Share Via Email | A+A A- By Express News Service KOCHI: National Cadet Corps (NCC) on Tuesday approached the Kerala High Court challenging a single-judge order allowing Hina Haneefa, a transwoman and a degree student of Thiruvananthapuram University College, to join the corps.The NCC said the single judge failed to consider the extraordinary and peculiar practical issues. The court also did not consider the preferences of the girl cadets on being faced with the need of community life with a transgender, who has got totally different physical and psychological factors, it said. ....
Sreerag, through his counsel Advocate K Arjun Venugopal asserts in his appeal that Haneefa should be admitted only under the category of transgender or third gender. To allow the entry of the petitioner to the corps on par with biological girls would be grossly unfair, the appellant contended. In Court today, the Division Bench questioned the appellant s interest in the matter and pointed out that the NCC was yet to file an appeal in the case. At this, the counsel for NCC, Central Government Counsel NS Daya Sindhu Shree Hari informed the Court that the NCC would also be filing an appeal. ....
High court of Kerala KOCHI: Ordering for allowing a transgender to join National Cadet Corps (NCC), the high court has directed for amending the law to include transgenders in NCC. Justice Anu Sivaraman issued the directive after considering a petition filed by Hina Haneefa, a student of University College in Thiruvananthapuram. The court said the fact that NCC Act does not recognize the third gender or that detailed guidelines are to be introduced for the integration of persons of third gender into NCC cannot be a justification for denying entry for the petitioner. Ruling that denial of enrolment to NCC is unsustainable, the court said the petitioner is entitled to participate in the selection process and to be enrolled in NCC if she is successful. ....

A bench of Justice Anu Sivaraman noted that the Transgender Persons (Protection of Rights) Act, 2019, recognises their right to a life of dignity, and prohibits discrimination. The provisions of the National Cadet Corps Act, therefore, cannot preclude the operation of the Transgender Rights Act, 2019, it said. ....
