system we trust versus all of those institutions we don't. juries take an oath to be fair. juries do not confuse opinion with fact. what about the media and politics? do you think they take an oath to be fair. ? court there are rules, there is a referee, a referee may be imperfect but that is better than no referee at all. where is the referee in politics, in court the jury evaluating the evidence for themselves, there is no reporter, no politician editing what happened. in court you have to be complete, fair, factual and complete, how different that is from the other institutions, courts use cross-examination. maybe the real reason we respect our justice system is the destination sought, juries seek something called truth. media want to be first, juries want to be fair, politics wants to win at any cost, juries know the rules matter as much as the out come matters, juries are the smallest form of government we have. 12 americans deciding matters as important as life and death. and proclaiming a verdict based on fact. juries are not perfect. no institution on earth is. but at least juries acknowledge there is a perfect. there is a truth. and that is more than i could say for the other institutions. joining us now former u.s. attorney fox news contributor, andy mccarthy, what is your take on the two verdicts? also the reaction to the verdicts? >> trey, i think they are the right verdicts. i think there is a lot to what you just laid out. in terms of the difference between you on the jury system works and how politics work. how our other institutions work, to me most important distinction is that in a trial and we saw this in the two trials. we don't put 12 experts in the box, we put 12 people with common sense in the box, if they need expert testimony, the idea is they get to hear from an expert who can give them some experience or expertise in a area that is material, but in end we trust common sense of the community to make the decision. it seems in politics, we put the experts in charge, and they sometimes have so much tunnel vision in term of ex expertise they mix the big picture, i don't think that juries do. trey: andy, i fear, i have seen it unfolded over last 5 years. this politicalization of our justice system. if we don't have, that i don't think we have anything, it seems that everything has a political undertone now. >> yeah, this is right. i think if you have they two-tier justice system, which i think a lot of people look at our justice system and rightly worry that is the case, then you don't have undergirding of the rule of law, that means any chance of a prosperous society hangs to the balance, we have bedlam, if we don't have an institution like the legal system giving us results we think are legitimate, we can't have the rule of law. i worry very much about the justice department, this justice department in particular. trey, i would say in connection with second case, aubrey case, that came second of the two that we were discussing. i have to sit here and ask myself, what is the justice department doing? they filed an indictment against the 3 men who was -- rightly, i think convicted in aubrey case, their theory of the case is that aubrey was killed solely dow to his race, there was no -- due to his race, it is a racially obsessed dominant view of the world. you look at trial that happened in georgia, they didn't prove race at all. they just proved what the facts of the case were. and that was more than enough for the jury to reach the correct verdict. i would in my life heard of a case where prosecutors have a motive they can prove pe beyond a reasonable doubt and they don't prove it. trey: you are a former prosecutor, when you add elements you add more things to prosecutor has to prove. you begin to jeopardize -- you can only serve one life. let me ask you, you have a quality that i often admire, the ability to say, i like this person but he or she is wrong or a don't like this person but he or she is right. how do we get more of that in our culture? separating you know, what should happen from our affection or lack of affecttion for the person doing the acting. >> trey, we come from the same world, which is not journalism. if you are successful as a lit gator, you have to come up with ports of your case that are weak, if you don't understand where you are at and where you are vulnerable then you don't have a chance in a setting that is designed to be how do we get to the right answer or the truth. you don't have a chant to chance -- chance to do well in that setting, we need to be more honest about situations we're in a lot less of a mind we have to be on one side or another. i have strong conservative views but i don't feel i could be an effective conservative unless i understand what the facts are. i don't want to spin in learning the situation i'm in, i want to know the situation i'm in, then i can go from there. trey: well said, andy, thank you for joining us, hope you enjoy the weekend. >> thanks trey. trey: are you rashal? >> i define it as use of knowledge to attain goals. that is there is something that you want to show, you want to get. and you use brain power to attain it. trey: professor that leaves he to wond for people are not using that to make decisions, what are they using to make decisions? that seems so rational. what are they using? >> yes. sometimes people use impressions, stereotypes, anecdotes, rumors theories that make your open side look noble and wise and other side look foolish and stupid. alignment with the truth. that doing things that actually conform to reality, we're capable of it, that is how we hold a job, and pay our taxes. but in some realms we may be just trying to make our own side look good. trey: all right, someone who is watching this says that makes sense, i want to train my find the to be or rationale doing able to disregard irrationality when i see or hear it, is it possible? it you train your mind to do that? >> yes. that is one thing i try to convey in my book, explain the major tools of rationality. that don't come naturally to us, like logic and probability and distinguishes correlation from causation. part to have at our fingerprints the tool of rationality, another part to belong to communities of people that follow rules s -- are aimed at getting at the truth. none of us is perfectly wise or rational, we're fallible. when you have a group of people that are allowed to criticize each other's fallacy that gives you hope that the group following those rules can be rational in the way every individual person could never claim to be. trey: how does rationality coexist with love and loyalty. how do we marry up love and loyalty and other things that are maybe less reliable. >> there is a kind of rationality to it, when you think about it. if she were to choose the best lucky, funniest, richest person, by law of averages someone better was bound to come oc long in future, she would drop you like a hot potato. if she loved you because you are you, that unique person. that at least gives you some grounds for committing yourself to her, and visa versa. even if cases of romantic, infattation falling head over headlines there is kind of a rationality to it. sometimes it pays to be a blitzer rational. trey: i watched some of your videos, i think that topic you took on to write about, it is fascinating. my previous guest was in a courtroom as was i, we logic and facts, i would like to talk to you again some point and for folks interested and rationality and why they need it. i recommend the professor's book, thank you for joining us professor pinker. >> thank you very having me. trey: yes, sir. >> this week russia and china signed a military pack, both ramp up military exercises in ukraine and taiwan, what this means for you, why you should be taking note next on "sunday night in america." n my windshie. the experts at safelite autoglass came right to me... with service i could trust. right, girl? joining us now, congressman devin nunes from california. i love reminding people you were talking about russia long before it became fashionable for people to talk about russia. against on backdrop, you have been talking about them way before anyone else. are you concerned about this allegiance. >> we've been one of few committees in congress investigating china back or over a decade now, republicans in house intelligence committee, and reason we were interested in russia back in the day, the obama-biden administration was so lax with russia, the attacks by al qaeda on our country, the largest intelligent failure was not understanding putin's plans. you are asking, this is reminiscent of old soviet union in late 1930s creating a pac with hitler's germany, we know how that ended. it did not end well for hitler or the russians, there is a lot of similarities there, russia is a small country, a oil petro state. has not been able to gets it ag together for a long time. you are this juggernaut in china. that is looking for global domination. i think at some point of chinese believe they will take advantage of russia. i think that russians are on a slippery slope trying to make buddies with the chinese. trey: you know, devin, president biden, i think over the weekend said that america is back. i don't want to be unnecessarily disrespectful, but it honestly does not seem that way, the world seems more chaotic than it has ever been. what leverage does the u.s. have with russia or china if they were forming this alliance? >> that is a really good question, america is back. -- in only some strange alternative realty, you look across the globe, it is on fire. when you have, this is what you were alluding to, reported 100,000 troops on the ukrainian border, this is not like the russians are trying to pretend here, this is a major troop build up, larger than we've seen even before the last time russia went into ukraine and took over crimea. you also have the chinese, who are clearly telling people they want taiwan back. and i just believe when no matter you know where you're -- your enemy circumstance en is. when your enemy tells you they will take over an island, in this case taiwan, i would believe them. what are options of united states? not a lot of great options, our military strength and size is lower than it has ever been, i think the moral in the military is very low because of this new wokeness culture that has been grout brought into the military. and forced vaccinations, a lot of things that don't have to do with winning wars and providing for deterrents are occurring in u.s. military. i think that the chinese and russians sense that, they see an opportunity to take as vantage of a very weak -- advantage of a very weak u.s. administration. trey: i'm letting you go with this, if republicans retake the house. will you be the chairman of the intelligence committee even if not the chair will you remain on the committee? what should be priority one for the new chair. >> china has to be number one important, we are conducting an investigation into the china, hahas not received a lot of coverage, but we're looking at u.s. companies and their supply chains and how they are reliant on china, we're conducting this investigation now, the democrats are not helping. but if the republicans take control. trey, as you well know, we'll have subpoena power, and focus will need to put a microscope on the supply chain issues that have proven to be show numerous vulnerabilities throughout the united states economy and our allies' global economy. trey: devin nunes, always great to see you, look forward to talking to you soon. >> thank you, too, thank you. trey: killing of 6 people, including a child. at a christmas parade, cannot quiet the voices on the left who continually apologize for criminals. our next guest is not a member of the squad. he has a very different take on what public safety should -- look like, senator lindsey graham is next on "sunday night in america." is that santa claus? last sunday night in wisconsin it was not santa claus coming down the parade route. he is not a career criminal on bond. it was darrell brooks a life long criminal who has been hurting people for most of his life, he was on sex offender registry on bond again, running over parents, grandparents and children. the night of joy in wisconsin ended with agonizing grief, then that grief turned to anger because darrell brooks jr. never should have been driving, he should have been in jail, days before we learned he ran over people at a christmas parade, prosecutors in wisconsin already knew he ran over someone with his car, they knew he had a lifetime of violent, but wisconsin prosecutorred recommended a $1000 bond. that is all security the prosecutors needed to let darrell brooks jr. back on the streets, now 6 body bags later, prosecutors finally concede, that bond was too low. we already know that. a thousand dollars was too low when you set it. now after 6 people are dead, and dozens more injured, you set the bond at 5 million. so what is different now? he was a career criminal before he killed 6 people at a christmas parade, we don't need prosecutor to react after there are 6 bodies laying on a parade route. we need them who prioritize public safety beforehand. and still on the left calling for lower bonds, always a battle, a division between team of good conscience and small segment like darrell brooks who condition ever seem to -- can't ever seem on follow the law. what is different now politics are sides with criminal element, they can never bring them selfs to talk about the victims of crime, but only perpetrators of crime. if you think that $1,000 was right bond amount for a career offender who ran someone in early november to be out of jail in time to run over dozens of people at a christmas parade, say so, say it loud enough where we can hear you. the rest of us need tomorrow for all novembers to come to make sure the criminals sympathizers and apologists masquerading politicians are never to influence policy in this country again. joining us now, senior senator from great state of south carolina, lindsey graham. we talk about the justice system all of the time. there are parts that should be reformed. but setting bond for a criminal offenders -- would not be what we're talking about. >> number one, what does it take to lose our license in wisconsin? there are so many things to talk about here, you did a good job of making this case real. what do you say to the family of the victims. how do we go to them as a nation and explain to them that this man was allowed to be loose given this criminal record. the chickens are coming home to roost when it comes to crime and radical left, it is fashionable in blue states and liberal district to softoo crime. we need to vote. congresswoman tlaib has a bill to. empty federal prison. some want to get away with cash bail. i am going to stand with the cops, with making it harder to get bail when maul over and over. over. trey: a clip for you and your reaction. >> when they read all of the changes he had prior to what he did on sunday, it made my sick to my stomach, then to hear him crying when the judge mentioned that these carried a life sentence to me it was selfish he did that, he was worried about himself. trey: you know senator, you mentioned members of squad, you mentioned tlaib. you know as much about the federal prison system. think about who is in federal prison, that she wants out in a decade, boston marathon bomber, unabomber, terry nichols. then in her state of south carolina i'm positive that dylann roof is so death row. >> yes, trey this is insane and crazy and dangerous, 2022 will be a very dangerous year for america if something does not change, terrorism on the rise ramp ant inflation, we have a broken border, you have iran about to break out with a nuclear program putting israel in a box, and here at home you have crazy people pushing laws that make it harder to prosecute people, and let people out who should be in jail. and look at california, people are going to stores and cleaning out the place, thousands of dollars of taken by the flash mobs, what happens to them? this started with defunding police. this concept to defund the police, sent a signal to criminals that are no more consequences when it comes to breaking the law, people are not afraid of breaking the law, they are emboldened to break the law in south carolina where you live, you try that crap here you are geeing to jail if you are luck -- doing to jail if you are lucky. trey: you say on the ballot in november. >> yeah. trey: i hope that republicans can quit fighting with one another long enough. this is a great issue, if we can focus on that, instead of the other nonsense. >> amen, trey, we're the party of having the cops back, i'm for judicial reform, for police reform but not for letting this guy out out of jail. i am not for letting people ransack stores with no accountability, i not for doing away with cash bail. if we as republicans don't talk about that, that is political malpractice. giving us issue, the enemy is radical left who is driving dem democratic party down an insane road. if we win in 2022 this crap stops, kevin mccarthy never lets these bills come out of the house, if i'm chairman of the judiciary committee, we'll have hearing about how you can loot a store and nothing happens to you, and hearing about how a state can let a guy like this out after all of his criminal record. and why you would set at $1,000. trey: thank you, senator. >> thank you, happy hanukkah for our jewish sends. trey: yes, sir. >> what if we were thankful all year long, hall of fame quarterback brett favre will join us next. >> and rachel campos-duffy and her husband, when "sunday night in america" comes back. you know, but, petty stuff. i have said this so many times that sports such a -- specially football, such a galvanizing way of bringing people together. and you know, what you routeing for your team and -- rooting for your team, you said dallas is your team there are a lot of other people out there rooting for dallas, i was a dallas fan growing up myself. you know, again sports it is galvanizing. and i don't know what we would do without it. trey: i don't know. you mentioned growing up, if my research is right, you were not heavily recruited out of high school as a quarterback, some people wanted to play defense for all of the people who may be feel under appreciated. did that motivate you how the recruiting coordinate ors got it so wrong. >> i don't think if it was wrong, this is a time there was not instance media, you have to physically go and see a player play to recruit. you done have youtubes and huddle apps and things like that. but my father was my head coach. he was stubborn as any mule you will ever come across. he was determined to run the football, that is what he did, he ran the wish bone for older generation, they know the wish bone. newer generation, it was a running formation offense. so, i was talented but, the bulk of my throws were all in pregame. and he would tell recruiters when they came, we want to see tape on your son, he would say you want to catch him throw you have to come to pregame, i don't know if they got it wrong. i think southern miss got it right, they offered my at last second. and saw value in what i could do. more so than play quarterback, i could punt and play defense and special teams. i wanted to play quarterback. but i had to start at the bottom of the totem pole and work my way up, that is what i did. trey: i'm smiling they say dean smith is only person in world that could hold michael jordan under 20 points a game as his head coach, you could have brett favre as our quarterback and still want to run the wish bone, but can't argue with dad. >> i can't tell you how many times once i made it in pro football, my dad and i would be in the truck, he would start trying to coach me. on the plays that i did wrong during the game. you know, son you were 28 for 32, you could have been you know -- i would say dad, wait. i don't want to hear it. you ran the wish bone, you had nothing to do with passing the football. and now you will teach me or try to tell me how to pass? i'm not having it. trey: i tell you this. i was a dallas fan, i pulled for you. i was brett favre fan, i still am, hope you have a great thanksgiving thank you. >> thank you for having me. trey: i have been in the home of our next guest. the night of president's debate in 2012, rachel invited friends and family to come over, moving a million miles an hour. holding a kid in one arm, and snacks with the other. out with a brand-new book, i am sure rachel wrote all by herself, while holding a child, rachel campos-duffy and her husband, i think it may be sean, if i am reading this right. >> yeah. we're good, he is green with envy you got to interview brett favre. >> that is awesome, you have similar hair, it looks good together. trey: the same color. all right. rachel, how did you have time to write a book? >> we make time, i love what you just said about your wife, i have met her, she is sweet as pie, i believe every word she said she has thankful all over the house, that is the kind of woman she is, a good christian woman, i like that message it reminds me, you have to be intentional about being thankful in these times, in these cultural moments we have to be intentional about christmas, specifically advent. the beginning of 4 weeks leads to christmas, which starts today, it is also the first day of hanukkah, the book is about traditions and intentional about them. what people do to celebrate christmas, every chaptser different, our chapter talks about your religious traditions, the real meaning for the seen when is, of course, the birth of christ. trey: i want to let everyone know, i love your husband, not only he still is one of my favorite colleagues, certainly was while i was there, we picked our office to be close to another another, and sean, one thing i loved, admired about you, you always had a smile on your face. no matter what else was happening. even on the worst days, you still had this joy about you. how did you do that? >> well, i had a bigger smile when you would come to wisconsin and help he campaign, biggest crowds when trey gowdy would come to wisconsin. you know, you talk about smiling on the face, because like you, i married up, we did well. terry way better looking than you are and way nicer than you, rachel the same for me, and the truth is, we're blessed to have good women in our lives, nice kids. and the faith that makes us whole. like rachel said in the book, we have very intensetional stories about our faith but there are a lot of funny store stories and sad stories. there is a story christmas, one year here mom had breast cancer they didn't get a christmas tree, a neighbor brought over a decorated fake tree. and her mom made it through breast cancer, but they keep that christmas tree that when they didn't have one someone brought it to them, they put it up every year, to celebrate christmas and how thankful they are their mother survived this challenging year. we see people in different ways, i see you, once a night on sunday, other times on fox, but people share a story beyond that we see a deeper size of who they are. how they celebrated christmas when they are little and now. >> we're coming out of a time where our government has been trying to tell us shut down easter, and thanksgiving, and christmas. and now we're coming out of this pandemic, i think people are excited to celebrate christmas. and hanukkah. but to make sure we hold on to the traditions, we don't want our government to interfere with that, and i think that this book is number two on the "new york times" bestseller, i think people are excited about christmas, they love fox. and so if you have any on your christmas list, who loves fox news, and you will just make it really easy, you have to get the book they will love it, that is it. trey: we have a little bit of time. there is a good chance terry will kick me out of the house because i mentioned her name. if i were celebrating christmas at duffies what would i experience. >> we would wait to cut down our tree outside with you. you could be a lumber jack. >> we have a huge nativity scene, tables long, her mother gave to her, that is what you would see. trey: two of my favorite people, thank you for spending part of your sunday with us, happy first night of hanukkah to our friends celebrates, "life, liberty and levin" is up next. ♪ ♪ ♪ mark: hello america, i am mark levin, this is "life, liberty and levin," look where we are, mar-a-lago, with president trump, a great honor,. >> thank you very much. mark: you put together a fantastic book, our journey together in the beginning of thetr book you
