taking this as a legislative compromise when the opportunity is so much greater or when biden could do this stuff with a stroke of a pen and is just reminding us that he is not choosing to. i have a lot of trouble reading her writing. i'm glad she doesn't write for us. she says empty promises were made to progressives and she is not guaranteeing they will back the bill if it comes back to the house, this as kevin mccarthy says he will do everything he can to strike the bill down if it makes it back to the house. >> if it fails in the senate it dice. if the t senate changes it, any of the changes have to come back to the house so we have another bite at the apple here. todd: the congressional budget office estimates the bill will raise the national deficit $367 billion over the next 10 years, even though the white house claims it is fully paid for. carley: former president trump says he thinks americans are ready to fight back against democrats' radical agenda at the polls. >> this country has tremendous potential. tremendous. but we're giving it away. and there will be a point -- there will be a point where the country can't come back and we can never allow that that point to be reached so i think things are going to happen very big in the midterm elections and i think in 2024 it's going to be a great result. carley: the former president also tearing into president biden, blaming him for the soaring inflation and calling his policies incompetent. i think the aoc interview with the new york times is very interesting because she said that if the senate doesn't pass the social spending bill as it was passed in the house, that pro egress i'ves -- progressives may try to stone wall the rest of president biden's agenda which is music to republicans' ears. todd: what's insane to me about this is they created leverage by being the loudest voices in the room. numbers-wise, they don't have the leverage. they managed to push their party so far left and in the process they created the leverage that will ultimately destroy them in the midterms and help republicans. it's a pre verse relationship between aoc and republicans that is playing out in front of us. carley: aoc said after the virginia race and when it went to glenn youngkin, she said the reason it did is because democrats weren't united around the progressive agenda enough and there wasn't enough excitement within the democratic party and they were too moderate. you listen to other democrats and they say -- and republicans are saying keep thinking that but the reality is that people are rejecting the progressive agenda and that is why glenn youngkin won the race and why there's such a big prediction that the midterms are going to go to the republican party. todd: carley, the average american doesn't necessarily say i am so entrenched in a party and they don't care about the stuff that the progressives want. i was in a room full of quote, unquote democrats this weekend. nobody was saying i need more of the aoc stuff. they were talking about kitchen table issues and the normal american approach to it, not everything is free and let sers abandon our -- let's abandon our principles that we established over the last 250 years. carley: if you look at how president biden has governed, he's definitely tipping his hat much more to the progressive agenda, if you think about $400,000 paychecks possibly to illegal immigrants, rejecting any semblance of border policies, this big, massive social spending bill that he is pushing to be his legacy. those are all extremely progressive ideas. and if you do think about why he's doing it, it's because there is a great fear there by the president that if he doesn't -- if he doesn't make the progressives in his party happy, then they will abandon him and that's why aoc gave this interview to the new york times, saying exactly that. the only problem with that is i don't think that joe manchin or kyrsten sinema care what aoc has to say and they're the ones that could possibly hold up this bill in the senate. todd: one area where democrats are united, silence over hunter biden. i wasn't telling you to be quiet. hunter biden's firm reportedly helping a chinese company purchase one of the most lucrative cobalt mines in the congo from an american company. the new york times reporting, quote, the president's son was part owner of a venture involved in the $3.8 billion purchase by a chinese conglomerate of one of the world's largest cobalt deposits. james comer had this reaction a little earlier. >> when a republican says something about hunter biden, all you hear is crickets. they know hunter biden is a problem. they just don't want to talk about it and they hope he'll go away but he's not going to go away. he makes the news every week. and every week it's something a little worse than the previous week. so the democrats are going to continue to turn a blind eye to hunter biden. this is going to be a big issue for house republicans when we try to win the midterms. somebody needs to hold hunter biden accountable because he's a national security threat. todd: if you're creating the commercials that republicans utilize during the midterms, have you a altogether of material with -- a lot of material with which to choose from, most of it created by the biden administration. there's a lot of hunter biden stuff to run on. you as a republican say if we take over the senate and the house, we can have investigations into this and those investigations are not happening you now because the democrats are in control of congress. if you're upset about hunter biden and about the national security implications and about the fact that the whole hunter biden story went unreported on prior to the 2020 election, we as republicans are going to get to the bottom of that if you elect us. carley: look at the $3.8 billion deal that hunter biden founded may have this chinese company owned, gained the rights of this cobalt mine in congo and the reason that's so important is because the way that china wants to become one of the -- one of the ways that china wants to become the world's leading super power is to own all of these rare earth minerals, cobalt being one of them. so this cobalt mine used to be owned by an american company and through hunter biden's firm it exchanged hands and it's now in the hands of a chinese company, of course his firm made money off of that. so this whole deal that hunter biden brokered helped china and it certainly hurt us and we're talking about the president's son here. todd: we need information on it. time now, 17 minutes after the hour. kyle rittenhouse sitting down with our own tucker carlson for his first interview since his acquittal. carley: despite that verdict, some lawmakers and members of the media are convicting him in the court of public opinion. >> this case has nothing to do with race. i never had anything to do with race. at this time while we are working on notifying the family members of the deceased. we're no longer looking for a suspect vehicle. we do have a person of interest in custody at the moment. but this is still a very fluid investigation. todd: waukesha, wisconsin chief of police daniel thompson confirming they have a person of interest in custody after a driver plows into families and participants at a christmas parade. attorney bob bianchi joins us now. what's your initial of evaluation of what you saw? >> it seemed to me, tom, when i saw a specific breakdown of a cargoing through that at a certain point in time just before he was approaching the parade, the car veers to the left, looking as if they're trying to avoid the people that are in the parade. however, there were all sorts of people to the left of that, that got injured. so initially there were thoughts that it may be terrorism. i don't think that that's going to be in play with regard to this, the cause of that particular issue. there were targets of interest they could have gone after that could have caused more carnage. it looks like the person may have been fleeing another scene, police when the police officers fired shot, adrenaline is pumping. they're going through the crowd, looking to get away. there's a lot of facts we don't know yet. we want to make sure was there anyone else involved. we want to break down all the social media components. we want to find what the motive is for this particular situation. obviously, there's a lot more information. when i was a prosecutor, i had to do press conferences, i know the media want to be so far out ahead. the job of investigating is laborious. we typically go slow and steady, that's the right way to do things, as opposed to getting too far out in front of the facts right now. we have to wait and see. todd: how much interaction is there right now going on between the police and the prosecutors? >> well, there should be a tremendous amount. this is a big issue i always have. when police do investigations like this, they should talk to the prosecutors. i always have my prosecutors involved in any significant investigation. why? at the end of the day, when they charge somebody, the prosecutors have to go into the courtroom and prove the case beyond a reasonable doubt. maybe the next coble we're talking about with -- next subject we're talk about with rittenhouse, would be an illustration of what happens when that's not of done correctly. we have to make sure that rights are protected and the investigation is done correctly, that the trial proceeds to prove a case beyond a reasonable doubt and that's at the hands of prosecutors at the end of the day. prosecutors being involved at this stage of the investigation, crucial. todd: you mentioned rittenhouse. here is kyle rittenhouse from his exclusive interview with tucker carlson. listen. >> this case has nothing to do with race. it never had anything to do with race. it had to do with the right to self-defense. >> right. >> i'm not a racist person. i support the blm movement, i support peacefully demonstrating. todd: as you know, bob, that doesn't matter to so many democrats, so many in the mainstream media and so many leaders in congress including congressman jerry nadler who is calling for the doj to review the rittenhouse case. here's what he tweeted after the verdict, this heart breaking verdict is a miscarriage of justice. justice cannot tolerate armed persons crossing state lines looking for trouble while people engage in protests. that statement is filled with falsehoods. why do democrats and the mainstream media seem so hell-bent on destroying the justice sis tome and resorting to trial by mob when they don't get the result that they want? >> this is an interesting thing and it's -- i'm not a political commentator. i'm a legal analyst. when we got this case, i wrote down when i was hosting my own show, that he brought to the gun to kenosha, that he was the initial aggressor, he never attempted to retreat, he provoked the encounters and he shot peaceful protesters. when we covered the show, gavel to gavel, we watched the entire thing, we realized he did not cross state lines with a weapon, he is not a member of a white supremacist group, was not a person that was the initial aggressor, he was the one being pursued. look, he was a cop wanna-be. he went through to take graffiti down. he did not initiate this. he was being purchase assumed -- pursued. when i was doing the show, if it was an african-american, hispanic, conservative or liberal, when the state's case went in and there was a witness testifying for the state and i asked my producer is this a defense witness that got called out of turn and they said this is the third victim. i said they're providing a self-defense claim. all of us collectively knew there would not be a guilty. most were thinking it would be a hung journey or outright acquittal. it's sad because there's narratives versus fact. and in the court of public opinion, people have a narrative but unfortunately if had they looked at the trial, the prosecution didn't have the evidence. todd: the only thing that matters is the evidence presented within the four walls of that courtroom. nothing else matters. the mob needs to realize that. otherwise, our system of justice is in a lot lot of trouble reading her writing. i'm glad she doesn't write for us. she says empty promises were made to progressives and she is not guaranteeing they will back the bill if it comes back to the house, this as kevin mccarthy says he will do everything he can to strike the bill down if it makes it back to the house. >> if it fails in the senate it dice. if the t senate changes it, any of the changes have to come back to the house so we have another bite at the apple here. todd: the congressional budget office estimates the bill will raise the national deficit $367 billion over the next 10 years, even though the white house claims it is fully paid for. carley: former president trump says he thinks americans are ready to fight back against democrats' radical agenda at the polls. >> this country has tremendous potential. tremendous. but we're giving it away. and there will be a point -- there will be a point where the country can't come back and we can never allow that that point to be reached so i think things are going to happen very big in the midterm elections and i think in 2024 it's going to be a great result. carley: the former president also tearing into president biden, blaming him for the soaring inflation and calling his policies incompetent. i think the aoc interview with the new york times is very interesting because she said that if the senate doesn't pass the social spending bill as it was passed in the house, that pro egress i'ves -- progressives may try to stone wall the rest of president biden's agenda which is music to republicans' ears. todd: what's insane to me about this is they created leverage by being the loudest voices in the room. numbers-wise, they don't have the leverage. they managed to push their party so far left and in the process they created the leverage that will ultimately destroy them in the midterms and help republicans. it's a pre verse relationship between aoc and republicans that is playing out in front of us. carley: aoc said after the virginia race and when it went to glenn youngkin, she said the reason it did is because democrats weren't united around the progressive agenda enough and there wasn't enough excitement within the democratic party and they were too moderate. you listen to other democrats and they say -- and republicans are saying keep thinking that but the reality is that people are rejecting the progressive agenda and that is why glenn youngkin won the race and why there's such a big prediction that the midterms are going to go to the republican party. todd: carley, the average american doesn't necessarily say i am so entrenched in a party and they don't care about the stuff that the progressives want. i was in a room full of quote, unquote democrats this weekend. nobody was saying i need more of the aoc stuff. they were talking about kitchen table issues and the normal american approach to it, not everything is free and let sers abandon our -- let's abandon our principles that we established over the last 250 years. carley: if you look at how president biden has governed, he's definitely tipping his hat much more to the progressive agenda, if you think about $400,000 paychecks possibly to illegal immigrants, rejecting any semblance of border policies, this big, massive social spending bill that he is pushing to be his legacy. those are all extremely progressive ideas. and if you do think about why he's doing it, it's because there is a great fear there by the president that if he doesn't -- if he doesn't make the progressives in his party happy, then they will abandon him and that's why aoc gave this interview to the new york times, saying exactly that. the only problem with that is i don't think that joe manchin or kyrsten sinema care what aoc has to say and they're the ones that could possibly hold up this bill in the senate. todd: one area where democrats are united, silence over hunter biden. i wasn't telling you to be quiet. hunter biden's firm reportedly helping a chinese company purchase one of the most lucrative cobalt mines in the congo from an american company. the new york times reporting, quote, the president's son was part owner of a venture involved in the $3.8 billion purchase by a chinese conglomerate of one of the world's largest cobalt deposits. james comer had this reaction a little earlier. >> when a republican says something about hunter biden, all you hear is crickets. they know hunter biden is a problem. they just don't want to talk about it and they hope he'll go away but he's not going to go away. he makes the news every week. and every week it's something a little worse than the previous week. so the democrats are going to continue to turn a blind eye to hunter biden. this is going to be a big issue for house republicans when we try to win the midterms. somebody needs to hold hunter biden accountable because he's a national security threat. todd: if you're creating the commercials that republicans utilize during the midterms, have you a altogether of material with -- a lot of material with which to choose from, most of it created by the biden administration. there's a lot of hunter biden stuff to run on. you as a republican say if we take over the senate and the house, we can have investigations into this and those investigations are not happening you now because the democrats are in control of congress. if you're upset about hunter biden and about the national security implications and about the fact that the whole hunter biden story went unreported on prior to the 2020 election, we as republicans are going to get to the bottom of that if you elect us. carley: look at the $3.8 billion deal that hunter biden founded may have this chinese company owned, gained the rights of this cobalt mine in congo and the reason that's so important is because the way that china wants to become one of the -- one of the ways that china wants to become the world's leading super power is to own all of these rare earth minerals, cobalt being one of them. so this cobalt mine used to be owned by an american company and through hunter biden's firm it exchanged hands and it's now in the hands of a chinese company, of course his firm made money off of that. so this whole deal that hunter biden brokered helped china and it certainly hurt us and we're talking about the president's son here. todd: we need information on it. time now, 17 minutes after the hour. kyle rittenhouse sitting down with our own tucker carlson for his first interview since his acquittal. carley: despite that verdict, some lawmakers and members of the media are convicting him in the court of public opinion. >> this case has nothing to do with race. i never had anything to do with race. it had to do with the right to self-defense. carley: criminal defense attorney bobby yunkie joins us next. when it comes to autism, finding the right words can be tough. finding understanding doesn't have to be. together, we can create a kinder, more inclusive world for the millions of people on the autism spectrum. go to autismspeaks.org >> we will not be releasing information on the fatalities at this time while we are working on notifying the family members of the deceased. we're no longer looking for a suspect vehicle. we do have a person of interest in custody at the moment. but this is still a very fluid investigation. todd: waukesha, wisconsin chief of police daniel thompson confirming they have a person of interest in custody after a driver plows into families and participants at a christmas parade. attorney bob bianchi joins us now. what's your initial of evaluation of what you saw? >> it seemed to me, tom, when i saw a specific breakdown of a cargoing through that at a certain point in time just before he was approaching the parade, the car veers to the left, looking as if they're trying to avoid the people that are in the parade. however, there were all sorts of people to the left of that, that got injured. so initially there were thoughts that it may be terrorism. i don't think that that's going to be in play with regard to this, the cause of that particular issue. there were targets of interest they could have gone after that could have caused more carnage. it looks like the person may have been fleeing another scene, police when the police officers fired shot, adrenaline is pumping. they're going through the crowd, looking to get away. there's a lot of facts we don't know yet. we want to make sure was there anyone else involved. we want to break down all the social media components. we want to find what the motive is for this particular situation. obviously, there's a lot more information. when i was a prosecutor, i had to do press conferences, i know the media want to be so far out ahead. the job of investigating is laborious. we typically go slow and steady, that's the right way to do things, as opposed to getting too far out in front of the facts right now. we have to wait and see. todd: how much interaction is there right now going on between the police and the prosecutors? >> well, there should be a tremendous amount. this is a big issue i always have. when police do investigations like this, they should talk to the prosecutors. i always have my prosecutors involved in any significant investigation. why? at the end of the day, when they charge somebody, the prosecutors have to go into the courtroom and prove the case beyond a reasonable doubt. maybe the next coble we're talking about with -- next subject we're
