>> oh no, oh no. i don't put any kinds of -- there is no value in any of those things there is a same kind of freak out after my debates and in fact i might say i had more difficulty than the president didn't hear him right now having this conversation. i would really like to remind everybody watching that right now biden is a one and trump is still zero he is the only person who's ever beaten trump. i really believe joe biden will do that again despite all of the democrats wetting the bed over that kind of thing. shannon: editor at your position is will be able to watch and see this incredible recovery for you. you've gotten consistently better and better. but a lot of folks appointed president biden say if this is a matter of age in a matter of ability that is not going to reverse it so different than your situation? >> well know of course we both had a difficult debate and yet we still manage to go on to win. everyone was calling that was the end of my career that it was the end of this race everyone was predicting i was going to lose by two points or more. and i smoke him by five points on that is what i am saying. one debate is not a career any more than donald trump 38 convictions for felonies are not going to define his reputation and his presidency. that is why they are both here again. it is the same year conversation i said this in 2016 is going to be very close. i said this in 2020 and i am saying it consistently through this race now. it's going to be very close just for clarity 34 he is awaiting sentencing will be covering that on july 11 the head of the convention. please talk about the president being able to win but is that the only measure here? do you have any worries he can actually govern if he do doesn't win for four more years? >> i don't. i have watched them for the last four years he's done incredibly good things. he got us through that pandemic. over a million americans lost their lives through that and look at our economy. ours is the world's envy economic kinds of power. look at the stock market but look at all these other metrics people were calling it was going to be a recession and here we are now blooming. the president's done a really good job and he deserves a second term i really do want to be clear is going to be very close i have said this before and that is not going to change and progress our latest polling we did in pennsylvania specifically because it is such a bellwether important state for any candidate who wants to try to get to the white house showed it was a tie are less pulling had at 48 even for both of these men had to head slightly different look when you bring in third-party candidates. but you mention the economy so i want to bring this up. in pennsylvania when asked who would do a better job on foreign policy, on the economy, on immigration and the border specifically in pennsylvania and they gave wide margins to president trump so how do you see that playing out in your critical state? >> the only poll that's really going to matter is election day the polls a change in the inverted and my race as well and here i am as united states senator and i just got back from israel a couple of days ago. that is what i want to remind everybody one debate does not define a person's record for the kind of person or the situation certainly not about an election that is four and a half months ago. >> was talk about your trip to israel you met with a lot of top leaders across the political spectrum but i want to start with prime minister benjamin trend when you spent time together he had great praise for your unwavering support of israel. i want it what your assessment is to be talked about his perception of support for the biden administration clearly them in very public tensions and some differences what was your conversation with him on that point? >> it was an honor to spend time with him as well he is a democratic elected leader of our key key ally i had the opportunity to literally meet everybody in leadership. i've met idf soldiers i have met university students across the spectrum. i really wanted to make sure everybody we stand with israel throughout all of this. i have disagreed with the president through that and i have shared that that is why there is the pictures i have had the opportunity to meet everybody and remind everybody we need to stand with israel through all of this and is going to get more and more difficult. we also want to make sure we bring back all of this and i cannot possibly support any kind of a deal for peace as long as hamas cannot be in power in any of that hamas needs to be effectively neutralized before there is any kind of peace. shannon: there is a left wing of your party more progressive that differs with you on that they are asking for totally different things pointing the blame at different places. they've been very vocal. are you worried about how that might impact present biden's ability to shore up the democrats and win reelection knowing the other voices are calling? some of them have a movement called band and blinded for their support him in the past aanother actively campaigning against him. >> that whole abandon biden thing is the dumbest thing i've ever heard. if you are more inclined to vote for a democrat or be exempt after willing to walk away from joe biden you are helping trump in that is really it is, if that kind of movement has that kind of move and they went to play with that kind of fire they better earn that burn. and now especially because people have turned their backs on joe biden. now, it's going to mean sure everyone is going to be all hands on the deck. and that continued to talk about this is a very stark choice. what kind of president you want for the next four years? what you want to talk about? the thing these men are excesses one is rebuilding america and taking us in a better direction or donald trump who is obsessed with revenge has been very clear he is here to be retribution and i do not believe the president they should never be a weaponize against the people in this america who happened to disagree with you. shannon: we know you are in the middle of a lot of diverse divisive heated conversations, senator per thank you for taking time with us it's good to have you. >> thank you for having me. shannon: german ohio republican senator jd vance. senator you hurt your colleagues saying president trump is about division and about revenge, your response? >> if you actually watch the performance of president trump in the debate that is not what it is about at all. it's getting the country back on track. bringing prosperity and peace back to the world stage and actually having a leader who can sit in a room with other world leaders and do the job as president. if you look at just how the two candidates performed, obviously joe biden had a disastrous performance which is whether talk about replacing him. you have to look at what donald trump was able to do showed commands of the facts he was a funny, he was engaging, is pushing back a little bit but doing it with a good natured demeanor. that is what you need to be able to serve as president of the united states and the contrast with joe biden who seemed to be unable to complete a sentence. i'm not worried about their debate performances, shannon, i am worried about what did these guys look like in the world stage? which of that look like in private meetings with world leaders and clearly donald trump shows he can represent our country well in that form joe biden showed he couldn't it was a remarkable contrast but this is not about division this is about prosperity. how do we get wages rising how do we shutdown the border and stop a world where everything seems to be on fire under joe biden's leadership? the very joe biden we also out the debate stage a couple nights ago. shannon: 's team says is showing up for the september debate the surgeries questions whether president excuse me president trump will is there any conversation he would not show up for the second debate? >> look and think donald trump is going to do is the best interest of his campaign because him winning is what's in the best interest of the country. i would donald trump to make the decision whether he is going to the september debate speak clearly the debates have been very good for him and i think a next debate would be very good for president trump because the contrast is remarkable. we have to ask ourselves not how these guys performed at the debate but how could joe biden possibly do the job of pairing against world leaders? how could anybody think having seen donald trump on the debate stage that he could not do the job. obviously he could and that is ultimately what the debate really showed we have two candidates one who cannot do the job one who has failed to do the job that is joe biden donald trump of both could do the job but has already done it successfully. we have a remarkable choice for the american people i am so glad i'm on the side of the guy who is actually done the job well and showed the debate he could do it again. shannon: it or you are among those who set you want a president biden to stay on the ticket that there people who voted for him and that's what they owed the democrats who have supported him all of those delegates were heading that way we know this a growing conversation pushing them out we know it today at camp david he is having a conversation with his family he was told it was a preplanned conversation meeting with the children and grandchildren of course the first lady but it raises speculation about the conversation. nikki haley is out there were in the trump campaign needs to be ready for change she said this the wall street journal they are going to be smart about it they're going to bring in somebody younger per the going to bring in someone vibrant they're going to bring in someone tested. we note voters have told us in polls across the board they do not like this rematch. what happens to the preparation, the strategy for president trump's team if you join the ticket or don't if they get somebody who has better favorables, younger, more likable and it got a new opponent to get ready for. >> i actually don't care if joe biden is a democratic nominee because donald trump is the republican nominee the contrast between republican policies under donald trump and whoever the democrats ultimately end up with is very powerful. but i do think as it would be incredible insult the democratic voters to have this primary process that was effectively rigged in favor of joe biden and then at the last minute when joe biden has a disastrous debate performance try to switch him out but who are they going to switch him out with? how could they possibly offer a good contrast to the guy who brought prosperity to his own country and peace on the world stage? the problem is not joe biden had a bad debate. the problem is democratic leadership over the last three and a half years has led to a war in europe, wars in africa were in the middle east and potential war in east asia not to mention sky high inflation every single one of the possible democrats who could run for president they all supported the policies that led to that inflation. i'm not worried about their party i am focused on our own party i think we have the best candidate to make the case if you elect us if you give donald trump a chance at the presidency he is going to bring back the peace and prosperity that is all we want is an america back on track for donald trump delivered it once he's going to deliver it again. shannon: let's talk f foreign policy talk about that how important is to any commander-in-chief president biden said president trump would withdraw from nato he says he would tilt vladimir putin and has told him just do what you want that's a quote when it comes to attacking nato members despite obligations what is president trump's position on staying in nato and coming to the defense as agreed under article five should someone be attacked? >> the first of all the democrats argument is so inconsistent with reality russia took territory under the bush administration it took a territory under the obama admin's ration took territory under the biden administration. it took zero territory under the trump administration because of vladimir putin actually respected donald trump and he has not respected any of these other clowns. that is the most important thing when it comes to putin's aggression in europe and the democrats arguments are absurd. on the question of nato what trump is said very clearly is your past to step up. america cannot be the policeman of the world. want nato to be a strong alliance. we do not want nato countries to beat welfare cli claims of the united states in vladimir pu putin's a significant threat to putin the germans have to step up, the french have to step up they need to do more for their own security. i think that argument lands not just with a lot of americans but with europeans. they are not our clients and want nato to be a strong alliance but for that to be the case the europeans and got to step up or is there any scenario there is an attack on a nato ally and we don't show up? >> look, shannon, we're going to honor our treaty obligations donald trump has been very clear about that but what donald trump is also been very clear about is that europeans have to take a bigger role in their own security. and by the way that's already had an effect. compared to the trump administration donald trump effectively applied pressure to them. another trump administration i'm working hard when you see more and more europeans taken a bigger role because they respect trumps leadership and also recognizerecognize trump is sayy clearly you guys have got to carry your fair share it's fair to america it's better for europe, it's better for the whole world for the europeans to step up that is the republican position it's different from the democrats position they have effectively told the europeans american taxpayers will float your security indefinitely. america's other things to focus on china, our own domestic problems europe is got to step up and that is a very important distinction between donald trump and joe biden. shannon: have got to go but senator any announcements you like to make before you go? will release its opinion on presidential immunity would have a direct impact on the federal criminal cases now pending against president trump but let's break it out there legal panel fox news contributor george washington university law professor jonathan turley author of the new book the indispensable right free speech and age of rage. also in our panel because cause additional accountability center president elizabeth wydra crisis president carrie severino clerked for justice clarence thomas but welcome all of you with that would not be sold during the end of the term right now but we are going into overtime. let's talk a little bit about what with got this week the active federal regulation how far regulators can go it came to the court in the context of these fisheries that said if yi you're going to put monitors on our boats and make us pay for them that is too much regulation but here is megan from one of the fisheries, they won their case. >> i am a static. we finally have a level playing field. american citizens finally have the same rights in court as the united states government. that is huge is going to make a huge difference in our industry and in every industry going forward. shannon: kind of wonky every industry this is a major impact for quick huge impact on citizens across the country we live in the so-called age of regulation. this doesn't level the playing field this came after the court ruled that citizens deserve a jury trial when they are facing fines. this really changes everything but chevron is dead as dillinger now it means the judges will go back to doing what judges do and interpret whether this is a reasonable approach of an agency to this law. it's going to have a huge impact they were going to be more lawsuits and more importantly citizens are going to have a real chance now to say i think this interpretation is simply wrong courts will have to look at that freshly. shannon: justice kagan writing for the dissent said this every current federal regulation expects courts from now on to play a commanding role for saw a role congress has given to them. >> actually not at all what it says the courts the real experts in interpreting a law or going to affect interpreting law. when it comes to how to enact that regulations the regulators can still do that that is their expertise. when the question is what does this law allow you to do? that is a court we do not let the regulators say this law your representatives to the past gis us way more power than the words essay the courts get to read the laws with then the regulators co their job within the realm that was given to them by congress they cannot go outside that now. >> elizabeth a lot of this gets back to congress if you pass laws ambiguous if it will at the regulatory state take care of it how much does it mean more work they've got to do on capitol hill? >> exactly. the point was of course if congress enacted a law the agency was working directly to the act that's always been impermissible but congress rights legislation that has to cover a lot of different things for a long period of time like the environment is a perfect example. they write broadly worded statutes at times that are filled with gaps, ambiguities that have been filled by experts in the agencies which are politically accountable because they are appointed by the executive, the elected executive the president of the united states is a massive shift of power from these and politically accountable actors to the court and it affects americans on everything from the air we breathe, the food we eat, the safety of our workplaces, civil rights, health care you name it affects every aspects of americans lives. shannon: i agree all lawsuits we are all lawyers edge of that's good or bad thing but more lawsuits are coming i went to touch on the fisher case generally six defendants of this obstruction statute applied to me came in the wake of enron and its member financial crimes of it is not rightly applied to those who showed up at the capitol generally six. the court said there is not a proper application it was flawed for this could potentially impact hundreds of cases including president trump. >> this fits squarely in the courts a precedent on things like this if you've got a list of a type of thing and you say and otherwise do that it has to meet along the same lights it's like if you had a football regulation that said you cannot pull or twist their helmets or otherwise harm them does not cover trash talking or stabbing them it talks about things you do to their equipment in this case they are saying the sarbanes-oxley act which is about destroying evidence and blocking evidence and things does not have to do is broadly speaking anything you could do to interfere with the proceeding just has to be something to do with evidence it's possible that will cover sunday january 6 defendants we do not know what the government cannot use that to shoehorn in a million other things and that is what it said in other contexts as well because you have disagreement, elizabeth? >> it's an interesting lineup would justice barrett with two more liberal colleagues and said the text is the text especially the textual list and originalists and judges should file the text where it goes and yes it is broad. clearly congress intended it to be broad when you corruptly obstruct an official proceeding as is alleged in the january 6 indictments, then that applies but also justice jackson again the interesting lineup in her concurrence with majority said because the official proceeding we are talking about on generally 6000 of the certification of the election that does have records and documents even under the majority's view of the law generally six defendants charges could still go forward. quick. immunity is a big one coming tomorrow. welt heard the arguments, we have read the briefs them it and whatcomes after decision da. >> if you follow the oral arguments the expectation many of us had is the court was clearly uncomfortable at the extreme views of either the trump team or the lower court the trump truck team is a sweeg virtual immunity the lower courts give very little protection for presidents going forward they were bothered by both of those. one of the justices said were writing for the ages here. they have not clearly established where this line has been so everyone is trying to obama's rush on the court saying where's the opinion? where's the opinion? this line is critical in determining where article two begins and ends on some of these issues. as of the expectation is they may come up with a nuanced view and send this back. that is important because if they send it back may prefer the trial court to determine what here was part of an official function? that will take time and the clock is ticking. many of us doubt the court can do that but have a trial before the election for. >> quick comments are both of you? >> what he think we get? >> the timing is key here trump might loose on the merits or because of the delay in issuing the opinion essentially be handed a limit of the supreme court for. >> i think exactly as jonathan said they're going to come somewhere between absolute immunity for anything and no immunity for anything this kind it were the trump team moderate its position by the time got to the supreme court. personal acts don't get immunity for official actually do which is good news for president biden, president obama, other >> it's interesting in 1800 we had an election were thomas jefferson ran against john adams on free speech. john adams had prosecuted his political opponents. some of the opponents of joe biden are clearly ready to do that now that would possible repeat. adam's loss that because is correct that of free speech. many view joe biden as the most insight since because of the elaborate census system
