smollett's case deserved to be aired out and he was not interested in whether or not there was a guilty verdict. he felt like cook county deserved justice one way or another. of course he is obviously thrilled with the verdict. jussie smollett found guilty on five out of six charges. the sixth charge is a charge of aggravated battery. that is because jussie smollett told police that his attacker were wearing masks. the jury found jussie smollett guilty on the five other charges. they are battery because jussie smollett was injured and they were also hate crime because jussie smollett is a black gay man. in all the jury deliberated about nine hours total. seven hours today. two hours yesterday. they only came back with one question. they wanted a copy of the prosecution's calendar which had giant red x marks ton indicating important dates in this trial. jussie smollett will now be sentenced in a matter of couple of weeks. we are waiting for jussie smollett to walk through this lobby. each and every day he has walked through this lobby with his mother usualry locked in arms. his mother is elderly had difficulty walking. almost all of his five siblings has been in the courtroom and that has been strong stroicial see his family show up to support him. we do expect to hear from one of jussie smollett's attorneys as well. tammy? >> tammy: also here tonight to unwrap all of this jonathan turley, george washington law professor and fox news contributor. jonathan, thank you very much for being a man in demand here. what i enjoyed as we led up to this your column explaining that, in fact, why smollett's testimony was so strange, that they were working to full fight jury. one person wouldn't decide not guilty and everyone else is guilty could create a mistrial. clearly after nine hours, there is noily to were no questions, it seems like this was very smooth. that that approach didn't work. what is your -- your take on how this has ended up be, chicago and the strange nature of what the defense did? >> >> the jury got it right i'm from chicago this case tore the city apart. he was race baiting. he used our long and painful divisions over race he wasn't. he was trying to get a vote of nullification for people to acquit him despite his guilt. >> tammy: right. >> it didn't work. six men, six women. including an african-american said no. and what's striking is lynching and speaker pelosi and others. they rushed to fulfill this narrative the jury came to the right decision in the arbery case. that was a jury of mixed races. they came to the right decision in kyle rittenhouse. >> tammy: exactly. >> same mix of jury. they are doing a lot better than our political leaders are doing. >> tammy: i think this is very reassuring because we are relying on the justin system, which is not immune from the nature of what's going on politically in our country and, yet, there is clarity. part large discussion about the issue does reinforce people from chicago despite its history and us not knowing what would happen and the nature of this first elineal nation of 16 indictments early on and this was the second go at it. that it was -- you know, they were taking it seriously. and as a chicagoan but as an american, obviously. sends a message to americans overall isn't working in general but here overall would you agree? we have seen politicians rushing tout say this was all true. and i was afraid, quite frankly that we would begin to see the court system begin to really be corrupted by these pressures. it hasn't been. people still have innate since of justice. i think that what they saw from smollett on that stand was insulting. >> tammy: good point, yeah. >> going to find out that the judge was insulted, too. he just may have sealed his fate in terms of jail time. >> tammy: what is he facing and what is like the highest limit and the lowest but then what do you think he would get and, perhaps him self-testifying changed that framework, that maybe he would have gotten probation and -- if he was lying. i don't know. >> you would have to be able to defend yourself. you know, lying on the stand. if you can do that in the midst of defense if that's a factor here. >> yeah, there used to be thing called exculpatory know where defendants aren't blamed for denying a crime. this is different. if i was his criminal defense attorney, i would have warned him that he is putting everything on the table with this one because key factors for sentencing is when you have remorse. going to be hard for him to change suddenly everything i said on the stand you can ignore that. man am i really sorry for what i did. is he stuck with this narrative ironically. >> tammy: do you think he will get years in jail? she was just confirmed as the new u.s. attorney for mass pass did seems it is like theater but seems literally unbelievable. what is your take on certainly ms. rollins but in general the crime that is spiking all across the country? >> well, tammy, it's tragic that a crime wave is crashing all across the country in places like los angeles and boston. i can't believe the cavalier attitude of george gascon to argue incorrectly that crime is down except for murder. unless you have been murdered in los angeles, everything is fine. that clip you showed from rachel rollins shows why she doesn't have temperament to be u.s. attorney let alone her terrible record as the d.a. in boston. she has rolled entire categories of crimes off limits breaking and destruction of property and drug possession with attempt to distribute and resisting arrest. these two are part of a broad and disturbing trend of what's called soros prosecutors around the country. prosecutors who have been backed by george soros and/or liberal billionaires. that our criminal justice system is. what happened this week in the u.s. senate is the first time in 42 years that there was a recorded vote on the u.s. attorney. typically we grant a lot of deference to the president and two senators from the state. i put my foot down and said i wasn't going to allow that to happen on this one. every democratic senator needed to go on the record that includes maggie hasan from new hampshire. a state that is doing with a terrible opioid problem. 80% of the drugs in new hampshire come from massachusetts. she just voted to make rachel rollins the chief law enforcement officer of the federal government in massachusetts. maggie hassan is going to answer to that for the voters of the granite state next fall. >> tammy: this is going to be a disaster. so much talent in the country to deliberately choose someone who is so unsuited for such an important position is remarkable. and there is this commitment, you know, all it does with the soros approach the far left and wanting chaos it seems to me that they have believed they felt that this would aid them in either growing government or getting elected. do you think that's possible that this is actually because everything they do seems to be attached to the politics of it. that this is now back firing? just some real hard core facts. crime is up significantly. murders are up in double digits in many big cities. crime suspect across the country. >> tammy: that's right. >> drug crime. 100,000 people murdered. >> last year by fentanyl overdoses. >> tammy: horrible, honorable. that is murder. you are right. that's murder. >> driving crimes are up. auto theft is up. burglaries as we now see are up. and a lot of this is being driven by a whole host of things. this isn't something that was solved by the prior administration. it certainly isn't going to be solved under the current plans of the administration. but, you know, we have got to look at the sources of these things. now we add to this mix inflation. it's going to cost us, you know, $4 a gallon to put patrols on the street. it's going to cost $150,000 just to put a man or a woman in uniform, if they are willing to take the job. talk about a crisis. we have a recruitment crisis in this country. >> tammy: right. >> we have a retirement crisis. why? because people don't want to work in law enforcement and why is that? because they are treated like dirt. come on. we have got recognize a couple of just keen observations. crime is up. we're a nation of laws. and we can either let them go and make things up as we go along or we can decide we're going to be a part -- that's what we have been asking. >> tammy: i have to tell you. they say about pandering and placating to the left by not doing anything and placate people who actually want crime to stop by playing both sides, right? >> i have great news. there is a new marine preserve expansion around the islands. this has been in the works for many, many years. it stalls and gets going and this it new president has only been in office in ecuador for 4 months. just came in. got it done. announced it in september. it's going to be enacted and in effect in january. not only is it this great marine reserve, he has the fishing industry is happy. everybody is happy. everybody is going -- the economy is going to grow. we can do it right sometimes. i think this will go into other countries other marine reserves. one thing we know about these reserves is when we just leave a section of the ocean alone, it doesn't take long before it comes back. that's really good news. >> tammy: we don't think about the things we don't see under. the coral reefs and the fish and whales affected by military actions. people don't that's ecuador. >> most people don't. it's 600 miles off-shore. it's not obvious to most people. i have been going there 20 years. i have seen the difference in the abundance of sea life. my hero is dr. sylvia earl said without healthy oceans we don't have oceans. without oceans this planet looks like mars. >> tammy: having someone with your profile makes a big difference for new presidents wanting to get things done for the world to take notice. don't you agree?
