pandemic low and a judge right now weighing punishment for ahmaud arbery's punishmans. all three could get life in prison without parole. we begin with a new look at the economy and what it tells us about the strength of the pandemic recovery this. new look is also the first jobs report of the mid-term election year and as the such the headline number is a big disappointment for the biden white house. the economy added only 199,000 jobs last month. that's well short of expectations, but there are some good numbers here for you and for the president. the unemployment rate fell to 3.99%. that's a pandemic low, hand look at this. average wages up in a big way, up 4.7% from last year. the president last hour calling the job news historic. >> i think it's an historic day for our economic recovery, and we have added 6.4 million new jobs since january of last year in one year. that's one of the most -- that's the most jobs in any calendar year by any president in history, how? how? how did that happen? well, the american rescue plan got the economy off its back and moving again. >> these december job numbers a snapshot of the economy just before the omicron surge which we snow adding more covid disrugs. let's get some perspective. mark zandi is an analyst with moody analytics. when you jobs numbers low and unemployment numbers good, is it the question why is the news so cloud? >> everything is being scrambled. the government agency that puts the numbers together is having all kinds of problems. you can see it in the revisions. we get a number every month and then subs kept data come out. we get revisions to the number and in the past year all those revisions have been higher so the -- the initial number we get looks a little soft and then it gets big and then bigger again and then bigger february and when it's all said and done we get a lot of jobs. i think that's what's going to happen with the soft gain that we got in december 1699. i think will ultimately end up being higher so i would focus on the unemployment rate, the decline to 3.9%. that's pretty low and head lower and pretty consistent with an economy that's -- that's strong and cutting through all the doing. >> is this fair to say -- if there's a problem in the economy right now it is not that there aren't jobs out there. it's that you can't find workers to fill them and part of that is worries about omicron? >> yeah. i think that's fair. we're filling a lot of jobs. hiring is at a record clip as well so, you know, businesses are hiring very, very aggressively. it's just, that you know, there's still a lot of open job positions to fill that got creed, you know, back when the pandemic, you know, undermined the economy more significantly, so a lot of cross-currents here but cutting through them all the economy feels pretty good. job creation is quite strong. now, having said all of that, as you point out, this is all before omicron. this data that we're observing today has no connection to omicron. omicron is creating problems for lots of different businesses, and when we get the employment data for the month of january a month from now, i think we are going to see a soft number, and that number will be soft for a good reason. that's because people can't work because they are sick. >> if you look across, look at leisure and hospitality up 53,000 and professional services 43 and manufacturing 26% and construction 22%. add in your take on the wages. if you're the president of the united states and you're trying to focus on the good numbers for workers out there, if you're a worker right now, you're in the driver's seat, right? >> yeah. i mean, leisure and hospitality and retail were the soft sectors in december and for good reason because they are on front lines of the pandemic. that's where the damage is most significant when waves of the pandemic go through, but you make a good point. another reason to feel pretty good about the numbers is wage growth is very strong, and it's pretty much strong across the board, particularly for low-wage workers, you know, workers that work in leisure and hospitality and in retail and other parts of the educational services. that's where we've seen the biggest wage gains and, of course, that's key because inflation also, john, has accelerated and so those workers need those big pay increases to compensate them for the fact that they are paying a lot more for everything that they are buying from gasoline to groceries. >> as always, grateful for your help. >> sure thing. >> let's bring in our reporters to share their insights. arlette saenz is with us, sung min kim and you focus on the good numbers, 6.4 million but this is the first jobs report of the mid-term election year, the 199,000 new jobs added was below what economists expected so the president was asked the question. well, republicans are going to say this is weak. here's the response. >> now i hear republicans say today that my talking about this strong record shows that i don't understand, i don't understand. a lot of people are still suffering they say, well they are, or that i'm not focused on inflation. malarkey. they want to talk down the recovery because they photovoted against the legislation that made it happen. they voted against the tax cuts for middle class families. they voted against the funds we needed to reopen our schools. >> welcome to the mid-term election year, right. >> oh, i -- sorry. you broke up for a second. >> i think what you're seeing and what president biden is doing this morning is taking a much more aggressive tone against republicans on his economic record than you've seen in the past and i think that obviously he speaks on the job numbers and tries to highlight the good and how people feel feel about the economy is still very much negative but at the same time he's trying to really create that contrasting record at the beginning of the year tonighting to the $1.9 trillion rescue plan pointing out that no republicans voted in front of it, using quite bidenism when he said earlier this morning when he said accusations that he's not focusing on inflation is quote malarkey, so i think this is kind of a stepped-up rhetoric and that you're going to see from the president later on or coming in this year particularly while he can go out and highlight the good numbers of the economy -- the good parts of the economy and the numbers that are coming out, you know, the struggle for democrats and the biden straight is people do not feel, you know -- voters don't feel the economy and the health of the economy on a macro scale. they really do feel is in their day-to-day personal lives and the more the case that the president can make that things are improving on an individual level can only help democrats in the mid-term this year. >> arlette, take us inside. this is what the president said running for president. he's blue collar joe, this is his wheelhouse and workers who are worried about some things. you see headlines from opinion writers, paul krugman says don't tell anyone, 2021 was a lot to celebrate and dana milbank said this is the worst economy we never had and what's the major problems, the cost of everyday items, housing costs, gas prize, that's inflation and your covid disruption. how do they try to get people in this mid-term election year to focus on the good numbers and then trust the president to the help them through the bad? >> reporter: john, we're on a lunch break right now, so once we return to this hearing we'll hear from the other attorneys for additional defendants in this case. now, look, the question here is not what the sentence will necessarily be. it carries a life -- it carries a life sentence. the question is for the judge to determine whether or not these three defendants should have the opportunity to seek parole after serving 30 years. now, we heard from the state, they talked about this being a case of vigilanteism and saying these are not necessarily charges that would -- that they believe require someone to have that opportunity at parole, but what really struck us today, john, was listening to the family of ahmaud arbery, a 25-year-old man who was just going for a jog in the neighborhood and ended up being chased by the truck and these men and they described the feelings, his mother and sister, wanda copper jones, here's what she had to say. they chose to target my son because they didn't want him in their community. they chose to treat him differently than other people who frequently visited their community, and when they couldn't sufficiently scare him or intimidate him, they killed him. >> we are not sure at this point if we will hear from the defendants themselves. they will have the opportunity if they choose to speak to the judge and attempt to sort of plead their case here when it comes to the sentencing. you know, john, this is not necessarily the end for the arbery family right now. they talked about how this was a day that they had been anticipating because they felt like it was a day of justice potentially for them, but, look, the attorneys for the three defendants have already said that they do plan to appeal and just next month the federal trial for the hate crime charges against all three of these men will begin hear in brunswick, and i'm not sure. you may be able to hear or see behind me there are people who have like shown up, and they are showing their support to the family here. the attorney for travis mcmichael said today to the judge that they were hoping that they would have some story of redemption here for the mcmichaels and also for the arbery family. at that point ahmaud arbery's father looked hat his attorney and gave him a look and that's what we're dealing with at this point. we do expect it to be finished sometime today. diane gallagher. we know the court hearing will resume at the top of the hour. thank you. let's get some perspective. were you with us many times during the actual trial as we listened to the testimony. the judge has to make a decision. are the circumstances here of this killing so extraordinary in his view that these men should be denied a chance of parole. you hear from ahmaud arbery's father and mother today, incredibly powerful statements. how much, if at all, does that impact the judge, and i don't say that to be disrespectful for the family. does the judge have a legal check list or is he open to the open-minded impact? >> the judge is open-minded to the impact. i'm not sure it's possible that they may have seen a written one in advance of the sentencing. you know, those are very emotional statements, and they are very important statements for victims to have a chance to be heard. i don't think what happens live in court before the judge will make that big of a difference today. i think this judge will have already considered what factors he will expect the victim impact statements to be full of grief and loss so i suspect he's already got a pretty good idea of what the sentence will be. >> judge glenda hatchett also joins us, host of "the verdict." judge, good to see you. is this a cut and dried decision from the judge based on the testimony of the trial or do these defendants say we know we're going to get 30 years, please, don't make it without parole? making some decisions and complaints about how cdc guidance is then communicated. the sources cite walensky's updated isolated guidance this week as a clear example of what they see as cdc messaging fumbles. kaitlan collins is here with us, part of the story reporting the story. what's the latest >> reporter: >> reporter: dr. walensky came in vowing to restore trust in the agency. the agency had been weakened by the trump administration, the accusations of politics driving the science there when donald trump was in interest as president, and that's something she wanted to fix, and now as we're approaching the one-year mark you see the american questioning the cdc and its guidance on this pandemic now more than ever, especially with the changes announced in recent days when it comes to what to do if you've tested positive and isolating at home now that we've had the surge in cases due to the omicron variant. we've learned from sources saying last fall the cdc had a series of messaging problems fumbling the messaging on several significant decisions. dr. walensky hoped to improve her communications skills so that when she steps out in the public eye in the first independent media briefing since last summer sheer can better communicate the changes to the guidance and the improvements and updates they make but they are still plagued by questions of what's going on. this is not just coming from critics outside the organization or from health experts outside the administration. sometimes it's coming from her own peers inside the white house. you've seen officials raise questions about why that latest guidance on when you can leave isolation after you've tested positive didn't include a recommendation to take a rapid test. that is something that other health officials in the administration thought should have been included and that's something that cdc director walensky has defended since and today on the call with the briefing with reporters she did say she wants to restore communication and make it better at the cdc. of course, whether or not that happens or if it's too late for people to restore the trust in the cdc is a big question because each the cdc scientists have said the process of putting that guidance together at times doesn't really go outside of a small circle of walensky's advisers and so then by the time it's out and people are raising questions about certain ways it was announced, certain ways it was implemented it's too late to have that process where other people could have waited and said maybe this sounds more reasonable or maybe this is a better way to explain the science to people, and so it's just been a massive issue within the cdc for months now when it comes to messaging. it was last year on masking. it was when the delta wave hit over the summer and now it still is, unfortunately, in 2022. >> kaitlan collins appreciate the live update. urge everybody to read the full report at cnn.com. our reporters are back with us. tia mitchell to you. on the one hand this is very hard and we should give everybody involved in the pandemic response some grace. you have delta and omicron and team biden did run an election campaign in which they said all this infighting and finger-pointing during team trump, that's why you need us. we can come in and do this. dr. walensky says i'm continuing to learn as we learn about the science and communicate that with all of you. what's your take on this big story? >> so there are two things that i think about with this story. number one, we have to remember, as you noted, these are public health experts and scientists. they are not communicators, and they are definitely not politicians so i think sometimes naturally they are going to be a little bit unpolished and perhaps not as aware of some of the public relations issues that could come with the statements they make, but the other thing i think about is the cdc is based in atlanta. so when you're living in a place where mask mandates were never in place, people are not masking, people are trying to get back to work, demanding schools remain open, i felt like her message was trying to speak to those people and say here's how the safest way to let you get to where you want to go, and that didn't really go over well with people in communities that are naturally more cautious, so it shows how the cdc is trying to please everyone, but we have to remember that, you know, with so many things in america people are not coming at it from the same perspective and this is the white house again is faced with an issue where you can't please everyone all the time so it's like no matter what you do, there is going to be criticism. >> and arlette, this is the story, essentially a family story within the biden administration dissatisfaction with a very senior biden administration official and from the outside a handful of people involved in helping team biden during the transition are also criticizing the administration's covid response. some of these experts believe they are too focussed on today, full and they don't have a big strategic plan for where we're heading. i'll rode a bit of it from some of the experts. without a strategic plan for the new normal with endemic covid-19 more people in the u.s. will experience morbidity and mortality. equity gaps will widen and this time we most prepare for the future. this is an ouch for team biden especially so since it comes from their friend. >> the biden team really likes to keep issue within the family so it's not too often that you see this group that comes out in unison to offer some criticism of what they see as the administration's strategy at this point. i think the biden administration, the white house at this point is really trying to navigate how to address these issues that are outstanding with the pandemic now and also trying to anticipate what is coming down the pipeline. we've seen with the omicron vasht there's been lags, frustrations when it comes to lack of testing. there's questions about what those tests, that rollout is going to look like of the right now the white house is really trying to balance their plans while also hearing these words from former advisers on how they feel. >> and so the challenge for the president, seung min, number up, get your ducks in order or get your people loyal or be quiet until you fix the problems and covid is a global pandemic. a lot of this is out of the president's control but his political standing rises or falls with how he handles this pandemic. listen to his take today on is covid here to stay? >> no, i don't think covid is here to stay. having covid in the environment here and in the world is probably here to stay, but covid as we're dealing with it now is not here to stay. the new normal doesn't have to be. >> the new normal doesn't have to be. that's the president's hope that we come out of this winter and things are in the spring as we head towards people not only trying to get back to new normal but starting to think about how they vote in november is different. >> right, right, and it is a shift in the message from the president who did campaign on literally shutting down the virus, and this is a question that the white house has gotten several times from reporters in recent days and the recent weeks, and this seems to me one of the first big acknowledgements that in some form that the drives is here to stay which is something that public health experts have been saying for some time now, that pittsburgh penguins we as a society will at some point have to learn to live with. i think president biden is also trying to make the case here that these really high case counts, the shortage in testing, school closures, that's not here to stay and that's his focus and trying to shut that down is his goal. >> let's bring in now dr. raney, grateful to see you. you are one of the people as was dr. walensky in the public sector who has helped me, helped me consistently through two years of this pandemic, more than two years of this pandemic now. when you see the criticism that the doctor is in government and people criticizing her management style or how she communicates, fair or not? >> my heart goes out to her. listen, running the cdc is a tremendous challenge. it is an immense bureaucracy. i love the idea of her improving her communication style. it's certainly different as a government official than it is as a private sector individual, as a practicing physician, but i don't think it's fair to put all the blame on her. show could communicate perfectly but the reality is when you go to the cdc web page this policy makes no sense. one of my friends said it feels like a choose your own adventure game. that's not on dr. walensky. that's on the nbc -- >> let me jump in there. i get the staff might write that, but i get that's it is on her. i get you're trying to say it's not on her alone. >> it is, but at the end of the day the buck stwops her. more than media training it's possibly about bringing training to run the system so the web pages agree. when the new isolation policy was released, there was one thing in the press release and the media notification and a different thing on the cdc web page telling people what the isolation policy was. one said it was asymptomatic people and the other was for people with resolving symptoms. those types of small inconsistencies need to be resolved before things go public and i think that type of training is what's needed at the highest levels of the cdc. dr. frieden, a former cdc director has said that it's really about not working on just what's the right science and it's what the right policy to release to the world and testing it before going tout to the public. time and to imagain we've been vok by the poll tis that come out of this cdc it wouldn't be -- >> a question that i think every parent around the country is asking. number up, we want to show you the combined current covid case count with covid hospitalizations and covid democrats you see the yellow lines. that's cases. omicron cases are way up. it's a straight line like a rocket ship. we do see, unlike delta, hospitalizations and deaths by the number, i know those are huge numbers still and they are hurting hospitals and every one of those deaths hurts an american family in an american community, but there is a big connection between cases and deaths unlike the previous waves. you have chicago teachers still refusing to go back to school. dr. walensky says trust me, it is safe. >> i want to remind people we had a delta surge in the fall and we were able to successfully keep our schools safely open, our children inschools, safely open and question that before we even had advantagesan for our children so among the things to do to get our kids vaccinated and to use you will of the strategies that we've talked about. >> on that issue she's squeaking quite clearly and firmly is. she right? >> if you're vaccinated, masked and everything it's taffe or become. listen, john, ind sending my own kids back to public school in roh moo-hyun. i recognize there's schools across the country that have not put the precautions in place. there are families with immunocompromised members or other reasons why of unlimited possibilities. a critical day at the supreme court. justices today hearing arguments over two biden administration coronavirus mandates. the first, a vaccine or test mandate for businesses with 100 or more employees. that affects some 80 million american workers. the second another vaccine mandate, this time for health care workers at facilities that receive federal funding. cnn's justice correspondent jessica snider is tracking the arguments. what are we learning? >> this is a high stakes case with an urgent deadline because the biden administration is trying to implement the mandates for two sets of workers,month but osha and health and human services, they say they don't have the power to implement any mandate of this magnitude. we're about two hours and 40 mintz in. the question is what do you remember do they have. they have beenching -- it could be argued that are federal agencies wouldn't have the right to act. conservative looking justices are locking at these with the -- they are saying agencies can only act when congress has given them explicit power. here's chief justice john roberts talking about osha's limited power in particular. >> it's up of your main objections that this is not a washing place issue. it's an outin the world issue, is that right? >> that's right, mr. chief justice. >> well, how focused on the workplace does something have to be before you had say that osha can regulate it? i think, for example, an assembly line, you know. workers sitting next to each other for a significant length of time working together in close contact. this vee vents a different kind of wisk so can osha said for workers none the assembly line are we saying workers must be vaks nated? >> no, not vaccinated. >> the judges will have to act quickly and the oshie ashe mandate is set to go into effect monday, a mandate that requires employers when 100 or more employees to require vaccination. to recap, the challengers want the justices to stop the mandate so it can continue to be challenged in the lower courts and then there's the other mandate looming. that one requires health care workers to be vaccinated. that's set to take place at the end of january unless the supreme court stops t.interestingly here, lawyers for these challengers, these business eds say a lot is at stake. they represent the business interests here, and they are saying that businesses will actually lose a lot of workers if the mandates take effect and if these businesses need to make plans now if it will go into effect urging the supreme court justices to act quickly here. john. >> it will be critical to hear what the judges say when they are done listening. thanks very much. let get some perspective. back with us former federal prosecutor shan wu. is this a joined test of how the conservative court views executive power, or is it more a question of what came up there from jessica schneider, did congress give these agencies big authority. is it the weeds or a big deal? >> it looks like the weeds but it is a big deal, john. it's really a test of new young group of conservative justices, amy coney barrett, gorsuch and kavanaugh, young justices at the height of their intellectual power. they are champing at the bit and that sbit john roberts so you can even hear in that tiny excerpt his approach to this measured,
