>> my understanding is soon as we vote yes on infrastructure it goes to the president because we're going to vote on the senate bill without amendment. so that is the risk that we vote on that, on the reconciliation bill, it goes to the senate. now the senate has to act. i'm convinced the president will ensure that bill passes the senate. they make changes it's going to be back-and-forth. but the key commitment the president has made is that he has 51 votes for key priorities and he didn't make that commitment for months, he only made it after he thought he could get those votes. that's why many of us are confident in that commitment >> if terry micale loses the governor's race in virginia do you think it's you're guy's fault? >> no i think it's the fact that the entire party couldn't come together quicker. it would have been better to have these deals done and as a party think about how to be more conservative and act quickly but i don't think it's one person or one caucus's fault. >> the question if answered honestly will add much more gray hair to your head do you believe the democratic party would be better served without pelosi and schumer as the leaders? >> no because there's no way anyone can navigate these slim majority without speaker's experience or biden's experience. i've been in congress three terms -- you know so many people. biden, schumer, pelosi they know a lot of people and those relationships matter. are there things i believe a new generation is suited for, yes, technology, understanding new jobs, when it comes to passing things with a slim majority in washington they know what they're doing. >> you guys are all talking about taxing the rich, that's where the money's going to come from, now i'm hearing you guys are let's planning on the fixing -- that word should be in quotes, okay -- fixing the state and local tax deductions, also known at salt tax deductions that trump took away from states like jersey, california and new york. the concern is, if you do that, that until that -- you know the salt taxes, will net to neutral the taxes on the rich. are you considering doing that? >> we are. but it would be capped. and it would help the middle and upper middle class. here's the bakic r. basic, you can raise taxes those making over $10 million, they made the most wealth gain, don't have to raise taxes on people making $200,000, especially when it is going to fund public schools and public health. the democrats are for working and upper middle class and we're for taxing people over 400,000 thousand dollars particularly the ultimaty wealthy. >> if you do the salt tax they say the way it is anticipated now, the scoring agency, the people measuring what the impact of this bill would be in terms of positive and negative tax burden, says if what is planned to be in the salt bill is in there for the next two years, for those two years you would not be taxing the rich you would in fact be giving them a break. >> i don't know how they're defining the rich, with the sur tax certainly millionaires will be taxed with an increase tax on enforcement, certainly the wealthy will be taxed, the salt deduction shouldn't extend to people making over $1 million it has to be capped, if we do it that way we'll still increase on ul ultra wealthy and wouldn't hurt middle and upper middle class, that's fair, people who need to pay taxes are the milton millionaires and ultra billionaires. >> i understand i'm just saying you better know how it works of otherwise you'll have explaining to do, don't want to get beat up on it. another thing. i don't understand why it's fair. why is fair to put this at biden's feet, i was listening to her say we trust biden, he says we can get the votes, fine. why is on him? >> if you look right now at the voters most likely to turn out, what do you see? you see republican are more likely to turn out than democrats. for republicans are more enthusiastic than democrats, you are seeing youngkin hold one point lead and registered voters, mcauliffe has three point advantage. you could argue what's going on in washington, d.c. you could argue democrats haven't passed much of anything. this fits a historical pattern the party out of power has more enthusiasm on its side, looking to punish the part of the president >> so, my producer just said, when you said the sub yous are breaking suburbs are breaking i meant blue because that's the story why biden won. fairfax, loudoun, they western very bi bad on trump versus his first campaign which was the big swing for biden. why don't we believe that will happen again. even thoet base for trump and youngkin won't make it. >> r. >> if you look among white voters with college degree you'll see donald trump is quite unpopular to them but youngkin net popularity white voters with college degree is 15 points higher than donald trump. even with voters without a college degree but youngkin limited the losses with voters without degree, donald trump could not. >> we've been nationalizing this as a window into early metrics. people were looking at vote in virginia through the lens how they felt about trump or biden. mcauliffe seized on that and made this race about youngkin being another trump who went hard on culture issues, what are they teaching kids in school, what's going on with the mask, who made the better bet? >> i would argue glen youngkin did because he's closing in the polls. and look he's tieing this to nationaling issues in some ways and flight joe biden is the president of and right now joe biden the president looking at his popularity in virginia and nationally, in the state of virginia approval rating of 45%, compared to favorable rating on election day 2020 just 52%. that's basically the same trend we're siege nationally. now biden down 43% versus election day 52% this is the thing so important when talking about why does virginia have national implications, if you look at the last three cycles, 2009, 2013, 2017 look at at approval rating of the president all in the 40s. somewhere in the low or high 40s. in all those cases in the following midterm they lost house seats. >> they usually lose house seats in the first term with couple exceptions, american people tend to like balance, we don't know how it will play out now in such an untraditional time. i like slide five. i think it makes a very important point about the true risk for democrats, whichsen enthusism yeah who will come out. explain this. >> this is essentially a poll by monmouth university said how motivated are you to come out the vote. -- we're seeing 80% white voters and black voters 65% if mcauliffe wins he will need black voters to come out and get it closer to presidential year electorate but we're seeing in the polling black voters are nowhere near motivated as white voters are. so one thing i'll look at is whether or not black voters show up in heavily african-american areas in virginia, if they do mcauliffe may win as polling suggests perhaps the opposite. >> that's the one basis where i think mcauliffe may be struggling, because of his party. and i'll tell you what, it even resonated inity alley. you know, the idea of people saying, you democrat-y. don't make me laugh. >> sorry. >> why doesn't his party -- why don't they like him? >> so, you're not connecting all the dots, right. >> you say that to me every segment, by the way. you need a new inset. >> i maintain -- >> -- go ahead. >> it's not an insult i just want to close the loop for you. joe manchin is the best thing to happen to joe biden. i don't believe in coincidence, the nbc survey comes out this weekend says 71% of the country, nearly half democrats think we're headed in the wrong direction. the abc survey says 32% plurality say this will hurt people like me. same poll you're talking about all night. do you think it's a coincidence one day later joe manchin comes out and puts the brakes on the big spending big? because i don't. manchin is forcing biden to take a win for the $1.2 trillion because they so-poorly sold the bigger bill, that's what's going on >> jess, do you think the house will a will you -- you know, they'll get a little bit trapped if the house votes for the infrastructure bill that's already passed the senate without amendments then it will become law and they'll be boxed out on the spending bill, what happens then? >> i think at this point everybody has work ted too hard and come too close to let it go if the house decides to vote on the infrastructure package it's because they think the second bill, the social bill, is secure. so i'm not going to be too concerned if i see that happening. i think this has been a really long and messy process, but these are the absolute worst hours of trying to pass historic legislation. eventually this will be an outcome story. this will not be a process story. i want everybody to remember how frustrating it was to try to pass obamacare and how it was declared a failure because it didn't have a public option but now one of the most powerful safety social nets we've seen. in a few years that's how we'll talk about this. every plank of the agenda being considered is wildly popular, reaching numbers you can't just get with democrats it's also republicans and most independentlies. -- independents. so once americans see it hit their checkbook that's where you will see the american people say oh, yes this really does effect me and my family. >> why isn't what jess has been saying, how it's been sold all along, michael? >> they try to blame the media for this, that's fixated on the bottom line but the legislatures have been fixated on the bottom line. it hasn't been a debate about component parts. it's about 3.5. 2.0. 1.75. don't over look the fact that joe manchin today is relying on pen-bharton analytics that say it's not $1.75 trillion it's 3.9. that analysis is not going to go away. i think the climate now is just one of where americans believe this is all too hurried, to spend too much money, there's got to be too much waste baked into it. i don't see this as resolving any time soon. i believe what told you, chris, i any manchin zog biden a favor forcing a $1.2 trillion win where 19 republicans in the senate including mitch mcconnell were on board. joe biden gets a much-needed notch in his belt. >> jess, response? >> i mean, i've seen poll that's suggest most americans think this bill is the right size or not big enough. i think at this point we have to start talking about what's in it and joe manchin knows what's in it. he probably spent more time negotiating this bill than any other single senator. he knows it meets all of the demands he laid out today. he knows because he was part of the negotiations. he knows that waiting for cbo score is something the senate needs to do anyway so it seems like this press conference didn't do anything to slow down the momentum with other democrats on the hill. it's just joe manchin being joe manchin. it's hard to make sense of what he's doing, unless you assume he just loves the attention, in which case, this is a master class in you how to get it. i don't tell candidates to gain national notorietiy by standing in the way of this agenda, but this gets done soon. >> you say notoriety, will it be notoriety or fame? >> go ahead, jess, i cut you off. >> sorry, i was saying west virginia actually needs these packages more than most states, there aren't any billionaires in west virginia. i can't imagine that there's a lot of west virginians cheering to take down social programs in this crisis. >> -- last word michael? >> well, i think it was spot-on question. you know. as we've been saying all along, although sb 8 is abortion restriction and the most extreme abortion restriction we've ever seen, the questions today in front of the supreme court were not just about abortion. everyone, it seems like all of the justices agree that this is patently unconstitution allow. the question really is, can a state justice decide, you know, the supreme court's precedents and the bill of rights, just don't apply in our state. and a state can just nullify a right that has been recognized bit supreme court for 50 years. a fundamental right. by allowing anyone to sue anyone who exercises that right or provides care to allow someone to exercise that right. that doesn't just apply for abortion, it could apply for guns, for freedom of religion. every single constitutional right is at stake if texas' argument succeed and the federal courts can't do anything when a state tries to nullify a right like texas is dog here. >> like texas is doing here. >> the real concern for roe v. wade is not a punitive civil of he measure they wrote into the texas law it's violent. that's where the mississippi law will come. are you hearing from barrett, from kavanaugh, or any others, that you take as a signal on that other issue? >> i didn't hear anything today that signals what the court's going to do. as you note one month from today the supreme court is going to hear arguments in dobbs versus jackson women's health organization which is challenge to mississippi 15-week abortion ban, the first time the supreme court is considering a ban before viability. the state of mississippi has asked the supreme court to overrule roe, to overrule casey and allow states to ban abortion outright. so the right to abortion is at stake in that case it's going to be heard one month from now. i didn't hear anything today that really signals how the court is going to rule in that case. >> what about with kavanaugh --ly give you final point obviously and congratulations on today being your first day before the supreme court, that's something to remember, when kavanaugh was talking about, he was saying, but, we may change the law in the future. and what would that mean, in terms of everything that had been done while we were waiting in this period, before we changd the law, what would that expose people to? now on one level you could say it's an expost facto argument. obviously anything before something is change ed fine. and it seemed like a gratuitous point from someone who is obviously a legal scholar. so, what was that about? it was just spontaneous, right? just a couple cooks on life talking about it but they never suspected that would be that spontaneous? right. the head of intelligence at d.c.'s homeland security office not only notified multiple agencies about the vie leapt c -- violent chatter online two days before the attack but alerted the city's health department to call up d.c. area hospitals to prepare for a mass casualty event. empty your emergency rooms he said. stock up your blood banks. >> good to see you, sir. >> what did you know? >> not what we knew but the threat picture we seen. leading up to january 6th we started seeing a lot of concerning information surrounding the events that were planned. information from particular actors that we hadn't seen before, specifically looking at what we call ttps, tactics, techniques and procedures that indicated they would be intent on performing acts of violence into personal violence and possibly even smuggling weapons into the district. >> so how come we weren't more prepared? >> well, you know, like you and other americans, i'm looking forward to seeing the conclusion of multiple investigations into that. i can't speak to why what happened at the capitol actually happened. our job from my team's standpoint was to collect, an liz -- analyze and disseminate threat information to as many people as possible. that's exactly what we did. >> so first, let's get a sense of what it was and then we'll get to what it meant to you. when you look at what you were seeing, do you believe that this was about a desperate set of groups that were just equally mad about things or do you believe there was coordination of intent and purpose? >> i think it's a little bit of everything. so we found even leading up to the january 6th, what made us really concerned was we saw a core group or several groups of individuals that were well organized and had articulated specific as i mentioned before, tactics, techniques and procedures that would bring to bear a lot of violence in our estimation if they came to the district of colombia. using a large amount of people who were there for their first amendment protected activities as shields or even as a force multiplier for their more activities. >> do you believe what happened on that day was a chain of things that couldn't have been anticipated and the guards kind of let them go because there were too many of them and guards weren't set up and people started to enter the capitol but it was benign at first or do you think it was more intentional than that? >> well, i'll be honest with you. everyone is focussing on january 6th, chris, but the seeds of what happened on january 6th were planted a long time ago and wee seen this fermenting in american society well before january 6th. and i know everyone is focused on january 6th and there will be an autopsy on going now. while that autopsy is ochocurri, we can't lose sight of the fact the elements that made january 6th still are still there in our society. even after january 6th. we started seeing threat information for individuals that didn't go to d.c. who lamented they hadn't been here and had articulated that it would have gone differently had they been here. so there is a lot of people out there not just who you saw on january 6th that are of like mind and i think that's probably the broader picture. >> percentage chance do you think it could happen again around another election event? >> you know, i don't predict the future. i will tell you that there are individuals out there who have mobilized from radicalization and their mobilizing to violence and those individuals we need to identify and connect with. chris, these aren't some foreign fighters that are coming over to our country to do us harm. >> right. >> these are our neighbors. these are our schoolteachers, bus drivers, first responders and so we really need to get to the bottom of how people are mobilizing from radicalization into violence and get to the bottom of that. >> you were going to say these are our brothers and sisters. i don't know we can say that anymore. we're in a weird place in this country. thank you for keeping us safe. >> thank you, chris. >> all right. we'll be right back. i stopped hanging out socially. it was a easy decision -- clearchoice.
