police arresting a suspect without incident. he spent almost seven hours, though, barricaded inside a home on high street. lorraine blanco joins us live from the scene with exclusive video of him sur -- of him surrendering and the thing of events. >> reporter: we just saw the woman and child rescued by police. they went into the home right behind me without talking to us. they endured a long and strenuous night and morning here. police say they knew the 41- year-old suspect. let's take a look at the exclusive video of police arresting the suspect just before 3:00 a.m. he surrendered after seven hours of negotiations at this home near jensen and high street. police tell us the suspect is an ex-felon. they say he helped three hostages at one point. officers rescued a woman and her 5 why son in the ordeal -- 5-year-old son. it all started around 8:00 when alameda county tried to arrest the man driving a saturn driving on 41st. the suspect fired at the deputy and drove off as two passengers fled on foot. investigators spent the morning interviewing the hostages. but they don't believe they had anything to do with this crime. >> this will be investigated to figure out who is connected and who is not. and how this individual picked this house to go in to. >> as far as you know, you don't believe they are in cahoots with this suspect? >> no, i do not. >> reporter: and this is more video before midnight. you can see the suspect with a gun to his own head. he was telling police to shoot him. that lasted for a while until he went back inside the house until 3:00 a.m. until he surrendered. the suspect is facing felony charges. reporting live in oakland, lorraine blanco, ktvu channel 2 news. police in emeryville are trying to find the person who shot and killed a young woman. officers say they were called to a home on 47th street near adeline around 3:30 yesterday afternoon. inside they found an 18-year- old female shot in the chest. the young woman was taken to the hospital where she was pronounced dead. police are hoping tips from the public will help lead them to the suspect. this, by the way, is emeryville's first homicide of the year. 7:03. just a couple of minutes ago, the polls officially opened on this primary election day. tara moriarty is at a polling station in berkeley right new. so tara, it's early but are people showing up? >> reporter: there are some folks that have just trickled in here on shadock avenue. and to make sure your vote is counted, you must have your ballot in by 8:00 tonight. california has an open primary. in the past, the republican and democrat primary winners bo face off in - -- would face off in november but -- would face off in november but you could see them racing against each other in the end. because of the redirecting line, california has as many as a dozen hot house races going on today. those could play a big role in the democrats taking the house. one of the democratic measures is a dollar tax per cigarette pack to help fund research for cancer. there is a low voter turnout expected. only 6 million of the 17 million registered voter and this year, alameda county polling stations will be under the watchful eye of the fed. this year officials from the department of justice will be observing practices here in the county to ensure no one is being disnim crated -- discriminated against. now, there will be language assistance for vietnamese and other languages. we'll be here throughout the morning and we'll be talking to some of those voters. live from berkeley, i'm tara moriarty, ktvu the story right here on "mornings on 2." a decision today could push our state's battle over same- sex marriage all the way to the u.s. supreme court. this morning, a federal appeals court in san francisco is expected to announce if it will rehear a legal challenge to proposition 8 or send the case to the supreme court. in february, a three-judge panel for the 9th circuit court of appeals decided prop 8 was unconstitutional. the prop 8 supporters have asked for a full hearing before 1 -- before 11 judges. paul chambers will have a live report on this at 7:30. dozens of california government agencies are in trouble with the state control for failing to file public payroll figures. one example, the solano county water -- water agency. government agencies are supposed to file a report annually stating how much their employees are being paid. the administrative services manager for the water agency says she just forgot and says she won't happen again. >> i have put a reminder on moo i calendar to file the report every year. >> this is tax payer-funded positions. this is their money at work. >> there is increased focus on the salaries of government employees following the scandal in bell, california, where some city officials were earning salaries as much as $800,000. all right. time now, 7:07. some new questions about a west oakland church school. california watch is reporting some parents have pulled their children out of a private school operated by st. andrew missionary baptist church. some students claim they were verbally and physically abused, including being hit with a belt and having objects -- objects thrown at them. others say they were forced to ask for money at b.a.r.t. stations for their tuition and according to documents, they reportedly inflated numbers to correct with collect more tax money. the school denies those allegations. we want to check in with sal, see how things are moving. some of the busiest spots in the east bay, sal. >> that's right, tori and dave. traffic is going to be busy all over the place. this is really the heart of the commute. starting off with highway 4. you can see highway 4 is busy here in the bay point area. it's stop-and-go in antioch and then some more slow traffic approaching 2 had 2 and concord -- 242 and concord. you will see slow traffic there. the morning commute will be slow at the bay bridge toll plaza. that's a five to seven-minute delay. the metering lights are on. if you are on the east bay, southbound 880 from hayward to union city on that side, it's beginning to slow june just he was booked at a juvenile hall yesterday on charges that included felony grand theft and felony animal cruelty. police say they found a bloody handprint on the pig's pen and the ground was covered in blood. 7:11. outrage over government workers collecting some big bow nunses. this new investigation revealing gsa employees already investigated for misconduct. they are getting some big paychecks. a top secret mission. a plane that launched from cape canaveral more than a year ago is now scheduled to land here in california and speculation over what it's been doing all of this time is soaring. and a presidential tag team right there. why former president clinton says it's essential that president obama is reelected. this country was built by working people. the economy needs manufacturing. real. ...that make a real difference. in about ten minutes, queen elect is expected to end her four-day diamond jubilee celebration with the appearance on the balcony of buckingham palace. roger clark is in london right now taking in all of the excitement with more on the events fit for a queen. i understand people are running in position to see that queen appearance on the balcony. >> reporter: the police are moving. a million people moving so they can get a good position at buckingham palace. it's a very big operation getting all of those people down the road waiting for the queen to appear on the balcony. very, very slowly. i will tell you something, in about 15 minutes' time, you will hear a clear that will raise the roofs in london, when all of these people see the queen appear on the balcony at buckingham palace. we've had a great time these last three days. millions of people have celebrated the diamond jubile. one of the celebrations last night, was the concert. it's a concert that people will talk about for years to come. ♪ >> in was a night when pop and royalty came came face to face with -- came face to face with the real thing, some of the greatest musicians. ♪ >> as well as elton john, others playing, including sir paul mccartney, tom jones and stevie wonder. ♪ isn't she wonderful >> prince charles and the queen came on the stage at the end of the concert. the prince of wales paying a tribute to his mother, a notably absent father and then the night was hit up by a spectacular fireworks display. while the queen is celebrating, people have cheered and waved at her all across the journey. now she's preparing to appear on the balcony. that will be the highlight of the jubilee. hundreds of thousands of people are moving. look at that. all of those people moving toward the -- toward the front of buckingham palace. you know, this is the real high point. it's just such a shame her husband is in the hospital. it's such a shame. he's been her side the whole time. the palace has not given us an update about his condition. hoping he makes a speedy recovery. >> i think people are -- around the world are thinking that. the grand finale of the jubilee celebration. rock he clark, thank you. >> reporter: excellent. back here at home, federal employees under investigation are still getting big bonuses. alison burns in our d.c. bureau right now to tell us about this latest scandal at the general services administration. >> reporter: gifts like ipads were given but now we find out there's cash. a nate investigation reveals the gsa handed out $1.1 million in bonuses over five years to 84 employees who have been under investigation by the agency's inspector general for wrongdoing or misconduct. the agency has no policy to ensure employees under investigation don't get bonuses. one manager behind the controversial las vegas bash got a $9,000 bonus even after his supervisor found out about the conference. now senators are vowing to review bonuses for all fell workers. >> how many more stories like this do we have to hear before federal managers will listen, not only to taxpayers and members of congress but their own employees that they al qaeda's second in command may have been killed in a u.s. drone strike in pakistan. u.s. officials confirm that he was the target of a -- of a drone strike that killed 15 people. right now, it is not confirmed if he was killed. but pakistani officials believe his house was hit during the attack. if he was killed, it would be the biggest blow to al qaeda since the death of osama bin laden last year. a space plane will soon return to earth after spending over a year in orbit on a secret mission. it was only recently revealed that the airport was in space. the plane launched from cape canaveral, florida, last march. it's only the second plane of its type to go into space. it will land in california sometime later this month. 7:20. i was watching the clear moon, full moon. >> yeah. the court approves joe ran van der sloot's -- joran van der sloot's extradition. but there's a major catch. it's getting away ! where is it ? it's gone. we'll find it. any day can be an adventure. stephany flores. he's currently in prison in peru. peru's supreme court says he will have to compete his -- complete his 28-year sentence before he can be extradited to the u.s. the man accused of killing unarmed teenager trayvon martin in florida claims he was confused when he allowed his wife to mislead the court officials about his finances. george zimmerman had been out on band but he was ordered back to jail on allegations that he allowed his wife to misstate how much money they really had during an april bond hearing. he returned back to jail on sunday. his attorney now plans to seek a new bond hearing. 7:24. let's get everybody out the door. sal, i know you are watching highway 4. highway 24 is busy. >> here in la fayette we'll see busy traffic approaching that b.a.r.t. station. but highway 4 is slow through antioch and pittsburg. a little slow in bay point and concord and 608 from pleasant hill to walnut creek is getting busy. you can see this is backed up to 880 as i look here at the list from the chp. we did have a collision on the westbound bay bridge. it was a noninjury crash up on the span. they got it out of there but they had to turn the metering lights on. you can see the metering lights and the slow traffic at the toll plaza. and this is a look at the santa clara valley, northbound 101. that accident near de la cruz is gone. northbound 280 is also slow diamond jubilee celebration in london. we're expecting her to speak but now she's just lookingant the adoring crowds right there in her royal best and they are getting a chance to see her live. there's gonna be many other events there, including a fly- by--- there's prince william there as well and we don't see his wife there. but prince william is there and other members of the royal family. we never know where the family is gonna be as we bring you these live pictures. among other events, there will be a fly-by-of the -- a fly-by- of the royal force. fly by of the royal force. >> i understand we will be giving a rare public address. it was taped yesterday. everyone just comments on her attire. there's the wave, the classic queen wave. her hat and jewelry all very coordinated. she looks fantastic, i have to say. everyone is feeling badly about her husband not being there. they are such a strong pair and have been so much through together -- have been through so much together and she became the queen during world war ii. she's seen an awful lot of her 60 years on the throne leading britain. again, her husband, prince philip, is recovering from a bladder infection. he's expected to recover. he was just put in the hospital as a precaution. earlier the queen attended a reception and a lunch at westminster hall. it's been a busy time for her. and there was a long flotilla where a million people were crowding to salute and honor their queen. i mentioned earlier my parents are there. my mother's british. not everyone can go to the tims. but everybody had a street festival or block party. i was talking to family members and people all over the u.k. were celebrating and honoring the queen, this milestone here, 60 yee on the throne. >> that was a -- 60 years on the throne. >> that was a great shot. >> yes. a little rainy sky but that's kind of typical for britain. the queen acknowledging the flyover, a special time for her and all of her subjects if you will. if you -- can you imagine the sea of flags being waved. >> when i was there about a week and a half ago, a lot of preparations, a lot of flags being put up, not only in london but outside of london. a short shot there of some of her family on the balcony. the queen there. the last time we saw the picture of the balcony was for the wedding for prince william and his wife, the duchess of cambridge. but again, you know, a nice picture of the queen and a very colorful flyover of some of the sets -- jets there and the red, white and blue colors. you saw a lot of those colors around london and some of the street festivals that i saw some pictures of where people were celebrating. >> and in the midst of all of the pomp and circumstance -- look at that. it's wishful that her husband is there. he's been there for so many things. >> and those planes are symbolic. the 60-year reign began and when she was a teenager she helped to work on the -- on some of the automobiles as part of the work to help the military efforts in world war ii during the bombings of london. her father refused to leave london, refused to leave buckingham palace. a stiff upper lip and that was a great example she set during all of her years on the throne and she became queen at age 25 when her father, king george 6, died unect -- george iv died, although he was -- unexpectedly, although he was not in good health. some of the pomp and circumstance happening outside of buckingham palace right now. [ sound of gunfire ] >> the gun salute. >> yes. a lot of people take pictures with those guards outside -- >> i can't help you get away  without knowing how you got your name. >> victoria. i was named after the queen, tori for short. sounds like they might be singing "god save the queen." >> yeah. >> a very special moment for the queen. and her mother, queen mumm, lived over 100. she's doing very well and could still be on the thrown for many years to come. the only other monarch on longer than ther was queen victoria. >> look at that shot, tori. >> yeah. >> have you ever seen the queen with a very big casual smile. >> i've seen pictures of her. she's been on vacation with her dogs and her horses. so she -- she is not one for a lot of outward emotion. >> yeah. >> but she seems to be enjoying these festivities. it's certainly very nice to see. we wanted to take you there live, a special event to the grand finale for queen elizabeth's 60-year diamond jubilee on the throne. we're just waiting to see what band is playing. ♪ >> sounds very familiar. >> uh-huh. that's called the mall, the view from bummingham palace from the park -- kuckingham palace from the -- bucking palham queen without her husband at her side. but a lot of family members there with her as you can see. prince william there on the right of your screen and his wife on the right and prince harry and her 7:34. we want to turn it other local news right now. in just hours we'll learn what's next in the battle over same-sex marriage. paul chambers is live in san francisco where a federal appeals court will soon make a very important decision. >> the good morning. decision is supposed to come down in about two and a half hours from now. they will reconsider a february ruling that struck down california's ban on same-sex marriages. it's believed that the 9th u.s. circuit of appeal is the ma -- the majority of the judges there are expected to give the decision about whether or not to -- declaring the 2008 voter approved, it wenten to -- went on to say -- >> now, whack in february, prop -- back in february, prop 8 supporters reviewed the decision if the appeals court decision decides to hear the kay, it will go before the panel that includes the chief judge and ten randomly judges. and that new ruling could take several months to a year. if the court decides not to hear the case, it's likely prop 8 backers would appeal it to the u.s. supreme court. >> i have no -- no true belief that the supreme court will do the right thing. i feel they are a bunch of conservative monsters. i believe that same-sex marriage went out a long time ago. like all discrimination against anyone, it's wrong. >> now, once again, that decision is expected at 10:00 this morning. we'll be out here. you busier dave and tori. i want to show you san jose, northbound 280 in san jose is pretty slow now. it's slow around the corner. it gets slower as you drive towards 17 if you are gonna be driving there. in the last few days we've seen this activity and it gets better by -- by 8:30. 85 is slow approaching 17. 101 does slow after 880 in sunnyvale. everyone mooing -- moving along an taking a look at the bay bridge, we had an earlier incident. it wasn't serious. but traffic is backed up beyond 8 0. rush hour commute and we're looking at rim, westbound 580, some slow traffic getting in from tracy. but after that, it looks okay. 680 from -- through walnut creek and then 80 westbound between pin nome and richmond, unwill see some slow traffic. let's go to steve. >> thank you, sir. mostly clear, patchy clouds around. good sleeping weather last night. temperatures very, very cool. a lot of low 40s. we still have 32. tahoe, truckee. with light snow. blue canyon, and raining at mt. shasta. jose is planning on cleaning up three homeless encarmments while trying to r f live there. this is a community on water district land. city officials have already started clearing out the brush and people here think they might be next. they say they don't know where they will go next. >> i'm just grateful this place is here because i've fallen on hard times. he was grateful -- i was shocked. i trend is catching on with commuters nationwide. the reason why more people are giving up their cars. the dow is up 7. the nasdaq is up 9. s&p up 3. i want to look at facebook stock. that's down slightly right now to 26.78 and four out of five facebook users say they've never bought a product or service as a result of ads or comments on the social network site. analysts say the survey by reuters shows facebook needs to do much more to turn its 900 million users into a strong base for advertisers. that comes at the same time, 44% of facebook users say they view the site less favorably since it went public last month. right now, jury selection has started in the trial of former penn state -- state assistant coach jerry sandusky on charges of sex abuse. we're live outside of pennsylvania to tell us about the rules the judge has already -- rulings the judge has already made. >> reporter: good morning. jersey sandusky, the defendant, of course, in this case, arrived smiling with his lawyer. prosecutors are here as well. and the judge has been giving instructions to a pool of 200 possible jurors in this case answering questions. they already broke them down into smaller groups. the judge has already said they will not be sequestered. the judge made it very clear, on the other hand, that he is going to trust him and he hopes his trust is not betrayed when he tells them if they are chosen to not read any accounts of this, watch tv news, and get involved in social media, this kind of thing. so that's a very key announcement he made this morning. >> susan, i know it may be difficult for you to hear. two quick questions. how hard will it be to find an impartial jury in this community and also the big issue of the witnesses, they have to give their real names if they are making these blames against sandusky. >> reporter: in answer to your first question, it could be difficult. prosecutors from this case did not want to hold the trial in centre county where sandusky lives and the home of penn state university. the obvious reason that sandusky would like to have it here, he's among people he knows, people who know hill an his work over the years. of course, these are other people -- and his work over the years. of course, these are people as well that know of the accusations. we've learned that -- let's see. four people have told the judge that they know jerry sandusky personally. two of them know his wife dottie, who is not here this p day, and a good -- here this day, and a good number of hands went up, more than 30, know people who work at penn state or have dealings with penn state university. it will be interesting to see if these people make the cut. in answer to your second question, there is a lot of fallout and concern over the judge's decision that the alleged victims in this case will have to reveal their names during the course of the trial instead of being known by numbers. the alleged victims in this case have said they are not happy about it. however, from all of the lawyers that we've spoken with that represent these peopling they say that nevertheless they want to move ahead and no one is dropping out. susan, thank you. 7:47. well, santa clara county dive teams have ended a search for sierra lamar. the teams used side scanning, sewn -- sonar equipment at the uvas reservoir yesterday. that produces very clear images making it easy to spot anything under that murky water. but they reportedly came up with no evidence related to sierra lamar. her suspected killer went fishing the very day after sierra lamar disappeared. june 5th, 2002, then 14- year-old elizabeth smart was taken from her bedroom in salt lake city utah. she was found almost a year later, about miles from her home. the -- about 18 miles from her home. the two people who kidnapped her, they are in prison. elizabeth smart, who is now 24 years old, got married this year and recently finished college. 7:48. more people nationwide are using public transportation. the american public transportation association says there was a 5% increase in transit ridership during the first quarter of the year. b.a.r.t. says its ridership is reporter: investigators are now interviewing that suspect trying to figure out why he did what he did and why he chose this particular home here on high and jensen street to barricade himself. a mother and her boy are back in their hole. we tried to talk to -- home. we tried to talk to her but she didn't answer her door. the suspect surrendered after seven hours of negotiationing. he's a 41-year-old -- negotiations. he's a 41-year-old ex-felon. another hostage, a man was released sometime after 11:00 p.m. it all started around 8:00 when an alameda county sheriff's deputy tried to arrest that man driving a stolen saturn near 41st and international. >> the suspect fired at the deputy and drove off. two passengers fled on foot. police evacuated nearby homes and buildings and blocked off streets. >> the primary mission is to protect everyone involved. so we were able to with our entry team and hostage negotiations come down here and have a dialogue with the suspect and we were able to talk him out and surrender with the police. >> here is a look more exclusive video. you can see the suspect with a gun to his own head. he was telling police to shoot him. witnesses describe him as hysterical and crying. that lasted for a while. he went back inside the house until just before 3:00 in the morning where he surrendered. he's facing assault with a firearm at a peace officer, false imprisonment and possession of a stolen vehicle. those charges are made worse by theth -- are made worse by the fact that he's also an ex- felon. >> thank you. it's election day and will be dropping in throughout the polling stations in alameda county. why is that? >> well, the department of justice has been coming to alameda county to monitor the voting. and this year we picked up vietnamese and tagalog languages and so they came out to monitor how that process is going. >> reporter: and california has an open primary. explain what that is. this is a first. >> it's a little bit different. it's a top two primary for all of the state offices. so what it means is if you look at the race for u.s. senator, for instance, there is a lot of different candidates. they are not listed by party. so you could find out with two republicans or two democrats running against each other in november. >> reporter: because of last year, redrawing of the district lines, california has a lot of hot house races. explain why it's so important for folks to come out and vote. >> yeah, every ten years we go through a redirecting effort based on the census. so that changes the boundaries and people do get confusioned by that where they may have voted for one contest for many -- confused by that where they may have voted for one contest for many, many years and they get confused. >> reporter: what's the rule? you have to get everything in at 8:00? >> everything has to be in by 8:00. if you have your mail-in ballot, you can go to any polling place and drop it there. >> reporter: it doesn't mean much. don't listen to that. this is a big deal for both sides. if scott walker can win, it will an big defeat for organized leader. and i think both sides really believe it could give them a shot in the arm in terms of organization and momentum in november in the state of wisconsin, which we don't talk about it that often as being a swing state. i understand a lot of people are also paying close attention to what happens here in california with the open primary where the top two vote getters will go on toner. so there is a lot of interest -- on to november. so there is a lot of interest in that. >> reporter: there's interest in how the polls will look for november but the whole idea of this jungle primary has a lot of people watching. we're watching individual races bike the member/member watches in southern california and there is a lot of individual stuff. but boy, a lot of people interested to see what happens when you throw all of the candidates in oth and -- in together. will one party -- i think this could have a very, very interesting implications. when you think about all of the change that's going on in the california congressional delegation this year, it could certainly increase that and mean more faces. >> we're expecting record low turnout. is that the same around the country? >> reporter: it really is. the primary is usually a low turnout. that's what makes the top two even more fascinating to think about. if you have that very low turnout, could someone who is maybe a favorite get knocked off and get into that final two simply because not that many people are showing up at the poll. i think peel see that mostly around the country of wisconsin, though, that might be a different story in terms of turnout. >> a lot of stake there. he fell from a cliff along hana highway on sunday. the family says they parked the rental car at a dirt lookout. he fell at least 300 feet from the cliff. there's no railing along the cliff where the boy fell. 8:16. investigators say speeding, not brake failure, was the cause of a crash outside of a southern california high school. police say 18-year-old daniel carrillo was going more than 50 miles an hour, when he ran a headlight, crashed into a group of people in riverside county. he told investigators that his brakes failed but investigators say no, those brakes were working. charges could be feebled against him by the end of the week -- could be filed against him by the end of the week. and yesterday's rain is blamed for a two-car accident in pittsburg. look at this one here. firefighters spent about a half- hour cutting through the cars with the jaws of life to get a trapped person out of the wreckage. it appears one car t-boned the other on west leland road. one person worked off the job at the double tree hotel yesterday, their union says large rallies are planned for the workers in the middle of a four-day strike. they say the hotel wants to free their salaries news. police in emeryville searching for the killer -- kill of a young woman. police say they were -- killer of a young woman. police say they were call toad a home and inside they found -- called to a home and inside they found and 18-year-old woman. she was shot in the chest and was rushed to the hospital. she was pronounced dead at the hospital. this is emeryville's first homicide of the year. this morning some san francisco residents -- residents are peak waking up in corporate house -- are waking up in corporate housing. the firefighters say the fire was plumbing related. >> the fire is going through the floors and we're fighting. fire on the second, fourth, fifth, sixth floors. >> the damaged apartments cannot be lived in so far. the red cross is helping those who lost their homes woman who accused san francisco giants' star pablo sandoval of sexual assault. now, the woman making the claim is 21 years old and lives in santa cruz county. detectives say they may finish their investigation of the allegations this week. sandoval is on a rehab assignment with the giants' minor league team after broking -- breaking a bone in his hand. he's expected to continue that say signment through the -- assignment through the rest of the week. 8:35. a problem with water runoff as people in one richmond -- has people in one richmond neighborhood fet off. people in the may valley neighborhood may have been trying to get the problem fixed for years. they say the runoff causes algae to grow. it also attracts mosquitoes and it smells bad. it's apparently coming from an underground water source. right now, the city says there's just no money in the budget to fix the problem. a large wildfire in the sequoia national forest has burned 1700 acres. the fire is burning near the giant sequoia grove northeast of bakersfield. in isen area rangers say -- this is an area rangers say has not burned in 40 years. firefighters say it does not affect the trees and it's 25% contained. the cause of the fire is under investigation. and the investigation into what caused live muni wires to fall onto peds in san francisco is -- pedestrians in san francisco is ongoing. according to the san francisco "chronicle" a hub from a muni bus may have become detached. it happened yesterday afternoon at the intersection of fifth and market streets. three people were injured by arrested a man suspected of stealing a car and firing shots at an alameda county sheriff's deputy. police say the suspect barricaded himself on a home on high street. three hostages were released a.m. counting ballots. we were in berkeley at the live oak community center as the first voters cast their ballots. more than 17 million people are registered to vote in california but own 6 million are expected to vote. the lowest turnout ever. >> so there's nothing really hotly contest on this ballot. so people just don't get interested. and if you contrast it to 2008 when we had a very closely contested presidential race, we had people wrapped around the building waiting to vote. today we have two or three people inside voting. new this year, alameda county has added two new languages,
