cnn starts right now. >> good evening, i am victor blackwell. discussing the most interesting stories. donald trump's former impeachment attorney, a lawyer for the mafia bosses, first, if democrats are not worried about next year's election, new numbers suggest they should be. in two poles, the general l election is the dead heat if the matchup is biden versus trump. despite trump facing the fourth indictment. 91 charges and all. several trials next year while people will be voting. something else noteworthy, nearly 60% of republicans today think that biden was not elected legitimately. also today, the fulton county d.a. said she wants the georgia trial to start the day before super tuesday. trump is intensifying his rhetoric against prosecutors and judges and all of his cases . one of his supporters today was charged with threatening to kill the judge overseeing the federal fraud case, using racial slurs she threatened to kill the judge if trump does not win. let's bring in independent counsel and former prosecutor, robert ray. he also defended former president trump during the first impeachment trial. robert, good to see you. thank you for being on. i hear this is your first opportunity to respond publicly to this indictment. you have had time for it to resonate. what do you think and what do you see? >> my first reactions i was inclined to agree with chris christie that this fourth one was heavy-handed and in some sense unnecessary as duplicate if of what jack smith already charged. that is not to say, the district attorney has every right to proceed in the exercise of discretion as she deems appropriate. on the other hand, i will say, my experience has been, generally speaking when the federal government proceeds through prosecutors and prosecution, the general rule is, it is not always followed, there e are exceptions that sta and local authorities defer to the federal prosecution. that has not happened in this case. in the space of a little more than four months, we now have four indictments against the former president. it strikes me as heavy-handed. i have said previously with regard to the other cases, it seems like the exercise has gone out the window. i think that i am worried about the course warpath that we are on. when i say that, you did appropriately mentioned the places where this intersects with the political process. inevitably you will have clashes between judges and juries. also the political process. let me be clear, absolutel federal judges and any judge needs tootected. they should feel free from this nonsense. potentially more serious. it is intolerable. that is not acceptable. that has not met with the full source of the criminal law. >> that answer takes me down several routes. i'm going to start where you ended in think there should be no threats of violence and no threats to kill judges and prosecutors and threats against members of congress. what role does your former client play. the judge warned him about making statements that could threaten witnesses and impede the process in any way. do you expect there will be action against the former president or should there be? >> there are some controls. there are limits to the first amendment. in the political process, where the first amendment interests are heightened, it is one thing to say that mike pence as a witness in a criminal case and another thing to say that donald trump is prevented from criticizing sharply a fellow presidential candidate. by the same token, i am well familiar with the dangers that the judge's faith and am familiar with judges that have been not just subject to threats . it is serious business. everybody needs to watch their language. senator schumer, the majority leader had strong words to say about justice cavanaugh and just to score such. it is danger that justice cavanaugh in particular was faced with. we can have strong debate. we do have to be mindful that the actions of consequence. there is behavior that is not acceptable. to answer your question, i think there are limits. they will be policed. i will also say in the political process, there will be a coalition with regard to those varying interest as we get to setting trial date is. the bulk of the prosecutors are anxious to get the trial started. been completed before the election cycle concludes. >> what you mean is in the country's best interest? skepticism or concerns about it happening before the election. these crimes were committed in their districts. do they not have a responsibility to bring these charges and pursue swift justice? >> it is always a question of prosecutorial discretion. i don't think any prosecution is ever compelled. you do have to have an eye when you are dealing with the former president and a current candidate. about what damage prosecutions may do to the political process. it is also the interests of the country in regard to the fair conduct of an election. i refer to to rely on lincoln's words bit patient confidence in the ultimate justice. we have lost patience. with single and have prosecutors cure all ills. we have a number of special prosecutors running around. district attorneys that feel free to charge a former resident. we are going to get to the point that we are so engulfed in the process, it is like at the prosecutors in the room and sort out between joe biden and donald trump. that is not a political system i want to live in. it is too much power to prosecutors. it is a dangerous road to travel. among the 19 defendants charged in georgia is rudy giuliani. he faces 13 counts, including racketeering charges. is a major force in using the laws to take down organized crime. including figures like tony solano. the former head of the crime family. thanks for being with me. >> you get a kick out of seeing the damage if you well to families by bringing broad sweeping multi-account indictments against clients of mine. it is something always -- about his ability to bring rico cases. he built his career on it. now he is on the receiving end. i'm happy to see it land in his lap like it landed in the lapse of the lot of people he prosecuted throughout the 80s. >> you mentioned the former mayor talking about using the statutes. let's listen to what he said? >> the upper-level people are not used to being convicted. especially not racketeering. it is a new way of doing business in a more effective way to crush them. >> it would make an excellent case. also against -- . >> go ahead. >> just watching him spout off makes me even happier that he is on the receiving end. good luck to him. i hope all the things he claims are great about bringing racketeering cases. >> based on what you have seen and read, what is the defense for? >> i really don't know. if i could put my defense have on, despite my personal feelings and having tried to a jury and multi-dependent cases. there were 10 racketeering trials to a verdict. several others ended in the plea. i know what it is like to be there and fight a strong indictment like the one the d.a. just brought. what he is going to try and do is say there is no real enterprise which is one of the two required elements you have to have. been a connected series or pattern of racketeering. what you can see, 96 pages in 41 counts, there are 161 acts listed as potential -- any two of which should be enterprise be found to exist by jury is enough to convict everybody. i think what he is going to try to do is say there is no evidence to support the enterprise that you need. the problem, he forgets. it is something that is useful against organized crime figures like the sweeping commission case. it could be any group. went as if they have the common purpose and are functioning as a unit. >> let me ask you, you are unique to get the answer from. when he backup and look at the scope of rudy giuliani's career , from u.s. attorney to mayor of new york and the presidential candidate. what runs through your mind when you look at that? [sigh] now, powerwash gives me the power of an overnight soak in minutes. with 3 cleaning boosters... not found in traditional dish soaps that help break down, loosen and lift away food and grease... so much faster! the georgia indictment listed at least 27 lies he told about the election. by comparison, the indictment accusing him of trying to overturn the election list 21. let's bring in sena reporter and fact checker extraordinaire. >> one was the lie that he won the 2020 election. you lost. the lie that he won georgia and declared at least once that he won by 400,000 votes. he lost by 11,779 votes. number 3 with the lie that there was massive voter fraud. there wasn't there or anywhere else. number 4 was his eye that the number of false and/or irregular roads with much bigger than the number needed to give him the victory. you made that claim in september 2021. number five is the lie that he won the other swing states in 2020. he lost not only georgia but michigan, nevada, pennsylvania, arizona and wisconsin. number seven was to get officials to lie. he wanted to just say it was corrupt and and leave the rest to me. number seven and eight are about vice president pants, that he had the power to reject electoral votes. pence told him it was illegal, unconstitutional. number 8, he had the campaign issue a false statement declaring that pence totally agreed with him, even though he told him that day that he disagreed. number nine with the lie that tony electors in swing states were real electors and in the indictment gets into a bunch of specific lies he told about georgia. number 10 is alive anywhere from 250 to 300,000 ballots were dropped or dumped. these were normal votes counted as normal. number 11 was a related lie that votes were dumped into fulton county and an adjacent county. number 12 that he lied that an election worker was caught on video stuffing the ballot box. she did nothing wrong. number 13 with the lie that the worker is a professional boat scammer. she was a fully exonerated worker. number 14 was his lie that georgia had 5000 ballots cast in the name of deceased people. the republican secretary of state told him that they actually found two such ballots and later updated that. number 15 was the lie that about 4500 people voted in georgia even though they were not registered. there were zero unregistered voters. about had already been cast in the name. it was imaginary completely made up. number 17 with the lie that georgia had 66,247 underage voters. informed congress that the number was zero. many of the boxes were actually apartments. them the lie that fell into illegally voted. the maximum even potential number of such filters was just 74. reference berger was unwilling or unable to address the various claims. in the indictment he gets into trumps lies to georgia officials. 139% of detroit residents voted. again just made up. not even close to true. number 23 was the lie that thousands of dead people voted in michigan. again made up. 24, 25 and 26 or otherwise about the election in pennsylvania, arizona and michigan. they knew the vote totals were based on allegro irregularities and fraud. >> it some gatorade and stick around. trump is expected to walk into the fulton county jail for the arraignment and just days. no surrender date has been agreed upon. the d.a. set a deadline for the chump and the codefendants to surrender by next friday. a key difference here is trump could get a mug shot. on fox, opinions on whether or not that is a good thing, those are mixed. here is laura ingram. >> these people are sick. how is a mug shot in any way necessary or in any way good for america. are they worried he's going to disappear into the general population. and that he would try to leave the country? you just run with them. >> i would definitely run away from the danger. >> we don't have $1.6 million. most people trading in the stock market or long-term investors. what it could be expressing is a viewpoint of what is going to happen to the economy. that is inflation will be harder to fight. harder than the stock market has been thinking. we will have to keep rates higher for longer. that will put stress on the economy and slow down the economy. that will impact corporate profit which will in turn bring down the stock market. that is what you are seeing expressed in this. does that mean the economy is going to collapse? no. the stock market and the economy are not always the same. just because you have a slowdown in the economy from the hyperinflated place, coming out of the pandemic, just because be slowed down, doesn't necessarily mean we are in recession. it does mean that stocks will fall. >> he is using more than 90% of the portfolio to bet on this downturn. the question always is when. is there any idea to know the timing of this, when we will see that turnaround. >> not me. what we do know, over the past couple of days, the stock market started to get scared of itself. it started to selloff. we are starting to see signs that inflation is the cure. the retail number for july came in hotter than we expected. gas prices are going up. the ukraine war is still hot which could impact food prices as well. the fed still has to keep its eye on squashing inflation and keeping rates higher in slowing things down. that is what we have seen. the stock market reacted by just heading down. if you want to get technical, that is a word you might hear. >> the fun, returned more than 50% of the last three years. outpacing competition. s&p 500 as well. do you think other investors will follow? >> which investors. you have to be a very sophisticated person to follow what he is doing. most people that trade regularly, especially if you happen to be one of those people that jumped into the game when you got your robin hood account during the pandemic, you are not going to be able to follow what he is doing. you can't follow what the grates are doing. this is a professional sport. at a very sophisticated game. i would say consumers at home and retail investors, don't worry about it. >> it will be choppy. there is a lot of uncertainty. we don't know when they will stop hiking the rates. we don't know when a lot of the story of the economy of the next phase is going to start being written and we will close the chapter. some people thought it would end at the end of this year, now we are pushing that to next year. we fought and placed in the 70s and 80s and it didn't go in a straight line down. it doesn't have to this time either. that level uncertainty always shakes the stock it up. unless you are pro-, i wouldn't try to time it. >> thank you so much. i appreciate the new vocabulary. >> have me back and i will teach you more. finger porting between the nfl player depicted in the blindside in the family that took him in. just how much of the oscar- winning movie is based on reality? >> you are very correct. clearly, there was love between them. he loved the family. they did take him in and provide shelter and they fed him and clothed him. the sad part, now that they are arguing with one another and trying to figure out what is wrong, the relationship is beyond the here. i do agree with the assessment. he was not taught football at a kitchen table with condiments. he was very intelligent. we are arguing semantics. to use the word adoption and it is clear he was not adopted. it was a conservatorship. now we are sitting here at 37, they still have a legal conservatorship. something is wrong. i believe we don't know a lot. there is a lot that is missing. unfortunately, a relationship that i believe started in the purest form, with them really wanting to help this kid has blossomed into something that we see often. when people have money and fame , often times, families get divided. he has said he is considered family. >> it really is sad. for the conservatorship to be in his 30s, he signed contracts with the nfl over those years. why does he still need this? let me play something here from his son. he said the lawsuit was a matter of time. >> it was a matter of time. i was curious today to look at our family text and see what things have been said. there were things that if i give you this much that i won't go public. >> what do you make of the timing? >> most people are thinking izzy hard up for cash? and looked at his total earnings, upwards of $30 million, not including -- the tuoys were extremely rich in their own right. where did they benefit?
