is you look at everything there. you look and assess his conduct. and what you find when you have the conduct is a lot of circumstantial evidence. a critical fact in this case is the fact that he ran. why? it evidences consciousness of guilt. you could explain the hitch hiking. he went somewhere. he was gone for a brief period of time. you could explain he was hiking alone, at least he said to miss baker. they separated for a little while. he was hiking alone. what you can't explain is where the guy is, why did he run, and why did he really feel that he needed to evade authorities. those are going to be questions in the event he's brought back safely that everyone is going to want to know. if there is an innocent explanation, you stay and explain. you don't run and hide. >> and stay with cnn as we continue to follow the investigation. a government shutdown later this month and suspend the nation's debt limit. it faces an uphill battle in the senate. it comes 59 at at a critical time for biden's economic agenda e. has a neating in the coming hours to address deep divisions in the party. cnn's ryan nobles has more from capitol hill. >> reporter: the house of representatives did get some work done on tuesday night. but it's likely that work won't get much further. the house passing a bill that would extend government spending through the end of the year and suspend the debt limit through the end of next year. but that bill faces an uncertain future in the senate where the republican minority has said they are not going to support any type of bill that gets rid of the debt limit for any period of time, even if it means a government shutdown, which this bill would do if not passed, because it is tied to that government spending proposal. we'll have to see how republicans play it. there are some republicans in a tough spot because there are certain impacts in states. at this point republicans say they plan to hold firm. if this doesn't pass the senate, the next option for the democrats would be to include it in that big reconciliation package which can be passed with only democratic votes. problem is democrats are having trouble passing that piece of legislation as well. democrats haven't agreed how they want to spend the $3.5 trillion that could potentially be available in that package. some moderate democrats believe it is too high. that backs into the issues both sides are having as it relates to the bipartisan hard infrastructure, $1.2 trillion already passed in the senate. house speaker pelosi promised moderate democrats in the house they would pass that bill as soon as next week. monday, in fact, and so far pelosi not backing away from that promise. the only problem is the progressives have said they're not voting for the bipartisan deal unless they get a vote on the reconciliation package, the bigger $3.5 trillion in the house and senate. a wide range of topics, four different issues, but you can see how they are all intertwined. at this point, not one of those four big issues that the congress is attempting to try and reconcile have a clear path toward being complete. next week is going to be crucial and negotiations throughout the rest of this week will also be very important. er ryan nobles, cnn on capitol hill. well, president biden is back at the white house after his speech to the u.n. general assembly. he will have a virtual summit with world leaders aimed at ending the coronavirus pandemic. it comes after he tells our affiliate he tested positive for covid-19, and will quarantine in new york for 14 days. he had been attending the u.n. summit with jair bolsonaro who refuses to get vaccinated. on the diplomatic front president biden sought to mend relations with european allies over the new defense pact with australia and the uk, and he urged world leaders to rely on diplomacy, not military might, to solve the world's problems. cnn's jeremy diamond has that report. >> we've ended 20 years of conflict in afghanistan. and as we close this period of relentless war, we're opening a new era of relentless diplomacy. >> reporter: president biden committing to an era of diplomacy and cooperation. to tackle everything from climate change to cyber security. as he looked to turn the page on america's longest war and some of the most tumultuous weeks of his presidency. >> today many of our greatest concerns cannot be solved or on addressed through the force of arms. bombs and bullets cannot defend against covid-19 or its future variants. >> reporter: but in the wake of the chaotic u.s. withdrawal from afghanistan and recent rift with france, he quelled doubt about leadership and alliances. >> as we move ahead, we will lead from the tombs, covid, human dignity and human rights, but we will not go it alone. >> reporter: even as he vowed to naming them and compete with china and russia, biden stressing he doesn't want a new cold war. >> we'll stand up for our ally ands friends and oppose attempts by stronger countries to dominate weaker ones, but we're not seeking -- say it again. we are not seeking a new cold war or a world divided into rigid blocks. >> reporter: the president's speech coming on the backdrop on the new relationship with australia that will provide submarines to counter china's growing military footprint in the indo-pacific, angered not only china but france who saw its own deal with australia implode. >> it is a more reliable ally. >> reporter: biden returned to the white house to meet with his british counterpart and the pact. as he called with french president emanuel macron, still nowhere to be heard. >> well, president biden's pivot away from military conflicts toward diplomacy comes as the u.n. faces its own diplomatic challenge. the taliban want their own representation at the u.n. general assembly this week. they are currently represented by an appointee of the former government. anna corinne joins us. what is likely to play out and what is happening in afghanistan as the taliban struggle to govern the country amid major concerns about their treatment of women? >> reporter: rosemary, the u.n. is yet to recognize the taliban government. this is something they've been asking for now for weeks. no other country in the world has recognized this taliban government, and now you have the taliban, the sense of emboldenment, saying we want an ambassador at the u.n., sit at the table, and we want our foreign minister to speak at the u.n. general assembly. making all these demands yet making no compromises whatsoever. when the taliban came into power over a month ago, they said they would be an inclusive government. women would be an integral part of society despite the taliban's track record, that they would be more tolerant and respectful. clearly that has not transpired on the ground. what we have seen is a brutal putdown of protests, of peaceful protests on the street, of women not being allowed to return to work, girls not being allowed to return to secondary school. this is causing great concern within afghanistan, obviously within the international community. the u.n. human rights chief spoke yesterday. let me read to you what she said. there is a real and palpable fear of afghan women of the taliban's return to repression of women and girls during the '90s. this is what we are hearing from women in afghanistan. they want to work. they need to earn a salary to feed their families, and yet they are being made prisoners in their own home. let's have a list tone what one afghan woman had to say. >> translator: women want to have a profession and to work. since the taliban came and took kabul they can't continue in their jobs. the taliban have taken away their freedom to work. >> reporter: and this is a huge issue. not just for women, but for all afghans because obviously joblessness is rife with humanitarian crises unfolding. the taliban cannot access the 9 billion in reserves that are in american banks. the international community, this is leverage that they have over the taliban. so, someone needs to tell this government that if you want recognition, if you want a seat at the table, then you need to play ball, and you need to be a responsible citizen and honor human rights, women's rights. yeah, and be the partner that you claim you will be. >> exactly right. anna corinne joining us from hong kong. many thanks. the u.n. general assembly is discussing global inequality with regard to covid vaccines. natalie is the c.e.o. of the united nations association uk. i asked her what global leaders need to achieve on vaccine equity and what is actually possible. >> the international community is united at least in its diagnosis of the problem. that is very acutely evident when it comes to equity. the secretary-general did not mince his words. he evoked a stark image of discarded vaccines in bins while 90% of people in africa are waiting for their first dose. i think what we need to see is some very concrete commitment to funding covax, to donating vaccines, and enabling other countries to develop their own vaccines, a global public good because it is an imperative. the situation will not end until we get this right. >> u.s. president joe biden said he favors diplomacy over military might and said, america is back, but many people are saying, what does that mean exactly, especially in the wake of his new defense pact with the uk and australia that france calls a breach of trust. then there is the u.s. withdrawal from afghanistan that causal eyes by surprise. what are france, ally ands others to make of all this? can biden win back that trust that he's clearly lost? >> reporter: i think he gave it a good go yesterday. he did not have the hero's welcome we might have expected him to have had he addressed the assembly six months ago. it's great to sinned positive signals during the diplomacy, give a coherent speech, raise human rights issues as well as make some commitments on climate and covid. i think the trust really does need to be earned, and the same goes for the uk as well in the lead up to glasgow. $for them to use the formal space in the general assembly to reconnect with allies as well as the theatrical set speeches. coming up, what cdc vaccine advisers are expected to discuss when they meet on covid booster shots in the coming encouraging development for the nearly 15 million americans who have received the johnson & johnson vaccine. the company now says that adding a second dose of the shot provides 94% protection against symptomatic infections. it's a big day for pfizer as well. fda authorization on their booster shot for some people could be coming at any moment. this as it looks more and more likely the pfizer vaccine for children ages 5 to 11 could come as soon as halloween. >> we've had 225,000 kids with covid. it's a serious issue among children, and the best way to protect them is with this vaccine. >> reporter: many hospitals seeing an increased number of children infected with covid-19. doctors had to put up a tent outside an emergency room of a children's hospital in pittsburgh to help meet the demand of patients. the hospital's chief of emergency medicine writing on social media, the number of children coming to the emergency don't at u.p.m.c. children's is historic. it is over 6% full in six states. >> we've implemented standards of care. this means the ability to deliver community standards of care using conventional means has been exhausted. >> reporter: two-thirds of hospitals in kentucky are reporting critical staffing shortages. >> i start my day every day with the situational report from hospitals, and it hurts to see that a hospital has every single person, every single ventilator in use and we have to send them more. that's a trend that we want to reverse. >> reporter: this as medical professionals are now sounding the alarm about this year's flu season. doctors say it could be particularly harsh given how little exposure people had to it last year. and getting vaccinated still a tough sell for a number of people out there. a health care provider in north carolina says it had to suspend hundreds of its employees because they were not vaccinated. novant health said it ended upped suspending 400 employees because they were not compliant. the health care provider says overall the majority of their employees are vaccinated, saying 98% of its employees are in compliance. jason carroll, cnn, new york. parts of the u.s. are facing an increased risk of flooding as the nation marks the first official day of autumn. meanwhile, there is another possible threat forming in the tropics. cnn meteorologist pedram javaheri is tracking the system. pedram. >> it is across the eastern united states, tapping into some tropical moisture. a frontal boundary coming in slowly that will develop this region into being a very wet set up of rainfall here going in through much of wednesday from detroit south into fort wayne, indiana, east to portions of virginia. certainly parts of southern pennsylvania, slight to moderate risk of excessive rainfall. today is the 22nd, which means the seasons are changing. in the northern hemisphere, it is the first day of autumn. certainly going to feel like autumn here once the front arrives. we have 12 hours of daylight, 12 hours of nighttime across the globe today as the eternal equinox kicks in at 3:20 eastern this afternoon. flooding in portions of the philly metro. the great lakes seeing flooding alerts. you can see how much rain is forecast here. lights up like a i didn't say mass tree. we're talking 4, maybe 6 inches in the next 24 to 36 hours. the front does come in with a lot of dryer and cooler air back behind it. just like clock work here, we usher in more autumn like temperatures, with gusty winds to boot as well. going to feel chilly across parts of the midwest. couple of tropical there across portions of the eastern atlantic, guidance wants to bring this from the leeward and windward islands. beyond this potentially into the caribbean. that will be a story worth following the resume their search for gabby petito's missing fiancee brian laundrie in the next few hours. investigators have been combing a nature reserve near laundrie's parents home the last few days. that's where he reportedly told his parents he was headed when he vanished just over a week ago. gis just as the investigation into petito's investigation was ramping up. her body was found over the weekend in wyoming and the coroner has ruled her death a homicide. petito had been on a cross-country road trip with her fiancee when she disappeared late last month. authorities still haven't given any details about how petito died. a forensic scientist spoke with cnn about why officials haven't revealed that information yet. >> the coroner, brent blue, has to make a determination as to whether it's an accident or suicide, a homicide, natural cause death, or in determinant. and the fact that this death was called a homicide would tell me that they must have a cause of death. they're not declaring it at this point because the autopsy is not completed. you need toxicology reports, microscopic investigation. there's a lot of information that has to be put together to finalize the autopsy report. but it indicates to me that there is clear evidence of not only the fact that it is a homicide. they know the cause of death. >> and be sure to stay with cnn as we continue to follow this investigation. well, president joe biden's biggest legislative priorities hang in the balance on capitol hill right now. mr. biden is meeting with multiple members of his own party this week to build consensus around the infrastructure bill and economic spending package. the meetings are an effort to break a stalemate among progressives and moderate democrats as they struggle to advance the president's agenda. and all this comes as mr. biden continues to deal with the ongoing pandemic, fallout from afghanistan, and the crisis at the southern border. cnn's phil mattingly reports on the challenges mr. biden is facing right now. >> we are fixing our eyes on devoting our resources to the challenges that hold the keys to our collective future. >> reporter: making crystal clear this short-lived era of america first is over. >> i know this. as we look ahead, we will lead. we will lead on all the greatest challenges of our time from covid to climate, peace and security, human dignity and human rights, but we will not go it alone. >> reporter: even as his administration grapples with a growing crisis at the southern border. >> what i saw depicted about those individuals on horseback treating human beings the way they were is horrible. >> reporter: with administration officials expressing horror over recent images that appear to show border patrol agents confronting haitian migrants. >> i'm going to let the investigation run its course, but the pictures that i observed troubled me profoundly. >> the u.s. border patrol agents seen on video aggressively confronting migrants have been placed on administrative duties while the incident is investigated. results are expected by the end of next week. meanwhile, at least 4,000 people have already been moved away from the border, with many more expected in the next few days. and yet still thousands remain waiting in desperate conditions to apply for asylum. cnn's rosa flores is on the scene in del rio, texas. >> reporter: what was it like? horrible, she says. new video from under the del rio international bridge showing the overcrowded conditions and thousands living in squalor. these images were taken by a cuban couple who say they waited there for four days before being processed by u.s. immigration authorities and released at a nearby gas station. he breaks down saying it was his mother's dream for him to get to america. the american dreams of thousands of migrants still under the bridge, mostly haitian say officials, are expected to be cut short as u.s. immigration authorities increase the number of removal flights. >> so, we expect four flights to depart today. we are working very closely with haiti and other countries to which the migrants are being repatriated. >> reporter: this as d.h.s. launches an investigation into this video showing border patrol agents on horseback using aggressive tactics against migrants. >> human beings should never be treated that way. and i'm deeply troubled about it. >> reporter: she says she crossed 14 countries and risked her own life to get here. [ speaking foreign language ] she shows a cell phone video of the sharp cliff and the steep mountain she climbed in the thick jungles of colombia. when you say there's a lot of dead people, what do you mean? [ speaking foreign language ] he says he counted 17 dead. >> translator: he said he saw dead women, dead children already decomposing. bodies were on the side of the river. [ speaking foreign language ] you had to drink the water? >> reporter: and inside this tent, they say, was a pregnant woman who was left behind. romero said she started crying and daria said he left her his food. despite the dangers, cnn has learned that up to 30,000 haitians could be headed to the u.s. southern border. >> and that's exactly why we are here because we want anybody who is thinking about coming to texas, whether it be from colombia or any other country, that texas is going to be responding. >> reporter: as for darias, he was allowed to stay in the u.s. for now. [ speaking foreign language ] >> translator: he says that he lost his mother 15 days ago. >> reporter: but his mom didn't live to see her son make it to america. he says she died unexpectedly in cuba. as for the number of migrants under the privilege waiting to get processed by u.s. immigration authorities, it's still in the thousands. at last check, the mayor of del rio says that there are more than 8,500 migrants still waiting. rosa flores, cnn, del rio, texas. in a major effort to address climate change, president joe biden told the u.n. general assembly he will work with congress to increase america's financial commitment to help developing nations confront the climate crisis. and chinese president xi jinping says he will stop his country from building new coal-fired power projects abroad. it marks a major shift in policy for china which is the world's largest emitter of greenhouse gases. let's bring in cnn's steven young. he joins us live from beijing. good to see you. how serious is china about addressing climate crisis? >> reporter: they are serious. they are stopping overseas coal projects is encouraging news. before this announcement china was the only major funder of such projects left. and with this new policy, of course, it could potentially shutter dozens of planned coal projects in 20 developing countries around the world. that's what they have been waiting for. it sends a strong signal to the international community and the global economy. the devil is in the details and details are lacking from this announcement. we still don't know when this policy will take effect or whether or not it's going to apply to private funding as well as public funding. and the much bigger issue here is we still don't know if and when china is going to stop building new coal-fired power plants domestically and start shutting down old ones. remember, according to experts, last year alone, china actually added as much new coal power as what they have just announced to potentially cancel overseas. so that's a scale of coal consumption in this country which relies heavily on fossil fuels to power its economy. and with coal accounting for almost 60% of the energy merry christmas, so this contradiction obviously has been often pointed out by experts, as well as officials from other governments including john kerry, the u.s. climate envoy who was here recently telling us it is counter intuitive and counterproductive for china to continue this building spree of coal plants while insisting they are going to stick to their ambitious climate goals including becoming carbon neutral before 2060. it is much likely beijing will be under growing pressure from other governments as well to do something dough mystically about coal. >> many thanks. a rare and powerful earthquake has rocked australia's second largest city damaging buildings and power lines in melbourne 200 meters from the epicenter. no reports of serious injuries. the 5.9 magnitude quake is one of the strongest on record in australia. right now there is no tsunami threat for the region. the volcano on the spanish island of la palma is still very active. these incredible images show plumes of smoke, streams of lava spewing westward toward the abse sea. the volcano ghani erupting sunday forcing the evacuation of thousands of people. they fear toxic gases may form once the lava reaches the sea and cools the molten rock. just ahead, queen elizabeth ii said andrew is served with legal papers in a sexual assault case. we will look at what's ahead in those proceedings. britain's prince andrew has been served with legal papers which were delivered to his lawyer in los angeles. he is facing a civil sexual assault case, but it's extremely unlikely he will cooperate with any proceedings. cnn royal correspondent max foster joins us now live. good to see you, max. what more are you learning about this and how is prince andrew likely to respond? >> reporter: he's already denied all of these charges made by dufrey. they really struggled to get him to engage at all with the process. even to the extent of receiving papers to notify him of the case happening. so the lawyers say they have served papers by email and post and his address in uk in person. but his team haven't accepted those papers are being served. they did send a lawyer to a pretrial hearing in america, and argued the case hasn't been served. but actually that was an opportunity for dufrey's side. the judge said they could serve the lawyer. the team say they have served prince andrew's lawyers with the paper so they can proceed this case. prince andrew's side will, no doubt, argue the cases haven't been served -- the papers haven't been served. may even argue the u.s. doesn't have jurisdiction over this case. but if dufrey's side are correct, the case can proceed and the trial can proceed. that does mean that he has 21 days to respond or there may be a default judgment in this case. potentially damages if he's found guilty in his absence. so it's a difficult p.r. process, but in terms of the legal process, i think as you say, it does look as though prince andrew's lawyers will argue whether or not the case is founded at all. >> all right. many thanks to our max foster staying on top of this. appreciate it. well, ahead, new details on the plan donald trump's team devised to try and overturn the results of the 2020 presidential election. back with that in just a moment. . mmm, delicious! i need this recipe. everyone thinks i made them, but it's actually d-con. what was that? absolutely. and that's exactly why you should join. the hacking collective known as anonymous says it has hit a web hosting firm popular with far-right group the proud boys and it's leaking data that could shed light on groups that could try to overturn the u.s. 2020 presidential election. the company at the center of the alleged hack, epic, says data released on 15 million people was already public. epic has a history of working with conspiracy theorists and conservative networks like parlor and gab. well, new details on the stagger staggering lengths to which donald trump went to erase his loss in the 2020 presidential election, but the most critical player in team trump scheme then vice president mike pence was not on board. cnn's brian todd explains. >> reporter: new information tonight on the outrageous measures donald trump went to to overturn the election results. a memo from trump's campaign two weeks after the election indicated the campaign knew that claims from trump lawyers rudy giuliani and sidney powell were false. claims that a voting machine company dominion had worked with a software company, financier george soros and venezuela to steal the election. >> the machines were easily accessible to hackers. >> reporter: they knew the claims were false according to new york papers. we have new details the extraordinary pressure president trump put on mike pence to overthrow january 6. >> if mike pence does the right thing we win the election. >> reporter: a controversial lawyer east man tried to convince pence he could overturn when they counted the electoral votes by throwing out electors from seven states. that is according to a new book "peril" by bob kosta and bob woodward of the "washington post." >> this shows with clarity that president trump himself was plotting a coup, working with his minions in the white house. >> reporter: a six-point memo by eastman laid out a plan for pence to overturn the election for trump which included throwing out the results in seven states because those states according to eastman had competing electors. but, in fact, no state put forward any slates of election ors. they were only trump allies claiming without authority to be electors. pence would have declared electors with more electoral college votes after pence tossed out those states. eastman spoke about that at a rally before the insurrection on january 6. >> anybody not willing to stand up to do it does not deserve to be in the office. it is that simple. >> reporter: in his memo, eastman even suggested pence take this action as a surprise. quote, the main thing here is pence should do this without asking for permission, either from a vote from the joint session or the court. the fact is the constitution assigns this power to the vice president as the ultimate arbiter. >> i think every single part of the legal analysis in this memo is wrong. president vice president's role is supposed to be entirely ceremonial. >> reporter: in the end pence refused to go along with eastman's plan that the constitution didn't give him the power to overturn the election. trump turned on pence, attacked him on twitter and called for pence's hanging. what if pence had gone along with this?
