic senators led by senator jack reed urged the administration to add homeless assistance. so democrats were pleading with the president if you give ukraine $24 billion can we do $5 billion in emergency housing vouchers because this is a problem around the country. again, you have senators, democratic senators from ohio, minnesota, connecticut, new york, vermont, rhode island, oregon, hawaii, arizona, georgia, massachusetts. it is a national problem. it is a serious, sad, tough national problem. >> bill: put this up, guys. rise in housing costs, we touched on that. lack of affordable rental units and opioid crisis. those three things go together? >> they do. some of it, i think the mental health issue probably is up there right with opioids. although sometimes the mental health leads to drug use. i don't know if they added that in. that's a huge issue as well. it is a serious, serious -- think about this for a moment, right? so 580,000 homeless, president biden set aside $3 billion. media went crazy. $8 hundred thousand student loans he will give them $39 billion. think about the priorities for a second. for someone who is supposed to be compassionate. 39 billion for people who are going to make the most money in the world versus 3 billion for almost the same amount of people who are homeless, helpless and struggling to make it in the greatest country in the world. >> dana: the other problem is nonprofit organizations, the organizations that try to deal with homelessness is like a black hole. money goes in. i'm not saying but it is nefarious. it is not working. they had to admit they don't know where all the money went. >> i grew up and used to go to some of these programs. some of them are great. a lot of them are actually programs of themselves. they will be programs to help drug addicts but run by former drug addicts. you need people in there from the private sector who know how to operate an organization. even if it's a nonprofit organization it needs to be run where there are audited results so we can keep donating people. people want to see results for that. i think one of the problems a lot of the operations themselves of these organizations are experimental and maybe they are well meaning but not getting the job done. >> bill: good stuff, charles. thanks for being on it. the migrant crisis will continue. >> particularly in new york. >> bill: all over this city right now. former new york city college professor who threatened to chop a "new york post" reporter with a machete could be getting a plea deal. she appeared in court yesterday and the judge discussed a possible agreement from prosecutors after getting a letter from a neighborhood program that offers counseling and community service. some consider that as easy plea if that happens. >> dana: don't forget she didn't just do that but chased him into the street and he was asking her what had happened in the classroom. >> every week you see something you've never seen before in this city. >> dana: haven't seen madonna in the neighborhood >> bill: i have six more days to come up with something. before we go, i got this for you, perino. roll it. charles, you too. a tourist waiting in the historic fountain to fill up her water model. onlookers were gobsmacked. security guard was later seen leading her away. it must have been hot the rome and that water must have looked good. here comes security in the yellow jacket. >> used to be a term called the ugly american. what the hell are you filling up your water bottle?
