The order stems from an issue with voter registration through the Department of Motor Vehicles, where 1,028 affidavit ballots were rejected by the Oneida County BOE because the registration applications were not processed properly. DelConte said these votes should count because the voters registered on time.

A State Supreme Court Judge this week ordered the Oneida Board of Elections to re-canvass all 1,797 affidavit ballots after it was found the officials failed to process the registrations of dozens of voters who signed up before the deadline through the Department of Motor Vehicles. The campaign for incumbent Democrat Anthony Brindisi had called into question the rejection of close to 70 ballots from voters registered through the DMV that had not been processed on time.

Judge in still-undecided House race to rule on 1,200 ballots

Lawyers for Brindisi and Tenney are now watching how the judge ends up ruling on a pile of contested ballots that could decide the race. DelConte has criticized county boards of elections for mishaps that led to confusion over whether some contested ballots were officially thrown out or not. And he’s chastised candidates’ lawyers for only wanting to count some challenged ballots and not others. The candidate’s lawyers offered their final oral arguments in court Friday. It’s unclear exactly when the process will wrap up. It’ll be up to the court system to figure out which ballot errors can be fixed, and which can’t.
