Hirsch v. USHealth Advisors, LLC, Judge Pittman, of the United States District Court for the Northern District of Texas, denied Aaron Hirsch’s (“Plaintiff”) Motion for Class Certification, which was based on allegations that USHealth Advisors, LLC (“USHA”) and USHealth Group, Inc. (“USGA”) (collectively “Defendants”) violated the Telephone Consumer Protection Act and Maryland equivalent of the Telephone Consumer Protection Act. In doing so, the Court put a dent in claims where professional plaintiffs seek to profit off the TCPA.
In that case, Plaintiff developed a plan to “profit through the TCPA.” When Plaintiff was called by a lead-generation vendor, Plaintiff, on multiple occasions, stated he was interested in buying health insurance (although he was not), scheduled a phone call with a USHA agent, and, after receiving the call from the USHA agent, asked to be placed on the internal do not call list. Throughout 2020 we saw many enforcement actions brought by EU and U.S. regulators. Whether for allegations of deception (misleading privacy representations) or unfairness (failure to protect information), COVID did not appear to slow down regulatory action. Laws that many companies forget about -or don’t know as well- were enforced by regulators, as well as through class action lawsuits. This included the Children’s Online Privacy Protection Act, Illinois’s Biometric Information Privacy Act, and the Telephone Consumer Protection Act.
There are other laws that create a patchwork of requirements for organizations. They range from laws based on the type of entity (HIPAA, GLBA), to those that regulate the activities in which the entity engages (CAN-SPAM, TCPA), and laws designed to protect individuals from whom the company is collecting information (COPPA, FERPA). ....

FCC Policy
The FCC is seeking comment on its proposal to implement the “voluntarily share” clause of the Telephone Robocall Abuse Criminal Enforcement and Deterrence (TRACED) Act by establishing an online web portal for submitting anonymous tips on alleged robocalls. Pursuant to statutory language, only “private entities”, which the FCC tentatively defines as non-governmental entities, may use the portal. The Enforcement Bureau would monitor the portal, but the existing complaint process managed by the Consumer and Governmental Affairs Bureau will remain in place. Comments and Reply Comments are due 30 and 45 days after Federal Register publication, respectively. ....
