JOHNSTOWN A Fulton County official on Tuesday provided a legislative committee an overview of New York state’s newly-enacted Marihuana Regulation & Taxation Act (MRTA).
County Director of Community Services Ernest Gagnon gave a presentation to the Board of Supervisors’ Human Services Committee at the County Office Building.
“This is a view from 10,000 feet,” Gagnon said.
He provided the committee with information about the new law. He noted that on March 27, state legislative leaders and Gov. Andrew Cuomo announced a deal to legalize adult-use cannabis and create a consolidated state Office of Cannabis Management. The OCM would be established within the state Liquor ....

On March 31, 2021, Gov. Andrew Cuomo signed the Marihuana Regulation and Taxation Act (MRTA), legalizing the recreational use of cannabis in New York State for individuals age 21 or older. While the New York City Council enacted legislation on May 10, 2020, prohibiting many private employers from conducting pre-hire marijuana testing as a condition of employment, the MRTA expands protections for off-duty cannabis use across New York State.
Trailblazing New Protections
Effective immediately, New York State employers are prohibited from refusing to hire, terminating or otherwise taking adverse action against applicants and employees for off-duty recreational cannabis use in most circumstances.
