Illinois legislature votes to end cash bail


The Illinois legislature of Representatives passed a bill spearheaded by the Illinois Legislative Black Caucus last Wednesday that would end cash bail.
The Pretrial Fairness Act, which gives Illinois until Jan. 1, 2023 to abolish cash bail, currently awaits Gov. J.B. Pritzker’s signature. Pritzker has expressed support for the bill in the past. If passed, Illinois will be the first state in the nation to end all cash bail.
Evanston mayoral candidate Sebastian Nalls, 20, said ending cash bail is a step in the right direction.
“This is an issue that hits directly at home for a lot of us,” Nalls said. “And it’s been disproportionately affecting Black and brown members of Illinois and members of the nation as a whole.” ....

New bill could eliminate the cash bail system in Illinois, among other reforms


A new Illinois bill, titled HB 3653, was recently passed by the Illinois General Assembly. It aims to reform the criminal justice system by abolishing cash bail by 2023 — through the Pretrial Fairness Act — among other changes. It is now up to Illinois Gov. J.B. Pritzker to sign it into law. 
 
With these changes in effect, court judges would be unable to detain most people. According to the bill, “detention only shall be imposed when it is determined that the defendant poses a danger to a specific, identifiable person or persons, or has a high likelihood of willful flight.”

Elimination of cash bond passes Illinois legislature

State Sen. Kimberly Lightford (D-4th District) voted along with the majority (32-23) to pass the Pretrial Fairness Act (HB3653) at 4:49 a.m. on Jan. 13. HB3653 was introduced by the Legislative Black Caucus of which Rep. Emanuel "Chris" Welch (D-7th District), now the House Speaker, is a member. The bill was passed on to the Assembly which approved the 764-page piece of legislation later in the morning. ....

As a senior case worker at Labyrinth, YWCA McLean County’s transitional housing program for formerly incarcerated women, Vera Traver has witnessed the devastating effects of cash bail.
But she’s also lived them as a formerly incarcerated woman herself.
Traver said she spent six months in jail, held on a $100 bond. While that may not seem like much, she didn’t have a job back then, making $100 hard to come by.
The experience still has an impact on her self-esteem. “It made me feel like I’m not even worth $100,” she said. “Sometimes even to this day, I have to remind myself that I am priceless.” ....
