a recorder conversation between the captain and the port authority. pretty damning stuff in there. what's happening right now? the captain is being questioned. and new this morning, the number of the missing much higher than we first reported. >> and, also, in politics, when you're the front runner, it's like you've got the bull's eye on your back. that would be mitt romney where rick perry and everyone else, rick santorum, all gunning for myth romney. the race is tight. we're going to break it all down for you. >> you're going to have to dig a little deeper when you fill up this morning. the highest january gas prices. could we see $5 gas this summer? >> and if you're about to pour some o.j., think about the folks picking the o.j. where did the oranges come from? because if they're from brazil, we sent our reporter there to find out just what they're spraying or putting on those oranges to fight diseases and it ain't something that our country likes. not one bit. we'll tell you more about that in just a moment. >> we're going to begin this morning with breaking news on several fronts in the ieal january cruise ship disaster. the italian navy blasting a hole in the ship. watch the lower left of the screen. the blasting of the this hull will allow search teams to enter and exit the cruise liner more easily. >> and, also, we've got some just phenomenal pictures that have been coming into cnn from our crews around the world. look at this. divers underwater. if this isn't harrowing, imagine these divers having to smash windows to swim into the hull and get through hallways clogged with debris. there are now 29 people who are unaccounted for. and that's obviously the first mission of those divers. but in the meantime, they were still able to uncover the first black box. it's already providing a a lot of very important information about just what happened when this cruise liner ran aground. the italian coast guard says it has also located the second black box. divers actually trying to get their hands on it. >> more break news here. we have the transcript of the recorded conversation between the port authority and the captain. this is from the italian newspaper. port authority, concordia, we ask you if all is well there. concordia responds all is well. it is only a technical failure. port authority, how many people are on board? 2,300. >> port authority says how come so few people. the captain says no, i am not on board. we've abandoned it. >> port authority responds what? you've abandoned the ship? no, i'm here. >> port authority says you must return on board, climb the ladder, assuming the rope ladder, return to the fore stem, that's the front of the ship and coordinate the work. captain schettino goes on and they say you must tell us how many people are on board? how many women? how many children? you have to coordinate the rescue operation. commander, this is an order. now i'm in charge, you've abandoned ship and now you are going to the step, again, the front of the ship and coordinate the work. there are already dead bodies. >> and schettino replies how many. >> you should be the one telling me. do you want to go home? now go back on the stem and tell me what to do. schettino okay, i'm doing it. the newspaper reports the captain never went back to the ship. >> now, we're not clear whether that's cell phone transmissions or radio transmissions, but that news paper is a bona fide newspaper. really just remarkable material. you can bet your bottom dollar that that is going to end up in court. we do want to get you up to speed on what's happening now. that captain who steered the ship into the rocky italian coast is about to go before a judge and be questioned today. he says he just hit rocks that weren't on his charts. cnn has been in the courtroom and she's joining us now on the line. so many questions. i think just give us the run down on the first thing that's happening in court with regard to this captain. >> that's right. the captain is in court right now. he's sitting in front of a a female judge whether that's going to make a difference or not, we don't know. but he's with his lawyer and the prosecutor who has very damning information against him right now. but his lawyer is going to focus on getting him out of jail. this captain has been in protective kus day sharing his cell with two other local inmates since his arrest on saturday. he wants to get out of jail. his lawyer is going to aplay for his release to house arrest or another form of protective custody because he's emotionally unstable. he suffers the pain for all of the deaths and, you know, people's lives who are destroyed. so this, today, is a very technical hearing. the lawyer or the captain is going to try to get him out of jail. and then the judge is going to ask a few questions based on the previous investigation. so far, that's about a hundred crew members and passengers that they have interrogated over the course of the last 72 hours. the magistrate is expected to ask about a half a dozen questions and then make a decision whether or not to keep the captain schettino in jail or not. >> now, barbie, we're just receiving these transcripts right now. are they going to be using these transcripts in court today? >> these transcripts are part of the investigation. and the lawyer for schettino is as going to try to stop further publication of these transcripts because he feels his client is public opinion. it is, theoretically, illegal to publish transcripts during an on going criminal trial. but it does happen quite frequently. and we've seen that. this is a very reputable newspaper and these transcripts we've had confirmation from tr prosecutor where the court is being held that those transcripts are bona fide. whether or not they'll get into the details of those transcripts in terms of the questioning of the captain today, that we won't know until after this hearing has ended. it's expected to last less than an hour, we're told. and then the lawyer will make a brief statement to reporters gathered here after the hearing. and then we'll know about a court calendar and we'll understand whether or not captain schettino will be remanded in custody or whether he'll be able to enjoy the investigation in his own private home. >> while they're assessing what we would call bond or bail hearings, i'm curious to the list of charges that could be in the works for him, multiple counts of manslaughter and 28 missing at this point. ship wreck, which is also a charge under italian law and then abandon ship, which, as i understand, and correct me if i'm wrong, can carry up to 15 years on itself. with that transcript that we were just talking about, it sounded pretty clearly of an admission of, no, we abandoned the ship. it's keeling. >> exactly. and i think by design, these charges are meant to carry the maximum weight possible that abandoning ship and ship wreck, ship wreck, which is a charge that carries at least three years on itself. that is like if you're in an automobile accident, it's the maritime equivalence of that. it's his fault is what they're saying. but the abandoning ship is a serious maritime offense. and that's the one that they're going to look at. i suspect that these transcripts are going to be crux of that investigation. again, the italian port authority ordering the captain back on the ship. it's going to be hard for any defense team to defend a captain on that. the port authorities got those transcripts. it's every conversation between the port authority and the captain of the ship recorded. this is a no contest document, basically, or transcript. so this will all be used against him. the manslaughter charges are six dead so far, but there are 29 or 28, the numbers may have changed. >> we have 29, yeah. >> 29, i stand corrected. 29. >> 29 still missing. so this -- >> keep us apprised of what transpires in court. this is fascinating, especially with these transcripts that have come. barbie nadeau reporting live. >> every morning, we give you an early start to your day. wisconsin governor scott walker could become just the third u.s. governor in history to be recalled from office. today, his opponents are expected to submit 540,000 signatures, that would be enough to force a recall election. walker reforms. ten min uts passed the hour here. we'll be watching europe very closely this morning after standard and poors downgraded many countries. >> when you start talking gas prices, that's when i really pay attention. >> and gas prices, there's a forecast out there that they could go up to $5 a gallon. and that's probably the parts that are like chicago, california. absurd. >> and they've been moving up here. and what's really interesting is there's a couple of thicks going on. you've got brazil, india, china, they are competing with the u.s. for supplies around the world. you've also got the concerns we've talked about with iran and all of the sort of the rabbling that the iranians are doing. and you've got people talking about going into the springtime and the summertime that you could see prices going up. i want to be very careful about forecasting gas prices because i think it could be unpredictable. i hope you can see this. the darker it is, the more -- the higher the price is. and then when you look at gas prices by a state, when you look at how much you spend on your income, when you put income and gas prices together, you can see that in the south, people spend an awful lot of their income on gas prices. mississippi, 14% of their income is spent on gasoline. the darker, that's gas prices and percent of income, look at where all of these primaries are coming up, guys. you're going to have politics playing out in a place where people spend a lot of their money on gasoline prices. >> is that just gasoline? >> that's just gasoline. because they pay less for heating oil and stuff because it's the south and a little bit warmer. but this is what we're going to be hearing a lot about. when people are paying more for gas, the economy becomes that much more important, even though people are saying that the economy is very bad, still eight out of ten saying poor, somewhat poor, not going in the right direction. so gas prices will be okay. and 47% approve the president's handling of his job. that's pretty much steady. i any in november, it was 49%. but when you start talking about gas prices and long term unemployment, these are some of the challenges that we hear about. >> $5, that's outrageous. i know you don't like to talk about specific dollars. >> i know. i know. >> and it does. but that's why i just think it could be a little unpredictable you're going to have to show me mungo hair. >> all girls know what i'm talking about. >> i'm feeling you. >> yeah, it's mungo hair. that's the word of the day, my friends. >> it is 16 minutes past the hour. we do want to get you up to speed on some top stories because we've been getting a lot of developments overnight. the italian navy is blasting a hole into this ship to allow the rescuers to get access because, of course, it is very difficult for those divers you're looking at to get in at the listing angle that that ship is at. right now, captain of the costa concordia, he's in a courtroom to answer some serious charges related to the grounding of that ship. 6 people dead, 29 unaccounted for, including two americans. >> in syria, opposition groups say 13 people were killed by government forces. >> if you were watching the debate last night, all of these candidates, look at them looking right at mitt romney. and there's a good reason for it. the bull's eye was on that man. newt gingrich, rick santorum, everybody going after mitt romney. and look at him laughing it all off. the front runner hoping to seal the deal on the gop nomination trying for that victory in saturday's south carolina primary. before the vote, the candidates are going to take part in our big cnn debate. it comes across your screen right here on thursday. john king is going to be involved in that. it will be the best of the 17th and, by then, debates. >> let's start with that. mitt romney's rivals trying desperately to take down the republican front runner. it's a tight race between gingrich and romney. perry says to romney, show me the money. >> mitt, we need for you to release your income tax so the people of this country can see how you made your money. >> my record is out there. proud of it. and i think if people want to have someone who understands how the economy works, having worked in the rereal economy, that i'm the best that can best oppose barack obama. >> in case you missed it last night, jamal sprks imons, from charles ton, south carolina, cnn political editor and from little rock arkansas, former communications director for the michelle bachmann campaign. last night was some of the most contentious exchanges. does romney need to release his tax returns in order to stop all of the asking? and my second question would be if he does, is it like president obama releasing his birth certificate? >> well, like he said, time will tell if he actually does do that. that was certainly big news of the night. but more importantly, what we did get out of this is we were able to show that romney was able to withstand all of the attacks that came out throughout the night. he did unvail a good more details of his job creation plan, which is important for the people of south carolina. currently, they're looking at an unemployment rate of 10% and far above 8.5 pbt. that's what they want to hear about. they want to hear what the candidates can do for them. they want to see what they can do. and a lot of the candidates did very well showing how they will help not only create jobs, but, also, how they want to reduce the income tax. so that was important that came out of this debate. whether or not this was a game changer for the candidates that were trying to secure the consistent conservative anti-romney vote, time will tell. but certainly gingrich came out of this very strong. he certainly shows that he is a fantastic debater. but more than anything else, romney was certainly the guy out there with the target on his back. and he came out of this very well. >> so, jamal, let's talk about that. the washington post called newt gingrich the winner last night. let's listen to what he said on jobs creation and then we'll talk about it. >> all unemployment compensation should be tied to a job training requirement. if somebody can't find a job -- [ applause ] -- and they show up and they say, you know, i need help, the help we ought to give them is to get them connected to a business-run training program to acquire the skills to be employable. now, the fact is 99 weeks is an associate degree. >> so ellis was just talking about the fact that this is a contender. you tweeted out last night newt is fuevo. what do you think? did he move up here? >> i think for that crowd, listen, i don't like much of what newt gingrich has to say, but for a republican crowd, they seem today really react very positively to him. i want to go back to what you just asked about mitt romney's tax returns. my experience working on campaigns, if it was an easy answer, if it was nothing in the tax returns to worry about, they would have released them a long time ago. there's a reason why mitt romney is delaying letting out his tax returns. he's delaying it to april hoping that the primary season will be over. people should ask for those tax returns sooner rather than later. >> paul, why don't you weigh in on that and then we'll talk about gingrich reestablishing himself. >> again, this has been a bone of contention. >> speaker gingrich, i already said at our last debate that anything that's false in "pac ads" whether they're supportive of me or supportive of you should be taken off the air and fixed. i've already said that. >> all right, sorry about that. we wanted to discuss super pacs a little bit later. >> it's early. we'll give you guys a little leeway. >> all right, paul. >> super pacs were a huge topic in this debate. romney, right off the bat on the defensive, about 20 minutes in, former senator rick santorum of pennsylvania hammering mitt romney as well over a super pac that's criticized santorum overvoting rights for former felons. romney was put on the defense there. it was the first time i saw romney kind of out of his game since our debate in las vegas. santorum really got into romney easter toir there. and. super pacs, a huge issue in this campaign. so much has changed compared to four years ago. but all of these campaigns, i think, are guilty in some ways when it comes to super pacs. >> but as a candidate here, you really can't go in and tell the super pac what to do or whatnot to do. they're kind of all guilt, right? [ male announcer ] want great taste and whole grain oats that can help lower cholesterol? honey nut cheerios. a chemical fungicide is raising questions about whether you need to be careful about the o.j. you're drinking. >> i will tell you what the fda is saying. we'll take you right to the source, talking to orange growers at a plantation in brazil. you're watching "early start." hi, everybody. and welcome back to "early start." it's nice to have you here with us. >> it is 5:29 in the east. so let's get started here. time to check the stories making news. brand new video of rescuers in italy carrying out controlled explosions to blast holes in the capsized cruise liner to actuallyactual ly allow firefighters to enter parts of the ship that have not been searched yet. breaking within the hour, authorities releasing new taped confers between the captain and a court official. >> and a big debate last night, mitt romney and his finances. tax returns, to be exact, under attack at the republican debate in south carolina. rick perry demanding that the gop front runner cough up the tax returns. he wasn't really answering to that. and in the latest cnn poll, newt gingrich is running neck in neck with governor romney in saturday's south carolina primary. >> democratic union officials plan to submit over half a million sug thattures today. this was after gutting collective bargaining powers for workers. >> the big story that we've been following throughout the evening, the captain of that capsized cruise ship in italy is in court as we speak. all of this as we have some incredible infrared video from the italian coast guard as they fly over that lilting ship. take a look at these pictures. you can just see those black dots along the hull of the ship. those are people on the side of a ship that looks as though it is sinking. and for all intense and purposes, it is dark to them, it is cold, they're clinging to the side of the vessel. you can see the gash in the side of the hull. look how far down that one person is to the base of the hull. these are people who have no idea if there are lifeboats anywhere to be seen or if rescuers are going to make it to them. but it is remarkable to see how many of the 4,000 passengers on board that ship were at least able to scramble to the upper side of the hull. >> it's really tough for the relatives, i would imagine, to take a look at that. we have some shocking transcripts showing the conversation between the port authority and the captain. so this is from the italian newspaper. and this is after the captain reports just two to three hundred people are on board. port authority says how come so few people? are you on board? schettino, who is the captain, says no. i'm not on board because the ship is keeling. we have abandoned it. >> port authority says what? you've abandoned the ship? schettino replies no? what? abandoned? i'm here. >> also new this morning, the italian navy is blasting a hole into the hull of the ship to allow search teams to get in and out of that cruise liner more easily. >> and also getting a look of what it was like inside the cruise ship after it struck the rocks. you know, they lost the electricity and the lights are all out, passengers and their life vests waiting for direction. >> and some of the images that are just remarkable inside the ship, there are equally remarkable images outside. look closely. that dark part of the hull shows a massive gash. if you're wondering how big that is, 160 feet long in the side of the ship. obviously, that's why the ship started taking on water. so much still to be known as to why it was listing the other way and which compartments filled and which didn't. 29 people still missing. they are searching for them. but we do know this, at this point, 6 people are dead. >> and among the missing, two americans. >> two americans who are on their lifetime retirement trip fwr the midwest. lauren moore was one of the people who was on board the costa concordia and she joins us on the phone now. >> i can hear you. >> you're back home? >> i am. it feels great to be home. >> i bet your family is es at theic that you're okay and back in their arms. >> they really we are. they brought a huge crowd to the airport. it was really nice. >> i had goose bumps just hearing you say that. just take me into that ship for a moment if you will. i get the idea it was passed 9:00 in the evening. just three hours since the ship went off for the voyage. lots of people at dinner. what happened? walk me through it? >> sure, i was at dinner when it happened. we had a late seating that night at dinner. and we heard the initial impact sitting there and it sounded like someone made a comment that was that an engine blowing? and all of the sudden, we heard plates and dishes and dinner ware just start hitting the ground. and it started shattering. and the boat started leaning. and it just didn't stop leaning. skbr just right away? right away it started to keel? you started to notice that the dining room you were in was on an angle? >> oh rkts right away. everything just started sliding off the table and just started shattering and people started getting up and running out of the dining room. >> did you know right away what was happening, lauren? >> not right away. the first announcements that came on overhead were, "ladies and gentlemen, please stay qualm. this is an electrical problem. >> did you believe that? >> you don't know what to believe. i've nevada never been in a situation like that. other people were grabbing life vests even though we hadn't been told to do so. after the boat started leaning so badly that it was coming difficult to walk and it was making me seasick, me and a friend realized that we've got to find a lifeboat. we have to get out of here. >> and remarkable that we're finding -- that even as you were into this voyage, there's still 24 hours legally before they have to give you the lifeboat drill. that had not happen. we were looking at some pictures that were so harrowing, they were infrared pictures as all of these passengers were scrambling to the high part of the ship. did you ever get that feeling that no matter what happens, walk up, walk up, get to the top part of the ship? >> yeah, and i was actually -- when we went to the lifeboat, we went to the part of the boat that was leaning up that was facing sky. and i guess it's just natural instinct to walk up and you don't think about that until you're in that kind of situation. and that's the way we went. >> did you see these people? we're seeing on our screen these people who seem to be clinging to the side of the boat as it's over on its side. did you see it? were you among them? >> i was luckily, and i didn't know it at the time, luckily, some of the first people off the ship. and this was what we're looking at was far into the night when so many lifeboats had already left and taken people to the island. and these people are some of the last people that did not manage to find a lifeboat in one of the first evacuations. >> so my guess is you're at home and you're able to see some of these images now, knowing that you were a part of all of this, are you able to sort of come to terms with what you're seeing on your television screen knowing that you were there, you were in that and there are still 29 people unaccounted for? >> it's so terrifying. and seeing that infrared image with those people right there, it's just -- i'm so lucky. those people, i don't know what i would have done if i had been in that situation. and i didn't realize at the time how lucky that i really was and even though i was in that horrible situation. but some of those people never made it out. and those people were clinging to the side and i just -- i feel so blessed in the situation that i was in. >> god bless you, lauren. and we are very glad that you are home and safe. and the best to you and your family. >> thank you so very much. >> i get chills just thinking about that, what she was going through. >> yep, 37 min uts passed the hour here. we have a mes sang from the food and drug add minnesota strags. the orange juice in your fridge, they say is still safe. last week, the fda put temporary freezes on all orange juice imporpts because they put shipments in from brazil. they halted all the shipments. >> i suppose just to be on the safe side. some of the first orange juice shipments have now been cleared. some small business owners, though, are a little bit worried and saying, hey, made in the usa is always a real good label. u.s. imports a lot of its o.j. from brazil. and some of those fif you think ge siets there. >> i'm glad you went to do this story for us because we've been getting our orange juice from brazil for a long time. why are we just now hearing about if you think ga sides that are not allowable here. >> that's a very good question. and that was actually something that the growers asked me. i went out into the state and they say they've been using this for 20 years. that it's allowed not only across latin america, but across all of europe. and they say they didn't even know that the united states started to ban its use in 2009. now, the good news is there are alternatives. and these guys say they want to keep the american consumer happy. they're willing to use the alternatives. they already rotate some of those alternatives in. they don't want to lose this market. they'll do what they have to. >> how long does it take to cycle this if you think fun ja side out of the oranges? >> well, they used it, they rotated it with others. but it's there. the latest crops that they're pulling off of the trees that we went to see, they've already used it on those. this crop won't be available in the united states if they decide that they can't have any, even the lowest levels. but the next crop, the oranges that are already blossoming, well, they won't use it if that's what it takes. brazil is the single biggest exporlter of orange juice in the world. they count for 85% of all orange juice exports. but they say that this market is important for them. they don't want people to feel unsafe. that by 2013, they can have a crop without this. >> wow. i have a question. was this just a random testing that happened on this? [ male announcer ] new glucerna hunger smart. you know what's exciting, graduation. when i look up into my student's faces, i see pride. you know, i have done something worthwhile. when i earned my doctorate through university of phoenix, that pride, that was on my face. i am jocelyn taylor, i am committed to making a difference in peoples lives and i am a phoenix. >> good morning, chicago. it looks dark and a little bit cold. it's 40 degrees in chicago where you're just waking up. >> i miss you guys. >> and very sad to see these pictures without her smack dab in the middle of them. >> no, that's not true. i'm happy to be here. but i miss my hometown. >> you ear expected to go up to -- or go down to about 36 today, as well. boy, the craze over products. electronics. apple products in particular created such a frenzy in china, fake apple stores are popping up everywhere. they're selling black market ie dell phones. >> the workers in the stores are wearing the blue shirts. apple decided we've got to suspend the sales in those stores. look at the pictures. other stan brandt sent these to us a few days ago. they were egging the store. they were actually attacking the security personnel there. oh, look at that. >> so stan grant is live in beijing. now they're banning all iphone products. >> reporter: yeah, that's right. good morning. what they're doing here is taking the iphone 4s off the shelf. those picture that is we sent to you last week, they were taken as they're trying to launch this new iphone. what happened was there were hundreds of people waiting outside the store. amongst them, gangs of scalpers. now, what these people like to do is get into the store, buy up all of the stock, therefore, depriving the normal customers and flip it for a profit on the black market. well, we decided to follow the money trail. we went back through checking out some of these gangs of scalpers. we found people hanging around outside the official apple store who were trying to sell these black market goods. then we found fake apple stores themselves. they look like apple stores. they have the same logo. they have the staff inside. all of the products are real. but they're selling them for sometimes up to 20, 25% higher prices than you would normally pay. so who pays in the end? the ordinary consumer. but they love their apple products so much, they're prepared to cough up the big bucks. >> are they able to fan out and police all the fakes? >> it's really difficult. it's so hard to track things down. they're angry about it. that's why they wouldn't sell the product the other day. they saw how many people were outside. that he're concerned about these ska scalpers. they don't endorse these fake stores. the problem is, though, when they run out of stock, where do people go? people have to go to these fake stores. they have to buy them at premium prices. i was just in the main apple store, the legitimate apple store today and it was reamed by security. so much security inside the store, keeping an eye on the scalpers to make sure that they don't get inside and try to sell to customers there as well. they're really grappling with a column of smoke. you get ahold of it and it moves. >> all right, stan grant, live in beijing for us. thank you for that. 47 minutes passed the hour here. an online store, zappos, to be specific, was hacked. 24 million people affected. the personal information is now compromised. we're going the tell you how to protect yourself. we're opening. you're watching "early start. [ male announcer ] and there you go, business pro. there you go. go national. go like a pro. top of the morning to you. it's nice to have you here with us. it's "early start." i ashleigh banfield. >> i'm sor bzoraida sambolin. >> we've been so busy collecting breaking news overnight. the captain of the ship that's listing and taking on water, passengers are missing still. we're starting to hear some of the things he was saying to the port authority over reported conversations. you will not believe some of the things he actually mentioned to them and how they responded. the italian coast guard has also recovered the the first black box from that shipwreck. mitt romney has the target on his back in myrtle beach. south carolina primary is just four days away. it is a tight race between gingrich and romney. are you feel that pinch when you go to fill up your tank because if you aren't, you mustn't be looking at the numbers flying by on the pump. these are the highest gas prices in january that we've ever had. could we see the $5 mark this summer? great possibility. we'll get into that in this program. first, though, the braces news. we've been getting a lot of information tlud our worldwide organization overnight. a closer look at that terrifying time the passengers inside that stranded cruise liner on its side were trying to escape the rising waters on board when that vessel ran aground. all of this new. first, let's get you to the video from the italian coast guard. remarkable. flying over in the helicopter the infrared images show all of those passengers just clinging to the side of the vessel. you can see there are hundreds of them. they're either waiting to get off, waiting for word of what to do, looking for life boats or figuring out some way just to escape the rising and very cold waters. take a look more closely as the video continues to move. you can see the gash in the side of the ves. also new, the italian navy blasting a hole in the ship. this all actually allow the search teams to enter and exit the cruise liner more easily. right now they are looking for 29 people who remain unaccounted for, including two americans. >> we're starting to get the sights and sounds inside that cruise ship as well. look at the images. passengers recording this as the emergency lights come on and the power goes off. you can see the passengers yelling to one another. they're wearing their life vests. but obviously there doesn't seem to be that mad race at this point. many passengers reporting they were confused and they weren't getting a lot of direction. but look at that. just walking calmly by. remarkable. >> he was saying in spanish checking to see if everything is okay. 29 people are still missing. at least six people are dead. this morning, we're also getting a first glimpse into the very disturbing conversation that were happening between the captain and the port authority. this is from a respected italian newspaper. concordia, we ask you if all is well there. concordia, we responds. all is well. it is only a technical fag ur. port authority, how many people were on board? >> captain, 2 to 300. >> a little surprised by that number. there were about 4,000 people on those vessels. how come so few people? are you on board? the captain says, no, i'm not on board because the ship is keeling. we've abandoned it. >> what? you've abandon doed the ship? >> no, what, abandon? i'm here. >> port authority says, you must return on board. climb the ladder, the rope ladder. return to the foer stem and coordinate the work. the captain does not reply to that. the port authority continues, you must tell us how many people are on board. how many women, how many children. you have to coordinate the rescue operation, commander. this is an order. now i'm in charge. you have abandoned ship and you you are going to the stem and coordinate the work. there are already dead bodies. >> the captain responds, how many? the port authority, you should be the one telling me this. what do you want to do? do you want to go home? now, go back on the stem and tell me what to do. schettino responds, okay, i'm doing it. the newspaper reports the captain never went back on the ship. so also happening this morning, the captain who steered the ship into the rocky it italian coast is about to go in front of the judge to report. dan, is he in court right now? at first we reported it was going to be at 5:00 eastern time. >> reporter: yeah, he's in there right now. it's important to point out this is not a court appearance as you would understand it in the states. here in italy, though, there's an investigating prosecutor who coordinates all the information and decides how to proceed and what he's doing at the moment is effectively questioning the captain. he has not been formally charged yet. he's being questioned. and then charges may follow by the looks of things almost certainly will follow from the information you've run through there. so he's in with the prosecutor now this morning. we didn't get a shot of him going in. he went in a side door. and apparently, according to some reports, this transcript with the port authority is being deliberately leaked despite his lawyers hoping it wouldn't be. obviously it casts him in a pretty bad light. as you mentioned, giving the impression that he was completely -- didn't have a grip on the situation, basically, the port authority shs as y, as you incredulous that he was apparently trying to abandon ship and ordering him to get back on board and take charge. it's a further sort of damning piece of evidence that's come out in a whole string of evidence over the fast few days, including people here on the island talking about the ship going way too close. we can clearly see from one of the photos that we've got in a system, a huge chunk of rock in the ship show that it hit that rock. we've been out on the water to see where it was. it is very close to the land, indeed. it's frankly pretty staggering as to why he went so close. his own employers, cruise -- costa cruise seems to be laying the blame pretty much squarely with the captain saying there would have been alarms on the bridge of this ship telling him not to deviate from the proper course. >> dan, if you can continue monitoring the developments for us and let us know what happens, we appreciate your time there. >> makes you wonder if family members of the missing have come to the island wait for word as they do in so many aircraft disasters. you see family members come. >> i would think so. >> hope for word. incredible. let's switch gears here. hard to do. 6:07 in the east. with four days to go before the south carolina primary five remaining republican candidates took to the stage last night for the first of two debates this week. >> that picture that just went by, that was pretty much how it went. they were all surrounding romney. gingrich and rick perry, zeroing in on the front-runner. rick perry actually saying right out there, where are your tax returns? how about releasing them so we can take a look. governor romney, newt gingrich decided to turn the focus on unemployment instead and president obama. >> we actually think work is good. we actually -- we actually think saying to somebody, i'll help you if you are willing to help yourself is good. and we think unconditional efforts by the vast food stamp president in american history to maximize dependency is terrible for the future of this country. >> gingrich would tie unemployment benefits to mandatory job training. u.s. markets will open today after being closed for the holiday yesterday. u.s. stock futures are looking up after they lost half a percent across the board on 23ri. >> and normally i'm always thrilled to have the lovely and talented christine romans standing beside me so i can ask a question but she's hiding behind the -- >> crazy thing. >> have you ever seen the tax code? this is the capital gains, this is the tax code in is a only small part of the tax code. h is the tax code. we have it here in 16 different books. this is the american tax code. everything from your mortgage interest deduction to employee benefits to capital gains, and the president's competitiveness counsel, his jobs counsel today, we're expected to hear more about what they're hoping to do in terms of, you know, simplifying the tax code and lowering corporate taxes. this road map to renewal, a draft of this was obtained by reuters. reform the tax code, cut the corporate tax rate, but expanding domestic drilling of oil, also perhaps how to boost manufacturing, how to boost education education and innovation. i think that all goes together if you have a good public school system in this country, that fosters innovation and a very vibrant higher education system which then helps jobs and all different kinds of jobs and manufacturing and the like. we'll see -- in heels, you're like 5'10". so now you know the taxes over there. >> only someone like ali velshi and i would have tax code tucked underneath their desk. >> we are zeroing in on capital gainses tax for a reason? >> no, i randomly picked that book. it's been a big part of the republican proposals on the campaign trail. some of them want to have no capital gains taxes at all. they say that it's unfair, it punishes success. we'll see that. >> you tend to wonder though when there's that much material and steve forbes comes along, let's simplify it and have a flat tax. >> we have a big country that's complicated and different and dynamic. obviously we need a lot of different kinds of rules and guidelines. but what we're going to hear, i think, from this panel that the president has been talking to is it's too much. some of these work across purposes. everyone wants to simplify the tax code. everyone does. it's like saying you love your mother. but how do you do it? red, white, and blue, american apple pie. and the election, you had asked me this. i found something out about u.s. markets during election years. >> you always tell me people hate uncertainty. >> election years tend to be good for markets and last part of an election year tend to be better than the rest. we looked back in recent memory 178 years. >> using your recent memory. >> and found on average the dow gains 5.8% in election year. 29 times it's gone up. 15 times it's gone down. interesting, a couple of recent memory has been complicated. in 2000 rare year when the s&p fell, because we didn't know who the winner was, remember? so that was uncertainty. 2008 was the worst election year in the history of the world. we can look at all of this broad history, 178 years. >> and toss it. >> but recent history has been complicated. there you go. that's just a little trip back to 1833 for you this morning and with all the tax code. >> and you got up at what, 3:00 in the morning, fed the baby and came in? >> it's the way the mind works. thank you very much, christine. we appreciate it. >> remarkable. thank you for that. so recess is over. in just a few hours a house of representatives are actually back in session. we have live pictures at the capital. members of the senate return next week. >> they have their work cut out for them as well. remember that whole payroll tax cut we were talking about before the holidays? the stop gap thing is over and the deadline now is february 29th. they've go got to come up with some kind of permanent solution. is your paycheck going to change? if you make $25,000 a year, it's going to be an extra $42 a month at stake. $50,000 a year and you're talking an extra $83 a month if you make $100,000 a year, good on you and your savings would be $166 a month. congressional correspondent kate balduan is live in washington, d.c. kate, this was really ugly before the holidays and i don't suspect for a moment, my friend, it's going to get any better. is this a more serious deadline we're looking at now than before the holidays or could we have another stop gap? >> they're both very serious deadlines. this is when the thpayroll tax t will run out which many say is an effective tax increase. the center of the bitter battle we're talking about back in december. for many of our viewers who hung with me through that very partisan fight, they're going to probably be rolling their eyes a bit because the beginning of this next session is a little bit of here we go again as the house comes back in and senate will be coming back in. they're going to be starting this new session with a little bit of last year's business. payroll tax cut extending it, whether or not to extend it and for how long, that is, of course, front and center and will be top of the to do list. when congressional negotiators, they will be getting back in town. 20 congressional neg gators that will be picked to spearhead these talks, they will be getting right down to it right away along with congressional leaders. if last session is any evidence as well as just what a political football, this payroll tax cut issue has become, i would not be surprised at all if this went right up to this coming deadline which is the end of february. >> well, you know, they listen to the people, right? they would know that those $83 a month really mean something. i pulled some of the folks who actually chimed in on our website and $40 will cover my son's school lunch for the month. $40 is a pack of diapers. that's nothing when you have two little ones. are they listening that this is really effecting folks and they have to come up with a resolution? >> folks on capitol hill say they are listening. they of course then point the finger at the other party saying that's the reason why things are being held up. if you look at the recent -- at the most recent cnn poll approval rating of congress it's hit a new low. i don't know how much lower congress' approval rating could go. i think there's kind of obviously a bit of a difference between are they listening and are they acting. and that's kind of part of the fight coming forward. so the house comes back this evening. the senate comes back next week. a lot of issues to take up right away. and we'll, of course, election year politics will be centered stage and be part of all of these -- all of these efforts going forward. >> will it ever. kate balduan, clever lady, thank you. >> obviously, that's what president obama has been possibly thinking of doing, is centering that campaign against not the opponent but against congress with an 11% approval rating. might be a good policy. coming up, lots more for you including all the highlights on the big debate and whether mitt romney can zero in on the tea party and when t-- win the tea party over. and do they count as an entire lot? because as i understand, there was no vote, there was no endorsement, it was a very big meeting of people who are somewhat disseparate. what did you accomplish? >> the whole point of it was to bring tea party people in south carolina together to network with one another and to find out how they can be more effective going into 2012. they used to debate last night and the election that's coming up this weekend to leverage and to spring from that. it was great. it had over 600 registrants. it was an absolutely wonderful event for them. >> so i'm looking at one of our most recent cnn polls of tea party support in south carolina. it sort of breaks down like this. governor romney gets 31% of tea partier support while newt gingrich falls behind at 20%. you know what, i'm looking at a different poll. i'm sorry. i have different numbers up here on the screen. let me read the ones from the screen. romney has 32% while ring s santorum at 20%. gingrich has 23%. kind of out of order. you know what i'm getting at though. what i wanted to really ask you about is, while those numbers are always fun to follow, i always get the impression when i hear you all speak that you are very different people and you cannot be considered a voting bloc. do you like that? do you want that to continue? would you prefer to have more power as a larger authority? >> well, what i think is really important to focus on is the fact that all of the candidates right now are talking about the core values that the tea party movement has been talking about for nearly three years. fiscal responsibility, conversations stug ali limited government and free markets. even governor romney who implemented romney care in massachusetts has said he would repeal the government-controlled health care as a national level. so they're all stalking at the issues we've been talking about. and in that sense, the citizens do have the power. >> all right. well, let me ask you this. i know that ron paul did show up at your event, but apparently there was some scheduling strangeness and he ended up leaving before really being able to speak. but he sure did speak last night on that fox news debate. i want to play one of the comments that he made about foreign policy. and then i want to ask you about it on the other side. have a listen and particularly have a listen to how the audience responded. >> maybe we ought to consider a golden rule in foreign policy. don't do to other nations what we don't want have them do to us. so we -- we endlessly bombed these countries and then we wonder why they get upset with us? and yet it continues on and on. >> all right. jenny beth, if he was making those comments at your actual convention, would we have heard all of those boos as well or does the tea party sort of fall into line somewhat with the idea that foreign policy can sometimes be very, very expensive? >> absolutely can be very expensive. so from that standpoint we do pay attention to it and look at it. and the things that ron paul talks about with forry policy, it does raise questions among the tea party people and it sparked a lot of debate. debate is healthy in this country. it makes us make sure that what we're doing is the right thing. and if it's not the right thing, how can we do it better? >> zoraida, first, let me tell you that i know all of these candidates. i've known them for several years. i think there are great qualities about all of them. i think when the bain attack started, particularly coming from the gingrich campaign and perry campaign, i felt like it sounded like obama stump speech than belong in the republican primary in this day. so i just felt like it was a big mistake. i don't think class envy is going to work in south carolina. i don't think neither of these candidates believe what they're saying which means they have no understanding of free market capitalism or they don't believe what they're saying which means it's just a desperate ploy to get votes through class envy. i just don't think class envy belongs in a republican primary. >> rick perry has stopped mentioning bain in his speeches. so why not support him now when you clearly agree with him on his other points? >> well, actually when this started i felt like that both of these candidates, romney and perry, were strong candidateses, great records. i've known governor romney for four or five years. i've known governor perry a little bit just recently. i do think he has an outstanding record. i think when you go into an election and you start to use class envy as kind of a desperate measure to get vote, i think it just says a whole lot about your campaign and i don't think that's what america is about. look, we've got a general election coming this fall. the general election is really going to probably be about class envy. it's going to be about whether american can be the land of opportunity or the land of envy. and that's what this general election is probably going to be about in the fall. but we don't need that in the republican primary. >> but south carolina in particular are very conservative state and a lot of romney's competitors are comparing him to obama. so we're going to let you take a look at this attack. it was released by rick santorum. when we're going to talk about that. >> obama supported the wall street bailouts. so did romney. obama gave us radical obamacare that was based on romneycare. obama's a liberal on social issues. romney once bragged he's even more liberal than ted kennedy on social issues. why would we ever vote for someone who is just like obama? >> so there's the question, right? when you compare the two, when you have a socially conservative state, how do you come to terms with choosing a mitt romney? >> well, look, south carolina ask a rough and tumble state. we've got a reputation, they say when the iowa caucuses are over, everybody in south carolina grabs a knife or hatchett or ax and throws it and when the prime is over you try to look to see whether any of them stuck in your back. know it's going to be tough if front runner is always being attacked. let's look at the bain record. when you look at the bain record it's a record of outstanding performance. just look at staples. you've got 89,000 employees there. i know there are some individuals that are being on television right now who lost their jobs with companies that bain had invested in. but look at the success stories. those 89,000 people are stories, too. they're stories of people who photo work, you have to apaycheck, go back and take care of their families. they're in the communities. they serve their communities. they put braces on little susie. those are stories, too. i think before this campaign is over we're going to hear a lot of success stories of bain and those are the stories we out to be talking about. $25 billion of profit were distributed to investors while governor romney was at bain. who were those investors? no, i'm not run for anything. i can't promise to lower your gas. >> she said $2 gas and a lot of people are saying, yeah, $2 gas if we have a massive financial crisis or recession. that's how you would get such low gas prices. a headline catch ourg attention overnight in the newsroom from cnn money and i'll tweet this out if you follow me, $5 a gas is what some economists are forecasting. few reason, modestly recovering u.s. economy, demand from china and brazil and india and other places in the emerging markets that are doing very well or at least better than the united states. and also these concerned about the strait of hormuz and maybe the iranians threatening to close off this vital shipping lane for oil. so you're looking at gas prices rising. we already are. some are telling me $3.50 is a gallon likely. others are saying in some spots it could be as high as $5. that would be probably chicago, that would be california, any place where there are a lot of taxes. to say that there's an average gas price in america is like saying there's an average temperature. it isn't. this is the one indicator, the one number that i cover that more people comment about and are effected by because every single week put your -- you fill up your gas and you feel it and it's extra money you spend filling up the tank you're not spending on something else. important thing to watch. >> hormuz may go away. we have these diplomatic problems and they surface and get fussy and go away sometimes. but china and india ain't going away. those demands are going to continue to get bigger. does that mean we is k. expect expo then shall gas prices? >> the other thing is economic recovery and how the economies are recovering is very important. slow steady recovery in the u.s. means more demantd fors gasoline and the like. if you have weaknesses or slow in china you could have less demand other than is forecast in china. remember, we're pulling out, i think, gosh, 89 million barrels a day we're using. every drop of oil a day we're getting out of the earth's crust we're using somewhere in the world. this is a very vital component. it's felt differently around the country in different places. i'm going to show you a chart of gas prices and how different they are. the darker you see here is how much high ter gas prices are by state. and then this next blue chart i'm doing to show you, the barker the blue here is, that is how much of your income you're spending. let's talk about south carolina for a moment, shall we? very apropos. >> 12% of their income is spent on gas. florida, 10 % of their income is spent on gas. ten cents of every dollar spent to fill up the tank. that is why this really importance week-by-week-by-week numbers become a political number as well. >> folks are struggling. it's hard to share this information. the only positive side, if you are plan for summer, you get a heads up. >> take all of the heavy stuff out of your trunk. go to aaa.com and find ways to low ur your gas price. big debate whether you should be using the window or air conditioner. it doesn't matter right now because it's 28 degrees. >> or you could drive a smart car. >> do you? i don't have homework today. it's what's right here is what is most important to me. it's beautiful. ♪ ♪ we like to get you the faces behind the front pages. in wisconsin today this big story developing. folks there are collecting signatures to try to recall their governor, scott walker. on the phone is the chairman and the face of wisconsin's democratic party, mike tate. mike, why, what's the problem in wisconsin that you want them out? >> good morning. thanks. you know, there has been a lot of reasons why we think scott walker has to go. remember last winter, almost one year ago, scott walker passed what's known as act ten, which eliminated all collective bargaining rights. basically it was a dead end union bust. he never talked about that during the campaign. he then went on to the largest cut in the country to public education over a billion dollar cut, public education. he had a raid on the university of wisconsin system, he passed a photo id bill that is the most restrictive in the nation. probably going to deprive many people of the right to vote. you know, fundamentally, he just didn't tell the truth about what the agenda was when ran for governor. governing in the way that helps the top 1% and not the hardworking families here in wiscons wisconsin. >> we heard the recall would cast a million dollars to effect wait and in the end it still goes to election anyway. the last time he was up for election, the margin was about 5%. so it was fairly close. what makes you so sure that he isn't just going to win again and then you're out the 9 mil in your state?
