new information this afternoon as two candles continue to escalate around the new york governor andrew cuomo. he's seen as the hero of the pandemic. he reportedly had staff who were actively changing numbers on how many new york state nursing home residents were dying. the governor's most senior aide rewrote the report to take it out. it, being the all right 9,000 nursing home residents that were dead. the report was released july 6. 4 days later, cuomo said he was writing a book about his leadership in the darkest days of the virus. we'll dig in to the timing of that as well as the accuser that calling him a textbook harasser and groomer. >> i was terrified. i was shaken. i thought any moment something could happen. >> martha: more on that story to come with leo terrell. we begin with ron kim, assemblyman. he's chair of the state's aging committee and he has been blowing the whistle on this nursing home scandal since day 1. he lost his uncle in one of these facilities. thanks for being here. >> thanks for having me back. >> martha: i remember you saying to me when lativia james was digging into the numbers, that there was something wrong there. you shed a tear because you were so relieved. you were yelling from the mountain tops about this story. did you ever think you'll see what you see now, investigations by "the new york times" and finding that his aides were colluding and covering up the numbers? >> well, martha, a few of us knew that was the case. even when the report came out, we were calling it out this is not an accurate report. a self-auditing. it was not an accurate report. yes, i do feel we are finally telling the truth and getting to the truth. i hope that we can continue to investigate. this is completely unacceptable and we need to move forward to stay in the right direction as soon as possible. >> martha: so i know there's a vote under consideration right now to remove the emergency powers regarding covid from the governor's abilities. there's also now the concern that there might be criminal investigations in to this or there could be potential criminal charges. i want to remind everyone, awhile back, we had john daukus, a former doj analyzing this case. here's what he said. >> there's federal criminal offenses for obstruction of justice, for providing false data to the government and for concealing data from the government and conspiring to block a federal investigation. and all of those statutes are things that i presume the u.s. attorney's office and the department of justice are looking into at this point. >> martha: so do you have any indication of where this goes next in terms of potential criminal charges or from the state government perspective, the stripping of those powers? >> yeah, so the governor and the governor's top advisers pushed the state health officials the suppress life and death information about nursing home fatalities. it was a coordinated criminal conspiracy to suppress data. that we the lawmakers desperately needed to legislate and offer better policies and solutions to help save lives. the changes that cuomo's aides made to the report proves that they had the full-accounting of the nursing home deaths, including the covid positive on patients that dieds in hospitals. as early as last summer of 2020. so yes, martha, we need a thorough investigation, we need to pursue charges if this is all true, as if they committed an obstruction of justice and suppression of data that we could have used to save people's lives. >> martha: where is your sense from your perspective, where you sit in this government in the new york government of whether or not he's under real pressure? he said he won't resign over the other issue he's grappling with, the sexual harassment allegations. what is your sense of how strong a position he has right now in government? >> martha, andrew cuomo doesn't have the self-dignity to resign. he must be impeached. the emergency powers that we were voting on today, it's a good step in the right direction. i wish we could have done more. but now we must be bold because it's not about the governor. it's not about anyone else. it's protecting the integrity of our legislative bodies so we can be a co equal government in protecting the people of new york. i believe not just me, more people are calling for his resignation. if he doesn't resign, it will turn into an impeachment process. >> martha: assemblyman kim, thanks very much. we'll speak with you as this develops. good to have you here. >> thank you. >> martha: now to fox news senior meteorologist janice teen. she lost her mother-in-law and father-in-law to covid. last month would have been their 60th wedding anniversary. janice has a new book out called "make your own sunshine" which she's tried to do during covering this story and her own family experience as she continues to cover it. janice, good to have you here. >> thank you, my friend. >> martha: so i want to put this up on the screen. this is from cuomo's spokesperson, calling you out. you were an early whistle-blower on this. she said she's not a credible source on anything, except maybe the everybody with. what would you say that now having come as far as you have and having pushed this story to the point that you have? is there a limit to how many unaccompanied minors that the biden administration will allow in? >> so is the plan to take in and safely and humanely find a home for an unlimited number of unaccompanied children? >> this issue requires us taking a step back as human beings and mothers, as which i am one. we want them treated safely, they're not trafficked or sent back on an unsafe journey. >> she didn't really answer the question. the department of homeland security is predicting 117,000 minors will crosby may according to internal documents reviewed by axios. the biden administration is now trying to create more bed space in part by possibly opening up military facilities as you alluded to and look at relieving them more quickly to relatives in the united states. "the new york times" says they're transforming immigration facilities to hubs. there's companies like greyhound bus asking the federal government to do more to make sure that anyone that enters the u.s. on the southern border is getting a covid test. here's texas senator john cornyn. >> they have absolutely no plan. they underestimated this. they had no plan to deal with it. this is in the face of a pandemic. there's no regimen for testing migrants as they're released into the united states. this is a humanitarian crisis and we've seen it before. >> the white house says this is a challenge but not a crisis. to give you an idea how serious they are taking it, martha, there's a team of the president's top advisers either already close to the border or preparing to go to the border sometime soon to get an assessment of what the situation is like on the ground first hand. martha? >> martha: and i would imagine those people are going to try to answer the two absolutely right point-on questions that you asked. are you going to change your gears here and is there a cap, is there a limit. thanks very much, kristin. good to see you today. let's bring in mark morgan, border protection acting commissioner. good to have you with us today. i'd like to start by, you know -- i heard senator cornyn said there was no plan on the biden administration's part. if you go back to the campaign, it appears that there was a plan and it was articulated directly by then candidate biden. let's watch. >> people should have to get in line. but if people are coming because they're seeking asylum, they should make their case. >> these people deserve to be heard. that's who we are. a nation that says if you want to flee and fleeing oppression, you should come. >> martha: you should come said joe biden. you know, you wonder why we're seeing what we're seeing. he said we should see a surge to the border. that's what we're seeing, mark. exactly what he asked for during the campaign. >> martha, that is right. that was their plan. their plan was to remove every policy or authority that had the trump name attached to it, martha, that was effective. they've tone that. the united states is an active participant in encouraing and facilitating the illegal -- this is the part -- illegal entry into the united states. that's what we're talking about, martha. that's what they created besides the hypocrisy is the way they're using them. your correspondent said it right. they're creating reception centers for illegal entry right now along our borders. >> martha: yeah, we're watching as the building of these facilities that happened -- some of these facilities under the trump administration. you heard jen psaki saying we're handling this humanely. i'm a mom. we don't want them to make the dangerous trip back. but what about the dangerous trip on the way? >> yeah, when it comes to the state of numbness that i was describing, so many of us we didn't feel happy. we didn't get excited for anything because the lives that we've been like in place of. it's been so redundant. so we're so numb and nothing is exciting and happy. >> martha: trey, you say you've developed some study skills that are not what you want them to be. feeling offensive, wanting to sleep longer or procrastinate. >> yeah, school is like doing everything at midnight. everybody is procrastinating. for me as a senior, i'm going to college next year. that is my life for four years. this year i'm supposed to be creating the best habits for myself possible. i've been creating the worst habits for myself possible. i know i'm not the only one either. >> no, i'm sure you're not allow at all. that's the point of this. i appreciate you talking. i want other kids to know they're not alone in the way they're feeling. nicholas, you haven't been school an entire year. home since this time last year. you said your mom has noticed that she thinks that you seem down. tell me about that. >> right. so when i first started coming home and everything was kind of fresh, we were all told hey, you're going to have an extra week off of school. going to move up spring break, going to have a full week off and get back into it, back to normal. everything is going as we planned. but as the dates kept getting pushed back when we would go back and summer came, my mom just started asking me, hey, you seem really down. are you okay? she just was constantly checking in on me. i felt normal. that's when it hit me that my new normal was what used to be when i was sad and when i was really down. that was normal for me now. >> martha: what do you do about that? >> i think from a civil side, she has a classic in my opinion a perfect civil rights case on sexual harassment. let me be very clear. governor cuomo is not an assistant at a restaurant. he governored one of the most powerful states in the country. that woman on that interview was credible. she's already made a statement and the standard is very simple. a reasonable person would be intimidated be i the tremendous amount of influence that governor cuomo has. i'm telling you from a civil standpoint, she has a powerful civil rights lawsuit for sexual harassment. no question about it. >> martha: it's fairly recent and she documented it with texts after the event explaining what he said. so she has some documentation here, which will be helpful to her case no doubt as well. jessica, i'm interested in what you think about the fact that she's being represented by deborah katz. she represented christine blaze ford. she also has a p.r. firm that is putting out statements on her behalf that seems to be the way these things work now. that tells us that there is an effort out there to go after this governor, andrew cuomo. you think politically he survives this? >> well, he has two controversies right now. there's explosive reporting in the nursing home scandal as recently as last night in "the new york times" and the wall street journal. he has that fire going on and the me too fire on the other side of things. highing someone like deborah katz is a message, that they want this big, a big p.r. story and putting as many people in positions of power on the spot to say how they feel about this. >> martha: who is "they" jessica? >> the accuser and deborah katz's firm. they want this public as possible. they have every right to. i agree with leo, sounds like this young woman's story is credible and having listened to governor cuomo's press conference as he got to the crying part of it, sounded like he wasn't denying a lot of the situations that are textbook sexual harassment. he's an incredibly powerful person. you could argue the most powerful state in the country. maybe california ahead of that. would make anyone feel intimidated let alone with that age gap and in terms of her role as well. >> martha: leo, you're shaking your head here. what are you thinking? >> i'm hurt and i'm bothered by jessica gave a nice speech as a press secretary. let's be clear about this. let's forget the politics. this is wrong. this governor did something wrong. the democrats have tape on their mouth. the white house, joe biden, the first day, martha, said i'm going to fire anyone that intimidates or harasses. kamala harris has said nothing about this. she was front and center on kavanaugh. let's forget politics. this is wrong. the white house is wrong for not speaking out. kamala harris is wrong and every woman regardless of party and affiliation this is wrong. let's say it loud and clear, this is wrong, period. >> i'm with you, leo. if these allegations turn out to be true, they're 100% wrong. but there's no tape on the white house and nancy pelosi and chuck schumer. they've been always supportive of the investigation into the governor's actions. if we're so into saying things a wrong, you say donald trump -- don't oh me. i appreciate the compliment? >> martha: that's an interesting chart. thanks, blake. let's bring in andy puzder, author. charlie kirk is here as well from turner point usa and austan goolsbee, former chief economist for president obama. great to have you here, gentlemen. austan, i want to start with you. you can see the places that are more open have better functioning economies and you think act the fact that president biden we have to pass this $1.9 trillion because that will give us the momentum we need to do the rest of our agenda. so the question is, is this money necessary or is this when necessary for the rest of the biden white house agenda? >> i'm just a policy guy. i don't know about the political momentum. i know there's more than 10 million people that lost their jobs in this crisis that are still out of work. we have not gotten back to the employment levels even close to where we were before the crisis began. >> martha: don't you think if businesses are allowed to reopen that a lot of them can go back to work? >> i think some will be able to go back to work. even with the jobs numbers today, we're going to be years -- it's not two years to full employment. we have more than 10 million people that we have to fill the hole. it could be three, four, five years even at the rate of the job creation that we saw today before we would be back to where we were before we started. we need more money. that's why 70% of the country including a majority of republicans support the bill. >> martha: yeah, we've been through a great depression, the 2008 financial fall. andy puzder, this bill, people have become numb to it. we're talking about $4 trillion that we're talking on here. the question is do we still need it or are we on the way out of this thing and is it good or bad for the economy? >> we clearly don't need it. we're clearly on our way out of this. it has huge risks of inflations. phil graham, a conservative economist agree. you probably should listen. they agree this is going to create so much demand that it's going to overheat the economy and have problems. states like california and new york and illinois, they need to open up. that's what is going to bring the economy back to full speed. as you noted in the states that have opened, i'm in tennessee but take tennessee, florida, texas, mississippi, these states actually have very good unemployment rates. comparable to what they had prerecession. you can't -- the economy can't come back if we don't let it open up. you have to get these governors to let it open up. i'm going -- i'm not a politician either. i can tell you president biden was very open when the pandemic hit that he viewed it as an opportunity to transform america. i don't think they want to let go of this pandemic until they have done everything they can to transform america in the wrong direction unfortunately. >> martha: charlie, we saw a poll today that i thought was very encouraging, gallup poll. 60% of americans perceive that the coronavirus situation in the united states is getting better. i think that is the overall feeling in the country. what should the message be about how to get back open our feet?
