wildfire updates. what can you tell us now in. >> reporter: hey there, griff, good morning to you. we're alongside one of the main entry points into the town of a lahaina. people here have been lined up for hours, some of these folks sleeping in their cars waiting for the curfew in the town of lahaina to expire. some of these people have nothing left, they just want to get in, see what's left of the town. take a listen to some folks about what they've seen there. >> i want people to know that there are people out here suffering, and we need donations. we need, we need people shipping things out here. we need families fed, we need -- yeah, we need so much men -- help. >> reporter: home after home in lahaina, gone. one estimate from core logic puts the estimate of destroyed homes at more than 3,000. the rising death toll now at 80 people as rescue crews search for more victims. thousands of people have now left the island, and around 1400 are currently staying in emergency shelters here. it's still unclear how the fires started, but the the island was ripe for an inferno. extremely dry conditions combined with 70 80 # mile mile-per-hour winds caused in part by passing hurricane dora created a challenging battle for the island's firefighters. residents say they were given little warning and that the island's emergency sirens didn't go off with texts being sent out instead. many escaping with just their lives, some in lahaina jumping into the water to save themselves as this town was razed by fire. the coast guard says it rescued 17 people. >> they were fortunate to have been there during the rescues at a time when the smoke lifted for them to be able to see the people who needed to be rescued. the helicopters that were launched were actually not able to approach closely enough during the worst of fire to see through the smoke. >> reporter: power and cell service is slowly starting to return to the west side of the island, but now another challenge. the water there now undrinkable because of toxins in the water caused by these wildfires. griff, back to you. griff: wow, max. you know, the images you're showing are devastating, and that that plea from that young man is just heartbreaking. >> reporter: yes. griff: is there any indication that the residents like him are getting some help? >> reporter: help is on the way. the american red cross is on the ground, the county is mobilized, distribution points for water and food. but there is us from ration from locals. you know -- frustration from locals. the curfew has kept people out for ours -- hours, people not able to access their homes that have been maybe destroyed, they're not able to get in. so on one hand, there is help available, there is help on the way, but still a lot of frustration from locals who say the help is not coming fast enough. griff: max gorden live for us on the ground in maui, good reporting. molly: the american red crosses is assisting locals with recovery efforts after this, the worst natural disaster in the state's history. for more on the relief efforts that are going on there the on the ground, we have the national spokesperson for the american red cross, evan peterson. evan, thank you so much for joining us to give us some insight. max was detailing some of the big challenges there from the water system to these incred by long lines of people who want to get in and take a look at their homes, what may or may not be left of them. so some 3,000 people without homes now, homes destroy. what is the red cross doing right now there on the ground? >> yes. and you're absolutely right, the devastation of this wildfire has impacted thousands of people. it truly is devastating. everybody is impacted by this. i ebb mean, i've been here for about almost 24 hours now, and i can tell you there's not a single person i've met down here who doesn't have a family member, a friend, a loved one who was running for their lives x. so our hearts go out, and we want them to know that we are here. right now our focus is -- [audio difficulty] we are are working with municipalities, the governor's office, the national guard, we're working with fema to make sure that we can set up shelters where we need to, we can get resources, food, water, comfort kits to them and also be that thread, be that neighbor to talk to. it's no shortage of the imagination that people have undergone something traumatic here. sometimes they need that spiritual care, someone to listen. we're going to be there for that through all of this. molly: yeah. of it's heartbreaking when we see these aerials shots of just how tremendous the damage is. enormous logistical challenges as well. one of the most difficult parts of this is there are still so many people missing. how can people continue to look for their loved ones if they have yet to be found at this time? >> i want to tell you about a story that i encountered yesterday. i was flying -- and peeking to my flight attendant who said they had a gone two days without hearing from a relative who was caught up in the fire. it was hours before they took off they got that note saying we found them, they are okay. there are so many other stories like that, and the red cross is really trying to help people with reconnection. there are some challenges, there's still major infrastructure down, so cell service, internet, things like that, but we encourage people right now we're asking them to call 1-800-red-cross, 733-2767, and and you have options on this how people get connected to their loved ones, and we can start relaying those messages. molly: you know, you were talking about where you're standing, where this devastation is. there's a hot of inter-island heart there in hawaii. what are the people hawaii doing between island to island to help out there particularly in this devastated community of lahaina? >> i can't speak to specifically what people are doing, but what i can tell you is at that the american are red cross is really making sure that everybody is having someone to talk to and getting resources and connecting them to those -- i mean, for instance, at last check we had 2100 people stayed overnight in our shelters, but during the day they're actions -- acting as -- [inaudible] sometimes although internet connection may be spotty, people are coming in and charging their phones, getting water to take back home to their friends, their family, getting a bite to eat at our place. we are making sure that we can help them try to connect with people wherever they are -- [inaudible] molly: yeah. that reconnection, you know, can heal so many hearts right now. there was an interview earlier today, a young woman from lahaina who said she didn't know which of her friends were alive, which were dead. there's still so much confusion there on the ground watch's the greatest logistical challenge for the red cross there? >> i think you just said it, i mean, right now we are hours away from the mainland, but we are getting supplies in, we're getting people in. so those resources are coming, but right now it's just the logistics of dealing with this wild wildfire. we saw it spread so fast, so rapidly, so chaosically at times. -- chaosically at times. with we don't want to direct people to areas that aren't safe, so we're still trying to work with our local officials on the ground and communicate, okay, are these hot spots gone, where can we start moving in to help people and also just simply how can they get to us. it actually is a big problem. trying to find ways to spread messages whether it's through interviews like this, whether it's serving out alert systems or or even just driving down a community's street just making sure once these areas donation. ♪ griff: attorney general merrick garland appointing a special counsel in the hunter biden investigation as hunter's plea deal reaches an impasse. lucas tomlinson is live outside the white house with the latest. hey, lucas. >> reporter: griff, justice department now has three active special counsels investigating the president of the united states, his son and a former president of the united states, a former attorney, acting attorney general thinks this is the reason why this latest special counsel was started to investigate hunter biden. >> question is why now, what has a happened, what has changed. and i think what has changed is that the congress and representative comer and chairman jordan and others have found evidence. there is a lot of smoke surrounding the case, and now they can't sweep this under the rug. >> reporter: republicans have been calling for a special counsel for a long time, griff, to investigate hunter biden, but many in the gop are not happy with david weiss who has already been investigating hunter for the past five year. the appointment of potential counsel allows weiss to bring more charges outside the state of delaware where the u.s. tone. here's jonathan turley about this plea deal and the additional charges. >> there's no question this magnifies the danger for hunter biden. his attorney told the prosecutor in the courtroom, well, let's just rip it up. well, that doesn't go over well with most prosecutors, and there are some major charges out are there like a fara violation for being an unregistered foreign agent that can be brought forward. they can end up elevating some of these counts to felonies. he is not in a good place. >> reporter: recall just a few weeks ago up hunter biden walked into that delaware courtroom where he thought he was just minutes away from being a free man, free from being charged any further. of course, that all fell apart and he could -- this could be going to a trial. there's no question t not just what hunter biden or his family or the white house wanted, especially president biden running for re-election in 2024, griff. griff: lucas tomlinson live for us on the north lawn, thank you. ♪ ♪ molly: all right. check it out, gop presidential candidate vivek ramaswamy speak ising right now at the iowa state fair just earlier to the he had a chance to sit down with the state's wife, of course, they're speaking. for more from the iowa state fair following all of the candidates, alexis mcadams live this des moines. alexis, to you. >> reporter: hey molly. in between the time we talked to you last, we can tell you former president donald trump is now on the ground in des moines, iowa, and is he's heading to the iowa state fair. a lot of crowds waiting to get a glimpse of him as he'll be flanked by lots of security and voters who just want to say what he's going to -- see what he's going to say on the fairgrounds. ron desantis has been shaking hands and talking to everyone here, he says one of the top issues he's a heard from iowa voters is all about the economy. listen. >> bidenomics is basically americans have a lower star of living so -- standard of living so that he can pursue his political and ideological agenda like the green new i deal. that is unacceptable. you have to have an economy where people work hard, play by the rules, get the most out of their god given ability, and they can raise a family, buy a home, afford a car, do all those things. >> reporter: desantis' team does confirm to me this afternoon that he's bringing a gaggle of iowa legislators with him to the fair today. this move comes after donald trump announced on wednesday he was showing up with nine florida republican members of congress who endorsed him over desantis. here on the same day, there is a lot going on. the two gop front-runners competing for voters' attention today, they've beening gaggling all over here. other presidential hopefuls including vivek ramaswamy and nikki haley have walked the grounds as well, showing off their personalities and talking with voters about what they would do for america. i caught up with senator joni ernst who tells me this is a make or break moment for some of these candidates >> they are going to face hard questions from iowa voters. and it is important. iowa is a great place to come, we can winnow the field and make it easier for some of these follow-on tates. iowa's an inexpensive place to be, and that means if you're not a go zillionaire and running for president, you can come into iowa and meet voters. >> reporter: it's all about likability here at the state fair. we're in the heart of the midwest, and people really don't want to tub some of the policief the policies at the debate, but with they want to see their likable, how they communicate, how they hold some of these babies, eat corn on the cob. you name it, they're doing it, so we'll see how it all turns out. molly: eating corn on the cob in front of a dangerous people, that is always a dangerous -- a bunch of people, that's always a dangerous thing. thank you for covering it for us, alexis mcadams, we appreciate it. griff: for more on campaign 2024, joining us to the marc lotter, america first policy student chief communications director, and david defurry, former obama campaign foreign policy adviser. let's pick up right where alexis left off, if can that is you go to the iowa state fair, you pay homage to the butter cow, you eat pork chop on a stick and you get to see the candidates. i vivek ramaswamy was about to be joking now ♪ the claps come out, time's up, snap back to reality -- griff: so they got to see that, that is not a career politician as vivek's surrogate, ben yoho, pointed out in the last hour. is that good? does that help, marc, or would you want your candidate to steer very clear of that? >> i think back in the old days that would be considered a bad thing, but i think now people want to see the candidates more as being real people. i'll even go back to bill clinton playing the saxophone. it's just a real moment that a says, no, you're not just this person who appears on television behind a podium, you're actually real. and so it takes guts -- i would not have rapped up there. laugh rah laugh griff: well, i'm ott not sure the crowd was really into it. they may have been shocked. what do you say, david? >> he's from my hometown, cincinnati. he's not a trained politician, experienced politician, he hasn't done this before, so there's some of these off the cuff appointments that i do think have some appeal. he got the words right, he looked like he did it april well, so i give him an a on performance. griff: all right, let's talk, you know, i was so excited when id had you guys in here today. i wanted to talk about as we get closer and closer, i know iowa's kicking off to the election, and fox, of course, has the first debate coming up >> just a -- in just a few weeks. it seems it is investigation after investigation, scandal after scandal, the issues are almost absent. no one's talking about health care, few people are talking about inflation but yet, obviously, we had the hunter biden internal counsel announced. what do you make about that, marc? are we in danger of missing the issues, or does that come later in >> no, i think it comeses later. at the end of day, i think it's going to be a wash. obviously, the former president, you know, will face charges as he does, many people think that joe biden should be facing charges, and we'll see if he does. but at the end of the day, they will discount both of those and say who's going to lower my gas prices, who is going to secure the border, who is going to bring us back to those policies where where america was winning again and not what we have going on right now. and so i think, yeah, it's easy right now to focus on the investigations and the information that -- investigation that's to come, but in the end i think people are going to vote with their pocketbook, on the issues and policies. griff: what about you, david? the how much of an impact do you think -- take just yesterday the announcement of the hunter biden special counsel. how much of an impact do you think that has on this race? >> we've seen this coming for a while. trump has been indicted at three different courts around the country, could be in a fourth cart in georgia. it's going to weigh on his campaign, and now we see the special counsel being announced for hunter biden. and and so this is going to be a big issue. and most importantly, it's going to be a distraction for the candidates themselves. but notably, joe biden is not under investigation, and there's been no ed that's come forward to -- can evidence to suggest that he's committed any -- griff: we don't know -- >> that's true, it's going to be hard for him to see his son going through this. i think what's important is jack smith, both when he announced the indictment on the classified documents case and the january 6th crimes, he said he's innocent until proven gl. the same holds true for joe biden -- excuse me, for hunter biden. he's innocent until proven guilty. it's good that we have special counsels in both cases, and let's let them do their job. let's let the process of rule of law play out, and let's try not to let it be a distraction. it's going to really weigh on the candidates. griff: great point you're making although just to interject one thing, we don't fully know -- garland was asked whether or not this special counsel now, the scope of it, will involve influence peddling and possibly joe biden himself. we don't know the answer to that. it may are well be the case. but the larger point is with so many investigations, special counsels going on, are we nearing a dangerousing area from which we can't come back in terms of politicization of politics? i mean, we know if former president donald trump gets back into office, he's promising we're going to see more of what we've got right now. >> see i don't think this is pretty case. on both sides -- politicization. they both did things that deserve investigation, and it would be political if we didn't investigate them, if we didn't appoint special counsel, if we didn't treat them like any other person, all of whom are subject to the laws in the united states. so it's really important that we let this play out. and i would also note that for donald trump, he's going to make all sorts of defenses. he's going to conflate his campaign with his defense in these cases, but i hope that he tries to focus on the issues and his platform when he's talking, when he's campaigning around the country and he saves his defenses for court. griff: i'm not even sure he needs to though, because every time he gets indicted, his numbers go up more. marc, can any of these other candidates, desantis, ramaswamy, tim scott, nikki haley, can they break through with so much attention being put on donald trump and the in investigations? >> no, it's other. i mean, donald trump is up by 40 points in the real clear politics average against his closest competitor. john mccain was up -- sorry, trailing by only 14 points on this day 2008 cycle. and he was able to come back. there's a big difference between 14 points and 40 points. i mean, this nomination is all but over, and now the time is for everyone on the republican side to focus on the real opponent if which is joe biden. griff: i love the fact that we record shows because if something changes in six months, i'm bringing crossings. i'm told by sources yesterday alone there were more than 1,500 illegal crossings just here in the rgv sector. we'll show you what we saw last night. right here where i'm standing after the sun went down, groups of migrants starting to cross illegally, predominantly family units, parents with their kids, little toddlers, unaccompanied young children, that sort of thing as we're starting to see a return of families crossing in big numbers here at the border. then as you take a look at this video of migrant buses that texas has been ebb sending to sanctuary cities, confirming that a young migrant child passed away on one of their migrant with buses to chicago. they point out, the state of texas does, that everybody signs a voluntary consent waiver, they get water, food, air-conditioning and when the child started getting sick or whatever happened, they called 911, and they had a translator for the parent. she was taken to a hospital where she later was pronounced dead. state of texas putting out this statement which reads in part, quote, after being processed by u.s. customs and border protection in the city of brownsville, each bus passenger underwent a temperature check ask was asked if they had any medical conditions that may require medical assistance. following this check prior to boarding, no passenger presented with a fever or medical condition. excuse me. an autopsy is now underway to try to determine the cause of death, and it is turned investigation. lastly, we'll take you out to arizona, another fentanyl bust in the nogales port of entry. cbp officers finding a stow hidden in the engine room on a train. that guy had a bag on him with 109,000 fentanyl pills and 0 pounds of meth on -- 10 pounds of meth on him. that nogales counsel in the hunter biden probe as some republicans question if weiss can be an unbiased investigator pointing to the weiss work on-upper biden's plea deal -- on hunter biden's plea teal that fell apart last month. alexandria hoff has the latest. >> reporter: good to be with you. some republicans never liked the idea of a special counsel, house oversight committee chair james comer has long felt it would take away the investigative power from the house gop if as committees continue to probe the biden family. >> i don't think we need any more evidence to hoe that the the president of justice is trying to obstruct our investigation. i think merrick garland made that argument for us today. >> reporter: house speaker kevin mccarthy stated this action cannot be used to obstruct congressional investigations or hate wash the biden family corruption. weiss negotiated the sweetheart deal that couldn't get approved, how could he be trusted as a special come. some republicans are -- special counsel. senate chuck grassley, for him it's weiss that's the cause for concern. >> i sent a letter saying we should is are a special counsel. on the other hand, i have some question about weiss doing it. >> reporter: well, that's because there's been so much back and forth. in may, irs whistleblower gary shapley testified that u.s. attorney weiss sought special counsel status because he felt limited in his powers to fully investigate hunter biden. weiss and attorney general merrick garland disputed the claims, now here's shapley's attorney. >> to choose that very same person to go ahead and elevate them to special counsel status when he has been claiming to congress all along that he didn't need it is, seems like an odd choice. >> reporter: and, griff, last hour you spoke with democratic congressman ami bera, he provided his thoughts. >> it's good for the country to see a former president on trial or, you know, a president's son on trial. i just would hope that there's a way to resolve these without putting the country through either one of these cases. >> reporter: well, critics also argue that appointing a sitting u.s. attorney goes against doj regulations which state that a special counsel should come from outside the justice department, griff. griff: no shortage of thoughts on this issue, and a lot more to come. alex, thank you very much. molliesome if. molly: all right. for more on the potential legal fallout from the special counsel appointment and how it might affect the hunter biden probe, we have constitutional attorney smith joining us now. thank you so much for giving us a little bit of your time on a saturday. this ongoing probe, there's kind of a new era, a new part of it now that we've seen this appointment of special counsel although the same prosecutor that nearly got hunter biden that plea deal that fell apart. this could take quite a while. here's comer from the oversight committee kind of talking about their concerns. the move by attorney general garland is part of the justice department's efforts to attempt ad biden family cover-up in light of the oversight committee's mounting evidence of president joe biden's role in his family's scheme selling the brand for millions of dollars to foreign nationals. your thoughts on that, a cover-up, a stall tactic. >> well, let's put this into some perspective, molly. let's go back to the 19900s where ken starr was appointed the special counsel to investigate bill clinton and all of his various issues. keep in mind that ken starr was appointed, he did not work for the department of justice, he did not work for the attorney general, janet reno at the time. he was picked because he was a prominent attorney from outside of the united states government, from outside of the department of justice. that's how special counsels are supposed to work. and as you mentioned, the regulations that govern the department of justice specifically state that a special counsel is supposed to come from outside of the government. because remember, it's not just about making sure that the process is complete, come we e hencive and fair -- comprehensive and fair, it also has to have the proper appearance of or fairness. and again, here you have david weiss who literally works as an employee for the department of justice under merrick garland being picked by merrick garland, the hand-picked attorney general of joe biden to investigate joe biden's son. obviously, the optics don't look right here which is why you're supposed to, if you're the attorney general of the united states, look outside the the president of justice to -- the department of justice. molly: republicans have been i leasing new information, new bank records, the latest from the house committee on oversight and accountability detailing payments made to the biden family from russia, kazahkstan and ukraine. the president doesn't seem to enjoy being asked about those revelations. here's peter to do city asking the president a question a few days ago. >> reporter: there's this testimony now where one of your son's former business associates is claiming that you were on speaker e phone a lot with them, talking business. >> i've never talked business, and i knew you'd have a lousy question. >> reporter: well, what -- why is that a lousy question? >> because it's not true. molly: what role do you think congress should play at this point in time? >> well, you know, given the fact that david weiss said that he was going to come and testify to congress in september and now that he's been made the special counsel, one wonders if he's going to show up, and if he does show up, is he able to talk about the hunter biden investigation? certainly, one of the issues you have to start to look to if you're the congress is whether or not this really does justify looking more seriously at things like impeachment if you feel there's some cover-up going on at the department of justice. and, again, you know, congress does have an oversight role. that's part of the process of being one of the branches of government. department of justice is supposed to do their job but, again, congress is able to to hold people politically accountable especially if they feel the department of justice is not doing what they're supposed to be doing. molly: president trump is out in iowa today on the campaign trail. meanwhile, the u.s. district judge in the case, specifically the january 6th case can, has warned donald trump and his attorneys about inflammatory statements and has essentially said it could potentially force her to speed his trial up on those charges related to his bid to overturn the 2020 election allegedly. there was a little shot from iowa there for just a moment. but your thoughts this -- on this, the prosecutors would like to see this trial start january 3 -- january 2nd. that is just before the iowa caucuses which are also slated to be in january. your thoughts. >> well, first of all, the constitutional right to a speedy trial wrongs to the criminal defendant -- belongs to the criminal defendant, in in this case president trump. it doesn't belong to the department of justice. so if anyone wants to speed e the case along, it's up to the defendant. now, of course, the alternative which which usually happens, molly, in these kinds of cases is the defendants need time to investigate and take what's moan as discovery, get their information together because, remember, the department of justice has been working on this january 6th stuff literally for years. so they've got their ducks presumably in a row to be able to try the case against president trump. but donald trump has not had that advantage, so he's going to need time to prepare his defense. there's a lot of allegations that are here involving various states and how the, you know, whether there were voting irregularities and the like, and donald trump may want to as part of husband defense look into those things, and that's all going to take time. anybody that thinks you're going to have a trial in d.c. in january, frankly, i think that's completely unrealistic, and i think the judge probably knows that. molly: mark smith, thank you so much for your insights. former president trump keeping a very busy schedule in iowa today as well. thank you for going the other way. inflation up in july, up in uni, and it's been up since president biden was in office. prices are up about 16% since biden took office, wages are down by about 3%. and this is why three-quarters of americans, when polled, say they think the economy's in bad shape. you've got record credit card debt that people are taking out ask and a 36% increase in what they call 401(k) hardship withdrawals. so if bidenomics is working, the average american certainly doesn't feel it. griff: when you really put your finger on i think what was the most significant thing, and that is if water after spotting a shark via drone yesterday, this as the beach increases shark surveillance following an attack on monday that left a woman in critical condition. nate foy is live with the latest right there from rockaway beach. hey, molly. the police and fire departments are using drones every dingell sr. single day, from 9 a.m. until sunset to monitor the water cans and try to spot any sharks before, god forbid, any more attacks. this comes after mononight's heart attack attack on a 65 year woman. yesterday there was another shark sighting, another scare here at rockaway beach. our producer seth was here for this. you see lifeguards pulling people out of the water. this process took ab an hour, and i mention it comes after a shark attack on mono, the first major shark attack in new york city since the 1950s. take a look at this next picture. here's how the drone process will work. if the fdny and nypd each have one drone that they will launch up. the pilot will look for any sharks underneath the surface to then alert the swimmers. the parks department will be notified and then the lifeguards will make sure everyone gets out of the water. listen to this. >> the lifeguards will shut down the beach immediately. then we'll make other notifications. we'll wait and follow that shark, see, you know, where it's going to go, and then usually if the shark goes away, it's usually an hour after the sighting or a mile on each side of the location the shark was saw. then we'll reassess, and then they will open the park, the swimming again. >> reporter: so the woman who was attacked monday night remains in the hospital in serious condition. she lost 20 pounds of flesh in her leg. originally was many critical condition, she's improving. since then officials have spottedded sharks about 25 miles east of where we are on long island and then again, of course, yesterday another shark sighting here at rockaway beach. back out here live, there are no swimming signs on the beach today, but people appear to be comforted by the presence of the drones. we have seen a lot of people going in the water. one hinge to point out, there are -- thing to point out, there are only two drones in operation right now, and five beaches are being patrolled in new york city. the eyes in the sky can only see so much is. molly: that is a great point and, boy, wishing that woman a school of fish. now, there's a little glare on the water so you can't see it, but this is exactly how the swimmers get nibbled because you're there where the bait fish are. i don't recommend, by the way, going into the water. there was a gentleman with his daughter, we told them to get out of the water. we got that shot, then we got out. molly: i was just going to say, where's the cage? respect you supposed to have a cage when you're swimming with heart attacks? griff: it was about 2 and a half, 3 feet of water, and once we lost sight of him, we got out too because we obviously don't want to
