the president's 53-year-old son is attempting to dodge is a house subpoena. now, hunter's lawyers say that their client is willing to only appear for a public hearing before house of representatives, not a closed door deposition as the law requires. now, if you or i orders receive a subpoena from congress, we would be forced to comply or we would be facing possible jail time. but hunter seems to think he's above the law. now, well, i wonder where he got that impression from. maybe it was the attempted sweetheart plea deal with david weiss or david weiss, allowing the statute of limitations to pass. or maybe is daddy's doj running out the clock on many of hunter's serious tax violations or hunter's ability to purchase massive quantities of drugs and hire foreign with zero legal consequences whatsoever? or possibly it was all that money that hunter took in from america's geopolitical foes like, you know, russia and china and romania, etc. while his father was in a position of great power and great influence all while apparently not paying quite a bit of in taxes and on a lot of income. and that has to be resolved. and all of this will work that he has zero experience in at a time where he was admittedly addicted to drugs. but while the very liberal and biased and politicized and weaponized biden, doj drags its feet. the republican house is taking action. contrary to what democrats would have you believe. the gop's impeachment inquiry into joe biden is very serious. oversight committee chairman james comer, who will join us in a moment, is investigating legitimate claims of corruption through closed door hearings, financial forensics and other inquiries. hunter, meanwhile, is attempting to turn this into a political charade with a public hearing. but still, comer is more than willing to give hunter his circus. but first, that door deposition would still be required as ordered, including the way documents handed over. that's the subpoena. hunter must comply. of course, this is all part of hunter's big new, what they're calling legal strategy to fight back. according to politico today. four years as hunter biden faced a protracted criminal probe, he was told to cooperate with prosecutors and wait quietly for exoneration. that strategy favored by veteran failed. so now he's, quote, directly taking on his adversaries with lawsuits and other legal threats. now, some might call call this a campaign of intimidation to others it might look like desperation. according to another report, white house staffers, they are extremely irritated with hunter for clearing this new strategy with the biden white house and democrats on capitol hill are also unhappy with two unnamed lawmakers calling hunter's new offensive strategy all risk, no reward. this comes as one of hunter's friends is worried that the democrats are now eager to use the president's son as a sacrificial lamb in this case. the big question tonight, is hunter willing tell the truth about his father or is he willing to maybe take on the fall himself? and for republicans and other logical people around the country, while this scandal is not really about hunter, about hunter's struggles with addiction, this is about the big guy. in other words, the real brand. and that would be joe biden, who allegedly used his struggling son to up the family coffers. was was hunter, for example selling access and influence to that biden brand so that jill and joe biden could afford this beautiful beachfront estate in delaware. live in luxury on a senator salary. and according to james comer paid ten family members what ends up to be tens of millions of dollars. middle class joe and his wife, well, they love to portray themselves as living a middle class lifestyle, but it appears that image was not quite accurate as joe was buying expensive corvettes and again, that beachfront property. >> and now let's see what the bidens do. >> are they ready to are a subpoena? my understanding is of your subpoena. you want a closed door under oath deposition and you want materials handed over. is correct, sir. >> that's correct. this is a normal subpoena. this is a normal congressional subpoena. it's a lawful subpoena. we have asked him to come in on december 13th. his attorney said today that he would gladly come in, but only for a public hearing. he'll have a public hearing after we do the deposition. this is the way credible investigations are conducted. and hunter, hunter, joe biden is not above the law just because he's gotten away with criminal activity by the doj, the fbi, the irs, the national archives, doesn't mean he's going to be treated that way by the house oversight committee. we're going to abide the law. jamie raskin's, the ranking member on the house committee, did this exact same process here. this is a very similar scenario with steve bannon when he was subpoenaed by the january 6 committee. he wanted to come in not for a deposition, but for a public hearing. raskin said he had to sit down for a deposition because that's what the law requires. that's what we require of hunter biden. we will gladly have a public hearing with hunter biden after we do the deposition to go over 10,000 plus pages of bank records and, documents that we have with with countless questions about specific transactions. >> do you do you need more documents? have you been requesting more documents? have they been forthcoming with the with the banks have been very forthcoming. the banks wanted to give us this information. look, the banks notified treasury years of criminal activity by the biden family. so the banks the private banks have been very cooperative. who hasn't been cooperative? are the biden is the biden administration. we've requested all the the pseudonym emails we the number of emails that joe biden used a fake name grows almost on a basis. we've asked for those emails. they've provided 14 pages. there are thousands more pages that they haven't provided. we need to know about that because. we know there was communication between the white house, between you, when joe biden was vice president and hunter biden and his even though joe biden claimed numerous times on television had a wall between his the government and his family shady business activities. we know now that there was no wall there, that joe biden used a fake name to get around the four year requirement. so, so normal investigators. couldn't find this out. we worked very hard on this investigation over the past eight months on, as you know, we built a mountain of evidence. now we're in the deposition phase. and that's what the subpoena for hunter biden was all about, a deposition to sit down, the democrats will get equal time. and it is, for all practical purposes, public we will release the transcripts. we will do. this the way every congressional deposition has been composed in history. and the american people will know exactly how hunter biden entered these questions in the deposition. would he have the right to plead the fifth? well, i mean, everyone has the right to plead the fifth. but, you know, according to hunter biden's attorney today, he wants to come forward. and i think that's great. give him an opportunity he's going to have due process. he's going to be able to answer some questions. but this isn't about hunter biden. this is an investigation by congress of joe biden for potential corruption. hunter biden is a key witness in our investigation of joe biden. we know the biden family has received millions and millions of dollars from our enemies around the world. we don't know what they did to receive the money. we don't know a lot of things about how the bidens have been able to afford such lavish lifestyles. when really don't know what they do for a living. hunter became an artist. yeah, but you became an artist when joe biden became president. well, we do know that hunter admitted himself that he had no experience in energy, oil, gas or ukraine, but yet he was dealing with burisma and his father took actions as as vice president withheld $1,000,000,000, leveraged that billion dollars, get an investigative prosecutor fired ,and in 6 hours the guy was gone. the investigation's over. hunter got paid. and this was five days after you have been able chronicle a phone call that came from hunter from dubai with burisma executives. is that correct, sir? that is correct. and we learned all that through a transcribed interview. and that's what we want hunter biden to do to come in for an interview. everyone knows that if you have a credible, substantive investigation, you have depositions, you have transcribed interviews, then you bring in people for committee you agree with me. abbe lowell is a real deal. he got off. senator menendez, he got off john edwards. he was jared kushner's lawyer. the guy is probably one of the top d.c. attorneys. so my question is, what is his strategy here? now, we'll do the public hearing, but we don't want to do the deposition in part and maybe hand over information. you're looking for us. will that work. >> no, it's not going to work. bluster, bravado, intimidation . >> you know, a subpoena, sean, is in order. the law compels you to comply. you don't get to dictate terms. but as you say, hunter biden thinks he's special and above the law. so he's trying to avoid a deposition where tough questions by smart investigators who work for the committee members, they know the facts. they would confront hunter with the truth about his corrupt schemes. financial records don't in the committee. to their credit, his amassed volumes of evidence of bribery, money laundering, tax fraud, lobbying crimes. and look, if hunter biden lies under oath, that's even more crime. so that's the reason why he's demanding a public hearing, because he knows that probing questions are rare. members grandstand their speeches. but he also wants the usual biden sycophants like jamie raskin and dan goldman to portray him as this poor victim of drug addiction who should be forgiven of his crimes. but, you know, addiction is not an excuse under the law. so the committee, i think, absolutely right to reject hunter biden's demands. what is your take, matt whitaker? what is the strategy behind this, the legal strategy. okay, we want the public hearing, but we don't want to do that deposition part that you're insisting on. and i imagine that would probably be requesting of documents and other information. wouldn't that? >> yeah, it would be. and remember, lowell knows exactly what he's doing. he knows that the the weakest part of this case is if his client has to sit down for directed questioning from a counsel of the majority, can ask a line of questions and not be interrupted every 5 minutes by the rules of the committee. if it was public. and so, you know, this is just one part of their defense. obviously, they're still facing potential tax charges in california. there, the gun charges pending. and, you know, it's going to be very interesting as i look at this whole thing is, you know, chairman komar mentioned steve bannon. and that reminds me of peter navarro as well, who were held in contempt, who were by the doj. and so, you know, this is a high stakes game where, you know, if if they can't come to some agreement and he doesn't show up for that subpoena deposition, then he should be held in contempt and prosecuted by doj, just like everybody else has been. well, you're right. if we had equal justice in application of our laws if justice was blind, but we have, in my view, a weaponized department of justice. you know, god only knows what would happen. but i would tend to think hunter would not get the same treatment as bannon or navarro, in my view. let me let me ask you, greg. jared, as as as hunter now goes forward with this, and when we talk about all of this suspicious activity, reports, they have identified tens of millions of dollars in business that they can find no services rendered for all of this money. ten biden family members benefiting financially. then you have the very to me, the cut and dried case is the burisma case. hunter admits he has no experience in energy, but he's got two massive energy conglomerates, one in ukraine, one in china, paying him a fortune for what? at a time when he acknowledges he was addicted to drugs at a time he acknowledges he had no experience, why would they ever pay for a hunter that type of money? >> they wouldn't. it was an illegal quid pro quo . and the evidence is overwhelming, sean, that hunter sold his dad to the world china, russia, ukraine, romania, other countries over which joe biden exercised. >> he was bought and paid for, if you will, and family got enormously rich by selling out america in has to be the biggest bribery scandal in political history. 150 suspicious activity reports as you point out prove that tens of millions flowed to biden controlled shell companies then funneled the family members. devon archer confirmed they were selling influence and access to joey aided and abetted his son's schemes in. the burisma scandal conferring promising this in exchange for money. i mean, you don't have to show that joe biden pocketed, a penny is still a crime under the bribery statute. >> if cash goes to his family. and of course, bribery is also an impeachable offense, sean. >> yeah, you know, matt, it's not illegal to loan money, but there seems to be, as chairman coleman was pointing a lot of loans going on here. i would imagine that if a loan was made, there would be some record of it. if it wasn't down as a loan. certainly there's got to be a date, a time method of payment that would would back up that claim, right? >> yeah. not only that, you would expect a promissory note. it's the only way you could enforce that kind of debt ultimately. and you know, the other thing that i'm reminded of, if there's no interest, all these loans, if nobody's paying interest, they're paying principal back. that appears to be it just a cover up for these transactions. but remember, i think exhibit number one, that hunter biden needs to answer the question about is that text message that he sent his own daughter where he asked if, you know, she just should be happy that she doesn't have to give 50% to her own dad like hunter has to. and so i think that's you know, that's where the committee those types of questions are, why this deposition needs to happen on the 13th. well, i want to know if the $5 million loan was real, that was forgivable with no interest. i want know if that's the case and if it is the case that i want to request from both you, that you give me those terms and $5 million. i'm sure you would do that every day of the week. right. because the minute you gave it to me, i would say thank you for forgiving this. you're not getting paid back. i will see airwaves, there are tunnels underneath kids beds. when you go to a hospital and there are weapons in front of colorfully painted portraits in a children's hospital when the main military complex of hamas is underneath al-shifa hospital, it's ridiculous. israel is doing everything it can to avoid civilian deaths. but you are fighting terrorists here. it is insane. it is something that was not said to ukraine, by the way. i don't recall the admonitions. why didn't far to ukraine? we must condition the. we trusted our ally. and here we don't trust our ally. and it's sad to me, sean, because we are dealing with monsters. my month old, almost one-year-old son is upstairs in, a crib sleeping. but 11 month old fear b this is not in the hands of hamas anymore. no, he's been sold or handed off to another terrorist group alongside his four year old brother, erielle, and his mom, sherri, as his family desperately waits, desperately waits for any news. we dealing with monsters here. so don't media got into the lie that israel bombed out a hospital and killed 500 doctors, nurses and patients. they went with that lie. israel did not fire that rocket . that hospital wasn't even hit. it ended up being islamic hitting parking lot. that's a big problem. but now we know that in this this network of terror tunnels that they have, their command headquarters was under one of gaza's biggest hospitals. so we know what their strategy is, how israel seems to have done everything possible, warning people to go to be safe. and they the people that have kept them there, the hamas, has kept them there. so i don't know what else they can do, except they've got a war to win. they've got a country that needs to survive this show. and here's why i'm out with all this. hamas was begging for a cease fire. israel had deployed or deployed what's called a seal lockouts in hebrew. that's a pressure cooker campaign. israel brilliantly ruled it out over a period of a month, killing of hamas terrorists with extreme selectivity using their jetpack unit. they can call off a missile mid-flight if they see kid running across the street. >> but the fact is, is that hamas is warfare, has dictated and found its way into oval office and gotten into the head of president biden, who's gotten israel a bad deal. now, let me say this. israel wants its hostages back. >> they're going to do anything to get them back. but israel was on its way to finding out and figuring exactly where those hostages were. but the fact is, is that right now israel's in a bad deal. and what i mean by that is those hostages and this deal is in control of who? >> hamas. and that's a big no no in counterterrorism, sean. we don't like terrorists controlling the deal. and what that means is that the only way to get a better deal is to crank up that pressure and focus on the complete dismantling of hamas so that we will not see an october 7th massacre. repeat itself, which hamas has been very public about. but here's the problem, sean. the problem right now is that the deal negotiators are the same country that are harboring the leaders of hamas, qatar. and in my world, that's also a big no no. and that deal needs to get moved because right now there's only 30% of those hostages released and that's a problem. but i can assure you, if they crank up the operations the minute they crank up, hamas will start to cry. and if that doesn't work, sean, i can assure you that maybe it's time to start looking at some death sentences for some very high ranking hamas officials who are in israeli prisons because we know the leverage game very well. but unfortunately, president biden has put israel in a corner right now and the hamas opponent, the hard. but let me just address this because my mind agrees with everything that you're saying. this is giving hamas an opportunity to to gather fuel and munitions and reconfigure their their strategies, etc.. it makes them stronger militarily. it makes the war effort more difficult for israel. that's my mind. and probably you increase the chances that more hostages will be taken. my heart is very sympathetic to israeli families have lost loved ones that are being held hostage. and the idea that you three prisoners that are guilty of crimes and you exchange it for one innocent, even child or infant is fundamentally unfair. but, you know, i can sympathize with the families and with with prime minister netanyahu wanting at least try to get these people home safely. >> i understand sean and i don't represent the israeli government. there's things that i can say that they can't. i can. but i can assure you that i represent the israeli know how have been around this business for 20 years. and i believe that there's conversations that are being had right now. israel will do whatever it can to get its hostages back, and that's the reason why it's a bad deal. and what i mean by that, again, is that hamas is dictating the terms of releases. and the problem with these terms right now is that there's no leverage. >> and that's where i come out. and as soon as that as soon as that he gets cranked up on israel or a death sentence or two. sean handed out to a couple of top hamas leaders. let me tell you that little green bandana that hamas proudly wore when they were massacring the israelis and kibbutz is in the south will hit it the great red versus blue state debate. they'll compare their records, states, their governing philosophies and much more. i think it'll be a good exchange. i hope so. of ideas that, you know, we will anyway be revealing a lot about country and this future. we've never been more divided than we are now, and i don't think you're going to want to miss it. here now with a preview of the big event. chairman of the harris poll, mark penn, and former arkansas governor mike huckabee is with us. all right. mark penn, let's just examine from a political point of view. you're a pollster. you worked with the clintons for years. from a political point of view ,do you think? i would argue that both are putting themselves in the arena. they both put themselves in the octagon here. i think they're both willing to take a risk to do it. and i think it's healthy for the country. that's my. take your take. yeah, definitely. look, i think this is a high risk event for everybody involved. i think ron desantis expected to be much in the presidential race against donald trump. so this has now turned into something that might have been risky where he has everything to lose, where maybe if he pulls off a great debate here and defends his record, he'll actually come up a few points in the presidential race. newsom he doesn't have much to lose here. he's not expecting to get fox voters to vote for him. no matter what. on the other hand, if he can say ron desantis, that's going to put him in a great position in the presidential bullpen, which is really what he's interested in getting. you know, we talk an awful lot ,governor huckabee, about joe biden being weak and frail and a cognitive. it has to be viewed as a reality that maybe come november of next year that joe biden's not going to be on the ticket as the presidential candidate for the democrats. >> do you agree with that? yeah, i and i think mark had a great point. this is a terrific opportunity for gavin newsom. it is risky for desantis. but i also want to say kudos to gavin newsom. this is a bold move on his part to come to the sean hannity show. i mean, heck, a lot of us who are republicans are afraid to come on your. >> and here's gavin newsom showing up. so i think it's just not exactly his credit. yeah, well, it is to his credit that he's willing to do it, because a lot of people simply would say, i don't think i'm going to be treated fairly. i think he will treat him fairly. for desantis, he needs the boost he needs to be able to show that he can get on this kind of stage because he hasn't been on a stage yet in the debates in. he just walked away with it. so his numbers have not moved. they've, if anything, declined since he first got in. he needs a boost and especially with nikki haley now getting the nod from a lot of the mega-donors which frankly may be more helpful to ron desantis than hurtful. i think it's a great opportunity for both of. >> you know, governor, tell me if you think my thinking is right on this, because going into this, as i have been preparing for this debate and reading volumes and volumes of material background positions, etc., looking at their records, you know what really fundamentally, i don't think a lot of the questions will be that big a surprise, because my mindset is on the fact that states have an even bigger impact on people's everyday and their policies can have an impact on people's everyday lives. anything else? and you're looking at two diametrically are to two opposite political points of view here, two different governing philosophies. i don't think they can be any more different. and they also seem to i don't know if it's real or not, but they really seem to like each other very much. but i really want to know, you know, which policies worked best for people. you were once a governor. >> what would you like to hear in this debate? well, i think they both need to explain their philosophy of government. what is the role of government? they come at it from a very different point of view. our founders had this brilliant idea called federalism, in which the states would be the laboratories of democracy. we would find out what and what doesn't. we wouldn't make a national mistake and subject to all the states now, 50 of them to a disaster and a washington centered government is a disaster. a state centered government is really workable and quite desirable. we can learn from democrats, those of us who are republican and democrats can learn from the republicans. if there's an idea that actually is pragmatic and works. and that's how it's been working in the states, i think that's a great opportunity for these two governors to sell their ideas, to sell their point of view and their philosophy of government. >> well, and mark, it couldn't be any different. >> there are their issues and their philosophy on taxes, on immigration, on energy based law and order. i mean, they really you can't have more different governing philosophies, in my view. what would you like to hear? well, and yet they both got reelected in their state. look, i think, sean, you have an incredible opportun ity to bring america back to real substantive. i think america that i go back whenever i feel blue about politics. i go watch the kennedy nixon debates, and they were incredible debates about real policies. i think you have an opportunity, whether it's on tax, whether it's on funding, whether car, whether it's how you run, and what you do with big cities. you have an incredible opportunity to educate america. i think this is going to be great tv. well, in spite i don't know i wrote gavin in a text, in spite of having his team claiming over and over again it's going to be two on one, maybe even three on one. i'm like three. there's only going to be three of us in the room. the reality is, i'm not debating. i'll be asking the questions. they get a chance to exchange the idea. so hopefully has mostly impacted children. and concerns are now growing that it is starting to spread. now, the corrupt, dishonest world health organization says they are monitoring the situation, but they will be basically the propaganda mouthpiece china during covid. and they're also saying that china has not any new or unusual pathogens anyway. they're bringing back social distancing and everybody's wearing a mask. again, back. anyway, joining us now, fox news contributor dr. nicole saphier. so, well, number one, this is very different in as much as it seems to be impacting children more than adults, at least in this stage. but when you see these images of all of these people in beijing back in masks, social distancing protocols, i'm thinking, here we go again. what are your initial thoughts ,dr. sapphire? >> well, sean, i think every parent across the world right now can tell you there's an uptick in respiratory viruses and viral and respiratory infections everywhere, certainly in the united states. what we're seeing, china since mid-october, there have been reports of increased respiratory. and about two weeks ago, china did confirm they are having clusters of pediatric or cases of pneumonia or pneumonia in kids. and so the world health organization and promed is the disease surveillance system came forth and said, listen, china, seeing as things didn't go so well with covid 19, we believe that you're telling us that it's the usual pathogens, adenovirus rhinovirus and even mycoplasma. but we some proof. and so the next day, china did put forth the data, showed that the cultures from many of these children's we're kind of the usual suspects we see every single year. when specifically is mycoplasma, pneumonia. now that is a bacterial infection, which is different than the other infections like and flu, which are viruses but aren't mycoplasma. pneumonia actually something very common. we see it here in the united states. and while the world health organization and china are saying that these rise in infections and pneumonia cases are from something called an immunity dip or immunity gap, meaning because kids were shielded from a lot of things because of the lockdowns, they didn't get exposed to normal pathogens. so their immune system's down, which is why they're having, you know, maybe more severe illness. we certainly saw that here in the united states last year with, flu with strep throat. >> but also on top of that, sean, there is a normal ebb and flow when it comes to mycoplasma pneumonia cases, especially in kids. in fact, the last time we saw a lot of those cases here in the united states was 2019. before that, 1215. so we're kind of in a normal pattern for that as well. the good news is, sean, i don't think there's cause for panic, not cause for alarm. i think this is all kind of the normal cyclical infections that we're going to see. but again, we. let me ask you this question. china, world health organization and why why are they racing towards masking and social distancing? >> well, sean, you have to remember that china and other asian countries masking for the general population is something that they did before covid 19. they did it even before stars. that is something that is within their population here in the united states showed that mask mandates didn't necessarily have an effect on community hospitalizations and even deaths. so what one country does, it doesn't necessarily equate to what another one should do. and we know that keeping children and people away from being out society decreases their immune systems and also decreases. socialization has horrible consequences on our economy. >> all right. dr. nicole saphier, we'll be watching closely. i don't trust china or the w.h.o.. appreciate your
