unvaccinated. >> nonetheless, the arrival of the omicron variant in this country has sparked some cancellations. stanford and harvard are the latest universities to announce online learning starting in january. the national hockey league has halted cross-border games between the u.s. and canada this week. and this afternoon, president biden will meet with his covid-19 advisers in the oval office. he is expected to address the nation tomorrow on exactly how the administration is going to respond to this new surge. cnn health reporter jacqueline howard, also cnn national correspondent jason carroll are following the developments this morning. jacqueline, let's begin with you. we always try to take the good with the bad here. the data has been clear throughout, this remains largely a pandemic for the unvaccinated. we have some good news on moderna and its booster shots. tell us what we're learning. >> that's right, jim. we have some good news from moderna this morning. preliminary data suggests that the booster helps increase antibody levels against omicron. here's what moderna announced this morning. moderna says that the current one booster dose, 50 micrograms, can boost antibody levels 37 fold compared with just two doses. so the current booster, 50 micrograms, can boost antibody levels 37 fold. a larger dose at 100 micrograms can boost antibody levels even more, by 83 fold. so that's what moderna says right now. data suggests that the booster does increase antibody levels, a larger dose can increase even more. what does that mean about the level of effectiveness? that's what we still need more data on, what we need to hear from moderna as far as what does this increase in antibody levels really mean? we heard from moderna's president just this morning during a conference call. here's what the president said during that call. >> moderna will focus its immediate efforts around omicron on advancing the prototype vaccine. we're going to continue to advance an omicron-specific booster for clinical trials in early 2022. >> so you heard there that they are working on an omicron-specific variant that could enter clinical trials in early 2022. but right now they are focusing on their current booster and what the latest data really means. and we also -- i just confirmed with moderna a few minutes ago that the company has shared this preliminary data with u.s. regulators. the company says, quote, we are sharing the data with regulators as they begin to assess if any change to the authorized boosters need to be made. the 50 microgram booster is authorized in the u.s. for people 18 and older, and the 100 microgram is offered for those severely immunocompromised. we'll see what happens next if u.s. health regulators respond to this new data. jim? >> all roads lead to vaccines and boosters. jason carroll is in new york city. cases up significantly. i mean, back to levels in terms of infections that we saw at the beginning of the pandemic. interestingly, jason, we're not seeing across-the-board cancellations as new year's approaches. >> reporter: right. not yet. that's certainly good news to a lot of the tourists who we've seen out here who were anticipating nooe ing new year' celebrations in times square. health officials are looking at the covid numbers very carefully as they way whether or not what they'll be doing out here. covid cases in the city have more than doubled compared to last week. most of the cases, when you look at the hospital data that's been coming in, most of the cases are among those who are unvaccinated. medical officials also looking at the data say that what they are not seeing is a substantial rise in the number of hospitalizations compared to, say, this time last year. meanwhile, when you look across the city, jim, you're seeing long lines, people waiting, people trying to get test results, tests ahead of the holidays as they try to go out and travel. some people traveling to drugstores, looking for kits and they're sold out. the city is trying to meet that demand by opening more test sites. they'll deliver 500,000 at-home test kits. a lot of eyes on times square trying to figure out what's going to be happening. new york city's health commissioner weighed in on that issue earlier this morning speaking to cnn giving his assessment of what should happen. >> follow the numbers and what the data and the science tell us. it is outdoors. everyone is required to be fully vaccinated. people wearing masks, of course, can add another layer of protection. and we'll make the decisions that we need to to help keep people safe. >> reporter: right now the mayor, bill de blasio, says the final decision about whether or not the ball will drop will come sometime before christmas. right now it is a go. organizers say anyone who comes out here will have to show proof of being vaccinated. they're not going to be requiring people to wear masks at this point, but they are strongly encouraging it. jim? >> new york restaurants have been for some time, show that card before you come in. jason carroll, thanks very much. president biden will speak tomorrow about the country's ongoing fight against covid. he is expected to emphasize testing and additional precautions such as masks and social distancing. but i probably don't have to tell you this, pandemic has set in for many americans. joining us now, harry enton. harry, anecdotally, i know there's not a lot of appetite to return to early pandemic measures here, what does the scientific data show us? >> if you look at the polling data, ask how many people are concerned right now about the coronavirus pandemic, what it essentially shows you is exactly that. look at that. extremely or very concerned about covid, it's 42% now. that's a little more than a month ago at 38%. compare it to a year ago. it was 62% a year ago. so clearly there's some fatigue setting in, people are less concerned. also look at social distancing, right. what do you see there? you see now just 45% of americans say they social distanced in the last week. that's basically the same as it was a month ago at 44%. a year ago it was 79%. a lot more americans are going out. more than that, you know, take a look at this. when it comes to masking, right, we've been saying all along, if you do go out, especially indoors, you should be masking. in light of omicron, likely to wear masks indoors. look at that. only 42% of americans say they're very likely. what's interesting is the unvaccinated, the ones who might be at the most danger, might be less likely. the vaccinated are more likely to wear masks going outside. >> a jump in infections even before omicron became dominant. is this, i'm hoping, showing more interest in getting boosters? that is consistent. if you're beasted, that is really good protection. >> yeah. you would think that more people would want to go out and get boosted. but, in fact, that's not really what the data is showing. yes, it is true that more people are boosted now compared to a month ago. but in fact what that polling data is showing that the people who are going out and getting boosted now were the people all along who said they would go out and get beasted. only at this particular point, only about half of americans say they're very likely or will, in fact, get beasted. that's significantly less than the folks who are fully vaccinated, around 70%, and even less than the folks with one dose, around 80% at this point. >> such a shame. it keeps you out of the hospital. >> reporter: i know. it don't make no sense, but i just report the numbers. i am boosted and am wearing my mask indoors. folks, you can save lives. >> listen to harry. thanks very much. my next guest has been part of the team working on projections for the omicron variant. the director of the ut, austin, covid consortium joins me now to discuss. good to have you on. there's so much guessing going on. the scientists, the policymakers, and the people at home making their own guesses as to where this will go. you've crunched the numbers and come up with 18 different scenarios. describe -- i don't want to say the worst -case scenario, right because that leads us down a path here. but describe where the data is leading you on this. >> yeah. so thanks for having me here this morning, jim. we're trying to take some of the guesswork out of it. we're trying to on a daily basis synthesize all the information we're hearing from around the world, all the data that are becoming available if south africa, from the uk, from the united states, and come up with plausible projections as to what might happen. there's still a lot of uncertainty. we have some very pessimistic scenarios which suggest that we could see a wave that peaks by the end of january that's much higher than wave we experienced last winter and january 2021. we could see more than twice as many cases at the peak, possibly even 20% more deaths during this peak than we saw last year. but that's a very pessimistic scenario, and things could be much milder than that. >> so the more optimistic scenario? >> the more optimistic scenario, all the scenarios, all of our projections suggest that we are probably entering a wave that will peak sometime in january or possibly early february. but in the more optimistic scenarios, the wave won't even hit the same heights we hit back in january of 2021. we will see cases rise, hospitalizations rise, we'll see deaths unfortunately rise as well. but the highest number are will not be nearly as bad as last winter. >> we have power in this as a people because we know that boosters help protect us individually, also help protect the population. so how much would booster shots have to increase from where they stand now in terms of a percentage of the population to make a difference in either of those scenarios you described? >> yeah. well, boosters are already making a difference. every additional booster protects somebody. so there's not like some critical threshold where we have to get there and make a difference. every person who makes that decision helps us. right now i think we're a little under 20% of americans have been boosted, which is about 30% who are eligible for boosters, and we've made projections that suggest that if we can get up to 80% of eligible people boosted by early march then we could potentially prevent a lot of the deaths that we're projecting in our more pessimistic scenarios. >> if only folks would listen. all right. where we stand now in terms of new infections, these are still largely delta driven. we know omicron spreads quickly. it's already here. it is spreading quickly. what does your research show in terms of how quickly it will become the dominant variant here? >> well, listen, jim. for weeks now, the white house including the president and his top advisers have been working hand in hand with senator manchin to find a path forward. heed a committed privately to the president at his home that he would support the framework agreed upon by the president and democratic leaders and they would work in good faith to find final agreements. just last week, the president met with senator manchin and said after that in a statement that he believed that they could find common ground on the remaining differences. and then on sunday came this bombshell interview by senator manchin in which he said he was a no on moving forward with build back better. we're told that the white house got less than a 30-minute heads up on this, president biden tried to get senator manchin on the phone before the interview, was unable to do so. then came this scathing statement from the white house that really reflected the anger and surprise that the president and his top aides felt. it talked about that vow to reach common ground, saying, quote, if his comments on fox and written statement indicate an end to that effort to find common ground, they represent a sudden and inexplicable reversal in his position and breach of his commitments to the president and the senator's colleagues in the house and the senate. the statement by press secretary jen psaki goes on to point to a number of the policy achievements that would have been reached in this bill that they say senator manchin is standing in the way of. it is important to note that president biden we're told did, indeed, sign off on this statement going out and in particular the parts of the statement that point out that senator manchin has breached his commitments to the president. we're told senator manchin in a radio interview said he expected this kind of a forceful response from the white house. but now of course the question is how do they, indeed, move forward. and the white house saying we will find a way to move forward next year. but what that path is seems very unclear right now. all we know is that senator schumer has said they will vote on this legislation in the new year. jim? >> jeremy diamond, thanks very much. joining me to discuss, congressman dean phillips, a democrat from minnesota. he is co-vice chair of the bipartisan house problem solving caucus. congressman, thanks for taking the time this morning. >> good to be with you, jim. >> i want to ask you about the response to this. you saw the white house press secretary's response yesterday. clearly not happy with joe manchin. now you see chuck schumer wants to force a vote on this, basically to make joe manchin go thumbs down on this in public. is that smart? does the white house want to make an enemy of joe manchin? >> jim, i don't think so. in my life experience, putting people in that position, condemnation and vitriol doesn't usually result in the outcome that we desire. let me assure you, i'm terribly disappointed, many of us including the senator, have been working hard for months on this. let me assure everybody watching that i believe this is the end of the beginning, not the beginning of the end. and i'm troubled by the response to it because i think these condemnations will only harden his heart, and i as vice chair of the problem solvers caucus are on a mission. my colleagues, at least democratic colleagues right now, to find common ground on this and ensure it does get done. i want people to keep the faith. >> tell us what that mission plan is. there is now this idea of breaking it up, in effect. start with the most urgent needs, things you know you could get support for. what are those first steps? do you start, for instance, with the child tax credit? >> i know senator manchin to be a man of his word. and i believe based on his public comments and his work so far on both this and the freedom to vote act, which we should also talk about, he has intention to get these done. he doesn't like how the build back better act looks right now, so how do we proceed? we sit down. we identify what his misgives are specifically, and try to find a way to reconcile this. you know, our system of government -- >> paint the picture for me because you and the problem solvers caucus have been trying to find a way forward for months. biden seemed to believe that manchin could get there. manchin expressed some public hope that he could get there. and keep in mind, i want to acknowledge there are other senators, sinema among them, who expressed reservations along the way. paint me a picture. give me an idea where there's overlap here and interest. >> well, let's start with conversation versus condemnation. yes, there are elements of it that he is not thrilled with. and look, we have to inject some pragmatism into the circumstance. we have a system of government that makes this tedious. it's designed to make change difficult. boy, we are witnessing that right now. so let's recognize what we need. we need him. plain and simple. we need his vote. so all those who are throwing fire at him do so at our collective peril. so we have to sit down in january, you know, clear our heads and hearts a little bit. there is a path forward. i have faith that we will get this done, and i would ask that the white house and fellow democrats who are disa disappointed -- i'm among them, by the way, jim, terribly disappointed -- but if we wish to accomplish this, my message is simple. let's not give up. we have ten months until the next election with the current very thin majorities in place. let's not give up. in my experience, the way many of my colleagues are approaching this, i'm afraid will result in exactly what we do not want, which is -- >> okay. is there a possibility -- i don't want to get too far out on a limb here -- of republican support for some of these individual measures? for instance, on prescription drug costs. that, by the way, is something that the trump administration had pursued in a republican-controlled congress. or on other issues such as paid family leave, there are a couple republican lawmakers who have expressed support for that. do you see that as a possibility in this environment, or is that pie in sky? >> well, one would think. first of all, most of the elements of build back better are wonderfully supported by most americans. one would think that my colleagues on the other side of the aisle would be supportive of a lot of that. i believe they are. certainly, in private they are. politics gets in the way of everything. one of the great challenges and problems in our system right now, jim, is that we package these massive measures together, we don't allow the input of rank-and-file members in the house or the senate. i'm afraid we're not using a process that results in the best outcomes and the most expeditious ones. the answer is yes, i believe there are elements to separate and vote on independently, but i do believe collectively the build back better act is very important the way it is positioned right now. so i think it's unlikely, sadly, we'll get republicans to join. i think it's worth an effort, but the most expeditious likely path forward is to reconcile this with mr. manchin. i do believe it's possible. >> okay. >> i hope some months fro from now it might be one or a few that we're back together celebrating the great success. >> let me ask you this. you know the headwinds and the midterms are already strong against democrats. just look at the polling on a generic ballot. without passing at least some of this, even in a pared-down form, an individual measure here or there, are democrats in for a real storm in the midterms otherwise? hmm! it's not the same if she's not here. oh. -what the. oh my goodness! i don't suppose you can sing, can you? ♪ the snow's comin' down ♪ -mommy? ♪ i'm watching it fall ♪ watch the full story at www.xfinity.com/sing2 this just in to cnn, and a story that's familiar. the governor of maryland has announced he has tested positive as well for covid-19. he is vaccinated and boosted and says so far he is feeling fine. senators elizabeth warren and cory booker also announced positive tests over the weekend. in europe, the spread of the omicron variant is a few weeks ahead of us here in the u.s. now many countries, they're back on alert and posing new restrictions not seen since the worst days of the early pandemic. cnn is covering those responses to the variant around the globe. >> reporter: israel is adding ten more countries including the u.s. and canada to its red no-fly list as it braces for the full force of a fifth covid wave. from 5:00 p.m. eastern time on tuesday, these countries will be off-limits for israelis unless they get special permission. travelers arriving from them will have to self-isolate for seven days, first in a designated quarantine hotel, then once they get a negative pcr test result at home, so long as they agree to have their movements tracked. israel has been adding countries like the uk, italy, and much of africa to its red list to reduce the spread of the omicron variant. most of israel's 175 confirmed cases and 380 suspected ones recently returned from overseas. sunday evening, prime minister bennett held a televised news conference imploring israelis to take the new wave seriously and encouraging those employed in the private sector to work from home. public sector workers are expected to follow next week. he also sought to reinvigorate israel's stalling vaccination campaign especially among children where take-up has been weak. the time is running out, he said. with god's help we will safely overcome this wave. >> reporter: everyone in london is asking will there be a lockdown for christmas. the deputy prime minister is refusing to rule out the possibility that tougher restrictions could come into force before the end of the holiday season, monday morning saying there are no hard and fast guarantees and warning everyone to be cautious about their social gatherings. in london, a major incident was declared over the weekend by london mayor sid deke kahn who says further restrictions are unavoidable and pushing government to enforce tougher rules saying they could see 3,000 people a day being hospitalized with covid-19 if tougher measures don't come into force before the end of the year. meanwhile, in ireland, where omicron has also become the dominant variant, a curfew has come into force from 8:00 p.m. all hospital venues and live events must shut down. the uk and ireland are grappling with a huge surge in cases. >> reporter: in paris, sadly, we will not be seeing a fireworks show at the eiffel tower on new year's eve this year. it's been canceled because of covid. the government has put in place targeted restrictions for new year's eve. they're asking towns and cities to cancel public gatherings, fireworks, and concerts. france and much of europe are currently experiencing record or near-record high infection numbers. and authorities only expect that to get worse with omicron, which could become the dominant strain on the continent in the next few weeks. all of this, even though france has had a very successful vaccination campaign. almost 90% of those eligible have been inoculated, yet this has not stopped this latest wave. so the country is betting on boosters. the rollout so far has been effective. it's open to all adults and about 1% of the country's total population is getting boosted every day. that's a high rate. the government wants to avoid another lockdown like the netherlands or austria recently. and so it has decided to tighten restrictions on the unvaccinated. the health pass, which is required to access many areas of public life, could soon become a vaccine pass, meaning that only the fully vaccinated would be allowed in restaurants, public events, airports, et cetera. >> thanks so much, a view around the world there. this just in to cnn -- here in the u.s., former president donald trump has filed a lawsuit against new york state attorney general letitia james seeking to halt her long-running civil investigation into his business practices. cnn's senior legal affairs correspondent paula reid, paula, this is not an unusual tactic for donald trump. he has o is often sued. what d do we know? >> first of all, the d.c. schools has told cnn this was not an approved project at all in any way. it did involve third-graders, we're understanding, at watkins elementary school. now "the new york post" is saying that the students were cast in different roles. one student was cast as adolph hitler. other students were cast as actually shooting, simulating shooting their fellow classmates. other students were cast as simulating digging mass graves. now, there are alleges allegations that hate speech was said during this project allegedly by the instructor. we're also hearing that the instructor said, now, don't tell anybody about this to the students, but the students went and told their home room teacher and that's how this became public and the parents got to know. now, we have some statements that have come in. we want to read one in part by the d.c. schools that says this was not an approved lesson plan. and we sincerely apologize to our students and families who were subjected to this incident. cnn also was able to receive a letter that was sent to the parents, and in part, we want to read this to you, students should never be tasked with acting out any atrocity, especially genocide and war. additionally, there were allegations of a staff member using hate speech during the lesson, which is unacceptable and not tolerated at our school. and, jim, the students, we understand, are undergoing conversations with the mental health professionals at the school, and a d.c. school official tells us the teacher is actually on leave. >> jean casarez, thanks so much. right now another story we're following, attorneys delivering their closing arguments, this in the manslaughter trial of former police officer kim potter. she fatally shot 20-year-old daunte wright in april after she claims she mistook her gun for her taser. on friday, potter testified in her own defense. she apologized saying she did not plan to use deadly force that day. >> you knew that deadly force was unreasonable and unwarranted in this circumstance. >> i didn't want to hurt anybody. >> joining me now to discuss the case civil rights attorney and cnn legal affairs analyst areva martin. we saw that moment in courtroom. a remorseful kim potter. what does the law say here, particularly the law when it comes to first and second degree maugt manslaughter, the charges she is facing here? >> it looks at the conduct and the reasonableness or unreasonableness of the conduct. the first-degree manslaughter requires jurors to find her conduct was reckless. the second-degree manslaughter charge only requires a finding of criminal jusnegligence. there's been a lot of focus on the emotional testimony of kim potter. we know she was e moepgs nal right after she shot daunte wright, saying, look, i'm going to jail. it's hard to know whether, you know, those tears or the emotion we saw on the stand was about being sorry about killing daunte wright or being scared about going to jail. i think we're not focusing enough on she pitched milted on the witness stand during cross that her conduct was unreasonable, and that makes the prosecution's case. the question is will the jurors overlook that because of her emotional testimony. >> that's an important point there because the negligence standard, right, was it met by her own story, right? not the remorse but saying in effect i screwed up here, right? does that feed into the prosecutor's case as opposed to help her defense? >> i think it was a slam dunk for the prosecutor's case because she admitted that her conduct was unreasonable, she admitted she was a 26-year veteran of the police department, that she old had training on taser. she admitted the taser and the gun look and feel different. so she made some critical admissions that are key to the prosecutor's case. so when you look at, you know, is there guilt here, i think she proved her own guilt. so taking the stand as we know is always a risk for a defendant. i think it was damaging to kim potter. now, again, the emotional -- i think people should look at the emotional testimony from daunte wright's mother. there's no guessing there. we know that mom was emotional because her 20-year-old son was killed in an incident with the police that didn't have to happen whereas we don't know about kim potter's emotional state. was it about daunte wright or saving herself from going to jail?
