The fbi says 26yearold Everitt Jameson was planning on using pipe bombs to funnel people into a spot where he could shoot them. The modesto man is charged with aiding a terrorist organization and distributing bombmaking information. Each charge carries a maximum penalty of 20 years in prison. The Attorney Says the client expressed second thoughts and his client had no bombmaking materials. An east bay family appears to be the victim of a prank Emergency Police call known as swatting. That same type of prank that very next day ended up with one person dead in wichita, kansas. Ktvus rob roth spoke with that family and with police. He joins us now in the newsroom with more. Reporter Hercules Police are taking this case seriously and its still under investigation. The family says they have no idea why someone would want to play such a potentially dangerous prank on them. Reporter here on normally quiet north front street in hercules, a family remains upset over what appears to be a very dangerous prank called swatting. The family asked we not identify them. Im terrified. Not sure if were targeted specifically or if this was just a random prank and just confused. Reporter police say just before midnight, two days after christmas they received an emergency call. Heard shots, his mother was screaming and that he was hiding. And then he kept saying that he heard noise, that he heard noises and then he whispered to the operate that theyre coming and then the operator heard a scream. Reporter the caller gave the address of this home. Inside were parents, grandparents and two young children. Police from hercules and pinole responded here and ordered them out of the house, guns drawn. I have guns pointed at my face, my son has guns pointed at his face. Were walking slowly. And the police apprehended us and im asking, whats going on . Reporter the husband came out in his bathrobe but wouldnt comply with an officers request to open his robe. He didnt want to make any sudden moves. I was afraid of getting shot for being an innocent man in his home. Reporter officers handcuffed the father and grandfather while they searched the house. Police found nothing and left the family back inside. But the Family Says Police never identified themselves initially and that led to their fear. Definitely the scariest position i have ever been in. And if my again to have my whole family go through it Reporter Police say they did identify themselves. Police, too, were victims of what appears to be swatting. Swatting is when a caller purposely calls in a hoax often requiring a police s. W. A. T. Team to respond. It does look like it was a prank at this point. And certainly it meets the criteria of some of the other swatting incidents that have been out there. Reporter the day after the hercules case, wichita, Kansas Police shot and killed an innocent man who too was an apparent victim of a prank call. We will continue to look into that as well to see if there might be any connection. I dont feel like were safe at this house. Obviously, they dont have anyone detained. San jose police have arrested the suspect wanted in connection with the Sexual Assault of a south bay teacher on tuesday. 23yearold andrew is in the Santa Clara County jail today. He is charged with a long list of crimes including Sexual Assault and robbery of the Harker Middle School teacher. The chief says a combination of emotional strength by the victim to who came forward and worked with detectives in this case and tips from the public after seeing that Surveillance Video led to the arrest of andrew braciamante. Police say the 23yearold man lives about a quarter mile from the Harker Middle School campus. Early tuesday morning, Surveillance Video allegedly shows him prowling the hall before trapping a teacher in her classroom. For a teacher to be in her classroom early to get her work done, she did nothing wrong. Reporter the man allegedly locked the door, sexually assaulted her, stole her cell phone and wallet and told her he would shoot her if she left the room. The chief says the victim provided details of the crime to a team of 50 officers investigating the case. I dont think any of us can imagine what that victim went through and just to be able to cooperate with the police, um, and give us a detailed segment of the horror that she must have felt. It was just, um, i dont know, i cant even put it into words. Reporter investigators say the suspect has an extensive criminal history for crimes including assault, sex with a minor and a parole violation. After tuesdays Sexual Assault and robbery, police say the suspect went to santa clara where he committed another crime at a liquor store. By thursday, with attention to the crimes growing, chief garcia says the suspect was trying to cut a deal for his surrender. Surrendering when were about to arrest you didnt really make us change our manner. The suspect did not give the victim a choice. We certainly were not going to allow this suspect to dictate how we were going to take him into custody. Reporter without a surrender deal in place, the chief says he headed to San Francisco where he cut his hair in an attempt to avoid capture. It didnt work. As the sfpd made the arrest thursday night. Harker School Administrators declined to talk on camera but in a statement, to fox 2, the head of school expressed gratitude for the hard work of the San Jose Police Department Adding this was a senseless heartbreaking crime. And you know, i really think jon gruden is so passionate about football that he might be a better coach. Thats what i was going to ask because he has been out but he is still in the game when he commentates but in terms of him coming back, you think he is going to be the same coach he was when he was with the raiders . Maybe todays player doesnt take that hyperactive coach screaming at him in this day and age and i think gruden is smart enough to realize the game is change, the players have changed. And i think he will develop and grow with it. I dont think you will see the same guy really going nuts in the players faces quite as often. The governor is concerned about Power Outages in the severe cold weather to come. Anytime you put freezing rain, wet snow, high winds, and followed by really low temperatures, all together at once, that usually creates huge issues for your distribution system. Some areas of massachusetts got more than 16 inches of snow as well and along the coast the tide was the highest in 30 years. Kind of a perfect storm forcing many people to evacuate their flooded homes. That extreme weather on the east coast combined with wet cloudy weather here has led to more delays and cancellations at San Francisco international airport. In fact, we just checked in with sfo where there have been 23 canceled flights and 282 flights delayed. Flights in and out of boston, new york, new jersey, all have been affected because of that bomb cyclone hitting the east. Back here at home, though, were talking rain. Reporter under a new deal with the Justice Department the House Intelligence Committee will get access to all documents to the russia probe and interviews with eight key witnesses including peter strzok who sent anti trump text messages. The fbi in particular is not used to having its inner discussions kind of brought to light. Reporter congress is also looking at the unverified trump dossier funded by democrats. The same Committee Says its possible the fbi relied on unverified information in the dossier prompting some lawmakers to lash out at attorney general Jeff Sessions. We expected a different process and and and treatment and a different Justice Department when you took over. But unfortunately, we are getting the same kind of slow walk on witness access and document production. Reporter the Justice Department is ramping up its investigation into allegations that the Clinton Foundation used pay to play politics while Hillary Clinton was secretary of state promising or delivering favors in exchange for donations or gifts, a violation of federal law. The white house says the investigation is warranted. Well have to wait and see what happens, but theres certainly been a lot of information out there that gives us cause for concern and its important they are finally looking at it. Reporter the defense argued for a motion for a new trial but the judge denied the motion. Gonzalez will appeal. Zarate is not a free man. He faces federal charges for being an illegal alien in possession of a firearm. We are going to ascertain whether or not there was collusion between the federal authorities and state authorities and if so, we can bring a motion to dismiss on double jeopardy grounds. Reporter famed defense attorney tony serra will represent zarate in the federal case. Shame on the federal government. Shame on the Trump Administration. Shame on them in terms of bringing a retaliatory vindictive prosecution. Reporter the defense attorney for the murder trial says when the verdict came in u. S. Attorney general Jeff Sessions and others were already talking about what they were going to do because they didnt agree with the jury. They started talking about, well, well charge him with illegal reentry and well do this and that. And so that has all the hallmarks of a vindictive prosecution. Reporter zarate will be on parole for 48 months. He is currently in San Francisco jail but is expected to be turned over to u. S. Marshals to face those federal charges next monday or tuesday. In San Francisco, Tara Moriarty, ktvu fox 2 news. San Francisco Police have arrested a man after nearly a ninehour standoff with authorities. It started sometime after 11 00 last night at a home near 29th avenue and moraga in the sunset district. Police say a man called them saying another man was threatening him at his home. Officers showed up and say they had interactions with this suspect before. Police surrounded the home and crisis negotiators were called in. They decided to wait it out and at 7 30 this morning the suspect made contact with police finally. The subject did attempt to assault one of the negotiators. Therefore, a less lethal device was used and he was taken into custody without further incident. Ktvu did speak with the man in custodys mother. She says her son has been struggling with methamphetamine addiction for years. North Bay Community is in shock after a man broke into a familys home and sexually assaulted an 8yearold girl inside. All while the childs mother was asleep in another room. Paul chambers reports. Reporter this man, 21year old noah holland, is behind bars after Rohnert Park Police say he broke into a home and sexually assaulted an 8year old child. Scary, you know . All the neighbors here, they know each other. Theres always kids running around. So theres no room on this earth for people trying to hurt children. Reporter investigators say holland went into the familys unlocked vehicle and used their garage door opener to enter the home. Police say holland went into the childs room, took off his clothes and climbed on top of her while she was asleep. The childs Mother Told Police that once her 8yearold daughter woke up, she screamed. Holland then ran from the house leaving his clothes and identification behind. I cant even imagine the terror to walk into Something Like that and it just shouldnt happen in a Small Community like this. Nobody ever thinks its going to happen to them. But the truth is, is theres bad people everywhere. I dont know what to think if that would happen to my son. Im glad they caught the guy. The widow of the gunman in the orlando nightclub attack told the fbi she knew her husband, quote, was going to do something bad before the shooting. She is going to be on trial for aiding a terrorist organization and obstruction of justice. In confession she said she was with omar mateen when he scouted the nightclub in orlando. She knew that night he was going to attack the nightclub. 49 people were killed. In a pretrial hearing, a judge ruled an expert in forced confessions will be allowed to testify. County sheriffs found the four bodies in their Santa Clarita home after getting a call from someone concerned about that family. Authorities say they found the body of a husband and wife, their college aged daughter and preteen son. The gun was found at the home. Police say they are not looking for any suspects. Uber cofounder Travis Kalanick plans to sell 29 of his stake in the company. The deal with investors includes japans softbank. Its said to be worth about 1. 4 billion. It is the first time that kalanick has been known to sell uber shares. Kalanick resigned as ceo last year following a series of scandals but still owns about 10 of the company. Labor Department Reports showed hiring slowed a bit last month in december. U. S. Employers added 148,000 jobs in december. That was a bit less than expected. But still, in a healthy range. One reason for the slow job growth is low levels of unemployment. Jobless rate held steady at 4. 1 . The lowest since 2000. But wage growth remains somewhat sluggish. It was close to disaster last winter when the oroville spillway started to crumble. Hundreds of thousands of people and entire towns were at risk downstream. Today experts released a view of the spillway failure calling it a longterm systemic failure. Ktvus tom vacar reports from the newsroom. Reporter the study blames an overconfident and complacent California Department of Water Resources for the multiple failures but it singles out not one or no division. Reporter they said the dwr for decades ignored failures. After the 3,000foot concrete spillway failed in february, things got worse when operators switched to the emergency spillover at the dams very top. Immediately, that uncontrolled water started eroding the dams face causing a potential failure of the dam. Today the authors of the report health a teleconference says dwr is hardly alone amongst agencies that own, inspect and regulate dams nationwide. Although we are recommending the dwr look at its organization to improve, many of those recommendations apply to other dam owners also. Reporter now, thats scary because of the enormity of its responsibilities listed on its own website. Dwr protects, conserves, develops and manages much of californias water supply including the state Water Project which provides water for 25 million residents, farms and businesses. If the department of Water Resources failed in the operation, inspection and regulation of its own dam, described as a longterm systemic failure, how can we trust the inspection and regulation this very same agency exercises over its own vast other facilities as well as 1249 other dams within the state . This is the nonanswer answer to that direct question i raised. I think, you know, there are this the industry, we we weve noticed specifically, its systemic to dwr, the regulators and the industry. Um, and the vast majority of things we are finding, things like oroville dont happen very often. Reporter nonetheless, mr. For us its kind of mild and warm. We have temperatures in the 60s and upper 50s. Those temperatures will gradually well, they will gradually stay the same. They are not going to change much really. Well be upper 50s, low 60s through the weekend. I think well see a few more low 60s because of the sun coming through. You have some scattered showers out there right now. This change here on sunday brings in this next system which has a low track to it a mid latitude sort of a track which will set us up with showers sunday night into monday. That should bring some snow levels down and bring significant snow to the mountains. Meanwhile, they could see two or three feet of snow. Just two years ago, 21,000 gallons spilled into the waters off the Santa Barbara shore. Its also a big reason california promises to fight hard against the Trump Administrations proposal to open coastal areas to oil drilling. This is a clear difference between Energy Weakness and Energy Dominance and under President Trump, were going to have the strongest Energy Policy and become the strongest energy superpower. So this fiveyear plan is getting pushback from all three western governors. They will fight any new drilling tooth and nail. So will environmental groups. Now, federal waters extend from three to 200 miles offshore. If the federal government has not sold the lease in the atlantic or pacific for 33 years, which means the areas have not been mapped with todays technology. Now, there may be no oil or a lot of it. We dont know. Now, opponents say it would be foolish to even look. We already have efforts on the ground to oppose it here in the state of california. They have already at city level been resolutions put forth to to reject offshore leasing.
