christien. >> reporter: good morning. investigators here in pittsburg looking for the gunman that opened fire. there is still police tape in this parking lot. this is the walmart apartment on leverage road here. investigators looking for whoever opened fire in this area of the parking lot. the victim was shot right here in this area. that man was loaded into an ambulance and rushed to john mere medical center with a gunshot wound to his face and leg. 911 calls started rolling in at 11:00 last night that shots had been fired at the parking lot here on leverage road. the victim was on a bicycle and a car began chasing him around the parking lot before opening fire. witness say the shooter fired at least five or six rounds and we'ring again that victim was struck multiple times. at this time police have not released information about the victim or his condition and have not released a suspect or vehicle description. coming back to our live shot you can see there is a security car that has been rolling around the parking lot keeping an eye on things. we have calls out to pittsburg police. we are trying to find out more about the victim and also we are trying to get that vehicle description or suspect description out to you as soon as possible. we will keep making those calls. for now we are live in pittsburg. a man is recovering after being grazed in the head by a bullet after trying to escape from an armed robber. the victim was with three other people behind an apartment complex when a hooded man with a gun approached them and demanded money. the 21-year-old victim was hit in the face with a gun and grazed by the man. time is 5:02. the deadline is getting closer and closer for uc berkeley new stadium project to be finished. lorraine blanco is at the new stadium will be ready in time for the season opener on september 1st. you can see plenty of equipment in the front and fences around the opening. it must be finished to get half of the game day crowds in and out safely. crews are working 12 hours a day, six days a week to finish the renovation. that is important because season tickets have been sold already. cal says fans should not be able to now 5:04. we have new information from florida in the trayvon martin shooting case. new documents say the fbi found no evidence that neighborhood watch volunteer george zimmerman shot trayvon martin because of his race. reportedly that conclusion was reached after questioning zimmerman's coworkers friends and neighbors. the documents also reportedly show the police officers that rushed to that scene minutes after the shooting couldn't agree on whether zimmerman had a broken nose but all of them said he had cuts on his head. properties too core -- prosecutors in san francisco say a driver spinning his car in circles caused a crash that killed his friend. later today 1-year-old daniel lar rose is expected to enter a plea. police think laura was driving drunk that killed perez. laura left the scene of the crash and abandoned his car before later turning himself in. there will be another long holiday weekend without one of the bay area bridges. on labor day weekend cal tran will have a confusing report out of southeast asia. cambodian troops fired shots on the passenger jet after mistaken it for a spy plane. top official in the army says the cambodian's opened fire as that plane was circling the border this week during bad weather. thailand's foreign minister denies that report. his forces did fire at the plane but that it was a military plane not a civilian plane. and bangkok airways says it has no reports of any of its flights coming under fire. escaped chimpanzee is back in its cage in las vegas. it was tranquilized yesterday after running wild through the streets of vegas with its mate. they shot and killed the other chime banshee -- chimpanzee when it charged at them. during the escape one climbed on top of a police car and was banging on it. the new allegations against penn state administrators is being called an example of cover up culture. administrators say any attempt to hide negative news will not solve the problem. they say last year two students were sexually assaulted on campus. attacks that were immediately reported to students, faculty, and the public. the san francisco psychiatrist says the culture of cover up can be very messy. institution is to be honest. our time is 5:15. news conference will be held today by the family of a young man that died during a gun battle with san francisco police. they will be calling for a shut down of muni. kenneth harding died a year ago after police tried to stop him because he failed to pay his $2 muni fair. police say harding fired first and died by his own bullet. they plan to shut down hewn know on monday -- muni on monday to protest his death. entrench the man that was -- the man that was initially implicated in the bryan stow case is suing the police. disregarding dna test and witness statements. although he was never charged for the attack, ramirez went back to prison on a parole violation. his lawsuit is seeking unspecified damages. two other men have been arrested in friday morning. getting on to the bridges and causeways. starting off getting into san francisco with oakland it is a nice drive. i've been checking with chp and happy to say we don't have a lot going on. no major problems rob the bridges. that includes the san mateo bridge where the traffic there looks good all the way out to the high-rise. it looks good the other way around too. we check all commute directions. sometimes this could be the most frustrating when there is is a crash. this is a look at the peninsula when you get there. the traffic on 101 and 280 still look very nice. let's go system gets a little help from a low to the north and now it's a bigger fog bank because it's lifting and there is more of a stronger west wind as well. gusting now 36 out of the west, southwest at travis. boy, i will tell you. yesterday at this time it was southwest at ten. now you get gusts to 36. it will be cooler well inland today. 50s an the temps right now. santa rosa says calm. i expect them to go into the 40s here. west, northwest at sfo. there is a west, southwest 25 gusting 36 travis. west, southwest ten at vacaville. vacaville gets a sea breeze that tells you everything you need to know. these tropical clouds are so close. they are just held in check. you can probably see them off to the distance east bay, south bay. there has been some rain down in southern california. and highs today the 70s continue to push inland. 80s pushing more toward the valley. it started yesterday around the bay but the low clouds that west wind and system dropping down we topped out on the temps wednesday. still warm to hot wednesday and thursday. so the wind picks up at times. also very warm inland well inland but not as nearly as hot as it has been. most locations drop 10-15 degrees. a lot of 70s now and 80s. 50s and 60s closer to the coast and local drizzle. fog will continue nights and mornings. that cooler pattern takes us right into the weekend. italy's credit rating is taking a hit. moody's downgraded the bond rating. they stand at two levels of junk bond status. european markets are up this morning. investors focused on this mornings report that chinese growth is within was trying to walk to page, arizona to pick up money wired business his father. a 12-year-old girl in sonoma county is recovering from a flesh eating bacteria that almost killed her. missy pendleton cut her knee after bumping into a sheep stand. the cut was small but it did require six stitches. two days later she had to be air lifted to children's hospital after pain and swelling in her leg and a fever. >> i knew i had to move rapidly to keep her from having a fatal outcome. >> missy had nine surgeries and spent almost a month in the hospital. she is now in physical theory and hopes to build >> i would say about 95% of the forecast area. some locations vacaville sometimes lake county can take another day after everyone else has cooled down. for most it will be cooler today when travis gets a southwest wind gusting to 36 miles an hour. that means they will drop significantly. here is sal. >> steve, good morning. westbound highway 4 is getting busier. it's not stop and go yet. it is little slow already though through antioch. not through bay point or concord. as we look at interstate 80 westbound that traffic is moving along pretty well. it's 5:30 let's go back to the desk. the wrongful death lawsuit trial of convicted killer hans reiser it could wrap up today with closing arguments. alex savidge is live in hayward. >> reporter: it was an unusual comparison hans reiser representing himself in his wrongful death trial that gets under way rater on -- later on today. his two children are suing him for damage. reiser's testimony took a strange turn when he compared himself to moses. saying he killed his wife to stop her from hurting his two kids. in 2008 the software engineer was convicted of killing his wifeny that reiser. he admitted to choking her to death. his two children seeking $15 million in damages to compensate for the loss of their mother. now following his conviction, reiser eventually led police to his wife's body in the oakland hills in exchange for a reduced sentence. he's now serving that reduced sentence 15 years to life in prison. his kids now 11 and 12 are living with their grandmother in russia. testimony is expected to wrap up later on today here at the hayward hall of justice and each side will have one hour for their closing arguments. we are live this morning in hayward alex savidge. time is 5:31. there was gunfire overnight outside of a pittsburg walmart and one man was shot. witnesses say the shooter was in the car chasing after someone riding on a bike. the shooter opened fire. that victim was taken to john mere medical center. he had been shot in the face and leg. we are not sure if the victim was a shopper or not. so far there is no reports of anyone else injured in that attack. a three-year-old boy was critically injured after he was hit by a car in vallejo. he darted in the street between two parked cars at 7:30 last night. the boy suffered head trauma and air lifted to oakland children's hospital. police say a 52-year-old man was driving the car that hit the boy he was not arrested. he is cooperating with investigators. time now 5:32. san francisco mayor ed lee is firing back at suspended sheriff ross mirkarimi. mayor lee is denying allegations that he committed perjury at last months misconduct hearing. the mayor testified he did not offer the sheriff another job if he resigned. >> i think there is concerted effort to steer him off track with individuals that want to claim something and divert the attention way. >> mirkarimi's lawyers are asking the ethic's commission to subpoena four witnesses who they believe will prove mayor lee lied. the commission will consider that subpoena request next wednesday. schoolteacher has surrenders to police. the santa clara county district attorneys office say a student reported inappropriate conduct with a teacher but that principal lyn did not tell authorities. the teacher craig chandler went on to molest another child. he faces charges of lewd and mollifies acts. the county wants to use $2 million to add 150 beds for inmates. it will accommodate a growing population. opponents say the money would be better spent on programs that deter people from committing crimes. 5:34. what if you could predict a traffic accident before it happened? san jose police are trying to do just that. coming up at 5:45 the new technique the police department will use to try to save lives. san jose fire department has received an $8.6 million grant from the feds. the money will allow the department to hire 27 new firefighter recruits. the san jose mayor chuck reid will talk about that grant at an 11:00 a.m. news conference today at the san jose fire department training center. he will be joined by congressman mike honda and congresswoman zoe. 5:35 is the time. sal is keeping an eye on the commute from our brand new newsroom. >> yeah. i've always been in the newsroom. >> yeah but newly remodeled. >> yeah. but you haven't been able to see it. i used to be sitting looking that way. now i'm sitting here and they can see the newsroom behind me. it's kind of cool. let's take a look at what we have now. the traffic is going to be okay on highway 24 as you drive out to the caldecott tunnel. there is no major problems if you are driving at the speed limit. i think you should be at that speed limit for a good long time. thus is a look at the bay bridge toll plaza. this traffic looks pretty good as a matter of fact. no major problems get into the city and steve says the fog is not quite not really a problem today as it was yesterday. yesterday it was lower on the deck. today not so much. we are looking at the commute here in hayward and castro valley now on 580 near five canyons parkway which runs underneath 580 almost right underneath interstate 508 there is an injury accident there. if you use five canyons parkway you will be effected by this. this is just off east castro valley boulevard. thus is right under-- this is right underneath interstate 580. at 5:36 let's go back to the steve. >> thank you, sal. good morning, everybody. the fog which is really just got squashed and sat there on the coast keeping the heat on the coast. it finally started to lift a little bit yesterday. not a lot. mainly around 500 feet to 5,000 feet. higher fog bank, west wind. it's not roaring inland. the sea breeze at travis is up to 36 miles an hour. i mean that is turbo charged. 50s for everybody here instead of the 60s. livermore at this time yesterday was 65. they are 57. that is a big drop. some of the higher temperatures inland you get up around 2,000 feet they are down around 8-10 feet. along with that stronger sea breeze a south, southwest at concord. i tell you the -- there is rain down in southern california. we'll only get some of the higher clouds here south bay and east bay. you can see them but they are not going to make it. 50s and 60s and 70s and 80s maybe a couple low 90s. it takes vacaville another day to cool off. when vacaville gets the southwest wind it tells you it will cool down. cooling will continue not only today but into the weekend. windy at times but not as warm as yesterday. temperatures around the bay 60s and 70s. and inland 80s and a few low 90s. with your weekend always in few it looks like a cooler pattern will take us into next week. next weekend looks like on the cooler side. time now 5:38. giant star tim lincecum the pressure is really on. why the unthinkable could happen if he has a bad game tomorrow. >> a monthly art gathering in downtown last ang -- los angeles turns violent. >> good morning, northbound 280 traffic looks good as you head into the west valley we'll tell you more about the morning commute and the bay weather. ♪ ♪ ♪ [ male announcer ] what's the point of an epa estimated 42 miles per gallon if the miles aren't interesting? two children are suing him for emotional damage. firefighters working out to get the upper hand of this wild fire in plaster county. it's almost doubled in size burning almost 80-acres. last night a outdoor art event erupted in riot between police and occupiers. the occupiers scribbled chalk messages on the sidewalk. police tried to keep demonstrators from blocking the street when a protestor tossed a bottle. when police moved in the other occupiers started pelting them with rocks. a gas leak caused a fire that shot flames 40 feet in the air in st. louis, missouri. it was caused by a piece of construction equipment that hit a pipe. some people that live in the area say they had been smelling gas for weeks. no one was hurt though and no homes were damaged. time now 5:54 4:. word from investigation two separate bombings today killed a nato service member and a local official with the afghan ministries of womens affairs and her husband. the service member was killed by a roadside bomb in the south. no other details right now. the afghan government says the official with the administrate industry of women affairs they were killed when a bomb blew up in the eastern part of that country. yesterday was the deadliest day in the 16 months since the uprising started against the government. they report 287 civilians killed across syria with more than 200 of those killed in a government attack on one village in the province of ahmad. the head of the u.n. observer says his teams can confirm government forces waged an attack in that area. the federal government is using a new tactic to crack down on california's medical marijuana industry. the government is pressuring landlords to evict marijuana dispensaries saying the properties are being used to distribute illegal drugs. harbor side health center is being evicted. so is the vapor room in san francisco. barbara parker released a statement about the government crack down. she wrote in part i'm deeply dismayed the federal government would seek to deprive californians of this vital medicine. 5:44. oakland police have few leads in the city's eighth homicide in one week. we first told you about this story yesterday morning at 4:30. investigators say a 19-year-old woman was shot in the head inside a room at the starlight motel. some of the people staying at the motel say they heard gunfire and heard screaming about 3:00 in the morning. a friend of the victim tried to give her cpr but she died there at the scene. there are extra police patrols in north richmond after four people were hurt in two separate shootings. the first one happened at 9:30 yesterday morning near first street. three people were shot. then 30 minutes later a fourth person was shot about seven blocks away. investigators believe the shootings are connected and gang related. san jose police want to predict traffic accidents before they happened. the department has hired a math professor from santa clara university from analyze accident patterns in the city using alga rhythms. the method is being used to predict theft in santa cruz, morgan hill, and los angeles but has never been tested on traffic accidents. >> instead of looking at where accidents have been, we are looking for patterns in the data to predict where they will occur in the future. >> team of officers will use the predicted policing method in september. in six months they will figure out if it's successful. >> we have learned the power is back on for customers in san francisco. last night pg&e says more than 10,000 people lost power in the western edition, eureka valley, and laurel heights neighborhood. but power was fully restored by 11:30. tim lincecum is pitching tomorrow for the giants and it could be a make or break game for him. if he has a third straight bad game, giants may give him a little break. general manager brian sabean told radio station knbr they may skip lincecum's next start. he wasn't talking to supporters
