block. a mother and her 3-month-old baby among her death and stark reminder of the innocent people stuck in this war and russian troops are reportedly trying to storm a steel plant where more than a thousand ukrainian soldiers and civilians are trapped underground. ukraine's deputy prime minister calling on the united nations to demand ceasefire in order to create humanitarian evacuation routes after humanitarian corridor collapsed earlier today. >> they'll be a referendum and leave negotiator process. trey: intense fighting continues along the front lines in the eastern part of this country from north and tank battles are reportedly fired. u.s. secretary of state antony blinken and u.s. defense secretary lloyd austin would be visiting the ukrainian capital of kyiv. we are waiting for parliamentarians there. do they have a -- yes, they do. are they able to take decisions, no. the decision is only taken in kremlin. after losing so many civilians in the field and full-scale war is hard to trust. that's why we want our partners to be with us and so that our partners guaranty our collective security. so at this stage we are focused to continue negotiations be -- be on the field, fight them back and need support of partners. mike: it is pretty clear that the president is obsessed with eastern ukraine, is giving russians territory is red line for you? >> first of all, he's obsessed with one thing to destroy ukraine as a whole and ukrainian ethnicity as a whole. he doesn't recognize it as a country and he doesn't think that we are independent and sobering state. we will be fighting for our people and we will be fighting for our territory so it is a red line almost for 8 years he temporary occupied crimea where i'm originally from and eastern donbas and at this stage he's trying to falsify to twist the story that he wants to occupy donbas in its administrative borders and now he's making a new story came up that he needs corridor to our crimea. so basically for a delay in ending title 42 under the trump-era public health measure the u.s. was able to expel migrants to home countries, democratic congressman henry cuellar said on fox news sunday the administration plan to remedy border surge is lacking. >> they are talking about adding medical officials down here and transportation, the metric that is being used, how do you move the migrant from the border over to the interior of the united states. alex: on tuesday the supreme court will hear arguments over the remain in mexico policy that was put in place under president trump since following that story, hello, bill. bill: yeah, mike, good afternoon to you. sorry, forgot the mike there. good afternoon to you. the crossings have been completely -- you might take a look at the crossing, a group either crossing or has crossed already and brought their dog with them and we actually just received update from the texas military regarding the missing national guard. he's been identified as 22-year-old specialist bishop e evans out of arlington, texas, the latest update being that they still have not found him. we will get more to him in a second but first we want to show you of the illegal crossings that have taken place this morning. take a look at the video just a short time ago more migrants crossing broad daylight, early morning hours when the water is running much lower and much easier to cross. this is about 3 miles away from where the soldier disappeared and went missing, this is a group of mostly venezuelans across the water. once they get to the u.s. side they were celebratory. some of them smiling and waving to our cameras, flashing us thumbs up but they weren't the only ones. take a look at the second group, this was a short time after, 20t group. more just walking right across the rio grande and they come from all over the world. we get a lot of venezuelans and cubans and northern triangle countries. this is video from yesterday. if we can pull this up. the texas military department says they have been searching nonstop for them and they dive teams had to stop yesterday because the currents were so strong. we are told those search efforts have resumed today. keep in mind, he jumped into the water more than 48 hours ago and texas rangers say the two illegal immigrants he was trying to save turned out to be drug smugglers, all they have found of a trace of him so far is his body armored, his walkie-talkie and a cell phone. still no trace of that soldier and take a listen what the former u.s. border patrol chief had to say about the border and this incident in particular. >> we keep talking about this wave of migration if title 42 goes away. that wave is already here and there's criminals, there's terrorists mixed. our nation is at risk and nothing stays at the border, it's going to the town where your viewers live in right now. they go everywhere and the biden administration just ignores it and doesn't even have the courtesy to acknowledge the death of the soldier. bill: migrants just continue crossing in this river behind us nonstop. about 20 minutes ago we witnessed border patrol on multiple boats having to yanked people under the water who brought children under the water with them and had to perform rescues so that national guard soldier unfortunately sounds like he lost his life and drowned trying to save what he thought were migrants struggling in the water. he is presumably dead after texas rangers say those two migrants ended up involved in international drug smuggling. more updates as we get them. mike: bill we were on the hour 48 hours ago when the story was first breaking, i cannot imagine what the men and women are feeling knowing that they've lost one of their own and they haven't been able to recover his body yet. bill: yes, it absolutely has to be frustrating for them not just being able to have the body but having constant crossings where people cobs constantly need rescue and if the border patrol agents weren't around with the boats rescuing them, now the national guard soldiers have to decide do we still jump into the water to saver these people knowing what just happened. yes, the soldiers, they do really good work out here every day, they save lives and help supplement federal resources but as long as these crossings keep going on, they'll be risk for conservation coalition. welcome to both of you. >> thanks, mike. mike: okay, so let's start with the legal fight over masks here. here is attorney general merrick garland, listen. >> the reason for appealing is we believe that cdc has clear statutory authority for the mask mandate and the cdc has assessed that it is necessary for the health of the american people particularly traveling public. that's our -- that's our explanation for why we are appealing. mike: could the democrats face a potential political backlash if they force masks on our faces again? >> absolutely, mike. i think it's about time that americans get to decide for themselves whether they choose to wear a mask on an airplane or not. and i think that we are going to see some significant backlash this fall and americans are frankly sick and tired of seeing all of this theater from the white house if the white house and members to have white house team want to continue to wear a mask at press conferences and put them on and off and so on and so forth, they are welcome to. this is a decision that should be left to the american people. mike: kristin, what about covid fatigue in the country and many americans are willing to assess the risk when it comes to personal health at this point? >> they are certainly in covid fatigue but the white house has to make judgments, god forbid there's -- they are in a difficult spot because god forbid there's another surge and they'll be expected to make sure that the american public has access to testing. so they've got to be prepared, they've got to weigh the public health but also certainly, you know, people need to move on with their life. mike: final thought on covid and the restrictions before we move onto topic two? >> i think the democrats need to be very careful here and understand that americans have covid fatigue and the really serious implications that these lockdowns have had on particularly young people, that's going to be on the mind of voters this fall particularly key demographics like suburban mothers. i think they need to be careful about how they proceed. mike: to inflation, let's take a look at prices at the pump. the current price for an average gallon of gasoline is 4.12 a gallon, a week it was it was 4.07 and a month ago it was higher, 4.24 and a year ago 2.88 a gallon. kristin, what's the political impact of these prices at the pump? >> i mean, there's always a political impact when -- when people are hurting and their pocketbooks are hurting. people need to acknowledge that. it is a real problem in this country right now. the issue is there's only certain things that we can do in a global economy. there's only so much we can do on our own. the congress should move forward with the conference to start addressing some of these things, yes, it's certainly challenging and certainly something that we as democrats need to be talking about head intoed the midterms. mike: it's not just the gas station but also the grocery store. let's put on the screen some of the price surges on various critical items, meat up 15%, beef up 15%, pork up 15%, and chicken up 13%, fish up 11% and you have eggs, milk, coffee, soups and more all up, quill, what about the politics of inflation heading into the midterms? >> sure, whether it's gas prices or the cost of groceries at the grocery store, it's not a democratic or republican issue. it's affecting all americans. when it comes to gas in particular, we need to that this is result of the deliberate policy on the part of democrats and seems like they are focused on shutting down down the fossil industry than keeping affordable for everyday americans. in the long-term i hope that democrats and biden pivot to returning to american independence and exporting natural gas and cutting regulation that allow more clean energy. there's a lot the democrats can and should do here to make sure that gas prices and energy prices are affordable for all americans. mike: kristin, you worked on the hill, how nervous are congressional democrats about the prices at the grocery store and the gas station in terms of the midterms coming up? >> i think you'd be crazy not to be, you know, it's about communicating with your constituents and i think, you know, those key demographics were mentioned specifically speaking to women talking to people about, you know, what we are trying to do to address these -- these high prices but, yes, you know, anybody headed into any incumbent head intoed this election should be concerned. mike: thank you so much for expecting a migrant surge when title 42 comes to an end. i'm joined by brandon judd, brandon, welcome and let's start with the search for this national guard soldier at the border. how heartbreaking is that for the men and women on the front lines to lose someone and also to not be able to find his remains especially when this guy was apparently lost his life going after people who were who wereinvolved in drug trade. >> these individuals wouldn't be crossing in del rio. del rio is a very slow sector. we have nine sectors on the southwest border and del rio is a slow sector and since president biden completely took away all of the policies that president trump implemented we have seen explosion in del rio. this was preventible and when you see somebody lose their life when they are trying to protect others, that's what we go out and do. we as law enforcement we put on a uniform to go out and protect other people and that's what we want to do and when you lose life that is senseless and because of policy it really upsets everybody. mike: let's look at encounter numbers, march 2021 was significant but this year's march numbers 21% higher, there is on the screen, 173, 277 in march 2021, 221, 203. how do you see assess those numbers, brandon? >> every one of us thought we could hit our ceiling back in '21. we thought the administration would turn a corner and do something different. give us the programs, give us the policies and resources that are necessary to secure the border, they haven't. we don't know that there's a feeling anymore. this month is going to be even worse than the month of march. you know, right now we are apprehending anywhere from 7 to 8,000 people so it could be as high as 240,000 once the numbers come up at the end of this month. it just continues to go up and up and this administration isn't giving us the necessary policies and programs to allow us to secure the border. >> one thing that caught my eye that jumped from february of this year to march of this year, we flashed it on the screen a moment ago, a pretty stunning number, there it is. up 33.4% to more than 221,000 border encounters and then it makes you wonder what happens when title 42 is gone. >> well all we have to do is look at the last year, the last couple of months. when president biden came into office, he kept title 42 but he didn't implement it the same way that the trump administration did. he gave a great number of carve-outs to a lot of nations, african nations, venezuela, cuba, colombia at times brazil eastern european nation, he gave an awful lot of carve-outs and that explosion in illegal immigration and he caused explosion giving to 50% of the countries, what's going to happen when he gives carve-out to 100% of the countries. we are projecting the numbers to go as high as 18,000 and right now we are at 8,000. when that happens we will be pulling out of the resources out of the field and when we pull resources out of the field then cartels will have complete control of our border, more of our children are going the die of overdoses to dangerous drugs like fentanyl which we have already seen in this country. it doesn't make any sense why we are at this situation especially when it is controllable. >> the fox flight team over the eagle pass border crossing there, it's been a hot spot obviously in recent months. when does this all end, brandon? >> it doesn't end until this administration is willing to push back against its open border base. that base wants to to happen. it's by design and until this administration is willing to do that, until this administration is willing to step up and say, the american public means more to us than our base supporters, then we will continue to see this crisis get worse. mike: brandon, final question, what's the level of the men and women in terms of their morale, the men and women in the front lines right now? >> i've got 25 years in this profession and i've never seen it worst than what it is right now. they don't want to come to work, they feel beaten, we don't feel like we can do the job to protect the american public like what we want to do. if you don't accomplish something, you don't feel fulfilled and right now we don't feel like we are accomplishing anything. mike: the french presidential election results for emmanuel macron and marine la pen will be later today. hey, christina. christina: millions of voters cast their ballot in tense presidential election with macron and la pen. centrist macron came in first with 28%. both candidates are condemning putin's war on ukraine although la pen has been sympathetic to put anyone the past and cast doubts on sanctions against russia that she believes could hurt the people of france. la pen says bringing down the cost of living would be her top priority as president and macron has left the country divided over his economic policies. meantime macron is touting his environmental and climate change agenda. today in a crowd of voters he also criticized la pen for saying that she think it is muslim head scarf is uniform imposed by islamist and slammed the proposal to being worn in french spaces. if he wins this election, he will be the first french president to win a second term in two decades. mike. mike: christina coleman live in los angeles, we will follow it. christina, thanks very much. former utah senator and the longest serving republican senator in american history orrin hatch has died at the age of 88. congressional correspondent joins me on life and legacy, chad, welcome. chad: good afternoon, mike, well, he was in the senate for 48 years and president biden in the past hour has put out a statement about orrin hatch and called him an american original. said he had sharp elbows but was a gentle soul. when orrin hatch served in the senate, he was prey conservative but he teamed with ted kennedy, rival senator, democrat from massachusetts, very liberal on children's health insurance also on the americans with disabilities act. he became the chair of the senate finance committee in 2017 and helped usher the passage tax reform back in 2017. he drew some controversy in 1991 during the clarence thomas confirmation hearings because of his attacks on anita hill. she had made allegations against clarence thomas obviously and he said that he thought her allegations against thomas were slick and there was dramatic point during confirmation hearings where he held a copy of the novel, the exorcist and copied and he became the chair when the republicans controlled the senate, mike. mike: hatch gave farewell address sounding concern of the state of the institution, what about that, chad? chad: he always longed for a middle ground. he said that senators should retreat from these partisan trenches as he described it. he had been known as deal-maker early on in his career but later when president trump came to office he sided with president trump on an awful lot of things. president trump wanted him to run mainly because he didn't like mitt romney who is the republican senator from utah. mike: senator had a musical career in his free time, tell us about that. chad: he was a pretty accomplished songwriter, one year according to forms, he raked $39,000 in royalties. he acted some, appeared in an episode of parks and rec and in 2009 he wrote a hanukkah song at the time it was the 19th most downloaded piece of music on the internet and it was right up there with the black-eyed peas and lady gaga, mike. heritage foundation brent sad sadler, brent, welcome. >> thank you very much for having me today. mike: let's take a look at southern ukraine. what have you observed in recent days? >> thank you very much. on this map i would like to focus on the naval front which doesn't get a whole lot of play, a whole lot of attention, a lot has happened in the last week. of course, in this area you had the sinking of the moskva. the chinese are watching that, lots of lessons. those two naval bases are used to rearm and refurbish naval vessels that are launching missile attacks on odesa and into western ukraine. the fact that there was a report yesterday that 3klio class conventional submarines probably going back and sorting the missile attacks and this morning, easter sunday, series of attacks that followed 8 to ten hours later, maybe new coincidence. i'm seeing a similar pattern. shoot all our missiles, go back in, reload and repeat. mike: tremendous focus on mariupol trying to create land bridge from mariupol to black sea. how valuable is mariupol in the next wave. >> right now mariupol is the foe cause. the donbas, this area is key for this part of the war. this war started in 2014, crimea and donetsk. the second to complete donbas and connect to go crimea. it seems to be outstanding question whether there's enough gas behind the russian military to get to odesa but the history, over a period of 100 years the russian empire and soviet union they fought ten wars with the turks over the same territory. they may pause we may be backed into a conflict over odesa. mike: fascinating. let's flip it. let's take a closer look to that map here, what do you see? >> the big thing remember just a few weeks ago you had russian forces that were rapidly relocated. normally, it would take several weeks to refurbish, to replace lost, you know, casualties, russia is now recruiting 60,000 veterans so people that do have some military experience, maybe, you know, advanced age but 60,000 troops to flush into this donbas region. but still, it's been a couple of weeks. it's unlikely that these forces are fully mission capable but, again, with the russian standard they may be good enough. so the push is to come down from the north which we are seeing a dozen or so small villages have been taken as the russians wear down the ukrainian forces in this area at the same time from kyiv as well as from kharkiv, they have to hold here and moverring in reinforcements to bolster in the donbas. another key place is mykoliav. it's key for the russians to move to odesa. mike: no surprise that the ukrainians have fought valiantly to defend their country? >> absolutely. mike: close-up at mariupol and take a closer look at what we are seeing here. obviously great concern about this steel facility where we believe a lot of people were hiding out trying to find a safe place from the fighting. your thoughts as we look at mariupol? >> so when you look closely. i mean, this is a heavily industrial area. lots of underground structures, lots of heavy equipment. it's surrounded on several sides by water. so it's almost like a natural fortress. what's happening inside here is very reminiscent of what we saw in world war ii in the battle of the stalin ground. horrific situation on the ground. it's an open question of how much long the people, mixed civilians with mixed with fighters can hold out in the last inside of mariupol. mike: when you consider how much fighting has been focused in mariupol, what are your fears in terms of the kind of atrocities that may be taking place to win this? >> the nature of warfare is that, you know, men, women and children who are getting caught up in this warfare are going to suffer greatly along with the military folks. it is probably one of the more brutal types of campaign, it's a slow type of warfare. we will only know what the russians decide to let out information. there's still some that come out sporadically on the last holdouts in the steel mill. mike: we are out of time. what surprised you about the conflict so far? >> russia's belief that the ukrainian people would not stand up, that also includes a large portion of ethnic russian and russian speakers in cities of kharkiv. they thought it would be a cake-walk in kharkiv and walk right into nirpa. mike: thank you so much. live report from super speedway (♪ ♪) ask your healthcare provider about rybelsus® today. mike: nascar, the talladega super speedway is today and charles watson live from the track bringing you the latest action on the ground. hello, charles. charles: hello, mike. you can see the cars out on the track as some of nascar's best here in talladega and will do it in a massive crowd. not full yet but nascar officials say they expect a hundred thousand fans to fill it up and but if you know nascar fans, mike, you know so many of these fans have been here already for days. and it's funny because we spoke to a family and says it took them ten years to get the prime real estate where they watch all the action and they haven't looked back since they've been coming to dega for a at least a decade to enjoy the perfect view of 2.66-mile long track. it is nascar's largest oval track and experts say it's high-banking and cars moving at speeds at 200 miles per hour and the toughest for drivers to navigate. the president of talladega super speedway says that's what makes this place so special and fan favorite. >> i think that's one of those things that factors into what makes talladega so great and makes it one of the tougher racetracks out there. charles: talladega certainly has the perfect ingredients for big wrecks aside from down right good racing, that's what fans say they are looking out for. >> well, everybody looks for the big one you know what i'm saying but there's only certain ones that i want to see in it. [laughter] >> you know, it's nascar, you got favorite drivers and you have unfavorite drivers. russia launched its invasion into ukraine and the civilian death toll here continues to rise. overnight 8 people were killed in the port city of odesa when russian missiles slammed into a residential block. a mother and her 3-month-old baby among her death and stark reminder of the innocent people stuck in this war and russian troops are reportedly trying to storm a steel plant where more than a thousand ukrainian soldiers and civilians are trapped underground. ukraine's deputy prime minister calling on the united nations to demand ceasefire in order to create humanitarian evacuation routes after humanitarian corridor collapsed earlier today. >> they'll be a referendum and leave negotiator process. trey: intense fighting continues along the front lines in the eastern part of this country from north and tank battles are reportedly fired. u.s. secretary of state antony blinken and u.s. defense secretary lloyd austin would be visiting the ukrainian capital of kyiv. we are waiting for power to carry out an agreement? >> they come to the negotiations with band-aid and they are representing -- they have represent minister of defense, minister of foreign affairs, they have parliamentarians there. do they have a -- yes, they do. are they able to take decisions, no. the decision is only taken in kremlin. after losing so many civilians in the field and full-scale war is hard to trust. that's why we want our partners to be with us and so that our partners guaranty our collective security. so at this stage we are focused to continue negotiations be -- be on the field, fight them back and need support of partners. mike: it is pretty clear that the president is obsessed with eastern ukraine, is giving russians territory is red line for you? >> first of all, he's obsessed with one thing to destroy ukraine as a whole and ukrainian ethnicity as a whole. he doesn't recognize it as a country and he doesn't think that we are independent and sobering state. we will be fighting for our people and we will be fighting for our territory so it is a red line almost for 8 years he temporary occupied crimea where i'm originally from and eastern donbas and at this stage he's trying to falsify to twist the story that he wants to occupy donbas in its administrative borders and now he's making a new story came up that he needs corridor to our crimea. so basically among democrats who is tight races across the country and these democrats do not want president biden's immigration policy working against them. currently 47 democrat members of congress are pushing for a delay in ending title 42 under the trump-era public health measure the u.s. was able to expel migrants to home countries, democratic congressman henry cuellar said on fox news sunday the administration plan to remedy border surge is lacking. >> they are talking about adding medical officials down here and transportation, the metric that is being used, how do you move the migrant from the border over to the interior of the united states. alex: on tuesday the supreme court will hear arguments over the remain in mexico policy that was put in place under president trump since crossing, a group either crossing or has crossed already and brought their dog with them and we actually just received update from the texas military regarding the missing national guard. he's been identified as 22-year-old specialist bishop e evans out of arlington, texas, the latest update being that they still have not found him. we will get more to him in a second but first we want to show you of the illegal crossings that have taken place this morning. take a look at the video just a short time ago more migrants crossing broad daylight, early morning hours when the water is running much lower and much easier to cross. this is about 3 miles away from where the soldier disappeared and went missing, this is a group of mostly venezuelans across the water. once they get to the u.s. side they were celebratory. some of them smiling and waving to our cameras, flashing us thumbs up but they weren't the only ones. take a look at the second group, this was a short time after, 20t group. more just walking right across the rio grande and they come from all over the world. we get a lot of venezuelans and cubans and northern triangle countries. this is video from yesterday. if we can pull this up. the texas military department says they have been searching nonstop for them and they dive teams had to stop yesterday because the currents were so strong. we are told those search efforts have resumed today. keep in mind, he jumped into the water more than 48 hours ago and texas rangers say the two illegal immigrants he was trying to save turned out to be drug smugglers, all they have found of a trace of him so far is his body armored, his walkie-talkie and a cell phone. still no trace of that soldier and take a listen what the former u.s. border patrol chief had to say about the border and this incident in particular. >> we keep talking about this wave of migration if title 42 goes away. that wave is already here and there's criminals, there's terrorists mixed. our nation is at risk and nothing stays at the border, it's going to the town where your viewers live in right now. they go everywhere and the biden administration just ignores it and doesn't even have the courtesy to acknowledge the death of the soldier. bill: migrants just continue crossing in this river behind us nonstop. about 20 minutes ago we witnessed border patrol on multiple boats having to yanked people under the water who brought children under the water with them and had to perform rescues so that national guard soldier unfortunately sounds like he lost his life and drowned trying to save what he thought were migrants struggling in the water. he is presumably dead after texas rangers say those two migrants ended up involved in international drug smuggling. more updates as we get them. mike: bill we were on the hour 48 hours ago when the story was first breaking, i cannot imagine what the men and women are feeling knowing that they've lost one of their own and they haven't been able to recover his body yet. bill: yes, it absolutely has to be frustrating for them not just being able to have the body but having constant crossings where people cobs constantly need rescue and if the border patrol agents weren't around with the boats rescuing them, now the national guard soldiers have to decide do we still jump into the water to saver these people knowing what just happened. yes, the soldiers, they do really good work out here every day, they save lives and help supplement federal resources but as long as these crossings keep going on, they'll be risk for at players in the guardians out= field, bottles, cans, debris on the field. yankees players had to stop celebrating including aaron judge to calm the fans down. after the game straw said yankees has the worst fan base on the planet. >> it was a beer parade and watching out. you can see them coming from a mile away. i'm trying to avoid the beer cans and our bullpen was hitting with them too. >> that's not okay and that's when i draw the line. >> we have seen something like this before, last july a game was stopped when a fan threw a baseball at red sox outfielder verdugo and the yankees play the guardians and we will see if they are on better behavior today, hopefully so. mike: no doubt, nate foy, thank you so much. federal judge suddenly struck down the mask mandate for airplanes, trains and other forms of public transportation. let's bring in our political panel, kristin hahn and partner at rock solutions and robertson, vice president of government affairs at the american conservation coalition. welcome to both of you. >> thanks, mike. mike: okay, so let's start with the legal fight over masks here. here is attorney general merrick garland, listen. >> the reason for appealing is we believe that cdc has clear statutory authority for the mask mandate and the cdc has assessed that it is necessary for the health of the american people particularly traveling public. that's our -- that's our explanation for why we are appealing. mike: could the democrats face a potential political backlash if they force masks on our faces again? >> absolutely, mike. i think it's about time that americans get to decide for themselves whether they choose to wear a mask on an airplane or not. and i think that we are going to see some significant backlash this fall and americans are frankly sick and tired of seeing all of this theater from the white house if the white house and members to have white house team want to continue to wear a mask at press conferences and put them on and off and so on and so forth, they are welcome to. this is a decision that should be left to the american people. mike: kristin, what about covid fatigue in the country and many americans are willing to assess the risk when it comes to personal health at this point? >> they are certainly in covid fatigue but the white house has to make judgments, god forbid there's -- they are in a difficult spot because god forbid there's another surge and they'll be expected to make sure that the american public has access to testing. so they've got to be prepared, they've got to weigh the public health but also certainly, you know, people need to move on with their life. mike: final thought on covid and the restrictions before we move onto topic two? >> i think the democrats need to be very careful here and understand that americans have covid fatigue and the really serious implications that these lockdowns have had on particularly young people, that's going to be on the mind of voters this fall particularly key demographics like suburban mothers. i think they need to be careful about how they proceed. mike: to inflation, let's take a look at prices at the pump. the current price for an average gallon of gasoline is 4.12 a gallon, a week it was it was 4.07 and a month ago it was higher, 4.24 and a year ago 2.88 a gallon. kristin, what's the political impact of these prices at the pump? >> i mean, there's always a political impact when -- when people are hurting and their pocketbooks are hurting. people need to acknowledge that. it is a real problem in this country right now. the issue is there's only certain things that we can do in a global economy. there's only so much we can do on our own. the congress should move forward with the conference to start addressing some of these things, yes, it's certainly challenging and certainly something that we as democrats need to be talking about head intoed the midterms. mike: it's not just the gas station but also the grocery store. let's put on the screen some of the price surges on various critical items, meat up 15%, beef up 15%, pork up 15%, and chicken up 13%, fish up 11% and you have eggs, milk, coffee, soups and more all up, quill, what about the politics of inflation heading into the midterms? >> sure, whether it's gas prices or the cost of groceries at the grocery store, it's not a democratic or republican issue. it's affecting all americans. when it comes to gas in particular, we need to that this is result of the deliberate policy on the part of democrats and seems like they are focused on shutting down down the fossil industry than keeping affordable for everyday americans. in the long-term i hope that democrats and biden pivot to returning to american independence and exporting natural gas and cutting regulation that allow more clean energy. there's a lot the democrats can and should do here to make sure that gas prices and energy prices are affordable for all americans. mike: kristin, you worked on the hill, how nervous are congressional democrats about the prices at the grocery store and the gas station in terms of the midterms coming up? >> i think you'd be crazy not to be, you know, it's about communicating with your constituents and i think, you know, those key demographics were mentioned specifically speaking to women talking to people about, you know, what we are trying to do to address these -- these high prices but, yes, you know, anybody headed into any incumbent head intoed this election should be concerned. mike: thank you so much for your time, have an awesome day. >> thank you. >> thank you. mike: border officials bracing for a surge of migrants as title 42 set to expire next month. more on that next. mike: border officials expecting a migrant surge when title 42 comes to an end. i'm joined by brandon judd, brandon, welcome and let's start with the search for this national guard soldier at the border. how heartbreaking is that for the men and women on the front lines to lose someone and also to not be able to find his remains especially when this guy was apparently lost his life going after people who were who wereinvolved in drug trade. >> these individuals wouldn't be crossing in del rio. del rio is a very slow sector. we have nine sectors on the southwest border and del rio is a slow sector and since president biden completely took away all of the policies that president trump implemented we have seen explosion in del rio. this was preventible and when you see somebody lose their life when they are trying to protect others, that's what we go out and do. we as law enforcement we put on a uniform to go out and protect other people and that's what we want to do and when you lose life that is senseless and because of policy it really upsets everybody. mike: let's look at encounter numbers, march 2021 was significant but this year's march numbers 21% higher, there is on the screen, 173, 277 in march 2021, 221, 203. how do you see assess those numbers, brandon? >> every one of us thought we could hit our ceiling back in '21. we thought the administration would turn a corner and do something different. give us the programs, give us the policies and resources that are necessary to secure the border, they haven't. we don't know that there's a feeling anymore. this month is going to be even worse than the month of march. you know, right now we are apprehending anywhere from 7 to 8,000 people so it could be as high as 240,000 once the numbers come up at the end of this month. it just continues to go up and up and this administration isn't giving us the necessary policies and programs to allow us to secure the border. >> one thing that caught my eye that jumped from february of this year to march of this year, we flashed it on the screen a moment ago, a pretty stunning number, there it is. up 33.4% to more than 221,000 border encounters and then it makes you wonder what happens when title 42 is gone. >> well all we have to do is look at the last year, the last couple of months. when president biden came into office, he kept title 42 but he didn't implement it the same way that the trump administration did. he gave a great number of carve-outs to a lot of nations, african nations, venezuela, cuba, colombia at times brazil eastern european nation, he gave an awful lot of carve-outs and that explosion in illegal immigration and he caused explosion giving to 50% of the countries, what's going to happen when he gives carve-out to 100% of the countries. we are projecting the numbers to go as high as 18,000 and right now we are at 8,000. when that happens we will be pulling out of the resources out of the field and when we pull resources out of the field then cartels will have complete control of our border, more of our children are going the die of overdoses to dangerous drugs like fentanyl which we have already seen in this country. it doesn't make any sense why we are at this situation especially when it is controllable. >> the fox flight team over the eagle pass border crossing there, it's been a hot spot obviously in recent months. when does this all end, brandon? >> it doesn't end until this administration is willing to push back against its open border base. that base wants to to happen. it's by design and until this administration is willing to do that, until this administration is willing to step up and say, the american public means more to us than our base supporters, then we will continue to see this crisis get worse. mike: brandon, final question, what's the level of the men and women in terms of their morale, the men and women in the front lines right now? >> i've got 25 years in this profession and i've never seen it worst than what it is right now. they don't want to come to work, they feel beaten, we don't feel like we can do the job to protect the american public like what we want to do. if you don't accomplish something, you don't feel fulfilled and right now we don't feel like we are accomplishing anything. mike: the french presidential election results for emmanuel macron and marine la pen will be later today. hey, christina. christina: millions of voters cast their ballot in tense presidential election with macron and la pen. centrist macron came in first with 28%. both candidates are condemning putin's war on ukraine although la pen has been sympathetic to put anyone the past and cast doubts on sanctions against russia that she believes could hurt the people of france. la pen says bringing down the cost of living would be her top priority as president and macron has left the country divided over his economic policies. meantime macron is touting his environmental and climate change agenda. today in a crowd of voters he also criticized la pen for saying that she think it is muslim head scarf is uniform imposed by islamist and slammed the proposal to being worn in french spaces. if he wins this election, he will be the first french president to win a second term in two decades. mike. mike: christina coleman live in los angeles, we will follow it. christina, thanks very much. former utah senator and the longest serving republican senator in american history orrin hatch has died at the age of 88. congressional correspondent joins me on life and legacy, chad, welcome. chad: good afternoon, mike, well, he was in the senate for 48 years and president biden in the past hour has put out a statement about orrin hatch and called him an american original. said he had sharp elbows but was a gentle soul. when orrin hatch served in the senate, he was prey conservative but he teamed with ted kennedy, rival senator, democrat from massachusetts, very liberal on children's health insurance also on the americans with disabilities act. he became the chair of the senate finance committee in 2017 and helped usher the passage tax reform back in 2017. he drew some controversy in 1991 during the clarence thomas confirmation hearings because of his attacks on anita hill. she had made allegations against clarence thomas obviously and he said that he thought her allegations against thomas were slick and there was dramatic point during confirmation hearings where he held a copy of the novel, the exorcist and copied and he became the chair when the republicans controlled the senate, mike. mike: hatch gave farewell address sounding concern of the state of the institution, what about that, chad? chad: he always longed for a middle ground. he said that senators should retreat from these partisan trenches as he described it. he had been known as deal-maker early on in his career but later when president trump came to office he sided with president trump on an awful lot of things. president trump wanted him to run mainly because he didn't like mitt romney who is the republican senator from utah. mike: senator had a musical career in his free time, tell us about that. chad: he was a pretty accomplished songwriter, one year according to forms, he raked $39,000 in royalties. he acted some, appeared in an episode of parks and rec and in 2009 he wrote a hanukkah song at the time it was the 19th most downloaded piece of music on the internet and it was right up there with the black-eyed peas and lady gaga, mike. heritage foundation brent sad sadler, brent, welcome. >> thank you very much for having me today. mike: let's take a look at southern ukraine. what have you observed in recent days? >> thank you very much. on this map i would like to focus on the naval front which doesn't get a whole lot of play, a whole lot of attention, a lot has happened in the last week. of course, in this area you had the sinking of the moskva. the chinese are watching that, lots of lessons. those two naval bases are used to rearm and refurbish naval vessels that are launching missile attacks on odesa and into western ukraine. the fact that there was a report yesterday that 3klio class conventional submarines probably going back and sorting the missile attacks and this morning, easter sunday, series of attacks that followed 8 to ten hours later, maybe new coincidence. i'm seeing a similar pattern. shoot all our missiles, go back in, reload and repeat. mike: tremendous focus on mariupol trying to create land bridge from mariupol to black sea. how valuable is mariupol in the next wave. >> right now mariupol is the foe cause. the donbas, this area is key for this part of the war. this war started in 2014, crimea and donetsk. the second to complete donbas and connect to go crimea. it seems to be outstanding question whether there's enough gas behind the russian military to get to odesa but the history, over a period of 100 years the russian empire and soviet union they fought ten wars with the turks over the same territory. they may pause we may be backed into a conflict over odesa. mike: fascinating. let's flip it. let's take a closer look to that map here, what do you see? >> the big thing remember just a few weeks ago you had russian forces that were rapidly relocated. normally, it would take several weeks to refurbish, to replace lost, you know, casualties, russia is now recruiting 60,000 veterans so people that do have some military experience, maybe, you know, advanced age but 60,000 troops to flush into this donbas region. but still, it's been a couple of weeks. it's unlikely that these forces are fully mission capable but, again, with the russian standard they may be good enough. so the push is to come down from the north which we are seeing a dozen or so small villages have been taken as the russians wear down the ukrainian forces in this area at the same time from kyiv as well as from kharkiv, they have to hold here and moverring in reinforcements to bolster in the donbas. another key place is mykoliav. it's key for the russians to move to odesa. mike: no surprise that the ukrainians have fought valiantly to defend their country? >> absolutely. mike: close-up at mariupol and take a closer look at what we are seeing here. obviously great concern about this steel facility where we believe a lot of people were hiding out trying to find a safe place from the fighting. your thoughts as we look at mariupol? >> so when you look closely. i mean, this is a heavily industrial area. lots of underground structures, lots of heavy equipment. it's surrounded on several sides by water. so it's almost like a natural fortress. what's happening inside here is very reminiscent of what we saw in world war ii in the battle of the stalin ground. horrific situation on the ground. it's an open question of how much long the people, mixed civilians with mixed with fighters can hold out in the last inside of mariupol. mike: when you consider how much fighting has been focused in mariupol, what are your fears in terms of the kind of atrocities that may be taking place to win this? >> the nature of warfare is that, you know, men, women and children who are getting caught up in this warfare are going to suffer greatly along with the military folks. it is probably one of the more brutal types of campaign, it's a slow type of warfare. we will only know what the russians decide to let out information. there's still some that come out sporadically on the last holdouts in the steel mill. mike: we are out of time. what surprised you about the conflict so far? >> russia's belief that the ukrainian people would not stand up, that also includes a large portion of ethnic russian and russian speakers in cities of kharkiv. they thought it would be a cake-walk in kharkiv and walk right into nirpa. mike: thank you so much. live report from super speedway [laughter] >> you know, it's nascar, you got favorite drivers and you have unfavorite drivers.
