>> white house taking criticism from both sides. >> joe biden won't go down to the border. kamala harris won't go down to the border of the rio grande valley in del rio. they insist these problems aren't happening. >> the biden administration must halt all deportation of haitian migrants. >> of all the president's screw-ups, there is not a single one greater than the crisis at the border. it is a crisis. >> i'm not just unhappy with the cowboys who were running down haitians and using their reins to whip them, i'm unhappy with the administration. >> dana: we're following this from los angeles. good morning, william. >> story is evolving on tro fronts. the camp is shrinking to under 5,000 thanks to mexico stopping bus loads of haitians from moving north and the biden administration trying to make the nightmare disappear by deporting migrants back to haiti and releasing thousands of others to u.s. streets, bus stations and airports with no more than a piece of paper suggesting they show up at a government office in 60 days. the disaster unfolding for the biden administration caught between a rock and hard spot claiming the haitian migrants would be immediately expelled as officials privately admit they're being released on a very large scale. republicans saying enforce the law. democrats begging the president to grant full asylum to everyone. listen to the administration try to have it both ways. >> if you come to the united states illegally, you will be returned. your journey will not succeed and you will be endangering your life and your family's lives. >> many of the individuals who we encounter claim asylum and have a right to have those asylum claims heard as our laws provide. >> so far dhs has flown 13 planes back to haiti filled with mostly single men and women. there is conflicting information whether they are going to up that to seven flights a day or scale it back to two. pregnant women and families with children are being allowed to stay and notice to report to an ice office within 60 days. statistics show 40% will disappear and live here working under the table for cash or with a stolen social security number. even if they're caught, they won't be deported without a criminal conviction. those who do show up generally qualify for cash and other social benefits. dhs is surging 600 additional agents to del rio. the rest of the border is wide open for more drugs and gotaways. right now many don't have any idea who are entering illegally elsewhere. >> they closed the border checkpoints in laredo for 12 hours because they were told send every available border patrol agent. that left those roads open for people to smuggle drugs or people. it has the ripple effect across the border in so many ways. >> the white house said i think yesterday the day before a haitians wouldn't be here long. the average length of stay for a non-criminal alien ice is the 3 days before being released. average length of time on electronic monitoring 655 days. because of the backlog in the courts the average case takes 2 1/2 years to complete generally speaking only 8% who claim credible fear ever actually leave. the ciels is is not over. haiti asked for the moratorium on repatriation flights and mexico is getting unindated with people coming in on their southern border, which is a powder keg. >> trace: mayorkas says -- the biden administration struggles to get a handle on the growing chaos at the southern border. jackie heinrich is live at the white house. good morning to you. >> good morning to you, trace. homeland security secretary count answer congress. they expected he would show up to answer other questions on the second day. that did not happen. mayorkas blaming long workdays and a laser focus on the mission to even be able to say how many haitians are illegally crossing the border. >> congressman, let me share something with you quite clearly. i work 18 hours a day, okay? when i returned from yesterday's hearing, i actually focused on mission. we will get that data both to the senator who posed it yesterday and to you, congressman, today. >> because the department is supposed to have those numbers couldn't answer the question, we asked the white house. they pointed us straight back to dhs and promised us at the white house they would get us the numbers by the afternoon and it never happened. >> i certainly understand why you are asking and people have been asking secretary mayorkas. those are numbers the department of homeland security would have the most up to date numbers. >> the white house is more focused on the image of border agents on horse back apprehending migrants with what perceived to be whips and some calling it reins. some calling it white supremacist behavior and the president was horrified by the incident and dhs is investigating. >> i'll be honest with you all. was not 8,000 or 10,000 black people. it is outrageous. >> the images we've seen at haitians waiting in tent camps to make an asylum claim is a reminder of that. haitian lives are black lives and if we truly believe that black lives matter, then we must reverse course. >> the white house squairl in the center of the criticism coming from the left and right. also this morning new reports just out that the u.s. envoy to haiti has resigned amid all of this tension. daniel foote writing in a letter that he would not be associated with the united states inhumane policy that is sending migrants back or haitians back to a gang-controlled country where the u.s. officials on the ground are in secure compounds. details are developing and get you more when we have that. >> trace: jackie, thank you. >> dana: mind blowing. my next guests are texas lawmakers who witnessed the crisis firsthand and urging the administration to take action. joining me now are texas congressman tony gonzalez and august pfluger. describe it for people. we can see with our own eyes. when you are there outside of the pictures you get the full sense of the enormity of the problem. >> i represent del rio and right now in del rio it is as if a hurricane has hit that small town. border patrol and other law enforcement agencies are doing everything they possibly can. the unity that they've posed to come together to get through this crisis is unlike any other. the latest updated numbers i have as of this morning are 4400 migrants still remaining under the bridge but over 2,000 migrants on the mexican side of the border. the border patrol agents are saving lives just last night one of the migrants delivered a child. they delivered a child underneath the bridge. these are the type of things that are happening every single day throughout not only in del rio but other sectors as well. meanwhile in el paso the el paso agents caught $2 million worth of narcotics. the problem is continuing to grow and spiral out of control and expelling migrants that don't qualify for asylum is part of that solution. >> dana: as you heard there are many democrats now demanding that the administration reverse course. you even had the envoy just resign saying it was wrong to be sending these people who don't qualify for asylum back to haiti. your thoughts. >> it is clear it is a crisis and president biden is getting attacked from both sides of the aisle is because he can't get a handle on this situation. you have a democratic mayor of del rio who has been crying out for help. tony gonzalez is doing a great job. my hometown is two hours of there and tony is getting the story out. what i saw is horrific on saturday. 15,000 migrants. meanwhile yesterday when asking mayorkas a very simple question is the border more secure under your leadership he said it is neither more or less secure. i'm sorry we have 1.5 million illegal immigrants as opposed to 500,000 last year. it is incredibly disastrous what's going on. >> dana: what happens when all the border patrol has to focus on thousands of migrants there in del rio? the border is quite long and we just do not have enough resources to cover all of it. >> there is a national security event that is just brewing. you can see another 9/11 type event on the horizon with everything that the debacle in afghanistan, coupled with a wide open border, southern border creates an environment ripe for disaster for americans. in the big bend sector right over very remote part of the southern border, very few agents and very limited resources. if this administration was serious about protecting the southern border, they would focus on technology. that's a softer -- one of the softer three elements they could to do secure the border. they have done nothing. it's as if the biden administration is waiting for another 9/11 to happen. >> dana: mr. pflueger, what do you think happens in the next few days? you have the biden administration trying to save its legislative agenda on economics and changing all of that. they have that bucket. they have afghanistan continues. all the americans are not out. special immigrant visas are not out. you have inflation concerns and you have this crisis on the border and the only time that they actually have had for example the one in charge, kamala harris, speak to it is when she mistakenly said the border patrol was whipping migrants. >> it's clear they are trying to shift the narrative away from the real disaster whether afghanistan or our southern border. our country is now less secure because of president biden. where are the democrats who just two years ago went to the border and cried out for help? i asked another question to secretary mayorkas yesterday, what is the number of known or suspected terrorists that entered this country? the outgoing border patrol chief who left on his own free will wrote a letter and said it's record numbers. the american public deserves to know that. we won't let the administration shift the narrative aif way from the real disaster. we're less secure because of afghanistan and southern border. we need the president and vice president to go there and acknowledge it is a problem and to defend american interests and american citizens. >> dana: last question mr. gonzalez. with the left now agitating. the president ran as a moderate, that's what he said, a moderate, not part of the bernie sanders wing. now you have the left asking. who do you think ends up winning his attention in this matter? >> i think the loser in all of this is the american public. here you have the house democrats finally getting some of the house democrats finally getting involved nft border crisis not because of the 33 abuse allegations by hhs for migrant children or not by some of the other chaos your seeing but racially driven. out of the 1.5 million migrants that came over. many are brown and have hispanic descent. why was there no outrage then? who do we follow? are you getting the same thing from your patients on guidance and who to follow? >> exactly. a lot of confusion. one thing i want to tell you at least the fda brought in advisory group this time. they may not do it 5 to 11-year-old group. why do i like that? he is one of the top vaccine people in the country. he said it is clear there is a benefit over the age of 60. i said why 65? he said it could have been 60. you are seeing some benefit there. there are 22 million americans who are more than six months out and half of them are over the age of 65 by the way. they will qualify if they got the pfizer bioshot. here is where the confusion comes from. what does it mean you need a booster? what does it mean? what they're measuring is risks of mild infections and does your antibody level go down? you know what? you have a memory of having had that vaccine and that ramps up when you see the virus. so that protects you against severe illness and hospitalization. so there is no reason to think the vaccine doesn't work beyond six months, it is just not quite as effective and we want to prevent spread. that's the other thing. you give a booster, decrease your risk of spread and severe illness. we don't know how long that lasts. the israel data is only a few weeks out. we don't know if the boost we give you will last and endure. the vaccine itself will endure but again it can diminish over time that's with pfizer only. the cdc group is not going to get into moderna i predict. only the pfizer and they won't get into johnson & johnson either yet. >> i want to go over the new documents showing chinese scientists 18 months before the first covid case they wanted to genetically engineer coronaviruss to make it more infectious to humans. the executive director of a group investigating the origins of covid said the following here. this is a roadmap to the high-risk research that could have led to the current pandemic. what do you think about these documents that have been released? >> i don't think it's the right thing to do for two reasons. first of all, as i think severe as the problems are with big tech today, i certainly don't want to live in a world in which the largest technology companies in the world are chinese rather than american. i also don't think it will be that effective. the real problem isn't a monopoly on product. it is a monopoly on ideas. if you take the four big companies and break them into 40 small companies but all adhere to the same ideology it will been and ideological cartel instead. we need to break up the ideological cartel and open up the marketplace of ideas. the right fixes will be in the direction of section 230 report big tech and big government using 20th century antitrust rules is the wrong way to go. >> dana: this is just -- i've been reading the story of the hypocrisy of covid restrictions on college campuses. some are insane. there is a piece in a magazine that caught my eye. college campuses have the craziest covid-19 restrictions at all. even if you're vaccinated and outside at a football game you have to wear a mask. another said you can't take your mask off at any time even to eat or drink during class and restricting socializing as well. >> look, sometimes i wonder whether these restrictions are preventing the spread of coronavirus or signaling the virtue of a campus pollz. one thing i say signaling your virtue has become more important than being virtuous. you need to think of the health of your students. i don't think it's coronavirus prevention at all costs but the health of your students in totality. i don't think all colleges have gone this crazy. i spoke at purdue earlier this week. there are good examples of university able to take a sane approach that are managing the health of their students in the right way. i this i where we cross the line is where universities actually want to use masks as a symbol of their virtue rather than thinking about the right ways to prevent the spread of the pandemic. >> dana: thank you vivek. great to see you. >> trace: meantime prince harry and meghan markle are making their way through the big apple. they are visiting the observatory at one world trade center this morning and also be attending this weekend's global citizen live concert in central park. the trip marks the couple's first public outing since the birth of their second child. that was back in june. who knows? brand-new numbers from dhs. fox news can confirm as of yesterday here in del rio sector, 1,719 haitians have been deported there this camp back to haiti. you can see the camp behind me. they are making considerable progress in clearing it out. but you look at those numbers. 1700 deported. the question becomes what happened to the other roughly 13,000? we know there are still thousands living in this camp. look at our second camera here, the latest number we have as of 30 minutes ago in this camp there are still about 3,880 migrants living in this camp. 1700 deported. 3800 still living here. that leaves 10,000 we have to figure out what happened to them. border patrol has been bringing in the buses and vans constantly here trying to clear this camp out as quickly as possible. you take a live look from our drone overhead and you can see the considerable progress that border patrol has made down here. this camp is definitely starting to thin out and knocking down makeshift structures and taking down the tents and plants that sort of thing. there are still upwards of almost 4,000 people still living here waiting to be processed. and we want to show you this video everybody has been talking about. with the horses if we can pull this up. the narrative is that border patrol was whipping these migrants even though they don't have whips. they were using their horse reins. the reverend al sharp ton is coming to del rio saying to investigate what happened here. we've been talking to the horse agents and they're frustrated and reassigned. we talked to one last night saying they have them shutting off lights and serving food not dealing with the migrants anymore and they just want to express their frustration. there is a false narrative out there in terms of what they're doing. those horse agents are highly specialized and no longer on the front lines patrolling the border. that leaves certain areas out here unsecure and yesterday dhs secretary mayorkas was pressed by congress with his job performance when it comes to border security. >> is the border more secure now under your leadership? >> congressman, it is no less secure than it was previously. president biden's approval numbers sinking to a new low. according to a new gallup pole 43% of voters approve. down 6 points since august and 14 points lower since he took office. the majority gives him negative marks. that gallup poll took place over a long period of time. i think three weeks or so. and a lot has happened. august was a terrible month. september has not been better, karl. >> not been better at all. the numbers among independents are pretty revealing. the president's job approval among independents is 37%. the 43% overall is the third lowest of the last four presidents. only donald trump who had a 37% approval at this point is lower. but it is 37% approval for biden among independents down 24 points from where he began in january. think about that. and in fact what's interesting to me is if you look at it, about 8% of that decline took place between february to june. five months. then 16 points in the last three months which suggests that this number among independents and the overall number will continue to decline until something dramatic happens that causes these numbers to stop and to begin to rebound. we certainly haven't seen any of that in september. >> trace: you are talking about numbers and i wanted to put the iowa numbers on. approval numbers in iowa. they are fairly stunning. 31% approval for president biden. 62% disapproval there and follow that up with the pollster sell zer quoting this is a bad poll for joe biden and it is playing out in everything he touches right now. that's the truth. everything they attempt comes crumbling down and yet there are no fall guys. nobody is being punished for any of this. >> nobody is being held responsible. the poll is a nonpartisan poll run by the des moines register, well respected. it was a battleground state in 2020 that joe biden lost but this portends bad for the democrats in 2022. it has competitive congressional races and governors race and senate race. democrats will be laboring against a heavy weight in the low numbers for president biden. nothing has happened in recent weeks. the afghan withdrawal, the situation with covid, the international scene at the united nations, the battle over the budget and the battle over the spending bill and the battle over the tax bill and the battle over the debt ceiling. none of these things have worked to the president's advantage and he desperately needs to turn things around. it doesn't look like that is going to happen soon. >> dana: i hate up your column today. it was called kevin brady's charge on tax hike hill. saying mr. brady gave his gop colleagues plenty of ammunition to attack the democratic tax increase and set their sights on the vulnerable points to convince swing fighters it will be a long fight. the blow out is for the next spending blow out. what you did through brady's research is to say these are the types of taxes that will go up. the type of people who will have to pay them and the type of spending that they want to do. >> brady -- congressman brady gave his colleagues three documents, seven pages in total. i got my hand on them really well done. themes in one of them in one. specifics in another and laid out the advantages of making these cases in the third. i thought it was a really well done and i hope his fellow colleagues in the house republican conference pay attention to it. sustained national effort to make these points even in safe republican districts it's critical the members go out and make these points so the american people get educated. the national media is not going to give the detail and not going to unveil some of the secrets behind this. for example, the joint committee on taxation says 75% of the cost of the corporate tax increase will be paid by working people in the form of lower wages and benefits. that's backed up by a left wing think-tank the tax policy center that says by the end of the decade as much as 95% of the cost of this will be born by middle and lower income taxpayers in the form of lower wages and lower benefits. so brady made an excellent case how it is bad for america's international competitiveness, bad for small business and ordinary americans. our utility bills and gas bills will be hirer. huge new taxes designed to make us move away from hydrocarbons but we'll import oil and gas from countries who laundrie entering a fifth day at the carlton reserve in florida. he disappeared more than a week ago. neighbors tell fox news it appears laundrie and his parents went camping the very same day his girlfriend gabby petito was reported missing. let's get to phil keating live in venice, florida with more. good morning. >> good morning, trace. back at the laundrie parents' house this morning. the ford mustang that brian laundrie parked at the trail head for his hike nine days ago, that car being returned by north port police. day in and day out of searching this backcountry of florida, very harsh and hot conditions. still no sign of brian laundrie, not his backpack, no footprints and nothing of physical evidence indicate that laundrie was ever actually here. every day the searching is continuing. today is day five. these are brand-new helicopter aerials of the search operation. it involves 60 searchers including a dive team and cadaver dogs looking through thousands of acres behind me down here in the carlton reserve. laundrie is a person of interest in the death of his fiance 22-year-old gabby petito. searchers are using atvs and high water vehicles known in florida as swamp buggies as the terrain is rough and much under water and plenty of alligators of snakes. according to locals those are abundant. his parents say their son went for a hike last tuesday. here is the search commander yesterday. >> i tell you these guys, law enforcement partners are motivated and hungry to find brian laundrie and ambitious to partner with us. >> theoretically could somebody be camping and surviving for a week in these very rough conditions? well, local venice outdoorsman said one could with proper preparation and good skills. >> there is no real potable water. you would need to purify your water. there is water everywhere but not a drop to drink. food wouldn't be too difficult. you could eat plenty of fish. >> petito and laundrie had been on a cross-country road trip visiting the country's gorgeous national parks. her body was found sunday in wyoming and is ruled a homicide. monday the f.b.i. and north port police executed a search warrant at the laundrie family house taking out boxes of potential evidence. computers, hard drives and cell phones. remember september 1st brian laundrie returned to that house without gabby petito whom he had left with for their multi-week if not multi-month cross-country road trip. what he told his parents remains to be learned, that's for sure. several people, fellow trekers who saw them over their journey have now come forward saying they saw very heated arguments between the couple in public and that their relationship sure seemed strained. >> trace: i'm curious quickly. monday they called off the search at the carlton reserve when the f.b.i. went into the house and suddenly back on tuesday they are out there again. has anybody gotten an answer of why they cut it off midday monday and were back out there again on tuesday and haven't found any kind of evidence that he was there? >> this is pretty much the main lead they know according to his parents of his last known whereabouts. they searched here in the reserve saturday and sunday. they said on monday we aren't going to find anything in there but monday afternoon is when they went to the parents' house and served a search warrant and talked to in the michael sussman case the attorneys for the government mentioned potential classified information meaning sussman's team would need to get special clearance before reviewing that potentially sensitive information. michael sussman was indicted a week ago today as part of special counsel john durham's look into the trump/russia investigation. they claim that sussman went to the f.b.i. said i have some information linking donald trump and russia. durham says that mr. sussman was not clear in what capacity he was delivering that information. was it as a clinton lawyer or just a good citizen? according to john durham sussman claimed he was doing it as a good citizen when he delivered the information to the f.b.i. information that did not pan out. the meeting took place in september 2016 meaning we're talking five years ago. the statute for limitations for providing a false statement to the f.b.i. sussman's charge is five years. that is why durham charged him now before the five year mark which hit a few days ago september 19th. 2 1/2 years ago durham began his case and he has charged two people in the probe, sussman and kevin clinesmith, former f.b.i. attorney who pleaded guilty to falsifying a document used to apply for the application to surveil trump campaign aide carter page. while clinesmith pleaded guilty no case that sussman will do the same and plans to >> trace: a massive search effort is underway for gabby petito's missing boyfriend brian laundrie. operation is centered on a vast florida nature reserve mostly under water and filled with snakes and alligators. let's bring in criminal defense attorney phillip holloway former assistant d.a. and police officer and phillip. they called off the search at the carlton reserve on monday and started it again on tuesday. you appear to be skeptical that brian laundrie is -- that they will find him alive. >> well, you know, most people, trace, good morning. most people are incapable of functioning in the world for very long without leaving some evidence of their very existence. the very fact that they are searching in a swamp in florida as you mentioned filled with alligators and snakes and other creatures is not a place that's hospitable to human life. the fact they had cadaver dogs in their yesterday and divers and sonar. they aren't looking in places where people will be camping. if you look at what they're doing and how they are searching, trace, it tells me that they are not looking to recover brian laundrie alive. we already know, of course, that gabby is unfortunately decease eds. -- deceased. if there will be prosecutions in the case it will depend on the answers that law enforcement gets from interviewing third parties to see if there is anybody else who may have helped perpetrate any crimes or conceal any crimes or otherwise impede the investigation. >> dana: evidence seems to be building that he was very possibly abusive to her from the 911 call when the people saw him at the restaurant. if you go back to that moment when they were separated on the side of the road there in utah, what might have -- what do you think should have happened at that point that would have prevented this result? >> sure, dana. i have gone back and looked at all this. the entirety of the situation. i respect their judgment. police do have discretion to make an arrest. i think they made an arrest. an eyewitness saw brian using physical violence against gabby and other information that she was also involved in some type of mutual combat. at a bare minimum the investigation on the side of the road developed, i believe, probable cause that would have been sufficient to charge one or both of them with some type of domestic violence. under the totality of the circumstances i this i the law enforcement officers would have been on sound legal grounds to have made that arrest. of course, i'm not blaming the utah police or anything like that but of course if there had been an arrest made and under the law out there in not only utah there is a heavy presumption in favor of making an arrest in a domestic violence case when it is a close call. the reason for that is so that parties are definitely separated from each other when tensions are high and we know if nothing else these two had at least at times a tension filled and tumultous relationship. >> trace: you say if there was an arrest made we might not be talking about this today. you believe it might have saved gabby's life? >> it could have changed the trajectory of things. if you look back at what happened they suggested that gabby sleep in the van and brian laundrie go into a hotel and then there was no other mechanisms in place to guarantee the two were physically separated when tensions were high and the reason why law enforcement in most instances when they investigate domestic violence case, if they have probable cause chances are they'll take someone to jail because it guarantees an immediate while some were trying to suppress this information when we should have had this robust debate whether or not it was actually happening? >> yeah, look, i think that's right. we did lose time but again to expect china to open up their doors is foolish. we did lose time. the only real conspiracy we've seen is to silence scientific debate from the nature of medicine articles that is the true conspiracy. and we have lost time. look, there is still time for robust investigation that must be led by democrats in the congress. some brave republican efforts, congressman scalise and rogers and others, mr. gallagher. but the democrats control the congress. it shouldn't be a partisan issue. again the chairman of the health called for an investigation. there is still time and we need to have bipartisan consensus to come together and try to find out what happened so we can avoid it happening again. >> trace: lastly i just have to ask this. a researcher said they read the documents and saying the scientists were trying to make -- it could have been quoting apocalyptic. it is dangerous stuff they were dealing with back in 2018. >> exactly right. we had a very robust debate in 2012 around the avian flu. we should go back to the national academies and have a robust debate on why we are doing this research. what's not debatable is doing it with our adversaries and china. that is
