[cheers] >> and continues to go perfectly to the miami script. >> brian: all right. we're beginning here with a fox news alert. former president donald trump expected to appear in a d.c. federal court, let me check my watch. make it later today, how about 4:00 where he is facing four new felonies claiming he made false statements about the 2020 election. >> steve: mr. trump is now fighting to move the case out of washington, d.c. where joe biden won by 95% last time around, where he says he would not have a chance at a fair trial. >> ainsley: 95% of them are anti-trumpers. and griff jenkins is live outside of the d.c. courthouse with the latest for us. hey, griff. >> griff: hey, good morning, ainsley, steve and brian. security is getting tighter here. a lot of media and as you mentioned, brian, 4:00 p.m. eastern we expect the former president to be here at the federal courthouse in d.c. facing his third indictment in four months and ahead of this one he is concerned about getting that fair trial. he took to truth social posting this yesterday saying. >> . the latest fake case brought by crooked joe biden and deranged jack smith will hopefully be moved to impartial venue such as the politically unbiased nearby state of west virginia. impossible to get a fair trial in washington, d.c. now, trump faces four charges in this indictment. three are on conspiracy, one for obstruction. and among the six co-conspirator listed but not named an attorney for john eastman says he believes his client is one of them and is prepared to defend eastman's memos to trump in the wake. listen. >> a eastman's advice was perfectly in the realm of good advice. if he goes to trial if is he convicted he will go to trial. we will never ever make a deal. >> griff: however, the man at the center of much of this case, former vice president pence is blasting his former boss and the lawyers who pressured him to refuse to certify the election results. >> it wasn't just that he asked for a pause. the president specifically asked me and his gaggle of crackpot lawyers asked me to literally reject votes, which would have resulted in the issue being turned over to the house of representatives and literally chaos would have ensued. >> griff: as we have heard much of this revolves around free speech issues. bill barr says special counsel jack smith has a high bar in prosecuting this case but agrees it has merit. >> i think it's a legitimate case. i think, unlike the document case, it's going to have issues of proof. it's a more complicated case. they are not attacking his family right. he can say whatever he wants. but that does not protect you from entering into a conspiracy. all conspiracies involve speech. and all fraud involves speech. >> griff: now, what we can expect to see here today obviously, former president trump coming here in the security heightened that it may resemble something similar to what we saw in june in miami when trump was there to be arraigned on the case involving the alleged mishandling of classified documents. so far, by the way, no protesters that we have seen out here will keep an eye on it and bring it to you as we get it. >> ainsley: tuesday night there were trump supporters and anti-trumpers outside in d.c. and that erupted into a shouting match. >> brian: did you hear anything about that, griff? >> griff: we're not really seeing much of that you know, i have been here every day since the middle of last week, and we haven't seen a large number. but, remember, in miami, because i also covered that for us. the protesters out there really took until the kind of day got going to see. so folks on both sides to come out. fortunately, in miami, it was peaceful. although there were some animated conversations out there. we will see what the day brings. the weather is supposed to be nice. maybe they will turn out. >> ainsley: did they put fencing up in front of the courthouse i know they did in front of the capitol. >> griff: they sure did. the fencing at the capitol is a little more hardened if you will at the risk of upsetting my cameraman les baker. back up a tad bit can you see behind me waist high railing do not cross lines that encircles the entire courthouse. >> steve: griff, we know police have been preparing for this arraignment later today but out of nowhere yesterday around 3:00 there was a mysterious bogus phone call that said there was an active shootner one of the senate office buildings. i know because my daughter-in-law was there and they evacuated everything. they said it's bogus but they think is probably one of those swatting things, right? >> griff: well, that's right. it appears that the senate got swatted as the headlines you have seen probably. and, the call came into 911. they reacted. listen, people are on very serious high alert here. >> this is a very serious situation for something like that to cou coincidently the day before the president comes to the court house. we are a stone's throw five or six blocks from the capitol hill, law enforcement all the way to law enforcement marshals working hand in hand to make sure everything is safe and secure today. >> brian: just one last question on something you just reported, you said earlier at the risk of upsetting my cameraman, griff, does he get upset at you a lot? are we getting -- is that a correct report? >> griff: listen, les baker is one of the best photographers in the nation he makes me look good. when i have to get him to pull back he might get upset, you know because it doesn't look as beautiful. i'm glad, brian, you are concerned about les. he will greatly appreciate that and getting me out of trouble for making him pull back. >> ainsley: where will we see the president go in at 4:00? >> griff: we don't know, ainsley, that's great question, ainsley. we don't know where we will see where he will go in because there are multiple entrances. front door behind me. side door. and a garage entrance. we assume he would go by motorcade into the garage area and that's a secure area there. we will have to wait to find out. >> steve: griff and co-star les we thank you for the live report from the pretty land courthouse. >> ainsley: thank you for not getting mad at the nice guy on camera. >> steve: by the way, when things happen today, we have been talking about the judge who is going to oversee the criminal time, that's not going to see who will oversee the president today. a magistrate judge is going to see. the former president will not be mugshotted; however. >> ainsley: not here. >> steve: he will be fingerprinted in d.c. the fulton county sheriff down in georgia says if mr. trump faces charges in georgia, he is going to be treated just like everybody else and he's going to get mugshotted. >> ainsley: fanny willis the d.a. down there will announce the charging decision in georgia by september 1st. >> brian: the president want it out of there. listen, i have got 5% of the vote. washington, d.c. not great place for me. that's where a lot of stuff took place. he put that on truth social. i don't know how successful what legal experts say convictions here regardless. punisher as a judge who serves in the same law firm as hunter biden. complex links that you could challenge and then there will be an appeal. and an appeal and probably end up in the supreme court. will this be first is the speculation. will mar-a-lago be second? will alvin bragg keep himself first excuse myanmar 20th. the next one in may the mar-a-lago cases. this one, i don't know where this fits. and then what about when the law teams stand up and say i got so much to go through i'm going to need more time. then this thing called an election comes up. at what point do you say i have to pull back. >> steve: the change of venue to west virginia is a long shot. don't look for that to happen. this judge has already handled a bunch of january 6th stuff and well-versed in it. what is different about this time and this arraignment, when he appeared in downtown south florida he had a hotel down there the durrell country club. in new york, trump tower, bedminster about 25 miles to the west of us, so he had a place to stay. right now we believe he overnighted in bedminster. the idea is apparently the u.s. marshals are going to escort the plane once it arrives at national. he will probably be in that building 3:00 or 4:00 this afternoon, then he will be promptly processed. the big question is after the arraignment, will he return to bedminster like he did last time and have a press conference. last time he had a big fundraiser. >> ainsley: he stopped at the big cuban restaurant in florida. >> brian: maybe the hotel that he. >> steve: somebody else owns it now. >> ainsley: used to be the old post office or library. >> steve: post office and now a waldorf astoria. >> brian: why not make it a post office again. >> ainsley: no president has ever been hit with criminal charges like this. there is nothing in the constitution, actually, that bars him from seeking office if he is convicted. he is facing 641 years if convicted on 78 felony charges. >> brian: right. good luck with that first time being accuse much doing anything in office. mar-a-lago after. the alvin bragg case before. >> this is the first time during. >> ainsley: these are the latest charges. >> brian: latest. very interesting the stance that mike pence is taking. mike pence obviously will hurd and chris christie made it clear they are the anti-trump force. other split the difference. weaponization of government, don't agree with january 6th bad day. depending lo it is. mike pence realizes he doesn't seem to be getting much traction listen, i'm going to make it clear. this is where the rubber hit the road. this is why i left. january 6th is a big deal. who know what is he said to the grand jury. >> ainsley: he was taking secret notes around january 6th he said. and that's in jack smith's indictment. >> steve: it is, indeed. in fact, the former vice president has not yet qualified for the big debate on fox. >> ainsley: hasn't raised enough money. >> steve: we have big debate news. first, take a look at where the standings are, according to that names-siena poll that came out earlier in the week. donald trump has about a little north of 50% of the republican votes on the republican side. but, when you do the math, you add up everybody else, that means about 45, 46% want somebody else. and that's one of the reasons why there is in some conservative republican circles some thinking about, okay, who would the person be to take on donald trump? and right after super tuesday, the idea is, whoever wins is the frontrunner. and then everybody -- let's say it's ron desantis, everybody else drops out, of course they would have to all be on the same page that way it becomes a trump vs. desantis thing that kind of debate would be interesting. we are going to see that before. >> ainsley: yes, we are. >> brian: real quick, on this poll, 46%, the "new york times" poll, are still considering voting for a different candidate. governor ron desantis a solid second head to head if it is one-on-one 62% to 31% trump beats second closest rival obviously it's ron desantis. everyone else in single digits. it should be interesting. to me if i see this poll and i'm donald trump i feel great about what my poll numbers are. why risk? why not go for, you know, go for the clincher by showing up for the debate on august 23rd. take a look at the rest of the field. this is why i'm leading and hopefully he will decide to do it. >> ainsley: you can't take your voters for granted. i hope he does decide to he show up. voters want to hear from him there are people undecided at this point because we really don't know who is going to go -- >> steve: in that poll they showed that a big chunk, north of 40% are persuadable. certain number h hard core trump people and it anti-trumpers. >> ainsley: look at the tortoise and the harry. hare don't get or skis. >> steve: now i want to say. >> ainsley: i don't know. i will tell you during the you don't want to get too excited and say oh i have got this in the hand and take for granted and someone does internet on better on debate stages. >> steve: we saw it on the hannity show, remember a month or two ago he sat down with gavin newsom out in california and brought up the idea of a debate and then ron desantis figured into it as you are about to see on this clip from a while back and last night. here is hannity. >> you would do a two hour debate with ron desantis? >> i would make it three. >> sean: three hour debate. >> yeah. >> sean: do i hear four? >> three hours with no notes i look forward to that. >> your answer is? >> absolutely. i'm game. let's get it done. just tell me when and where. we'll do it. here's the thing, sean. i mean, in one respect, the debate between california and florida, you know, has already been had, as you suggest. people have been voting on that. they have been voting on it with their fleet. they have fled california in record numbers. they would love to see the california fornication of the united states. biden may not be the nominee. you could have gavin newsom. you could have kamala harris if we go down that direction that will s. going to accelerate american decline. we can't see american decline anymore we need to reverse american decline they would like to see this debate october 9th or 0th and focus on the impact of representation at the state level. >> ainsley: he is not even in the race. it's crazy they are considering debating. i guess he is waiting in the wingsz, right? >> steve: people would love that show. >> brian: this is a god send for ron desantis. he becomes the number one story on the right. gavin newsom is considered the heir apparent on the left. everything gavin newsom does the x-ray version of what ron desantis has acted on on green energy and comes to taxes and who has brought in more people with their policies and who has forced more people out with their policies? it goes over and. >> ainsley: who is better looking? >> brian: we could talk about, yeah. to see them head to head, shoulder to shoulder on issues. and i talked to a couple of people that sat with gavin newsom. he is all show horse. is he not a substance policy guy. >> ainsley: when he interviewed with sean, he refused to say he would ever run for president. this is not my time. i'm not running. i support biden, i support biden. glenn youngkin yesterday when laura asked him if he was going to run for president he didn't answer the question that sounds like a campaign speech. i'm focusing on virginia and midterm elections. >> steve: we know what ron desantis looks like in a national debate. we have seen that but gavin newsom, he, i think, will be the big benefactor, actually sean hannity is going to be the benefactor because his ratings are going to be through the roof. gavin newsom people are going to watch him debate ron desantis. if you are a political independent or democrat, you are going to go that guy is so much younger than joe biden. shufnt we have that guy in there right now? >> brian: to me, you seem of see newsom, a that's fine. number one state. the biggest state in the union. i got it. >> steve: he is very popular there. >> brian: well, i mean, he actually got the embarrassment of being recalled and had to fight to keep his job which is pretty insulting. >> steve: he kept it. >> brian: but barely. so he kept his job and then you keep in mind, too. of that ron desantis can't get out of shadow of trump. and every time something happens trump spends money attacking him and trump is indicted and he loses the microphone, the spotlight. this would push him in the spotlight regardless of indictments then you get a chance to see what many people have seen in the florida. if he falls on his face against gavin newsom i would be stunned because he does have a lot of experience debating at this point. >> steve: it's not going to happen until november it sounds like. but, you know what? regarding the fox debate. i think the one thing, one reason donald trump will want to show is donald trump does not want to see the ratings the next day and 50 million people watched it because it's going to be on all the fox platforms. but he is not going to want to see ron desantis in the center podium because that was trump's podium during the debates. and donald trump wants his podium. >> ainsley: if he watched ton tv and he thought i'm supposed to thereby. >> steve: i should be right there. i should be making the folks laugh. >> ainsley: doesn't want to look at that and say gosh i made a mistake i should have been there gavin newsom, even though the numbers might not be great for california, conservatives can look at that easily, democrats still love him. >> steve: they love him. >> ainsley: they don't care. look at kamala harris. she is our vice president. she came from that same state. i think democrats would be so relieved that now they don't have to pull the lever for joe biden. >> brian: you mean if he ran? >> well, president biden told his attorney general merrick garland to jump and merrick garland said how high. and he has brought this unprecedented law fare against president trump. sent attorney to join alvin bragg's office to bring unprecedented indictment against trump for the noncrime of settling a nuisance claim and garland had jack smith indict president trump for the noncrime of a former president having his presidential records, which is allowed by the presidential records act. now merrick garland has jack smith indicting trump for the noncrime of objecting to a presidential election. and it's only a crime to object to presidential elections in third world marxist hell holes. democrats objected to republican wins in 1968, 2,000, 2004, and 2016. and so this case, this current case is before an obama judge and a in d.c. with a 95% democrat d.c. jury pool that's 99% trump deranged. there is no question he will be found guilty and convicted in d.c. and the supreme court will have to overturn this conviction because it clearly violates the first amendment. it's lawless law fare by jack smith and merrick garland. >> brian: mike, this is non-legal phrase. but the case is not done. the indictment is not finished. just like the mar-a-lago case they came in and added five more counts. he kept a lot in his quiver. so at another time can he call another press conference and have additional charges and, again, steal the news cycle. as you look at what has happened on the other side with the president, his son, and possible linkage "the washington post" calling the president out today about blatant lies about his knowing and possible links to his son's business dealings. every time something happens on the president, in comes something on the former president, do you believe charges will be added to the 45 page indictment we have already read? [cheers] >> and continues to go perfectly to the miami script. >> brian: all right. we're beginning here with a fox news alert. former president donald trump expected to appear in a d.c. federal court, let me check my watch. make it later today, how about 4:00 where he is facing four new felonies claiming he made false statements about the 2020 election. >> steve: mr. trump is now fighting to move the case out of washington, d.c. where joe biden won by 95% last time around, where he says he would not have a chance at a fair trial. >> ainsley: 95% of them are anti-trumpers. and griff jenkins is live outside of the d.c. courthouse with the latest for us. hey, griff. >> griff: hey, good morning, ainsley, steve and brian. security is getting tighter here. a lot of media and as you mentioned, brian, 4:00 p.m. eastern we expect the former president to be here at the federal courthouse in d.c. facing his third indictment in four months and ahead of this one he is concerned about getting that fair trial. he took to truth social posting this yesterday saying. >> . the latest fake case brought by crooked joe biden and deranged jack smith will hopefully be moved to impartial venue such as the politically unbiased nearby state of west virginia. impossible to get a fair trial in washington, d.c. now, trump faces four charges in this indictment. three are on conspiracy, one for obstruction. and among the six co-conspirator listed but not named an attorney for john eastman says he believes his client is one of them and is prepared to defend eastman's memos to trump in the wake. listen. >> a eastman's advice was perfectly in the realm of good advice. if he goes to trial if is he convicted he will go to trial. we will never ever make a deal. >> griff: however, the man at the center of much of this case, former vice president pence is blasting his former boss and the lawyers who pressured him to refuse to certify the election results. >> it wasn't just that he asked for a pause. the president specifically asked me and his gaggle of crackpot lawyers asked me to literally reject votes, which would have resulted in the issue being turned over to the house of representatives and literally chaos would have ensued. >> griff: as we have heard much of this revolves around free speech issues. bill barr says special counsel jack smith has a high bar in prosecuting this case but agrees it has merit. >> i think it's a legitimate case. i think, unlike the document case, it's going to have issues of proof. it's a more complicated case. they are not attacking his family right. he can say whatever he wants. but that does not protect you from entering into a conspiracy. all conspiracies involve speech. and all fraud involves speech. >> griff: now, what we can expect to see here today obviously, former president trump coming here in the security heightened that it may resemble something similar to what we saw in june in miami when trump was there to be arraigned on the case involving the alleged mishandling of classified documents. so far, by the way, no protesters that we have seen out here will keep an eye on it and bring it to you as we get it. >> ainsley: tuesday night there were trump supporters and anti-trumpers outside in d.c. and that erupted into a shouting match. >> brian: did you hear anything about that, griff? >> griff: we're not really seeing much of that you know, i have been here every day since the middle of last week, and we haven't seen a large number. but, remember, in miami, because i also covered that for us. the protesters out there really took until the kind of day got going to see. so folks on both sides to come out. fortunately, in miami, it was peaceful. although there were some animated conversations out there. we will see what the day brings. the weather is supposed to be nice. maybe they will turn out. >> ainsley: did they put fencing up in front of the courthouse i know they did in front of the capitol. >> griff: they sure did. the fencing at the capitol is a little more hardened if you will at the risk of upsetting my cameraman les baker. back up a tad bit can you see behind me waist high railing do not cross lines that encircles the entire courthouse. >> steve: griff, we know police have been preparing for this arraignment later today but out of nowhere yesterday around 3:00 there was a mysterious bogus phone call that said there was an active shootner one of the senate office buildings. i know because my daughter-in-law was there and they evacuated everything. they said it's bogus but they think is probably one of those swatting things, right? >> griff: well, that's right. it appears that the senate got swatted as the headlines you have seen probably. and, the call came into 911. they reacted. listen, people are on very serious high alert here. >> this is a very serious situation for something like that to cou coincidently the day before the president comes to the court house. we are a stone's throw five or six blocks from the capitol hill, law enforcement all the way to law enforcement marshals working hand in hand to make sure everything is safe and secure today. >> brian: just one last question on something you just reported, you said earlier at the risk of upsetting my cameraman, griff, does he get upset at you a lot? are we getting -- is that a correct report? >> griff: listen, les baker is one of the best photographers in the nation he makes me look good. when i have to get him to pull back he might get upset, you know because it doesn't look as beautiful. i'm glad, brian, you are concerned about les. he will greatly appreciate that and getting me out of trouble for making him pull back. >> ainsley: where will we see the president go in at 4:00? >> griff: we don't know, ainsley, that's great question, ainsley. we don't know where we will see where he will go in because there are multiple entrances. front door behind me. side door. and a garage entrance. we assume he would go by motorcade into the garage area and that's a secure area there. we will have to wait to find out. >> steve: griff and co-star les we thank you for the live report from the pretty land courthouse. >> ainsley: thank you for not getting mad at the nice guy on camera. >> steve: by the way, when things happen today, we have been talking about the judge who is going to oversee the criminal time, that's not going to see who will oversee the president today. a magistrate judge is going to see. the former president will not be mugshotted; however. >> ainsley: not here. >> steve: he will be fingerprinted in d.c. the fulton county sheriff down in georgia says if mr. trump faces charges in georgia, he is going to be treated just like everybody else and he's going to get mugshotted. >> ainsley: fanny willis the d.a. down there will announce the charging decision in georgia by september 1st. >> brian: the president want it out of there. listen, i have got 5% of the vote. washington, d.c. not great place for me. that's where a lot of stuff took place. he put that on truth social. i don't know how successful what legal experts say convictions here regardless. punisher as a judge who serves in the same law firm as hunter biden. complex links that you could challenge and then there will be an appeal. and an appeal and probably end up in the supreme court. will this be first is the speculation. will mar-a-lago be second? will alvin bragg keep himself first excuse myanmar 20th. the next one in may the mar-a-lago cases. this one, i don't know where this fits. and then what about when the law teams stand up and say i got so much to go through i'm going to need more time. then this thing called an election comes up. at what point do you say i have to pull back. >> steve: the change of venue to west virginia is a long shot. don't look for that to happen. this judge has already handled a bunch of january 6th stuff and well-versed in it. what is different about this time and this arraignment, when he appeared in downtown south florida he had a hotel down there the durrell country club. in new york, trump tower, bedminster about 25 miles to the west of us, so he had a place to stay. right now we believe he overnighted in bedminster. the idea is apparently the u.s. marshals are going to escort the plane once it arrives at national. he will probably be in that building 3:00 or 4:00 this afternoon, then he will be promptly processed. the big question is after the arraignment, will he return to bedminster like he did last time and have a press conference. last time he had a big fundraiser. >> ainsley: he stopped at the big cuban restaurant in florida. >> brian: maybe the hotel that he. >> steve: somebody else owns it now. >> ainsley: used to be the old post office or library. >> steve: post office and now a waldorf astoria. >> brian: why not make it a post office again. >> ainsley: no president has ever been hit with criminal charges like this. there is nothing in the constitution, actually, that bars him from seeking office if he is convicted. he is facing 641 years if convicted on 78 felony charges. >> brian: right. good luck with that first time being accuse much doing anything in office. mar-a-lago after. the alvin bragg case before. >> this is the first time during. >> ainsley: these are the latest charges. >> brian: latest. very interesting the stance that mike pence is taking. mike pence obviously will hurd and chris christie made it clear they are the anti-trump force. other split the difference. weaponization of government, don't agree with january 6th bad day. depending lo it is. mike pence realizes he doesn't seem to be getting much traction listen, i'm going to make it clear. this is where the rubber hit the road. this is why i left. january 6th is a big deal. who know what is he said to the grand jury. >> ainsley: he was taking secret notes around january 6th he said. and that's in jack smith's indictment. >> steve: it is, indeed. in fact, the former vice president has not yet qualified for the big debate on fox. >> ainsley: hasn't raised enough money. >> steve: we have big debate news. first, take a look at where the standings are, according to that names-siena poll that came out earlier in the week. donald trump has about a little north of 50% of the republican votes on the republican side. but, when you do the math, you add up everybody else, that means about 45, 46% want somebody else. and that's one of the reasons why there is in some conservative republican circles some thinking about, okay, who would the person be to take on donald trump? and right after super tuesday, the idea is, whoever wins is the frontrunner. and then everybody -- let's say it's ron desantis, everybody else drops out, of course they would have to all be on the same page that way it becomes a trump vs. desantis thing that kind of debate would be interesting. we are going to see that before. >> ainsley: yes, we are. >> brian: real quick, on this poll, 46%, the "new york times" poll, are still considering voting for a different candidate. governor ron desantis a solid second head to head if it is one-on-one 62% to 31% trump beats second closest rival obviously it's ron desantis. everyone else in single digits. it should be interesting. to me if i see this poll and i'm donald trump i feel great about what my poll numbers are. why risk? why not go for, you know, go for the clincher by showing up for the debate on august 23rd. take a look at the rest of the field. this is why i'm leading and hopefully he will decide to do it. >> ainsley: you can't take your voters for granted. i hope he does decide to he show up. voters want to hear from him there are people undecided at this point because we really don't know who is going to go -- >> steve: in that poll they showed that a big chunk, north of 40% are persuadable. certain number h hard core trump people and it anti-trumpers. >> ainsley: look at the tortoise and the harry. hare don't get or skis. >> steve: now i want to say. >> ainsley: i don't know. i will tell you during the you don't want to get too excited and say oh i have got this in the hand and take for granted and someone does internet on better on debate stages. >> steve: we saw it on the hannity show, remember a month or two ago he sat down with gavin newsom out in california and brought up the idea of a debate and then ron desantis figured into it as you are about to see on this clip from a while back and last night. here is hannity. >> you would do a two hour debate with ron desantis? >> i would make it three. >> sean: three hour debate. >> yeah. >> sean: do i hear four? >> three hours with no notes i look forward to that. >> your answer is? >> absolutely. i'm game. let's get it done. just tell me when and where. we'll do it. here's the thing, sean. i mean, in one respect, the debate between california and florida, you know, has already been had, as you suggest. people have been voting on that. they have been voting on it with their fleet. they have fled california in record numbers. they would love to see the california fornication of the united states. biden may not be the nominee. you could have gavin newsom. you could have kamala harris if we go down that direction that will s. going to accelerate american decline. we can't see american decline anymore we need to reverse american decline they would like to see this debate october 9th or 0th and focus on the impact of representation at the state level. >> ainsley: he is not even in the race. it's crazy they are considering debating. i guess he is waiting in the wingsz, right? >> steve: people would love that show. >> brian: this is a god send for ron desantis. he becomes the number one story on the right. gavin newsom is considered the heir apparent on the left. everything gavin newsom does the x-ray version of what ron desantis has acted on on green energy and comes to taxes and who has brought in more people with their policies and who has forced more people out with their policies? it goes over and. >> ainsley: who is better looking? >> brian: we could talk about, yeah. to see them head to head, shoulder to shoulder on issues. and i talked to a couple of people that sat with gavin newsom. he is all show horse. is he not a substance policy guy. >> ainsley: when he interviewed with sean, he refused to say he would ever run for president. this is not my time. i'm not running. i support biden, i support biden. glenn youngkin yesterday when laura asked him if he was going to run for president he didn't answer the question that sounds like a campaign speech. i'm focusing on virginia and midterm elections. >> steve: we know what ron desantis looks like in a national debate. we have seen that but gavin newsom, he, i think, will be the big benefactor, actually sean hannity is going to be the benefactor because his ratings are going to be through the roof. gavin newsom people are going to watch him debate ron desantis. if you are a political independent or democrat, you are going to go that guy is so much younger than joe biden. shufnt we have that guy in there right now? >> brian: to me, you seem of see newsom, a that's fine. number one state. the biggest state in the union. i got it. >> steve: he is very popular there. >> brian: well, i mean, he actually got the embarrassment of being recalled and had to fight to keep his job which is pretty insulting. >> steve: he kept it. >> brian: but barely. so he kept his job and then you keep in mind, too. of that ron desantis can't get out of shadow of trump. and every time something happens trump spends money attacking him and trump is indicted and he loses the microphone, the spotlight. this would push him in the spotlight regardless of indictments then you get a chance to see what many people have seen in the florida. if he falls on his face against gavin newsom i would be stunned because he does have a lot of experience debating at this point. >> steve: it's not going to happen until november it sounds like. but, you know what? regarding the fox debate. i think the one thing, one reason donald trump will want to show is donald trump does not want to see the ratings the next day and 50 million people watched it because it's going to be on all the fox platforms. but he is not going to want to see ron desantis in the center podium because that was trump's podium during the debates. and donald trump wants his podium. >> ainsley: if he watched ton tv and he thought i'm supposed to thereby. >> steve: i should be right there. i should be making the folks laugh. >> ainsley: doesn't want to look at that and say gosh i made a mistake i should have been there gavin newsom, even though the numbers might not be great for california, conservatives can look at that easily, democrats still love him. >> steve: they love him. >> ainsley: they don't care. look at kamala harris. she is our vice president. she came from that same state. i think democrats would be so relieved that now they don't have to pull the lever for joe biden. >> brian: you mean if he ran? >> well, president biden told his attorney general merrick garland to jump and merrick garland said how high. and he has brought this unprecedented law fare against president trump. sent attorney to join alvin bragg's office to bring unprecedented indictment against trump for the noncrime of settling a nuisance claim and garland had jack smith indict president trump for the noncrime of a former president having his presidential records, which is allowed by the presidential records act. now merrick garland has jack smith indicting trump for the noncrime of objecting to a presidential election. and it's only a crime to object to presidential elections in third world marxist hell holes. democrats objected to republican wins in 1968, 2,000, 2004, and 2016. and so this case, this current case is before an obama judge and a in d.c. with a 95% democrat d.c. jury pool that's 99% trump deranged. there is no question he will be found guilty and convicted in d.c. and the supreme court will have to overturn this conviction because it clearly violates the first amendment. it's lawless law fare by jack smith and merrick garland. >> brian: mike, this is non-legal phrase. but the case is not done. the indictment is not finished. just like the mar-a-lago case they came in and added five more counts. he kept a lot in his quiver. so at another time can he call another press conference and have additional charges and, again, steal the news cycle. as you look at what has happened on the other side with the president, his son, and possible linkage "the washington post" calling the president out today about blatant lies about his knowing and possible links to his son's business dealings. every time something happens on the president, in comes something on the former president, do you believe charges will be added to the 45 page indictment we have already read? >> yeah. i think jack smith will supersede this indictment at some point. maybe add seditious conspiracy. maybe actually name these six alleged co-conspirator, i think. fulton county d.a. down in georgia, fanny willis and other democrats are going continue to indict trump for the noncrime again of objecting to a presidential election. this is all out law fare against president trump because democrats fear they are not going to be able to stop him on november 5th, 2024. >> brian: just back to the original premise of the soundbite that he said in 2022 where we have to do everything constitutionally to stop him from becoming president again. is that what is happening here?
