The sentencing hearing, which is still taking place on the second floor of the hall of justice behind me here in San Francisco was just in recess. It is back in session. It is expected that the judge will sentence Jose Ines Garcia zarate to the maximum three years in prison after being convicted of a firearm possession in the death of kate steinle. Again, that sentencing has not taken place yet, this is what legal experts are expecting. Hes likely fulfilled that sentence given time served. Zarate was acquitted in the 2015 shooting death of steinle at San Franciscos pier 14. This is after the jury decided he was not guilty of murder and manslaughter charges. This morning, his defense team will argue for a retrial on that possession conviction. His lawyers claim the jury was not informed about transitory possession, thats the idea that Garcia Zarate held the weapon briefly but not long enough to call it possession. The prosecution filed a motion this week arguing that that claim is bogus

Reporter the judge handed down the harshst penalty to him. 15 years to life in state prison for all three former a guards. Ferries, rodriguez, and lubrin have been found guilty of seconddegree murder of the mentally ill inmate. He was first down deceased in his cell in august of 2015. Family members of the guard sobbed openly. Many asked the judge for leniency in letters, but the only letter read today came from michaels sister shannon who spoke about her life sentence when she found out about his death. The District Attorney and sheriff spoke moments after the sentencing was handed down. This is not a happy day for law enforcement, far from it because these three jail guards, whose job it was to oversee the correctional system will now be imprisoned within in it. Two years ago when these three jail guards broke michael tyrees body, they also broke the publics trust. And we have to work every day to rebuild and earn the trust the public gives us.
